Assisted living is a non-medical environment in which elders needing care and supervision can reside in a more home -like setting. We are licensed by the State of California to provide the following: assistance with dressing and bathing, supervision of medications, all meals and snacks, housekeeping, laundry, an activity program and transportation to medical appointments. There will be three shifts --the AM shift will employ -4-5 staff; the PM shift will employ 2 staff and the overnight shift will consist of 1 staff. There still remains a critical need for assisted living facilities for those elderly who are confused and require more specialized care and a safe environment. The setting,(near the end of Kovak Ct.) is ideal for such a facility because it is at the end of the road and adjacent to the Country House, an assisted living facility which has been in operation for over eleven years. The location provides for a safe, -quiet environment away.from heavy traffic. Currently there are only 12 beds of assisted living in Chico for those elderly who require specialized care due to dementia. 32. Currently there is a tri-plex located on the site. The exterior will remain somewhat the same. The interior will be renovated to accommodate 7 elderly residents. The landscaping will remain the same. 33. To the east of the tri-plex is the Country House, an assisted living facility for the elderly. To the west of the tri-plex to Cohasset Road are four similar tri-plex units. To the south of the tri-plex is an empty field and to the north is a drainage ditch. ,Office buildings are on the other side of the ditch. The area is zoned..Y-R-3 and there will be few exterior changes. Planning Division MAR 2 0 1997 orowie, Cajitornia 0 AGENDA REPORT TO: Honorable Chair and Planning Commission FROM: Department of Development Services, Planning Division DATE: May 29, 1997 REQUEST: Use Permit 97-24 for Lynette Dorerizo (Applicant): A Use Permit request to allow a 7 bed assisted living facility for the elderly in a R-3 (High Density Residential) zone, identified as APN 048-400-006, located on the north side of Kovak Ct., approximately 350 east of Cohasset Road, at 962 Kovak Ct., Chico. The project site is located in Supervisorial District,3. RELATED ITEMS: - None FOR: Planning Commission Meeting of June, 1997 SUMMARY: Staff recommends approval of this application subject to the findings and conditions contained herein. PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a 7 bed assisted living facility for the elderly. The project site'is .49 acre (21,450 sq. ft.) in size, and is zoned R-3 (High Density Residential). The Land Use Element Map of the Butte. County General Plan designates the project site as High Density Residential. The R-3 Zoning Ordinance requires that a conditional Use Permit be obtained for group homes for seven or more persons. The project site is developed with a 3,771 sq. ft. tri-plex structure which has been used for three rental units. Domestic water service for the project site is supplied by a public water system. Sewage disposal is handled by an on-site septic system. The project site is located within the Chico Nitrate Action Plan area. Surrounding parcels have numerous different zonings. The parcels immediately to the west of the project parcel are located in the County and are zoned R-3. Parcels to north, 'across a drainage ditch from the project site, are located in the City of Chico and are zoned R -P (Residential -Professional). The parcel to the south is located in the City of Chico and has split zoning:. R -P along Cohasset Road and R-1 further to the east. The parcel to the east of the project site, is located in the County and is zoned R-4. Surrounding land use is tri-plexes to the west, office buildings to the north, undeveloped to the south, a single family dwelling to the southeast, and an assisted living facility for 15 residents to the east, which is also operated by the applicant. The proposed use will be an assisted living facility for 7 elderly residents. The applicant is C� Butte County Department of Development Services 0 Planning Division ❑ licensed by the State of California to provide the following services: assistance with dressing and bathing, supervision of medications, all meals and snacks, housekeeping, laundry, activity programs, and transportation to medical appointments. There will be approximately 8 staff members, with 4-5 staff for the day shift, 2 staff for the evening shift, and 1 staff member for the overnight shift. The interior of the building will be renovated to accommodate the 7 elderly residents. The exterior of the building will be slightly altered. ANALYSIS: The proposed use will change the land use from three rental units to an assisted living facility for 7 elderly persons. The change in land use will not be significant and will not have a significant impact to the neighborhood because the proposed use will have the same approximate number of residents as a residential use of the project site, and the number of vehicle trips generated by the proposed use will be less than that generated by the residential use. The three rental units would house approximately 7 people (2.3 persons per unit), which is the approximate number of people who will live in the assisted living facility. The interior of the existing structure will be renovated to accommodate the 7 elderly residents. The exterior of the structure will be altered slightly, but will still retain the appearance of tri-plex dwelling