Planning Commission's denial of a use permit -(item on which a negative declaration
with mitigation measures regarding environmental impacts has been recommended)
to allow a private special use airport on property zoned A-40 (Agricultural 40 acre
parcels), property located on the south side of Tailwind Drive, approximately one mile
west of Dayton Road, at 4139 Tailwind Drive, identified as AP 039-200-073, Chico.
MOTION: I MOVE TO DENY THE APPEAL OF A USE PERMIT TO
ALLOW A PRIVATE, SPECIAL USE AIRPORT ON AP 039-200-
073 (BILL BLAYLOCK/RANDY WILLIAMS) BASED UPON THE
FOLLOWING FINDINGS:. SECTION 1: ENVIRONMENTAL
FINDINGS. A. AN INITIAL STUDY WAS COMPLETED IN
COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT IDENTIFYING POTENTIALLY SIGNIFICANT

Mr. Hogan said this item was continued closed with a Motion of Intent to deny.. He said
the Commission can open the hearing only regarding what staff was asked to prepare
regarding findings for denial.
The hearing was opened.
Randy Williams said he would like to ask this be re -opened for public hearing. He said
he did not get a copy of the findings. He said the use is consistent with the General Plan.
He said he is allowed an ag. strip and if this one is allowed it would reduce the number
of ag. strips in the area. He said there is an air strip there now with very little use. He
said the strip needs to be upgraded for community use.
Mr. Sanders said the ag. strip that is there now is a very crude strip.
Mr. Hogan said there are two issues. A request by Mr. Williams to re -open the hearing,
which would have to be re -advertised and re -noticed for a future agenda. The other issue
is the Commission could make the findings for denial and 'Mr. Williams would have the
right to appeal that decision.
Commissioner Lynch asked the cost to re -advertise?
Mr. Hogan said it would cost less to re -advertise than it would for an appeal.
Commissioner Lambert asked if anything would change by a new hearing?
Mr. Hogan said they could re -explore the report, if adjacent property owners put in writing
the need to use this as an ag. strip.
Commissioner Lambert felt this should be a policy decision from the Board of Supervisors.
Chairman Nelson said this deals with a policy issue as to whether a recreational airport
fits in an ag. area. He said this request goes against the Ag. Element of the General Plan
that was recently adopted by the Board. He said the Board needs to say whether this is
appropriate or not.

Mr. Williams said he would still like to request a new hearing.
Commissioner Lynch asked where it states in the code that an ag. strip has to be used
by the owner of the property only?
Mr. Hogan said it is under the purview of the Airport Land Use Commission for restrictions
on recreational airports. 'He said an air strip for a recreational airport needs a
Comprehensive Land Use Plan.
Commissioner Lambert said this would be a special use airport.
Commissioner Lynch said he did not fault one farmer having an air strip and other farmers
using that air strip.
Commissioner Lambert pointed out that this is for an ag. strip that includes a recreational
use also.
Commissioner Seegert said multi ag. strips do not preserve ag land.
Chairman Nelson said this needs to go to the Board for a policy statement.
Mr. Williams said he was willing to take time at this level to have the matter settled.
Mr. Sanders said this is a request for a private use airstrip and requires a Use Permit
unless it is accessory to the ag. use.
The hearing was closed.
It was moved by Commissioner Lambert, seconded by Commissioner Lynch for
discussion, to adopt the Motion of Intent to deny.
Commissioner Lynch asked if the Commission has a tie vote, does that mean the Motion
of Intent is denied?
Mr. Hogan said if the vote is a tied vote, it would cancel the motion, but would not cancel
the Motion of Intent to deny and would not automatically become a vote to approve.
Commissioner Lambert withdrew her motion.

The motion failed.
Chairman Nelson asked if the Commission wants a recreational airport in an ag. zone?
Commissioner Lambert said this item should go forward to the Board for a policy
statement.
Mr. Hogan said staff would take this issue to the Board for direction stating that the
Commission was unable to make a decision due to a tied vote. This item was referred
to the Board of Supervisors.
It was moved by Commissioner Lambert, seconded by Commissioner Lynch, and
unanimously carried as previously stated by Mr. Hogan.

Mr. Hogan stated that staff has not had the opportunity to furnish the Commission with findings
and asked that this hearing be continued to August 24, 1995.
It was moved by Commissioner Lynch, seconded by Commissioner Lambert, and unanimously
carried to continue this hearing closed to August 24, 1995 at 9:00 a.m.
Commissioner Lynch asked if the Use Permit is denied, can Mr. Blalock put in an agricultural
air strip with no conditions, just the ones listed in the ALUC and County Codes?
Mr. Hogan said that is correct. He said the air strip -would have to be an accessory use to an
agricultural use. He noted that an accessory use to an agricultural use for air applicators is not
well defined. _
Chairman Nelson said lie slid not want a s:mcboned airport in this area.
Commissioner Lynch said if this permit is denied it would open the door for agricultural strips
without restrictions.
Mr. Hogan said it has to be clear that the stripis an accessory to an agricultural use.

