This will include general assembly area with maximum occupancy load of 50. General assembly to be held in the building on west side of parcel 66 and will entail removal of wall partitions and possibly the addition of one more A.D.A. restroom. All construction will meet Butte Co. requirements. On parcel 65 there are 2 structures, restaurant in the forward portion facing Cohasset Rd. and another structure on the west side of the parcel that is currently a florist. The property has been meticulously landscaped to include indigenous plants, trees and shrubbery. A large patio area consisting of grass and concrete lie between the above structures. The complete area (parcel 65) enclosed by a 8 ft. cedar fence. Combined total square ft. equals 2743 of both structures. There are private residences on parcel #66 as a 48 ft. x 24 ft. mobile home, 2 bedroom 1 bath. There is a metal storage building on this parcel along with a patio and a peach and fig tree: On parcel 34 there is a 42 ft. x 24 ft. modular home with 2 bedrooms, 1 bath. The proposed use will not conflict with, impair or be detrimental to the uses both permitted and conditional in the R-4 zone and the High Density Residential General Plan designation in which it is located and/or adjoins because the church will occupy existing buildings devoted to commercial uses under an existing use permit; and P -J • B. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions: Plannind Division: No new development or alteration of the property shall be permitted in connection with this Use Permit. All events, functions and meetings shall 'utilize existing facilities. Any alterations to the site designed for, or intended to be used for permitted activities, shail require a review by the Planning Commission. 2. Prior to issuance of use permit, submit a final site plan to Planning Division showing a . minimum of 20 parking spaces and indicating required. landscaping pursuant to the Butte County Code Section 24-240, including, but not limited to parking lot landscaping. 3. If the parking lot is paved or the lot is otherwise improved, the applicant shall provide a permanent solution for drainage and submit construction and drainage plans to Department of Public Works for approval and install the required facilities. 4. (SL) (UP97-05) (VIDEO) Mr. Lucas summarized the staff report and said the impact would probably be less than the previous use as a restaurant/florist shop. He suggested that there should be an additional condition to sign an avigation easement, since the project is within two miles of the airport. Pastor Scott Tourville, of the Landmark Missionary Baptist Church, said they will'be glad to meet all—necessary conditions. Robert Culp, a neighbor from Christi Lane, said he is not opposed to the church, but wants to make sure there is not a problem with excessive noise. In the past there was amplified noise associated with O'Shaughnessey's Restaurant - from loud parties. The neighbors are in favor of a church on the site as long as there is not a problem with noise. Mr. Lucas said there is not a condition for noise since it was not thought to be a problem with a church. Mr. Culp asked if the church expands to the adjacent vacant parcel, if an additional permit would-be required. Chairman Seegert said this Use Permit would only apply to the current parcel. Pastor Tourville said that except for an occasional bar-be-que, everything would take place inside and all activities would stay under acceptable noise levels. The church does intend to buy all four lots eventually, but would have to apply for an additional Use Permit. Chairman Seegert asked if a condition to control noise would be acceptable. - Pastor Tourville said that would be alright. Commissioner Cage asked about landscaping. Mr. Lucas said there is sufficient landscaping already on the site. He said that activities such as outdoor wedding receptions might require some amplified sound and rather than prohibiting amplified sound, maybe set time limits instead. Commissioner Nelson said that reasonable noise should be allowed. Commissioner Lambert said that 55dB at the property line is normally considered acceptable. Fran Shelton, the real estate broker, said the property is ideal for a church, since it is too narrow for apartments, which would also be a much busier activity. The site is located at 2626 Cohasset Road, Chico. The buildings are located on the perimeter of the fenced lot with large patio area located in the center of the site. The existing buildings had been used as restaurant (1843 sq. ft.) and a flower shop (900 sq.ft.) before being sold to the current applicant. The site is accessed from Cohasset Road which is improved with curb, gutter and sidewalks. The surrounding area is a mix of commercial (north & south), multi -family residential (west) and single family residential uses (east). The larger building will be used for Sunday school, the Pastor's office and a fellowship meeting area. The maximum occupancy of this building is 50 persons. The smaller building will be modified and used as the general assembly room with a maximum occupancy of 50 persons. The church will operate seven days a week, although its primary use will be for Sunday and Wednesday worship services. The church is providing 28 parking spaces in a gravel lot which exceeds the county requirement for 20 spaces. The project will utilize an existing septic system and is connected to a public water supply. ANALYSIS: This project is conditionally consistent with the R-4 zone as a quasi -public use and is a secondary use in the High Density Residential General Plan designation. Upon obtaining a use permit, the church will be compatible within this mixed use neighborhood which includes restaurants, retail shops, apartment complexes, and auto dealerships. This project has been determined to be categorically exempt from the California Environmental Act under Section 15303, conversion of small structures. The church is not expanding or aftering the exterior of the buildings, but is merely removing some interior walls to accommodate assembly uses. There will be no increase in traffic, hours of operation or other impact associated with the conversion of uses and will actually reduce the level of intensity of use on the parcel from two commercial operations (restaurant/florist) to a single church. The use is compatible with the existing septic system on-site which was a significant problem for the effective operation of the restaurant. All modifications of the structures will also require plans to be submitted to and approved by the Building Division. Other concerns The Building Division has indicated that building plans and permits will be required for change of occupancy to meet building code regulations. This is stipulated in the conditions added for approval. The Butte County Fire Department requires conditions that building identification be installed in conformance with PRC 4290 and that there be all weather access to all structures.
