Mr. Sanders summarized the staff report, noting the agricultural character of the area has
not changed since the homesite segregation was approved.
Chairman Lambert questioned the wording of Option 2 to extend the covenant for a period
not to exceed ten years and said the wording might better be: "until the character of the
area changes, or the zoning or General Plan."
Commissioner Leland said he sees the issue as one of property rights in that the County,
in approving the ag segregation, acquired the development rights on the ag parcel.
According to the language of the Development Agreement, the Commission has to find that
"circumstances regarding said property and other properties in the area have changed
sufficiently to reconsider the restriction. He did not think imposition of another ten year
time period should or could be part of the language of an action. The applicant
theoretically could apply for termination of the covenant every year. The discretion lies with
the Commission to decide if the character of the area (or zoning) has changed.

A motion was made by Commissioner Leland and seconded by Chairman Lambert for
denial of the request to terminate the Covenant. The motion was withdrawn and restated
below:
It was moved by Commissioner Leland, seconded by Chairman Lambert, and carried
unanimously, to deny the request to terminate the Covenant and, make the finding that the
circumstances regarding said property and other properties- in the area have not changed
sufficiently to reconsider the restriction, and confirm that the covenant will continue on its
own terms.

SUMMARY: This request is inconsistent with the zoning classification. Approval of the request
for the lifting of the condition of the Development Rights and Open Area Easement Agreement
would result in creating of two parcels, one parcel which would not meet minimum acreage
standards for the zone, while allowing increased density of additional dwellings on the other
parcel. Staff recommends the Planning Commission extend the current Use Permit with its
conditions and covenant of the Development Rights and Open Area Easement Agreement on
APN 022-190-049, File # UP 97-15.
PROJECT CHARACTERISTICS: The project site consists of 5.53 acres, zone A-5 ith a
General Plan Land Use Element designation of Orchard & Field raps., The site h s n used
for agricultural purposes with no residential development on-site. The project site is -the
agricultural portion of a 7.53 parcel that was divided in 1982, providing a 2 acre parcel with a
homesite segregation and this project's 5.53 acre parcel.
The project site is located on the north side of Chatfield Avenue, approximately 400 feet west
of Azevedo Avenue and approximately one mile southeast of Biggs. The project site is zoned
A-5 (Agricultural - 5 acre minimum) and has a General Plan designation of Orchard and Field
Crops. The surrounding parcels also have the same zoning classification and land use
designation.
The project site has been used for growing of hay and grazing of livestock. The parcel has
remained undeveloped and used for agricultural purposes because conditions of the Agreement .
required the parcel to remain undeveloped for a minimum of ten (10) years.
ANALYSIS: The applicant's request is to lift the conditions of a homesite segregation agreement
from parcel 022-190-049, but parcel 022-190-048 is also a part of the project in that the -creation
of the two (2) acre parcel was the homesite split from the original 7.73 acre parcel. The 2 acre
parcel, created with approval of this Agreement, has a single family dwelling. In June, 1982,

the previous owners of the 7.73 acre parcel, then identified as APN 022-190-038, applied for a
Use Permit to allow the segregation of a homesite. The Planning Commission approved the
homesite segregation on July 8, 1982. The owners of the property signed the Conveyance of
Development Rights and Open Area Easement agreement on October 5, 1982. The agreement
limited the use of the project site to agricultural uses only. One of the conditions of the
agreement was that no homesites were to be permitted on the 5.53 acre parcel. As a result, the
density requirements and land use integrity of the zone were maintained, while a nonconforming -
sized parcel was created, the 2 acre parcel 022-190-048.
The applicant has indicated the purpose of this request is to lift the Agreement's restriction
prohibiting a residential dwelling on the 5.53 acre parcel currently used for agricultural activities.
The result of approving this request would be a circumvention of the zoning ordinance for A-5
(Agricultural - 5 acre minimum) zoned land. What had originally been a 7.73 acre parcel with
an A-5 zoning classification would now become two parcels of 5.53 acres and 2 acres in an A-5
zone. No changes to the General Plan have occurred since original approval that warrants
termination.
Presently, no homesite segregations are approved in an agricultural zone (A-5 through A-160).
The Board of Supervisors, in approving the Agricultural Element of the General Plan on May 9,
1996, supported the position to discontinue Agricultural Segregations for homesites (see
Agricultural Element, Goal 3, Policy 3.3, p AE -13).
The original owners of the property, James & Thelma Powell, signed a Conveyance of
Development Rights and Open Area Easement agreement (covenant), which resulted in the
creation of parcels 022-190-048 (2 acres) and 022-190-049 (5.5 acres) from a 7.5 acre parcel
in an A-5 zoned area. This was approved by the Planning Commission in July 1982. The
covenant separated the single family residence from the larger parcel. The owners, in signing
the covenant, agreed the larger parcel, Parcel 049, would remain in agricultural use. This
covenant is binding upon the original owners and their heirs, successors and assigns, which
disallows additional buildings from being located on the agricultural parcel. ,
"The Use Permit and covenant shall be in force for ten (10) years minimum from the time
of recording of the covenant at the Recorder's office and will continue until the applicant
applies for termination or partial termination thereof." §24-290(C)
The purpose of this application is to terminate the covenant. The Planning Commission's
options for action on this application are:
Terminate or partially terminate the covenant and remove conditions from the Use Permit.
Applications for termination or partial termination to be accompanied by the fee set by
ordinance of the Board of Supervisors to be deposited in the County general fund.

