HomeMy WebLinkAboutUP 97-09s USE PERMIT ; BUTTE COUNTY PLANNING COMMISSION APR 2 4 1997 DATE: (Certified Mail Receipt) UP 97-09 PERMIT NO. 055-450-017 & 018 ASSESSOR'S PARCEL NUMBER Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: L& L Surveying (applicant) is hereby granted a Use Permit in accordance with the application filed October 7, 1996 to allow three dwelling units on property zoned AR and C-1, located on the northwest corner of Indian Springs Road and Neal Road, in the south Paradise area. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec.. 24-62. 2. Unless otherwise provided for in a condition to this Use Permit, all conditions must be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a Use Permit has been granted is not established within two years of the date of receipt of the countersigned permit by the permittee, the permit shall become null and void and reapplication shall be required to establish the use.. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the -benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. This application for a Use Permit to allow three existing dwelling units is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. l A. , The proposed use of the -property,will'not impair the integrity and character of the zone in which the land Kies in that it is currently designated on the General Plan as Low Density Residential.and is already developed with single family dwelling units. B. The use would not be unreasonably incompatible with, or injurious to surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood in that the proposed uses in this permit are only expanding the current uses at this location, and the operational characteristics of the proposed use will not conflict with, or adversely affect the operation of mixed uses on the surrounding properties. C. The use would not be unreasonably incompatible with, or injurious to the general health, welfare and safety of the residents of Butte County in that R conditions imposed by this permit, if adhered to by the applicant, will ensure that the public safety is' protected. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, Use Permit for L&L Surveying (applicant) on APN 055-450-017 & 018 to allow three dwelling units on one. parcel is approved subject to the conditions listed herein. B. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall re uire a formal application for amendment. C. Conditions of Approval: 1. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all'other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 2. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction`an'd'maintained'continuously thereafter. 3. In lieu of'a pressurized water system or water storage tank, payment of $200.00 into the Battalion 1 water tender fund, is required prior to the issuance of a building permit. 4. Prior to the issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 5. Comply with the Uniform Building Code for property line clearances considering use, area and fire—resistiveness of existing buildings. 6. Access to the dwelling units shall be via the existing driveway off of Indian Springs Road. No new access to Neal Road shall be allowed unless approved by a tentative parcel map. 7. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. This project is located in Supervisorial District 5. RELATED ITEMS:, Boundary Line Modification and Tentative Parcel. Map 96-22 FOR: Planning Commission Hearing of January 9, 1997 SUMMARY: This request is for a Use Permit for three existing dwelling units on one parcel. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS:. This request is for a Use Permit to allow three dwelling units on one parcel. The project site currently consists of two parcels, but a boundary line modification (BLM) and a tentative parcel map (TPM) project were recently approved by the Development Review Committee which modifies the boundaries between the two project parcels and creates four new lots on the undeveloped (westerly) parcel of the project site. This request for a Use Permit for multiple dwelling units on one parcel is a condition of the BLM/TPM application that was recently approved for the project site. This condition requires that a Use Permit be obtained for the three dwelling units on one parcel prior to recordation of the final map. The project site, which is 5.5 acres in size, currently consists of APN 055-450-017 & 018. APN 055-450-017 is developed with two conventionally -built dwelling units and a commercial mini - storage business (James Company Storage). There are four mini -storage structures, each of which contains individual storage units. A chain-link fence surrounds the mini storage business. The mini -storage business is lighted with unshielded mercury vapor lights. APN 055-450-018 is developed with one conventionally -built dwelling unit and a garage. Vegetation on both .of the parcels is scattered pine and oak trees. The project site is dually zoned AR and C-1 and is designated by the Land Use Element of the Butte County General Plan as Agricultural Residential. The C-1 zone area covers approximately 2.7 acres of the project site, while the A -R zone covers approximately 2.8 acres of the project site. The three dwelling units are located in the AR zone, and the mini storage business is located in the C-1 zone. 11 Butte County Department of Development Services 0 Domestic water for the project site is obtained from on-site wells. Sewer service for the project site is handled by two separate septic tank/leachfield systems. Access to the three existing dwelling units is via a single graveled driveway that runs off of Indian Springs Road. Access to the mini -storage business is off of Neal Road. ANALYSIS: As a result of the recently -approved Boundary Line. Modification for the project site, the three dwelling units and the mini -storage business will be located on one parcel. Currently, two dwelling units and the mini -storage business are located on APN 055-450-017, and one