There was no one present representing the applicant or who wished to speak regarding this item. The hearing was closed to the public. It was moved by Commissioner Lynch, seconded by Commissioner Nelson, and unanimously carried for approval as follows: 1. Occupancy of the mobile home is limited to Colleen and Joshua Tamayo. 2. No rent is to be charged to the occupant of the mobile home. 3. Meet the requirements of the Butte County Environmental Health Department for domestic water supply and sewage disposal. 4. The mobile home is to be a temporary use on the property pursuant to the requirements of Section 24-304 of the Butte County Code. 5. The Use Permit shall expire two years from the date of issuance of the Use Permit. Hogan, Planning Manager , BY: Thomas Last, Senior Planner DATE: October 26, 1994 REQUEST: Use Permit for a temporary second dwelling on AP# 065-180-027 for George, Darlene and Joshua Tamayo (applicants)/ David and Wandalee Slankard (owners): A request for a Use Permit to allow a temporary mobile home, on property in the RT -1 A zone. The property is located on the south side of Woodward Drive approximately 1000 feet east of Holmwood Drive, in the Magalia area. RELATED ITEMS: A Use Permit for a temporary mobile home approved on November 11, 1987. FOR: Planning Commission Meeting December 8, 1994 ABSTRACT: This request is a continuance of an existing use. Staff recommends approval of the project subject to the findings and conditions listed in this report. PROJECT CHARACTERISTICS: This project is a request for a Use Permit to allow a mobile home as a temporary second dwelling. The parcel is developed with one conventionally constructed home and one single -wide mobile home. Del Oro Water.provides domestic water to the property. Two septic tanks and leach field systems also exist. The property is located in a mixed -forest setting, containing cedar, pine and oak trees. A single -wide temporary mobile home exists on the property. The current owners, Slankards, received approval of a temporary mobile home in 1987. According to Building Division records, the mobile home has been on the property since 1976. The property is being purchased by the Tamayos. County Code requires a new Use Permit for changes in occupancy of the temporary mobile home. ■ Butte County Department of Development Services - Planning Division ■ • • AGENDA ITEM PROJECT AND SURROUNDING ZONING GENERAL PLAN DESIGNATION AND EXISTING LAND USE: Direction Zoning General Plan Existing Land Use Project: RT -1A Agriculture Residential residential North: RT -1A' Agriculture Residential residential South: PQ Public vacant East: RT -1 A Agriculture Residential residential West: RT -1A Agriculture Residential residential ANALYSIS: Approval of this permit will allow Joshua and Colleen Tamayo to occupy the temporary mobile home and provide care to Mr. Tamayo. This need complies with Butte County Code Section 24-303. The location of the mobile home provides privacy for the applicants, yet would be close enough to allow care for them. The RT -1 A zoning is consistent with the General Plan Land Use designation of Agriculture Residential. This request is consistent with the intent of the County's temporary mobile home ordinance. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days after occupancy ceases. The Code also makes provision for a bond or deposit of sufficient size at the time of application to insure removal expenses, should the County be required to remove the mobile home. If the applicant removes the mobile home voluntarily, then the bond or deposit is returned. A $1,500 deposit is required for a single -wide mobile home. ENVIRONMENTAL DOCUMENTATION: This proposed request is categorically exempt from the requirements of the California Environmental Quality Act (CEQA), in accordance with Section 15303 of the Public Resources Code which states: "Class 3 consists of construction and location of limited numbers of new, small facilities of structures..." PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Prior to the public hearing, notices are mailed to all property owners within a 300 foot radius of the subject property, but not less than 10 parcels. No issues or concerns were raised by commenting agencies. RECOMMENDATION: Staff recommends that the Commission approve the application for a temporary second dwelling for George, Darlene and, Joshua Tamayo on AP#065-180-027 , subject to the following findings and conditions. ■ Butte County Department of Development Services - Planning Division ■ E AGENDA ITEM Section 1: Environmental Findings. Meet the requirements of the Butte County Environmental Health Department for domestic water supply and sewage disposal. J 4. The mobile home is to be a temporary use on the property pursuant to the requirements of Section 24-304 of the Butte County Code. 5. The Use Permit shall expire two years from the date of issuance of the Use Permit. If an application for extension is filed 60 calendar days prior to permit expiration, the Planning Commission may grant extensions of the Use Permit not exceeding one year per extension. 6. In the event that the applicant who is residing within the mobile home or the conventional residence, for any reason, moves to another location or is deceased, then in that event, the Use Permit granted herein shall automatically expire and the mobile home shall be removed within one hundred twenty (120) days. In the event the mobile home is not removed within one hundred twenty (120) days pursuant to the terms of the Use Permit, the County shall remove the mobile home and store it at the owner's expense. 7. The applicant is to pay a deposit or post a bond to cover the cost of removal in the amount of $1,500 for the single -wide mobile. 8. Meet the requirements of the Building Division of the Butte County Department of Development Services. 9. Building permit fees and any current, or new, impact fees are to be paid at the fee level in place at the time of the application for the building permit. 10. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. NOTE: Minor changes may be approved administratively by the Director of Development Services, or his designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for an amendment.