3. Consider the area for a change in designation from Orchard and Field Crops, Grazing and •
Open Land, or Agricultural -Residential to a non-agricultural designation under the
General Plan.
The zoning section also states the Use Permit and covenant shall be in force for the agreed
upon time unless the General Plan is amended and the property in question is no longer
designated agricultural. At which time the applicant may apply for termination of the covenant.
Staff has reviewed the covenant agreement, the General Plan designation and zoning
classification, and has performed a site visit to the area. There has been no change in the
General Plan for the area. Although there are residences in the area, the general nature and
use of the surrounding area remains agricultural.
ENVIRONMENTAL DOCUMENTATION: This application has been determined to be exempt
from the California Environmental Quality Act (CEQA) as it is classified as Categorically Exempt
(Class 3(a)), and as such, is not subject to the requirements of CEQA.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be held.
Notices of the hearing will be mailed to all property owners within a 300 foot radius of the subject
property.
RECOMMENDATION: Staff recommends that the Planning Commission extend the current Use
Permit with its conditions and covenant of the Development Rights and Open Area Easement
agreement on APN 022-190-049, File # UP 97.-15, for Clyde & Carol Brandt.

of the Agricultural Zone in which the properties described in Exhibit "A"

set forth in the County's General Plan, it is necessary and desirable that
Grantor(s) convey to the County the right to construct additional residences
on the property described in Exhibit "A" as Parcel 2; and
WHEREAS, it is the intent of the Grantor(s) and the purpose of this
grant of development rights to allow the Grantor(s) to maintain a residence
on the lot described as Parcel 1 on Exhibit "A" and prohibit the maintenance
of residences on the property described in Exhibit "A" as Parcel 2 so as to
neither increase nor decrease the number of residences permitted by the zone
in which the said properties are located.
THEREFORE, in consideration of the approval of the use permit granting
permission to Grantor(s) to maintain a single family residence on Parcel 1
for the purpose of maintaining Parcel 2 as open area for agricultural pur-
poses, Grantor(s) grant(s) to the County an Open Area Easement with Grantor(s)
and their successors' right to construct and maintain any residential uses
on the property described in Exhibit "A" as Parcel 2 subject to the following
terms and conditions:
1. Grantor(s) reserve(s) the right to construct or maintain any agri-
cultural buildings or to use Parcel 2 for any agricultural uses otherwise

permitted by ordinances duly adopted by the County; or ordinances hereinafter {�
adopted by -the County to regulate the use of the property described as
Parcel 2, except any rights to construct or maintain any accessory buildings,

2. Nothing in this instrument shall be construed to affect the right '

pipe lines, conduits, or drains below the surface of the area described in
Exhibit "A" as Parcel 2 insofar as such activities are not incidental to
establishing any residential use of said area, and are not in conflict with
the provisions of this Grant.
3. This grant of development rights shall not be construed to permit
the public to enter upon the properties described in Exhibit "A" for any
purpose whatsoever.
4. This easement and grant of development rights shall terminate and
the rights granted to the County herein shall revert to Grantor(s) upon the
occurrence of any of the following events:
a. The property is rezoned to any other zone; or
b. At least ten (10) years has elapsed from date of recordation, and
the Commission finds circumstances regarding said property and
other properties in the area have changed sufficiently to reconsider
the restriction.