dwelling unit and a garage are located on APN 055-450-018. The project'site is.designated by the' Land Use Element of the Butte County General Plan as Agricultural Residential and is zoned A -R (Agricultural -Residential) and C-1 (Light Commercial). The Agricultural Residential land use category recommends a minimum parcel size of one acre. The A -R zoning requires a minimum parcel size of 8,125 sq. ft. for parcels that use septic systems for sewage disposal, or as required to meet the sewage disposal provisions of Chapter 19 of the Butte County Code. There is no minimum acreage requirement for parcels located in a C-1 zone, but it must be large enough to meet the sewage disposal provisions of Chapter 19 of the Butte County Code if a septic system is installed. As a result of the boundary line modification, the project site will be 5.5 acres in size. With three dwelling units on the project site, this project will result in a density of 1 unit per 1.8 acres. This is above the minimum parcel size as recommend in the General Plan, and is above the minimum parcel size required by the A -R and C-1 zoning. Approval of this use permit will not result in a more intensive use of the project site. Three dwelling units on one parcel will not significantly impact the project area. The residential use on the project site has already been established and no further dwelling units will be allowed without first obtaining another use permit. The mini -storage use could expand its use, but only within the C-1 zone. All three dwelling units use the same driveway for access to a public road, so it already appears that the dwelling units are located on the same parcel. The Butte County Fire Department/California Department of Forestry has requested several conditions for this project. The first condition requires that construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations and Public Resources Code 4290, and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. The second condition requires that building identification and/or addresses shall be installed in _-conformance with Public Resources Code 4290 and'shall be posted at the beginning of building construction and maintained continuously thereafter. The third condition requires that in lieu of a pressurized water system or water storage tank, a payment shall be made into the Battalion 1 water tender fund prior to the issuance of a building permit. ❑ Butte County Department of Development Services ❑ 2 The Butte County Department of Public Works has requested two conditions as part of project approval. The first condition requires that prior to issuance of building permits obtain encroachment permits for all new or existing driveway approaches and construct them to County standards. The second condition requires that existing buildings shall comply with the Uniform Building Code for property clearances considering use, area and fire -resistiveness of existing buildings. The Butte County Environmental Health Division recommended approval of this project without conditions. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held. Notices of the hearing will be mailed to all property owners within a 300 foot radius of the subject property. RECOMMENDATION: Staff recommends that the Planning Commission approve the Use Permit on APN 055-450-017 & 018, File # UP 97-09, for. (UP97-09) (SB) Stephen Betts summarized the Agenda Report. He said access to the three dwellings will continue to be from Indian Springs Road. Any road improvements will be conditions of the parcel map. The Use Permit request is a condition of the parcel map to allow three dwellings on one parcel. Mr. Sanders said that although the resulting easterly parcel will not match the zoning line, that could be taken care of later as part of an area wide -"cleanup." HEARING OPEN TO THE PUBLIC Hollis Lundy, the surveyor, said the conditions are acceptable. He said the boundary line modification was done because of the terrain and because Paradise Irrigation District requested that there only be one applicant for the commercial and rental properties. There will be only one owner for the commercial property. Indian Springs Road will be improved to the westerly end of the property. There are no plans for future construction on the commercial property at this time. HEARING CLOSED TO THE PUBLIC It was moved by Commissioner Cage, seconded by Commissioner Lynch, and carried unanimously, for approval of the Use Permit for L and L Surveying on AP 055-450-017 and 018, subject to the findings and conditions of the Agenda Report dated December 16, 1996. This project is located in Supervisorial District 5. RELATED ITEMS: Boundary.Line Modification and Tentative Parcel. Map 96-22 FOR: Planning Commission Hearing of January 9, 1997 SUMMARY: This request is for a Use Permit for three existing dwelling units on one parcel. The proposal conforms to the zoning and the General Plan. Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is for a Use Permit to allow three dwelling units on one parcel. The project site currently consists of two parcels, but a boundary line modification (BLM) and a tentative parcel map (TPM) project were recently approved by the Development Review Committee which modifies the boundaries between the two project parcels and creates four new lots on the undeveloped (westerly) parcel of the project site. This request for a Use Permit for multiple dwelling units on one parcel is a condition of the BLM/TPM application that was recently approved for the project site. This condition requires that a Use Permit be obtained for the three dwelling units on one parcel prior to recordation of the final map. The project site, which is 5.5 acres in size, currently consists of APN 055-450-017 & 018. APN 055-450-017 is developed with two conventionally -built dwelling units and a commercial mini - storage business (James Company Storage). There are four mini -storage structures, each of which contains individual storage units. A chain-link