(SL) (U P97-21) A video of the site was shown. Mr. Lucas gave a brief summary of the project. Staff noted a petition in opposition was received, a letter from Nylander, a petition in favor, letter from Mr. and Mrs. Stanpononi, and a letter from Ms. Suhr. He said this is an ideal location because of the proximity to schools. He said the applicant is proposing an after school program, day care and pre school components. Commissioner Mooney said he does not like to see piecemeal curbs, gutters, and sidewalks. He was against the condition for -curbs, gutters, and sidewalks at this location. Mr. Lucas said the applicant will.be operating a van or bus to help eliminate traffic hazards. He said children will not likely be arriving on.foot;: There was no.condition asking for a van to take the children to the school. The hearing was opened to the'public. Kathleen Gile, representing the applicant; said the building will be 2,000 square feet. She said this is a proposed center for children 2-12 years old.' There will be two playing areas, one in front for the older children and one in back:- She said the backyard play area will be 175 ft. from the nearest residence. - Commissioner Mooney asked about the condition for a retention pond. Mr. Lucas said the applicant is required to deal with any additional runoff from the additional building. Ms. Gile said they are on public water. She said activities will be provided for the children. Barbara Crowe said she objected to the project. She is 100 ft. from the property . She was concerned with the noise. She has a neighbor that works nights and sleeps days. Mrs. Jorgenson said she is concerned with noise. She lives right behind the property. She said rain drains into her back yard now. She said she did not want to listen to 50 children all day long. She said this is a residential area. Gloria Balch, from Valley Oaks Children's Services, said licensing is very strict on the number of children allowed in a certain amount of space. Licensing requires adequate supervision and upkeep of the facility. She said this is a good site for this proposal and was in favor of the request. Commissioner Nelson asked if 50 children at one site is a common occurrence. He questioned how the neighbors would protest any lack of control over the children. BUTTE COUNTY PLANNING COMMISSION MINUTES -.September 25, 1997 W Ms. Balch said 50 children is not uncommon. There is 35 square feet per child indoors and 75 square feet per child outdoors. She said the Licensing Board would investigate in the case of a lack of supervisors or overcrowding. Commissioner Cage asked if this would be considered a school and could the Commission require that there be no animals on the property. Ms. Balch said this is a child care facility, not a school, and there could be private dogs and animals on the property. Mr. Lucas said the Commission can require a solid fence to attenuate noise. Margaret Richardson was concerned. She said she lives 1/4 mile from LP and. Helen Wilcox schools and can hear the children from that distance. She was concerned with children walking from Helen Wilcox to this site due to traffic. Ms. Jordison said this property is on septic. She said this project will reduce the value of her property. Mr. Lucas said the property is on public water and public sewer. Ms. Gile said a teacher would walk with any child that needed to cross a street on foot. She said the play ground will be 15 ft. from the yard fence. She said there will be four children's bathrooms and one for staff. The hearing was closed. Commissioner Cage said she would like to see if they could require four way stop signs at Monta Vista and Las Plumas intersections. Mr. Lucas said staff can send a letter to Public Works regarding this concern. Commissioner Mooney said traffic control should start at Monte Vista before the traffic comes into the residential area. He said it was alright to add a landscaping condition since the applicant did not object. It was moved by Commissioner Mooney, seconded by Commissioner Leland, to approve the request subject to the conditions and findings as follows: Commissioner Cage asked about landscaping along the southern property line for noise attenuation. Commissioner Nelson said he had a problem with the number of children. He said a large number will make the play areas like a school yard. He said the neighbors did not bargain for the noise when they bought their houses. Commissioner Leland said they should have day care centers where the children are. He did not feel landscaping would attenuate the noise. BUTTE COUNTY PLANNING COMMISSION MINUTES - September 25, 1997 Mr. Lucas agreed landscaping does very little. Condition 8 was changed by adding to the end "or_provide a covenant for same." Ms. Gile said they would not object to landscaping. Commissioner Cage added Condition 11 to read "Landscape along the southern property line in high brush or trees for noise attenuation." Commissioner Leland said it is his impression that landscaping does nothing to block noise. Mr. Lucas said landscaping does do very little to address noise concerns. It was agreed to add Condition 11 as stated above regarding landscaping. Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303, conversion of a small structure from use to another where only minor alterations are made to the structure. Section 2: Zoning Ordinance Findings. A. The proposed use is a conditional use of the property which pursuant to Butte County Code Section 24-35 will not conflict with, impair or be detrimental to the uses both permitted and conditional in the R-1 zone and the Low Density Residential General Plan designation in which it is located and/or adjoins because these land use categories allow for small lot, multi -family, commercial and public - quasi public uses; and B. The proposed use would not be unreasonably incompatible with, or injurious to, surrounding properties in that the project is conditioned to reduce associated impacts to a level of insignificance that are similar to existing conditions and uses in the area; and C. The proposed use of the property would not be detrimental to the health, safety, and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the- County because the proposed use will not create any significant noise or traffic related impacts beyond present levels and operating conditions added will further reduce any associated impacts to a level of insignificance. Section 3: Action A. Subject to the findings indicated in Sections 1 and 2 of this Exhibit A, approve a Use Permit for Joanne Suhr on APN 036-580-033 to allow a child care/activity center for 50 children in an existing dwelling subject to the conditions listed herein. . BUTTE COUNTY PLANNING COMMISSION MINUTES - September 25, 199-7 B. Conditions of Approval 1. The child care/activity center shall be limited to a maximum of 50 children and shall be restricted to operating between the hours of 6:00 a.m. and 7:00 p.m. Monday through Friday. 2. The maximum number of employees is four (4). 3. Prior to issuance of Use Permit submit a final site plan to the Planning Division for review and approval showing two entrances connected by a one-way pull through drive, a minimum of seven (7) parking spaces and indicating required landscaping pursuant to the Butte County Code Section 24-240, including, but not limited to, parking lot landscaping. 4. Prior to establishing the use applicant shall submit building modification plans to the Building Division for review and approval and obtain all necessary permits. Submit a copy of building permit to the Planning Division prior to occupancy. 5. Construction, Installation or development of structures or facilities on the parcel shall comply with the latest California Fire Safe Regulations (PRC 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 6. The preschool use shall be inspected by the State Fire Marshall. 7. Prior to issuance of building permits deed to Butte County, in fee simple, 30 feet of the right-of-way from the centerline of Lower Wyandotte Road. The right-of-way shall be sufficient for the installation of standard No. S-5 at all street intersections. 8. Prior to issuance of building permits submit road and drainage improvement plans for the installation and construction of the street frontage improvements on Lower Wyandotte Road to RS -213 road standard, including, but not limited to, P.C.0 curb, gutter and sidewalk and the required street section for parcels with gross acreage of one acre or less. Construct and install the required improvements or provide a covenant for same. 9. Prior to issuance of building permits a plan for a permanent solution for drainage shall be submitted to, and approved by, the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural publicly maintained drainage channel and shall provide that there is no increase in the peak flow run-off to said channel or facility. 10. The property is zoned R-1 (Residential). This project is located in Supervisorial District 1. RELATED ITEMS: None FOR: Planning Commission Meeting of September 25, 1997 ABSTRACT: This application is for a Use Permit to allow a child care center for 50 children. The proposed use requires a use permit in the R-1 zone and is a Secondary Use in the Low Density Residential General Plan designation. Staff recommends approval with conditions and findings contained in this report. APPLICABLE BUTTE COUNTY REGULATIONS: This Use Permit application is submitted pursuant to Butte County Code Sections: 24-45 (Use Permits) which requires that an application be submitted and a public hearing be held by the Planning Commission. The Commission may grant a use permit when it finds that the proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health or general welfare of the persons residing or working in the neighborhood, or to the general health, safety and welfare of the residents of the County; and 24-120,D-4 (Residential Zones: R-1) which indicates that child care centers require a conditional Use Permit; and 24-240 (Parking Regulations) which stipulates that preschools provide one (1) space per classroom or office, but in no case less than three (3) spaces; and 26-12 (Improvement Requirements -Urban Areas) which stipulates that commercial uses in the Oroville Urban Area are required to construct curb, gutter, sidewalks, and drainage facilities identified in the Site Improvement Standards pursuant to Chapter 20 of the Butte County Code. PROJECT CHARACTERISTICS: This project is a request for a Use Permit to allow a child care/activity center for up to 50 children in an existing 1625 sq.ft. residential dwelling unit. The use will occur on a 2.16 acre parcel located on the east side of Lower Wyandotte Avenue. Ar Butte County Department of Development Services - Planning Division AV 1 The parcel is presently developed with a single family home. The project site is bordered on the west by Lower Wyandotte Avenue, on the south by a small lot subdivision, to the east by a condominium development and large lot residential use to the north. The site is accessed via a one-way pull through driveway from Lower Wyandotte Avenue and is approximately 1,000 feet north from the intersection with Monte Vista Avenue. The project is served by the Lake Oroville Area Public Utility District for sewer service and Oroville Wyandotte Irrigation District for public water supply. The child care/activity center will operate Monday through Friday and is intended to serve three functions; a structured environment for after-school programs, a