The Commission waived the presentation of the Agenda Report. A video of the site was shown.
Commissioner Lambert noted that on Page 3 of the Agenda Report, the name and Assessor's Parcel number
for the applicant should be Mede Bowlsby, AP 047-200-037, rather than Jean Reidhead, AP 047-580-036.
HEARING OPEN TO THE PUBLIC
Merle Bowlsby, the property owner, said he has a deed for proof of ownership of the property. He would
like to install a mobile home for his son and his son's family on the property.
Commissioner Lambert questioned If a 1200 square ft. mobile home would meet the required 30% or less,
of the original home.
Mr. Sanders said that the 30% figure is only relevant in an attached unit, not a detached unit.
HEARING CLOSED TO THE PUBLIC
Commissioner Lambert thought that the last sentence of the note regarding minor changes in conditions
should be eliminated.
Mr. Hogan thought that note would be more appropriately placed within the body of the Agenda Report.
Commissioner Lambert agreed that the note should not be included with the motion or the conditions. It
is not a condition that can be met.
Mr. Hogan noted that the paragraph is included in order to allow for very minor changes in projects.
Commissioner Lambert suggested deleting the note on this particular project, and consider placing the note
in the body of the analysis if included at all.
Mr. Sanders suggested including such a note in the Use Permit itself.
Commissioner Lynch thought that minor changes should be allowed as long as the basic requirements are
met, such as providing a driveway and adequate parking rather than a circle driveway.
Mr. Hogan suggested adding the paragraph as another section just prior to listing the conditions.
It was moved by Commissioner Lambert, seconded by Commissioner Lynch, and carried unanimously, for
approval of the Use Permit for Mede Bowlsby on AP 047-200-037 subject to the findings and conditions as
follows:

Section 2: Zoning Ordinance Findings.
A. The proposed use of the property will not impair the integrity and character of the zone in which the
land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding
property or detrimental to the health, safety and general welfare of the persons residing or working
in the neighborhood or to the general health, welfare and safety of the County; and
, Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit
for Merle Bowlsby on AP 047-200-037, to allow a Second Unit. Approval shall be subject to the
following conditions:
B. Conditions of Approval:
1. The Second Unit shall not exceed 1200 square feet.
2. Provide two additional off-street spaces.
3. An attached or detached garage or carport with a maximum exterior dimension 20' by 24' is
permitted.
4. Adequate sewer and potable water facilities shall be provided as determined by the Butte County
Environmental Health Division.
5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Verification of
ownership shall be required prior to permit issuance and annually thereafter by submittal of a
declaration in a form specified by the Director of Development Services or designee.
6. No permits for any additional dwelling may be approved unless the Second Unit is first removed.
7. All structures must meet the "Fire Safe" requirements of Butte County and PRC 4290. Pay $200 into
the Battalion 4 water tender fund.
Minor changes may be approved administratively by the Director of Development Services, or designee,
upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall
be made by each Department or Division that the modification is consistent with the application, fees paid,
and environmental determination as conditionally approved. Changes deemed to be major or significant in
nature shall require a formal, application for amendment.
Jean L. Reidhead - (Item determined to be categorically exempt from environmental review) Use Permit

Mr. Sanders noted that the last sentence of the note regarding minor changes in a parcel map should be
deleted. Mr. Sanders said that one of the property owners resides on the property.

Commissioner Lambert asked about the ownership of the property?
:Mr. Sanders said that Parcel 36 has two owners, one of which resides on the property, and Parcel 35 is
under a completely separate, unrelated ownership. Parcel 36 is owned jointly by a mother and a daughter.
There was originally a 20 acre parcel, which is now two 10 acre parcels. The adjacent 10 acre parcel is
under a completely different ownership. The creation of the subject ten acre parcel (AP 047-580-036) needs
to be verified.
HEARING OPEN TO THE PUBLIC
Jean Reidhead said she lives on the property now with her daughter and son-in-law. She would like to move
a second unit onto the property for herself. Ms. Reidhead owns the property jointly with her mother.
Mr. Hogan said that the verification of the legality of the parcel is a condition of approval and will have to
be resolved before a second unit is occupied.
Commissioner Lambert noted that Conditions #5 and #8 would address concerns regarding legal parcel
and owner residency.
It was moved by Commissioner Lambert, seconded by Commissioner Lynch, and carried unanimously for
approval of the Use Permit for Jean L. Reidhead, on AP 047-580-036, subject to the findings and conditions
as follows:

