(SH) (File UP97-16) A video of the site was shown. Mr. Hackney gave a brief summary of the project. He said staff recommends denial. He said there have been many complaints from the neighbors. Mr. Hackney noted a correction in the findings, changing Section 2 A(3) from 100 new parcels to 12 new parcels. Chairman Lambert noted that a letter in opposition was received from Horace and Natalie Grimm. A petition from Loretta Hinkle, with photos, in opposition, was also received. The hearing was opened to the public. Larry Bannon said he was adamantly against this kennel because of the noise. .William Bisbee said the Commission is welcome to visit the site. He said when a person -- - has.land they_ should_ be, able to -have .animals. .He said _other_-neighbors.have.dogs.that, bark and make his dogs bark. He said he would follow the conditions and the law. Commissioner Leland said he understood Mr. Bisbee's feeling, but the C_ ommission has to judge this project on meeting the criteria of the.Butte County Code and law. Clayton Mitchell said he was opposed to the permit because of noise. He said Mr. Bisbee's dogs bark all night and keep him up. He said the kennel would de -value property in the area. Alice Barnes said she was the previous owner of this property for 17 years and she never had any problems with her neighbors. She said Mr. Bisbee is using a private road for access that he does not have a right to use. She was opposed to the kennel. Robert Johnson said he was against the project because of noise. He also felt the kennel would de -value his property. Loretta Hinkle said she has lived here for 27 years. She said the dogs bark all day and night. She said she has a tape recording of Mr. Bisbee's dogs barking. She was against —the -kennel. - - - - - Linda Bickford said she was opposed to the kennel. ' BUTTE COUNTY PLANNING COMMISSION MINUTES - July 26, 1997 I� Walt Hagard suggested that approval of this permit would give the County jurisdiction and control over the,dogs. Mr. Bisbee said he has the dogs for his livelihood. He said, yes, dogs bark. He said some of the people testifying today are not telling the truth. The hearing was closed. Commissioner Leland said he visited the site. He said there was a slight odor from the Emus, but it was not bad. It was. moved by Commissioner Mooney, seconded by Commissioner Leland, and unanimously carried to deny the Use Permit as follows: EXHIBIT "A" Section 1: Environmental Findings. A. - An Initial Study has been completed in compliance with the California Environmental Quality Act. B: Potentially significant environmental impacts•�may result from approval -of -this, application. C. The Initial Study has been. independently .reviewe-d,_analyzed and._consider_ed..and_ reflects the independent judgement of the County of Butte.- , Section 2: Zoning Ordinance Findings. A. The proposed use of the property, pursuant to Butte County Code Section 24-100, may conflict with, impair or be detrimental to the uses both permitted and conditional in the ARMH-1 zone and the Agricultural Residential General Plan designation in which it is located and/or adjoins: 1. Existing development pattern has numerous residential structures within 300 feet of the proposed use; and 2. The ARMH-1 zone will allow for the creation of more than 12 new parcels . immediately adjacent to the project site; and -3: The -keeping -of animals, including dogs,• has , resulted. in.several complaints regarding noise and sanitation on this property. The proposed use will be incompatible with, or injurious to, surrounding properties in_.that. .the ,.project .site_.has,.not. existed, -compatibly with.. adjacent,. properties. for several years and it is not reasonable to expect that approval.of this application, even conditioned to address the identified potential impacts, will reduce such impacts to a level of insignificance; and C. The proposed use of the property will be detrimental to the health, safety, and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety. of the residents of the County in that the proposed use will exacerbate existing conditions associated with identified impacts. Section 3: Action. A. Subject to the findings in Sections 1 and 2 of this Exhibit.the request for a Use Permit is denied for William Bisbee on APN 026-050-026 to allow a dog kennel for eleven (11.) dogs on property zoned ARMH-1 located at 6850 Melvina Avenue, approximately 1700 feet north of Messina Avenue, Palermo area. Mr. Bisbee asked about getting his money back. _ Chairman -Lambert-explained,that When an application`is applied -for there is the risk that the project may be denied. She informed Mr. Bisbee of the appeal process. RELATED ITEMS: None .FOR: Planning Commission Meeting of June 26, 1997 SUMMARY: This application is for a Use Permit to allow a dog kennel, to include a 320 square foot structure consisting of 10 stalls, 11 dogs and 12 runs on a six (6) acre parcel in Palermo. Staff recommends the Planning Commission deny this request due to the findings contained in this report. PROJECT CHARACTERISTICS: This request is for a Use Permit to allow a dog kennel, to include a 320 square foot structure consisting of 10 stalls, 11 dogs and 12 runs on a six (6) acre parcel in Palermo. The applicant does not propose a commercial venture and will not have any employees. Currently the site has a single family residence and a barn and an assortment of animal life on the 6 acre site. The project site is zoned ARMH-1 (Agricultural Residential Mobile Home - 1 acre minimum) and has a general plan designation of Agricultural Residential. The project site is surrounded by parcels ranging in size from 1/4 acre to 5+/- acres. All surrounding parcels have ARMH-1 zoning and Agricultural Residential land use designation. The parcel is bordered by residences on all sides. There are several residence's less than 300 feet from where animals are presently being kept. The site is serviced by its own septic system and well water. Access to the parcel is from Melvina Avenue via Messina Avenue, Palermo. ANALYSIS: The request can be considered under the current ARMH-1 zoning and Agricultural Residential land use designation. The dog kennel is listed as a conditionally consistent use in the ARMH-1 zone, and is a secondary use of the Agricultural Residential land use designation. The project site is approximately six (6) acres in size. However, staff ❑ Butte County Department of Development Services - Planning Division ❑ 1 has several concerns with this request. These concerns include: sanitation, noise, and land use compatibility with surrounding neighbors. Sanitation. Approval of this project may have a potentially significant impact from runoff to nearby surface waters due to dog feces and other animal wastes.' This is an issue that, with proper mitigations, could be adequately addressed for the kennel use through the design & installation of a concrete pad