Pursuant to the provisions of the Zoning Ordinance of the County of Butte and `the special conditions set forth below: Ernest Rissler is hereby granted a Use Permit for the establishment of an auto repair shop. The majority of the operation will occur within the exiting 6,000 square foot building. An incidental portion of the business will require occasional spot welding that shall occur outside the structure. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval.. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee consistent with conditions of approval herein, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of. the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed .one year. Upon application, and for good cause by .the Permittee, at a public hearing pursuant to Section 24- 45.25- above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Page 1 of 3 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of. Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. Prior to issuance of any permit on the project site, pay any outstanding project -related processing fees. 2. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 3. The number of employees shall be limited to three (including the owner), unless a signed agreement with the other business located on site to allow additional employees. Public Works 4. Prior to establishing use, obtain an encroachment permit and improve all new and existing driveway approaches to publicly maintained roads as specified in the county improvement standards and the terms of the encroachment permit. Environmental Health Division 5. Maximum quantities of hazardous materials handled at the business shall be, below minimum thresholds for Hazardous Materials Release Response Plan (HMRRP) program requirements: a. Liquid — 55 gallons b. Solid — 500 pounds c. Compressed Gas (inert gases excepted) — 200 cubic feet at standard temperature and pressure. These thresholds are for individual hazardous materials, not aggregate quantities of similar materials. It is possible that inert gasses (i.e. argon) used in TIG or MIG welding will exceed thresholds, but are of much less concern from a public health and safety perspective. 6. Meet Environmental Health requirements for businesses that handle hazardous waste, including compliance with Hazardous Waste Generator programs as applicable. 7. Maximum number of employees for, all businesses on property is limited by capacity of the onsite wastewater treatment system. Ten (10) employees is the current maximum for the property unless available useable wastewater dispersal area is evaluated and determined to be adequate to allow expansion of the existing system. 8. Provide connection to an approved water supply. Building Division 9. Building/Tenant Improvement permit is required for the change in use of the existing building. Standard commercial plan requirements for permit application include 3 site plans and 3 sets of construction plans (floor plan, electrical, plumbing, mechanical and elevations) with construction Page 2 of 3 / details and additional details unique to the use and occupancy of the tenant improvement. Plans and design prepared by a California Registered Design Professional for all structural improvements shall be required. In addition, 2 Certificates of Energy Compliance (title 24 energy) accessibility upgrades and details shall be included with the construction plans. 10. A separate permit for fire suppression system with 3 sets of plans prepared by a California Contractor, license Classification C-16 plans shall be required as determined by Code Analysis. 11. Plans and Code Analysis shall be completed by California Registered Design Professional South Feather Water and Power Agency 10. Applicant shall comply with South Feather Water and Power Agency's rules and regulations governing water service. CalTrans 12. An encroachment permit will be required by Caltrans prior to any work conducted in, or if any monument signs are proposed in or adjacent to, the State's highway right-of-way. An incidental portion of the business will require occasional spot welding that shall occur outside the structure. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 3. The number of employees shall be limited to three (including the owner), unless a signed agreement with the other business located on site to allow additional employees. Public Works 4. Prior to establishing use, obtain an encroachment permit and improve all new and existing driveway approaches to publicly maintained roads as specified in the county improvement standards and the terms of the encroachment permit. Environmental Health Division 5. Maximum quantities of hazardous materials handled at the business shall be below minimum thresholds for Hazardous Materials Release Response Plan (HMR -RP) program requirements: a. Liquid — 55 gallons b. Solid — 500 pounds c. Compressed Gas (inert gases excepted) — 200 cubic feet at standard temperature and pressure. These thresholds are for individual hazardous materials, not aggregate quantities of similar materials. It is possible that inert gasses (i.e. argon) used in TIG or MIG welding will exceed thresholds, but are of much less concern from a public health and safety perspective. 6. Meet Environmental Health requirements for businesses that handle hazardous waste, including compliance with Hazardous Waste Generator programs as applicable. 7. Maximum number of employees for all businesses on property is limited by capacity of the onsite wastewater treatment system. Ten (10) employees is the current maximum for the property unless available useable wastewater dispersal area is evaluated and determined to be adequate to allow expansion of the existing system. 