periodic structured day -time environment for children who are off-track from year-round instruction, and a preschool format. The center will provide computer learning space, areas for school projects and an extensive physical development program. The applicant is requesting the center be permitted to accommodate a total of 50 children at any one time for these three functions as outlined below. After-school oro -ram: This function will accommodate approximately 30 children between the ages of 5-12 years of age who will arrive via public school bus at approximately 2:30 p.m. and be picked -up by their parents between 5:30 p.m. and 7:00 p.m. The applicant may also provide a van that will be available to staff to pick-up children at the various schools in the Oroville area. Off-track day care: This function will accommodate children who are off-track for a period of three to four weeks from the year-round schools. The total number of children will vary depending on school scheduling, but it is estimated that this will be 20 children for the day -time child care function. The children will generally be dropped -off between 6:00 a.m. and 8:00 a.m. and be picked -up between 4:30 p.m. and 6:00 p.m. Preschool day care: This function will accommodate children ages 2-4 who most likely will have older siblings attending the center so that parents can utilize one care provider for all their children. The total number of these children will vary between 12 and 20 depending on the number of children and space available in other programs. The schedule for this function will be similar to the off-track children. The combined functions will operate between 6:00 a.m. and 7:00 p.m. with overlap of functions occurring between, approximately 3:00 p.m. and 6:00 p.m. The center will initially employ four (4) full time persons with a potential for eight (8) full-time jobs. The center will provide approximately 35,000 sq.ft. of completely fenced play area for outdoor activities. The applicant is providing 17 parking spaces for the use. All driveways and parking areas will be gravel. In accordance with State of California Child Care Licensing requirements the entire play area surrounding the house is fenced. ANALYSIS: This project is conditionally consistent with the R-1 zone as a private school/quasi- public use as discussed by the Board of Supervisors (Discussion Item 87-405). The Board has interpreted that day care facilities and schools shall be allowed in all zones having a provision for quasi -public uses subject to first securing a Use Permit. The Low Density Residential General Plan designation indicates that quasi -public uses are Secondary Uses. Careful and deliberate review of the use found there to be no environmental constraints associated with this proposal which utilizes an existing structure. Staff has identified three areas of concern for discussion: AF Butte County Department of Development Services - Planning Division Ar 2 0 41 compatibility with surrounding uses, site requirements and the need to meet building code requirements for a child care center. Land use compatibility The site is located in an R-1 zone which is primarily intended for residential uses. The existing parcel is presently in use as a private residence, and is surrounded by a primarily residential area with R-1 zoning to the west and south, PUD to the east and C-2 to the north. The child care/activity center does pose two potential impacts to the neighborhood by way of increased traffic and noise generated by children playing outside. The noise impact is not expected to be significant because the project is located on a fenced 2.16 acre lot that will provide adequate spacing between this use and surrounding uses. Additionally, students will be spending the majority of time in the indoor learning environment. Traffic related impacts may be significant because the use could generate a potential for approximately 100 additional car trips a day if all the children would be transported individually. Lower Wyandotte Avenue is a primary arterial road with a 1995 traffic count of 4950 daily trips and a threshold capacity of 12,000 daily trips at Level of Service "C". The addition of 100 trips is will not significantly impact the roadways level of service. Furthermore, the applicant indicates that the approximately 30 children in the after-school program will arrive via the school bus or by the van operated by the center. This alternative transportation method would reduce the total vehicle trips to approximately 70 trips per day. Of the 70 total trips generated, 20 trips are expected to be spread over a two hour period in the morning and 50 trips will occur over a four hour period in the afternoon. Based on current Levels -of -Service this number of trips at the expected intervals will not significantly alter the level of service on Lower Wyandotte Avenue. Site requirements The site access is from Lower Wyandotte and will be accommodated by a one-way pull through driveway to reduce congestion at points of ingress/egress. This circulation pattern would greatly increase the safety of all traffic and provide the most efficient use of the site. The Butte County Zoning Ordinance requires that a preschool provide a minimum of three (3) parking spaces. The preschool will employ four (4) teachers per shift requiring parking spaces. The site plan provides for seventeen (17) parking spaces. The DPW has indicated that the project must conform to urban improvement standards including the installation of curb, gutter, sidewalks and the required street section. The applicant must also submit a permanent solution to drainage for the use. The State of California requires 35 sq. ft. of space per child indoors and 75 sq. ft. of space per child outdoors for