USE PERMIT BUTTE COUNTY PLANNING COMMISSION February 28, 2013 DATE: UP13-0002 PERMIT NO. 039-610-029 ASSESSOR'S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Verizon is hereby granted a Use Permit for the development of a 130' tall monopole wireless communication tower, with 9 antennae and one microwave dish, prefabricated Equipment Shelter (192 SF), a back-up generator on a 6' x 13' concrete pad. The facility footprint, not including easements, will be 1,400 SF. 1. Failure to comply with the conditions specified herein as the basis for approval of this Use Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Code, Chapter 24, Article 34, Section 251 Permit Revocation or Modification. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this Use Permit must be established within 24 months of the delivery of the countersigned permit to the Permittee, or as provided by BCC Chapter 24, Article 34, Section 247 Time Limits and Extensions. 3. Minor changes as provided by BCC Chapter 24, Article 34, Section 26 C, may be approved administratively by the Zoning Administrator upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Terms of Approval (BCC Chapter 24, Article 26, Section 24-185) A. Permits for telecommunication facilities issued under this article shall be valid 10 years, unless this term is changed through the permitting process. Page 1 of 6 0 1 W B. A permit granted under this article becomes invalid if an operator of a telecommunication facility ceases to operate the facility under the terms of this article or under the specific conditions of approval for the facility. If the facility becomes non-compliant, the owner shall cease to operate the facility and remove it from its location within 90 days of being informed that the permit has become invalid. C. All permits for telecommunication facilities, regardless of the method by which they were originally issued, may be extended administratively by the Zoning Administrator upon verification of the permit -holder's continued compliance with the findings and conditions of approval under which the application was originally approved. The Zoning Administrator may require a public hearing for renewal of a Conditional Use Permit for a telecommunication facility. D. As part of the permit renewal process, the Zoning Administrator may require submittal of a certification by a licensed professional that the facility is being operated in accordance with all applicable FCC standards for RF emissions. . Page 2 of 6 • Conditions of Approval: Planning Division i Mitigation Measure #1: To avoid creating substantial glare, the monopole and equipment attached thereto shall be constructed of, or treated with, a flat finish material with a low light reflectivity value. The pole shall be painted form a height of 10 feet above the ground to the top of the facility with alternating aviation orange and white stripes, unless the applicant can demonstrate that such measures are not required to ensure compatibility with established air navigation practices in the immediate area. Prior to issuance of a building permit, the applicant shall submit sample color chips to the Planning Division for review and approval. Any painted surfaces are to be maintained during the life of this project. Plan Requirements: The note shall be placed on all building and site development plans. Timing: Requirements of the condition shall be adhered to throughout the life of the project. Monitoring: Department of Development Services shall ensure that this note is placed on all building and site development plans. Prior to issuance of a building permit, the applicant shall submit sample color chips to the Planning Division for review and approval. Building inspectors shall spot check and shall ensure compliance on-site. 2. Mitigation Measure #2: The motion sensor lighting shall be fully shielded and directed downward so as to not create any glare or excess light on adjacent parcels. Plan Requirements: Building and site development plans shall indicate that all exterior lighting, other than required obstruction lighting for the tower, shall be fully shielded and directed downwards. Timing: The requirements of this measure shall be adhered to at all times. Monitoring: Department of Development Services staff shall conduct a field inspection prior to use of the facility to verify that all exterior lights meet the requirements of this mitigation measure. Building inspectors shall check and ensure compliance on-site. 3. Mitigation Measure #3: Obstruction marking and lighting, consistent with the requirements (limited to marking and lighting design only) of U.S. Department of Transportation Federal Aviation Administration Advisory Circular AC70/7460-1K, is required at the top of the tower, and shall have a flashing or steady burning light that is shielded from the ground to prevent visual impacts, unless the applicant can demonstrate that such measures are not required to ensure compatibility with established air navigation practices in the immediate area. Plan Requirements: Building and site development plans shall indicate the type of lighting proposed. Timing: The requirements of this measure shall be adhered to at all times. Monitoring: Department of Development Services, as needed, shall conduct a field inspection to verify that the lighting is consistent with approved type. Page 3 of 6 • 0 4. Mitigation Measure #4: The proposed tower shall be consistent with the following NAAA Tower Safety Guideline: - The proposed tower is constructed on prime agricultural land and should be freestanding without guy wires. Furthermore, if determined to be necessary, the tower should be lit and well -marked so they are clearly visible to aerial applicators. Plan Requirements: The building plans shall identify the required design features required per this mitigation. Timing: The requirements of this measure shall be required prior to development. Monitoring: Department of Development Services shall review building plans to make sure tower satisfies the above requirement. 5. Mitigation Measure #5: Dust generated by the development activities shall be kept to a minimum with a goal of retaining dust on the site. Follow the dust control measures listed below: a. Water shall be applied by means of truck(s), hoses, and/or sprinklers as needed prior to any land clearing or earth movement to minimize dust emissions. b. Haul vehicles transporting soil into or out of the property shall be covered. c. A water truck shall be on site at all times during development activities. Water shall be applied to disturbed areas a minimum of two (2) times per day or more as necessary. d. On-site construction vehicles shall be limited to a speed of 15 mph on unpaved roads. e. Post a publicly visible sign with the telephone number and person to contact regarding dust complaints. This person shall respond and take corrective action within 24 hours. The telephone number of the Butte County Air Quality Management District shall be visible to ensure compliance with BCAQMD Rule 200 & 205 (Nuisance and Fugitive Dust Emissions). f. All visibly dry disturbed soil surface areas of operation shall be watered to minimize dust emissions. g. Existing roads and street adjacent to the project shall be cleaned at least once per day if dirt or mud from .the project site has been tracked onto these roadways, unless conditions warrant a greater frequency. Plan Requirements: The note shall be placed on all building and site development plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: Department of Development Services shall ensure that this note is placed on all building and site development plans. Building inspectors shall spot check and shall ensure compliance on-site. Butte. County Air Quality Management District inspectors shall respond to nuisance complaints. Page 4 of 6 6. Mitigation Measure #6: Should development activities reveal the presence of cultural resources (i.e., artifact concentrations, including arrowheads and other stone tools or chipping debris, cans, glass, etc.; structural remains; human skeletal remains), work within 50 feet of the find shall cease immediately until a qualified professional archaeologist can be consulted to evaluate the resource and implement appropriate mitigation procedures. Should human skeletal remains be encountered, State law requires immediate notification of the County Coroner. Should the County Coroner determine that such remains are in an archaeological context, the Native American Heritage Commission in Sacramento shall be notified immediately, pursuant to State law, to arrange for Native American participation in determining the disposition of such remains. Plan Requirements: This note shall be placed on all building and site development plans. Timing: This measure shall be implemented during all site development activities. Monitoring: The applicant/developer shall notify the Planning Division if any cultural resources are uncovered. Should cultural resources be discovered, the Planning Division shall coordinate with the developer and appropriate authorities to avoid damage to cultural resources and determine appropriate action. 7. The telecommunication facilities shall comply with the applicable requirements under Butte County Code Sections 24-181, 24-182, 24-186 and 24-187. Public Works 8. Prior to establishing use, obtain an encroachment permit and improve all new and existing driveway approaches to publicly maintained roads as specified in the county improvement standards and the terms of the encroachment permit. Prior to constructing facilities into, under, over, above, or upon any public street in the unincorporated area of the county, obtain an encroachment permit from the Butte County Public Works Department. Submittal of improvement plans for review and approval by the Public Works Department may be required depending on the facilities proposed. Processing Fees 9. Prior to issuance of the Use Permit, pay any outstanding project -related processing fees. County Counsel 10. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. I hereby declare under penalty of perjury that I have read the foregoing conditions that they are in fact the conditions which were imposed upon the granting of this Minor Use Permit, and that I agree to abide fully by said conditions. Chico, CA This is a proposed 35' X 40' fenced Wireless installation consisting of a 130' Monopole and a 12'x 16' shelter located within the fenced enclosure. The Shelter will haveam— at4E-�- room. One room inside is a 12'x16' area for Verizon's radio equipment and the other 9'-6" x 12' space is for Verizon's 48kw standby generator that will operate if all power goes down to the site. There will be 9ea antennas mounted at the 126' AGL that are 99"long x12" wide x 8" deep. The entire installation is placed inside the proposed lease space and is situated on the parcel near the N/West corner by 7 rows of trees at approximately 155' from the edge of the current pavement along Meridian Road and approximately 164' from the edge of the pavement along Sacramento, Ave. The proposed site is needed to fulfill serious capacity and connectivity failures to the Agricultural community, to travelers along the main roadways leading to the river front recreational lands feeding from the Hwy 32 east to west directions connecting into Chico's main site coverage grid. These sites are an unmanned facility and fully monitored by a 24 hour NOCC that provides 26 sets of specific notification alarms IE Smoke, Fire, High Heat, A/C unit, Entry, failure etc. back to a main NOCC that is constantly monitored by a live attendant. Indicate the type of land use (residential, commercial, etc.), intensity of land use (one -family, apartment houses, shops, department stores, etc.), and scale of development (height, frontage, set -back, rear yard, etc.). As stated above the existing parcel is a privately owned Agricultural farm that has fruit trees as a main crop. On the parcel is the Main home that is approximately 28' in height and a Barn shop building located to the North of the main home that is approximately 20' in height. The CUP authorizes a 130 -foot tall monopole wireless communication tower with 9 antennae and one microwave dish, a prefabricated equipment shelter; a 506 -gallon, and a back-up diesel generator on a 6 - foot x 13 -foot concrete pad in the AG -80 (Agriculture — 80 acre minimum) zone. .You have indicated your concern regarding conditions of approval to the CUP: General Condition No. 6 pertaining to terms of approval and Condition No. 3 (Mitigation Measure No. 3) pertaining to obstruction marking and lighting. To address your concerns, this determination provides a formal interpretation of the. Zoning Ordinance pursuant to Article 2 (§24-6 et seq.) of the Ordinance and a minor modification pursuant to §24-246, Changes to an Approved Project. General Condition No. 6: General Condition No. 6 pertains to the terms of approval of the CUP and reads as follows: 6. Terms of Approval (BCC Chapter 24, Article 26, Section 24-185) A. Permits for telecommunication facilities issued under this article shall be valid 10 years, unless this term is.changed through the permitting process. B. A permit granted under this article becomes invalid if an operator of a telecommunication facility ceases to operate the facility under the terms of this article or under the specific conditions of approval for the facility. If the facility, becomes no the owner shall cease to operate the. facility and remove it from its location within 90 days of being informed that the permit has become invalid. C. All permits for telecommunication facilities, regardless of the method by which they were originally issued, may be extended administratively by the Zoning Administrator upon verification of the permit -holder's continued compliance with the findings and conditions of approval under which the application was originally approved. The Zoning Administrator may require a public hearing for renewal of a Conditional Use Permit for a telecommunication facility. D. As part of the permit renewal process, the Zoning Administrator may require submittal of a certification by a licensed professional that the facility is being operated in accordance with all applicable FCC standards for RF emissions. A CUP is a discretionary entitlement granted for a development project that may not be revoked or substantively modified in an arbitrary manner. Any action to revoke or modify the underlying Conditional Use Permit as provided by Section 24-185(C.) must also be consistent and satisfy the requirements of Section 24-251, Permit Revocation or Modification, which reads as follows: 24-251 Permit Revocation or Modification Any discretionary permit may be revoked, or conditions of approval modified, as provided for in this section. A. Review Authority. 1. A permit may be revoked or modified by the review authority which originally . approved the permit or approval. 2. In instances where the Zoning Administrator was the approval authority, the Zoning Administrator may choose to refer any action to revoke or modify a permit to the Planning Commission for review and final decision. B. Public Notice and Hearing. Public notice and hearing for any action to revoke or modify a permit shall be provided in full compliance with Article 36 (Public Notice and Hearings). C. Findings. The review authority may revoke or modify a permit only if one or more of the following findings can be made: 1. The applicant or property owner has altered the circumstances under which the permit was granted to a degree that one or more of the findings required to grant the original permit can no longer be made. Page 2 of 5 2. Permit issuance was based on misrepresentation by the applicant, either through the omission of a material statement in the application, or in public hearing testimony. 3. One or more conditions of approval have been violated, or have not been complied with or fulfilled. 4. The use or structure for which the permit was granted no longer exists or has been discontinued for a continuous period of at least 12 months. 5. The applicant or property owner has failed or refused to allow inspections for compliance. 6. Improvements authorized by the permit are in violation of the Zoning Ordinance or any law, ordinance, regulation, or statute. 7. The use or structure is being operated or maintained in a manner which constitutes a nuisance. D. Effect of Revocation. The revocation of a permit shall have the effect of terminating the approval and denying the privileges granted by the permit. It is only by the review authority's (in this case the Planning Commission's) making one or more of the specific findings in BCC §24-251(C.) at a noticed public hearing that an approved CUP may be substantively modified or revoked. It is therefore my determination as Zoning Administrator that a Conditional Use Permit for a telecommunications facility shall be administratively reviewed and. extended pursuant to BCC 24-185 upon verification of the permit -holder's continued compliance with the findings and conditions of approval under which the application was originally approved. If the Zoning Administrator has determined the Use Permit is subject to one or more of the seven specific findings listed in BCC §24-251(C.), and the situation cannot be corrected by voluntary compliance by the applicant and/or property owner, the Zoning Administrator may provide public notice and schedule a public hearing by the review authority to consider revocation or modification of the Conditional Use Permit Condition of Approval No. 3 Condition of Approval No. 3 (Mitigation Measure #3) pertains to obstruction marking and lighting of the tower and reads as follows: 3. Mitigation Measure #3: Obstruction marking and lighting, consistent with the requirements (limited to marking and lighting design only) of U.S. Department of Transportation Federal Aviation Administration Advisory Circular AC 70/7460-1 K, is required at the top of the tower, and shall have a flashing or steady burning light that is shielded from the ground to prevent visual impacts, unless the applicant can demonstrate that Page 3 of 5 such measures are not required to ensure compatibility with established air navigation practices in the immediate area. Plan Requirements: Building and site development plans shall indicate the type of lighting proposed. Timing: The requirements of this measure shall be adhered to at all times. Monitoring: Department of Development Services, as needed, shall conduct a field inspection to verify that the lighting is consistent with approved type. The basis and authority for the Planning Commission's imposition of Condition of Approval No. 3 on February 28, 2013 is found in two sections of Butte County Code. Section 24-180 requires submittal of a site plan of the proposed facility to the Butte County Agricultural Commissioner for comment and to send a "notification letter to all aerial agricultural applicators registered in the county informing them of the proposed site location and tower height." (BCC§24-180 (B.)) Section 24-182 provides obstruction marking and lighting may be required by the review authority as follows: 1. The review authority may require that tower or pole facilities be painted from a height of 10 feet above the ground to the top of the facility with alternating aviation orange and white stripes and have a flashing or steady burning light installed on the top that is shielded from the ground to prevent visual impacts, unless the applicant can demonstrate that such measures are not required to ensure compatibility with established air navigation practices in the immediate area. (BCC §24-182(a.)(1.)) The Department of Development Services has provided a notification letter to aerial agricultural applicators and spoken with some of the applicators who conduct operations in the immediate vicinity of the proposed monopole. Each of the applicators contacted informed the Department that both daytime and night visibility of the proposed monopole was a safety concern for aerial operations in the vicinity and recommended, at minimum, that an obstruction light system be installed to increase conspicuity. As noted in Chapter 2, Section 20 Structures to Be Marked and Lighted, of the Federal Aviation Administration (FAA) Advisory Circular AC 70/7460-1K Obstruction Marking and Lighting, the FAA generally does not require marking and/or lighting of structures with an overall height below 200 feet above ground level and not exceeding obstruction standards contained in 14 CFR part 77. However, the FAA Advisory Circular does represent the accepted practice for the design of obstruction marking and/or lighting. It is therefore my determination as Zoning Administrator that Condition of Approval No. 3 may be deemed satisfied by the installation of a red obstruction light system consistent with the standards of Chapter 5, Section 53. Poles Towers and Similar Skeletal Structures, of FAA Advisory Circular AC 70/7460-1K. Specifically, the following system shall be provided: Page 4 of 5 1. Top Mounted Obstruction Lights — two or more steady burning (L-810) lights shall be installed in a. manner to ensure an unobstructed view of one or more lights by a pilot. 2. Intermediate Level Lights - Two or more steady burning (L-810) lights shall be installed on diagonallyor diametrically opposite positions on the monopole as close as practicable to the 70 foot above ground level elevation. You have also requested clarification that the requirements of Condition No. 3 do not extend to other FAA requirements regarding obstruction marking and/or lighting. Because the requirements of`Condition of Approval No. 3 are imposed by Butte County and are not required by the FAA, these requirements do not apply (e.g. notice and reporting requirements, light failure notification, monitoring .and control devices, etc.). Please note, however; that Butte County Code does require the following with respect to maintenance of obstruction lighting: 2. All obstruction .lighting shall be visually inspected on a regular basis to ensure proper operation. Any lighting failure or malfunction that affects a top light or flashing light regardless of its position on the tower shall be reported immediately to the Department of Development Services and remedied in a timely manner. Monitoring: Department of Development Services shall review building plans to make sure tower satisfies the above requirement. Mitigation Measure #5: Dust generated by the development activities shall be kept to a minimum with a goal of retaining dust on the site. Follow the dust control measures listed below: a. Water shall be applied by means of truck(s), hoses, and/or sprinklers as needed prior to any land clearing or earth movement to minimize dust emissions. b. Haul vehicles transporting soil into or out of the property shall be covered. c. A water truck shall be on site at all times during development activities. Water shall be applied to disturbed areas a minimum of two (2) times per day or more as necessary. d. On-site construction vehicles shall be limited to a speed of 15 mph on unpaved roads. e. Post a publicly visible sign with the telephone number and person to contact regarding dust complaints. This person shall respond and take corrective action within 24 hours. