The property is zoned AR (Agricultural Residential). This project is located in Supervisorial District 4. RELATED ITEMS: None FOR: Planning Commission Meeting of April 11, 1996 Summary: Staff recommends approval of this application. This project conforms to the general plan and to the zoning requirements. PROJECT CHARACTERISTICS: This request is for a Use Permit to allow a permanent second dwelling unit on a single parcel. The property is located at 1647 20th St., Thermalito. The parcel size is .66 acres (29,000 sq. ft.) and is zoned AR. The Land Use Element of the Butte County General Plan designates the. property as Low Density Residential. The only structure currently occupying the site is a 1,360 sq. ft. house with a carport and a small storage shed. The applicant proposes to install a 1,698 sq. ft. mobile home on the rear of the property. Domestic water for the property is obtained from the Thermalito Irrigation District. Sewer service is also handled by the Thermalito Irrigation District. Surrounding parcels are zoned AR and P -Q (Public, Quasi Public) and have a General Plan designation of Low -Density Residential or Public. Surrounding land uses is residential and an elementary school. The rear yard of the project site backs up to the elementary school's play ground. An uninhabitable mobile home is located behind the dwelling unit. ANALYSIS: The AR zone allows one single-family dwelling or modular home per parcel. Butte County Code 24- 95.C.1 requires a Use Permit for more than one dwelling unit per parcel in the AR zone. The proposed second dwelling unit is a 1,698 sq. ft. mobile home. Because it is over 1,200 sq. ft., this is an application for a Use Permit, not an application for a Minor Use Permit under the provisions of Butte County Code 24-280. The project site is serviced by the Thermalito Irrigation District (TID) for domestic water supply and for sewage disposal. The proposed second dwelling unit will hook up to TID for these services. The Butte County Environmental Health Department has stated that the second dwelling unit must connect to TID for sewer and water. TID has commented that the applicant must pay sewer connection fees, and install laterals and deans outs per TID specifications. TID also commented that the applicant will be required to extend existing water service to the proposed additional residence as per TID specifications. The Butte County Fire Department has commented that in lieu of a pressurized water system or water storage tank, a payment of $200.00 into the Battalion 6 water tender fund is required prior to the issuance of a mobile home installation permit. The Fire Department has also stated that the applicant provide an all weather access to all structures, which is designed to cant' a 40,000 pound fire apparatus, and which is at least 10 feet wide with a 15 foot vertical clearance. The parcel will not become overcrowded due to the second dwelling unit. The parcel is 29,000 sq. ft. (.66 acres) and the total square footage of both dwellings and the storage shed will be approximately 3,200 sq. ft. This means that approximately 12% of the parcel will be covered with structures. There is sufficient room for two off-street parking spaces for the proposed second dwelling unit. Asa condition of this use permit, the uninhabitable mobile home that ■ Butte County Department of Development Services - Planning Division 0 AGENDA ITEM is on the property must be removed prior to issuance of a mobile home installation permit. Additional vehicle traffic generated by the additional residence will be minimal and will not significantly impact the roads in the project area. One condition of this use permit will require that the owner of the property live in_either the primary dwelling unit or the second dwelling unit and sign an affidavit to that effect. Another condition willrequire that the second dwelling unit be removed before any other dwelling unit is permitted. The AR zoning allows a minimum parcel size of 6,500 sq. ft. when public sewage disposal service is provided. The Butte County Land Use Element Map designates the parcel as Low Density Residential. This designation allows up to six dwelling units per acre when utilizing public water and sewer services. This is equal to 7,260 sq. ft. per parcel. The project parcel, with 29,000 sq. ft., is large enough to meet the General Plan density requirements. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve the Use Permit for David Kissler on Application No. UP 96-14, subject to the findings and conditions listed in Exhibit A. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. The proposed location, size, design, and operating characteristics of the proposed use is in accordance with the purpose of Chapter 24 of the Butte County Code, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County; and B. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County; and C. The proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety and general welfare, or materially injurious to properties or improvements in the vicinity; and Section 3: Action. A. Subject to the findings indicated in.Sections 1 and 2 of this Exhibit A, Use Permit for David Kissler on APN 030-071-028 to allow a permanent second dwelling is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: 1. The second dwelling unit shall connect to the Thermalito Irrigation District for domestic water supply and sewage disposal. 2. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 7. Provide at least two (2) off-street parking places for each dwelling unit. 8. The uninhabitable mobile home must be removed from the property prior to issuance of a mobile home installation permit for the second dwelling unit. 9. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. The hearing was opened to the public. David Kissler said the second unit was for security purposes, that he has had a lot of thefts. He agreed to the conditions. He said he wants to get rid of the junk that is piling up around the place. The hearing was closed. Commissioner Lambert said usually she would ask about a temporary use, but would approve a permanent second unit in this area. • It was moved by Commissioner Cage, seconded by Commissioner Lambert, and unanimously carried for approval subject to.the.findings and conditions listed in Exhibit A as follows: • Section 1: Environmental Findings. Provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. 4. An attached or detached garage or carport with a maximum exterior dimension of 20' by 24' is permitted. 5. Either the existing single family dwelling or the Second Unit shall be owner occupied. Certification of ownership shall be required prior to permit issuance and annually thereafter by submittal of a declaration in a form specified by the Director of Development Services or designee. 6. No permits for any additional dwelling may be approved unless the Second Unit is first removed. 7. Provide at least two (2) off-street parking places for each dwelling unit. 8. The uninhabitable mobile home must be removed from the property prior to issuance of a mobile home installation permit for the second dwelling unit. 9. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2.