this use which can be accommodated by the property and proposed buildings. Ar Butte County Department of Development Services - Planning Division Ar 3 Other concerns The Building Division has reviewed the project and indicated several requirements necessary to convert the single family dwelling to a child care center use. These requirements include upgrading the electrical system, plumbing, .and other inside structural modifications. The child care/activity center will require modifications to the building that must meet Uniform Building Code requirements for the use. A condition of project approval has been added to submit all plans to the Building Division for review and approval prior to establishing the use. Pacific Gas & Electric commented that modifications to the gas facilities will be required. Such modifications would include an emergency fire valve at the curb, monitor regulation at the gas meter, possible meter protection, and inclusion of the property into their annual leak survey records. The Butte County Fire Department has commented that the project must meet the requirements of the State Fire Marshall. ENVIRONMENTAL DOCUMENTATION: This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303, conversion of a small structure from use to another where only minor alterations are made to the structure. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Public notices were mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comments. RECOMMENDATION: Staff recommends that the Planning Commission approve the application for Joanne Suhr on APN 036-580-033, subject to the following findings and conditions in the attached Exhibit "A". Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Joanne Suhr is hereby granted a Use Permit in accordance with application filed: 7/15/97 to allow a child care/activity center for 50 children in an existing dwelling on property zoned R-1 located at 5597 Lower Wyandotte Avenue, Oroville. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Director of Development Services, Public Works or Environmental Health, or their designee, upon receipt of a substantiated written request by the applicant. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. The Center is not just a "Day Care Facility" where the children are taken care of all day and every day. The primary focus of this establishment is for school age children, ages approximately 5 to 12 years of age, in grades kindergarten through fifth grade. The care that we expect to provide is for "off-track" times during the school year. There may be times when the actual number of children could be close to the number proposed in the estimate due to an over -lap of one group, who may be coming for a short period of time in the afternoon, with the group that are in the "off-track" mode. b) The numbers that will be coming to the Center will not be consistent due to the difference in the schools that will be in our area and involved with the scheduling of their areas. The primary schools that are in our area are: Bird Street, Eastside, Oakdale Heights, Ophir, Standford, and Wyandotte Ave. Schools that are further out in Thermalito will be mostly full day students that are out for one reason or another. 2) The traffic problems. Since all the children will not be at the center on a daily basis there will not be a significant number of cars arriving at the center at any. one time. One group of children, the ones who will be coming for after school care only, will come by school bus or by picked up by an automobile or van, if there is sufficient need for a van, which will be purchased by the center. If the child is to be there for the entire, day due to off-track at school, parent's who need to drop them off should not be arriving at the same time due to the difference in their work schedules. (2) 3) Explanation of Drop Off and Pick-up Time: The full-time students, approximately 20 children, will be dropped off, by their parent's between 6:30 a.m. and 8:00 a.m. The part-time students, approximately 10 children, will arrive on the school bus at some time between 2:30 and 3:00 p.m. The remaining part-time students will be picked up by automobile or in a van. Parent's arriving to pick-up their children will arrive at varying times after work or school. 4) Off Track and Year Round Schools: There are three schools in the Oroville District that have year round school. At Ophir and Wyandotte the children are off in four week blocks of time. At Bird Street School the children are off in three week blocks of time. All parent's were active in not only the academic structure of the school but in assisting with upkeep of the school and participation in fund raising for the school projects and activities. Due to this involvement and the philosophy of the school that children be allowed choices, if at all possible, in areas where they would like to develop their skills. At no time were any of the employees allowed to "become physically involved" with the children. This was in an era where spanking was permissible in Public Schools for certain offenses that was not an option at this establishment. Punishment was "time out" in order to consider what they had done and why they should not have done that particular thing. Children, obviously, are the future of our entire nation. While we realize that our contribution will be very limited if we can assist in motivating even a small portion of the children that we come into contact with to enjoy reading; interact with their peers in a more positive manner; become comfortable with computers, which are essential in our modem life; and have more equipment available to assure that they will be physically fit from enjoyable outdoor activities provide great satisfaction for both Kathryn and