The Commission waived the reading of the Staff Findings.
Commissioner Lambert asked about the agreement with the Building Department to
remove the mobile home?
Staff said the mobile home was temporary while building a conventional home. Staff
said the applicant would like to keep the mobile home as an "Aunt Minnie" now_ that
the residence is finished.
The hearing was opened to the public.
Richard Watt said he agrees with the conditions.
The hearing was closed.
It was moved by Commissioner Matson, seconded by Commissioner Lambert, and
unanimously carried for approval as follows:
A. Find that the project is Categorically Exempt from environmental review; and
B. Find that the proposed use of the property will not impair the integrity and
character of the zone in which the land lies and that the use would not be
unreasonably incompatible with or injurious to surrounding property, or detrimental
to the health, safety, and general welfare of the persons residing or working in the
neighborhood or to the general health, welfare and safety of the County, because
it meets the Aunt Minnie regulations; and
C. Grant the Use Permit to allow a temporary mobile home as a second dwelling on
AP 055-300-111 (Richard and Audrey Watt) subject to the following conditions:
1. Occupancy of the mobile home is limited to Ms. Lillie Dickson.
2. No rent is to be charged to the occupant of the mobile home.

requirements of Section 24-304 of -the Butte -County -Code.
5. The Use Permit shall expire two years from the date of issuance of the Use
Permit. Upon application, the Planning Commission may grant an extension
of the Use Permit not exceeding one year.
6. In the event that the applicant who is residing within the mobile home or
the conventional residence, for any reason, moves to another location or is
deceased, then in that event, the Use Permit granted herein shall
automatically expire and the mobile home shall be removed within one
hundred twenty (120) days. In the event the mobile home is not removed
within one hundred twenty (120) days pursuant to the terms of the Use
Permit, the County shall remove the mobile home and store it at the
owner's expense.
7. The applicant is to pay a deposit or post a bond to cover the cost of
removal in the amount of $1,500.00 for a single -wide mobile home $2,000.00
for a double -wide mobile.
8. Meet the requirements of the Building Division of the Butte County
Department of Development Services.
9. Must be a mobile home certified under the National Mobile Home
Construction and Safety Standards Act of 1974.

STAFF FINDINGS - September 30, 1992
ANALYSIS:
The applicant is requesting approval of a Use Permit to allow a temporary mobile home to
be located at 4885 Pentz Road. The mobile home is actually installed and occupied at this
time. Building Permits have been issued and a three-bedroom house is also under construction
on this property. A Building Department Agreement is in place that requires the mobile
home to be removed prior to the final inspection of the new home. Approval of this request
would allow the mobile home to remain. Occupancy for the mobile home is proposed for the
applicant's mother, Lillie Dickson.
Butte County Code Section 24-303 recognizes the need for temporary second units for the care
of persons who by old age, disease, infirmity, or other causes that require additional assistance
from family members. Section 24-303 further states "The ability to care for one's close
relatives will not only result in better care for citizens, but will also negate in many situations
the necessity for public assistance which many citizens find degrading and damaging to the
pride of the persons concerned and their immediate relatives. This will also provide privacy
and dignity for the relative as well as independence, of which these people are deserving."
In some cases, a "custodial care provider" may be the only means of implementing this section.
Butte County Code Section 24-304 provides for removal of the mobile home within 120 days
of the time that it is no longer being occupied pursuant to the code section. The Code also
makes provision for the County requiring a bond or deposit at the time of application of
sufficient size to cover the removal expense of the mobile home. This is to insure that the
taxpayers at large (via the General Fund) are not charged those expenses should the County
be forced to remove the mobile home pursuant to the code. Of course, if the applicant
removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly,
if the County removes the mobile home, then only charges actually incurred would be
reimbursed from the bond or deposit with the remainder being returned to the applicant. A
survey of several mobile home dealerships in Butte County has indicated a rather wide range
of estimated costs of removal. Cost, of course, would vary due to installation of landscaping,
decks, awnings, and physical site characteristics. Taking the median figures and adding a small
amount for administrative costs and storage costs, it appears that a reasonable deposit would
be $1,500 per single -wide and $2,000 for a double -wide mobile home. These amounts seem
reasonable to ensure that the mobile home is removed at no cost to the County or the
taxpayers. The applicant proposes to place a single -wide mobile home on the property.
The proposal has been identified as a Class 3(a) Categorical Exemption from the provisions
of the California Environmental Quality Act (CEQA).
RECOMMENDATIONS:
A. Find that this project is Categorically Exempt from environmental review; and

The Board of Supervisors has found that for the health,. safety and welfare of the people of the County that it
has often become necessary, for the care of persons who by reason of old age, disease (either mental or
physical), infirmity or other cause, are unable, unassisted, properly to manage and take care of themselves
or would benefit from familial assistance, to allow mobile hones to be placed on smaller parcels than present
County codes or ordinances permit so that such persons will not have to be institutionalized, but rather can

