At the regular meeting of the Butte County Planning Commission held July 24, 1997, your
request for a Use Permit to allow a 30 dog kennel on property zoned A-5 located at 288
Watt Lane, Gridley, was approved subject to the conditions listed on the enclosures.
Please sign both copies and return both copies to this Division within 40 calendar days.
Should you desire to appeal any of the conditions imposed by the Planning Commission,
you must do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive,
Oroville, California, prior to 5:00 p.m., Monday, August 4, 1997. The appeal deposit of
$250.00 must be paid at that time. If you do not appeal and if there are no other appeal
within the 10 calendar -day appeal period, the action of the Planning Commission is final.
A Notice of Determination (NOD) should be filed for purpose of completing the California
environmental quality Act requirements. The fee for filing the NOD is a $25.00 document
handling fee. A check made payable to the Butte County Treasurer in the amount of
$25.00 should be submitted to the Planning Division in order to complete the process.
Please be aware that failure to return the signed copies within 40 calendar days will
invalidate the Planning Commission's approval. Re-application to this Division would then
be necessary.
The Use Permit is deemed granted when the enclosures have been signed by the
applicant, with the counter signature of the Chairman of the Planning Commission, and
said permit is received by the applicant by registered mail.
Pursuant to Section 66020 (d) (2) of the Government Code you are hereby notified that you
have 90 days to register a protest challenging any fees, dedications, reservations, or

EVALUATION OF ENVIRONMENTAL IMPACTS
I. BACKGROUND:

5. Project Description and Location of Parcel(s) The request is for a Use Permit to approve a dog kennel
for the boarding and training of up to 30 dogs. The project will start with a 15 dog run, expanding to
30 dog runs within five (5) years. Dogs are to be kept inside and each kennel is to be equipped with
a bark eliminator collar. Currently there is a single family modular home 24x60 and a metal structure
30x65 on a cement slab foundation. It is proposed to house the dogs inside the metal structure. As
the need for additional dog runs increases beyond the 24 dog run capacity of the metal structure, the
applicant proposes to build an addition onto this structure to house the additional dogs. The dogswill
primarily be limited to English Springer Spaniels. They will be trained both on-site and offsite. These
dogs are trained either for Field Trials (show competition) or for hunting. Some use of guns (blanks)
and whistles are involved. Dogs trained for Field T.rials,are kept as long as a year, while dogs trained
for hunting are kept from 3 to 4 months. Operating hours will average 3-4 hours per day, at 20 to 25
minutes per dog. The project is located on an 8.2 acre parcel at the end of Watts Lane, approximately
one mile north of Stimpson Road (East Gridley Road), on the east side of Highway 70, north of
Robinson Comer, in the Gridley area. The project site is zoned A-5 (Agricultural -5 acre minimum) and
has a general plan designation of Orchard & Field Crop. The project site is surrounded by parcels
ranging in size from 8+/- acres to 26+/- acres. All surrounding parcels have A-5 zoning and Orchard
& Field Crop land use designation. The parcel is bordered by grazing land, with the nearest residences
located south, approximately 300-600 feet away. The topography is fairly level and there is an
assortment of trees along Watt Lane and bordering the property, providing a natural screen blocking
the project site from the neighbors to the south. Water is provided by a private well and sewer service
is provided by a septic system. Access to the parcel is from Watt Lane via. Stimpson Road.

II. DETERMINATION:
On the basis of this initial evaluation:
I find that the proposed project COULD NOT have a significant effect on the environment, and a
NEGATIVE DECLARATION will be prepared.

5) Earlier analyses may be used where, pursuant to the tiering, program EIR, or other CEQA process, an
effect has been adequately analyzed in a earlier EIR or negative declaration. Section 15063(c)(3)(D).
Earlier analyses are discussed in Section XVII at the end of the checklist.
6) Lead agencies are encouraged to incorporate into the checklist references to information sources for
potential impacts (e.g. general plans, zoning ordinances). Reference to a previously prepared or