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission: I. Adopts a Mitigated Negative Declaration with the following findings: A. An Initial Study was completed in compliance with the California Environmental Quality Act. Said study identified no significant environmental effects with implementation of Butte County Code, Chapter 24, Article 25, Supplemental Use Regulations, and Article 24 Land Use Compatibility Standards. B. The Planning Commission has considered the Mitigated Negative Declaration, together with comments received during the review process. C. On the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, there is no substantial evidence that the Use Permit for Pristine Sun, Planning Division File No. UPI 1-0002, would have a significant effect on the environment. D. The Mitigated Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. E. The custodian of the record is the Department of Development Services. The location of the record is 7 County Center Drive, Oroville CA 95965. II. Finds that based on a review of the project as proposed, the Department of Fish Finds that collection of fees pursuant to Fish and Game Code Section 711.4 is required, prior to filing a Notice of Determination for the project, unless the project proponent provides verification from the California Department of Fish and Game that the project is exempt from the fee requirement. If a required fee is not paid for a project, the project will not be operative, vested or final and any local permits issued for the project will be invalid (Section 711.4 (c)(3)). 4 III. Makes the following Use Permit findings: A. The proposed use is allowed in the applicable zone. The project is zoned AG -40 (Agricultural 40 -acre minimum). The Agricultural Zone identifies utilities under four categories: Minor, Accessory, Intermediate and Major. This project falls under the Major Utility category. This project is a major utility which requires a conditional use permit. B. The location, size, design, and operating characteristics of the proposed use will be compatible with the existing and future land uses in the vicinity of the subject property. The project site is located in a rural area with residential, agricultural and vacant parcels. The overall size of the project, 5 acres, encompasses approximately 12.5% of the 40 acre parcel. The location of the facility on the parcel is proposed to be approximately 230 feet north of Cox Lane. Based on the distance from Cox Lane, the 6 -foot high screened fencing, landscape screening along the southern fencing and the limited height of the solar equipment, 8 to 10 feet about the ground, the project is compatible with surrounding uses. C. The proposed use will not be detrimental to the public health, safety, and welfare of the County. The Initial Study/Mitigated Negative Declaration for the project concluded that people living near the proposed solar facility would not be exposed to significant levels of radio frequency (RF) emissions from the solar panels, the inverter or the additional power lines. The nearest residential dwelling to the proposed communication facility is approximately 625 feet. According to researchers at the Brookhaven National Laboratory, regardless of the specific technology, photovoltaics generate significantly fewer harmful air emissions (at least 89%) per kilowatt-hour (KWh) than conventional fossil fuel fired technologies (Vasilis, 2008). D. The proposed use is properly located within the County and adequately served by existing or planned services and infrastructure. Implementation of the project would not require domestic water or wastewater treatment, or solid waste facilities. It would not be in conflict with any statutes or regulations relating to solid waste, nor would it employ equipment that would introduce interference into any system. The project will be tying into the existing PG&E power lines which are sufficient to handle up to 0.5 megawatt (MW) (500 kilowatt, kW). The project would not increase the level of demand for fire protection service needed on the site because solar facilities do not normally require such services. The proposal would not result in an increase in demand for school facilities in the area. The project would not result in any impacts to area parks and facilities. E. The size, shape, and other physical characteristics of the subject property are adequate to ensure compatibility of the proposed use with the existing and future land uses in the vicinity of the subject property. 5 The project site is located in a rural area with residential, agricultural and vacant parcels. The overall size of the project, 5 acres, encompasses approximately 12.5% of the 40 acre parcel. Mitigation measures are included to protect wildlife and the project is designed to meet setback requirements from Wyandotte Creek. The solar facility is anticipated to have a life span of 20 to 25 years, with a potential for replacement of solar panels and other equipment. When the facility is no longer needed, the applicant has provided a decommissioning plan and will restore the site back to pre project conditions. F. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. IV. The project is consistent with the following General Plan Policies: AG -P1.1 The County supports the State and federal legislation designed to conserve soil and protect agriculture land. The site has been used for horse grazing. It has been that as long as the land is not identified as "Prime Farmland", "Farmland of Statewide Importance" or "Unique Farmland" by the Farmland Mapping and Monitoring Program (FMMP) Important Farmland Map, alternative energy facilities of this type are permitted with approval of a conditional use permit. The project site is identified as "Grazing Land" by the FMMP Important Farmland Map. W -P1.7 Agriculture, logging, mining, recreational vehicle use and other open space uses shall follow best management practices to minimize erosion and protect water resources. The project includes mitigation measures and conditions of approval that will implement. requirements to address erosion and the identified seasonal creek on site. W -P3.3 The County shall protect groundwater recharge and groundwater quality when considering when considering new development projects. No water or wastewater facilities are proposed in this project. The water source for ongoing project maintenance needs (cleaning/rinsing-off the panels) will be brought to the site in a water truck setup for cleaning the panes. The applicant will only use water for cleaning the panels. Eighteen hundred gallons of water will be used twice a year to clean the panels. The water will drain from the panels onto the ground. There are no cleaning agents used to wash the panels. COS -P1.1 Greenhouse gas emission impacts from proposed development projects shall be evaluated as required by the California Environmental Quality Act. Given the net greenhouse -reducing short-term duration and limited scope of the construction/development activities, and the infrequent maintenance truck trips needed to maintain the facilities, the project is not expected to generate greenhouse gas emissions, either directly or indirectly, that may have a significant impact on the environment. 6 There are no applicable State or local regulations or plans for greenhouse gas reduction with which the project could comply. However, given that the proposed facility is expected to be a net greenhouse gas reducer, it is reasonable to state that the project will not conflict with an applicable plan, policy or regulation adopted for the purpose of reducing the emissions of greenhouse gases. COS -P3.2 The development of renewable fuel sources in the county shall be encouraged, provided that such fuel sources can be built or expanded and that significant adverse environmental impacts associated with such development can be successfully mitigated. COS -P3.7 Wind power generation facilities, solar power generation facilities, and other alternative energy facilities shall be encouraged in all General Plan land use designations, consistent with zoning provided that significant adverse environmental impacts associated with such development can be successfully mitigated. All new proposed energy projects shall be compatible with the Military Operations Areas (MOAs) Figure LU -5. The General Plan (GP2030) adopted by Butte County in October, 2010, which designated the project site with the Agriculture land use designation, specifically authorizes the development of solar power generation facilities in the Agriculture land use designation. The project was reviewed by the Intergovernmental Planner for the NAVFACSW Intergovernmental Branch AM -3. The project site is not identified as being located in either of the Military Airspace Overlay areas. COS -P7.3 Creeks shall be maintained in their natural state whenever possible, and creeks and floodways shall be allowed to function as natural flood protection features during storms. The proposed project development footprint may impact the function or flow of Wyandotte Creek; however, the project has an adequate setback from the creek per mitigation measures. COS -P7.4 New development projects shall mitigate their impacts in habitat areas for protected species through on- or off-site habitat restoration, clustering of development, and/or project design and through the provisions of the Butte Regional Habitat Conservation Plan (HCP) and Natural Community Conservation Plan (NCCP) within the HCP/NCCP Planning Area, upon the future adoption of the HCP/NCCP. The project site may be habitat for special -status species. Mitigation measures have been identified to avoid any potential negative effects that construction may have on these habitats. COS -P7.5 No new development projects shall occur in wetlands or within significant riparian habitats, except within the Butte Regional Habitat Conservation Plan (HCP) and Natural Community Conservation Plan (NCCP) Planning Area where such development is consistent with the conditions of the HCP/NCCP, upon the future adoption of the HCP/NCCP. rA The subject property contains potential wetlands that have been avoided by restricting the project footprint through mitigation measures to avoid and minimize impacts and mitigate for unavoidable impacts. COS -P7.6 New development projects shall include setbacks and buffers along riparian corridors and adjacent to habitat for protected species, except where permitted in the Butte Regional Habitat Conservation Plan (HCP) and Natural Community Conservation Plan (NCCP) Planning Area and where such development is consistent with the conditions of the HCP/NCCP, upon the future adoption of the HCP/NCCP. Per discussion above, the project may encroach on critical habitats or riparian corridors. The project as conditioned will conform to mitigation measures that mandate appropriate setbacks from these resources. COS -P7.7 Construction barrier fencing shall be installed around sensitive resources on or adjacent to construction sites. Fencing shall be installed prior to construction activities and maintained throughout the construction period. In the event that resources are observed by a qualified biologist or botanist, there are mitigation measures in place that will mandate proper fencing. COS -P7.8 Where