Mr. Lucas said that two issues that'should be considered are the impact of an airport on surrounding properties, and
the appropriateness of a private recreational airport in an agricultural zone.
Chairman Nelson asked what kind of precedent would be set by approving this airport?
Mr. Lucas said the zoning code has traditionally permitted recreational airports in agricultural zones, but with the
adoption of the new Ag Element, such uses should be reconsidered, although the Ag Dement does not specifically
address private use airstrips.
Chairman Nelson asked if the proposed use would conform to the intent of the Ag Dement?
Mr. Lucas said the proposed use is probably not appropriate in an ag zone, based on the discussions that took place
during preparation of the Ag Dement. This application, however was made prior to adoption of the Ag Element.
Mr. Lucas said that the subject property and surrounding properties are being used for agriculture. There are also
recreational uses occurring on the property (water ski lake).
Commissioner Lambert asked if this proposal would conform to the Greenline policies?
Mr. Lucas said the land would still be used for ag purposes and there would not be an increase in population density.
The airstrip will be on one parcel, and used by several surrounding property owners.
Commissioner Lambert said that parcels were reconfigured around January, 1994, in order to allow the airstrip to
occur.
Mr. Lucas said he was unaware of those parcel modifications.
Comnmissioner Lynch said that there would be restrictions on the adjacent parcels because of the clear zone.
Mr. Lucas said there might not be restrictions, but rather an incompatible situation. If a Comprehensive Land LJse
Plan (CLLJP) is not prepared, the adjacent property owners could do things that might impact the airport, but that
would be the problem of the airport operator. If something were to occur which might impact the airport, Caltrans
would review the site again for safety and the permit might be terminated If a CLLJP is prepared, the use of the
airport could be protected, or the surrounding land uses could be protected
Commissioner Lynch suggested that the airport owner either be required to own or have an easement for the
properties in the clear zone.
Chairman Nelson said it would make more sense to prepare a CLLJP prior to approving a LJse Permit.
Mr. Hogan said that the conditions could be worded to require the preparation of a CLLJP prior to the issuance of
the Use Permit. He noted that the surrounding property owners would also be the same people sharing use of the
airport.

Commissioner Lambert said that a CLUP extends for a two mule radius.

,Mr. Hogan said that is the default area, but it can be less. The main consideration is, with conditions, would, the
airport would be compatible with agriculture?
Mr. Lucas said the adjacent property owners would be sharing the airport, however the overflight zone would extend
beyond those properties.
Commissioner Seegert said he would not have a problem with the airport unless the property owners at each end of
the runway, were not sharing in use of the airport and were impacted by it.,. - .

Commissioner Lynch said he was not necessarily in favor of the Use Permit, but for the record, he would like to
propose that the two conditions suggested by ALUC be included in the Use Permit and also a condition as follows:
Any clear zones required must be on property involved in the Use Permit or recorded easements on other properties
be required for clear zones or other required lands involved in the Comprehensive Land Use Plan." That way, if
property in the clear zone is sold, the new owners would be aware of the easement.
Commissioner Lambert asked if that would include avigation easements?
Mr. Lucas said that would-be possible.
Commissioner Lynch said it would include anything that is stated to be involved in the CLUP suggested by ALUC.
Mr. Hogan said that ALUC Conditions 1 and 2 seem to negate the need for Condition 4 of the Staff Report. He
suggested that if Conditions 1 and 2 are adopted, that Condition 4 on Page 5 of the Staff Report be eliminated He
also suggested that if Condition 1 is adopted that it be required to be met prior to issuance of the Use Permit
Commissioner Seegert asked how much property would actually be removed from ag use by the airstrip?
Mr. Lucas said that presently there is an existing ag strip, so no ag land would be taken out of ag use.
Mr. Hogan said that 1.43 acres is involved with the airstrip.
Commissioner Lambert said that Cliff Johnson mentioned something about 30 acres being removed from ag land
He might have been referring to the water ski lake.
Mr. Lucas did not recall that figure.
Commissioner Lambert was definitely opposed to the airport.

Commissioner Lynch said he was certain that if the proposal is denied, it wi11 be appealed, so he would like a
.complete record to go forward.
Mr. Hogan suggested a motion of intent, directing Staff to bring back findings for denial, if that is the wish of the
Commission.
Commissioner Lynch said he would like to make a motion in favor of the Use Pemiit, although he would vote
against the motion, in order to lay out conditions in addition to those conditions already laid out, so that if the denial
is appealed, the Board of Supervisors would be aware of the conditions.
Mr. Hogan said that after a motion of denial, there could be a side comment with the conditions which the Planning
_ 'C_o_mmissio_n would recommend if the Board should approve the airport.