REQUEST: Use Permit - Merle Bowlsbv. applicant/owner, A.P. 047-200-037. File # 95-
122: Use Permit to allow Second Unit on property zoned A-10, located on the
west side of Reese Road, approximately 1/2 mile north of Munjar Road, Chico.
FOR: Planning Commission Meeting of February 23, 1995
ABSTRACT: Staff recommends approval of this application.
PROJECT CHARACTERISTICS: This request is a use permit request to allow the placement of a Second Unit
pursuant to Butte County Code Section 24-202 as amended by Ordinance 3163 on November 8, 1994. The
property is currently developed with a primary dwelling that is a mobile home and a detached garage. The
applicant proposes to place a new, 1200 square foot, manufactured home serve as the Second Unit. The
property is located on the west side of Reese Road, north of Munjar Road, north of Chico. Surrounding parcels
on Reese Road are all five acres in size with this parcel being the last remaining 10 acre parcel. Domestic water
will be provided by a private well which will be shared by both dwellings. Sewage disposal will be handled by
individual septic tanks and leachfields.

ANALYSIS: This request will allow for the placement of a 1200 square foot Second Unit. The Second Unit
Ordinance recently adopted by the Board of Supervisors permits second dwellings subject to the following
requirements:
The Second Unit may be attached to the primary residence or may be a separate, on site, detached
dwelling.
2. An attached Second Unit shall be architecturally compatible with the primary residence and the
appearance of the building shall be that of a single family dwelling.

3. The size of an attached Second Unit shall not exceed 640 square feet or 30% of the size of the primary
dwelling, whichever is greater, in no case shall the Second Dwelling Unit exceed 1200 square feet. A
detached Second Unit shall not exceed 1200 square feet.
4. The parcel or lot upon which the Second Unit is to be located must meet the minimum acreage
requirement for which the parcel or lot is zoned.
5. In addition to the off-street parking required for the primary dwelling, one off-street parking space shall
be provided for Second Units of 640 square feet or less; two additional off street spaces shall be
provided for larger units.
6. An attached or detached garage or carport with a maximum exterior dimension of 12' by 20' is permitted
for Second Units of 640 square feet or less. A garage or carport with a maximum exterior dimension
of 20' by 24' is permitted for larger Second Units.
7. Adequate sewer and potable water facilities shall be provided as determined by the Butte County
Environmental Health Division.
8. A Second Unit may not be placed on a parcel or lot where a temporary mobile home, in accordance
with Section 24-295 and 24-295.10, has been approved or on a lot that has more than 1 dwelling unit
located upon it.
9. Either the existing single family dwelling or the Second Unit shall be owner occupied. Verification of
ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration
in a form specified by the Director of Development Services or designee.
The applicant proposes a detached Second Unit on a 10 acre parcel which meets the requirements of the zone.
The request can or does meet all of the other conditions. Though no garage is proposed at this time, the
applicant could construct one at a later date, no larger than 480 square feet. Adequate parking is available on-
site.
ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from
the provisions of CEQA under a class 3 exemption.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held.
Advertisement of the public hearing will occur in a local newspaper and public notices were mailed to all
property owners within a 300 foot radius of the subject property. As of the date of this report we have received
no public comment.
RECOMMENDATION: Staff recommends that the Planning Commission approve the use permit on A.P. 047-
200-037, subject to the following findings and conditions:

I. Failure to comply with the conditions specified herein as the basis for
approval of application and issuance of Permit, constitutes cause for the
revocation of said permit in accordance with the procedures set forth in the
Butte County' Zoning Ordinance, including Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a special condition to this use permit, all
conditions must be completed by the Permittee within 12 months of the
delivery of the countersigned permit to the Permittee.
3. If any use for which a use permit has been granted is riot established within
one year of the date of receipt of the countersigned permit by the Permittee;
the permit shall become null and void and reapplication and a new permit
shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and
assigns of the Permittee.
SPECIAL CONDITIONS:
1. The Second Unit shall not exceed 1200 square feet.
2. Provide two additional off-street spaces.
3. An attached or detached garage or carport with a maximum exterior dimension
20' by 24' is permitted.
4. Adequate sewer and potable water facilities shall be provided as determined by the
Butte County Environmental Health Division.

5. Either the existing single family dwelling or the Second Unit shall be owner
occupied. Verification of ownership shall be required prior to permit issuance and
annually thereafter by submittal of a declaration in a form specified by the Director
of Development Services or designee.
6. No permits for any additional dwelling may be approved unless the Second Unit.