fence surrounds the mini storage business. The mini -storage business is lighted with unshielded mercury vapor lights. APN 055-450-018 is developed with one conventionally -built dwelling unit and a garage. Vegetation on both of the parcels is scattered pine and oak trees. The project site is dually zoned AR and C-1 and is designated by the Land Use Element of the Butte County General Plan as Agricultural Residential. The C-1 zone area covers approximately 2.7 acres of the project site, while the A -R zone covers approximately 2.8 acres of the project site. The three dwelling units are located in the AR zone, and the mini storage business is located in the C-1 zone. 0 Butte County Department of Development Services ❑ Domestic water for the project site is obtained from on-site wells. Sewer service for the project site is handled by two separate septic tank/leachfield systems. Access to the three existing dwelling units is via a single graveled driveway that runs off of Indian Springs Road. Access to the mini -storage business is off of Neal Road. ANALYSIS: As a result of the recently -approved Boundary Line Modification for the project site, the three dwelling units and the mini -storage business will be located on one parcel. Currently, two dwelling units and the mini -storage business are located on APN 055-450-017, and one dwelling unit and..a garage are located on APN 055-450-018. The project site:is~designated by -the Land�Use.Element of.the *Butte County General Plan as Agricultural Residential and is zoned A -R (Agricultural -Residential) and C-1 (Light Commercial). The Agricultural Residential land use category recommends a minimum parcel size of one acre. The A -R zoning requires a minimum parcel size of 8,125 sq. ft. for parcels that use septic systems for sewage disposal, or as required to meet the sewage disposal provisions of Chapter 19 of the Butte County Code. There is no minimum acreage requirement for parcels located in a C-1 zone, but it must be large enough to meet the sewage disposal provisions of Chapter 19 of the Butte County Code if a septic system is installed. As a result of the boundary line modification, the project site will be 5.5 acres in size. With three dwelling units on the project site, this project will result in a density of 1 unit per 1.8 acres. This is above the minimum parcel size as recommend in the General Plan, and is above the minimum parcel size required by the A -R .and C-1 zoning. Approval of this use permit will not result in a more intensive use of the project site. Three dwelling units on one parcel will not significantly impact the project area. The residential use on the project site has already been established and no further dwelling units will be allowed without first obtaining another use permit. The mini -storage use could expand its use, but only within the C-1 zone. All three dwelling units use the same driveway for access to a public road, so it already appears that the dwelling units are located on the same parcel. The Butte County Fire Department/California Department of Forestry has requested several conditions for this project. The first condition requires that construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations and Public Resources Code 4290, and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. >w' The secondcondition=requires,that::building.identification-and/or addresses shall be installed in r- conformance with Public Resources, Code 4290 -and shall be posted at the beginning of building construction and maintained continuously thereafter. The third condition requires that in lieu of a pressurized water system or water storage tank, a payment shall be made into the Battalion 1 water tender fund prior to the issuance of a building permit. ❑ Butte County Department of Development Services ❑ 2. The Butte County Department of Public Works has requested two conditions -as part of project approval. The -first condition requires that prior to issuance of building permits obtain encroachment permits for all new or existing driveway approaches and construct them to County standards. The second condition requires that existing buildings shall comply with the Uniform Building Code for property clearances considering use, area and fire -resistiveness of existing buildings. The Butte County Environmental Health Division recommended approval of this project without conditions. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be categorically exempt from the provisions of CEQA under a Class 3 exemption. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be. held. Notices of the hearing will be mailed to all property owners within a 300 foot radius of the subject property. Supervisorial District 5. RELATED ITEMS: None FOR: Development Review Committee Meeting of September 12, 1996 SUMMARY: This request is for a Boundary Line Modification and Tentative Parcel Map to create 3 additional parcels. The proposal is conditionally consistent with the AR and C-1 zoning and the Agricultural Residential General Plan designation. Approval of this application is recommended with adoption of the mitigation measures and conditions requested. PROJECT CHARACTERISTICS: The application is for a Tentative Parcel Map and a Boundary Line Modification involving 2 existing lots (identified on the map as Parcels 1 - 4) and a total of 11.16 acres of land area. The applicant wishes to modify the boundaries between the existing 2 lots to separate the residential and commercial use and further divide the residential lot to create 4 new lots ranging in size between 1.2 acres and 1.6 acres each. The lots are located on the northwest corner of Indian Springs Road and Neal Road, in the south Paradise area. The two existing lots are dually zoned AR (Agricultural Residential) and C-1 (General Commercial) and have a General Plan designation of Agricultural Residential. The C-1 zoning applies to an approximately 2 acre portion of both existing parcels located along Neal Road with the remaining