units. The proposed use will not change the appearance of the neighborhood. According to the Institute of Transportation Engineers Trip Generation handbook, the number of vehicle trips expected to be generated by the type of proposed use will be approximately 15 vehicle trips day. However, this estimate may not be accurate because the number of vehicle trips expected to be generated by the employees of the facility will be approximately 16. Adding in the vehicle trips required for deliveries and for visitors to the facility, the total number of vehicle trips is expected to be higher than the figure given in the Trip Generation handbook. Few, if any, of the residents of the assisted living facility are expected to own vehicles. A residential use of the project site would generate approximately 30 vehicle trips per day. It is expected that the number of vehicle trips generated by the assisted living facility will be similar to the number of vehicle trips generated by a residential use of the tri-plex. Delivery trucks are expected to make a few trips daily to the facility, but this is not expected to be significant and some of the truck trips will be in conjunction with deliveries to the County House living care facility located adjacent to the proposed use. The Butte County Fire Department commented on this project and is requesting that building identification and/or addresses be installed and maintained in conformance with Public Resources Code 4290. They are also requesting that an all-weather access road be provided to all structures, -which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. The existing improvements should already meet these standards, but these standards will be added as conditions of project approval to ensure that the standards are met. The Butte County Department of Public Works did not have any comments or conditions regarding this project. j= Butte County Department of Development Services ❑ Planning Division 2 The Butte County Environmental Health Division requests that a condition of this project require that prior to issuance of a building permit that the applicant obtain Butte County Health Division clearance for any remodel, infill, or additions to the existing structure. This has been added as a condition of approval. The north and south property lines of the project site are located adjacent to the City of Chico. Comments received from the City of Chico Planning Division state that the project site has been prezoned R-2, and that a group care home serving 7 to 12 individuals and licensed by the State of California is permitted with a Use Permit under the R-2 zoning. The project site is part of a five parcel County island that is surrounded by the City of Chico. At some point in the future, the project site will most likely be annexed to the City of Chico. The proposed use is consistent with the City of Chico's prezoning for the area. The project site is located approximately 6,500 feet from the end, and slightly to the west, of the main runway at the Chico Municipal Airport. The project site is located within the Chico Municipal Airport Environs Plan area. The Butte County Airport Land Use Commission (ALUC) held a public hearing on this project at their May 21, 1997 meeting. At that hearing, the ALUC determined that the proposed living care facility is consistent with the Chico Municipal Airport Environs Plan, and recommended several conditions for project approval. The first recommended condition requires that noise reduction measures be incorporated into the living care facility structure in order to reduce the inside noise level to 55 dB CNEL or less. Prior to issuance of a Use Permit, the applicant will be required to submit documentation to the Building Department that shows that the interior noise level of the structure does not exceed 55 dB CNEL. The second recommended condition requires that the landowner sign an avigation easement. The avigation easement grants to the City of Chico the right to use the land above the project site for aircraft operations associated with the Chico Municipal Airport. The avigation easement also serves the purpose of notifying the current and any future landowners of the project site that they may be subject to noise impacts from aircraft operations. These recommendations, from ALUC have been added as conditions of project'approval. To approve a Use Permit, the Planning Commission must find that the request meets the requirements of Section 24-45.10 of the Butte County Zoning Ordinance. This section states that the Commission may grant a Use Permit if the proposed uses of the property will not impair the integrity and character of the zone in which the lands lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. This project qualifies for a categorical exemption to review under CEQA as per Section 15303 (Class 3 exemption), conversion of existing small structures from one use to another. Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within a 300 foot radius of the subject property. RECOMMENDATION: Staff is recommending that a Use Permit be granted for Lynette Dorenzo on AP 048-400-006 for a 7 -bed assisted living facility for the elderly subject to the findings and conditions contained in Exhibit "A", attached. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Lynette Dorenzo is hereby granted a Use Permit in accordance with the application filed: March 20, 1997, to allow a 7 -bed assisted living facility for the elderly in a R-3 (High _Density Residential) zone, identified as APN 048-400-006, at 962 Kovak Ct., Chico. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. ❑ Butte County Department of Development Services ❑ Planning Division ❑ 5 FINDINGS: Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(c), conversion of existing small structures from one use to another; and Section 2: Zoning Ordinance Findings. A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: . 1. The character of the area includes a mixture of residential uses, including multi -family and another assisted living facility; and 2. The physical characteristics of the site including available parking, access, sewage disposal, and building improvements meet required standards; and B. The proposed project is conditionally consistent with the R-3 Zone and is a Secondary Use under the Low Density Residential General Plan designation; and Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for Lynette Dorenzo on APN 048-400-006 to allow a 7 -bed assisted living facility for the elderly. Approval shall be subject to the following conditions: B. Conditions of Approval: 1. The assisted care facility shall be limited to no more than seven (7) residents. 2.. Prior to issuance of Use Permit, provide documentation to the Building Department that the assisted living facility structure has an interior noise level of 55 dB CNEL or less. 3. Property owners shall sign an aviagation easement granting the right of continued use of the Chico Municipal Airport in the airspace above the ❑ Butte County Department of Development Services ❑ Planning Division ❑ n subject parcel and acknowledging any and all existing or potential airport operations impacts. 4. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 5. Provide an all weather access to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. 6." Prior to issuance of building permits, obtain Butte County Health Department clearance for any remodel, infill, or additions to existing structure. 7. Should you desire to appeal any of the conditions imposed by the Planning Commission, you must do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville, California, prior to 5:00 .p.m., Monday, July 7, 1997. The appeal deposit of $250.00 must be paid at that time. If you do not appeal and if there are no other appeal within the 10 calendar -day appeal period, the action of the Planning Commission is final. A Notice of Exemption (NOE) should be filed for purpose of .completing the California environmental quality Act requirements. The fee for filing the NOE is a $25.00 document handling fee. A check made payable to the Butte County Treasurer in the amount of $25.00 should be submitted to the Planning Division in order to complete the process. Please be aware that failure to return the signed copies within 40 calendar days will invalidate the Planning Commission's approval. Re-application to this Division would then be necessary. The Use Permit is deemed granted when the enclosures have been signed by the applicant, with the counter signature of the Chairman of the Planning Commission, and said permit is received by the applicant by registered mail. PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a 7 bed assisted living facility for the elderly. The project site is .49 acre (21,450 sq. ft.) in size, and is zoned R-3 (High Density Residential). The Land Use Element Map of the Butte County General Plan designates the project site as High Density Residential. The R-3 Zoning Ordinance requires that a conditional Use Permit be obtained for group homes for seven or more persons. The project site is developed with a 3,771 sq. ft. tri-plex structure which has been used for three rental units. Domestic water service for the project site is supplied by a public water system. Sewage disposal is handled by an on-site septic system. The project site is located within the Chico Nitrate Action Plan area. Surrounding parcels have numerous different zonings. The parcels immediately to the west of the project parcel are located in the County and are zoned R-3. -Parcels to north, across a drainage ditch from the project site, are located in the City of Chico and are zoned R -P (Residential -Professional). The parcel to the south is located in the City of Chico and has split zoning: R -P along Cohasset Road and R-1 further to the east. The parcel to the east of the project site is located in the County and is zoned R-4. Surrounding land use is tri-plexes to the west, office buildings to the north, undeveloped to the south, a single family dwelling to the southeast, and an assisted living facility for 15 residents to the east, which is also operated by the applicant. The proposed use will be an assisted living facility for 7 elderly residents. The applicant is 0 Butte County Department of Development Services 13 Planning Division 0 licensed by the State of California to provide the following services: assistance with dressing and bathing, supervision of medications,. all meals and snacks, housekeeping, laundry, activity programs, and transportation to medical appointments. There will be approximately 8 staff members, with 4-5 staff for the day shift, 2 staff for the evening shift, and 1 staff member for the overnight shift. The interior of the building will be renovated to accommodate the 7 elderly residents. The exterior of the building will be slightly altered. . ANALYSIS: The proposed use will change the land use from three rental units to an assisted living facility for 7 elderly persons. The