WHEREAS, pursuant to the County's General Plan. the'County has determined
that the property of Grantor(s) described in Exhibit "A" is agricultural
land constituting a natural resource of Butte County; and
WHEREAS. the County's General Plan sets forth a Policy of Protecting
the Agricultural Production Capability of Agricultural lands. and the
maintenance and conservation of this natural resource; and
WHEREAS, in furtherance of such policy, the County has zoned the
property described in Exhibit "A" to an Agricultural Zone; and
WHEREAS. Grantor(s) desire(s) to create a lot for the purpose of
maintaining a single family residence thereon, such lot being described as `
Parcel 1, in said Exhibit "A"; and
WHEREAS. Grantor(s) has (have) applied for and been granted approval
of the use permit pursuant to the provisions of the Butte County Section i`
24-S4 to permit the maintenance of such residence thereon; and

WHEREAS, in order to preserve and maintain the agricultural purposes
of the Agricultural Zone in which the properties described in Exhibit "A"
are located, and to maintain the consistency of said :one with the policies
set forth in the County's General Plan. it is necessary and desirable that
Grantor(*) convey to the County the right to construct additional residences
on the property described in Exhibit "A" as Parcel 2; and
WHEREAS, it is the intent of the Grantor(*.) and the purpose of this
grant of development rights to allow the Grantor(s) to maintain a residence
on the lot described as Parcel 1 on Exhibit "A" and prohibit the maintenance
of residences on the property described in Exhibit "A" as Parcel 2 so as to
neither increase nor decrease the number of residences permitted by the sone
in which the said properties are located.
THEREFORE, in consideration of the approval of the use permit granting
permission to Grantor(s) to maintain a single family residence on Parcel 1
for the purpose of maintaining Parcel 2 as open area for agricultural pur-
poses. Grantor(s) grant(s) to the County an Open Area Easement with Grantor(s) i

and their successors' right to construct and maintain any residential uses

on the property described in Exhibit "A" as Parcel 2 subject to the following
terms and conditions:
1. Grantor(s) reserve(s) the right to construct or maintain any agri-
cultural buildings or to use Parcel 2 for any agricultural uses otherwise
permitted by ordinances duly adopted by the County; or ordinances hereinafter
adopted by -the County to regulate the use of the property described as
Parcel 2o except any rights to construct or maintain any accessory buildings,
subject to any regulations or limitations set forth in any such ordinances.

of Grantor(s) to lay, operate9 maintain, repair, or remove nater and sews..

4. This easement and grant of development rights shall terminate and
the rights granted to the County herein shall revert to Grantor(s) upon the
occurrence of any of the following events:
a. The property is rezoned to any other zone; or
b. At least ten (10) years has elapsed from date of recordation, and
the Commission finds circumstances regarding said property and
other properties in the area have changed sufficiently to reconsider
the restriction.

County agriculture Element that I believe were not
considered. I have attached same to this letter.
We have consolidated several parcels just to
maintain a viable economic model. Likewise, we incorporated
the ranch to effect such a model. We are in our senior
years and is imperative that our management be on site.
It was very discouraging to be denied said request
when your intent is to enhance responsible management.

Goal 1
Maintain parcel sizes that ensure the long-term preservation, conservation and continuity
of those general plan areas identified as Orchard and Field Crops and Grazing and Open
Lends.
Policies
1.1 Designate Orchard and Field Crops lands on the General Plan Land Use Element
Map based on Figure A-1, (Soil Classifications), and the current or historical
existence of field crops, seed crops, vegetable crops, tree and vine crops,
aquaculture, nursery stock, and apiary products and uses. :
1.2 Designate Grazing and Open Lands lands :on the General Plan Land Use Element
Map based on Figure A-1, (Soil Classifications), and the current or historical
existence of grazing, animal husbandry and aquaculture use.
1.3 Designate areas outside of the adopted Spheres of Influence of Chico, Oroville,
Paradise, Biggs and Gridley, and outside of the more intensely developed portions
of the communities of Durham; Nord, Honcut, Bangor, Richvale, and Palermo for
the protection of continued agriculture. The County recognizes the cities of Gridley
and Biggs desire to study possible future urbanization within the corridor area
between those two cities. However, as long as these are unincorporated lands the
County has the primary responsibility for planning in this area.
1.4 . In order to address and plan for future growth needs, Gridley and Biggs are
encouraged to undertake a comprehensive review and update of their respective
general plans and related documents.
1.5 Conserve Orchard and Field Crops lands and Grazing and Open Lands as
designated in the General Plan Land Use Map.
1.6 Limit the minimum parcel sizes for new land divisions, in areas identified as
Orchard and Field Crops on the General Plan Land Use Map, to not less than the
existing zoning designations from 5 to 160 acres. The densities currently
established by the existing zoning on Orchard and Field Crops lands shall be the
minimum lot size allowable. Further subdivision of Orchard and Field Crops lands
are discouraged.
1.7 In the Orchard and Field Crops area, encourage parcel consolidation. and site -
sensitive planning by allowing for Transfer of Development Credits (TDC) and other
land use concepts.