Response: The project request, a Use Permit for a 30 stall dog kennel, does not conflict with the
general plan designation or zoning. The Orchard & Field Crop general plan land use designation
provides for intense animal uses as a secondary use. The A-5 zoning provides for intense animal
uses with a Use -Permit.
The request for a dog kennel with this intensity of use is not expected to be incompatible with existing
land uses adjacent to the property. The applicant has stated the dogs will be housed inside an
enclosed structure. Each stall will be equipped with a "bark eliminator" collar. The size of the parcel
(8.2 acres), the purpose of the kennel (for gun dog training), the manner in which the dogs will be kept
(in an enclosed structure), and the use of special features for the dogs ("bark eliminator" collars for
each stall), are all factors that mitigate against impacting surrounding agricultural uses, i.e., grazing
of cattle. There exists the potential for some noise impacts resulting from the use of "shots" (blanks
being fired) in the training methods used (See Response in Item 10). Surrounding parcels vary in size.
Those parcels larger than ten (10) acres have the potential for future parceling, but for those parcels
less than ten (10) acres there is no potential for increased parceling with the current zoning. The
potential exists for neighboring parcels to divide into 5 acre parcels, creating two to four times the
number of parcels which cun'ently exist. This potentiality is mitigated to a degree by the presence of
the Wyman Ravine floodplain which encompasses much of the land north, east and south of the
project site. The 11.92 acre parcel adjacent on the north is encompassed within this floodplain, with
the exception ofthat porrlion neighboring the proposed dog kennel facility. The potential exists for 1-2
future residences being located within 150-200 feet of the kennel.

The soil characteristics of the site, Kimball loam, Wyman loam silty phase, and Rocklin fine sandy
loam, are idenfified as having moderate erosion potential. The characteristics of the project site, level
with little slope, is such that little erosion would likely occur.

Response: Approval of the project request is not going to have any effects upon absorption rates or
drainage patterns. The existing 30x65 structure will be utilized for the dog kennel. This structure is
capable of housing 24 dogs. The applicant has indicated that if they are successful they hope to
expand their operation to 30 dogs within five (5) years. Any additional kennels will require expanding
the present structure to accommodate the additional six (6) kennels. The characteristics of the site
are such that any expansion of the building for an additional six kennels - sized at 4'x I V - will not
significantly affect drainage pattems. Approval of the request is not going to have any impacts upon

the groundwater.
Approval of this project may have a potentially significant impact from surface water runoff, due to dog
feces and other animal wastes, to surface waters if such waste products are not disposed of properly.
To address this issue a mitigation. measure for a septic system to handle dog feces is necessary to
adequately address such a potential impact.
MITIGATION #1: The kennel operator shall clean and remove all excrement from the kennel on
a weekly basis and dispose of excrement in septic tank installed under permit from the Butte
County Environmental Health Division. The septic tank shall be pumped as needed or as
directed by the Butte County Environmental Health Division.. '

Response: Approval of the request to permit a dog kennel for 30 dogs may present potentially
significant noise impacts on the surrmundng area. The potential sources of noise may include barking,
gun shots and whistles employed in the training program. The applicant has proposed to equip each
stall with a "bark eliminator" collar. The whistles used for the type of dog the applicant will be training
(English Springer Spaniel) make very little noise (pers demonstration, Gary Breitbarth). The project
site is located at the end of Watt Lane, with the nearest neighbor located in excess of 300' away. Few
neighbors live in the general proximity of the site. However, there is the potential for future land
division and an increase in population density in the vicinity of the project. The applicant has indicated
he would be using blank shots in gun training with the dogs on-site. The applicant said he would like
to use the back portion of the parcel, on the other side of the creek where it is further removed from
any residences, to train the dogs with gunfire.
MITIGATION #2: All stalls shall be equipped with "anti -bark" collars.

Gary and Dawn Breitbarth - proposed Negative Declaration with mitigation,
measures regarding environmental impacts and Use Permit to allow dog -kennel -
for 30 dogs on an 8.2 acre parcel zoned AR -5 (Agricultural Residential - 5 acre
parcels) located at the end of Watt Lane, north of Stimpson Road, on the east side
of Highway 70, identified as AP 025-220-003, Gridley. (SH) (UP97-25) (VIDEO)
A video of the property was shown. Mr. Hackney gave a brief summary of the project. He
recommended three changes to the conditions. Condition 1, recommend on the second
sentence, that "weekly" be changed to "daily"; Condition 6, the wording be changed "the
kennel shall be inspected annually" instead of twice a year; and add Condition 11
"Applicant shall obtain a kennel license from Butte County Animal Control."
Chairman Lambert asked how a stall collar is used, and if the dogs are trained on-site and
off-site?
Mr. Hackney said the dogs will be taken off-site for some training of hunting dogs. The stall
collars are used inside the kennel.
Commissioner Leland asked on Condition 4 what the County was being held harmless
from?
Mr. Sanders said the condition is to protect the County against claims resulting from the
approval of this Use Permit. .
Commissioner Leland said he was not sure it was appropriate to have hold harmless and
requested that the condition be deleted.
Commissioner Nelson said that off-site training activities are not under the purview of this
Commission.
Commissioner Cage said there should be a condition on outdoor fencing for a run area.
Commissioner Mooney was concerned with the use of a training gun. He said he would
not like the gun used in the middle of the night, but during daylight hours only. He was also
concerned with the dog whistle.
Mr. Hackney stated that the training will usually be between 5 and 7 P.M. in the evening.
He said the Commission would have to ask the applicant about the whistle. - ~
Commissioner Mooney said people can not hear the whistle, but all the dogs in the
neighborhood can. He asked if there were alternatives to the excrement disposal proposed
by the Health Department. 4