sensitive on-site biological resources have been identified, construction employees operating equipment or engaged in any development - associated activities involving vegetation removal or ground disturbing activities in sensitive resource areas shall be trained by a qualified biologist and/or botanist who will provide information on the on-site biological resources (sensitive natural communities, special -status plan and wildlife habitats, nests of special -status birds, etc.), avoidance of invasive plan introduction and spread, and the penalties for not complying with biological mitigation requirements and other State and federal regulations. Per required mitigation measures, construction crews will be educated on preventing the loss or destruction of on-site biological resources. COS -P7.9 A biologist shall be retained to conduct construction monitoring in and adjacent to all habitats for protected species when construction is taking place near such habitat areas. Per required mitigation measures, a biologist will be procured to monitor the site during construction. COS -P7.10 Long-term recovery plans for areas affected by wildlife shall incorporate native species and enhance wildlife habitat. The project as proposed includes a reclamation plan that will address the long term health of native species and wildlife habitat. COS -P8.1 Native plant species shall be protected and planting and regeneration of native plant species shall be encouraged, wherever possible, in undisturbed portions of development sites. The project may encroach on critical habitats or riparian corridors. The project as proposed will conform to mitigation measures that mandate appropriate setbacks from these resources. Native and non-invasive groundcover will be planted under the arrays and between array rows post -construction. The project as proposed includes a reclamation plan that will address the long term health of native species and wildlife habitat. / COS -P8.3 Native plants shall be used wherever possible on County -owned and -controlled property. Per general plan policies COS -8; COS -P8.1; COS -P8.2; COS -P8.3, native and non-invasive groundcover will be planted under the arrays and between array rows post -construction. COS -P8.4 Introduction or spread of invasive plant species during construction of development projects shall be avoided by minimizing surface disturbance; seeding and mulching disturbed areas with certified weed -free native mixes; and using native, noninvasive species in erosion control plantings. Per mitigation measures, a Noxious Weed Control Plan (as discussed in the Agricultural Resources section of the attached Initial Study/Mitigated Negative Declaration) will be implemented and obeyed throughout the projects construction process. COS -P9.1 A biological resources assessment shall be required for any proposed development project where special -status species or critical habitat may be present. Assessments shall be carried out under the direction of Butte County. Additional focused surveys shall be conducted during the appropriate season if necessary. Upon adoption of the Butte Regional Habitat Conservation Plan (HCP) and Natural Community Conservation Plan (NCCP), assessment requirements of the HCP/NCCP shall be implemented for development projects within the HCP/NCCP area. A biological assessment has been performed. Mandatory mitigation measures are in place that will protect special status species. COS -P9.2 If special -status plant or animal species are found to be located within a development site, proponents of the project shall engage in consultation with the appropriate federal, State and regional agencies and mitigate project impacts in accordance with State and federal law. Upon adoption of the Butte Regional Habitat Conservation Plan (HCP) and Natural Community Conservation Plan (NCCP), mitigation requirements of the HCP/NCCP shall be implemented for development with the HCP/NCCP area. Examples of mitigation may include: a. Design the proposed project to avoid and minimize impacts. b. Restrict construction to specific seasons based on project -specific special - status species issues (e.g. minimizing impacts to special -status nesting birds by constructing outside of the nesting season). c. Confine construction disturbance to the minimum area necessary to complete the work. d. Mitigate for the loss of special -status species by purchasing credits at an approved conservation bank (if a bank exists for the species in question), funding restoration or habitat improvement projects at existing preserves in Butte County or purchasing or donating mitigation lands of substantially similar habitat. 9 • e. Maintain a minimum 100 -foot buffer on each side of all riparian corridors, creeks and streams for special -status and common wildlife. f. Establish setbacks from the outer edge of special -status species habitat areas. No special -status plant or animal species were observed within the 5 -acre development footprint. Mandatory mitigation measures are in place that avoid the destruction of habitat and establish setback for the proposed project. The project complies with these requirements COS -P17.1 Views of Butte County's resources, including water features, unique geological features and wildlife habitat areas, shall be maintained. The project proposes development on a vacant portion of a farm field, which itself is not a notably visible or scenic vista within the County. However, it is located in a valley location where there are views of the foothills of the Sierra Nevada Mountains to the east and north from many locations. The project has the potential to affect some of these scenic views. However, due to the limited height 8 to 10 feet, the project will not impact any water, unique geological features or wildlife habitat areas. Butte County has not promulgated regulations for the protection of scenic views from private' land. Apart from the height restrictions in Article 4, Sections 24- 14 D.2 and 3 and Article 25, Section 157 C 3, there are no restrictions or protections in Butte County's codes which ensure that existing scenic views from individual residences will be maintained. Views from individual properties are therefore not a specifically protected property right in Butte County. V. Approves Use Permit UPI 1-0002 for Pristine Sun, subject to the findings and conditions in Exhibit "A" A. The use granted by this Use Permit must be established within 24 months of the delivery of the countersigned permit to the Permittee, or as provided by BCC Chapter 24, Article 34, Section 247 Time Limits and Extensions. 3. Minor changes may be approved administratively by the Zoning Administrator upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division 12 0 0 1. Mitigation Measure #1 - (Noxious Weeds Management Plan) In compliance with General Plan Policy COS -P8.4, place Condition of Approval on the Use Permit that states: "Prior to implementing any approved uses, submit a Noxious Weed Control Plan for approval by the Agricultural Commissioner." Plan Requirements: This Condition of Approval shall be required on the Use Permit. Timing: Requirements of the condition shall be adhered to throughout the approved use on the parcel. Monitoring: The Butte County Department of Development Services shall ensure that this Condition of Approval is required on the Use Permit and on all building and site development plans. Mitigation Measure #2 - (Nuisance and Fugitive Dust Emissions) Place a condition of Approval on the Use Permit requiring implementation of the following protections for air quality, consistent with BCAQMD best practices: Implement Dust Control Measures The following measures shall apply to all development activities on the project site. Follow the air quality control measures listed below: a. During clearing, grading, earth moving, excavation, or transportation of cut or fill materials, water trucks or sprinkler systems are to be used to prevent dust from leaving the site and to create a crust after each day's activities cease. b. During construction, water trucks or sprinkler systems shall be used to keep all areas of vehicle movement damp enough to prevent dust from leaving the site. At a minimum, this would include wetting down such areas in the later morning and after work is completed for the day and whenever wind exceeds 15 miles per hour. c. Soil stockpiled for more than two days shall be covered, kept moist, or treated with soil binders to prevent dust generation. d. On-site construction vehicles shall be limited to a speed of 15 mph on unpaved roads. e. Haul vehicles transporting soil into or out of the property shall be covered. f. Existing roads and streets adjacent to the project shall be cleaned at least once per day if dirt or mud from the project site has been tracked onto these roadways, unless conditions warrant a greater frequency. g. Other measures may be required as determined appropriate by the BCAQMD to comply with Rule 205 -Fugitive Dust Emissions or Department of Public Works in order to control dust. Post Contact Information h. Post a publicly visible sign with the company person and telephone number to contact regarding dust complaints. This person shall respond and take corrective action with regard to Rule s 200 & 205. The name and telephone number of the Butte County Air Quality Management District shall also be included to ensure corrective action is taken in compliance with BCAQMD Rules 200 & 205 (Nuisance and Fugitive Dust Emissions). Other Construction Practices L Maintain all construction equipment in proper tune according to manufacturer's specification. j. Alternatively fueled construction equipment on site such as compressed natural gas (CNG), liquid natural gas (LNG), propane, or biodiesel. 4. Construction workers shall park in designated parking area(s) to help reduce dust emissions. Mitigation Measure #3 - (Raptor survey) If construction occurs between 1 March and 15 September, a qualified biologist shall survey the project site and within 250 feet of the site for nesting birds of prey and migratory birds no more than thirty days prior to the initiation of construction. Results of the preconstruction survey shall be submitted to the Butte County Development Services Department for review and acceptance. 1. If an active nest is located within 250 ft. of the project site, a biologist will monitor the nest weekly during construction to evaluate potential nesting disturbance caused by construction activities. The biological monitor will have the authority to stop construction if construction appears to be resulting in nest abandonment or forced fledging. 