The following information is provided as a result of the inspection: The site is zoned FR -40 (Foothill Recreational, 40 acre parcels) with a General Plan Designation of Agricultural Residential. The property is 100 -acres in size, however the mine site is confined to an approximate 15 -acre area. The zoning and General Plan designation would allow for the creation of two 40+ acre parcels for residential or agricultural use. The area is identified as Scabland by Soil Conservation Service Maps. This soil unit is characterized by shallow (1 to 2 -inches) stony topsoil. The property is currently undeveloped with the exception of the mined area and access road. The site is secured by fencing and a gate. According to local information, the site was utilized by the operator to supply the Army Corps. of Engineers rip -rap material for projects on the Sacramento River during the 1970's. The main pit is characterized by a somewhat circular area about 8 -acres in size surrounded by 20 - 30 foot high cliffs. This area was excavated out and the cliffs remain. The cliffs appear to be quite stable owing to the solid composition of the rock. The floor of the pit site is relatively level with a good covering of native and invasive grasses. Two small ponds are present in the south area of the pit. Although no trees or shrubs are present, the grass cover is quite dense and no evidence of erosion is present. Drainage is contained within the pit site, and it appears that run-off accumulates within the ponds, which are confined by the cliffs. This site would be useful as open range or perhaps a feeding/watering station for cattle. No waste or abandoned equipment is present. Reclamation of the site has occurred naturally since originally disturbed. Although no formal reclamation plan was approved for this area, it appears that some grading on the pit floor occurred after mining operations were finished. Any further disturbance in this area for reclamation purposes would be counterproductive. The portion of the site closest to Cohasset Road appears to have been used as a staging and stockpile area. This area is about 7 -acres in size. The most prominent feature in this area is a cliff face. This cliff face is located on fill material which was removed from the pit site described above. The cliff formed on the loose, unconsolidated fill material through natural means, and from material being removed during the years. Below the cliff face is several small stockpiles of rip -rap and loose material. Another small cut into this material is located to the northeast of the access road. Both of these areas are features that should be laid back further to conform to a 2:1 slope according to Butte County Public Works. This will provide a safe slope and enhance visual continuity with the surrounding area. Another site that buttresses the cliff appears to be stable at an approximate 1:1 slope and should not be disturbed, since natural vegetation has successfully stabilized the site. This area is also devoid of any waste materials or abandoned equipment. Several large tires have been left on the higher part of the site, closer to the pit, and should be removed. Reclamation of this area should involve laying back the unstable cliff and all areas exceeding 1:1 slope. to achieve a 2:1 slope, smoothing out hummocks left from various stockpiles, scarifying compacted areas and reseeding and planting, possibly, with digger pine, a species that appears to grow successfully on the disturbed areas of the site already. Public Works recommends that the any left over stockpiles be plowed back into the cliff site to aid final slope configuration. It is not recommended that the access road be reclaimed as this road provides access to the 100 -acre property and any uses that may be developed in the future. No topsoil was conserved from previous mining activity. However, some of the unconsolidated fill material may be usefull as a topsoil on areas which will be reseeded. This area could support a building site as a final use, if water and sewer service can be provided. Recommendations discussed in this informal field visit should be certified by a Registered Professional Engineer. Planning Division staff recommends that a closure plan be developed by the landowner, taking into account recommendations outlined here. This plan must be made to conform to SMARA standards to the satisfaction of the County and the Department of Conservation, Office of Mine Reclamation. d ..";State of Califomia I DEPARTMENT OF CONSERVATION 1998 MINING OPERATION ANNUAL REPORT MRRC-2 Page 1 (Revised 04/99) r • CA MINE ID# MINE NAME COHASSETTE MINE 1. The site visit was made to determine what work was necessary to close the site in accordance with SMARA. Public Work's was a customer at this site, which involved the removal of stockpiled rip -rap for flood control and repair projects. However, Public Works did not actively mine the site. The site is zoned FR -40 (Foothill Recreational, 40 acre parcels) with a General Plan Designation of Agricultural Residential. The property is 100 -acres in size, however the mine site was confined to an approximate 15 -acre area. According to Jim Shultz, the site was utilized by the operator to supply the Army Corps. of Engineers rip -rap material.for projects on the Sacramento River during the 1970's. Drainage iscontained within the pit site, and it appears that run-off accumulates within the ponds, which are confined by the