training and he works nights.
There was a discussion on adding a condition for fencing to.match the site plan. This was
acceptable with the applicant.
Ed McConnell said he. owns property in Gridley and has a business in Gridley. He said the
applicant will be training very expensive dogs. He was in favor of the permit.
The hearing was closed.
Commissioner Cage requested that they add Condition 12 "Applicant shall comply with all
other applicable State and local statutes, ordinances, and regulations."
It was moved by Commissioner Leland, seconded by Commissioner Cage, and
unanimously carried for approval, with the corrections and additions to the conditions as
follows: -
Section 1: Environmental Findings.
A.. An Initial Study was, completed in compliance with the California Environmental
Quality Act identifying potentially significant environmental effects that the project
may have. Provisions and the design of the project and the conditions added to the
project will mitigate such effects to a level of insignificance; and
B. The Planning Commission has independently reviewed, analyzed, and considered
the proposed Negative Declaration with mitigation measures prior to making its
decision on the project, and the Negative Declaration reflects the independent
judgement of Butte County; and
Section 2: Zoning Ordinance Findings.
A. The proposed use of the property, pursuant to Butte County Code Section 24-45,
will not conflict with, impair or be detrimental to the uses both permitted and
,conditional in the A-5 zone and the Orchard & Field Crop General Plan designation
in which it is located and/or adjoins; and

B. The proposed use would not be unreasonably incompatible with, or injurious to,
surrounding properties in that there are limited residences in the area and future
densities are limited to the 5 acre minimum in the A-5 zone and to potential

conditioned to reduce associated impacts to a level of insignificance that are similar
to existing. conditions in the area; and
C. The proposed use of the property, pursuant to Butte County Code Section 24-90,
will not conflict with, impair or be detrimental to the uses both permitted. and
Conditional in the A-5 zone and the Orchard & Field Crop General Plan Land Use
designation in which it is located and/or adjoins:
1. Existing development pattern has no residential structures within 300 feet
of the proposed use; and
2. The A-5 zone will allow for the potential creation of approximately 5 new
parcels immediately adjacent to the project site; and
3. The keeping of animals, including dogs, is provided for in the A-5 zoning,
subject to animal maintenance requirements of Sections 24-255 through 24-
255.15.
D. The proposed use of the property would not be detrimental to the health, safety, and
general welfare of the persons residing or working in the neighborhood, or to the
general health, welfare and safety of the residents of the County in that the
proposed use will be conditioned to reduce associated impacts to a level of
insignificance.
Section 3: Action
A. Subject to the findings indicated in Sections 1 and 2 of this Permit and the mitigation
measures and conditions found in Exhibit "A," a Negative Declaration with mitigation
measures is hereby adopted and the Use Permit approved for Gary & Dawn
Breitbarth on APN 025-220-003 to allow a dog kennel for 30 dogs on property
zoned A-5 located at the end of Watt Lane at 288 Watt Lane, Gridley area.
B. Minor changes may be approved administratively by the Director of Development
Services or designee upon receipt of a substantiated written request by the
applicant. Prior to such approval, verification shall be made by each Department
or Division that the modification is consistent with the application, fees paid and
environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
C. Mitigation Measures:
1. The kennel operator shall clean and remove all excrement from the kennel on a

at the cost of the kennel operator. The Planning Division shall be notified of the
time of the inspection and informed of the outcome within 72 hours of inspection.
Any deficiencies documented by the Rabies Control Division shall be corrected
within one month of observation or within a time frame acceptable to Rabies Control
Division.
7. Approval of this request shall not waive compliance with all sections of the Zoning
Ordinance and all other applicable State and County laws and regulations in effect
at the time of building permit application.
E. Public Works Department Conditions:
8. Prior to the issuance of building permits obtain encroachment permit for all new or
existing driveway approaches and construct them to County standards, as specified
in County Improvement Standards.
9. Prior to the issuance of building permits deed to Butte County, in fee simple, 30 feet
of right-of-way from the centerline of Watt Lane.
F. Fire Department Conditions:
10. Provide an all weather access to all structures, which is designed to carry a 40,000
pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance.