Commissioner Lynch said he would like make a motion to approve with specific conditions.
Mr. Hogan said the sante thing could be accomplished with a motion for denial, and if the motion passes, to note
for the record, that if the item is appealed, that the Commission wishes the Board at a minimum to consider certain
conditions.
Chaimnan Nelson agreed that making a motion for denial, noting that if the Board of Supervisors considers approval,
certain conditions should definitely be considered, would be the best procedure.
Commiissioner Lambert agreed that a motion of intent should be prepared, with appropriate findings, so it can be
reviewed
Mr. Hogan said that a motion of intent for denial could be prepared, along with recommended conditions if the denial
should be appealed and a Use Pemiit granted He said it would not be necessary to reopen the hearing. Questions
from the public would have to be confined to discussion of whether or not the item as brought back before_ the
Commission, is exactly what was requested by the Planning Commission.
A motion of intent was made by Commissioner Lynch, seconded by Commissioner Lambert, and carried, to deny
the Use Permit, and further that if it comes to pass that the motion is appealed, that Conditions 1 and 2 as proposed
by ALUC are included, and also that a condition is added as follows: "Any clear zones required must be on property
involved in the Use Pemnit or have recorded easements on other property required for clear zones or other required
lands involved in a Comprehensive Land Use Plan," and that findings be made relative to a Private Use Recreational
Airport in an Ag area in that it affects other land, other surrounding lands over which the owners of the airport and
operators will have no control, -that it violates the policies and principles of the Ag Bement, (granted the Ag Bement
-was not involved.when this application was made), and also that it violates the intent of the Greenline.
Commissioner Lambert noted that ALUC Condition 1 should also contain the words, "prior to recording the Use
Permit." Commissioner Lynch agreed that should be included in the motion.
The motion of intent was carred by the following vote:

Commissioner Seegert said that he was not opposed to the Use Permit since there would be no loss of ag land and
the land is already being used for the requested purpose.
Commissioner Lambert said it'would be unlikely that a CLUP would be designed to protect surrounding property
owners and land uses, and would likely be designed in favor of the airport.

Mr. Hogan said this item was scheduled for the ALUC hearing on July 19, 1995, and should be
continued to the next Planning Commission after the ALUC meeting.

Tom Kaye, a neighboring property owner, said he is in famor of the proposed airstrip.
It was moved by Commissioner Lynch, seconded by Commissioner Seegert, and carried
unanimously to continue the Use Permit request for Bill Blaylock for the airport OPEN to July

Use Permit to allow a private special use airport on property zoned interim A-160,
located on the south side of Tailwind Drive, approximately 1 mile west of Dayton
Road, south of Chico.

FOR: Planning Commission Meeting July 13, 1995
ABSTRACT: Staff recommends approval of this application. The proposed use will be limited to the private use
of no more than five property owners and will not conflict with surrounding agricultural uses nor any other airport
facilities in the County.
PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a private, special use, airport. The
proposed site is a 40 acre parcel located at the southerly end of Tailwind Drive, approximately 1 mile west of
Dayton Road, south of Chico. The surrounding area is used for intensive agricultural purposes which include
orchards and row crops. There is one existing residence and a shop structure on the site. The airstrip will be
located about 300' west of the residence. There is also a portion of a private water ski lake on the site. The lake
also lies over portions of the two 40 acre parcels immediately to the east.
The proposed airstrip will be approximately 25' wide and 2700' long. The surface will be gravel with the potential
that at some time in the future it may be paved. The applicant anticipates that the area around the runway will still
be used for agricultural crop production such as alfalfa or some other low growing field crop. Running in a north -
south direction, the landing strip traverses the length of the property. The parcel to the north is 40 acres in size,
has a portion of a water ski lake on it, and does have some agricultural production. The parcel to the south is 112
acres in size and is used for agricultural production.

AGENDA ITEM
ANALYSIS: This project will allow the construction of a private, special use, air strip that will serve a few parcels
in the immediate area. Airports in Butte County fall into four categories, public use, personal use, agricultural, and
special use facilities. All of the municipal airports are public use fields, offering access to the general public.
Personal use airports are just that, personal, intended only for the use of the property owner upon which it is
located. Agricultural strips are intended to be used strictly as an accessory to general agricultural operations. A
special use airport, while not open to the general public, is controlled privately by the owner or owners in support
of commercial activities, public service operations or personal use. This facility falls into the special use category
because it will be used by a number of private individuals. It is not intended for commercial use but may also be
used for some agricultural activities. Butte County Code Section 24-90 requires a Use Permit for private, non-
agricultural, airstrips in the agricultural zones.
Based upon information from the applicant, no more than 5 property owners in the immediate vicinity, and their
guests, will have the rights to use this facility. These people own planes, will live in the area, and wish to keep
their planes nearby. At least three of the users of the facility will live on Tailwind Drive. The number of flights will
be extremely limited as compared to either Chico Municipal Airport of Ranchaero Airport. The applicant has stated
that 24 hour use of the facility is contemplated which will require the installation of some runway lights. This and
the other design criteria of the airport must meet the same design requirements of a public use airport as stipulated
by the Division of Aeronautics. The minimum requirements are as follows:
PUBLIC USE AIRPORT
1. A runway and runway safety area.
2. Turnarounds or holding aprons at each end of each runway.
3. A parking area with proper lateral clearances, with tie down spaces for at least four aircraft.
4. A wind cone installed at the center of a segmented circle.
5. Runway markings, to include displaced or re -located thresholds, centerline, numbers and hold lines.
6. Clear 20:1 approaches to both ends of the runway.
Provision is made that, depending on use, variances to these design requirements may be given. It can be
anticipated that the applicant will ask for and receive some variances but that the design of the airport will not be
less than that of a personal use airport. The requirements of a personal use airport are as follows:
PERSONAL USE AIRPORT
The runway length is adequate to enable aircraft to operate safely, considering airport location, density,
altitude, and the performance data of the most demanding aircraft using the airport.
The ends of the runway must be at least 200' from the airport property line.
3. The runway centerline must be at least 50' away from the property line of another owner.
4. The taxiway centerline to object or obstruction not owned by the airport owner shall be at least 50'.

