Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Pine Ridge Park & Mini Storage is hereby granted a Use Permit to allow a 4,764 square foot expansion (50 storage units) to an existing mini storage. The storage units will range in size from 25 square feet (5 x 5) to 200 square feet (10 x 20). 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permitee consistent with conditions of approval herein, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permitee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permitee. ■ Butte County Department of Development Services ■ ■ July 25, 2013 ■ Agenda Report — UPI 3-0004 ■ Page 1 of 2 ■ 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. Prior to issuance of any permit on the project site, pay any outstanding project -related processing fees. 2. Storage of hazardous or acutely hazardous materials is specifically prohibited. Each lease/rental agreement shall include this restriction. 3. The proposed use will be designed to match the existing mini storage facility. Public Works 4. Prior to establishing use, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall detail existing drainage conditions and shall specify how drainage waters shall be detained or retained onsite and/ or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Building Division 5. Obtain building permits for the proposed building construction from the Butte County Building Division. Submit building plans and specifications prepared by a California registered design professional (engineer or architect) demonstrating compliance with the current California Building Code requirements. I hereby declare under penalty of perjury I have read the foregoing conditions, they are in fact the conditions which were imposed upon the granting of this use permit, and that I agree to abide fully by said conditions. ANALYSIS Land Use and Zoning • The parcel has a General Plan land use designation of Retail and Office. This designation allows structures and activities providing a full range of merchandise and services to the general public. • The parcel is zoned NC (Neighborhood Commercial). • The NC zone allows for retail and service uses that meet daily needs of nearby residents and workers. • The NC zone requires a conditional use permit for a Public/Mini Storage. • The project parcel is located in the Paradise Urban Area and is with the Town of Paradise's Sphere of Influence. • The nearest offsite residential dwellings are located to the west across Pentz Road and to the south. Existing RV spaces are located between the proposed mini storage expansion and to the residential dwellings to the south. • The project parcel is surrounded by residential zones, VLDR (Very Low Density Residential) to the west, east and south, and MDR (Medium Density Residential) to the north. • One oak tree, which has been determined by an arborist to be unsafe and should be removed regardless of the expansion of the mini storage facility, will be removed. General Plan Consistency • The project was reviewed for consistency with the policies of the General Plan. W -P3.3 The County shall protect groundwater recharge and groundwater quality when considering new development projects. No water or wastewater facilities are proposed needed for this project. COS -P1.1 Greenhouse gas emission impacts from proposed development projects shall be evaluated as required by the California Environmental Quality Act. COS -P7.5 "No new development projects shall occur in wetlands or within significant riparian habitats, except within the Butte Regional Habitat Conservation Plan (HCP) and Natural Community Conservation Plan (NCCP) Planning Area where such development is consistent with the conditions of the HCP/NCCP, upon the future adoption of the HCP/NCCP.*" The project site area has been used as R v space and does not have any identified wetlands in the project area. The location, size, design, and operating characteristics of the proposed use will be compatible with the existing and future land uses in the vicinity of the subject property. The proposed use, which will expand the existing mini storage facility by adding 4,764 square feet of storage space, is not unreasonably incompatible with, or injurious to, surrounding properties and uses. The project parcel is located on the east side of Pentz Road (a county -maintained paved road). No road or frontage improvements are required. The project frontage includes landscaping that will provide some visual screening along Pentz Road. The project would not introduce significant additional traffic to the area, as compared to trafficfor allowed uses in the zone. C. The proposed use will not be detrimental to the public health, safety, and welfare of the County. The project is considered exempt from the California Environmental Quality Act (CEQA) provisions under Categorical Exemption Class 3 (section 15303 of the CEQA Guidelines) New Construction or Conversion of Small Structures. The project proposes to expand the existing mini storage facility. It will add 4,764 square feet of storage space (50 units ranging in size from 50 to 200 square feet). D. The proposed use is properly located within the County and adequately served by existing or planned services and infrastructure. Implementation of the project would not require domestic water or wastewater treatment, or solid waste facilities. It would not be in conflict with any statutes or regulations relating to solid waste, nor would it employ equipment that would introduce interference into any system. The proposal would not result in an increase in demand for school facilities in the area. The project would not result in any impacts to area parks and facilities. E. The size, shape, and other physical characteristics of the subject property are adequate to ensure compatibility of the proposed use with the existing and future land uses in the vicinity of the subject property. The project size area for the proposed expansion is approximately 0.25 acres on an 8.67 acre parcel. The existing mini storage facility area is approximately 0. 