1.8 In the Grazing and Open Lands area, encourage the voluntary retention of ranch
lands in large acreages through site -sensitive planning, Transfer of Development

1.1 Amend the Land Use Element Map outside of the LAFCo-adopted Spheres of
Influence by designating Orchard and Field Crops and Grazing and Open Lands
generally as shown on Figure A-2, (Agricultural Land). Amendments to City
spheres of influence and community spheres may occur from time to time.
Consideration of amendments: to the spheres for cities and for communities must
be based upon detailed land planning, including but not limited to a specific plan,
community plan or detailed general plan, and the LAFCo sphere amendment
process.
1.2 Amend the Zoning Ordinance to provide zoning consistent with a Orchard and
Field Crops and a Grazing and Open Lands land use designations including
minimum lot sizes, and uses which support continued agriculture, as shown on
Figure. A-2, (Agricultural Land);.
1.3 In the zones consistent with the general plan designations of Orchard and Feld
Crops and Grazing and Open'. Lands make provisions for the following:
■ A definitive purpose and intent
■ A detailed list of permitted and expressly prohibited uses
■ Aquaculture and related facilities
■ Accessory uses
■ Continuation of agricultural segregations for processing only
■ Specific requirements for agriculture -dependent and.
agriculture -related industries
■ Parcel consolidation
■ Site sensitive land planning
■ Residential clustering through the PUD process with density
bonuses in the Grazing and Open Land area
■ Residential clustering without density bonuses in the Orchard
and Field Crops area
■ Transfer of Development Credits
■ Minimum lot sizes and development setbacks
1.4 Apply A (Agriculture) zoning to all lands designated Orchard and Field Crops on
the General Plan Land Use Map.

2.2 Encourage urban infill development within city limits and within existing
unincorporated communities where development can more easily and readily be
served by public infrastructure facilities.
2.3 Require development to provide land use transitions, setbacks and buffers
between urban development and agricultural interface to reduce interference and
conflict.
2.4 Create development and performance standards designed to protect agricultural
uses from urban encroachment conflicts:
2.5 Encourage urban development to the LAFCo adopted Spheres of Influence.
2.6 Provide a clear delineation, on'the General Plan Land Use Map, between long-term
agricultural production lands and city/community areas.

2.7 Allow for the conversion of agricultural land within LAFCo Spheres of Influence
where land has been determined to be irretrievably lost to urbanization. These
would likely be areas where urban development has surrounded or substantially
encroached upon agricultural land and has limited its continued productive use.
2.8 New residences within agricultural areas shall be required to pay its fair share of
development impacts on public services and infrastructure.
Programs
2.1 Rezone unincorporated land within LAFCo-adopted Spheres of Influence to be
consistent with urban densities and City -adopted General Plans. Cooperate with
cities to make maximum efficient use of vacant lands within adopted Spheres of
Influence.
2.2 The Zoning Ordinance shall require that a buffer be established on property
proposed for residential development in order to protect existing agricultural uses
from incompatible use conflicts. The desired standard shall be 300 feet, but may
be adjusted to address unusual circumstances. Guidelines, as part of the General
Plan's implementation, shall be developed illustrating buffer requirements for
various situations.
2.3 Where development approval, other than residential, is proposed on lot(s) adjacent
to an agricultural operation or Orchard and Feld Crops land use category, the
Zoning Ordinance shall require a natural or man-made buffer between the .
development and the agricultural land use. The buffer shall be totally on the lot(s)
where development is proposed. A buffer could be a topographic feature,. a

