Failure to comply with.the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use" permit, all conditions must be completed by the Permittee within 24,months of the delivery of the countersigned permit to the Permittee. 3. Minor changes'may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated „ written request by the applicant, or their respective designee,. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid 'and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for. amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. Evangelical Truth Ministries/ New Life Church - (Item determined to be categorically exempt from environmental review) Use Permit to allow -a-new-2,520 sq. ft. structure which will contain a multi-purpose room, an office, two classrooms, and a kitchen, on property zoned A -R (Agricultural Residential) located on the southeast corner of Grand Avenue and 10th Street, identified as APN 031-254-022, Thermalito. (SB) (UP97-07) Mr. Betts said that a letter was submitted by a neighboring property owner regarding drainage. He said that on Page 3, in the fifth paragraph, the recommended improvements would include sidewalks only on the side of the road with the church frontage. Regarding drainage, the Public Works Department will have to approve a drainage plan. Commissioner Lynch asked how close to the property are the nearest curbs, gutters and sidewalks. Mr. Betts said there are none in the vicinity. He said modification of the previous Use Permit deleted the requirement for street improvements. He said there is a fire hydrant on the church property. HEARING OPEN TO.THE PUBLIC Pastor Mike Jacobsen said he did not know about a drainage problem or any drainage agreement and has not yet spoken to the neighbor about drainage, but is willing to work things out. Commissioner Lambert asked how the applicant feels about the sidewalk requirement. Pastor Jacobsen said the closest sidewalk is at least 1/4 mile away in only one direction and is a small section. He would like to have sidewalks eventually, since it would improve the appearance of the property, but would not want to install them at this time. HEARING CLOSED TO THE PUBLIC Commissioner Lynch suggested adding to Condition 4, regarding sidewalks, the words, "when adjacent properties install curbs, gutters and sidewalks." He said that isolated improvements could cause a drainage problem. Mr. Sanders said that street improvements would have to be reviewed by the Public Works Department. Commissioner Lambert was concerned that Condition 5, regarding drainage, would include the concerns of the neighboring property owner. It was agreed that the language of Condition 5 would allow the Public Works Department to make sure the drainage is properly handled. The church use is considered a quasi -public use, which requires a use permit in an AR zone. Use Permit 79-47 was issued in 1979, and modified in 1984, to allow a church use in an AR zone. Expansion of the church use requires that a Use Permit be obtained for the new structure. The project site is 2.69 acres in size and has been developed with a 2,520 sq. ft: church auditorium and a 800 sq. ft. conventionally -built dwelling unit. The youth pastor for the church lives in the dwelling unit. Approximately 1.5 acres of the project site is open area, consisting of grassland. Domestic water for the church and the dwelling unit is obtained from the Thermalito Irrigation District. Sewer service for the church and the dwelling unit is also handled by the Thermilito Irrigation District. A fire hydrant is located on the project site. There is a graveled parking lot, with additional unimproved parking areas available on the project site. The size of the proposed structure will be the same as the existing structure. The church use has been in operation since 1979 and has not had a significant impact on the surrounding residential uses. Use of the church occurs mostly on Sundays, when vehicle traffic in the project area is at a minimum. Vehicle traffic generated by the church results in a short- term impact to the intersection of Grand Ave. and 10th St. soon after the church lets out. The purpose of the new structure is not to further additional growth of the church congregation, but rather to meet the needs of the current congregation. All church functions now occur in the existing building. With the proposed 2,520 sq. ft. structure, the church will be able to conduct other church functions in it instead of only in the existing building. The existing building will be used as a sanctuary and the proposed structure used for other church functions, such as Sunday school and social functions. The office in the proposed structure will be used by the church's pastor. The graveled parking lot is large enough to accommodate the vehicles of the congregation. There is sufficient area available elsewhere on the project site for additional parking. The applicant has stated that the church would like to pave the existing parking lot in the near future. Paving the parking lot will create a large impermeable surface which will increase the amount of water runoff from the project site. A condition of the project will require that the applicant submit a permanent solution to drainage for the project site to the Butte County Department of Public Works. The existing building has outside lights mounted on it for safety and security