The Commission waived the reading of the Staff Findings. The hearing was opened to the public. Ralph Schaefer agreed with the conditions. Chairman Lynch complimented the applicant on his plot plan. Greg Stanley was concerned with the cost of removal of the mobile home being more than the requested $2000 bond or deposit. Chairman Lynch said the bond is for payment to the County if the County has to move the mobile home. If the cost is higher than what is received the applicant will be billed for'the expense. Mr. Stanley said when the Use Permit is up and the mobile home is removed, what happens to the second septic system if the property is sold. He wanted to know if another temporary mobile home could be moved onto the property. Chairman Lynch said this would take a new application -and the new owner would have to go through this process again. Mr. Stanley said he did not object to the temporary mobile home for 2 or 3 years for Bernice Fulton, but he did not want it there for 6-10 years or longer. Commissioner Forbes said anyone in the future can apply. Commissioner Walter said there is an existing ordinance for approval of this type of permit. Mr. Stanley was concerned with enforcing the conditions of the use permit. 'He was concerned with the mobile home becoming permanent. He asked if the property is sold does the septic and electrical have to be removed. Commissioner Forbes said the Commission was concerned with only the issue before them. Mr. Stanley said that once this is allowed it opens the door for more in the future. He said he lives there and has to plan for the future. BUTTE COUNTY PLANNING COMMISSION MINUTES -`December 22, 1988 t Commissioner Lambert said it was difficult to deny this request. She ~ said she would not approve this as a permanent second dwelling. Staff said it was the policy of the Board of Supervisors to allow the temporary residence consideration throughout the County. Mr. Stanley asked to be advised of the renewal meeting. _ Chairman Lynch said the renewals come in on the consent agenda and are not a noticed public hearing. Mr. Schaefer said he was aware of Mr. Stanley's concerns. He said it might help in the future to have a condition on the size and quality of the mobile home being installed. Staff said the only requirement is that the mobiles meet the 1976 HUD standards. The hearing was closed. Commissioner Walter had no problem with the project. Chairman Lynch said the safeguards are there to prevent an abuse of the situation. Commissioner Lambert had no problem with this application. It was moved by Chairman Lynch, seconded by Commissioner Forbes, and unanimously carried for approval as follows: A. Note that this project is categorically exempt form environmental review; and B. -Find that this proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental•to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County; and C. Approve the Use Permit to allow a temporary mobile home as a second dwelling on AP 41-10-36 (Bernice Fulton) subject to the following conditions: 1. Occupancy of the mobile home is limited to Bernice Fulton. 2. No rent is to be charged to the occupant of the mobile home 3. Install sewage disposal system under permit and inspection from .the. The Butte County Department of Public Works and the Butte County Environmental Health Department had no objections or comments other than the conditions listed below. ANAT.VCTC This project is a request to place a mobile home as a temporary second dwelling on property located approximately 1/4 mile north of the end of Williams Road, in the area west of Butte College, north of Pentz Road. 1 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - December 13, 1988 The proposed second dwelling will be located approximately 50 feet south of the primary dwelling on the property and approximately 900 feet from the nearest neighboring residence. As such, this project would not conflict with neighboring uses nor cause any undue hardships. Domestic water is to be supplied to both mobile homes by the same well and sewage disposal will be by a separate septic system for each dwelling. The primary dwelling is to be occupied by W. Ralph Schaffer and his family and the temporary mobile home will be occupied by Bernice C. Fulton who is also the owner of the property. Mrs. Fulton is the mother-in-law of Mr. Schaffer. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to ensure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double -wide mobile home. These amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers. The applicant proposes to place a double -wide mobile home on the property. Recommendations: A. Note that this project is categorically exempt from environmental review; and B. Find that this proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County; and C. Mrs. Fulton is now deceased with her daughter, Joanne F. Schaefer (my wife), designated as the executrix of her -estate. The referenced dwelling is no longer being used as a residence. It is now used as my personal office/library and as display and storage space for Joanne's and my collections and memorabilia. It does provide one guest bedroom, an expansion to our main house, but the kitchen has now been disabled. I feel that it is now appropriate to close your file on what was the prior use. I will be communicating with the Building Division to formalize this change in use. Staff said the issue of temporary mobile homes will be discussed in more detail at the end of the meeting. Commissioner Bergman asked what does temporary mean? Staff indicated that the purpose of the section is to allow care to be provided for someone unable to care for themselves. It is the intent of the section to have the mobile home removed when care is no longer needed. The older permits were not required to bond for removal. If the occupancy changes, the applicant would have to apply for a new Use Permit. Commissioner Nelson said some of the renewals are for daughters of the applicants and he questioned if this was proper? Staff said yes, it can be a relative or close friend, however the permit is supposed to be for a disability or caretaker type provision. Commissioner Bergman said he thinks this provision is developing into something contrary to the Zoning Ordinance. He asked if there was any requirement for a doctor's certification as to the disability? Staff indicated that an affidavit was required indicating that there is a disability. Staff said more details will be discussed later in the agenda under the Miscellaneous item. Chairman Lambert reiterated that the item will be discussed, in detail, later on the agenda. These renewals are the same as the Commission has been approving, and she would hesitate to change the process -today. She said she agrees the Commission should furhter discuss the issue. It was moved by Commissioner Bergman, seconded by Chairman Lambert, to have more discussion and action on the consent agenda to be discussed with the miscellaneous item at the end of the meeting. Commissioner Lynch felt that a commitment has been made by the County to allow these Use Permits and to allow for their renewal. Commissioner Bergman said it is within the power of the County to condition renewals. He said the ones that were not bonded, should be bonded before renewal and the renewal applicant should have to prove the disability. Chairman Lambert said she would hesitate to deny these renewals. Commissioner Nelson said he did not mind discussing these later. He said one of the problems is that there are similar renewals currently being processed at the Planning Office that will be on the next agenda and any decision on these renewals could have an affect on them too. Commissioner Lynch said the Commission will have to involve the Board of Supervisors to change the Ordinance in order to require bonds and medical certificates. He did not think they should hold up the current renewals. Staff said renewal is a discretionary action. The Ordinance is silent as to requiring medical proof. Staff suggested the Commission consider these renewals on their merits as they have done in the past and noted that according to the way the ordinance is written, renewals are adopted by Use Permit. It does not give the Planning Commission the authority to add conditions without going through the use permit process, but does allow the Commission to approve or deny renewals. Commissioner Bergman withdrew his motion and Chairman Lambert withdrew her second. It was, moved by Commissioner Bergman, seconded by Commissioner Ferguson, and unanimously carried to approve the renewals.
