(LPW) The Commission waived the reading of the Staff Findings. A video of the site was shown. Staff gave a brief- summary of the project. - The hearing was opened to the public. Charla Nielsen said the mobile is for her sister who is ill. She asked if she would be allowed to keep the mobile for her parents after her sister passes away? Staff explained the renewal procedure and the fact that a new Use Permit would have to be obtained if the occupancy of the mobile was to change. Commissioner Ferguson said he understood the reason for where the mobile was to be placed. Charla said there is agricultural land all around her and she has had no objections to this project from any of her neighbors. The hearing was closed. It was moved by Commissioner Ferguson, seconded by Commissioner Nelson, and unanimously carried for approval as follows: A. Find that this project is Categorically Exempt from environmental review; and . B. Find that this proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, welfare, and safety of the County; and C. Public Works: "None" California Dept. of Forestry f CDF• 'Provide an all weather access for a 40,000 pound fire apparatus to all buildings. Pay $200.00 into the Battalion 3 water tender fund." ANALYSIS: This project is a request to allow the placement of a mobile home as a temporary second dwelling on property located at 1879 Larkin Road, Gridley area. The proposed mobile will be located at the rear of the property. The proposed location is within the 25' side and rearyard setbacks. This location was chosen for its open and sunny location. The alternative location is under large trees that will provide excessive shading in the winter. If approved, the variance would allow the mobile a 10' sideyard and a 15' rearyard setback, instead of the required 25'. This is an A-40 zone, which requires the 25' setbacks, even though this is only a 1.08 acre parcel. Due to the temporary nature of the permit and approval by the neighbors, this reduced setback does not create concern. The mobile home will be used to house the terminally ill sister of the applicant and her children. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double - wide mobile home. These amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers. The applicant proposes to place a double wide mobile home on the property. RECOMMENDATIONS: 2 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - July 2, 1993 A. Find that this project is Categorically Exempt from environmental review; and B. Find that there are special circumstances applicable to the property, that due to size and surroundings, the strict application of this chapter deprives the property of privileges enjoyed by other property in the vicinity and under identical zoning classification; and D. Approve the Use Permit to allow a temporary mobile home as a second dwelling on AP #025-200-091 (Albert & Charla Nielsen) subject to the following conditions: 1. Occupancy of the mobile home is limited to Toma Padilla and 2 children. 2. No rent is to be charged to the occupant of the mobile home. 3. FINDINGS OF FACT 41 Each zoning classification and land use has an associated set of development standards which are specified in the Butte County Code. The Code also estab- lishes a procedure to grant variances from these standards where unique circumstances exist to warrant relief from the strict application of these standards. A variance can be granted only if specific findings are made to indicate that unique circumstances do, in fact, exist. These special circumstances may include factors such as the size, shape, topography, location and surroundings of a piece of property. The courts have clearly indicated that variances are not intended to rewrite the County Code and can only be granted if all the findings listed below are made. Further, the courts have indicated the actual, factual basis for these findings must be stated. + NOTE TO APPLICANT_ Please do NOT apply for a variance unless you can provide the necessary factual basis to grant the requested variance. All necessary application fees are non- refundable. FINDINGS 1. It appears as if the use to take care of a family member or friend is no. longer the use of the temporary second dwelling. It appears as if the temporary second dwelling is now being used as a rental unit. This is in violation of Butte County Codes 24-90 (Agricultural Zones), 24-280 (Second Dwellings) and 24-295 (Temporary Mobile Homes). If the use of the ten.:porary second dwelling is no longer needed for the care of a family member, or friend, please remove the dwelling and contact the Butte County Planning Division (538-7601) to verify that it has been removed. If the use is still needed, please contact the Butte County Planning Division (attn: Sherry Viernes) to update your Affidavit of Relationship for a Temporary (second dwelling) Mobile Home form, with proper payments. Sincerely, Diane Lewellen Office Assistant III AFFIDAVIT OF RELATIONSHIP FOR A TEMPORARY MOBILE HOME The Board of Supervisors has found that for the health, safety, and welfare of the people of the County that it has often become necessary for the care of persons who by reason of old age, disease (either mental or physical), infirmity or other cause, are unable, unassisted, to properly manage and take care of themselves, or would benefit from familial assistance, to allow mobile homes to be placed on smaller parcels than present County Codes or Ordinances permit, so that such persons will not have to be institutionalized, but rather can reside near their close relatives who can help care for them. The ability to care for one's close relatives will not only result in better care for citizens, but will also negate in many situations the necessity for public assistance which many citizens find degrading and damaging to the pride of the persons concerned and their immediate relatives. Public Works: "None" California Dept. of Forestry/CDF• "Provide an all weather access for a 40,000 pound fire - apparatus to all buildings. Pay $200.00 into the Battalion 3 water tender fund." ANALYSIS: This. project is a request to allow the placement of a mobile home as a temporary second dwelling on property located at 1879 Larkin Road, Gridley area. The proposed mobile will be located at the rear of the property. The proposed location is within the 25' side and rearyard setbacks. This location was chosen for its open and sunny location. The alternative location is under large trees that will provide excessive shading in the winter. If approved, the variance would allow the mobile a 10' sideyard and a 15' rearyard setback, instead of - the required 25'. This is an A-40 zone, which requires the 25' setbacks; even though this is only a 1.08 acre parcel. RECOMMENDATIONS: 2 011 BUTTE COUNTY PLANNING COMMISSION STAFF FINDINGS - July 2, 1993 A. Find that this project is Categorically Exempt from environmental review; and B. The ability to care for one's close relatives will not only result in better care for citizens, but will also negate in many situations the necessity for public assistance which many citizens find degrading and damaging to the pride of the persons concerned and their immediate relatives. This will also provide privacy and dignity for the relative as well as independence, of which these people are deserving. 1. Please state the circumstances that apply: 'f,frs'/ hG / / 6SS 2.