5. The lighting system, if installed, shall be installed so that the required "R" marking is illuminated.
As shown on the use permit plan, the runway continues to the property line on both the north and south sides and
thus does not meet the 200' minimum setback requirements for a personal use airport. Furthermore, the most
recent advisory circular from the FAA regarding airport design recommends a 240' safety zone on each end of the
runway. The proposed design of the airport also fails to make provisions for extended obstacle free areas under
each approach zone at the end of the runway. The approach surface rises and a 20 to 1 slope, beginning at
runway end. This means that at the building setback line of the adjacent parcels to the north or south, any
structure taller than 25' will intrude into the approach surface. This means that if an adjacent property owner
constructs a barn, silo, house, or any other structure or plants trees that intrudes into the approach surface, the
runway will have to be shortened to correct the intrusion. Without some type of control over adjacent lands to the
north and south the applicant could find that the runway will no longer be long enough to use safely. This can
be avoided by obtaining additional property on at each runway end or obtaining an avigation easement over the
land.
This airport is going to be an amenity for at least two 40 acre parcels on Tailwind Drive. There is already an
elaborate private water ski lake on these parcels with individual boat houses. The lake was constructed prior to
the adoption of the interim A-160 zoning adopted for this property, which expressly prohibits such facilities. The
character and use of the parcels on Tailwind Drive does not appear to be agricultural. These parcels are upscale
estates surrounded by intensive agricultural uses. The addition of an airport to the existing amenities will not result
in any significant adverse effects to the surrounding area if the number of users is limited. There are few
residences in the area that could be affected by noise, and traffic will probably not be increased significantly on
Tailwind Drive. The airport should also be compatible with surrounding agricultural uses and will not result in the
direct loss of significant prime agricultural lands. There are already existing fuel storage tanks on the property
used for agricultural purposes. The applicant can use one of these tanks for aviation fuel or may install a new tank.
If a new tank is installed specifically for the airport use, it should be no larger than 500 gallons and be an approved
tank with appropriate containment facilities.
The Butte County Airport Land Use Commission has proposed preparing a comprehensive county -wide airport
policy plan which would establish goals, policies, and guidelines for utilizing existing airport facilities and providing
new airport facilities. This plan would act in a manner similar to a General Plan in that it would act as the
foundation for airport policy. Until this plan is formulated and adopted, the approval of new airport facilities can
not easily be assessed in relation to the overall County needs. Both Chico Airport and Ranchaero Airport appear
to have adequate capacity to serve the Chico community. Ranchaero Airport is only four miles driving distance
from the project site and could easily serve the needs of the local residents. This project is not needed to provide
adequate air facilities in the county and its sole purpose will be to provide a recreational use for a handful of private
property owners. This project will have to be reviewed by the Butte County Airport Land Use Commission and has
been set for a meeting to be held prior to the Planning Commission. A supplemental report on the ALUC
recommendation will be provided.
ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California
Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. An Initial Study Part 1
has been prepared by the applicant and Part 2 has been prepared by County staff. The applicant has reviewed
the checklist and suggested mitigation measures and has provided additional information which eliminates the
need for mitigation measure numbers 2 and 3, calling for further improvement and relocation of Tailwind Drive.
Based upon the a review of the Initial Study, staff has determined that the project impacts can be fully mitigated
with the addition of the following mitigation measures added as conditions of approval for the project:

PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held.
Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners
within a 300 foot radius of the subject property. As of the date of this report we have received no public comment.
RECOMMENDATION: Staff recommends that the Planning Commission approve a Use Permit to allow a private,
special use airport on A.P 039-200-073 (Bill Blaylock/Randy Williams) subject to the following findings, special
conditions and attached standard conditions.
FINDINGS:
Section 1: Environmental Findings.
A. An Initial Study was completed in compliance with the California Environmental Quality Act
identifying potentially significant environmental effects that the project may have. Provisions and
the design of the project and the conditions added to the project will mitigate such effects to a
level of insignificance; and
B. The design of the proposed project improvements will not cause environmental damage to fish
of wildlife or their habitat; and
C. The Planning Commission has independently reviewed, analyzed and considered the proposed
Negative Declaration with mitigation measures prior to making its decision on the project, and the
Negative Declaration reflects the independent judgement of the County of Butte; and
Section 2: Zoning Ordinance Findings.
A. The proposed use of the property will not impair the integrity and character of the zone in which
the land lies and that the use would not be unreasonably incompatible with or injurious to
surrounding property or detrimental to the health, safety and general welfare of the persons
residing or working in the neighborhood or to the general health, welfare and safety of the County;
and
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use
Permit for Bill Blaylock/Randy Williams on AP#039-200-073 to allow a special use airport.
Approval shall be subject to the following conditions:

SUMMARY: The Butte County Airport Land Use Commission held a public hearing on July 19,
1995 to act on the Use Permit application submitted by Bill Blaylock and Randy Williams for a
Special Use Airport on a 40 acre parcel located on Tailwind Drive, Chico. The ALUC has the
responsibility to review all airport related matters in the county and make recommendations to the
Planning Commission.
It is the ALUC recommendation that the Planning Commission approve the project finding that the
creation of this private airstrip in the county does not impact the orderly development of air
transportation and does not create a potential health, safety, and welfare concern for surrounding
property owners or the general public using the existing air transportation network provided the
following conditions are met.
Prepare a detailed airport land plan that shows runway lengths, clear zones, all associated
structures/hangars, fuel storage areas, oil/solvent recovery areas, and all other improvements,
and submit the plan to ALUC for review and approval. The plan should also be submitted
to, and accepted by, the Caltrans Aeronautics Program.
2. Prepare and submit to ALUC for review and approval, a Comprehensive Land Use Plan
(CLUP) for the airport environs based on the criteria established in the Caltrans Aeronautics
Program Airport Land Use Planning Handbook. The plan must be approved by ALUC prior
to issuance of Use Permit.

PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a private, special use, airport. The
proposed site is a 40 acre parcel located at the southerly end of Tailwind Drive, approximately 1 mile west of
Dayton Road, south of Chico. The surrounding area is used for intensive agricultural purposes which include
orchards and row crops. There is one existing residence and a shop structure on the site. The airstrip will be
located about 300' west of the residence. There is also a portion of a private water ski lake on the site. The lake
also lies over portions of the two 40 acre parcels immediately to the east.
The proposed airstrip will be approximately 25' wide and 2700' long. The surface will be gravel with the potential
that at some time in the future it may be paved. The applicant anticipates that the area around the runway will still
be used for agricultural crop production such as alfalfa or some other low growing field crop. Running in a north -
south direction, the landing strip traverses the length of the property. The parcel to the north is 40 acres in size,
has a portion of a water ski lake on it, and does have some agricultural production. The parcel to the south is 112
acres in size and is used for agricultural production.

ANALYSIS: This project will allow the construction of a private, special use, air strip that will serve a few parcels
in the immediate area. Airports in Butte County fall into four categories, public use, personal use, agricultural, and
special use facilities. All of the municipal airports are public use fields, offering access to the general public.
Personal use airports are just that, personal, intended only for the use of the property owner upon which it is
located. Agricultural strips are intended to be used strictly as an accessory to general agricultural operations. A
special use airport, while not open to the general public, is controlled privately by the owner or owners in support
of commercial activities, public service operations or personal use. This facility falls into the special use category
because it will be used by a number of private individuals. It is not intended for commercial use but may also be
used for some agricultural activities. Butte County Code Section 24-90 requires a Use Permit for private, non-
agricultural, airstrips in the agricultural zones.
Based upon information from the applicant, no more than 5 property owners in the immediate vicinity, and their
guests, will have the rights to use this facility. These people own planes, will live in the area, and wish to keep
their planes nearby. At least three of the users of the facility will live on Tailwind Drive. The number of flights will
be extremely limited as compared to either Chico Municipal Airport of Ranchaero Airport. The applicant has stated
that 24 hour use of the facility is contemplated which will require the installation of some runway lights. This and
the other design criteria of the airport must meet the same design requirements of a public use airport as stipulated
by the Division of Aeronautics. The minimum requirements are as follows:

This application is for a use permit for a private/special
use air strip off of Dayton Rd.
The State Division of Aeronautics is the licensing agency
for private/special use airstrips. That agency will make
the determination as to whether or not the site is suitable
for such use (from an aeronautical point of view) and
dictate all of the requirements relating to size, air space,
airport layout, use etc.
Butte County should be making a determination as to whether
a special use runway will have any adverse affects on the
area in which it is proposed.
The request is for a "special use" runway as defined by the
State. However, we have no intention of having any
commercial operations, nor do we anticipate any more than 6

Regarding the airport permit that I had requested,
I did not receive notice of the last meeting and thus was not present for -the public part of.
the hearing.
The last I heard was that I was requested to prepare a land use plan for the ALUC. A few
days after the ALUC meeting I called to ask for information regarding the preparation of
the land use plan. At that time I was informed that there was a meeting, no one showed
up, and that it was recommended for denial.
Surely you can understand that after we spent a year and over $2000. in fees for the
application, it would have been in our best interest to be at the meeting, and that if we had
known of the meeting the certainly would have been there.
Please reopen it to our and public input and reschedule the hearing. Please send notices to
both myself and Randy Williams as to the time and date. Randy Williams' phone number is

