Copy of Use Permit / Variance to Planning Technician: MM — 3 1997 AGENDA REPORT TO: Honorable Chair and Planning Commission FROM: Stephen Lucas, Associate Planner DATE: December 12, 1996 REQUEST: Use Permit #97-10 on APN 036-021-049 for Farnell Thomas - Owner/Applicant: A Use Permit request to expand an existing church building on a .5 acre parcel in an AR (Agricultural -Residential) zone located on the west side of V -C Road approximately 200 feet south of V-7 Road in the Oroville area. The project site is located in Supervisorial District 1. RELATED ITEMS: None FOR: Planning Commission Meeting of January 23, 1997 SUMMARY: Staff recommends approval of this application subject to the findings and conditions contained herein PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a 2304 sq.ft. expansion of an existing 2088 sq.ft. church structure to be utilized as a sanctuary. The proposed structure will be a conventionally built structure, be similar in design to the existing structure, and not include any plumbed facilities requiring additional sewage capacity. The project site is .51 acres in size and accessed by V -C Road. The site is currently developed with the existing church and parking area. Domestic water for the church is obtained from the Oroville Wyandotte Irrigation District (OWID). Sewer service for the church is provided by the Lake Oroville Area Public Utility District (LOAPUD). The parcel is served by the EI Medio Fire District. A fire hydrant is located at the corner of V-7 Road and V -C Road approximately 200 ft. from the project site. Presently there is street side parking and portion of the side lot is available for parking. The project proposes 21 spaces to be located on the rear portion of the lot to be accessed by a driveway along the southern property line. The site is located in the Oroville Urban Area. SURROUNDING ZONING, GENERAL PLAN DESIGNATION AND EXISTING LAND USE: Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. Direction Zoniny General Plan Existing Land Use Project: AR Low Density Residential Church North: AR Low Density Residential Residential -vacant South: AR Low Density Residential Residential East: AR Medium Density Residential Residential West: AR Low Density Residential Residential ANALYSIS: Approval of this project will allow a 2,304 sq.ft. expansion structure to be utilized as a sanctuary. The site is zoned AR which allows this quasi -public use with a use permit. The General Plan designation is Low Density Residential which stipulates that the project is a secondary use. There are three concerns related to this project, compatibility with the surrounding neighborhood, adequate site design and adequate sewage disposal capacity. Compatibility The church use has been in operation since the early 1960's and has not had a significant impact on the surrounding residential uses. The scale of the church facility design is appropriate to a residential area and provides a necessary service to the community while establishing a standard for property maintenance. Use of the church occurs mostly on Sundays, when vehicle traffic in the project area is at a minimum. Vehicle traffic generated by the church results in a short-term impact to the intersections of Oro -Bangor Highway/V-0 Road and V-7 Road/Wyandotte Avenue soon after the church lets out. 0 Butte County Department of Development Services Agenda Report 0 The purpose of the new structure is not to further additional growth of the church congregation, but rather to meet the needs of the current congregation. All church functions now occur in the existing building. With the proposed 2,304 sq. ft. addition, the church will be able to conduct other church functions in the existing structure such as Sunday school and social functions. Site Design The project site is flag lot and presents a unique, but workable site design. The church buildings will be located on the front of the lot and the parking area will be located in the rear with driveway access along the south parcel boundary. The proposed 21 space graveled parking lot is large enough to accommodate the vehicles of the congregation. If paving the parking lot is desired in the future, this will create a large impermeable surface which will increase the amount of water runoff from the project site. A condition of the project will require that the applicant submit a permanent solution to drainage to the Butte County Department of Public Works before any paving of the lot will be allowed. The Department of Public Works has indicated that due to the location of the project site in the Oroville Urban Area, road improvements will be required along the site frontage on V -C Road to RS -2A standard, including but not limited to P.C.C. (Portland Cement Concrete) vertical curb, gutter and sidewalk and the required street section. While these improvements are requested at this time, it should be noted that this property would be the only "improved" parcel on V -C Road. The Commission may wish to amend Condition #9 to allow the applicant to sign a covenant requiring these improvements be installed if and when surrounding parcels are improved to the same standards. The proposed structure may have outside lights installed on it. A condition of this project will require that all external light fixtures