that drains to an approved septic system. Currently the applicant has a wide assortment of animals on his property: horses, mules, goats, pigs, geese, ducks, peacocks., chickens, and dogs. Staff noticed several areas of scattered animal waste on the property, as well as piled animal waste. This request is intended to apply only to the keeping of dogs in the kennel, other animals are governed by the animal keeping sections of the zoning code and are permitted without a permit or any restriction on the number of animals kept. Noise. Approval of this project may result in a potentially significant impact from noise. The applicant currently has two hound dogs on the property already. This has resulted in several noise complaints to Butte County Animal Control. Butte County Animal Control's comments regarding this application is that approval of this request "most likely will result in additional nuisance complaints .... " Butte County Animal Control points out that the type of dogs the applicant has said he wants to kennel (hound dogs) are known for howling excessively just by their nature. This is an issue that could be addressed through the use of proper mitigations such. as anti -barking collars and/or bark -activated sprinkler systems. However, ongoing monitoring may be difficult and the potential for more complaints may not be significantly reduced. Land Use Compatibility. The Agricultural Residential General Plan designation allows for intense animal uses as a secondary use and makes provisions for quasi -public uses. The proposed dog kennel conforms to this criteria in that it is clearly an intense animal use. While the ARMH-1 (Agricultural Residential Mobile Home -1 acre min.) zone does allow for animal keeping, it was modified in February 1995 to specifically require a use permit to allow kennels based on past interpretations of animal keeping. This request for a dog kennel is not compatible with the character of the surrounding neighborhood. There are residences on all sides of the project site, with some family dwellings less than 200 to 300 feet away. All the surrounding parcels are zoned ARMH- 1. Most of the neighboring parcels are larger than two (2) acres in size. The potential for future land divisions down to one acre parcels is present, resulting in the increasing of the number of residences living next/near the proposed dog kennels. The neighborhood is of a rural residential nature, i.e. larger parcel sizes and animal keeping. The kennel may create significant visual and odor impacts to surrounding properties due to the proximity of several neighbors', residences. The applicant's parcel is not screened from, surrounding residences. The site currently has some odor impacts due to the number of different species of animals already on-site and because of the manner in which the animal waste exists on-site (Site visit). The kennel will create a significant ❑ Butte County Department of Development Services - Planning Division ❑ 2 noise impact due to the type and number of dogs. The history of noise events on-site and the history of the relationship of the applicant with his neighbors (as related to staff by William Bisbee indicate the County may expect continued noise nuisance complaints. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. Based upon the review of the Initial Study, staff has determined there are potentially significant impacts resulting from this project. RECOMMENDATION: Staff recommends that the Planning Commission deny the application for William Bisbee on APN 026-050-026, due to the following findings in the attached .Exhibit "A." Project Description and Location of Parcel(s) The request is for a Use Permit to allow a 320 square foot structure consisting of 10 stalls, 11 dogs and 12 runs on a six (6) acre parcel in Palermo. The applicant has indicated he plans to keep up to 11 hunting type dogs (hounds) of his own in the kennels. Occassionally he might keep a friends dog for a brief time. The applicant does not propose a commercial venture and will not have any employees. There are no plans to breed dogs. The applicant likes to hunt and wants the dogs for his personal use. Currently the site has a single family residence and a barn and an assortment of animal life on the 6 acre site. The project site is zoned ARMHA (Agricultural Residential Mobile Home -1 acre minimum) and has a general plan designation of Agricultural Residential. The project site is surrounded by parcels ranging in size from 1/4 acre to 5+acres. All surrounding parcels have ARMHA zoning and Agricultural Residential land use designation. The parcel is bordered by residences on all sides. Surrounding residences average less than 300 feet from the project site. The topography is fairly level, and while there is an assortment of trees along Melvina Avenue and bordering the property, there is no natural screen blocking the project site from the neighbors. Water is provided by a private well and sewer service is provided by a septic system. Access to the parcel is from Melvina Avenue via Messina Avenue, Palermo.' 6. The applicant described having huntingftund dogs in the kennel. The breed of dog the applicant has discussed bringing to his property is known for its 'howling'. Currently the applicant has at least one hound onsite. Existing noise levels resulting from dog howling has already disrupted the neighbors on an ongoing basis. The Butte County Animal Control officer has been called out to the site on several occasions because neighbors have complained about the noise from this (these) dogs. This officer has stated that any permit approval for additional dogs will result in additional nuisance complaints (see Comments from Butte County Animal Control). There may be mitigation measures that could address this condition, such as requiring the dogs to have anti -baric collars; or, that a sprinkler system be installed in the kennel so that whenever the dogs howled the sprinklers would be activated, drenching the dogs and (dampening their spirits) discouraging them from barking. MITIGATION #2: Prior to final inspection of kennel structure, the applicant shall install a noise activated "anti -bark" sprinkler system in the structure. MITIGATION #3: The kennel operation shall not create average noise levels in excess of 55dB at property lines. If average noise levels exceed this level for a sustained one hour period or on a daily basis, noise mitigation measures shall be implemented that may include, in addition to the noise activated sprinkler system, sound walls, "anti -bark collars" or other methods approved by the Department of Development Services. Any necessary noise mitigation measures shall be installed within one month of being identified as necessary. 11. PUBLIC SERVICES. Currently that noise level is disruptive enough to the neighborhood that Butte County Animal Control has been called to the site on a number of occasions.
