We will be using the salon for the child care center and the residence to live in. We will remove buildings from the back of the salon(garage) to the back end of the property for playground space. The playground will be surrounded by a 8ft fence. There are two buffer zones with a side and back alley. We will be open from 6:45am to 6:00pm., monday through friday. Children will be inside with exception of the following outside times: 9:00am to 10:00am no more than 20 children outside 10:00am to 11:00am no more than 20 children outside 12:30pm to 1:30am no more than 18 children outside 3:00pm to .4:00pm no more than 18 children outside 4:00pm to 5:00pm no more than 20 children outside Parking will be available in the front of the property. I have looked into this matter at great length, discussed the process and procedures with the case planner, Stephen Hackney, and feel that at this time, the proper result of your application has been achieved. Perhaps sometime in the future, when there is City sewer available for your project, you will want to submit an application for the day care use. discussing your letter with Mr. Hackney, it appears there are a number of discrepancies in the sequence of events. Throughout your letter you refer to your meeting with Mr. Hackney. In fact, he's never met either of you. He worked with your real estate agent, Ms. Linda Almlie, thoughout this process. This being the case, it would appear your perceptions of Mr. Hackney's attitude and manner in which he processed your application is predicated upon what was related to you through Ms. Almlie. My understanding is that Mr. Hackney has only spoken to you once or twice by telephone. He expressed the concern that perhaps your agent, Ms. Almlie, might not be keeping you informed of the issues/concerns related to your application. From current and past experience, I know how Mr. Hackney is conscientious in explaining potential issues to applications when he is at the counter. Our submittal requirements call for the planner to discuss such matters with each applicant. One of the reasons for this is to avoid just the situation you apparently have experienced — to get part way through the process only to have to withdraw your application. The cause leading to your decision — Environmental Health requirements regarding septic service — is one of the principle issues Mr. Hackney discussed with Ms. Almlie from the outset. It would appear, evidenced by the record of material in the file, that had your agent, Ms. Almlie, seriously considered Mr. Hackney's concern about the issues inherent with your project, you would have saved yourself the monies that were spent in pressing forward with this project — at the insistence of both your agent and yourself (by phone). To clarify, in general terms, the nature of work performed in processing an application, a variety of duties are required to be performed. These include: ■ Reviewing the application for completeness; ■ Comment letter is sent to various agencies (30 days to comment); ■ Reviewing the application to determine whether it constitutes a "project" under CEQA; ■ Reviewing/researching the General Plan designation and zoning to see if the request is consistent; ■ Reviewing/researching any other planning documents, e.g., Specific Plans, specific urban development standards, etc., to see if the request is consistent; ■ Reviewing/researching environmental documents, e.g., soil surveys, vegetative surveys, County constraints maps, etc., which all of these elements must be addressed in order to begin an environmental analysis of the application; 0 Site survey: case planner must go out to the project site to ground -verify map characteristics; to check CI for such things as types & numbers of structures, their location or proposed location vis-a-vis setbacks; any surface water features, e.g., for presence of vernal pools ; compatibility of surrounding land uses; types of vegetation, e.g., presence of any rare or endangered species such as the Butte County Meadowfoam; any wildlife habitat or signs of wildlife, e.g., presence of buckbrush and deer scat to indicate presence of resident or migratory deer; geometric features of road system accessing the project site - for safety reasons; and so forth. All of this is necessary in order to write an adequate Initial Study; ■ Case planner writes Initial Study (Environmental Checklist) as required by CEQA; this work is reviewed/proofread by the Senior Planner; Initial Study goes back to the case planner for any necessary editing; Initial Study is sent to applicant for review (15 days); ■ Case planner writes staff report; all this while comments are received; case planner incorporated recommended conditions of approval into report; ■ Staff Report is reviewed by Senior Planner, returned to case planner; any editing necessary is performed; report is submitted to clerical who proofreads report and sends report to the Director of Development Services for final'review; if any additional editing is required the report is returned to the case planner for editing, then the report is given to the secretary for publishing; ■ Case planner attends public hearing on the project. Within the parameters of these processing steps, every project has its own characteristics that may require additional specific attention. In the case of your project, this process was not brought to a conclusion, but a number of these processes were carried out. Discussion was held by Mr. Hackney with other staff, with staff from other agencies, and periodically with your representative, Ms. Almlie, either in person or by telephone. Time spent in these activities was tracked and noted, to be billed against your deposit. As to the amount of the billing, neither Mr. Hackney, nor any case planner working on a project would be able to tell an applicant what will be the cost at any given point in the process. There are other people involved with different billing rates. And if he has not totalled his own hours — as you point out in your