7. All structures must meet the "Fire Safe" requirements of Butte County and PRC
4290. Pay $200 into the Battalion 4 water tender fund.
Minor changes may be approved administratively by the Director of Development Services
upon receipt of a substantiated written request by the applicant. Prior to such approval,
verification shall be made by each Department or Division that the modification is
consistent with.the application, feespaid and environments! determination as conditionally
approved. Changes deemed to be major or significant in nature shall require a formal
application for amendment.

west side of Reese Road, approximately 1/2 mile north of Munjar Road, Chico.
FOR: Planning Commission Meeting of February 23, 1995
ABSTRACT: Staff recommends approval of this application.
PROJECT CHARACTERISTICS: This request is a use permit request to allow the placement of a Second Unit
pursuant to Butte County Code Section 24-202 as amended by Ordinance 3163 on November 8, 1994. The
property is currently developed with a primary dwelling that is a mobile home and a detached garage. The
applicant proposes to place a new, 1200 square foot, manufactured home serve as the Second Unit. The
property is located on the west side of Reese Road, north of Munjar Road , north of Chico. Surrounding parcels
on Reese Road are all five acres in size with this parcel being the last remaining 10 acre parcel. Domestic water
will be provided by a private well which will be shared by both dwellings. Sewage disposal will be handled by
individual septic tanks and leachfields.

ANALYSIS: This request will allow for the placement of a 1200 square foot Second Unit. The Second Unit
Ordinance recently adopted by the Board of Supervisors permits second dwellings subject to the following
requirements:
The Second Unit may be attached to the primary residence or may be a separate, on site, detached
dwelling.
2. An attached Second Unit shall be architecturally compatible with the primary residence and the
appearance of the building shall be that of a single family dwelling.

3. The size of an attached Second Unit shall not exceed 640 square feet or 30% of the size of the primary
dwelling, whichever is greater, in no case shall the Second Dwelling Unit exceed 1200 square feet. A
detached Second Unit shall not exceed 1200 square feet.
4. The parcel or lot upon which the Second Unit is to be located must meet the minimum acreage
requirement for which the parcel or lot is zoned.
5. In addition to the off-street parking required for the primary dwelling, one off-street parking space shall
be provided for Second Units of 640 square feet or less; two additional off street spaces shall be
provided for larger units.
6. An attached or detached garage or carport with a maximum exterior dimension of 12' by 20' is permitted
for Second Units of 640 square feet or less. A garage or carport with a maximum exterior dimension
of 20' by 24' is permitted for larger Second Units.
7. Adequate sewer and potable water facilities shall be provided as determined by the Butte County
Environmental Health Division.
8. A Second Unit may not be placed on a parcel or lot where a temporary mobile home, in accordance
with Section 24-295 and 24-295.10, has been approved or on a lot that has more than 1 dwelling unit
located upon it.
9. Either the existing single family dwelling or the Second Unit shall be owner occupied. Verification of
ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration
in a form specified by the Director of Development Services or designee.
The applicant proposes a detached Second Unit on a 10 acre parcel which meets the requirements of the zone.
The request can or does meet all of the other conditions. Though no garage is proposed at this time, the
applicant could construct one at a later date, no larger than 480 square feet. Adequate parking is available on-
site.
ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from
the provisions of CEQA under a class 3 exemption.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held.
Advertisement of the public hearing will occur in a local newspaper and public notices were mailed to all
property owners within a 300 foot radius of the subject property. As of the date of this report we have received
no public comment.
RECOMMENDATION: Staff recommends that the Planning Commission approve the use permit on A.P. 047-
200-037, subject to the following findings and conditions:

