AGENDA REPORT TO: Honorable Chair and Planning Commission FROM: Stephen Betts, Assistant Planner DATE: November 25, 1996 REQUEST: Use Permit 97-11 for Fred Cruz - Owner/Applicant: A Use Permit request to allow a mobile home in a C-1 (Light Commercial) zone, identified as APN 031-231-001, located on the east corner of Grand Ave. and 9th St., at 833 Grand Ave., Thermalito. The project site is located in Supervisorial District 4. RELATED ITEMS: None FOR: Planning Commission Meeting of December 12, 1996 SUMMARY: Staff recommends approval of this application subject to the findings and conditions contained herein. PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a mobile home in a C-1 zone. The applicant has stated in his application that the mobile home is intended to be a temporary use, and will be removed within 120 days after the occupants have moved out. There is an existing single family dwelling unit on the project site, which was built in the 1940s. There is no commercial use on the project site. The project site was zoned C-1 in 1984 and is designated by the Land Use Element Map of the Butte County General Plan as Commercial. The C-1 zone requires that a use permit be obtained for any residential use that is not in conjunction with an allowed commercial use. The existing dwelling unit was built prior to the C-1 zoning, and the current residential use is considered a legal, pre-existing, nonconforming use. - The project site is .26 acres in size: The existing dwelling unit is a conventionally built house, and is approximately 1,000 sq. ft. in size. Domestic water for the dwelling unit is obtained from the Thermalito Irrigation District. Sewer service for the dwelling unit is also handled by the Thermalito Irrigation District. The project site fronts on Grand Ave. and 9th St., with access onto Grand Ave. Large bushes block off most of the view of the project site from Grand Ave. The occupants of the mobile home will be the applicant and his wife, both of whom are senior citizens. The occupants of the existing dwelling unit will be the applicant's son and daughter-in- law. The applicant initially applied for an Administrative Permit for a temporary mobile home under the provisions of Butte County Code 24-295 ("Aunt Minnie"), but because the C-1 zoning does not allow a residential use not in conjunction with a commercial use, the application was not 0 Butte County Department of Development Services Agenda Report 0 accepted by staff. The applicant was told that a use permit would be required for any increase in the residential use on his parcel. SURROUNDING ZONING. GENERAL PLAN DESIGNATION. AND EXISTING LAND USE: Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. Direction Zoning General Plan Existinq Land Use Project: C-1 Commercial Residential North: C-2 Commercial Residential/Commercial South: AR Low Density Residential Residential East: C-1 Commercial Residential West: C-1 Commercial Vacant ANALYSIS: Approval of this project will allow a 672 sq. ft. mobile home in a C-1 zone. The C-1 zone does not allow a residential use that is not associated with a commercial use unless a use permit is obtained. The project parcel and the adjacent parcel to the east were rezoned to C -1 - from A -R in 1984. At that time, the residential use was already established on the project site. The rezone extended an already existing C-1 zone that was located north and east of the project site. The nearest commercial use is located three parcels to the east of the project site. Other commercial uses are located to the northwest and northeast, across Grand Ave. from the project site. The two parcels directly to the east of the project site are developed with dwelling units. The proposed temporary mobile home will not have an -impact on the nearby commercial uses. The C-1 zone that the project site is located in is mostly developed with dwelling units, not commercial uses. The only commercial uses are a neighborhood grocery store, a small motor repair shop, and a radiator service shop. The need for commercial services in the project area is not great as witnessed by the lack of commercial services that have been established in the area. Of the 21 parcels zoned C-1 or C-2 in the project -area, only four have a -commercial use. Because the mobile home is a temporary use, the project site could still be a commercially viable property at some time in the future. The mobile home will be occupied by Fred and Ruth Cruz, who, due to their advanced age, require care from their son and daughter-in-law, who will reside in the existing dwelling unit. A condition of this Use Permit will limit occupancy of the temporary mobile home to Fred and/or Ruth Cruz. Another condition will require that an affidavit be completed yearly attesting to the occupancy of the mobile home and the existing dwelling unit. The addition of the temporary mobile home on the project site will result in a minor increase in vehicle traffic on Grand Ave. The amount of vehicle trips generated by the temporary mobile home, which is estimated to be ten (10), will not cause a significant impact to vehicle circulation in the project area. The existing driveway, which accesses Grand Ave., will be used by both dwelling units. There is adequate parking on the project site for two additional vehicles. ❑ Butte County Department of Development Services Agenda Report ❑ 2 The Environmental Health Department has stated that the temporary mobile home must connect to the Thermalito Irrigation District (TID) for sewer and domestic water services, and that a "will serve" letter will be required from TID. Comments received from TID show that they do not have a problem with the mobile home connecting to, their service. A mobile home installation permit and utility permit must be obtained from the' Butte County Building Department prior to installation of the temporary mobile home. In order to ensure that the proposed temporary mobile home is indeed a temporary use, a condition of this Use Permit will require that the temporary mobile home shall be placed on a temporary foundation and that the mobile home shall be removed within 120 days of either Fred Cruz and/or Ruth Cruz no longer living in the mobile home. Another condition will require that the applicant provide a surety bond, cash desposit, or timed certificate of deposit to ensure the removal of the mobile home. The amount of the bond, deposit or certificate of deposit is $1,500 for a single wide mobile home, or $2,000 for a double wide mobile home. This deposit, which is a normal condition of an Administrative Permit for a temporary mobile home, will be used to remove and store the mobile home if it is not removed by the owner within the required 120 days. If the mobile home is removed with the 120 days, the deposit will be returned to the applicant. The Butte County Department of Public Works has recommended several conditions for this project. One condition requires that prior to the issuance of building permits, an encroachment permit be obtained for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. The second condition the