The project is conditionally consistent with the "A -SR" Agricultural - Suburban Residential zone and the General Plan designation of Low Density Residential which notes that utilities and public quasi -public facilities are secondary uses for this land use designation. PROJECT CHARACTERISTICS: This project is a request to allow the construction and use of a well/pump house for public water service on a parcel designated for low density residential use. The facility will be located within a 500± square foot cement block structure on an 8,000 square foot portion of an existing residential parcel. The project site is located on the south side of West Sacramento Avenue, immediately east of Bidwell Avenue. The well/facility will improve the current water pressure and volume for a population of approximately 500 residents. The parcel currently contains an existing homesite with a 2,400 square foot residence, and associated residential accessory structures and an almond orchard. The access drive to the existing home is from Bidwell Avenue. A recently constructed single family residential subdivision is located directly east of the project site with public improvements (contiguous curb and gutter, and sidewalk) extending from the existing residential subdivision to the easterly boundary of the project site. To the north, west and south are residential land uses including older single-family residential homes, duplex -residential and newer low density residential homes. Parcel sizes in the general vicinity range from 0.3 of an acre to 2+ acres. The subject site is uniformly flat with no significant topographical features. The area soils once suitable for cultivation, have been converted and designated for residential uses. ■ Butte County Department of Development Services - Planning Division ■ The applicant proposes to locate the public water facility directly adjacent to West Sacramento Avenue, north of the existing single-family home. Access to the pump building is proposed from a 16 -foot wide driveway on West Sacramento Avenue. Also included is a small parking area for the one employee who will check the facility once a day. In the future, the facility may include an above the ground fuel tank which will be housed in a secondary concrete container for use only in emergencies during a power outage. The 16'x 32' concrete block building will be setback 20 feet from West Sacramento Avenue with a 20 foot setback from an adjoining residential parcel to the east. (Please see attached "Plat to Accompany Use Permit Application.) An existing wood fence is located on the east property line. At the request of the property owner, a four foot high, wood fence will be constructed around the entire perimeter of the pump house site. All sides of the site will be landscaped. A preliminary landscape plan with the building elevation has been attached for your review. Pursuant to the request of Butte County Public Works Department, the project applicant will construct "one half of the street (West Sacramento Avenue) to RS -2A standard, including, but not limited to, P.C.C. curb, gutter and sidewalk". ANALYSIS: This project is conditionally consistent with the "A -SR" Agricultural -Suburban Residential zone and the General Plan designation of Low Density Residential which notes that utilities and public quasi -public facilities are secondary uses for this land use designation. The provision of public facilities such as domestic water service, is a necessary component of the development process. The proposed facility will provide adequate pressure and water volume for the surrounding residential area. The facility will be landscaped for compatibility with the residential nature of the surrounding properties. Operation of the facility will not increase the normal ambient noise levels of a residential neighborhood. Additionally, the necessary public improvements to ensure street safety and compatibility will be constructed adjacent to the project site as a condition of approval for the Use Permit. Other concerns/comments: The City of Chico reviewed the proposed water facility as part of prezoning action for the general vicinity prior to the recent subdivision. The City of Chico Planning Division has no comments, recommendations or objections to the proposed project. The Environmental Health Department has recommended approval of the project without conditions. Chairman Lambert asked the depth of the proposed well and if the well would impact the agricultural wells to the west.Y Mr. Sanders said that Cal Water wells are typically deep, but their representative could answer the question better. ` Commissioner Leland asked why this request was not subject to the Subdivision Map Act. Mr. Sanders said as a public utility, they are exempt from the Subdivision Map Act. The hearing was opened to the Public. Rick Rodriguez, NorthStar Engineering, said they had no problems with the conditions. Tony Ruggle, Cal Water, said the well would be between 400-700 feet deep. He said there will be no significant impact to surrounding ag. wells. Chuck Benedict asked if this request should be reviewed by the Water Commission under Measure G. Mr. Sanders thought Measure G was concerned with the sale of ground water outside the County. Virginia Bender said there are many homes in this area with wells less than, 100 ft. She was concerned with what this well would do to their water table. She said she is in the green zone across from this site. Commissioner Nelson explained that it was his understanding, in the Chico area, there are three layers of aquifers and that most of the ag. wells are in the first and second layers, that this well would draw from the third layer. Linda Koenig said her well is 65 ft. deep and she is concerned with this affecting the water level of her well. She asked for a written guarantee that this well would not affect her well. Walt