cliffs. Below the cliff face is several small stockpiles of rip -rap and loose 0 material. Another small cut into this material is located to the northeast of the access road. Both of these areas are features that should be laid back further to conform to a 2:1 slope according to Public Works. Reclamation of this area should involve laying back the unstable cliff and areas exceeding 1:1 slope to a 2:1 slope, smoothing out hummocks left from various stockpiles, scarifying compacted areas and reseeding and planting, possibly with digger pine, a species that appears to grow successfully on the disturbed areas of the site already. U. NOT APPLICABLE -►' o s 29..Describe how reclamation of this site in this manner may affect future mining at 'this site and in the surrounding area. The quarry could be reactivated relatively simply since reclamation will not substantially overcover the rock being mined, but will instead involve primarily those. areas from which the rock has previously been extracted. SUPPLEMENTAL"INFORMATION ITEM No. 27 (a) There will be not substantial backfilling since all materials being quarried are marketable. Grading will consist of leveling and surfacing' mined areas and former stockpiling areas to create.a level to the rolling topography. (b) Loose rock will be scaled and over hangs will be eliminated. (c) Since all materials being.quarried are marketable no permanent waste dumps will be necessary. (d) Not applicable. It is not anticipated that drainage courses will. be impacted. .(e) The jaw -type rock crusher used for crushing and..separating the rock will be removed by the operator when quarrying activities have ceased. (f) Not potential contaminants are known. '(g) Not applicable. (h) The quarry is 'located on private property and access will be controlled by fences and a locking gate across the access road. No hazardous slopes will be left. .(i) Native grasses and ground cover have'begun to reestablish themselves within the short period since operations.were halted. CHICO PARADISE 191.-E. Woods - Luhr's Rock Quarry, AP 47-23-36 July 15, 1981 I have reviewed the reclamation plan and the environmental information form supplied me by Mr. Woods. I have also looked at the site on the ground. It appears to me that the application meets the requirements of the Surface Mining and Reclamation Act. I would suggest, however, that all crushing, loading and weighing operations be conducted on the existing pit site to reduce the noise level sometimes found in other similar operations. I believe this is the plan and is agreeable to the applicant. I would recommend that you further process this reclamation plan and I will be available to speak to the requirements if you would like. Would you notify me and Mr. Woods of the next step in the process. I will send a copy of this plan to the state geologist which is required by state law. A copy of this letter will be sent to Mr. Woods with a receipt for his $25.00 check for the reclamation fee. Jane Dolan Butte County Board of Supervisors 25. County Center Drive Oroville, CA 95965 Dear Chairwoman Dolan: Plannin ®'vision :AUG 2 3 1999 Orovl 9, a* ornia As you may know, the County of Butte operates at least one surface mine that is subject to the Surface Mining and Reclamation Act (SMARA). Under the requirements of SMARA, all mines in the state, whether operated by public or private entities, must have a lead agency approved reclamation plan and financial assurance for reclamation. According to information in our files, Butte County maintains a mining operation, located on Cohasset Road approximately 5 miles north of Chico, that lacks an. approved reclamation plan and/or financial assurances. Over the last two years, the Department of Conservation has stepped up its enforcement efforts in an attempt to improve SMARA compliance statewide. These efforts have included the issuance of numerous administrative penalties and several closure orders for non-compliant operations. The Department is reluctant to take enforcement actions against another government agency without significant cause. If our records are in error, please provide the Department with written documentation of an approved reclamation plan and financial assurance for the mine in question. If this mine is not compliant with SMARA, please submit an explanation of what efforts the County is making towards bringing the . subject operation into full SMARA compliance, and a detailed timetable identifying anticipated milestone dates towards reclamation plan and/or financial assurance compliance. In the interest of fairness to the hundreds of private mining operations ;W, 0 The Honorable Jane Dolan August 18, 1999 Page Two 0; that have complied with SMARA, and in keeping with the spirit and intent of the law, the Department also expects that Butte County will voluntarily cease operations at non- compliant mines until such time that compliance is attained. I urge you to take this matter seriously, and to encourage County staff to take immediate steps to notify us regarding the status.of the subject mine in question, and whatever actions are necessary to achieve compliance. Otherwise, in the interest of our statutory obligations and of sound public policy, the Department may be compelled to initiate enforcement actions against Butte County. County Center Drive Oroville, CA 95965 Dear Chairwoman Dolan: v As you may know, the County of Butte operates at least one surface mine. that is