BUTTE COUNTY PLANNING DEPARTMENT
NOTICE TO ALL APPLICANTS
Effective July 2, 1985, the project review procedure for Use
Permits and Variances was revised by the Board of Supervisors. The
Planning Department will no longer process an application for a Use
Permit or Variance without a review by both the Butte County
Environmental Health Department and the Butte County Department of
PUblic Works, Land Development Section.
Prior to the formal application to the -Planning Department for a
Use Permit or Variance, the applicant must provide the necessary
information to the Environmental Health Department, Land
Development Division, .and Planning Department to -ensure compliance
with appropriate ordinances. Effective June 21, 1988, all
information -required from an applicant in order to -process his pre -
application must be submitted with six(6) ._months from the date
this initial .pre -application -was- submitted -.to 'the Planning
Department.
Upon tentative approval of a land Use Permit or_ Variance by the
Environmental Health Department and Land Development Division of
the Department of Public Works, the applicant must submit a'
completed formal application including any required changes from
the original submittal and the balance of the fees. Effective June
21, 1988, this must be completed within six (6) months of the
tentative approval.
The information required for the pre -application review for the Use
Permit or Variance .is identical with that which is required for the
final application, and unless modified during the pre -application
review will be used for the application for the public hearing.
The request for the pre -application review must be accompanied by
fees in the amount of $252.00 plus $53.00 for each hour of work in
excess of one hour performed by a sanitarian for a Use Permit; and
$192.00 plus $53.00 for each hour of work in excess of one hour
performed by a sanitarian for a Variance.

On November 12, 1992, the Butte County Planning Commission renewed your permit for
a temporary second living unit on your property. Section 24-304, as amended, of the
Butte County Code provides that your permit shall be only for a term of one year, and
must be renewed annually if the use is to continue.
Effective July 12, 1993, the Butte County Board of Supervisors adopted an annual renewal
fee of $50.00 for temporary second dwellings.
Inasmuch as your renewal expires on December 1, 1994, you are hereby advised to apply
for a renewal. Please complete the enclosed renewal form and return it to this office with
your check in the amount of $50.00 made payable to the Butte County Treasurer.

area, was approved subject to the following conditions:
1. Occupancy of the mobile home is limited to Ms. Lillie Dickson.
2. No rent is to be charged to the occupant of the mobile home.
3. Meet the requirements of the Butte County Environmental Health Department for
domestic water supply and sewage disposal.
4. The mobile home is to be a temporary use on the property pursuant to the
requirements of Section 24-304 of the Butte County Code.
5. The Use Permit shall expire two years from the date of issuance of the Use
Permit. Upon application, the Planning Commission may grant an extension of
the Use Permit not exceeding one year.
6. In the event that the applicant who is residing within the mobile home or the
conventional residence, for any reason, moves to another location or is deceased,
then in that event, the Use Per;mit granted herein shall automatically expire and
the mobile home shall be removed within one hundred twenty (120) days. In the

the amount of $1,500.00 for a single -wide mobile home $2,000.00 for a double -
wide mobile.
8. Meet the requirements of the Building* Division of the Butte County Department
of Development Services.
9. Must be a mobile home certified under the National Mobile Home Construction
and Safety Standards Act of 1974.
10. Applicant must also comply with all other applicable State and local statutes,
ordinances,. and regulations.
Should you desire to appeal any of the conditions imposed by the Planning Commission,
you must do so in writing with the appeal fee of $516.00, to the Clerk of the Board of
Supervisors, 25 County Center Drive, Oroville, California, prior to 5:00 p.m., Friday,
November 20, 1992. If you do not appeal and if there are no other appeal within the
8 -day appeal period, your use permit will be issued after November 20, 1992.
Recently enacted legislation (AB 3158, Chapter 1706, Statutes of 1990, effective January
1, 1991) requires that the Department of Fish and Game impose and collect filing fees
as specified to defray the cost of managing and protecting fish and wildlife trust
resources. These filing fees are collected during the environmental review process and
are to be paid at the time the County files a "Notice of Exemption" with the County
Clerk pursuant to Section 21152 of the Public Resources Code.
To increase administrative efficiency, the statute delegated the collection of filing fees
to the County Clerk and provided the County authority to collect a $25.00 documentary
handling fee. The fee due for your project is $25.00. A checks made payable to the
Butte County Treasurer should be submitted to this department by November 24, 1992.
Project applicants should be aware Section 21089(b) of the Public Resources Code,
provides that any project approved under CEQA is not operative, vested, or final until
the filing fees required under Section 711.4 of the Fish and Game Code are paid.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the
special conditions set forth below: Richard and Audrey Watt is hereby granted a Use
Permit in accordance with application filed: 9/10/92 to allow a mobile home as a
temporary second residence on property zoned AR -MH -1 located on the west side of
Pentz Road, approximately 1600 feet north of Lago Way, Paradise.
1. Failure to comply with the conditions specified herein as the basis for
approval of application and issuance of Permit, constitutes cause for the
revocation of said permit in accordance with the procedures set forth in the
Butte County Zoning Ordinance, including Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a special condition to this use permit, all
conditions must be. completed by the Permittee within 12 months of the
delivery of the countersigned permit to the Permittee.
3. If any use for which a use permit has been granted is not established within
one year of the date of receipt of the countersigned permit by the
Permittee, the permit shall become null and void and reapplication and a
new permit shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be
binding upon and be to the benefit of the heirs, legal representatives, successors,
and assigns of the Permittee.
SPECIAL CONDITIONS:
1. Occupancy of the mobile home is limited to Ms. Lillie . Dickson.
2. No rent is to 'be charged to the occupant of the mobile home.