Responding to the mitigation requests submitted by the County I would like to offer the
following information.
10a. Please be advised that there are numerous fuel storage tanks on the properties
already. They range from 550 to 6000 gallons. Most are for pumps, others are for farm
equipment. This requirement seams to be irrelevant.
13c. Contrary to ones first thoughts, the airport will not increase traffic. It will decrease
it. Case in point:
* I want to fly my plane. If it is at Ranchero, I have to get in my car and drive to it. If the
plane is already on site, there is no traffic generated to get to it.
*If a guest flies in, he has come in a plane and I don't have to get. in my car and drive to
Ranchero to pick them up. No traffic generated here.
*Aircraft mechanics are not mobile. They work out of FBO's. If my plane is at Ranchero
and I have to work on it, I have to drive there. If it is on the ranch, I fly it to Ranchero for
mechanical services. No traffic generated here. This is almost a moot point as planes
usually have a service once a year (at least that is what we wish for).
*Fuel trucks have serviced all the tanks on the ranch with NO IMPROVED road for years.
The road has now been improved. January has been a very wet month and UPS,
telephone, propane, low boys, farm trucks and dump trucks have come and gone on the
road as it is. I would rather make a decision as to the appropriate time to call a fuel truck
that spend another $100,000 on a road we don't need.. If it is the desire to buy AV gas, it
can come on the same truck that delivers all the other farm gas. In fact, it would cost a lot
more if it didn't come on the same truck. With Ranchero only 2 minutes away, it is likely
that most of our gas will be bought there, just like you drive your car to the gas station.
*Lastly, the irrigation ditch to the north of the ag well (in the right of way) has been filled
in and the road put on top of it. there is a 20' wide improved road all the way.(with no
i
well in the improved road) Yes the ag well is still in the right of way (which is 60" wide)
but there is still 25' on one side of it and 35' on the other. This is no different than an
island, stop light, or sign on any other street. It is also similar to a freeway overpass or
bridge support. The well is there, it is visable, and very easy to drive arround. It would
cost $30,000 to move it. Our subdivision map was approved with the well in the right
of way and is was viewed as not posing any problems.

Dr. Williams is my neighbor and plans to be one of the users of the runway. The runway
is also going to be used as an Ag. Strip (for non hazardous substances only). It will meet
or exceed all requirements for a special use strip as defined by the State Dept. of
Aeronautics.
No commercial applications are desired (other than Ag. operations which require no
permit). The pAose of this application is to allow the landing of personal planes on the
runway. Several of the adjoining neighbors have expressed an interest in having'access to
the strip for personal use only.
The primary application is for a personal use runway. At the request of the neighbors, we
are requesting a special use application. However, if for any reason a special use permit
cannot be granted, please revert this application to a personal use application.

INSTRUCTIONS TO USE PERMIT APPLICANTS
1. If applicant is not the owner, written authorization by the owner or other proof of agency must
be submitted in order for the applicant to legally sign the application. Application shall be
considered void if not signed by the owner or legal agent.
2. All items on application shall be filled in as completely as possible. If an item is not appli-
cable, please indicate by the term "NA".
3. It is important that the applicant supply an accurate description of the location of the proposed
project, including the following:
a. Assessor's parcel number(s) (from the tax bills or A`ssessor's maps).
b. Street addresses (if available).
c. Distances and directions to named streets, bodies of water or railroads.
4. Twenty-four (24) copies of a detailed plot plan of adequate scale to clearly show proposed build-
ings and improvements, folded to 8% x 11 inches, shall accompany and be made part of the
"Application for Use Permit". If the use, permit is approved, .the plot plan becomes the ap-
proved development plan for the property. The plot plan shall include the following information:
a. A scaled drawing of the parcel(s) boundaries.
b. Location and dimensions of all existing and proposed improvements on the property,
including buildings, driveways, parking areas, wells, septic tanks and leach fields.
c. Location and name of bordering streets, access roads, nearby crossroads, streams,
bodies of water and railroads.
d. North arrow and scale of drawing.
5. The "Application for Use Permit" is subject to public hearings and approval by the Planning
Commission. Any special conditions of approval shall be made a part of the approved "Use
Permit" and shall be binding on the applicant. The procedures for County action on use per-
mit applications are stated in Chapter 24 of the Butte County Code.
6. The Planning Commission, on the basis of the evidence submitted at thepublic hearing,may
grant use permits when it finds that the proposed uses of the property will not impair the
integrity and character of the zone in which the land lies and that the use would not be un-
reasonably incompatible with or injurious to surrounding properties nor detrimental to the
health and general welfare of the persons residing or working in the neighborhood nor to the
general health, safety and welfare of the county.
7. In approving a use permit, the Planning Commission may include such conditions as are
deemed reasonable and necessary under the circumstances to preserve the integrity and
character of the zone and to secure the general purposes of the Butte County General Plan
and Chapter 24, of the Butte County Code. Such conditions may include, but are not limited'
to: time limitations, development plan approval, hours of operation, fencing, dedication of
right-of-way, and street and drainage improvements. Conditions imposed upon issuance of a
use permit must be reasonably related to the use for which the permit is requested.

ABSTRACT: Staff recommends the Board uphold the decision made by the Planning
Commission and deny this appeal. The proposed use will be incompatible with adjoining
agricultural uses, the Butte County General Plan (including the Greenline policies), and will
impair the use of prime agricultural lands for crop production.
PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a private, special
use, airport. The proposed site is a 40 acre parcel located at the southerly end of Tailwind Drive,
approximately 1 mile west of Dayton Road, south of Chico. Existing on the site is a single family
residence and a crude agricultural landing strip. The airstrip is located about 300' west of the
residence. There is also a portion of a private water ski lake on the site. The surrounding area
is used for intensive agricultural purposes which include orchards and row crops.
The proposed airstrip will be improved to approximately 25' wide and 2700' long. The surface
will be gravel with the potential that, at some time in the future, it may be paved. The applicant
anticipates that the area around the runway will still be used for agricultural crop production such
as alfalfa or some other low growing field crop. Running in a north -south direction, the landing
strip traverses the length of the property. The parcel to the north is 40 acres in size, has a portion
of a water ski lake on it, and does have some agricultural production. The parcel to the south
is 112 acres in size and is used for agricultural production.