52 acres. The overall area of the existing and proposed mini storage area will be less than 9% of the project parcel. The majority of the parcel is used as an RV park. The site is well vegetated to provide ample screening form Pentz Road and adjacent parcels. Only a minimal amount of vegetation will be removed to accommodate the expansion. The project, with project conditions, complies with the required findings to approve a conditional use permit. ENVIRONMENTAL REVIEW/CEQA ISSUES • The project site area has been previously disturbed and used as RV spaces. • This project has been determined to be exempt from the California Environmental Quality Act (CEQA) provisions under Categorical Exemption Class 3 (section 15303 (c) of the CEQA Guidelines) New Construction or Conversion of Small Structures: (c) A store, motel, office, restaurant or similar structure not involving the use of significant amounts of hazardous substances and not exceeding 2,500 square feet in floor area. In urbanized areas, the exemption also applies to up to four such commercial buildings not exceeding 10,000 square feet in floor area on sites zoned for such use, if not involving the use of significant amounts of hazardous substances where all necessary public services and facilities are available and the surrounding area is not environmentally sensitive. • The project site is located in the Paradise Urban Area and is within the Town of Paradise's Sphere of Influence. The proposed development would include three building, totaling 4,764 square feet. The storage spaces will range in size from 25 square feet to 200 square feet. • The proposed expansion of the mini -storage facility will not require wastewater or potable water. The project site is located in an area zoned for commercial use. Per the California Natural Diversity Data Base (CNDDB) there are no identified sensitive species within 0.5 miles of the site. The project will not impact any onsite or offsite environmentally sensitive areas. LOCAL AGENCY REVIEW • Comments/conditions received from Butte County Departments and other Agencies were reviewed and implemented into the proposed project conditions. PUBLIC COMMENT • Staff received one phone call from the property owner to the south. She voiced her concern about ongoing damage to their fence and their daughter's fence that separates the RV Park and their properties. She stated that moving trucks are using the existing access road (Manzinita Way) to the RV Park to access the existing mini storage facility. These trucks have caused damage to the fence which has had to repair. She is not against the expansion, but would like to eliminate the use of that access for the mini storage business Staff reviewed aerial photos and street view (Google Earth) to see the access. It appears as if the access was created to provide ingress for the RV Park. It is a narrow road, with a tight turn, that seems to be an area that would be difficult to maneuver large trucks or towed trailers. Staff was unable to determine if the damage is being caused by vehicles for the mini storage facility or the RV Park. The project is consistent with the following General Plan Policies: W -P3.3 The County shall protect groundwater recharge and groundwater quality when considering new development projects. No water or wastewater facilities are proposed needed for this project. COS -P1.1 Greenhouse gas emission impacts from proposed development projects shall be evaluated as required by the California Environmental Quality Act. Given the short-term duration and limited scope of the construction/development activities, the infrequent vehicle trips generated by the use, the project is not expected to generate greenhouse gas emissions, either directly or indirectly, that may have a significant impact on the environment. There are no adopted State or local regulations for greenhouse gas reduction with which the project could comply. The project will not conflict with any applicable plan, policy or regulation adopted for the purpose of reducing the emissions of greenhouse gases. COS -P7.5 "No new development projects shall occur in wetlands or within significant riparian habitats, except within the Butte Regional Habitat Conservation Plan (HCP) and Natural Community Conservation Plan (NCCP) Planning Area where such development is consistent with the conditions of the HCP/NCCP, upon the future adoption of the HCP/NCCP.*" The project site area has been used as RV space and does not have any identified wetlands in the project area. COS -P7.6 "New development projects shall include setbacks and buffers along riparian corridors and adjacent to habitat for protected species, except where permitted in the Butte Regional Habitat Conservation Plan (HCP) and Natural Community Conservation Plan (NCCP) Planning Area and where such development is consistent with the conditions of the HCP/NCCP, upon the future adoption of the HCP/NCCP.*" There are no riparian corridors on or adjacent to the project site. COS -P7.7 Construction barrier fencing shall be installed around sensitive resources on or adjacent to construction sites. Fencing shall be installed prior to construction activities and maintained throughout the construction period.* There are no sensitive resources on or adjacent to the project site area. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permitee consistent with conditions of approval herein, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permitee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permitee. .
