Westsite Wireless - (Item determined to be a General Rule Exemption from Environmental Review) Use Permit to allow a 100 foot wireless communication tower and a 300 square foot accessory building on 49.59 acres of land zoned A-10 (Agricultural - 10 acre parcels) located between Highway 32 and Humboldt Road, east of the PG&E towers, identified as AP 011- 004-027, 097, east of Chico. (CM) (UP96-25). Mr. Murphy said the proposed tower is in close proximity to the PG&E high voltage transmission lines. He said the applicant submitted some additional information and suggested changing Conditions 2, 3, 4 and 5 since they would be enforced anyway by the federal government. Commissioner Nelson asked why the tower cannot be across the street with the other facility. Mr. Murphy said there will be several users on this tower. There has been some talk about the other towers being taken down and those users moving to this tower, but the applicant could address that situation. Commissioner Lambert asked, regarding Condition 7, who has the responsibility for removing the towers. Mr. Murphy said that ultimately the responsibility, lies with the property owner. Commissioner Lambert suggested that'some sort of system for keeping track of the locations of cellular towers be set up. Also she thought that the conditions should be retained even though they may duplicate federal requirements. Mr. Murphy agreed that the tower locations should be mapped. r, Mr. Sanders said that the federal regulations only come into effect on towers over 200 feet in height, so neither the painting or the lighting would be required according to federal regulations. Chairman Seegert said that unpainted towers might blend in better with the existing towers. Mr. Murphy said the towers will be galvanized of a type that weathers to a dull gray. The building will be beige. Chairman Seegert said that the maximum tower height of 100 feet does not allow for the little whips on top. HEARING OPEN TO THE PUBLIC John Ryan, a partner in the application, was present. Commissioner Nelson suggested that cellular towers should be grouped as much as possible. Mr. Ryan agreed that users should share facilities rather than have a proliferation of towers, and the proposed towers will be for multiple users, and two of the facilities across the street might be removed. He said that sites are located in relation to other sites, the systems being used, the terrain and the cost of the lease. He said they would prefer not to have the tower painted or lighted. He said that according to federal regulations, towers under 200 feet not in the vicinity of an airport are not required to be painted or lit. Commissioner Lambert said that although this location may not require tower painting or lighting, she would not want to get into the habit of eliminating painting or lighting on towers. Mr. Ryan said there is a question of who has the responsibility for enforcement of painting and maintenance of the paint, and that the federal regulations are very specific and technical and might be difficult to enforce by the County. BUTTE COUNTY_PLANNING COMMISSION MINUTES - October 10,.1996 Commissioner Lambert said it would be the applicant's responsibility to maintain the paint. Mr. Ryan said that at the proposed site, the land is used for grazing only. Chairman Seegert asked about the height of the tower. Mr. Ryan said that tower would be 100 feet and the whiplike antennas would be from 3 feet to 9 feet long and are almost invisible. If the tower is limited to a total of 100 feet, then the actual tower would have to be lowered to 80 feet, which would affect the number and kind of user the tower can accommodate. He suggested allowing for a total of 115 feet. There was a consensus to change Condition 1 from 100 feet to 115 feet. Fred Gerst spoke in favor of requiring the tower to have painting and lights in the interests of safety in the event of a night emergency forced landing. He was under the impression that there was a policy that all towers would be painted and lit. 4 Mr. Sanders said that no such ordinance has been adopted although certain conditions have been used for towers in agricultural areas. Chairman Seegert asked if the other towers and the PG&E facilities are lit. Mr. Gerst noted that the tower near Larkin Road was painted but was supposed to have a light on top and there is no light as yet. He felt it is important for safety to set standards for the towers. Mr. Ryan explained that he wanted Condition 4 deleted because it is a function of the federal government. Mr. Murphy agreed that notification is a federal function, and would be a tremendously expensive function for the County to take on. HEARING CLOSED TO THE PUBLIC Commissioner Cage asked the applicant to speak about Condition 5 regarding painting of all exposed equipment. Mr. Ryan said he does not want a light on the tower and wants it to be clear exactly what has to be painted so it will be clear to the Building Division. He said that there will be a "shielding" effect for this tower since