8. The proposed use is required to connect to SFWPA. • The proposed auto repair business will be located in the building along the southern property boundary. • A hardware store was originally located on the site. • Vegetation is limited to two trees. • Elevation is approximately 850 feet above sea level. • The property generally drains via sheet flow and a seasonal drainage way to the northwest. • The project parcel is not located within a 100 -year flood zone, an earthquake zone, or an airport compatibility zone. Auto repair and service requires one (1) space for each four hundred (400) square feet of gross floor area, but in no case less than six (6) spaces. The project site has adequate area for fifteen parking spaces (6,000 s.f. / 400 s.f. = 15 parking spaces). • Butte County Code Section 24-45.10 specifies the criteria for granting a,use permit. "The planning commission, on the basis of the evidence submitted at the hearing, may grant use permits required by the provisions of this chapter when it finds that the proposed uses of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the county. The proposed auto repair shop, to be located within an existing building, will not impair the integrity and character of the zone in which the land lies, and the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County as supported by the following: 1. The C-1 zone conditionally allows an auto repair shop with issuance of a Use Permit. 2. The proposed use, which will be located within an existing building, is not unreasonably incompatible with, or injurious to, surrounding properties and uses. The project parcel is located on the corner of State Highway 162 and Old Olive Highway (a county -maintained paved road). No road or frontage improvements are required. Since no new structures or road improvements are required, the project would not create physical impacts that would affect the neighborhood. The project would not introduce significant additional traffic to the area, as compared to traffic for allowed uses in the existing zone. The proposed auto repair shop will generate similar or less traffic, than a typical light commercial retail use. 3. The existing location, size, and design of the use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. B. The location, size, design, and operating characteristics of the proposed use will 'be compatible with, and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The proposed use will be located within the existing 6, 000 square foot building. Only limited welding incidental to the auto repair will occur outdoors. The site is also developed with another commercial building (approximately 9,415 square feet) and a couple of accessory buildings. The existing buildings are consistent and comparable with retail commercial buildings in the surrounding area. 2. The availability of public facilities, services and utilities No additional public services are needed to accommodate this project. The project will be served by public water (South Feather Water and Power Agency) and an existing on site waste water system (septic). 3. The harmful effect, if any, upon desirable neighborhood character: The project site is located in a commercial zone on the corner of State Highway 162 and Old Olive Highway, a county -maintained paved road. The proposed auto repair shop will generate similar or less traffic, than a typical light commercial retail use allowed by right in the C-1 zone. 4. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed use permit application to County agencies and has received responses that indicated there is no evidence that the use, with appropriate conditions, would cause any other relevant project -related impact. The project -related impacts appear to be minor in general, assuming all conditions are dutifully executed. ENVIRONMENTAL REVIEW/CEQA ISSUES • The project site is previously developed and located in an area zoned for commercial use. • The proposed use of an auto repair shop would be consistent with surrounding uses and would not generate noise, dust, or traffic that would create a significant effect on the environment. • This project has been determined to be exempt from the California Environmental Quality Act (CEQA) provisions under Categorical Exemption 15303 New Construction or Conversion of small structures (c) A store, motel, office, restaurant or similar structure not involving the use of significant amounts of hazardous substances and not exceeding 2,500 square feet in floor area. In urbanized areas, the exemption also applies to up to four such commercial buildings not exceeding 10,000 square feet in floor area on sites zoned for such use, if not involving the use of significant amounts of hazardous substances where all necessary public services and facilities are available and the surrounding area is not environmentally sensitive. The project site is located in the Oroville Urban Area and is within the City of Oroville's Sphere of Influence. The proposed use would be located within an existing 6,000 square foot building. The auto repair shop would have the following substances (and average quantities) located on site: • Automotive Engine Oil — 5 gallons • Diesel Engine Oil — 25 gallons • Transmission Fluid — 5 gallons • Mineral Spirits — 10 gallons • Antifreeze & Coolant — 50 gallons in bulk and will be recycled • Compressed Gas (inert gases excepted) — up to 200 cubic feet (at standard temperature and pressure) The types of substances were reviewed by the Butte County Environmental Health Division and were determined to be relatively low quantities of common hazardous materials, none of which present a high hazard characteristic. The site was previously developed and paved for the commercial use on site (Ace Hardware). No onsite or offsite disturbance is proposed, or necessary. Per the California Natural Diversity Data Base (CNDDB), there are no