Name of Proponent: Berry Creek Community Church (Stuart Sanderson) 2. Address: 173 Sandy Spring Lane, Berry Creek CA 95916 Phone: (916) 589-3062 3. Name of Proposal, if applicable: 4. Type of Project: Use Permit Project Description and Location of Parcel: This project is for a quasi -public use to allow a church in an Unclassified zone. The site is zoned U (Unclassified) and has a General Plan land use designation of Agricultural Residential. The project site, which is 1.89 acres in size, has been developed with a single family residence and attached garage. The site is vegetated with numerous pine trees, a few oaks, and manzanita brush. The project site gently slopes downhill from east to west, with an average slope of 12%. The site fronts on Bald Rock Road. The Berry Creek Community Church currently meets in the Berry Creek Grange Hall which is located adjacent to the project site. The church currently has about 35 members. This project will result in four new structures being placed on the project site. The structures will be built in 4 phases: Phase 1 will be a 1,440 sq. ft. church with a study and an office; Phase 2 will be a 1,467 sq. ft. addition to the church; Phase 3 will be a 1,344 sq. ft. multi-purpose center; and Phase 4 will be a 400 sq. ft. storage building. A graveled 70 -space parking area will be constructed, along with new leachfields. Additional project description can be found at the end of this document. 6. The coming and going of traffic related to the church use may present potential impacts to the neighboring residents. These impacts are addressed below. The church currently meets in the Berry Creek Grange Hall, which is located on the adjacent parcel to the east of the project site. The traffic impacts already exist in the project area but will shift to the new site. The approval of this project will not disrupt or divide the physical arrangement of the community. The soils on the project site are considered to have a very high erosion potential, and the project site receives an average rainfall of 55 to 60 inches per year. The project site has an average slope of 12%. Approximately 80.16 of the project site will have surface disturbance due to new structures or cleared areas for parking spaces. Approval of this project would ultimately lead to a potential increase in soil erosion due to the expected construction impacts and vegetation removal. Standard construction techniques will be required as part of the construction process of this site. Another mitigation will require that the parking spaces and the access road be graveled with at least 2 inches of Class 2 aggregate material in order to reduce soil erosion. Therefore, significant erosion impacts are not expected to occur. The proposal will require some excavation or grading for driveways and level building sites. Any fill placed on site will have to meet the requirements of Chapter 70 of the Uniform Building Code and will be compacted to accepted engineering standards and will not represent a hazard. Therefore, the project will not create any unstable earth conditions or result in changes to geologic substructures. This proposal will result in some soil disruption, displacement, compaction and overcovering of the site as a result of development of a road, structures, driveways, leachfields, and landscaping. Overcovering will represent a minor percentage of the property. All grading associated with residential construction will also be subject to the requirements of Chapter 70 of the Uniform Building Code. Based on this information the project will not result in significant soil impacts. Mitigation # 1: Limit soil work to periods of dry weather between April 15 to November 15. Mulch protect, Hydro -seed, or otherwise stabilize the soil on all areas that have been disturbed or have been cleared of vegetation and are of erodible material. Mitigation # 2: The access road and all parking areas shall be covered with at least two (2) inches of Class 2 aggregate material and maintained thereafter. 4. WATER. No changes will occur in any water movements, nor in quantities ofgroundwaters. Once all of the proposed structures are completed, approximately 9% of the project site will be covered by structures, and approximately 80.16 covered by graveled parking areas. Minimal. changes in absorption rates and drainage patterns may occur due to impervious coverages from the new structures. The Department of Public Works is requiring a plan for a permanent solution for drainage be submitted prior to issuance of a building permit. The plans will show how drainage waters will be detained on site and(or conveyed to the nearest drainage channel. The plan will provide that there be no increase in the peak flow runoff off the site. In addition, the two mitigations found in Item 3 will reduce erosion impacts to a less than significant level. Mitigation: None required. 5. AIR QUALITY. Would the proposal. a) Violate any air quality standard or contribute to an existing or projected air quality violation? X b) Expose sensitive receptors to pollutants? X c) Alter air movement, moisture, or temperature, or cause any change in climate? X d) Create objectionable odors? X Response: The proposed project will not result in any significant cumulative impacts in air quality because the church is already operating out of the Berry Creek Grange Hall, located on the adjacent parcel to the east. Temporary air quality impacts may occur to residents in the project area as a result of construction activities on the project site. The nearest dwelling unit is located approximately 75 feet west of the project site. Another dwelling unit is located approximately 150 north of the project site and is located behind extensive vegetation. The access road and parking areas will be graveled. Vehicles on the gravel may put dust into the air. In order to reduce these impacts, a mitigation of this project will require that the project site be watered down during construction, and that the gravel road and parking