The prior owners were J. Lowell and Anne Hagberg. Mr. and Mrs. Hagberg had received a Use Permit in July of 1997. This permit will allow for a single family residence to be constructed on the above mentioned property. It is our intention to build a single family residence on the above mentioned property. We intend to live at this location. Before we begin the construction process we have need to sell our current residence. Due to the uncertainty of the housing market, we need additional time for the sale to occur. Lowell and Anne Hanbera (aaalicant/ownerl: A Use Permit request to allow a single family dwelling unit in a M-2 (Heavy Industrial) zone, identified as APN 021-260-048, located 161 ft. east of Losser Ave., and approximately 1,200 ft. north of West Liberty Rd. Gridley area. The project site is located in Supervisorial District 4. RELATED ITEMS: None FOR: Planning Commission Meeting of June 26, 1997 SUMMARY: Staff recommends approval of this application subject to the findings and conditions contained herein. PROJECT CHARACTERISTICS: This project is a Use Permit to allow a single family dwelling unit in a M-2 (Heavy Industrial) zone. The project site is 4.75 acres in size, with the parcel being divided by a large drainage channel. Approximately .29 acres lies on the west side of the drainage channel and 4.46 acres on the east side of the drainage channel. A dilapidated bridge across the drainage channel allows access to the eastern portion of the project site. The project site has split zoning: M-2 on the eastern portion and A-5 on the western portion. The Land Use Element Map of the Butte County General Plan designates the project site as Industrial on the eastern portion and Agricultural -Residential on the western portion. The proposed dwelling unit will be located on the M-2 portion of the project site. The M-2 Zoning Ordinance requires that a conditional use permit be obtained for dwelling units placed in this zone. The M-2 portion of the project site has been improved with a 3 year old walnut orchard while the A-5 portion supports a mature walnut orchard: An agricultural well is located on the M-2 portion of the project site and domestic water service for the project site will be supplied by an on-site well. Sewage disposal for the future dwelling unit will be handled by an on-site septic system. Access to the project site is via a recorded 50 ft. wide road easement which runs off of Losser Ave. Surrounding parcels are zoned M-2 to the north, east, and south, and A-5 to the west. Surrounding land use is agricultural and rural residential. The closest industrial use to the project site is located approximately .5 mile to the northeast. The project site is located within the City of Gridley's Sphere of Influence. 0 Butte County Department of Development Services ❑ . Planning Division ❑ ANALYSIS: This Use Permit will allow a single family dwelling unit in a M-2 (Heavy Industrial) zone. No manufacturing uses have been established in the immediate project area, but at some point in the future manufacturing uses could be established. It is possible that construction of a dwelling unit at the proposed location could adversely affect development of future industrial uses in the area. Manufacture or industrial uses may be reluctant to locate in areas that are close to residential units due to nuisance complaints. In addition, noise and odors from a nearby manufacturing use could impact the residents of the dwelling unit on the project site. Potentially, this dwelling unit could become part of a future industrial use as an accessory residence. The project site is divided by a large drainage channel, which the split zoning for the project site also follows. The .29 acre portion to the west of the drainage channel is zoned A-5, which does allow a residential use. The applicants considered placing their dwelling unit here, but wanted more privacy then can be afforded by the .29 ace parcel. Placing the dwelling unit on the .29 acre A-5 parcel would require that many of the mature walnut trees be removed to make room for the dwelling unit and accessory buildings. The area for the dwelling unit on the M-2 was not planted with walnut trees, so no trees will need to be removed. The proposed dwelling unit will be located in the northwest corner of the project site. The parcels located to the north, east, and south of the project site are zoned M-2. The dwelling unit will be located approximately 35 ft. from the north property line, approximately 165 ft. from the east property line, and 555 ft. from the south property line. The long distances from the east and south property lines, along with the walnut trees located on the project site, will act as a buffer between the dwelling unit and any future manufacturing uses. While the distance between the dwelling unit and the north property line is only 35 ft., the north property line has been planted with a row of tall eucalyptus trees which may act as a buffer to any future adjacent manufacturing uses. In addition, there is sufficient area for a larger vegetation buffer to be planted if it is desired. The Butte County Fire Department commented on this project and is requesting that building identification and/or addresses be installed and maintained in conformance with Public Resources Code 4290. They are also requesting that an all-weather access road be provided to all structures, which is designed to carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 foot vertical clearance. There is an existing bridge across the drainage ditch, but it is does not appear to be able to meet Fire Department standards. The applicant will be required to provide a bridge across the drainage ditch that meets Fire Department standards prior to issuance of building permits. The Butte County Department of Public Works is recommending that prior to issuance of building permits that encroachment permits be obtained for all new or existing driveway approaches and construct them to County standards. This will be added as a condition of project approval. The Department of Public Works also stated that if the property is developed for commercial or industrial uses there will be additional requirements. ❑ Butte County Department of Development Services ❑ Planning Division ❑ 2 The Butte County Environmental Health Division commented on this project and has stated that a sewage disposal permit will be required for new septic systems. They are also requesting that prior to issuance of building permits that the applicant provide verification of potable water by analysis of well water for coliform bacteria. These concerns have been added as a conditions of approval. The City of Gridley Planning Commission -and City Council considered this project at their public hearings and indicated that they are not opposed to the project, provided that the applicant is required as a condition of approval to record an agreement that he and future owners will not protest development and operations of uses legally permitted by the manufacturing zoning of the site and the area around it. This requested condition had been added as a condition of this project's approval. To. approve a Use Permit, the Planning Commission must find that the request meets the requirements of Section 24-45.10 of the Butte County Zoning Ordinance. This section states that the Commission may grant a Use Permit if the proposed uses of the property will not impair the integrity and character of the zone in which the lands lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. This project qualifies for a categorical exemption to review under CEQA as per Section 15303 (Class 3 exemption), construction of a limited number of small structures: PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within a 300 foot radius of the subject property. RECOMMENDATION: Staff is recommending that a Use Permit be granted for J. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: J. Lowell and Anne Hagberg are hereby granted a Use Permit in accordance with the application filed: April 22, 1997, to allow a single family dwelling unit in a M-2 (High Density Residential) zone, identified as APN 021-260-048. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be .completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of- Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed.to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors,. and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. ❑, Butte County Department of Development Services ❑ Planning Division ❑ 4 A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(c), construction of new, small structures;'and Section 2: Zoning Ordinance Findings A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with or injurious to surrounding property or detrimental to the health, -safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County because: The project site is currently planted in walnut orchard and the owner has no plans to convert.the agricultural use to a manufacturing use; and 2. No manufacturing uses have been established on other nearby properties that are zoned M-2; and 3., The location of the proposed dwelling unit will. allow for either distance and/or vegetation to act as a buffer between the dwelling unit and any future manufacturing uses; and 4. The home could be used as a caretaker residence or other type of accessory residence if future industrial uses are established on-site and B. The proposed project is conditionally consistent with the M-2 Zone with a Use Permit and is a Secondary Use under the Industrial General Plan land use designation; and Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for J. Lowell and Anne Hagberg on APN 021-260=048 to allow a single family dwelling unit in a M-2 zone. Approval shall be subject to the •- following conditions: ` B. Conditions of Approval: 1. Prior to issuance of building permits, the applicant shall sign and record an agreement that he and future owners will.not protest development and operations of uses legally permitted by the manufacturing zoning of the site and the area around it. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. The subject property does include a small area of that size on the west side of the 70' -wide drainage ditch in an A-5 zone. This small area is better suited as a homesite, because it is buffered from the designated industrial area by the wide ditch. However the illustration submitted with the application indicates the home will be built on the large industrial part of the 5-4cre site, east of the ditch. The site on which the home is to be built is zoned M-2, and properties on three sides of it are also zoned M-2. Although the area is currently planted to orchard, it is the designated industrial growth area in Gridley's Sphere of Influence. Some manufacturing uses don't like to locate next to residences because of nuisance complaints. It is possible that construction of a home at this location could adversely affect development of manufacturing uses in the area. Persons residing next to industrial uses frequently complain about noise and odors. Some banks have refused mortgage financing for homes located in manufacturing zones. Properties within Gridley's Sphere of Influence are the subject of Butte County Resolution 86/106. The City proposes to provide full municipal services, including electricity, to all areas of its Sphere at some time. Development within the Sphere should be conditioned upon an agreement not to protest annexation to the City and connection to City services when they are available to the area. At the Council meeting, the applicant indicated he is aware that manufacturing uses can be constructed around his proposed house, and he will not object to such development in the future. Councilmembers unanimously agreed they are not opposed to building a house on the site, as long as the applicant is required to record an agreement that he and future owners will not protest development and operation of uses legally permitted by the manufacturing zoning of the area. In reference to an Agreement from the City of Gridley, in Condition No.. 1, Chairman _ Lambert asked if they can tie a future owner to an, agreement- to not -protest future manufacturing development in the area and how would it be done. She said the agreement needs to be tied to the land with the Use Permit. Commissioner Nelson said the agreement is a way to notify people. - The -hearing was -opened -to the public. Lowell Hagberg said he is willing to provide a form to sign acknowledging zoning. He said they will have to move some trees for the driveway. He said the bridge will be replaced by a pipe or new bridge. The hearing was closed. Commissioner Leland said Condition 1 was not needed. It was moved by Commissioner Leland, seconded by Commissioner Nelson, and unanimously carried for approval with the deletion of Condition 1 as follows: Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(c), construction of new, small structures; and Section 2: Zoning Ordinance Findings. A. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit B" and dated 19_ and is incorporated herein by this reference. 2. Prior to the issuance of building permits, the plans, incorporating all applicable conditions of approval shall be submitted to the Planning Division to verify compliance with said conditions of approval. 3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing gates and a solid or semi -open shade cover. Plans to be reviewed and approved by the Planning Division prior to construction. 4. Prior to any use of the project site or business activity being commenced thereon, pursuant to this permit, conditions of approval contained herein shall be completed to the satisfaction of the Planning Division. 5. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING 1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. ■ Use Permit Standard Conditions - Butte County ■ 5 0 - • 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. , Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. ■ Use Permit Standard Conditions - Butte County ■ E 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on _, 199_, the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County "Counsel. 9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article II of the Butte County Code. The fee amount shall be determined and calculated as of the date of application for building permit. 10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and record the CSA 87 Traffic and Drainage Mitigation Agreement or pay the required fees prior to the issuance of the Use Permit. _ 11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax Collector's Office to begin the process of a Transient Occupancy Registration Certificate. A Transient Occupancy Registration Certificate shall be required within ten (10) days -after commencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobile home park, recreational vehicle park, campground, or parking area (See Chapter 23A). 12. Prior to the issuance of the Use Permit, the applicant shall pay all outstanding County fees.