Bender said he was concerned about the only recourse against Cal Water being a court action if his well goes dry. 0 Butte County Planning Commission Minutes - October 9, 1997 0 Tony Ruggle said the draw for this well will probably be from 200 feet or more. He said this will be the second well in the area because of growth. He said the well is need to maintain the pressure and for fire protection. The hearing was closed. Chairman Lambert was also concerned about the effect on the ag. wells in the greenline area. Mr. Sanders said if the Commission would like further information, they can continue this hearing. Commissioner Mooney said he did not have a problem with this request. Commissioner Leland said that anyone who owns a parcel has a right to drill for water. He said he was inclined to approve this request as it stands. He said this is a zoning issue. It was moved by Commissioner Cage and seconded by Chairman Lambert to continue this item for two weeks and to contact the Water Commission. Mr. Parilo read the findings necessary to approve this application. He said it may be prudent to continue this hearing to have a technical person present to answer questions. PROJECT CHARACTERISTICS: This project is a request to allow the construction and use of a well/pump house for public water service on a parcel designated for low density residential use. The facility will be located within a 500± square foot cement block structure on an 8,000 square foot portion of an existing residential parcel. The project site is located on the south side of West Sacramento Avenue, immediately east of Bidwell Avenue. The well/facility will improve the current water pressure and volume for a population of approximately 500 residents. The parcel currently contains an existing homesite with a 2,400 square foot residence, and associated residential accessory structures and an almond orchard. The access drive to the existing home is from Bidwell Avenue. A recently constructed single family residential subdivision is located directly east of the project site with public improvements (contiguous curb and gutter, and sidewalk) extending from the existing residential subdivision to the easterly boundary of the project site. To the north, west and south are residential land uses including older single-family residential homes, duplex -residential and newer low density residential homes. Parcel sizes in the general vicinity range from 0.3 of an acre to 2+ acres. The subject site is uniformly flat with no significant topographical features. The area soils once suitable for cultivation, have been converted and designated for residential uses. ■ Butte County Department of Development Services - Planning Division ■ The applicant proposes to locate the public water facility directly adjacent to West Sacramento Avenue, north of the existing single-family home. Access to the pump building is proposed from a 16 -foot wide driveway on West Sacramento Avenue. Also included is a small parking area for the one employee who will check the facility once a day. In the future, the facility may include an above the ground fuel tank which will be housed in a secondary concrete container for use only in emergencies during a power outage. The 16'x 32' concrete block building will be setback 20 feet from West Sacramento Avenue with a 20 foot setback from an adjoining residential parcel to the east. (Please see attached "Plat to Accompany Use Permit Application.) An existing wood fence is located on the east property line. At the request of the property owner, a four foot high, wood fence will be constructed around the entire perimeter of the pump house site. All sides of the site will be landscaped. Pursuant to the request of Butte County Public Works Department, the project applicant will construct "one half of the street (West Sacramento Avenue) to RS -2A standard, including, but not limited to, P.C.C. curb, gutter and sidewalk". The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit B" and dated 19_ and is incorporated herein by this reference. 2. Prior to the issuance of building permits, the plans, incorporating all applicable conditions of approval shall be submitted to the Planning Division to verify compliance with said conditions of approval. 3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing gates and a solid or semi -open shade cover. Plans to be reviewed and approved by the Planning Division prior to construction. 4. Prior to any use of the project site or business activity being commenced thereon, pursuant to this permit, conditions of approval contained herein shall be completed to the satisfaction of the Planning Division. 5. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING 1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. ■ Use Permit Standard Conditions - Butte County ■ 5 Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. ■ Use Permit Standard Conditions - Butte County ■ 0 The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this applicationdoes not become effective unless, prior to 4:00 p.m. on ,199 —, the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. 9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article II of the Butte County Code. The fee amount shall be determined and calculated as of the date of application for building permit. 10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and record the CSA 87 Traffic and Drainage Mitigation Agreement or pay the required fees prior to the issuance of the Use Permit. 11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax Collector's Office to begin the process of a Transient Occupancy Registration Certificate. A Transient Occupancy Registration Certificate shall be required within ten (10) days after commencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobile home park, recreational vehicle park, campground, or parking area (See Chapter 23A). 12.