3.1 Apply the County's Right to: Farm Ordinance to all non-agricultural land use
approvals, including building permits, within or adjacent to designated agricultural
areas.
3.2 In order to preserve the maximum amount of land for commercial agricultural
production and to avoid conflicts, restrict non-agricultural uses in the Zoning
Ordinance, including, but not limited to, water ski lakes, riding stables, golf
courses, residential subdivisions, and industrial and commercial uses not directly
related to agriculture on agricultural lands. Public uses, including but not limited
to, sewer treatment plants, drainage facilities, and energy generating facilities shall
be permitted subject to a Use Permit. Such facilities shall be carefully located so
as not to unduly interfere with existing or planned agricultural activities.
3.3 Discontinue Agricultural Segregations for homesites (I'rfe estates serve the same
purpose).
3.4 Continue Agri ulturaI Segregations for agricultural processing while requiring an
agricultti�al cQ nservation easement on the remaining land, a vegetation buffer of
6 to 8 feel � full growth around the processing use, and a 200 -foot setback from
the agricultural area.
3.5 '/The primary purpose of the Orchard and Field Crop and Grazing and Open Lands
land use categories shall be for agricultural production, related processing, and
services in support of agriculture. Residential uses, such as the farmer's home,
in these categories are secondary uses and are permitted on a limited basis to
assist and support agriculture.
3.6 Carefully locate residential lands where limited agricultural uses and farm animals
are allowed, to avoid conflicts with agricultural operations. This includto.,
limited to, commercial stables, and the raising of exotic animals. .

3.7 Ensure that pre-existing lots, uses, and buildings which were legal prior to the
adoption of the Agricultural Element are permitted to continue.
Programs
3.1 Require recordation of the County's Right to Farm agreement as a condition of all
residential land divisions in areas adjacent to or designated for Orchard and Feld
Crops and/or Grazing and Open Lands. Promote a general public awareness and
understanding of the special requirements of commercial farming, ranching, and
agricultural practices associated with normal farm activities. Additionally, provide
the County Recorder's Office with copies of the County's Right -to -Farm Ordinance
and copies of the County prepared written explanation.
3.2 Require sellers or any fiduciary agents to provide a County prepared written
explanation of the County's Right -to -Farm Ordinance as part of the notice package
to prospective buyers in areas adjacent to and within Orchard and Field Crops
and/or Grazing and Open Lands areas.
3.3 Utilize mitigation banks, environmental mitigation sites, wildlife refuges, and other
natural resource preserves, within or adjacent to land designated or used for
agricultural lands, to allow the continuation of standard farming or ranching
practices.
3.4 Enforce provisions of existing State Nuisance Law (California Civil Code Sub-
section 3482.5).
3.5 When a request is made for a Use Permit on a lot(s) with existing agricultural
operations, require the submittal of an agricultural maintenance plan to provide for
the continuation of existing agricultural activities. The plans shall .be reviewed for

3.6 Provide a definitive purpose section for the agricultural zones. and a list of
agricultural uses, including, but not limited to, crop production, orchards,
aquaculture, animal husbandry, agricultural industries, and the like, which preserve,
promote, and support the agricultural area.
3.7 Amend the Zoning Ordinance to recognize the legal rights of existing legal lots,
1K uses, and buildings which, as.a result of the Agricultural Element, do not comply.
Additionally, amend the Zoning Ordinance to exempt legal non -conforming lots,

for expansions, additions and modifications that would normally be allowed for

6.1 Facilitate agricultural production by considering a limited range of ancillary or

production occurring in the surrounding area or dependent upon -an agricultural

6.1 Create opportunities to promote and market agricultural products grown or
processed within Butte County (such as a Farmers' Market) as a part of the
economic development activities of local government agencies.
6.2 Allow limited visitor -serving commercial uses, such as wineries and specialty
produce markets, subject to the approval of a Use Permit in agricultural areas, to
ensure continued agricultural use and compatibility with surrounding uses.
6.3 Continue to permit roadside stands for the sale of agricultural products, in any
agricultural land use category, to promote and market those agricultural products
grown or processed on the property. Clearly secondary and incidental sales of
agricultural products grown in Butte County may be permitted subject to
appropriate approvals.
6.4 Require that agriculture -dependent industries and uses meet the following criteria:
■ The use will not require the extension of sewer or water
■ The use does not substantially detract from agricultural
production on-site or in the area
■ The use does not create a concentration of commercial uses
in the immediate area
■ The use is compatible: with and does not adversely impact
surrounding land uses
■ The use provides for adequate traffic circulation

numbers of employees to be housed on both a seasonal and permanent basis.