ANALYSIS:
The applicant is requesting approval of a Use Permit to allow a temporary mobile home to
be located at 4885 Pentz Road. The mobile home is actually installed and occupied at this
time. Building Permits have been issued and a three-bedroom house is also under construction
on this property. A Building Department Agreement is in place that requires the mobile
home to be -.removed prior to the final inspection of the new home. Approval of this request
would allow the -mobile home -to -remain. Occupancy for the mobile home is proposed for the
applicant's mother, . Lillie Dickson.
Butte . County Code Section 24-303 recognizes the need for temporary second units for the care
of persons who by old age, disease, infirmity, or other causes that require additional assistance
from family members.. Section 24-303 further states "The ability to care for one's close
relatives will notonly result in better care for citizens, but will also negate in many situations
the necessity for public assistance which many citizens find degrading and damaging to the
pride of the persons concerned and their immediate relatives. This will also provide privacy
and dignity for the relative as well as independence, of which these people are deserving."
In some cases, a "custodial care provider" may be the only means of implementing this section.
Butte County Code Section 24-304 provides for removal of the mobile home within 120 days
of the time that it is no longer being occupied pursuant to the code section. The Code also
makes provision for the County requiring a bond or deposit at the time of application of
sufficient size to cover the removal expense of the mobile home. This is to insure that the
taxpayers at large (via the General Fund) are not charged those expenses should the County
be forced to remove the mobile home pursuant to the code. Of course, if the applicant
removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly,
if the County removes the mobile home, then only charges actually incurred would be
reimbursed from the bond or deposit with the remainder being returned to the applicant. A
survey of several mobile home dealerships in Butte County has indicated a rather wide range
of estimated costs of removal. Cost, of course, would vary due to installation of landscaping,
decks, awnings, and physical site characteristics. Taking the median figures and adding a small
amount for administrative costs and storage costs, it appears that a reasonable deposit would
be $1,500 per single -wide and. $2,000 for a double -wide mobile home.. These amounts seem
reasonable to ensure that the mobile home is removed at no cost to the County or the
taxpayers. The applicant proposes to place a single -wide mobile home on the property.
The proposal has been identified as a Class 3(a) Categorical Exemption from the provisions
of the California Environmental. Quality Act (CEQA).
RECOMMENDATIONS:
A. Find that this project is Categorically Exempt from environmental review; and

Find that this proposed use of the property will not impair the integrity and character
of the zone in which the land lies and that the use would not be unreasonably
incompatible with, or injurious to surrounding properties or detrimental to the health
and general welfare. of the persons residing or working in the neighborhood or .to the
general health, -welfare, and safety of the County because ; and
C. Approve the Use Permit.to- allow a temporary mobile home as a second dwelling on

1. _ Occupancy of the .mobile home is limited to Ms. Lillie Dickson.
2: - No rent. is to be charged to the occupant of the mobile home.
3. Meet the requirements of the Butte County Environmental Health Department
for domestic water supply and sewage disposal.
4. The mobile home is to be a temporary use on the property pursuant to the
requirements of Section 24-304 of the Butte County Code.
5. The Use Permit shall expire two years from the date of issuance of the Use
Permit. Upon application, the Planning Commission may grant an extension of
the Use Permit not exceeding one year.
6. In the event that the applicant who is residing within the mobile home or the
conventional residence, for any reason, moves to another location or is deceased,
then in that event, the Use Permit granted herein shall automatically expire and
the mobile home shall be removed within one hundred twenty (120) days. In
the event the mobile home is not removed within one hundred twenty (120) days
pursuant to the terms of the Use Permit, the County shall remove the mobile
home and store it at the owner's expense.
7. The applicant is to pay a deposit or post a bond to cover the cost of removal
in the amount of $1,500 for a single -wide mobile or $2,000.00 for a double -wide
mobile.
8. Meet the' requirements of the Building Division of the Butte County Department
of Development. Services.
9. Must be a mobile home certified under the National Mobile Home Construction
and Safety Standards Act of 1974.