2. If an active nest occurs in a tree scheduled for removal, the species of bird using the nest will be determined. Raptor nest trees will be preserved until it is outside of the breeding season for that species or until the young have fledged. If construction cannot be delayed until the end of the breeding season, guidance from DFG shall be requested. Timing: Prior to and during construction. Monitoring: Development Services Department 4. Mitigation Measure #4 - (Burrowing Owl) Prior to the issuance of development permits and no more than thirty (30) days prior to any ground disturbance, a qualified biologist shall conduct a protocol level survey to determine presence of California burrowing owl in (1) the area between the banks of Wyandotte Creek that are within 500 feet of the proposed disturbance area, and (2) whatever un-disked/graded areas that also may be within 500 feet of the proposed disturbance area. If burrowing owl is (are) found to exist within this survey area, appropriate development exclusion buffers shall be determined and established in consultation with the California Department of Fish and Game in order to avoid and 14 0 • preserve said resources. If avoidance of all or any burrowing owl is not feasible, mitigation for impacts shall be determined in consultation with the California Department of Fish and Game. Timing: Prior to and during construction. Monitoring: If preconstruction surveys are required, the Planning Division shall ensure that said preconstruction surveys are performed no more than thirty (30) days prior to disturbance and, if burrowing owl are present, shall ensure that adequate avoidance and/or mitigation measures are implemented as determined in consultation with the California Department of Fish and Game. Mitigation Measure #5 - (Giant Garter Snake) Construction related activities have the potential to impact the Giant Garter Snake (GGS). Therefore, the following mitigation measure is required: "Prior to any surface disturbance activities (grading, excavation or construction) on non - paved areas, the developer shall implement the following measures, or measures which may be adopted through the Butte Regional Habitat Conservation Plan/Natural Community Conservation Plan, to avoid any impacts to Giant Garter Snake and the habitat upon which it relies, or shall mitigate potential impacts to the satisfaction of the California Department of Fish and Game. 1. Construction activities should be conducted only between May 1 and October 1. This is the active period for giant garter snake and direct mortality is lessened, because snakes can be detected, and can move out of the way of machines and people to avoid injury or death. (see # 12 below for other option) 2. Twenty-four (24) hours prior to construction activities, the project area must be surveyed by a qualified biologist for giant garter snakes and habitat upon which it relies. The survey of the project area shall be repeated if a lapse in construction of two weeks or greater has occurred. If a snake is encountered during construction, activities shall cease until appropriate corrective measures have been completed or it is determined by a qualified biologist that the snake will not be harmed. Sightings and/or incidental harm to snakes shall be immediately reported to the Fish and Wildlife Services ((916) 414-6600) and the Department of Development Services ((530) 538-7601). 3. Based on the site survey, the qualified biologist must flag and designate snake habitat areas to be voided within or adjacent to the project area as Environmentally Sensitive Areas. This area must be avoided by all construction personnel. 4. Land clearing activities must be confined to the minimal area necessary to facilitate construction activities. Limit vegetation clearing within 200 feet of the banks of potential giant garter snake aquatic habitat to the minimal area necessary. 5. Construction activities within 200 feet from the banks of giant garter snake aquatic habitat must be avoided. Confine the movement of heavy equipment within 200 feet of the banks of potential giant garter snake aquatic habitat to existing roadways to minimize habitat disturbance. 6. Prior to ground disturbance (grading, excavation and construction), all on-site construction personnel shall be given Fish and Wildlife Service -approved instruction by a qualified biologist regarding how to recognize the presence of Giant Garter Snake and the importance of avoiding impacts to these species and their habitats. 15 7. In areas where wetlands, irrigation ditches, marsh areas or other potential giant garter snake habitats are being retained on the site: a. Install temporary fencing at the edge of the construction area and the adjacent wetland, marsh, or ditch. b. Restrict working areas, spoils and equipment storage and other project activities to areas outside of marshes, wetlands and ditches. c. Maintain water quality and limit construction runoff into wetland areas through the use of hay bales, filter fences, vegetative buffer strips, or other accepted equivalents. 8. If on-site wetland, irrigation ditches, marshes, etc. are being relocated in.the vicinity, the newly created aquatic habitat shall be created and filled with waterrip or to dewatering and destroying the existing aquatic habitat. In addition, non -predatory fish species that exist in the aquatic habitat and which are to be relocated shall be seined and transported to the new aquatic habitat concurrent with the dewatering of the existing site. 9. If wetlands, irrigation ditches, marshes, etc. will not be relocated in the vicinity, then the aquatic habitat shall be dewatered at least two weeks prior to commencing construction. 10. Any areas de -watered related to construction must remain dry for at least 15 consecutive days after April 15 and prior to any excavation of filling of the dewatered area. 11. After completion of construction activities, all temporary fill and construction debris shall be removed whenever feasible and disturbed areas shall be restored to pre - project conditions. Required restoration work may include replanting of species removed from banks or replanting emergent vegetation in the active channel. 12. If construction is proposed between October 2 and April 30, prior to any ground disturbance the project proponent shall conduct California Department of Fish and Game -recommended protocol level survey. Prior to any ground disturbance or construction, the results of such survey shall be submitted to the Department of Development Services. Prior to any ground disturbance or construction the Director of the Department will identify and require appropriate mitigation measures, consistent with the findings of the survey. 13. All requirements above shall be noted in full on the site plan for any development permits (including but not limited to septic, well and building permits) issued by Butte County. Timing: Requirements of the mitigation measure shall be adhered to throughout all grading, excavation, and construction periods. Monitoring: Departments of Development Services will ensure that the requirements of the mitigation measure shall be adhered to during construction. The on site inspectors of the Building Department will ensure that the requirements of the mitigation measure are adhered to throughout all grading, excavation, and construction periods. " 6. Measure #6 - (Western Pond Turtle) No less than 24 -hours prior to the commencement of construction activities, a preconstruction survey shall be conducted by a USFWS-approved biologist to survey for 16 0 • western pond turtle. Surveys will include western pond turtle nests as well as individuals. The project site shall be re -inspected by the monitoring biologist whenever a lapse in construction activity of two weeks or greater has occurred. If western pond turtles are found within the project area, the biologist (with the appropriate agency permits or approvals) will temporarily move individuals outside of the project area into a suitable habitat upstream of the construction area. Following the pre -construction survey, a temporary wildlife barrier such as silt fencing shall be placed around the construction site to prevent ingress of turtles. Fencing will be established in upland immediately adjacent to turtle habitat and extending up to 200 feet from construction activities. Areas outside of the silt fencing shall be avoided by all construction personnel. The fencing shall be inspected by the Contractor before the start of each work day and maintained by the Contractor until completion of the proposed project. The fencing may be removed only when the construction of the proposed project is completed. Timing: Requirements of the mitigation measure shall be adhered prior to construction activities. Monitoring: The Butte County Department of Development Services shall ensure that the pre -construction survey is completed by a USFWS-approved biologist prior to construction activity. 7. Mitigation Measure #7 - (Wetlands) Prior to any ground disturbance, or the issuance of any building permit, the applicant shall submit written verification that any necessary permits have been secured from the US Army Corps of Engineers (USACOE). If permits are not required, provide written correspondence from USACOE. Plan Requirements: Provide documentation to the Department of Development Services that the regulatory requirements of USACOE have been met. Timing: Prior to issuance of development permits and ground disturbance. Monitoring: The Butte County Department of Development Services shall confirm verification process has been completed or have received correspondence from ACOE that no impacts will occur with this project. 8. Mitigation Measure #8 - (Monitoring Costs) The Department of Development Services (DDS) is responsible for monitoring the landowner's compliance with all Conditional Use Permit conditions of approval as detailed above. As the cost of ongoing monitoring of Measures and Conditions of Approval is not included in the County's application fees, at the discretion of the Director of DDS (Director), the cost of DDS staff and consultant time directly related to the monitoring of compliance with Conditional Use Permit conditions of approval may be billed to and borne by the landowner at the established DDS Planning Division hourly rate. The current fee amount established in Butte County Code and implementing resolutions for Mitigation Measure and Condition of Approval Monitoring (currently $1,031.79) shall be paid within 30 days of the date of project approval. Regarding the monitoring of relevant mitigation measures and conditions of approval after construction, the landowner shall maintain this fee with DDS in an amount (not to exceed the established maximum) at a level determined by the Director to ensure adequate ongoing mitigation measure and condition of approval monitoring. Mechanisms which may be used by the County to address failure by the landowner to maintain the adequate fee amount may include, but are not limited to, "stop work" orders, denial of building 17 permits and/or final inspections at the discretion of the Director of DDS, and/or permit revocation or modification as provided by Section 24-251 of Butte County Code. Timing: Monitoring costs shall be paid within 30 days of project approval. Monitoring: The Butte County Department of Development Services shall ensure adequate monitoring funds are available to ensure adequate ongoing Measure and condition of approval monitoring. 9. Mitigation Measure #9 - (Biologist for Construction Monitoring) A qualified biologist and/or botanist shall be retained by the applicant/developer to the satisfaction of the Department of Development Services to conduct construction monitoring in and adjacent to all habitats for protected species when construction is taking place near such habitat areas. The biologist will submit weekly monitoring reports to the Department and the applicant/developer. Timing: This measure shall be implemented during site preparation and construction. Monitoring: Butte County Department of Development Services shall ensure compliance with this requirement. 