areas be maintained so as not to put dust into the air. Once construction of all the facilities are complete there will be an increase in vehicle traffic over time as the church grows to meet the needs of the community. to an increase in the membership of the church,' but no further impacts to air quality are expected. Based on the number of current members of the church, and if each person arrived in their own vehicle, approximately 70 vehicle trips (35 in, 35 out) are generated by the church use. Estimates from the Institute of Transportation Engineers Trip Generation handbook (5th Ed.), for a church this size indicate that approximately 27 vehicle trips during a weekday, 28 vehicle trips on a Saturday, and 106 vehicle kips on a Sunday will be generated. These figures are for a church located in an urban setting. Peak use of the proposed church will occur on Sundays, from 9 A.M. to 1 P.M. During this time period, short term traffic impacts may occur on Bald Rock Road as vehicles enter and exit the project site. Construction activities will cause temporary, localized increases in existing noise levels which will have an impact on the residents of adjacent parcels. In order to reduce construction -related noise to a less than significant level, a mitigation of this project will allow noise-generaling construction activities on the project site to only occur from 8.00 a.m. to 5:00 p.m., Monday through Friday. This will ensure that noise -producing construction activities only occur during normal working hours. Automobile noise will be the primary source of the noise increase, with the peak hours of noise occurring on Sundays, from 9:00 a.m. to 1:00 p.m. The noise is not expected to be significant, but will noticeable on the adjacent parcels to the north and west of the project site. Additional noise sources may be from church activities being held outdoors. Mitigation # 5: Noise=generating construction activities on the project site shall only occur between the hours of 7:30 a.m. to 5:00 p.m., Monday through Saturday. 11. PUBLIC SERVICES. Would the proposal have an effect upon, or result in a need for new or altered government services in any of the following areas: a) Fire protection? X b) Police protection? X c) Schools? X d) Maintenance of public facilities, including roads? X e) Other governmental services? X Response: The project site is located in an area that has a high fire hazard. Fire Station #61 is located approximately 1 mile away. Response time is less than 10 minutes (pers. comm. C. F.). The Butte County Fire Department is requiring that a 2,500 gallon water storage tank be installed prior to beginning Phase 3. This will be added as a condition of project approval. Approval of this project should not result in a need for new or altered government services (see comment responses from government agencies). Mitigation: None required. 12. To reduce this impact to a, less than significant level, all outside light fixtures will be required to utilize 'low spillover" design to prevent light from directly spilling off the project site. Rock Road, approximately 3.7 miles east of Oro -Quincy Highway, at 1461 Bald Rock Road, identified as APN 062-230-102, Berry Creek. (SB) (UP98-01) (VIDEO) A video of the site was shown. Mr. Betts gave a brief summary of the project. Commissioner Mooney suggested Condition one be limited to dry periods or do an erosion control plan. The hearing was opened to the public. Mr. Sanderson said they agree with the conditions. Mr. McLafferty, owns the property west of the church, said he had no objections to this permit. The hearing was closed. It was moved by Commissioner Mooney, seconded by Commissioner Cage, and unanimously carried for approval as follows: FINDINGS: Section 1: Environmental Findings. A. An Initial Study was completed in compliance with the California. Environmental Quality Act identifying potentially significant environmental effects that the project may have. Provisions and the design of the project and the conditions added to the project will mitigate such effects to a level of insignificance; and B. The design of the proposed project improvements will not cause environmental damage to fish, wildlife, or their habitat; and C. The project site is located in Supervisorial District 1. RELATED ITEMS: None FOR: Planning Commission Meeting of November 13, 1997 SUMMARY: This application is for a Use Permit to allow a church as a quasi -public use. The proposed use requires a Use Permit in the U zone and is a Secondary Use in the Agricultural - Residential General Plan Land Use designation. Staff recommends approval with conditions and findings contained in this report. APPLICABLE BUTTE COUNTY REGULATIONS: This use permit application is submitted pursuant to Butte County Code Sections: 24-45 (Use Permits) which requires that an application be submitted and a public hearing be held by the Planning Commission. The Commission may grant a Use Permit when it finds that the proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health or general welfare of the persons residing or working in the neighborhood, or to the general health, safety and welfare of the residents of the county; and 24-230.C.5 (Unclassified Zone) which requires that a conditional Use Permit be obtained for quasi -public uses; and 24-240.B (Parking Regulations) which stipulates that churches provide one (1) space for each six (6) individual seats or equivalent in the church or one (1) space per fifty (50) sq. ft. of usable seating area, whichever is greater, plus one (1) space for each classroom or office. PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a church. The project parcel is 1.89 acres in size. The parcel is zoned U.