property in the AR zone. The effect of this proposal is to allow the new residential parcel to be fully developed while isolating the commercial zoning on one new parcel. The parcel fronting Neal Road will retain access to that road with the four newly created parcels having access from Indian Springs Road via an unnamed cul-de-sac road. Parcel 017 is presently developed with two single family homes, four mini -storage units and public restrooms. Parcel 018 is developed with a single family home and detached garage. All existing development is within 400 feet of Neal Road with the remaining lands undeveloped. All the parcels will be served by individual wells and septic systems. The property is located in a primarily rural residential setting. The property is cleared of vegetation and sparsely landscaped for a distance of 400 feet from Neal Road with the remaining six (6) acres characterized by thick foothill chaparral of manzanita, pine and oak. There is an unnamed seasonal stream/drainage bordering the eastern boundary of the property. Elevations on the property range from 1140 ft. along the eastern boundary rising to 1210 ft. along Neal Road. ANALYSIS: This request is conditionally consistent with the AR zoning and Agricultural Residential General Plan designation which permit residential uses at rural densities. The project will be required to meet all standards and requirements of the Subdivision Map Act and conform to all County standards for subdivision design. The project has three areas of concern: multiple dwelling units on one parcel, fire protection standards and the impact to the seasonal creek/drainage on the site. # Butte County Department of Development Services - Planning Division # Multiple Dwellina Units The proposed land division will result in three (3) residential units located on one parcel. The existing lot configuration has two (2) dwelling units on parcel 017 and one dwelling unit on parcel 018. The existing parcels are dually zoned AR and C1 with all dwelling units being located within the AR portion of the parcels. The AR zone does allow for multiple dwelling units on a single parcel with the approval of a use permit and the Agricultural Residential General Plan designation allows for parcels as small as one acre in size. In order to comply with the zoning requirements of the zone, a condition is added requiring the property owner to obtain a valid use permit for the multiple dwellings on the single parcel. An alternative to this scenario would be to reconfigure the parcel map to create a single, minimum one plus acre parcel for the dwelling unit on parcel 017 and have the new parcel lines conform to the zoning boundaries between the AR and C1 zones. This would be the preferred solution and meet the requirements of both the General Plan and Zoning Ordinance while creating more easily regulated zoning boundaries that would separate commercial and residential uses. This alternative would reduce the number of marketable lots from four (4) to two (2), which may not be acceptable to the applicant. This scenario may become necessary if the use permit is not approved by the Planning Commission. Seasonal Creek/Drainage A seasonal creek/drainage is located along the eastern boundary of the property and is characterized by thick vegetation. Development near this watercourse could lead to an increase in soil being eroded into the creek and impact wildlife habitat. In order to lessen the erosion and loss of habitat impacts to the creek, several mitigations are proposed. The first mitigation will prohibit all development within 50 feet of the top of bank of the creek or from the outer edge of the riparian vegetation, whichever is greater. The second mitigation will require that a California Department of Fish and Game 1604 Streambed Alteration permit be obtained prior to any work in any streambed or intermittent streams. Fire Concerns The project site is located in an area with high fire hazard danger and will require special conditions in order to reduce the potential for either impacts from a wildfire or reduce the potential as a source of fire. The Butte County Fire Department/California Department of Forestry requires that all new residences be constructed with fire suppression sprinkler systems or have access to a pressurized community water system. The project is also located within a State Response Area for wildland fires and construction of homes in this area makes fighting these fires more difficult because fire resources must protect structures before wildlands. The Fire Department has requested that all new structures and driveways meet the Fire Safe Regulations of Butte County and Public Resources Code 4290 which include fuel reduction areas within 30 feet of all structures and specified addressing signs. Because of the 30 foot fuel reduction requirement the current side and rear yard building setbacks of 5 feet for the AR zone are not adequate. Property owners placing structures within 30 feet of the property line would be restricted from clearing brush on the adjacent parcel. To allow all property owners to have control over fuel reduction around their homes a 30 foot side and rear yard building setback shall be required instead of the normal 5 foot side and rear yard building setbacks of the AR zone. Other concerns The subdivision will be subject to the following additional conditions established by other agencies. The Environmental Health Division requires the final map to show the leachfield free setbacks from wells and the creek. The Department of Public Works requires that development standards established in the project conditions be met. The payment of # Butte County Department of Development Services - Planning Division # 2 school facilities fees will be required at the time building permits are issued. The payment of sheriffs facilities fees will be required at the time of building permit issuance. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. An Initial Study has been prepared by County staff. Based upon review of the Initial Study, staff has determined that the project can be fully mitigated with the addition of mitigation measures added as conditions of approval. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Public notices will be mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Development Review Committee approve the application on APN 055-450-017 & 018, subject to the attached findings and conditions in Exhibit A. Reviewed and Approved by: William Farrel Director of Development Services # Butte County Department of Development Services - Planning Division # 3 EXHIBIT A Section 1: Environmental Findings. A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act which identified potential significant environmental effects that the project may have, but provisions in the project plans or proposals agreed to by the applicant would mitigate such effects to a point where clearly no significant environmental effects would occur; and B. Find that the Development Review Committee has independently reviewed, analyzed and considered the proposed Negative Declaration with mitigation measures prior to making its decision on the project, and hereby finds that the said Negative Declaration adequately represents impacts associated with this project; and C. The design of the subdivision and improvements has the potential to cause environmental damage to fish or wildlife or their habitat and the collection of Department of Fish and Game Environmental Filing Fees is required; and Section 2: Subdivision Map Act Findings. A. The proposed map is consistent with the Butte County General Plan Goals and Policies; and B. The design and improvements of the proposed subdivision are consistent with County standards and policies provided all conditions of project approval are complied with; and C. The project is physically suitable for the use and density of the proposed development; and D. The design and improvements of the project will not cause public health or safety problems; and E. The design and improvements of the project will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision; and F. Approval of this project will not be detrimental to the public health, safety and welfare provided the required conditions and mitigations are complied with; and Section 3: Action A. Subject to these findings indicated in Sections 1 and 2 of this report, move to adopt the Negative Declaration with mitigation measures and approve the Boundary Line Modification and Tentative Parcel Map for Robert and Gay James on APN 055-450-017 & 018 to create 4 lots. Approval shall be subject to the following conditions. B. Minor changes may be approved administratively by the Directors of Environmental Health, Development Services or Public Works, upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. # Butte County Department of Development Services - Planning Division # 4 Mitigation Measures: Show on the map a 50 foot No Disturbance Zone along all the seasonal drainages on the eastern boundary of proposed parcels 1 and 4. The distance shall be measured from the top of bank or outer edge of the riparian vegetation, whichever is greater. 2. Place a note on a separate document which is to be recorded concurrently with the map or on an additional map sheet that states, "Structures, dumping, fill material, and/or excavation shall not be allowed within the 50 foot No Disturbance Zone as depicted. Limited vegetation removal necessary for flood control is permissible within the No Disturbance Zone; however, all living and thriving native trees shall be retained and all vegetation removal shall be approved by the Department of Fish and Game prior to removal." Place a note on a separate document which is to be recorded concurrently with the map or on an additional map sheet that states: "Prior to any clearing, grading and/or construction in a streambed, including intermittent streams, obtain a California Fish and Game 1604 Streambed Alteration permit as per Department of Fish & Game requirements." 4. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 8. In lieu of a pressurized water system or water storage tank, payment of $200.00 per created parcel into the Battalion 1 water tender fund, is required prior to the issuance of a building permit. Place a note on the map or on an additional map sheet stating that: "Development of these parcels may require the payment of Butte County Fire Department water tender fees and all new structures must meet the Fire Safe Regulations of Butte County and Public Resources Code 4290." 9. Prior to, or concurrently with the recordation of the parcel map, provide a fully executed road maintenance agreement on the County approved form. 12. Provide street name signs per requirements of the Department of Public Works prior to recordation of the parcel map. Street names shall be approved by the County Address Coordinator prior to the recordation of the parcel map. 13. Obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 14. All access rights shall be reserved by deed, per County Ordinance, and offered for dedication and depicted on the parcel map. 16. Pay the recording fees then in effect for recording the parcel maps and related documents. 18. Provide two-way traversable access to each parcel from a County maintained road or state highway. Improve parcel access road to RS -8 LD -IV. Submit road and drainage plans to the Department of Public Works for plan checking and approval prior to construction. 19. Prior to recordation of the parcel map, obtain an encroachment permit and construct a standard road approach, in accordance with County Improvement Standards. Adequate sight distance at the intersection of access road and Neal Road shall be provided. 20. Show on the additional map sheet of the parcel map a 50 ft. building setback from the centerline of Neal Road, Indian Springs Road and internal street. 21. Prior to recordation of the parcel map a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works.