A. Find that this project is Categorically Exempt from environmental review; and

6. No permits for any additional dwelling may be approved unless the Second Unit is first removed.

District representatives have reviewed ,the information'contained in your memorandum dated January 5, 1995
regarding the Bowlsby Use Permit which will allow a second dwelling. District representatives have
determined that the- proposed project will negatively impact Chico Unified School District and, therefore,
warrants further environmental analysis.
The District recognizes that Senate Bill 1287 (SB 1287) may adversely impact the City's authority to impose
the following requested mitigation measures by rescinding court precedents established via the Mira, Hart and
Murrieta cases; but that issue is yet to be resolved. In addition, any restrictions which may be imposed by SB
1287 may be eliminated if Assembly Constitutional Amendment 6 (ACA 6) fails to win the support of the
majority of California voters. Based on this information, the District requests that the following comments be
included in the project approval record and requested mitigations imposed to the extent allowed by law.
SCHOOL FACILITIES FOR NEW STUDENTS GENERATED BY THE PROPOSED DEVELOPMENT
Setting
The Bowlsby application proposes 1 additional residential unit. Applying the District's .43 student yield factor,
this development will generate approximately one school age child.
Utilizing current District actual student enrollment data and projected student enrollment data from already
approved new residential,development, each elementary, junior high and senior high school in the District is
filled to capacity. To accommodate a 50+percent increase in student enrollment in recent years, the District
(1) reutilized existing school facilities, 0(2) utilized inferior elementary school facilities, (3) placed relocatable
classrooms on existing elementary school campuses, (4) instituted 'multi -track year-round education in three
existing elementary schools, (5) occupied one new urban elementary school .on a year-round schedule, (6)
occupied one new elementary school on a traditional school schedule, (7) is in the process of constructing a
third elementary school, (8) has placed interim facilities on the secondary campuses pending the availability

of new school facilities, (9) acquired a site and has planned to build a new junior high/middle school and (10)
has planned to expand one existing senior high school.
The District continues to be a participant in the State School Building Program wherein the cost of constructing
new school facilities is shared by the State and by the local district in a pro rata fashion. The State-wide need
to construct new schools far exceeds available pro rata State funding; therefore, needed new Chico Unified
School District school facilities have not been provided in a timely manner. Local Chico Unified School
District revenues generated from school impact fees, coupled with the proceeds from the general obligation
bonds approved by the voters in April 1988, will meet the student housing needs generated by local birth rates
and previously approved residential developments but will not meet the student housing needs generated by new
development. The District anticipates housing increasing numbers of students in interim facilities until funding
becomes available to construct new schools.
Impact of Proposed Development on Chico Unified School District Schools
Since District elementary, junior and senior high schools are filled to capacity, it is evident that students
generated from Bowlsby Use Permit application cannot be served by existing facilities. In addition, there is
currently no funding mechanism that will enable the District to provide facilities for these students.
Based on the District's .43 student yield factor per average (1,532 square feet) household, the 1 residential unit
proposed in Bowlsby, Use Permit application will yield approximately one student that must be housed in
District schools. The District projects that larger residential units will yield more than .43 students per
household and smaller residential units will yield less than .43 students per household. To adjust for the higher
student yield factor in larger than average households and the lower student yield factor in smaller than average
households, the District utilizes a mitigation cost based on square footage of habitable space in each household.
This project must be consistent with the City of Chico General Plan and the impact on the District must be
recognized and addressed in the project approval process.
Mitigation of Impact on Chico Unified School District Schools,
The District is opposed to City approval of the proposed Bowlsby Use Permit application unless the project
fully mitigates its impact on the District.
Acceptable mitigation measures include:
• cash or in lieu equivalent (land or school facilities), approved by the District, which is equal to the full
mitigation cost as described below;
• imposition of a controlled phasing of single or multi -family residential development to coincide with
provision of adequate school facilities; or
0 denial of the project.
The 1993/94 per habitable space square foot cost to fully mitigate the impact of each residential -unit is $4.45
per square foot. This amount will be adjusted as needed to reflect the impact of inflation, school facilities
needs, regulatory changes and other cost influencing factors. The full mitigation cost of $4.45 per square foot
of new residential development will include school impact fees (currently $1.72 per square foot). The school
impact fee will be supplemented with an appropriate amount of cash or in lieu equivalent (land or school
facilities) approved by the District. The combination of school impact fees and cash or in lieu equivalent must
fully mitigate the impact of the development on District schools.
Since the school mitigation cost established by the District is based on habitable square footage of the
residential unit and District representatives are not informed of the exact habitable space of the residential unit
in the proposed development, it is not possible to confirm the total cost of the mitigation at this time. The
following calculation is provided to allow one who is knowledgeable of the habitable space of each residential
unit in the _proposed development to make her/his own calculations:
CALCULATION
Total habitable space in residential unit(s) times the current cost for full mitigation in effect when paid ($4.45
per square foot in 1993/94) equals total mitigation.
For example:
1 unit @ 1,200 square feet/unit x $4.45 = $5,340; or
1 unit @ 1,532- square feet/unit x $4.45 = $6,817; or
1 unit @ 1,800 square, feet/unit x $4.45 = $8,010.