there are other nearby towers and the high power lines which any pilot would have to avoid and this tower will be in a saddle of the hill. He described what the antenna looks like and how it is painted sky blue. He does not object to painting the equipment.and outbuildings -- just the tower. Mr. Gerst said the only reason to put lights on the towers is for night emergency landings. A pilot in avoiding the large poles might run into the less obvious obstruction. In the ag areas, the towers need to be painted for the benefit of daytime aerial applicators. Condition 1 was changed from 100 feet to 115 feet. Condition 2 was deleted and replaced with "Applicant shall comply with all current FAA and FCC requirements pertaining to the proposed tower." Condition 3 was deleted. Condition 4 would remain. Condition 5 would have the words "all exposed equipment" deleted. It was moved by Commissioner Lambert, seconded by Commissioner Nelson and carried unanimously for approval of the Use Permit for Westside Wireless as per the Agenda Report, with the changes noted above. BUTTE ~COUNTY PLANNING COMMISSION MINUTES~- October, -10, 1996 ENVIRONMENTAL FINDINGS: The project is covered by the general rule that the California Environmental Quality Act (CEQA) only applies to projects which have the potential for causing significant effects on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Upon careful and deliberate review of the project and the project site environs, it has been determined that this application meets the criteria for a general rule exemption under Section 15061(b)(3) of the California Environmental Quality Act guidelines. ZONING ORDINANCE FINDINGS: The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with or injurious to surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the county. CONDITIONS OF APPROVAL: Environmental Health Division Requirements The facility shall have no plumbing. Public Works Division Requirements 2. Prior to the issuance of building permits obtain encroachment permit for a driveway from Humboldt Road and construct driveway to county standards, as specified in County Improvement Standards. Planning Division Requirements 3. The tower facility and all attachments shall not exceed 115 feet in height pursuant to Federal Aviation Administration regulations. The applicant shall comply with all Federal Aviation Administration regulations and requirements. 4. Applicant shall comply with all current FAA and FCC requirements pertaining to the proposed tower. 5. The applicant shall notify the Butte County Agricultural Commissioner and all aerial applicators who I operate in Butte County of the construction of the facility prior to erection of the tower. The applicant shall paint or finish associated buildings with an earth -tone color compatible with the surroundings. The facility shall meet the requirements of the Butte County Environmental Health Division for hazardous materials storage, including the filing of a business plan prior to operation of the facility. 8. At such date as antenna space on the tower is no longer leased, the property owner shall cause the tower to be removed. 9. The tower shall be constructed to accommodate multiple antenna installations who may acquire space on the tower without obtaining an additional use permit. RELATED ITEMS: None FOR: Planning Commission Meeting of October 10, 1996 SUMMARY: Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Conditional Use Permit to erect a 100 ft. wireless communication tower and 300 sq. ft. accessory building. A temporary pole may be installed first, to be followed by a more permanent self-supporting latticework metal tower. The accessory building may house a propane powered generator. Multiple users will lease antenna space on the tower. Applicant states typical users include: MCI, Metro Call, Page Net, and Air Touch. PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION, AND EXISTING LAND USE: Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. Site access will be from Humboldt Road. The equipment building will contain an emergency generator. The fenced yard will store Butte County Department of Development Services Agenda Report the propane fuel source. The larger parcel is rangeland used for cattle grazing. - The General Plan designation of Agricultural Residential allows utilities and quasi -public uses as secondary uses. The zoning designation of A-10 Agricultural Zone, allows the use. Section 24-90 A 4. "The erection, construction, alteration or maintenance of gas, electric, water or communication transmission facilities." The proposed tower is located 10 miles south of the Chico Municipal Airport. It is below the 200 ft. height restriction imposed by the Federal Aviation Administration (FAA). The general area is used for grazing. The tower will not present a significant hazard to aerial agricultural spraying. The project does not represent significant impact to residents in the area and will not impact significant wildlife habitat. On-site propane fuel storage for emergency generator operation, will not pose a significant health hazard. 