SUMMARY: This application is for a Use Permit to allow a dog kennel for 30 dogs. The
kennel is a conditionally consistent use in the AR -5 zone and a secondary use in the Orchard
& Field Crop General Plan designation. Staff recommends approval with conditions and
findings contained in this report.
PROJECT CHARACTERISTICS: This request is for a Use Permit to allow a private dog
kennel on an 8.2 acre parcel. Currently there is a single family modular home 2460 and a
metal structure 30x65 on a cement slab foundation. It is proposed to house the dogs inside
the metal structure. As the need for additional dog runs increases beyond the 24 dog run
capacity of the metal structure, the applicant proposes to build an addition onto this structure
to house the additional dogs. The dogs will primarily be limited to English Springer Spaniels.
They will be trained both on-site and offsite. These dogs are trained either for Field Trials
(show competition) or for hunting. Some use of guns (blanks) and whistles are involved.
Dogs trained for Field Trials are kept as long as a year, while dogs trained for hunting are
kept from 3 to 4 months. Operating hours will average 3-4 hours per day, at 20 to 25 minutes
per dog. The project is located on an 8.2 acre parcel at the end of Watts Lane, approximately
one mile north of Stimpson Road, on the east side of Highway 70, north of Robinson Corner,
in the Gridley area.
The project site is zoned A-5 (Agricultural -5 acre minimum) and has a General Plan
designation of Orchard & Field Crop. The project site is surrounded by parcels ranging in
size from 8+/- acres to 26+/—acres. All surrounding parcels have A-5 zoning and Orchard
& Field Crop land use designation. The parcel is bordered by grazing land, with the nearest
residences located south, approximately 300-600 feet away. The topography is fairly level
and there is an assortment of trees along Watt Lane and the north and south borders ,of the

property, providing a natural screen blocking the project site from the neighbors to the south.
Water is provided by a private well and sewer service is provided by a septic system. Access
to the parcel is from Watt. Lane via Stimpson Road.
ANALYSIS: The request for a dog kennel with this intensity of use is not,expected to be
incompatible with existing land uses adjacent to the property. The applicant has stated the
dogs will be housed inside an enclosed structure. Each stall will be equipped with a "bark
eliminator" collar. The size of the parcel (8.2 acres), the purpose of the.kennel, gun dog
training, the manner in which the dogs will be kept in an enclosed structure, -and the use of
"bark eliminator' collars for each stall, are all factors that mitigate against impacting
surrounding agricultural uses. a
The Initial Study completed for this project has identified several issues and concerns that
must be addressed in order to accurately assess the project. These issues/concerns include
animal waste and odor, and noise.
Animal waste & odor:
Approval of this project may have a potentially significant impact from surface water runoff,
due to dog feces and other animal wastes, to surface waters if such waste products are not
disposed of properly. Approval of the request will increase the presence of animal waste on-
site. A mitigation measure for a septic system to handle dog feces is necessary to
adequately address such a potential impact. If animal wastes are not properly disposed of
in a proper manner odor could become a problem. Approval of a dog kennel for 30 dogs
should not result in objectionable odors arising from increased dog feces if properly handled
as required by the Butte County Environmental Health Division.
To assure potential septic and odor impacts will be reduced to levels of insignificance the
following recommendations will be made as conditions of approval:
The kennel operator shall clean and remove all excrement from the kennel on a
weekly basis and dispose of excrement in septic tank installed under permit from the
Butte County Environmental Health Division.
2. The septic tank should be pumped as needed or as directed by the Butte County
Environmental Health Division.
Noise:
Approval of the request to permit a dog kennel for 30 dogs may present potentially significant
noise impacts on the surrounding area. The potential sources of noise may include barking,
gun shots and whistles employed in the training program. The applicant has proposed to
equip each stall with a "bark eliminator" collar. The whistles used, for the type of dog the
applicant will be training, make very little noise (pers demonstration,, Gary Breitbarth). The