subject to the Surface Mining and Reclamation Act (SMARA). Under the requirements of SMARA, all mines in the state, whether operated by public or private entities, must have a lead agency approved reclamation plan and financial assurance for reclamation. According to information in our files, Butte County maintains a mining operation, located on Cohasset Road approximately 5 miles north of Chico, that lacks an approved reclamation plan and/or financial assurances. If our records are in error, -please provide the Department with written documentation of an approved reclamation plan and financial assurance for the mine in question. If this mine is not compliant with SMARA, . please submit an explanation of what efforts the County is making towards bringing the subject operation into full SMARA compliance, and a detailed timetable. identifying anticipated milestone dates towards reclamation plan and/or financial assurance. compliance. In the interest of fairness to the hundreds of private mining operations The Honorable Jane Dolan August 18, 1999 Page Two that have complied with SMARA, and in keeping with the spirit and intent of the law, the Department also expects that Butte County will voluntarily cease operations at non- compliant mines until such time that compliance is attained. I urge you to take this matter seriously, and to encourage County staff to take immediate steps to notify us regarding the status.of the subject mine in question, and whatever actions are necessary to achieve compliance. Otherwise, in. the interest of our statutory obligations and of sound public policy, the Department may be compelled to initiate enforcement actions against Butte County. I appreciate your prompt attention to this matter. If you have any questions regarding this issue or SMARA compliance in general, please don't hesitate to contact our Office of Mine Reclamation at (916) 323-9198. The issue of discussion: OMR has stated Butte County is out of compliance with the Surface Mining Aggregate Reclamation Act (SMARA) because the County has used resource material from a Cohasset Road site without having a Lead Agency approved Reclamation Plan and financial assurance for surface mining activities. Staff has held discussions with the Director of Public Works, Mike Crump, and the Emergency Services. Officer, Mike Madden. Mr. Crump has stated the County has used material from the Cohasset site onlw during times of emergencies. Butte County has experienced such emergencies each winter for the past several years. The County has experienced calamities demanding timely and expeditious response including, but not limited to the following: collapsed bridges, weakened and breached levies, collapsed dams (Okie Dam on Butte Creek), widespread flooding resulting in damaged roads, inundated farms and orchards, and extensive loss of crops and property. The County, under the direction of the Director of Public Works, the Director of the Office of Emergency Services, and other County officials, have worked tirelessly in meeting these disasters. During these emergencies -- officially declared emergencies by the County Board of Supervisors, and by Governor Pete Wilson -- these County - officials have occasionally taken rip rap or other material from the Cohasset site. This was done with the landowner's permission, and only under declared emergency conditions. In a recent telephone conversation with Mike Madden, the Director of Emergency Services indicated his office=had the authority to take material where and when necessary under a declared emergency situation. Mr. Madden stated that the Thomas B. Stafford Act, Title VII, the Governor's Directive temporarily suspending SMARA requirements., and SMARA Section 2714(a) all gave his office the authority to take such action, as determined to be.necessary, when and where such material is available, and not be subject to SMARA requirements. Staff is currently in the process of revising the County Mining Ordinance and has been given direction to include in the revisions, provision for obtaining and providing mining resource material above and beyond Use Permit/Mining Permit conditions/limitations for any given operation, during times of emergencies. Also, wording is to be included which provides for the extraction of resource material from non -permitted sites under emergency circumstances. The County's proposal to provide for emergency extraction of resource material from nonpermitted sites is based on Section 2714(a) of SMARA, which reads: §2714. This chapter does not apply to any of the following activities: (a) Excavations or grading conducted for farming or onsite construction or for the purpose of restoring land following a flood or natural disaster. [Staff's highlights] Staff understands the word or to be a significant conjunction which clearly separates distinctly different uses and different purposes. The highlighted portion of this section addresses in general terms lands in need of restoration due to emergency situations -- not specific onsite restoration only. In other words, if a parcel next to the Sacramento River is in threat of being flooded because a levee is about to be breached, the County may pull rip rap material from the nearest source -- albeit offsite -- and deliver it tc that parcel to reinforce the levee. OMR staffs position, according to our telephone conversations, is that this section only applies to excavating material from the threatened or affected