identified sensitive species within 1.8 miles of the site. The project will not impact any onsite or offsite environmentally sensitive areas. The proposed use will be required to be served by public water (South Feather Water and Power Agency). An existing hook-up is located at the entrance off of Old Olive Highway. Butte County Environmental Health Division determined there is sufficient area onsite for wastewater disposal. All necessary public services and facilities are available to the project. The project site is located in an area zoned for commercial use. The proposed use will operate within an existing structure. Only limited welding incidental to the auto repair will occur outdoors. The site was previously developed and paved for the commercial use on site (Ace Hardware). No onsite or offsite disturbance is proposed, or necessary. Per the California Natural Diversity Data Base (CNDDB) there are no identified sensitive species within 1.8 miles of the site. The project will not impact any onsite or offsite environmentally sensitive areas. II. Finds that the collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required based on the determination the project is categorically exempt. III. Approves Use Permit UP12-0004 for Ernest Rissler, subject to the conditions found in Exhibit "A" and the following findings: A. The proposed auto repair shop, to be located within an existing building, will not impair the integrity and character of the zone in which the land lies, and the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County as supported by the following: 1. The C-1 zone conditionally allows an auto repair shop with issuance of a Use Permit. 2. The proposed use, which will be located within an existing building, is not unreasonably incompatible with, or injurious to, surrounding properties and uses. The project parcel is located on the corner of State Highway 162 and Old Olive Highway (a county -maintained paved road). No road or frontage improvements are required. Since no new structures or road improvements are required, the project would not create physical impacts that would affect the neighborhood. The project would not introduce significant additional traffic to the area, as compared to traffic for allowed uses in the existing zone. The proposed auto repair shop will generate similar or less traffic, than a typical light commercial retail use. 3. The existing location, size, and design of the use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. B. The location, size, design, and operating characteristics of the proposed use will be compatible with, and will not adversely affect, or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The proposed use will be located within the existing 6, 000 square foot building. Only limited welding incidental to the auto repair will occur outdoors. The site is also developed with another commercial building (approximately 9,300 square feet) and a couple of accessory buildings. The harmful effect, if any, upon desirable neighborhood character: The project site is located in a commercial zone on the corner of State Highway 162 and Old Olive Highway (county -maintained paved road). The proposed auto repair shop will generate similar, or less traffic, than a typical light commercial retail use allowed by right in the C-1 zone. 4. The suitability of the site for the type and intensity of use or proposed development: The site is suited for the project because the property is 'large enough (1.76 acres), has access to a county -maintained road, adequate area for circulation and parking. It has been determined by Butte County Environmental Health that there is adequate waste water disposal for the proposed auto repair shop and the proposed furniture maker and retail sales in the 9,415 square foot existing building. 5. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed use permit application to County agencies and has received responses that indicated there is no evidence that the use, with appropriate conditions, would cause any other relevant project -related impact. The project -related impacts appear to be minor in general, assuming all conditions are dutifully executed. C. The design and improvements of the proposed use are consistent with County standards and policies provided all conditions of project approval are complied with. D. The design and improvements of the project will not cause public health or safety problems because the project site does not contain any physical characteristics that could cause health or safety concerns with the required mitigations and conditions. E. The project site is not.located within an earthquake fault zone. ; F. The project would not have an impact to any aircraft operations because the project site is not located within an Airport Compatibility Zone. G. Approval of this project will not be detrimental to the public health, safety, and welfare provided the required conditions are complied with. H. The project is consistent with the Retail and Office General Plan land use designation. I. Maximum quantities of hazardous materials handled at the business shall be below minimum thresholds for Hazardous Materials Release Response Plan (1 MRRP) program requirements: a. Liquid — 55 gallons b. Solid — 500 pounds c. Compressed Gas (inert gases excepted) — 200 cubic feet at standard temperature and pressure. These thresholds are for individual hazardous materials, not aggregate quantities of similar materials. It is possible that inert gasses (i.e. argon) used in TIG or MIG welding will exceed thresholds, but are of much less concern from a public health and safety perspective. 6. Meet Environmental Health requirements for businesses that handle hazardous waste, including compliance with Hazardous Waste Generator programs as applicable. 7.