10. Mitigation Measure #10 - (Construction Employee Training) The qualified biologist and/or botanist retained by the applicant/developer to the satisfaction of the Department of Development Services to conduct construction monitoring will provide mandatory training to construction employees operating equipment or engaged in any development -associated activities involving vegetation removal or ground disturbing activities in sensitive resource areas. The qualified biologist and/or botanist will provide information on the on-site biological resources (sensitive natural communities, special -status plan and wildlife habitats, nests of special - status birds, etc.), avoidance of invasive plan introduction and spread; and the penalties for not complying with biological mitigation requirements and other State and federal regulations. Timing: This measure shall be implemented during site preparation and construction. Monitoring: Butte County Department of Development Services shall ensure compliance with this requirement. 11. Mitigation Measure #11- (Construction Barrier Fencing) Construction barrier fencing shall be installed, at a distance specified by the qualified biologist and/or botanist retained to conduct construction monitoring in and adjacent to all habitats for protected species, around sensitive resources on or adjacent to construction sites. Fencing shall be installed prior to any construction activities and maintained throughout the construction period. The biologist shall determine the location and delineate/stake-out the location of this fencing. Timing: This measure shall be implemented during site preparation and construction. Monitoring: Butte County Department of Development Services shall ensure compliance with this requirement. 12. Conservation Measure #12 - (Cultural Resources) Place a Condition of Approval on the Use Permit UPtO--@663- that states the following options: I i -000�, W A qualified professional archeologist shall be on site during ground disturbing activity; or 2. If determined, by the Tsi-Akim Maidu Tribe, that the amount of ground disturbing activity is minor, on site monitoring is not required, but the following shall apply: "During any excavation or other substantial subsurface disturbance activities, individuals conducting the work should be advised to watch for cultural resource materials. Should any evidence of prehistoric cultural resources be observed (freshwater shells, beads, bone tool remnants or 'an assortment of bones, soil changes including subsurface ash lens or soil darker in color than surrounding soil, lithic materials such as flakes, tools or grinding rocks, etc.), or historic cultural resources (adobe foundations or walls, structures and remains with square nails, refuse deposits or bottle dumps, often associated with wells or old privies), work within 50 feet of the find shall cease immediately until a qualified professional archaeologist can be consulted to evaluate the remains and implement appropriate mitigation procedures. Should human skeletal remains be encountered, State law requires immediate notification of the County Coroner ((530) 538-6579). Should the County Coroner determine that such remains are in an archaeological context, the Native American Heritage Commission in Sacramento shall be notified immediately, pursuant to State law, to arrange for Native American participation in determining the disposition of such remains." Plan Requirements: The Condition of Approval shall be required on the Use Permit UPI 1-0002 and on all building and site development plans. Timing: This measure shall be implemented during all site preparation and construction activities. Monitoring: The Department of Development Services shall ensure that this requirement is followed and is placed on all building and site development plans. Should any evidence of prehistoric cultural resources be observed as described above, all work should immediately cease, and a qualified archaeologist must be consulted to assess the significance of the cultural materials and report such assessments to the Department of Development Services. The Department of Development Services shall then coordinate with the developer and appropriate authorities to avoid damage to cultural resources and determine appropriate action. 13. Mitigation Measure #13 — (Noise Construction) To reduce construction -generated noise the developer shall implement the following measures to mitigate construction noise throughout all construction periods: 1. Limit noise -generating construction activity in excess of 50 dB, including generators, backhoes, jackhammers, augers, and power saws to daytime hours (7:00 a.m. to 6:00 p.m.) with no noise -generating construction activity in excess of 50 dB on Saturdays, Sundays or holidays. Exterior noise levels shall be measured 100 feet away from the nearest residence, if that point remains on the noise -sensitive property; otherwise, noise levels shall be measured at property line. 2. Use best available noise suppression devices and properly maintain and muffle diesel engine -driven construction equipment; 3. Construction equipment shall not be idled for long periods of time; 4. Locate stationary equipment as far as possible from sensitive receptors; 19 • Designate a Disturbance Coordinator and post the name and phone number of this person conspicuously at the entrance(s) to the project site so it is clearly visible to nearby residents most likely to be affected by construction noise. This person would manage complaints resulting from construction noise. The Disturbance Coordinator shall contact noise sensitive receptors and advise them of the schedule of construction." Plan Requirements: This Condition of Approval shall be required on the Use Permit. Timing: Requirements of the condition shall be adhered to throughout site development activities. Monitoring: The Butte County Department of Development Services shall ensure that this Condition of Approval is required on the Use Permit and adhered to during construction activity. Violations of the mitigation will be reviewed by the Department of Development Services on a complaint basis. 14. The solar facility shall be incompliance with Butte County Code, Chapter 24, Article 25, Section 157 C, Standards, Solar Energy Systems. 15. The fencing along the southern portion of the solar facility shall be screened by vegetation. A landscaping plan shall be submitted to the Department of Development Services. Vegetation type shall approved by the Director of Development Services, or his designee. Public Works 16. Prior to establishing use, obtain an encroachment permit and improve all new and existing driveway approaches to publicly maintained roads as specified in the county improvement standards and the terms of the encroachment permit. 17. Prior to establishing use, deed to Butte County in fee simple 30 feet of right-of-way from the physical centerline of Cox Lane along the entire property frontage. 18. The facility footprint will be 1,400 SF. • A 15 -foot wide access easement is proposed out to West Sacramento Ave. • The access will be a graveled access driveway along the east side of the project site with a hammerhead turn -around. • The facility will be enclosed with 6 -foot high chain-link security fencing with 3 strands of barbwire at the top. • No water or wastewater facilities are proposed. SITE CHARACTERISTICS: • The 47.88 -acre project site is developed with an existing residence and barn, located in the southeast corner of the parcel. The rest of the parcel is planted in deciduous fruit trees. • The parcel has frontage on Meridian Road and West Sacramento Avenue. • The exiting residence and barn are accessed from Meridian Road. • The project parcel is located approximately two miles west of the City of Chico. • The project site has an approximate elevation of 135 feet above sea level and slopes generally to the west. • The western third of the parcel is located in an A flood zone. A small portion of along the western edge of the parcel is floodway. The proposed lease area is identified as flood zone «X • The site is not located within an earthquake fault zone or an airport land use compatibility zone. • This is an area characterized by agricultural operations (orchards) and rural residential • Parcels in the project vicinity range in size from 1.1 to 52.6 acres. Average parcel size is 13.9 acres. • There are no streams or creeks on site. ANALYSIS: Zoning Consistency • The project parcel is zoned AG -80 (Agricultural 80 -acre minimum). • Wireless Communication Facilities are regulated by Article 26 of the Butte County Code. The Purpose (Section 24-176) of the Telecommunication Facilities is to: A. Encourage the location of new monopoles, towers and antennas in non-residential areas, thereby discouraging the need for such facilities in residential areas. C. Minimize the total number of antennas through the county. D. Encourage co -location of facilities at appropriate new and existing monopoles, towers and antenna sites. E. Encourage wireless communication providers to locate new monopoles, towers and antennas in areas that minimize adverse impact on agricultural and air navigation. F. Require wireless communication . providers to design and configure wireless communication facilities in a way that minimizes visual impacts. • The applicant has indicated the project area is presently underserved by their cellular coverage. Their cellular communications operates in the UHF, or ultra -high -frequency portion of the radio spectrum. In each of the segments the electromagnetic spectrum the RF signals travel in a "line -of -sight" manner. They do not travel long distances by bending to follow the curvature of the Earth, or by bouncing off of the ionosphere, such as commercial AM or shortwave radio signals do. Therefore, they are subject to being interfered with, or blocked by any number of terrestrial objects, from trees and hills to man-made structures such as buildings and concrete and steel roadway bridges and overpasses. • The height of the tower will also provide an opportunity for other carriers to collocate on the tower, reducing the need for additional towers in the project area. Mitigation measures are included to address potential impacts to agricultural operations, including potential aerial spraying. • The following section highlights Section 24-181, General Requirements for Telecommunication Facilities: A. Setbacks. 1. Generally, new telecommunication facilities shall be located on a parcel so that the distance from the base of facility to the parcel boundary is equal to or greater than the height of the facility.(Reduced setbacks are allowed in the agriculture zones and non- residential zones with conditions specified in 24-181 A.2 to. A.4.) The monopole (130 feet) meets the necessary setback requirements from the property lines. Setbacks from the property lines, meeting or exceeding the height of the tower are: North — 169feet; South — 898 feet; East — 153feet; and West - 1, 796 feet B. Height. 1. The maximum height for telecommunication facilities in all zones shall be 100 feet, except in Commercial and Industrial zones where it shall be 150 feet. Section 24- 18113.1 specifies that the review authority may approve additional height based on justifiable need. Because of the "line of sight" signal propagation limitation, the general result is that the higher the antennas are placed, the larger the `footprint" or service area of the cell. Towers are often built as much to provide additional capacity for more users and more capability to process Internet data as for improved signal strength. The new site is designed to provide service for a minimum of two miles in all directions, and therefore a minimum of 130 feet is necessary. The applicant provided the following list of existing surrounding Verizon cell sites that the new site will "hand 'off ' to, as well as their heights and distances form the proposed new site location: • North Chico, 1298 Nord Avenue. 