project site is located at the end of Watt Lane, with the nearest neighbor located in excess
of 300' away. Few neighbors live in the general proximity of the site. However, there is the
potential for future land division and an increase in population density in the vicinity of the
project. The applicant has indicated he would be using blank shots in gun training with the
dogs on-site. The applicant said he would like to use the back portion of the parcel, on the
other side of the creek where it is further removed from any residences, to train the dogs with
gunfire.
To assure potential noise impacts will be reduced to levels of insignificance the following
recommendations will be made as conditions of approval:
1. The stalls shall be equipped with "anti -bark" collars;
2. Use of gun training shall be restricted to the use of blanks, at the eastern half of the
parcel, at least 600 feet distance from residences on-site.
No other issues or concerns were identified in the Initial Study. The Butte County Fire
Department and Public Works have recommended additional conditions and are listed in.
Exhibit "A."
ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project
under the California Environmental Quality Act (CEQA) and as such, is subject to the
requirements of CEQA. An Initial Study has been prepared by County staff. Based upon the
a review of the Initial Study, staff has determined that the project impacts can be fully
mitigated with the addition of mitigation measures added as conditions of approval for the
project.
RECOMMENDATION: Staff recommends that the Planning Commission approve the
application for Gary & Dawn Breitbarth on APN 025-220-003, subject to the following findings
and conditions in the attached Exhibit "A."

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Gary & Dawn Breitbarth are hereby granted a Use Permit in
accordance with application filed: 4/17/97 to allow a dog kennel for 30 dogs on property
zoned A-5 located at 288 Watt Lane, Gridley.
Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said permit
in accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-45.
2. Unless otherwise provided for in a special condition to this use permit, all
conditions must be completed by the Permittee within 24 months of the delivery
of the countersigned permit to the Permittee.
3. If any use for which a use permit has been granted is not established within two
years of the date of receipt of the countersigned permit by the Permittee, the
permit shall become null and void and reapplication and a new permit shall be
required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns
of the Permittee.
Section 1: Environmental Findings.
A. An Initial Study was completed in compliance with the California Environmental Quality
Act identifying potentially significant environmental effects that the project may have.
Provisions and the design of the project and the conditions added to the project will
mitigate such effects to a level of insignificance; and

B. The Planning Commission has independently reviewed, analyzed, and considered the
proposed Negative Declaration with mitigation measures prior to making its decision
on the project, and the Negative Declaration reflects the independent judgement of
Butte County; and
Section 2: Zoning Ordinance Findings.
A. The proposed use of the property, pursuant to Butte County Code Section 2445, will
not conflict with, impair or be detrimental to the uses both permitted and conditional
in the A-5 zone and the Orchard & Field Crop General Plan designation in which it is
located and/or adjoins; and
B. The proposed use would not be unreasonably incompatible with, or injurious to,
surrounding properties in that there are limited residences in the area and future
densities are limited to the 5 acre minimum in the A-5 zone and to potential constraints
such as the presence of a floodplain in the area; and the project is conditioned to
reduce associated impacts to a level of insignificance that are similar to existing
conditions in the area; and
C. The proposed use of the property, pursuant to Butte County Code Section 24-90, will
not conflict with, impair or be detrimental to the uses both permitted and conditional
in the A-5 zone and the Orchard & Field Crop General Plan Land Use designation in
which it is located and/or adjoins:
Existing development pattern has no residential structures within 300 feet of
the proposed use; and
2. The A-5 zone will allow for the potential creation of approximately 5 new
parcels immediately adjacent to the project site; and
3. The keeping of animals, including dogs, is provided for in the A-5 zoning,
subject to animal maintenance requirements of Sections 24-255 through 24-
255.15.
D. The proposed use of the property would not be detrimental to the health, safety, and
general welfare of the persons residing or working in the neighborhood, or to the
general health, welfare and safety of the residents of the County in that the proposed
use will be conditioned to reduce associated impacts to a level of insignificance.
Section 3: Action
A. Subject to the findings indicated in Sections 1 and 2 of this Permit and the mitigation
measures and conditions found in Exhibit "A," a Negative Declaration with mitigation
measures is hereby adopted and the Use Permit approved for Gary & Dawn Breitbarth