myself. I was employed in Santa Clara County as a Supervising Clerk in Child Protective Services. I was astonished to realize what was happening in our County, and in most of the country. - What I perceived to be a "normal" reaction on the part of parent's was not in evidence with the people that were involved in incidents regarding children. It was difficult to reconcile my perception of how children were raised with what I found occurring in our own area. I have not been a "licensed child care provider" but successfully raised two wonderful children who turned out to be loving caring parent's. I am fortunate enough to have four grandchildren with whom I am able to interact with frequently. I am involved with the well being of all of them and hope to be able to insure that other children will have the benefits that our children have. A small one bedroom unit is located in the upper corner of the property. There are three bathrooms in the main house and one bathroom in the smaller unit. There is a storage shed, garage and a car port with an attached storage area. There is sloping area to the rear of the house. The soil consist of top soil, clay and lots of rocks. The soil is stable. There is good drainage in all areas of the property due to natural drainage on an adjoining property. #33 - This property is located at 111 Acacia Avenue. It has an alley way behind it. Directly behind the property is a three or four unit apartment complex. Beyond that is a private residence. Across from the alleyway and near the apartment complex and the private residence is a large water storage tank. Next to the water storage. tank there is a private residence that faces Acacia Avenue. Across the street there is a private residence. Below the property at 111 Acacia Avenue there is a residential home with a vacant lot behind it. As a single parent, I found myself in the positi P many women find themselves. After working a long day I would'Fick my children up from a Day Care. On one occasion my son was spanked until he had welts on his legs, because he was aflew minutes late arriving at the Day Care after school. 1 wouldV then start my search for a new Day Care that met the needs F my children, yet was affordable. It was at this point that IJdecided to stay home with my own children and take other children in. I wanted to offer to other mothers what I myself could not find in a Day Care situation. For the past eleven years my children and I have extended our family to many children in the Chico Area. much growth has taken place during that time. We have grown from e baby sitting situation to an extended family creative learning situation. The children have always come first to us. All our learning programs are geared to the individual needs cf each child. No child has ever been turned away because of the parents inability to pay. On one occasion, a special room was set up for a little boy to be his own because his mothe: was dying of cancer and he would be spending some extra time with us. What I am trying to express to you is that we are not a baby sitting service, we are an extension of every family that enters our door. We are in a partnership with each parent in molding the lives of these precious children. In a report made by the Greater Chico, Chamber of Commerce, Child Care Task Force 1389 Report. It was noted that 70% of women between the age of 25 - 34 have jobs. This leaves these 70% in the same position I found myself eleven years ago, searching for Quality Care for our children. In the same report the Sub Committee developed a list of priorities tha '.needed immediate attention; " One major concern is the quaity of care our children recieve." What can we do to relieve the situation? Among others the Committee recommended; " Review cur ent licensing standards which may unintentionally drive costs hi er without any benifit such as improved quality." " City an .County governments should also waive fees or relax regulations to acilitate construction of new centers." The Committee found that unless action was taken Day Care could reach a critical shortage in the early 1990's. Weekly I recieve phone calls from parents searching for Day Care. I have people who have driven by come to my door and ask to be put on a waiting list. I have mothers who have just found that they are Expecting, call and ask fcr an interview so they will have a space for their child when it is barn. I do not advertise in the news-pap?r, Valley Oaks Childrens Service and The Association of Family Day Care Providers hold all referals on my request. I feel that we have reached the critical point, and it is for this reason that we have deciued to open our doors to more children. Children are the most important natural resource we have. We must protect and educate them as best we can. I ask the Commission to keep this in mind as they make a fair and just decision. Apparently there is some concern regarding the inconvenience -and noise of the children playing in the Center. In order to alleviate any concerns, or at least mitigate them, we measured the. distance from the play areas to the fence that encloses our property, and in the case of the Mobile Home Subdivision in the rear of the property, to our fence and then the distance that was from the fence to the nearest Mobile. The area from the back of the Center Play Area is 81' from the area to the wooden fence separating our property from the Mobile Home area. When that is combined with the distance from the wooden fence to the first Mobile on the other property, which is a distance of 95', the combined footage is 176' from the nearest Mobile Home. The younger children will be in this area. The children will be supervised at all times while the Center is in operation. They will be in their own specified area at designated times. The area between the above play area and the homes in the subdivision on the South of the play area is 69' feet to the fence. There is additional footage to the existing structures but it is variable and it was not measured from the fence to the existing structures in that area. The Playground for the older children is in the front of the Center. It will be enclosed with a 6' fence on the front and sides and a minimum T fence on the area in front of the center. They will also be in that area at specified times and only with supervision. The nearest distance from the fence surrounding the Playground to the fence separating the property from the neighbors will be at least 15'. The distance from the fence to the surrounding residences will be additional due to the placement of the residence on the lot. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. May 6, 1997 Concerns: 1) The estimated number of children that will be served by the Center. a) The projected number of children who would be at the center at any given time is just that, a projection. The Center is not a "Day Care Facility" where the children are taken care of all day and every day. The primary focus of this establishment is for school age children, ages approximately 5 to 12 years of age, in grades kindergarten through fifth grade. The care that we expect to provide is for "off- track" times during the school year. There may be times when the actual number of children could be close to the number proposed in the estimate due to an over- lap of one group, who may be coming for a short period of time in the afternoon, with the group that are in the "off-track" mode. b) The numbers that will be coming to the Center will not be consistent due to the difference in the schools that will be in our area and involved with the scheduling of their areas. The primary schools that are in our area are: Bird Street, Eastside, Oakdale Heights, Ophir, Standford, and Wyandotte Ave. Schools that are further out in Thermalito and Palermo will be mostly full day students that are out for one reason or another. 2) The traffic problems. Since all the children will not be at the center on a daily basis there will not be a significant number of cars arriving at the center at any one time. One group of children, the ones who will be coming for after school care only, will come by school bus or by picked up by an automobile or van, if there is sufficient need for a van, which will be purchased by the center. If the child is to be there for the entire, day due to off-track at school, parent's who need to drop them off should not be arriving at the same time due to the difference in their work schedules. We have alleviated some obstacles, bushes etc., that would have made it difficult to see if there should be oncoming traffic due to obstruction of their view of the road. As previously indicated we intend to assure that their will be an entrance and an exit for safety reasons. To enhance the entrance and exit of the property we will be making a speed reduction area in the front of the Center. • (2) 3) Explanation of Drop Off and Pick-up Time: • The full-time students, approximately 20 children, will be dropped off, by their parent's between 6:30 a.m. and 8:00 a.m. The part-time students, approximately 10 children, will arrive on the school bus at some time between 2:30 and 3:00 p.m. The remaining part-time students will be picked up by automobile or in a van. Parent's arriving to pick-up their children will arrive at varying times between 4:00 p.m. and 7:00 p.m. after work or school. 4) Off Track and Year Round Schools: There are three schools in the Oroville District that have year round school. At Ophir and Wyandotte the children are off in four week blocks of tirr e. At Bird Street School the children are off in three week blocks of time. We are enclosing a copy of the year round schedule for the schools mentioned above. To further explain the different schedules for the schools in our area. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit B" and dated _, 19_ and is incorporated herein by this reference. 2. Prior to the issuance of building permits, the plans, incorporating all applicable conditions of approval shall be submitted to the Planning Division to verify compliance with said conditions of approval. 3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing gates and a solid or semi -open shade cover. Plans to be reviewed and approved by the Planning Division prior to construction. 4. Prior to any use of the project site or business activity being commenced thereon, pursuant to this permit, . conditions of approval contained herein shall be completed to the satisfaction of the Planning Division. 5. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING 1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. ■ Use Permit Standard Conditions - Butte County ■ 5 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Wdhin this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1.604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. ■ Use Permit Standard Conditions - Butte County ■ D 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it - has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on _, 199_, the applicant shall sign and file with the Department of , Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. 9. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax Collector's Office to begin the process of a Transient Occupancy Registration Certificate. A Transient Occupancy Registration Certificate shall be required within ten (10) days after commencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobile home park, recreational vehicle park, campground, or parking area (See Chapter 23A). 12.