(Unclassified). The Land Use ■ Butte County Department of Development Services ■ Planning Division ■ 0 • Element Map of the Butte County General Plan designates the project site as Agricultural - Residential. The church use is a quasi -public use, and the U Zoning Ordinance requires that a conditional Use Permit be obtained for quasi -public uses. The project site is developed with a single family dwelling unit and an attached garage. There are many pine trees, a few oak trees, and manzanita on the project site. The project site gently slopes down to Bald Rock Rd. Domestic water service for the project site is supplied by an on- site well. Sewage disposal is handled by an on-site septic tank and leachfield system. A 60 ft. road right-of-way easement, which is used by the residents of the parcel to the north of the project site, is located on the eastern portion of the project site. The church facilities are proposed to be built in four phases. Phase I will be a 1,440 sq. ft. structure that will be used as a church, and which will include a study and an office. Phase II will be a 1,467 sq. ft. addition to the structure built for Phase I. Phase III will be a 1,344 sq. ft. multi- purpose center. Phase IV will be a 400 sq. ft. storage shed. At the completion of Phase III, there will be 70 parking spaces on the project site. The existing dwelling unit will be used as a parish house or as a caretaker's house. PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION AND EXISTING LAND USE: Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. Northwest TM -3 Agricultural -Residential Rural Residential South: U Agricultural -Residential Undeveloped East: U Agricultural -Residential Berry Creek Grange Hall West: U Agricultural -Residential Rural Residential ANALYSIS: The proposed use will not cause a significant impact to the project area. The Berry Creek Community Church currently holds services in the Berry Creek Grange Hall on the adjacent parcel to the east of the project site. The Berry Creek Community Church currently has approximately 35 members. It is the church's intention to build the new church building, and as the congregation grows, add on to the first structure, with the multi-purpose structure to follow. It may be several years before the church membership grows large enough to require enlarging the first structure. The church use will cause visual and noise impacts to the residents living on the parcel to the west of the project site. The residents on that parcel currently have a nice view of the project site, seeing mostly trees. With the proposed use, many of the trees will be removed and three new structures will be erected. The church use will result in a degradation of the visual quality of the project site due to the removal of trees and the due to the construction of new buildings. ■ Butte County Department of Development Services ■ Planning Division ■ 2 The applicants have stated that they intend to save as many trees as possible. A mitigation of this project requires that any mature tree that is cut down must be replaced. The adjacent residents will also be subject to noise impacts from the proposed church. Vehicles arriving and departing the project site and in the parking lot will generate low levels of noise which will be heard on the adjacent parcel. Events held outside, such as church picnics or children playing, will also generate noise that will be heard by the adjacent residents. The peak hours of noise will occur from 9:00 a.m. to 1:00 p.m. on Sundays. According to the Butte County General Plan Noise Element, acceptable noise levels in a residential area are 50 to 70 dB CNEL. Acceptable noise levels for a church are also 50 to 70 dB CNEL. It is not expected that the church use will generate noise levels that exceed 70 dB CNEL. 70 dB is equal to the sound of a power mower at 100 ft. It is expected that the church use will generate a noise level of 55 to 60 dB. 60 dB equates to the sound an air conditioner makes at 50 feet. The impacts caused by the vehicle trips generated by the church are already present in the project area because the church use is already operating out of the Berry Creek Grange Hall on the adjacent parcel to the east of the project site. Based on the number of current members of the church, and if each person arrived in their own vehicle, approximately 70 vehicle trips (35 in, 35 out) are generated by the church use. Based upon estimates from the Institute of Transportation Engineers Trip Generation handbook (5th Ed.), a church the size of the proposed church will generate approximately 27 vehicle trips during a weekday, 28 vehicle trips on a Saturday, and 106 vehicle trips on a Sunday. These figures are for a church located in an urban setting, not a rural area, so it is anticipated that the actual vehicle trips will be less. Peak use of the proposed church will occur on Sundays, from 9:00 A.M. to 1:00 P.M. During this time period, short term traffic impacts may,occur on Bald Rock Road as vehicles enter and exit the project site. The site plan indicates that 70 parking spaces will be provided. This is approximately 10 more than is required by the parking requirements of the Zoning Ordinance for a church this size. A mitigation of this project will require that the access road and all parking areas be covered with at least 2" of Class 2 aggregrate material. The nearest fire station (#61) is located approximately 1 mile away. The Butte County Fire Department is requesting that the structures. comply with the latest California Fire Safe Regulations (Public Resource Code 4290) and all other applicable State and County Codes. They are also requesting that building identification and/or addresses be installed in conformance with PRC 4290 and that the structures meet the requirements of the Uniform Fire Code. The Fire Department is also requesting that prior to beginning Phase 3, a 2,500 gallon water storage tank for fire protection be installed on the project site. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level., Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. ■ Use Permit Standard Conditions - Butte County ■ 5 • 3'. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. 4. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. .L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue.