Department of Public Works recommends is that prior to building permit issuance for a new residential dwelling unit, the applicant shall pay all applicable development fees at the rate in effect at the time of acceptance of the application. Such fees, shall include, but not be limited to: Park Fee, School Fee, Thermalito Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire Protection Fees. Staff recommends that these conditions not be required as a 'part of project approval for this application because this application is for a temporary mobile home, not a permanent second dwelling unit. As such, the mobile- home will be removed from the project site once the intended occupants no longer live in it. The Butte County Fire Department has recommended three conditions for this project. The first condition requires that building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. The second condition requires that in lieu of a pressurized water system or water storage tank, payment of $200.00.per new dwelling into the Battalion 6 water tend fund, is required prior to the issuance of a building permit. The third condition requires that an all weather access be provided to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. Staff recommends that the second condition not be required as part of project approval for this application. This application is for a temporary mobile home, not a permanent second dwelling unit. As such, the mobile home will be removed from the project site once the intended occupants no longer live in it. 0 Butte County Department of Development Services Agenda Report ❑ • . 0 ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is.subject to the requirements of CEQA. This project qualifies for a categorical exemption to review under CEQA as per Section 15303 (Class 3 exemption), construction of small structures. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve Application No. UP 97-11 for Fred Cruz on APN 031-231-001, subject to the findings and conditions contained in Exhibit A. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Fred Cruz is hereby granted a Use Permit in accordance with application filed October 10, 1996, to allow a temporary mobile home on .26 acres located on the southeast corner of Grand Ave. and 9th St., Thermalito, in an area zoned C-1 (Light Commercial). Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes.may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. 'Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. Upon careful and deliberate review of the project and the project site environs, the proposed temporary mobile home will have no significant environmental effects and has been determined to meet the criteria for a categorical exemption under Section 15303 of the California Environmental Quality Act guidelines; and B. The design and improvements of the proposed project will not cause environmental damage to fish or wildlife or their habitat and is Deminimus; and Section 2: Zoning Ordinance Findings. A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with or injurious to surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County; and B. The proposed project is conditionally consistent with the C-1 Zone and is a Secondary Use under the Commercial General Plan designation; and Section 3: Action. A. The commercial use in this area is very limited -- only 4 out of 21 parcels. The second dwelling will be used by parents who are senior citizens. The Public Works Department has asked for several conditions which Planning staff feel should not be applied since the use will be temporary. He noted that Condition 11 requires adequate access for emergency vehicles. HEARING OPEN TO THE PUBLIC Jack Cruz, the son, said both his parents are disabled and need the temporary dwelling while he cares for them. It was moved by Commissioner Lynch, seconded by Commissioner Lambert, and carried unanimously, for approval of the Use Permit for .Fred Cruz, pursuant to the findings and conditions of the Agenda Report dated November 25, 1996. A. Upon careful and deliberate review of the project and the project site environs, the proposed temporary mobile home will have no significant environmental effects and has been determined to meet the criteria for a categorical exemption under Section 15303 of the California Environmental Quality Act guidelines; and B. The design and improvements of the proposed project will not cause environmental damage to fish or wildlife or their habitat and is Deminimus; and \ Section 2: Zoning Ordinance Findings. A. -4 The proposed, -use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not. 'U -,e unreasonably incompatible with or injurious to surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County; and B. The proposed project is conditionally consistent with the C-1 ' Zone and is a Secondary Use under the Commercial General Plan designation; and Section 3: Action A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for Fred Cruz on APN 031-231-001 to allow a temporary mobile home. Approval shall be subject to the following conditions: B. Conditions of Approval: 1. A mobile home certified under the 1974 National Mobile Home Construction and Safety Standards Act. Occupancy of the mobile home shall be limited to Fred and Ruth Cruz. An affdiavit, on a form provided by the Butte County Department of Development Services, Planning Division, shall be submitted yearly to the Planning Division attesting to the occupancy of the temporary mobile home and the dwelling unit. 2. No rent is to be charged to the occupant of the mobile home. 3. The temporary mobile must connect to the Thermalito Irrigation District for domestic water and sewer services. 4. The siting of the mobile home shall be exempt from the site requirements of the residential, zoning district, except as required by Butte County Code Chapter 24, and the Butte County Code Chapter 28A. 5. The mobile home is declared to be a temporary use on the property, accessory to the primary unit, and shall not be placed on a permanent foundation. Additionally, a temporary mobile home shall not be permitted on a lot or parcel where there is an approved Second Unit. 7. The mobile home shall be removed within one hundred twenty (120) days of either Fred Cruz and/or Ruth Cruz no longer residing in the mobile home. If it is not removed within one hundred twenty (120) days, the County shall remove said mobile home and store it at the owner's expense. 8. The Permit may be revoked if any of the terms or conditions of the Permit are violated or if any acts or omissions of the permittee in connection with the use authorized by said Permit constitute a public nuisance. 9. The applicant must maintain a bond or deposit in the amount of $1,500 fo:f 'a single -wide mobile home or $2,000 for a double -wide mobile home. 10. Building identification and/or addresses shall be instailed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 11. Provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. 12. Applicant shall comply with all other applicable State and local statutes, ordinances and regulations.