140 feet, 3.1 miles from proposed Chico River site • Downtown Chico, 215 Orange Street, 96 feet, 3.9 miles from proposed Chico River site • North Esplanade, 3902 Esplanade, 96 feet, 4.6 miles from proposed Chico River site • Durham -Dayton, 9169 Aguas Frias Road, 120 feet, 6.8 miles from proposed Chico River site • Hamilton City, Highway 45 & Road 23, 198 feet, 4.6 miles from proposed Chico River site • Meridian Road, 15082 Hamilton -Nord Cana Highway, 193 feet, 8.8 miles from proposed Chico River site • Bayliss, 2805 Highway 45, 150 feet, 9.6 miles from proposed Chico River site It can be seen then that a 130 foot tall communications structure is fairly typical for the area, and from an engineering perspective is necessary in order for the signal to reach far enough to successfully transfer phone calls and data sessions to the adjacent cell towers as the user is moving about. Regarding the specific parcel Verizon has selected for this project, it is ideal due to its location which is central to the intended coverage area. If it were to be further west, it would not only reduce its ability to provide capacity relieffor the sites in Chico, but it would then be situated in a designated flood plain, which opens up a host of building and regulatory impediments. At the very least this would result in a requirement to construct the site, including the associated ground equipment, above the existing grade which would naturally increase the aesthetic impact of the project. If the site were to be placed further east, it may not provide the desired level of service along River Road and the Sacramento River, including recreational areas that are very popular with fishermen and rafters. Building the site significantly to the north or south of the selected location would result in a degradation of its ability to enhance coverage on Chico Highway 32 and/or Chico River Road, since the site was strategically placed between these two roads in order to be able to provide coverage to both. • Section 24-183 (Standards for Types of Facilities): C. Monopoles or Towers. 1. New monopoles or towers proposed in or within 1,000 feet of agriculture and residential zones require written notice, in a manner approved by the Zoning ■ Butte County PLANNING CONMSSION AGENDA REPORT ■ ■ February 28, 2013 ■ Verizon (c/o Alan Heine) - UPI 3-0002 Agenda Report ■ Page 4 of 22 ■ 0 • Administrator, to be given to owners of parcels located within a minimum radius of 1,000 feet of the parcel on which the proposed monopole or tower will be located. Staff notified all parcels and tenants within 2, 640 feet of the project parcel. 2. Monopoles or towers in agricultural or residential zones shall not exceed 30 feet in height except when: a. No feasible alternative site exists; b. A denial would constitute a prohibition on the provision of the affected wireless communication service in violation of federal or State law. See response above under discussion in Section 24-181 B. • The parcel is under a Williamson Act Contract. Section 51238 of the California Government Code provides that the "erection, construction, alteration, or maintenance of... communication ... facilities are ... compatible uses in any agricultural preserve ", unless the Board of Supervisors makes a specific finding to the contrary. Under Rule 3.B.8 of the Butte County Williamson Act Rules and Procedures, the Board of Supervisors has found that, where they are an accessory use to a primary agricultural use on Williamson Act lands, public utility transmission and delivery lines consistent with Section 51238 are compatible with the Williamson Act, as long as they are incidental, related, appropriate, and clearly subordinate to the primary agricultural use. The cell tower site will be located in a 1,400 SF leased area, with an additional 3,800 SF of easement area. Four orchard trees are proposed to be removed to locate the tower and ground related ground equipment. The additional leased area for access and utility lines will be located so that no additional trees will be removed. The majority of the site, 46.8 acre (97.7 %) is in, and will remain, an active orchard. The communication tower and facility is clearly incidental to the agricultural use. It is determined that the proposed cell tower is consistent with the accessory uses identified under Rule 3.B and approved as compatible with the Williamson Act by the Board of Supervisors. Based on the above information, a Williamson Act Committee recommendation is not required for the proposed project. General Plan Consistency • The project parcel is designated as Agriculture by the General Plan. • The project was reviewed for consistency with the policies of the General Plan. AG -P1.1 The County supports the State and federal legislation designed to conserve soil and protect agriculture land. Approximately 46.8 acres of the 48.77 acres site is used for agricultural production (orchard). In order to place the communication facility on the parcel, four orchard trees are proposed to be removed. This is a very small amount of the existing trees. AG -2.5 When a request is made for a Conditional Use Permit on a lot(s) with existing agriculture operations, an agricultural maintenance plan to provide for the continuation of existing agricultural activities shall be submitted, in accordance with the Zoning Ordinance. The plan shall be reviewed for comments and conditions by the Agricultural Commissioner and Development Services prior to the Planning Commission hearing on the Conditional Use Permit. Agriculture, logging, mining, recreational vehicle use and other open space uses shall follow best management practices to minimize erosion and protect water resources. The project was reviewed by the Agricultural Commissioner and Development Services and was determined to be "de minimis ". Approximately 46.8 acres of the 48.77 acres site is used for agricultural production (orchard). In order to place the communication facility on the parcel, four orchard trees are proposed to be removed. This is a very small amount of the existing trees. It will not impact the viability of the agricultural operation. COS -P13.3 The County shall utilize the Zoning Ordinance to require review of all proposed development projects within the Military Operations Areas (MOA) shown in Figure LU -5. The project site is not located with the Military Operations Areas. The project was sent to the NAVFACSW Intergovernmental Branch AM -3 for review and it was determined the tower would not have any impacts to military overflight areas. Criteria for Granting a Use Permit The criteria for granting a use permit for the 130 -foot tall tower and ground equipment derive both from the generally criteria for granting all use permits (BCC section 24-222) as well as the specific criteria for Monopole Facilities (BCC section 24-183 C 1 & 2). BCC section 24-222 Findings A. The proposed use is allowed in the applicable zone. The project is zoned AG -80 (Agricultural 80 -acre minimum). The Agricultural Zone identifies new towers or poles as requiring a conditional use permit. B. The location, size, design, and operating characteristics of the proposed use will be compatible with the existing and future land uses in the vicinity of the subject property. Wireless communication monopoles can present a negative aesthetic impact due to their high visibility and metal construction; however, the proposed monopole is approximately 370 feet from the nearest residence. Moreover, the lease area is located within an existing orchard. The monopole at 130 feet in height will be visible, but associated equipment will generally be shielded from view from Meridian Road and West Sacramento Avenue. C. The proposed use will not be detrimental to the public health, safety, and welfare of the County. People living near the proposed communications facility have the potential to be exposed to radio-frequency (RF) emissions from the antennas mounted on the monopole. The nearest residential dwelling to the proposed communication monopole is approximately 370 feet from the proposed monopole. Wireless communication systems emit non -ionizing, electromagnetic energy. The perceived health risk of this emission has been identified as a potential public health and safety issue. However, no studies to date have demonstrated a specific correlation between wireless communication facilities and health problems. The actual use of radio frequency transmission requires only a small amount of energy, making mobile phone technology one of the most efficient forms of communication available. Unlike television and radio transmitters which work at full power all the time, a mobile phone site is designed to control its output so that it provides exactly the signal strength required to handle the number of calls being made at that moment, no more and no less. Therefore, if no calls are being made at any one moment, the cell site will virtually shut itself down. The antennas are designed to transmit most of the signal away horizontally, or just below the horizontal, rather than at steep angles to the ground. Wireless communication systems are, by design and operation, low-power devices. Even under maximum exposure conditions, in which all channels are operating at full power, public exposure from a wireless facility will typically be less than 3 microwatts per centimeter squared (pW/cm2). This exposure. is more than 1,200 times lower than the current American National Standards Institute (ANSI) and the National Council on Radiation Protection and Measurement .(NCRP) report public exposure standards. The current ANSI and NCRP maximum allowable exposures are set at levels 50 times higher than the majority of the scientific community believes may pose a health risk to human populations. The proposed communications facility is proposed to utilize a 506 gallon diesel powered generator for emergency backup power. The storage of diesel on the project site requires that the applicant complete a "Hazardous Materials Release Response Plan" pursuant to Chapter 6.95 of the California Health and Safety Code and is regulated by the Butte County Environmental Health Division. With the submittal and implementation of the Hazardous Materials Release Response Plan " the project is not expected to create any hazardous conditions or emissions. The proposed communications facility will also have large batteries within the equipment cabinets. Such batteries are typically classified as non -hazardous material for transportation. The use of these batteries on the project site is not expected to create any hazardous materials or emissions. D. The proposed use is properly located within the County and adequately served by existing or planned services and infrastructure. Implementation of the project would not require domestic water or wastewater treatment, 'or solid waste facilities. It would not be in conflict with any statutes or regulations relating to solid waste, nor would it employ equipment that would introduce interference into any system. The project would not increase the level of demand for fire protection service needed on the site because solar facilities do not normally require such services. The proposal would not result in an increase in demand for school facilities in the area. The project would not result in any impacts to area parks and facilities. E. The size, shape, and