be shielded in a manner that insures direct light does not project beyond property boundaries. The condition will also require that existing fixtures shall be replaced with suitable light fixtures at the time of building permit issuance. This condition will prevent any new light sources from spilling light and glare off the project site and onto the adjacent parcels. The new structure will create a new impermeable surface, thus leading to a minor increase in the amount of water runoff from the project site. The Butte County Department of Public Works has requested that as a condition of this project the applicant submit a plan for a permanent solution to drainage for the project site. Existing drainage is via sheet flow to the north western portion of the project site. Sewage Disposal The project is presently served by the Lake Oroville Area Public Utility District (LOAPUD) for its sewage. The District has commented that the proposed expansion may not be accommodated by the existing step sewer system. This is not anticipated to be a problem considering the proposed structure does not include any additional bathrooms, kitchens or other effluent creating uses. All sewage discharge will remain the same and is presently accommodated by LOAPUD. .�IiT--Ti The EI Medio Fire Department had no comments or conditions for the project. Staff has included two conditions for fire access and building identification. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. This project qualifies for a categorical exemption to review under CEQA as per Section 15303 (Class 3 exemption), construction of small structures. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within ❑ Butte County Department of Development Services Agenda Report ❑ 2 a 300 foot radius of the subject property. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24- 62. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit.by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. Upon careful and deliberate review of the project and the project site environs, the proposed structure will have no significant environmental effects and has been determined to meet the criteria for a Categorical Exemption under Section 15303 of the California Environmental Quality Act guidelines; and B. The design and improvements of the proposed project will not cause environmental damage to fish or wildlife or their habitat and is Deminimus; and ❑ Butte County Department of Development Services Agenda Report ❑ 4 Section 2: Zoning Ordinance Findings. A. The proposed use will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or be. detrimental to the health and general welfare of the persons residing or working in the neighborhood or to the general health, safety, and welfare of the residents of the County; and B. The proposed project is conditionally consistent with the AR Zone and is a Secondary Use under the Agricultural Residential General Plan designation; and Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for Farnell Thomas on APN 036-021-049 to allow a new 2,304 sq. ft. structure. Approval shall be subject to the following conditions: B. Conditions of Approval: Planning Division All external light fixtures shall be shielded in a manner that insures direct light does not project beyond property boundaries. Existing fixtures shall be replaced with suitable light fixtures at the time of building permit issuance. 2. Prior to paving the parking surface the applicant shall submit a drainage plan to the Department of Public Works that shall specify how all drainage from the paved surface will be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 3. The use of the new structure is approved as a sanctuary without any kitchen, bathroom or accessory uses. Any additional uses will require a review by the Department of Development Services for a determination of consistency with this use permit. 4. The applicant shall construct the gravel 21 space parking area as depicted in the site plan prior to occupancy of the new building. 5. Applicant must comply with all other applicable Federal, State and local statutes, ordinances and regulations. 6. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 7. Provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. Environmental Health Division 8. .. Prior to the recordation of the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. (UP97-10) (SL) (VIDEO) There was a discussion about Condition 10 for street improvements and the possibility of allowing a covenant since there are no such improvements in the neighborhood. Mr. Sanders said the drainage solution should not be postponed. Mr. Lucas noted that the Condition 11 concerns drainage apart from the drainage associated with street improvements. It was agreed to modify Condition 10 to allow the street improvements to be installed at such time as improvements are installed on surrounding properties, and to sign the covenant prior to issuance of building permits. Commissioner Lynch suggested that it would be better to have perpendicular, rather than diagonal, parking spaces because it would be much easier to back cars out and provide more spaces as well. It was agreed there was plenty of room for parking and two lanes of traffic in the parking area. Commissioner Lynch said the parking lot should