parcel for levee repair. This would seem to be a very narrow interpretation of the statute which would severely limit local jurisdictions from providing needed disaster relief and protection of life and property. What if the necessary material, rip rap, gravel sand, whatever, is not available from onsite sources? How then does the County respond to that farmer or homeowner, and to the greater community, if the levee should break and the County did not do everything it could to prevent the disaster? The County of Butte continues to make every effort to comply with SMARA requirements. An example of this effort is the County's Almond Avenue mining site reclamation plan, in which the Department of Public Works has responded to OMR's request for a reclamation plan. Presently, the County has contracted with NorthStar Engineering to prepare the Reclamation Plan. The draft plan is expected at the end of June 1998. The County will continue to work with the OMR in meeting its obligations in mining related matters. At the same time, the County has a duty to do what it can to protect its citizens in times of natural disasters. We look forward to any comments you may have concerning our interpretation of SMARA requirements. The issue is one that may need to be taken a step further as it relates to long-term policy matters which may impact the health and safety of County residents. All of the provisions of Article 9 "Reclamation Standards" appear to have been satisfied here. ITEM 2: STOCKPILE AND STAGING AREA This area of approximately 7 acres appears to have had overburden and native rock mixed in unconsolidated zones. on solid underlying rock. The stability of this fill material graded to no steeper than a 2:1 slope should be adequate, provided no urban use or structural foundation occurs on or immediately adjacent to this area. Slopes will be flattened to a 2:1 (1 foot vertival on 2 feet horizontal) in all areas where no natural revegatation has occurred. All areas of reshaped slopes and old stockpiles will be smoothed, scarified and seeded using indigenous species consistent with the time of year to achieve self - regeneration without irrigation or fertilizers. Existing loose rock will be included with fill material near the toe of the unconsolidatad material slopes to act as a filter for storm water runoff and as a stabalizing berm. Caution should be excercised in performing the laying back operation with any zones of unstable material being removed, distributed and prepared for seeding. Species richness will be as required to attain sufficient long term erosion control from the effects of surface runoff. Fertilizers and mulch will be included in the initial seeding of disturbed areas. ITEM 3: ACCESS ROAD The access road will remain in it's current condition and not require any further remediation to conform with SMARA. A check for $150 is also enclosed as the annual report fee for 1996, 1997, and 1998. Please be advised that no mining operation or production is currently underway, nor has one existed since 1974 on the parcel of land at issue. I have no intent to resume any mining operation. Before January 1, 1976, rock was extracted at the site, but no rock has been extracted since that time. Therefore, any acreage disturbed was vested pursuant to the Reclamation Act. During 1996 and 1997, Butte County Public Works and others were allowed to remove loose rock from the site. This rock was extracted from mining operation during or before 1974. In 1974, the mine was closed with no intent to resume. The fee paid by the Butte County Public Works and others was approximately $2 per ton for a total of $2755.25 in 1996 and $3379.45 in 1997. Rock was not sold in 1998. . For the 1996, 1997, and 1998 Annual Report, there is no company that operates the site, there is no designated agent in California, and there is no owner of a mining operation because a mining operation did not exist during those years. As for the fee determination for the 1996 Annual Report, no rock was produced from the site during that year. The loose rock that was sold was produced prior to January 1, 1976. Therefore, I am enclosing a $50 fee for that year pursuant to Exhibit C, Category 1, Code A. As for the fee determination for the 1997 and 1998 Annual Report, no rock was produced from the site during those years. The loose rock that was sold in 1997 was produced prior to January 1, 1976. Rock was not sold during 1998. Therefore, I am enclosing a $50 fee for 1997 and a $50 fee for 1998 pursuant to Exhibit C, Table 1, Code B. The mining operation has ceased with no intent to resume, there is no production for the year, and a lead agency has not certified that reclamation is complete. This is due to the fact the any disturbed acreage was vested. In addition, please be advised that the filing fee is merely being paid as a result of compliance efforts pursuant to your letter. My contention is that no mining operation nor production was underway at the site during 1996 and 1997. Thus, the filing of an annual report is not required. Again, the loose rock that was sold during 1996 and 1997 has existed on the site since 1974. If it is determined that a mining operation does not exist at the site, I respectfully request the refund of the filing fee in full. If this mine is not compliant with SMARA, please submit an explanation of what efforts the County is making towards bringing the subject operation into full SMARA compliance, and