7.1 Work with agricultural land owners to provide appropriate amounts, at reasonable
densities, of farm labor and farm family housing.
7.2 Assist in the location of farm labor and farm family housing where it promotes
efficiency in the farming operation and has a minimal impact on productive
farmland.
Programs
7.1 Site farm labor and farm family housing units to minimize disruption of farming
operations, avoid conversions of productive farmland, and take maximum
advantage of existing facilities including utilities and driveways.
7.2 To help provide a stable work force for agriculture, continue to facilitate efforts of
individuals, private organizations and public agencies to provide safe and adequate
housing for farm workers.
7.3 Limit residential land uses in the agricultural areas to dwellings only for
preservation of the family farm,'.for farm employees and those persons who own
the farm land, up to a limit established by Ordinance. All such dwellings shall be
encouraged to locate on lands least impacted for agricultural use and/or in
"clustered" configurations to minimize the conversion of agricultural lands to any
other uses. A maximum dwelling unit density for the total acreage in the farm or
ranch shall be established by Ordinance. Records verifying employment of farm
workers must be provided and made available on request.
7.4 Allow temporary housing, including temporary sanitary and cooking facilities, for
seasonal workers during harvest season subject to applicable building and health
codes.
7.5 Enforce the provisions of the 'Uniform Building Code and State Health Codes.

ANALYSIS: Approval of this project would allow a the segregation of two single family dwellings of 2300 sq.fL and
1960 sq.fL in size on 1.3 acre parcels. The applicant indicates that the homes are utilized by ranch employees and
it is the owners desire to.transfer ownership of the segregated homesites to these employees. This application has
been reviewed for consistency with the land use regulations found in the Butte County General Plan Agricultural
Element, the Orchard & Fleld Crops General Plan designation, the Butte County Zoning Code Sections 24-90 (A-20,
Agricultural Zones) and 24-185 (Segregation of Homesit-as in.Agricultural Zones) and the Subdivision Map Act as
discussed below.
Agricultural Element
The Butte County Agricultural Element (AE) was adopted by the Board of Supervisors in May of 1995 after two years
of discussions by members of the Butte County Farm Bureau and members of the agricultural community. This
Agricultural Element Committee reviewed the agricultural uses and policies in Butte County and developed the AE
of the General Plan to preserve and enhance the agricultural base of Butte County. The AE applies to all.lands
designated in the Butte County General Plan Land Use Element as Orchard & Field Crops. Goal 1, Policy 1.9 (p.AE-
10) also applies the policies of the AE to the parcels located in the Durham- Dayton -!Nelson (D2N) Area Plan.. The.
parcel in this application is subject to both the regulations of the AE and the D2N Plan.

On December 2, 1996, our office received an application for a Use Permit
accompanied by a deposit in the amount of $700.00. Your project is being processed
by our staff on a "real time" billing basis. To date your project has incurred charges
totaling $658.00.
Butte County Code, Sec. 3-44 (c) states, in part, 'When the initial deposited funds are
depleted to an amount equal to twenty-five (25) percent of the original deposit, no
additional processing of the application will occur until the applicant deposits with
Butte County sufficient funds to restore a balance equal to the amount of the initial
deposit".
Due to the complexity of your project, processing to date is very close to exceeding
your initial deposit. To continue the processing of your project we will require that a

PLEASE CONTACT THE BUTTE COUNTY FIRE DEPARTMENT FOR COMPLIANCE WITH THE
FOLLOWING CHECKED CONDITIONS
Construction, installation or development of structures or facilities on the parcels/lots shall
comply with the latest California Fire Safe Regulations, (Public Resources Code 4290),
and all other applicable State and County codes, ordinances and regulations in effect at
the time of application for improvement permits.
l� 2. Building identification and/or addresses shall be installed in conformance with Public
Resources Code 4290 and shall be posted at the beginning of building construction and
maintained continuously thereafter.
3. Fire hydrant identification, reflector or post reflectors shall be installed acceptable to the
County Fire Warden.
4. In lieu of a pressurized water system or water storage tank, payment of $200.00 per
created parcel into the Battalion _ water tend fund, is required prior to the issuance of a
building permit.
5. A pressurized community water system for fire protection is required. The specific
locations and fire flow requirements shall be in accordance with the Fire Department
specifications and to the satisfaction of the County Fire Warden. Average required hydrant
spacing _ feet, hydrant size _ inches, and residual fire flow _ gpm. Submit plans to
the Fire Department for review and approval prior to construction of facilities.
6. In lieu of hydrant installation, payment may be made into the hydrant fund at a cost
of $1.72 per lineal foot of street frontage. The estimated fee amount is $
_ 7. Prior to recordation of the Map or application for a building permit, the applicant shall pay
the then current fee for4he West Chico Fire Station Fund.
8. Provide an all weather access to all structures, which is designed to carry a 40,000 pound
fire apparatus at least 10 feet wide with a 15 foot vertical clearance.