'Fuel storage requires a permit from the Environmental Health Division. To reduce the potential hazard to aircraft, the upper portion of the tower will be painted in orange and white bands with a red light on top. The lower portion of the tower will be painted an earth tone color to reduce ground level visual impacts. To address the concern that towers will become obsolete as low earth orbit satellites take over, and clutter the landscape, a condition has been added requiring removal when the facility is no longer needed. ENVIRONMENTAL DOCUMENTATION: The project is covered by the general rule that the California Environmental Quality Act '(CEQA) only applies to projects which have the potential for causing significant effects on the environment. A temporary pole may be installed first, to be followed by a more permanent self-supporting latticework metal tower. The accessory building may house a propane powered generator. Section 24-90 A 4. "The erection, construction, alteration or maintenance of gas, electric, water or communication transmission facilities." The proposed tower is located 10 miles south of the Chico Municipal Airport. It is below the 200 ft. height restriction imposed by the Federal Aviation Administration (FAA). The general area is used for grazing. The tower will not present a significant hazard to aerial agricultural spraying. The project does not represent significant impact to residents in the area and will not impact significant wildlife habitat. On-site propane fuel storage for emergency generator operation, will not pose a significant health hazard. Fuel storage requires a permit from the Environmental Health Division. To reduce the potential hazard to aircraft, the upper portion of the tower will be painted in orange and white bands with a red light on top. The lower portion of the tower will be painted an earth tone color to reduce ground level visual impacts. To address the concern that towers will become obsolete as low earth orbit satellites take over, and clutter the landscape, a condition has been added requiring removal when the facility is no longer needed. Where one or more antenna farm areas have been designated for a com- munity or communities (see §17.9), the Commission will not accept for filing an application for a construction per- mit to construct a new station or to in- crease height. or change antenna loca- tion of an existing station proposing the erection of an antenna structure over 304.80 meters • (1,000 feet) above ground unless: (a) It is proposed to locate the an': tenna structure in a designated an- tenna farm area, or (b) It is accompanied by a statement from the Federal Aviation Administra- tion that the proposed structure will not constitute a menace to air naviga- tion, or (c) It is accompanied by a request for waiver setting forth reasons sufficient, if true, to justify such a waiver. • § 17.21 cants claiming such exemption under §17.14(a) shall submit a statement with their application to the FCC explaining basis in detail for their finding. This shall not occur before the illumination drops to 53.82 lux (5 fc), but shall occur before it drops below 21.53 lux (2 fc). (3) . Night to day. The intensity changes .listed in paragraphs (d) (1) and (2) of,- this section shall be reversed in transitioning from the night to • day modes. Failure of the intensity step changing circuits shall cause all lights to oper- ate in the high intensity mode or the next brighter intensity step above that required for the period of operation. Antenna structures having a skeletal tower or other main support structures over 181.88 meters (600 feet) up to and including 304.80 meters (1,000 feet) in height shall. be obstruction lighted as follows: (a) There shall be installed at the top of the skeletal tower or other main support structure three or more high intensity light units which conform to FAA/DOD Specification L-856, High In- tensity Obstruction Lighting Systems. The complement of units shall emit a § 17.41 white high intensity light and produce an effective intensity of not less than 200,000 candelas (daytime) uniformly about the antenna structure in the hor- izontal plane. The effective intensity shall be reduced to approximately 20,000 candelas at twilight, and to ap- proximately 4,000 candelas at night. The light units shall be mounted in a manner to insure unobstructed viewing from aircraft at any normal angle of approach and so that the effective in- tensity of the full beam is not impaired by any structural members of the skel- etal framework. The units will nor- mally be adjusted so that the center of the beam is in the horizontal plane. (b) At the approximate 1/3 and % lev- els of the skeletal tower there shall be installed additional sets of high inten- sity obstruction lights as in paragraph (a) of this section. The normal angular adjustment of the beam centers above the horizontal shall be 2 degrees at the 1/3 level and one degree at the X13 level. See Table under § 17.42.