not be paved because it would simply allow water to drain onto the adjacent lot. Mr. Lucas said the proposal is for a gravel parking lot. If the parking lot should be paved, a drainage plan would be required. HEARING OPEN TO THE PUBLIC Farnell Thomas, the applicant, had no questions. SURROUNDING ZONING, GENERAL PLAN DESIGNATION AND EXISTING LAND USE: Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. The site is zoned AR which allows this quasi -public use with a use permit. The General Plan designation is Low Density Residential which stipulates that the project is a secondary use. There are three concerns related to this project, compatibility with the surrounding neighborhood, adequate site design and adequate sewage disposal capacity. Compatibility The church use has been in operation since the early 1960's and has not had a significant impact on the surrounding residential uses. The scale of the church facility design is appropriate to a residential area and provides a necessary service to the community while establishing a standard for property maintenance. Use of the church occurs mostly on Sundays, when vehicle traffic in the project area is at a minimum. Vehicle traffic generated by the church results in a short-term impact to the intersections of Oro -Bangor Highway)V-6 Road and V-7 Road/Wyandotte Avenue soon after the church lets out. 0 Butte County Department of Development Services Agenda Report 0 The purpose of the new structure is not to further additional growth of the church congregation, but rather to meet the needs of the current congregation. All church functions now occur in the existing building. With the proposed 2,304 sq. ft. addition, the church will be able to conduct other church functions in the existing structure such as Sunday school and social functions. Site Design The project site is flag lot and presents a unique, but workable site design. The church buildings will be located on the front of the lot and the parking area will be located in the rear with driveway access along the south parcel boundary. The proposed 21 space graveled parking lot is large enough to accommodate the vehicles of the congregation. If paving the parking lot is desired in the future, this will create a large impermeable surface which will increase the amount of water runoff from the project site. A condition of the project will require that the applicant submit a permanent solution to drainage to the Butte County Department of Public Works before any paving of the lot will be allowed. The Department of Public Works has indicated that due to the location of the project site in the Oroville Urban Area, road improvements will be required along the site frontage on V -C Road to RS -2A standard, including but not limited to P.C.C. (Portland Cement Concrete) vertical curb, gutter and sidewalk and the required street section. While these taA01xOimprovements are requested at this time, it should be noted that this property would be the only "improved" parcel CuN°elou on V -C Road. The Commission may wish to amend Condition #9 to allow the applicant to sign a covenant requiring these improvements be installed if and when surrounding parcels are improved to the same standards. The proposed structure may have outside lights installed on it. A condition of this project will require that all external light fixtures be shielded in a manner that insures direct light does not project beyond property boundaries. The condition will also require that existing fixtures shall be replaced with suitable light fixtures at the time of building permit issuance. This condition will prevent any new light sources from spilling light and glare off the project site and onto the adjacent parcels. The new structure will create a new impermeable surface, thus leading to a minor increase in the amount of water runoff from the project site. The Butte County Department of Public Works has requested that as a condition of this project the applicant submit a plan for a permanent solution to drainage for the project site. Existing drainage is via sheet flow to the north western portion of the project site. Sewage Disposal The project is presently served by the Lake Oroville Area Public Utility District (LOAPUD) for its sewage. The District has commented that the proposed expansion may not be accommodated by the existing step sewer system. This is not anticipated to be a problem considering the proposed structure does not include any additional bathrooms, kitchens or other effluent creating uses. All sewage discharge will remain the same and is presently accommodated by LOAPUD. Other The EI Medio Fire Department had no comments or conditions for the project. Staff has included two conditions for fire access and building identification. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the. existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant. shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet.from ground level. Mature trees removed shall be•replaced by planting replacement trees of equal number and not less than _ gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. 4. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to'a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. _ 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5.