letter — then he would be unable to even tell -you what are his costs. There apparently has been a misunderstanding in this matter between your agent, Ms. Almlie, and Mr. Hackney. I have read Mr. Hackney's letter to you, July 3, 1996, and his concluding paragraph is one of empathy with the purpose and intent of your application. I believe his comments speak to his attitude regarding your application. I regret you feel disheartened and frustrated with the process. That is part of the reason we want the planners to discuss potential issues with applicants right from the beginning, and to explain the permit process at the same time. She was upset that I contradicted her impression/perception of our previous conversations with her client. The issue is the amount being refunded the applicant. DISCUSSION: In the course of our phone conversation, Linda and I disagreed on whether I had ever given her a specific or general dollar amount as to how much her client should expect in a refund. Linda says I told her around $800 would be refunded to her client, and she passed this figure along to her client, Susan Blakeley. I told Linda that I not only never gave her a dollar figure, but that I never would give anyone a dollar figure. I have no way of knowing, that in our previous phone conversation, when she asked me, I told her I would have to total my hours first and that there is clerical time. This a.m. I reminded Linda of this, and asked her, isn't it logical that I would be in no position to give her a dollar figure when at the time she asked I didn't know my own time spent on the project, nor did I know the time clerical had spent, and would possibly need to spend to close the file. Linda's response was to maintain that I had told her around $800. So we were at an impasse. Linda continued to complain about the amount charged, claimed that no way had any of this time and effort been spent on this project, and that the County charges too much for processing its projects. I told Linda that I thought it ironic that she was complaining about the refund when from the very beginning, from the day she first brought the application in, that I advised her to consider not submitting it for reasons I specified (traffic, accesslegress, parking, septic, etc.). I reminded her that on at least two occasions I recommended that she advise her clients to consider withdrawing their application and save the money for further processing. Even after Environmental Health sent their letter requiring hookup to City sewer, I initiated the phone call to Linda informing her of this and again suggesting they consider withdrawing their application. I think it was about two weeks later she called and asked that the application be withdrawn. I asked her for a letter for the file to that affect, which she sent the next day. I told Linda that I could understand where she was coming from - she is in real estate and she has a client. From where I am coming from was from a planning perspective that was grounded in a concern regarding the health & safety of children at the proposed day care. Linda made the comment/statement that she felt/the client felt that I was biased against the project from the very beginning. I told Linda that it was my responsibility to look at the potential impacts of an application and inform the applicant of any potential problems/issues. At the same time, I clearly said it was the applicant's right to submit an application. Further, my feelings about this project have nothing to do with conditions/requirements of other agencies. What really has stopped this project, at this point, is Environmental Health's requirements for hookup to City sewer. This first tank is located in the garden area near the raar door of the residence. The tank is made of concrete with a solid concrete lid. The lid has been broke, to gain access into the tank for pumping. The baffle,inside the tank is Vi" thick. it is usually 4" thick. The bathrooms aAd kitchen in the front ;e4jvgoge drains into this tank. The utility sink in the shop and the washing machines in the shop drain into thie'tank. The plumbing to the closest string of shampoo bowls was disconnected. I was unable to verify that they drain: into this tank. There is a clean-out off the end of the tank which appears to be for the leach line. The baffle wall does not extend all the way to the bottom of the tank as is normal in today's tank design. However$ the wall is not broken. This is the way it was designed. When the tank reaches operating level, the solids would be kept seperate which is the function of the baffle. The tank should be located 5' from any building and not be under any roofing at -.all. This tank does of meet code because it is only inchea fromthe building. They all enter through the game inlet. Thi* inlet pipe needs to have a sanitary too on it. The second inlet has the sanitary tee on it, but I can find nothing that 4rains into the tank through this pipe. when the drain in the house was used, it did not come into the tank. There is a second riser nearby. This riser is over leach rock. I canna- tell if it is a leach line or a leach pit. There two pipes visible. I believe that one pipe comes.from the round tank. I coo not know where the second pipe comes from. There is a white pipe about 10' away near the fence. This pipe has water visible at the bottom of it. I do not know what.this pipe is for. Second lot . When the toilet for the house WaS flushed, it did not enter any Of the tanks or pipes that were visible. i can see that the pipes -go down into the ground under the house. I cannot see whore it if they exit from under the house. if the house is torn down, do not allow the pipes to be damaged. The pipes then can be followed to the tank. If the tank for the house must be located before the house is torn down, we can snake the line and try to follow the sound. As a last resort, we can cut a hole in the floor and find which way the pipes are going. If the tank must be located, let me know. Questions not answered, 1.