purposes. The proposed structure may also have outside lights installed on it. The unshielded mercury vapor light located on the pole at the south end of the existing building throws light and glare onto the adjacent parcel, which contains a dwelling unit. A condition of this project will require that all external light fixtures be shielded in a manner that insures direct light does not project beyond ❑ Butte County Department of Development Services Agenda Report ❑ 2 property boundaries. The condition will also require that existing fixtures shall be replaced with suitable light fixtures at the time of building permit issuance. The new structure will create a new impermeable surface, thus leading to a minor increase in the amount of water runoff from the project site. The Butte County Department of Public Works has requested that as a condition of this project the applicant submit a plan for a permanent solution to drainage for the project site. Existing drainage is via sheet flow to the eastern portion of the project site. The Butte County Environmental Health Department has commented that the new structure must hook up to the Thermalito Irrigation District (TID) for sewer and domestic water services. TO has no objections to the project. The Butte County Fire Department has requested that building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter: The Fire Department has also requested that the applicant provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. The proposed use will not impair the integrity and character of the zone in which the land lies, -and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or be detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, safety, and welfare of the residents of the County; and B. The proposed project is conditionally consistent with the Unclassified Zone and is a Secondary Use.under the Grazing & Open Lands General Plan designation; and Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for Evangelical Truth Ministries (DBA New Life Church) on APN 031-254-022 to allow a new 2,520 sq. ft. structure containing a multi- purpose room, an office, two bathrooms, and a kitchen. Approval shall be subject to the following conditions: B. Conditions of Approval: 1. The new structure shall connect to the The_rmalito Irrigation District for sewer and water service. 2. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 3. Provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. 4. Prior to the issuance of building permits submit road and drainage improvement plans for the installation and construction of the street frontage improvements on Grand Avenue and 10th Street to RS -2A standard, including but not limited to P.C.C. vertical curb, gutter and r sidewalk and the required street section. Construct or install the required improvements when adjacent properties install them. 5. Prior to the recordation of the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 6. Prior to building permit issuance for a new commercial or industrial development, or addition to an existing development, the applicant shall pay all applicable. development fees at the rate in effect at the time of acceptance of the application. Such fees shall include, but not be limited to: School Fee, Thermalito Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire Protection Fees. 7. All external light fixtures shall be shielded in a manner that insures direct light does not project beyond property boundaries. Existing fixtures shall be replaced with suitable light fixtures at the time of building permit issuance. 9. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. I am writing this letter challenging the issuance for a permit to construct another building by the Church. This was brought to my attention in the your attached letter. Being that I have to be out of town I am writing this letter. I have just received your letter and was not even notified by the Church of such construction. I feel the Church should consult with me before getting permission to build because of the drainage rights. When the Church was first built, drainage rights onto my property had to be approved by my family and me before the construction of it. My family discussed it and we decided to allow it, with the stipulation that the creek which runs through my property (that all the water drains into), be moved to the end of my property line connecting to the Church's property. The creek would still be on my property. . Since the construction of the Church I have tried many times to see if we could come to a settlement, but with the numerous changes of the administrators of the Church,'nothing was ever accomplished. I was told once that they would take care of moving the creek or might even buy me out. I am requesting that whatever County Department is in charge of issuing this Use Permit, deny it on the grounds that they are constructing another building which was not discussed in the original drainage rights agreement. I feel that I am only asking for what is fair. I have not pursued any avenues to see if I could get the original drainage rights revoked. Because I do not think it is a proper avenue to take at this time, nor do I know if I have any legal rights to do so. So I hope that you take this letter into consideration and let the owners of the property work out the drainage rights situation amongst the property owners.