on APN 025-220-003 to allow a dog kennel for 30 dogs on property zoned A-5 located
at the end of Watt Lane at 288 Watt Lane, Gridley area.
B. Minor changes may be approved administratively by the Director of Development
Services or designee upon receipt of a substantiated written request by the applicant.
Prior to such approval, verification shall be made by each Department or Division that
the modification is consistent with the application, fees paid and environmental
determination as conditionally approved. Changes deemed to be major or significant
in nature shall require a formal application for amendment.
C. Mitigation Measures:
The kennel operator shall clean and remove all excrement from the kennel on a
weekly basis and dispose of excrement in septic tank installed under permit from the
Butte County Environmental Health Division. The septic tank shall be pumped as
needed or as directed by the Butte County Environmental Health Division.
2. All stalls shall be equipped with "anti -bark" collars.
3. Gun training shall be restricted to the eastern (1/2) half of the parcel, away from
existing and potential future residences.
D. Planning Division Conditions:
4. The kennel operator shall sign a Hold Harmless agreement with Butte County.
5. The kennel operator shall be permitted to display a sign at the entrance of the property
to a maximum size of ten (10) square feet subject to required setbacks.
6. The kennel shall be inspected twice a year by the Butte County Rabies Control
Division at the cost of the kennel operator. The Planning Division shall be notified of
the time of the inspection and informed of the outcome within 72 hours of inspection.
Any deficiencies documented by the Rabies Control Division shall be corrected within
one month of observation or within a time frame acceptable to Rabies Control Division.
7. Approval of this request shall not waive compliance with all sections of the Zoning
Ordinance and all other applicable State and County laws and regulations in effect at
the time of building permit application.
E. Public Works Department Conditions:
8. Prior to the issuance of building permits obtain encroachment permit for all new or
existing driveway approaches and construct them to County standards, as specified
in County Improvement Standards.

9. Prior to the issuance of building permits deed to Butte County, in fee simple, 30 feet
of right-of-way from the centerline of Watt Lane.
F. ' Fire Department Conditions:
10. Provide an all-weather access to all structures, which is designed to carry a 40,000
pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance.

conflict with, 'impair or be detrimental to the uses both permitted and conditional in the A-5
zone. and the Orchard & Field Crop General Plan Land Use designation in which it is
located and/or adjoins:
Existing development pattern has no residential structures within 300 feet of the
proposed use; and
2. The A-5 zone will allow for. the potential creation of approximately 5 new parcels
immediately adjacent to the project site; and
3. The keeping of animals, including dogs, is provided for in the A-5 zoning, subject
to animal maintenance requirements of Sections 24-255 through 24-255.15.
D. The proposed use of the property would not be detrimental to the health, safety, and
general welfare of the persons residing or working in the neighborhood, or to the general
health,.welfare and safety of the residents of the County in that the proposed use will be
conditioned to reduce associated impacts to a level of insignificance.
Section 3: Action
A. Subject to the findings indicated in Sections 1 and 2 of this Permit and the mitigation
measures and- conditions found in Exhibit "A;" a Negative Declaration with mitigation
measures is hereby adopted and the Use Permit approved for Gary. & Dawn Breitbarth on
APN 025-220-003 to allow a dog kennel for 30 dogs on property zoned A-5 located at the
end of Watt Lane at 288 Watt Lane, Gridley area.
B. Minor changes may be approved administratively by the Director of Development Services
or designee upon receipt of a substantiated written request by the applicant. Prior to such
approval, verification shall be made by each Department or Division that the modification
is consistent with the application, fees paid and environmental determination as
conditionally approved. Changes deemed to be major or significant in nature shall require
a formal application for amendment.
C. Mitigation Measures:
1. The kennel operator shall clean and remove all excrement from the kennel on a daily basis
and dispose of excrement in septic tank installed~or other means of disposal under permit
from the Butte County Environmental Health Division. The septic tank shall be pumped
as needed or as directed by the Butte County Environmental Health Division.
2. All stalls shall be equipped with "anti -bark" collars. All training shall take place during
daylight hours.
3. Gun training shall be restricted to the eastern ('/2) half of the parcel, away from existing
and potential future residences.
D. Conditions:
4. Tiaekennel operator shall install'a 6 ft. chain !ink fenice as shown ori the attached site plan.
5. The kennel operator shall be permitted to display a sign at the entrance of the property to
a maximum size of ten (10) square feet subject to required setbacks.
6. The kennel shall be inspected annually by the Butte County Rabies Control Division at the
cost of the kennel operator. The Planning Division shall be notified of the time of the
inspection and informed of the outcome within 72 hours of inspection. Any deficiencies
documented by the Rabies Control Division shall be corrected within one month of
observation or within a time frame acceptable to Rabies Control Division.
7. Approval of this request shall not waive compliance with all sections of the Zoning
Ordinance and all other applicable State and County laws and regulations in effect at the
time of building permit application. . ,
8. Prior to the issuance of building permits obtain encroachment permit for all new or existing
driveway approaches and construct them to County standards, as specified in County
Improvement Standards.
9. Prior to the issuance of building permits deed to Butte. County, in fee simple, 30 feet of
right-of-way from. the centerline of Watt Lar.e.
10. Provide an all weather access to all structures,) which is designed to carry a 40,000 pound
fire apparatus at least 10 feet wide with a 15 foot vertical clearance.
11. Applicant shall obtain a kennel license from Butte County Animal Control.
12. Applicant shall comply with all other applicable State and local statutes, ordinances, and
regulations.