other physical characteristics of the subject property are adequate to ensure compatibility of the proposed use with the existing and future land uses in the vicinity of the subject property. The project site is located in a rural area with residential and agricultural parcels. The overall size of the project, approximately 5,200 square feet on the 47.88 acres parcel, encompasses approximately 0.25% of the project parcel. Mitigation measures are included to protect agricultural uses in the surrounding area. The project, with project conditions, complies with the required findings to approve a use permit. Land Use • The project would not result in a significant increase in air emissions, fugitive dust emissions, light, noise, or vehicle traffic. Only a minor amount of construction activity would be required to install the proposed tower and ground related equipment. • The project site is not located within an Airport Compatibility Zone. Agency Review • The project application materials were circulated to, Environmental Health, Public Works/Land Development, Agricultural Commissioner, Cal Fire/Butte County Fire, Assessor's Office and NAVFACSW Intergovernmental Branch AM -3. Notices regarding the 20 -day review period were mailed to landowners near the project site, and a notice was placed in the Chico Enterprise Record. Pursuant to California Public Resources Code Section 15073(d), the Department of Development Services determined that this project is not a project where one or more state agencies would be a "responsible" or a "trustee" agency or would exercise jurisdiction by law over natural resources affected by the project. Therefore, this project is not of statewide, regional, or areawide environmental significance. The initial study prepared for this project determined there may be potential environmental impacts to the following areas: • AestheticsNisual Resources • Agricultural Resources • Air Quality • Cultural Resources The initial study, which is attached to this agenda report, recommended six mitigation measures to reduce environmental impacts to a less than significant level. The collection of fees pursuant to Fish and Game Code Section 711.4 is required, prior to filing a Notice of Determination for the project, unless the project proponent provides verification from the California Department of Fish and Game that the project is exempt from the fee requirement. If a required fee is not paid for a project, the project will not be operative, vested or final and any local permits issued for the project will be invalid (Section 711.4 (c) (3)). Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. IV. The project is consistent with the following Telecommunication Facilities Standards and Requirements: A. Setbacks. 1. Generally, new telecommunication facilities shall be located on a parcel so that the distance from the base of facility to the parcel boundary is equal to or greater than the height of the facility.(Reduced setbacks are allowed in the agriculture zones and non-residential zones with conditions specified in 24-181 A.2 to A.4.) The monopole (130 feet) meets the necessary setback requirements from the property lines. Setbacks from the property lines, meeting or exceeding the height of the tower are: North — 169feet; South — 898 feet; East —153 feet; and West - 1, 796 feet B. Height. 1. The maximum height for telecommunication facilities in all zones shall be 100 feet, except in Commercial and Industrial zones where it shall be 150 feet. Section 24-181B.1 specifies that the review authority may approve additional height based on justifiable need. Because of the "line of sight" signal propagation limitation, the general result is that the higher the antennas are placed, the larger the `footprint" br service area of the cell. Towers are often built as much to provide additional capacityfor more users and more capability to process Internet data as for improved signal strength. In this case, the Chico River site is intended to improve signal levels along West Sacramento Avenue, River Road, Highway 32, and other areas between Chico and Hamilton City, as well as provide some capacity relief to the existing towers in the western part of Chico by shifting the traffic originating west of Chico to the new site and thereby freeing up resources for more users in Chico. The new site is designed to provide service for a minimum of two miles in all directions, and therefore a minimum of 130 feet is necessary. Regarding the specific parcel Verizon has selected for this project, it is ideal due to its location which is central to the intended coverage area. If it were to be further west, it would not only reduce its ability to provide capacity relief for the sites in Chico, but it would then be situated in a designated flood plain, which opens up a host of building and regulatory impediments. At the very least this would result in a requirement to construct the site, including the associated ground equipment, above the existing grade which would naturally increase the aesthetic impact of the project. If the site were to be placed further east, it may not provide the desired level of service along River Road and the Sacramento River, including recreational areas that are very popular with fishermen and rafters. Building the site significantly to the north or south of the selected location would result in a degradation of its ability to enhance coverage on Chico Highway 32 and/or Chico River Road, since the site was strategically placed between these two roads in order to be able to provide coverage to both. C. Monopoles or Towers. 1. New monopoles or towers proposed in or within 1,000 feet of agriculture and residential zones require written notice, in a manner approved by the Zoning Administrator, to be given to owners of parcels located within a minimum radius of 1,000 feet of the parcel on which the proposed monopole or tower will be located. Staff notified all parcels and tenants within 2,640 feet of the project parcel. 2. Monopoles or towers in agricultural or residential zones shall not exceed 30 feet in height except when: a. No feasible alternative site exists; b. In order to place the communication facility on the parcel, four orchard trees are proposed to be removed. This is a very small amount of the existing trees. It will not impact the viability of the agricultural operation. The project includes a mitigation that requires, if necessary, that the monopole be lit and striped per U.S. Department of Transportation Federal Aviation Administration Advisory Circular AC7017460-IK. This requirement is limited to marking and lighting design only. AG -2.5 When a request is made for a Conditional Use Permit on a lot(s) with existing agriculture operations, an agricultural maintenance plan to provide for the continuation of existing agricultural activities shall be submitted, in accordance with the Zoning Ordinance. The plan shall be reviewed for comments and conditions by the Agricultural Commissioner and Development Services prior to the Planning Commission hearing on the Conditional Use Permit. Agriculture, logging, mining, recreational vehicle use and other open space uses shall follow best management practices to minimize erosion and protect water resources. The project was reviewed by the Agricultural Commissioner and Development Services and it determined the proposed use was "de minimis ". Approximately 46.8 acres of the 48.77 acres site is used for agricultural production (orchard). The project site is not located with the Military Operations Areas. The project was sent to the NAVFACSW Intergovernmental Branch AM -3 for review and the responded there are no impacts to military. VI. Approves Use Permit UP13-0002 for Verizon, subject to the findings and conditions in Exhibit "A" A. If the facility becomes non-compliant, the owner shall cease to operate the facility and remove it from its location within 90 days of being informed that the permit has become invalid. C. All permits for telecommunication facilities, regardless of the method by which they were originally issued, may be extended administratively by the Zoning Administrator upon verification of the permit -holder's continued compliance with the findings and conditions of approval under which the application was originally approved. The Zoning Administrator may require a public hearing for renewal of a Conditional Use Permit for a telecommunication facility. D. Any painted surfaces are to be maintained during the life of this project. Plan Requirements: The note shall be placed on all building and site development plans. Timing: Requirements of the condition shall be adhered to throughout the life of the project. Monitoring: Department of Development Services shall ensure that this note is placed on all building and site development plans. Prior to issuance of a building permit, the applicant shall submit sample color chips to the Planning Division for review and approval. Mitigation Measure #2: The motion sensor lighting shall be fully shielded and directed downward so as to not create any glare or excess light on adjacent parcels. Mitigation Measure #3: Obstruction marking and lighting, consistent with the requirements (limited to marking and lighting design only of U.S. Department of Transportation Federal Aviation Administration Advisory Circular AC70/7460-1K, is required at the top of the tower, and shall have a flashing or steady burning light that is shielded from the ground to prevent visual impacts, unless the applicant can demonstrate that such measures are not required to ensure compatibility with established air navigation practices in the immediate area. Plan Requirements: Building and site development plans shall indicate the type of lighting proposed. Plan Requirements: The building plans shall identify the required design features required per this mitigation. Timing: The requirements of this measure shall be required prior to development. Monitoring: Department of Development Services shall review building plans to make sure tower satisfies the above requirement. 5. Mitigation Measure #5: Dust generated by the development activities shall be kept to a minimum with a goal of retaining dust on the site. Follow the dust control measures listed below: a. Water shall be applied by means of truck(s), hoses, and/or sprinklers as needed prior to any land clearing or earth movement to minimize dust emissions. b. Haul vehicles transporting soil into or out of the property shall be covered. c. A water truck shall be on site at all times during development activities. Water shall be applied to disturbed areas a minimum of two (2) times per day or more as necessary. d. On-site construction vehicles shall be limited to a speed of 15 mph on unpaved roads. e. Post a publicly visible sign with the telephone number and person to contact regarding dust complaints. This person shall respond and take corrective action within 24 hours. The telephone number of the Butte County Air Quality Management District shall be visible to ensure compliance with BCAQMD Rule 200 & 205 (Nuisance and Fugitive Dust Emissions). f. All visibly dry disturbed soil surface areas of operation shall be watered to minimize dust emissions. g. Existing roads and street adjacent to the project shall be cleaned at least once per day if dirt or mud from the project site has been tracked onto these roadways, unless conditions warrant a greater frequency. Should human skeletal remains be encountered, State law requires immediate notification of the County Coroner.
