S I Project # UP16-0002 CUP Application — New Off -Site Si APN 025-240-090-000 d►°� -, Project Setting Description 10 UN 2016 r; tb7 r, Project Description Marin Ventures LLC ("Applicant") is requesting approval of a Conditional Use Permit to erect one (1) double faced, off-site sign, thirty five feet tall, along Hwy 70 at APN 025 240 090. The property is approximately 28.7 acres and is zoned General Commercial, with a General Plan designation of RTL. The property is bounded by Hwy 70 to the East, and South, Pacific Heights Road to the West and Vineyard Lane (private road) to the North. The only development on the property is a vacant concrete building pad and adjacent septic field at the far northwestern portion of the property. The balance of the property is unimproved. The property is generally flat with a slight downward slope at the far southernmost portion of the property. Please see attached site plan. Project Background The Applicant is requesting approval of a Conditional Use Permit to allow the construction, operation and repair of an Off -Site Sign along Hwy 70. The sign will provide off premises outdoor advertising opportunities for local and regional advertisers. Outdoor advertising drives sales, helps guide mobile consumers to goods and services and supports jobs. Most outdoor advertisements promote local businesses, thus increasing the local tax base and benefitting the local economy. The Butte County Zoning Ordinance Article 20 — Signs, allows for Off -Site Signs in the General Commercial Zone. Off -Site Signs are allowed up to 35' in height and 672 square feet in area. The proposed sign is 35' in height and 480 square feet in area. Article 20 - Signs, Section 24-102 Permit Requirements. Off -Site signs require Zoning Administrator Approval of an Administrative Permit, except as noted in Subsection (C) Zones Abutting Residential Zones, which requires a Conditional Use Permit for any Off -Site Sign on a Commercial Zone that abuts a Residential Zone. Zoning of adjacent properties: East (across Hwy 70) Resource Conservation (unimproved land with two existing double sided off-site signs) South & West (across Pacific Heights Road) AG20 (orchards) North (across Vineyard Lane), 3 parcels VLDR (each with single story SFD), 1 parcel GC (with single story SFD), 1 parcel REC-1 (Dingerville Golf Course). See attached Exhibit A. Section 24-102 is intended to protect the residential properties in close proximity to a proposed off-site sign from potential negative impacts. The Applicant's proposed off-site sign is located approximately 1,800 feet, (over 1/3 of a mile) away from the VLDR parcels to the north, and further from the actual structures. In other Counties in Northern California, when such a provision exists in the Zoning Ordinance, a qualifying distance is typically included in the text. For example, Mendocino County prohibits Off -Site Advertising Signs within 300' of a residentially zoned parcel. We have attached Exhibit B showing the location of the proposed off- site sign and the substantial distance to the residential zoned properties to the north. We have also enclosed Exhibit C which shows the perspective of the sign from the residential properties to the north. The potential impacts are de minimis. There is a recent precedent for an Administrative Approval under similar circumstances. Project Number ADM 15-0041, located at 3330 Highway 32, APN 042-060-082, received approval of a Permanent Sign Administrative Permit from Butte County for an off-site sign on January 4, 2016. Located north are two residentially zoned parcels: 042-060-076 zoned VLDR and 042- 060-010 zoned VLDR-2.5. These residentially zoned properties are approximately 696 feet and 805 feet from the approved off-site sign. We have attached Exhibit D, showing the location of the recently approved off-site sign in relation to the existing residential zoned parcels to the north. Off -Site Signs located adjacent to a State Highway are also under the jurisdiction of the California Department of Transportation, Outdoor Advertising Branch ("Caltrans"). Caltrans requires the approval of the local jurisdiction prior to submitting an application with Caltrans for an Outdoor Advertising Display Permit. In summary, the project is consistent with the goals, policies, general land uses and programs of the County's General Plan and the applicable provisions of the Zoning Code. The location, size, design and operating characteristics of the proposed use are compatible with the existing and future land uses in the vicinity of the property. The project will have no adverse effect on the public health, safety or welfare including the adjacent properties. The project is surrounded by Highways and Streets, with a small portion of the north east abutting adjacent parcels zoned GC, REC-1, and VLDR. The project is properly located within the County of Butte and adequately served by existing services and infrastructure. The size, shape, and other physical characteristics of the subject property are adequate to ensure compatibility of the proposed use with the existing and future land uses in the vicinity of the property. The project will not result in any significant environmental impacts that require mitigation and is categorically exempt from the California Environment Quality Act (CEQA) pursuant to Section 15303 (c). Therefore, findings could reasonably be made to support approval of our Conditional Use Permit.