J. SITE DEVELOPMENT
1. The project site shall be developed in accordance with the approved project site plan and
the conditions contained herein. Said site plan is on file in the Planning Division, is
identified as "Exhibit B" and dated _, 19_ and is incorporated herein by this
reference.

2. Prior to the issuance of building permits, the plans, incorporating all applicable conditions
of approval shall be submitted to the Planning Division to verify compliance with said
conditions of approval.
3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view
obstructing gates and a solid or semi -open shade cover. Plans to be reviewed and
approved by the Planning Division prior to construction.
4. Prior to any use of the project site or business activity being commenced thereon, pursuant
to this permit, conditions of approval contained herein shall be completed
to the satisfaction of the Planning Division.
5. All electrical and mechanical equipment, including but not limited to air conditioning units,
electrical boxes, transformers, and backflow preventers, shall be screened from public
view. Screening shall be to the satisfaction of the Planning Division and in compliance with
the Building Division.
K. LANDSCAPING
1. A detailed landscape and irrigation plan consistent with the project site plan shall be
submitted to and approved by the Planning Division prior to the issuance of building
permits.
2. A plan of the existing on-site mature trees, located in any area proposed for buildings and
vehicular access, shall be provided to and approved by the Planning Division prior to the
issuance of building permits and/or prior to grading or vegetation removal. The applicant
shall minimize the removal of mature trees, where possible. A mature tree shall be
defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level.
Mature trees removed shall be replaced by planting replacement trees of equal number
and not less than _ gallon size.
3. All landscaped areas shall be maintained in a healthy and thriving condition, free from
weeds, trash, and debris, during the term of this permit.

4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded,
planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent
irrigation system shall be installed for non-native vegetation. A one year Faithful
Performance bond shall be posted to guarantee installation and established growth.
5. In parking lots of commercial and industrial development, trees of not less than 15 gallon
size shall be provided to reduce heat gain from the paved surface and to soften the visual
impact of the paved area. Such trees shall be planted at a minimum density of one tree
every three parking spaces. Tree species shall.be approved by the Planning Division prior
to planting.
6. Prior to the commencement of grading and/or construction activity, all individual or groups
of oak trees which are to be retained as part of the project, shall be fully protected through
the use of root protection zones (RPZ). During construction, RPZs shall be established
using protective fencing enclosing an area with a radius 1.5 times the distance from the
trunk to the dripline. - Within this protective buffer, no grading, trenching, fill, or.vegetation
alteration of any kind shall be allowed. The RPZs shall be maintained after the completion
of construction in order to continue to protect the oak trees, but the'fencing shall be
removed.

1. During construction, should any archaeological artifacts be discovered, the Planning
Division shall be notified immediately, and all work shall cease until a qualified
archaeologist has examined the artifacts and the site and submitted his or her findings to
the Planning Division, and recommended clearance to continue. Recommencement of
construction shall be upon the approval of the Planning Division. Archaeological artifacts
are defined as follows:
_ 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year
floodplain and/or streambed the following entitlements must be obtained: a California Fish
and Game 1604 Streambed Alteration permit and an Army, Corps 404 permit or exemption
certificate.
M. ADDITIONAL APPROVALS
1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic '
Impact Fees shall be made.
2. Prior to the issuance of a building permit for each new or additional living unit the applicant
shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established
fee.
_ 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the
orchard or other agricultural use of the property, the property owner shall enter into the
County approved Orchard Management Agreement. The agreement shall terminate
in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160.
The agreement shall be recorded and recording fees paid by the applicant.
4. Approval of this request shall not waive compliance with all sections of the Zoning
Ordinance and all other applicable State and County laws and regulations in effect at the
time of building permit application.