change in land use will not be significant and will not have a significant impact to the neighborhood because the proposed use will have the same approximate number of residents as a residential use of the project site, and the number of vehicle trips generated by the proposed use will be less than that generated by the residential use. The three rental units would house approximately 7 people (2.3 persons per unit), which is the approximate number of people who will live in the assisted living facility. The interior of the existing structure will be renovated to accommodate the 7 elderly residents. The exterior of the structure will be altered slightly, but will still retain'the appearance of tri-plex dwelling units. The proposed use will not change the appearance of the neighborhood. According to the Institute of Transportation Engineers Trip Generation handbook, the number of vehicle trips expected to be generated by the type of proposed use will be approximately 15 vehicle trips day. However, this estimate may not be accurate because the number of vehicle trips expected to be generated by the employees of the facility will be approximately 16. Adding in the vehicle trips required for deliveries and for visitors to the facility, the total number of vehicle trips is expected to be higher than the figure given in the Trip Generation handbook. Few, if any, of the residents of the assisted living facility are expected to own vehicles. A residential use of the project site would generate approximately 30 vehicle trips per day. It is expected that the number of vehicle trips generated by the assisted living facility will be similar to the number of vehicle trips generated by a residential use of the tri-plex. Delivery trucks are expected to make a few trips daily to the facility, but this is not expected to be significant and some of the truck trips will be in conjunction with deliveries to the County House living care facility located adjacent to the proposed use. The Butte County Fire Department commented on this project and is requesting that building identification and/or addresses be installed and maintained in conformance with Public Resources Code 4290. They are also requesting that an all-weather access road be provided to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. The existing improvements should already meet these standards, but these standards will be added as conditions of project approval to ensure that the standards are met. The Butte County Department of Public Works did not have any comments or conditions regarding this project. ❑ Butte County Department of Development Services ❑ Planning Division ❑ 2 The Butte County Environmental Health Division requests that a condition of this project require that prior to issuance of a building permit that the applicant obtain Butte County Health Division clearance for any remodel, infill, or additions to the existing structure. This has been added as a condition of approval. The north and south property lines of the project site are located adjacent to the City of Chico. Comments received from the City of Chico Planning Division state that the project site has been prezoned R-2, and that a group care home serving 7 to 12 individuals and licensed by the State of California is permitted with a Use Permit under the R-2 zoning. The project site is part of a five parcel County island that is surrounded by the City of Chico. At some point in the future, the project site will most likely be annexed to the City of Chico. The proposed use is consistent with the City of Chico's prezoning for the area. The project site is located approximately 6,500 feet from the end, and slightly to the west, of the main runway at the Chico Municipal Airport. The project site is located within the Chico Municipal Airport Environs Plan area. The Butte County Airport Land Use Commission (ALUC) held a public hearing on this project at their May 21, 1997 meeting. At that hearing, the ALUC determined that the proposed living care facility is consistent with the Chico Municipal Airport Environs Plan, and recommended several conditions for project approval. The first recommended condition requires that noise reduction measures be incorporated into the living care facility structure in order to reduce the inside noise level to 55 dB CNEL or less. Prior to issuance of a Use Permit, the applicant will be required to submit documentation to the Building Department that shows that the interior noise level of the structure does not exceed 55 dB CNEL. The second recommended condition requires that the landowner sign an avigation easement. The avigation easement grants to the City of Chico the right to use the land above the project site for aircraft operations associated with the Chico Municipal Airport. The avigation easement also serves the purpose of notifying the current and any future landowners of the project site that they may be subject to noise impacts from aircraft operations. These recommendations from ALUC have been added as -conditions of project approval. To.approve a Use Permit, the Planning Commission must find that the request meets the requirements of Section 24-45.10 of the Butte County Zoning Ordinance. This section states that the Commission may grant a Use Permit if the proposed uses of the property will not impair the integrity and character of the zone in which the lands lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer; no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue.