ANALYSIS: This is an appeal of a denial of this project by the Planning Commission. Several
areas of concern were raised by the Planning Commission in making its decision:
Compatibility with neighboring agricultural uses - As proposed the air strip runs
the length of the property with no provisions for obstacle free areas at each end of
the runway. Future development or agricultural activities on adjacent parcels may
limit the use of the air strip in the future unless clear zone easements are obtained.
Compatibility with the Agricultural Element - as stated in the Agricultural Element,
conflicts often arise when land uses incompatible with the character of agricultural
operations are developed within, or next to established farms or ranches. A goal
of the Element is to support the management of agricultural lands in an efficient,
economical manner, with minimal conflict from non-agricultural uses. In support
of this goal, a number of polices have been adopted to restrict non agricultural uses
including water ski lakes, riding stables, golf courses, commercial uses, and
industrial uses. The use proposed by this request is clearly recreational in nature
and is accessory to residential uses in the area and not agricultural uses.
Compatibility with the Greenline policies - The project is not compatible with the
Greenline policy of providing for the long term protection of agricultural resources
in the Chico area.

Precedent setting - Approval of this request would have the effect of setting a
precedent for allowing similar uses in the agricultural areas of Butte County.
Based on these concerns, the Planning Commission made the decision to deny the request. If the
Board of Supervisors chooses to uphold this appeal, the findings for approval are contained in the
agenda report prepared for the Planning Commission and included in this packet. The following
conditions would be recommended if approval is to occur:

and their guests. A list of the property owners including addresses and assessors
parcel numbers shall be submitted to the Butte County Development Services
Department, Planning Division. Notification of changes to the list shall be made
to the Planning Division within 3 months. (MM)
2. Meet the Requirements of Cal Trans, Division of Aeronautics.
3. If additional on-site storage of gasoline is proposed solely for the airport use, the
new fuel storage tank shall be no larger than 500 gallons, be approved by Butte
County Fire Department, and shall have a concrete secondary containment facility
capable of holding 110% of the tank volume. (MM)
4. Prior to issuance of this Use Permit, prepare a detailed airport land use plan that
shows runway lengths, clear zones, all associated structures/hangars, fuel storage
areas, oil/solvent recovery areas, and all other improvements, and submit the plan
to ALUC for review. The plan shall also be submitted to, and accepted by,
CalTrans Division of Aeronautics.
5. Prepare and submit to ALUC for review and approval, a comprehensive Land Use
Plan (CLUP) for the airport environs, based on the criteria established in the Cal
Trans Aeronautics Program Airport Land Use Planning Handbook. The plan must
be approved prior to issuance of this Use Permit.
6. The end of the runway shall not be closer than 240' from the adjacent property
lines or appropriate avigation easements be obtained from adjoining property
owners to insure the necessary clear zones/obstacle free areas and approach zones.
7. Applicant must also comply with all other applicable State and local statutes,
ordinances and regulations.
ENVIRONMENTAL DOCUMENTATION: This project is being recommended for denial, and
no environmental documentation need be adopted. An Initial Study has been prepared by
County staff which can be used if the Board wishes to uphold the appeal and approve the project.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be
advertised and held. Advertisement of the public hearing was published in a local newspaper and
were mailed to all property owners within a 300 foot radius of the subject property. As of the
date of this report we have received no public comment.

RECOMMENDATION: Staff recommends that the Board of Supervisors deny the appeal of a
Use Permit to allow a private, special use airport on A.P. 039-200-073 (Bill Blaylock/Randy
Williams) based upon the following findings.
FINDINGS:
Section 1: Environmental Findings.
A. An Initial Study was completed in compliance with the California Environmental
Quality Act.identifying potentially significant environmental effects that the project
may have.
Section 2: Zoning Ordinance Findings.
A. The proposed use of the property is not consistent and in accordance with the currently
adopted Butte County General Plan and its elements, especially the newly adopted
Agricultural Element in that it violates its goals and policies since the airport would be
used for recreational purposes that may pose conflicts with existing and planned
agricultural activities adjacent and in the neighborhood of this proposed use. In
addition, the location of a recreational use airport in the agricultural area violates the
intent of the Chico Greenline for the protection and continuation of agriculture.
B. The proposed use of the property will impair the integrity and character of the zone in
which the land lies in that the requirement by the Airport Land Use Commission for a
Comprehensive Land Use Plan will provide protection for the continuation of the airport
to the possible detriment of the existing and planned agricultural uses adjacent and in
the neighborhood of the proposed use..
C. The proposed use of the property would be unreasonably incompatible with, or injurious
to, surrounding properties in that approval of a recreational use airport in the agricultural
area would set a precedent for future recreational airports and cause the removal of
prime agricultural lands from agricultural production.
D The proposed use of the property would be detrimental to the health, welfare, and safety
of the persons residing or working in the neighborhood or to the general health, welfare,
and safety of the County in that the Airport Land Use Commission will require that
clear zones and overflight areas be established over existing and planned agricultural
lands limiting the usage of those properties and increasing concern for public health,
safety and welfare from the overflights.