a detailed timetable identifying anticipated milestone dates towards reclamation plan and/or financial assurance compliance. While we appreciate the reasoning behind the County's interpretation of Public Resources Code (PRC) Section 2714(a), our office respectfully disagrees. As stated previously, the Governor's Executive Order and Proclamation of Emergency are suspensions of SMARA, not exemptions. While these orders suspend the immediate need for permits, reclamation plans and financial assurances prior to obtaining material, it is our opinion that any sites opened under these emergency situations are ultimately subject to reclamation. Additionally, you have stated that this site has been used several times under the emergency scenario. It would appear that the County is maintaining a mining site which could and should be in compliance with SMARA for future needs. I agree that this issue is one that needs to be taken a step further. I forwarded a copy of your letter to the State Mining and Geology Board and the Department's legal office. I urge the County to contact the Board directly regarding the County's interpretation of SMARA requirements and proposed mining ordinance revision. As we have discussed, your draft appears to be a clear and concise statement of the position taken by Butte County. Hopefully, it will elicit a helpful response clarifying the position of the Department of Conservation. I am not at this time expressing a legal opinion as to the correctness of the County's position; however, a cursory reading of the excerpt from Public Resources Code Section 2714(a) indicates that an interpretation broader than the state's apparent interpretation seems possible. On the other hand, the State may be correct in interpreting the provision where a location is repeatedly used over a period of years to extract material for off-site use, even though the use is for emergency purposes. I will be interested to learn what the State's interpretation will be, both in general and as applied specifically to the Cohasset site. The issue of discussion: OMR has stated Butte County is out of compliance with the Surface Mining; Aggregate Reclamation Act (SMARA) because the County has used resource material from a Coha3set Road site without having a Lead Agency approved Reclamation Plan and financial assurance for surface mining activities. Staff has held discussions with the Director of Public Works, Mike Crump, and the Emergency Services Officer, Mike Madden. Mr. Crump has stated the County has used material from the Cohasset site only during times of emergencies. During these emergencies -- officially declared emergencies by the County Board of Supervisors, and by Governor Pete Wilson -- these County officials have occasionally taken rip rap or other material from the Cohasset site. This was done wish the landowner's permission, and only under declared emergency conditions. In a recent telephone conversation with Mike Madden, the Director of Emergency Services indicated his office had the authority to take material where and when necessary under a declared emergency situation. Mr. Madden stated that the Thomas B. Stafford Act, Title VII, the Governor's Directive temporarily suspending SMARA requirements, and SMARA Section 2714(a) all gave his office the authority to take such action, as determined to be necessary, when and where such material is available, and not be subject to SMARA requirements. The County's proposal to provide for emergency extraction of resource material from nonpermitted Bites is based on Section 2714(a) of SMARA, which reads: §2714. This chapter does not apply to any of the following activities: (a) Excavations or grading conducted for farming or onsite construction or for the purpose of restoring land following a flood or natural disaster. [Staff's highlights] Staff understands the word or to be a significant conjunction which clearly separates distinctly diffeoent uses and different purposes. The highlighted portion of this section addresses in general terms lanes in need of restoration due to emergency situations -- not specific onsite restoration only. In other words, if a parcel next to the Sacramento River is in threat of being flooded because a levee is about to be breached, the County may pull rip rap material from the nearest source -- albeit offsite -- and delive, it to that parcel to reinforce the levee. OMR staffs position, according to our telephone conversations, is that this section only applies to excavating material from the threatened or affected parcel for levee repair. This would seem to be a very narrow interpretation of the statute which would severely limit local jurisdictions from providing needed disaster relief and protection of life and property. What if the necessary material, rip rap, gravel, sand, whatever, is not available from onsite sources? How then does the County respond to that farmer or homeowner, and to the greater community, if the levee should break and the County did not do everything it could to prevent the disaster? The County of Butte continues to make every effort to comply with SMARA requirements. An example of this effort is the County's Almond Avenue mining site reclamation plan, in which the Department of Public Works has responded to OMR's request for a reclamation plan. Presently, the County has contracted with NorthStar Engineering to prepare the Reclamation Plan. The draft plan is expectec at the end of June 1998.