5. This Conditional Use Permit is granted for a period of month(s) at the end of which
time it shall expire (unless the approving authority has held a hearing thereon and granted
an extension. In connection with such an extension the approving authority may add,
change, or delete conditions.
6. Approval of this Conditional Use Permit shall become null and void if the use for which it
has been granted is not established within two calendar year from the date of approval. No
formal cancellation or revocation action by the County will be necessary.
7. The developer shall display a current County Zoning and .County Land Use Map in the
sales office at all times, and/or suitable alternatives.
8. Approval of this application does not become effective unless, prior to 4:00 p.m. on
_, 199_, the applicant shall sign and file with the Department of
Development Services an Indemnity Agreement in a form satisfactory to the County
Counsel.
9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a
Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the
provisions of Chapter 3, Article II of the Butte County Code. The fee amount shall be
determined and calculated as of the date of application for building permit.
10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and
record the CSA 87 Traffic and Drainage Mitigation Agreement or pay the required fees
prior to the issuance of the Use Permit.
11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax
Collector's Office to begin the process of a Transient Occupancy Registration Certificate.
A Transient Occupancy Registration Certificate shall be required within ten (10) days after
commencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming
house, apartment house, mobile home park, recreational vehicle park, campground, or
parking area (See Chapter 23A).
12. Prior to the issuance of the Use Permit, the applicant shall pay all outstanding County fees.

B. DRAINAGE
1. Prior to the recordation of the issuance of building permits a plan for a permanent solution
for drainage shall be submitted to and approved by the Department of Public Works. The
drainage plans shall specify how drainage waters shall be detained on site and or
conveyed to the nearest natural or publicly maintained drainage channel or facility and
shall provide that there shall be no increase in the peak flow runoff to said channel or
facility.
2. Prior to the issuance of building permits establish 100 year floodplain elevations and the
lowest floor elevations for any structures. Show on the site plan map for building permits
the elevations (by contours) and the location of an accepted NVGD benchmark and a
temporary benchmark on-site.

1. Construction, installation or development of structures or facilities on the parcels/lots shall
comply with the latest California Fire Safe Regulations, (Public Resources Code 4290),
and all other applicable State and County codes, ordinances and regulations in effect at
the time of application for improvement permits.
2. Building identification and/or addresses shall be installed in conformance with Public
Resources Code 4290 and shall be posted at the beginning of building construction and
maintained continuously thereafter.
3. Fire hydrant identification, reflector or post reflectors shall be installed acceptable to the
County Fire Warden.
4. In lieu of a pressurized water system or water storage tank, payment of $200.00 per
created parcel into the Battalion _ water tend fund, is required prior to the issuance of a
building permit.
5. A pressurized community water system for fire protection is required. The specific
locations and fire flow requirements shall be in accordance with the Fire Department
specifications and to the satisfaction of the County Fire Warden. Average required hydrant
spacing _ feet, hydrant size _ inches, and residual fire flow _ gpm. Submit plans to
the Fire Department for review and approval prior to construction of facilities.
6. In lieu of hydrant installation, payment may be made into the hydrant fund at a cost
of $1.72 per lineal foot of street frontage. The estimated fee amount is $

Responsibility For Packaging And Completing
Airbill You are responsible for adequately packaging your
goods and properly filling out this airbill. If you omit the number of

packages and/or weight per package, our billing will be based on
our best estimate of the number of packages we received and/or
an estimated "default" weight per package as determined by us.
• Responsibility For Payment Even if you give us different
payment instructions, you will always be primarily responsible for
all delivery costs, as well as any cost we incur in either returning
your package to you or warehousing it pending disposition.

such items as artwork, jewelry, furs, precious metals, nego-
tiable instruments, and other items listed in our Service Guide.
• You may send more than one package on this airbill and fill in
the total declared value for all packages, not to exceed the $100,-(
$500 or $50,000 per package limit described above. (Example: 5
packages can have a total declared value of up to $250,000.) In