1995 to act on the Use Permit application submitted by Bill Blaylock and Randy Williams for a
Special Use Airport on a 40 acre parcel located on Tailwind Drive, Chico. The ALUC has the
responsibility to review all airport related matters in the county -and make recommendations to the
Planning Commission.
It is the ALUC recommendation that the Planning Commission approve the project finding that the
creation of this private airstrip in the county does not impact the orderly development of air
transportation and does not create a potential health, safety, and welfare concern for surrounding
property owners or the general public using the existing air transportation network provided the
following conditions are met.
1. Prepare a detailed airport land plan that shows runway lengths, clear zones, all associated
structuresThangars, fuel storage areas, oil/solvent recovery areas, and all other improvements,

D. Project Description and ,Location: This is a use permit request to allow a the construction and operation
of a special use on
on property located at the westerly end of Tailwind Dr. approximately 1 mile west
of Dayton Road, south of Chico. The airport will be used privately, for non-commercial uses, by a few
property owners in the area and will not be open to the general public. No more than 6 planes will be kept
on site and the use will be limited to a few property owners in the area. The strip is proposed to be
approximately 2700' long and will have a gravel surface. The surrounding properties are all in agricultural
production with the exception of the subject parcel and the two parcels immediately to the east, which are
being converted to large estate residential uses- A large, private, recreational water ski lake has already
been. constructed on portions of four different parcels. Additional project description and area description
can be found in the data sheet at the end of this document.
II. EVALUATION OF ENVIRONMENTAL IMPACTS

to the area. Additional runoff generated by the compaction can be handled,on site by the balance of the
property.

Response: Lights, if installed for night time use, will consist of runway lights, threshold lights and lighted wind

the use will be limbed to daylight hours only.

8. Land Use. Will the proposal result in a substantial alteration of the present or
planned land use of the area?

Response: Indirectly, the proposal represents some conflict with surrounding uses. This use is being
requested as an accessory use to a limbed number of parcels that are being developed as large residential
estates in the middle of an intensive agricultural area. Four of the properties in the area also share a large,
private, recreational pond that is used primarily for water skiing. These improvements only serve to reinforce
the use of the properties for residential uses and not agricultural production. These parcels are likely to be
developed with large, expensive homes and new residents may find agricultural operations intrusive.
Complaints by the residents about agricultural operations may increase. A the time of building permit
application for a residence property owners will be required to sign a right -to -farm statement acknowledging
the effects of adjacent agricultural uses.

9. Natural Resources. Will the proposal result in:
a. Substantial increase in the rate of use of any natural resource?

Response: The only natural resources being used is gasoline and petroleum products associated with airplane
operations, which will neither increase nor decrease as a result of this project.

Response: There is a very slight risk of explosion in the event of a crash. This is not seen as significant risk
due to the sparsely populated surroundings and limited number of flights. The land within 1 mile of the airport
is all agricultural with a few scattered homes. Hazard to ground structures is extremely slight.
Airplane fuel, if stored on she, should be limited in quantity and stored in a tank that has secondary
containment equal to at least 110% of the tank volume. This will limit the risk of release of this flammable
material. Waste motor oil will be generated by the airplane operations and The Butte *County Hazardous Waste
Plan requires this waste oil be disposed of properly. Since the number of planes will be limited to about 6 an
on site collection facility is not necessary. Plane owners who choose to change their own oil on site will have
to dispose of it the same as if they were changing the oil in their car and the project should not be treated any
differently. Many pilots will probably fly their planes to airports with appropriate facilities for maintenance.
Mitigation: On site fuel storage to be limited to no more than 500 gallons which shall be stored in a tank
approved by the Butte County Fire Department and shall have a secondary concrete containment capable of
holding 110% of the tank volume.
b. Possible interference with an emergency response plan or an emergency
evacuation plan?

Response: The project is not part of nor near any facilities to be used in an emergency response plan or
evacuation plan and will therefore not affect those plans.

guests, fuel deliveries (if fuel is stored on she), etc., will also increase slightly. The access road to the site
is adequate for agricultural uses but with the increase in traffic, the road should be improved.

With the additional traffic that will be using the road and the potential for larger vehicle such as fuel trucks,

addition, there is a large agricultural well within the right-of-way of Tailwind Drive. The road right-of-way should
be moved to correct this encroachment.

In order to review the application for your requested special use airstrip, a number of
requirements must be met. Due to the nature of these required items, this application
is considered incomplete.
1. The plot plan submitted is inadequate. All required clear zone easements, safety
zone parameters and structures on your and surrounding properties must be
clearly indicated.
2. An Airport Land Use Plan (ALUP) is required for Airport Land Use Commission
adoption. Enclosed is a copy of the guidelines to be used in preparation of the
document.
3. Submit your ALUP to the CalTrans Division of Aeronautics for review and any,
State requirements that must be met. (Adoption of the ALUP by the Airport
Land Use Commission is dependent upon approval from the CalTrans Division
of Aeronautics.)
Once these items have been addressed and/or resolved, the Planning Division will
continue its review of the project.
