Findings of Exemption (attach as necessary):
1. The county of Butte has conducted an initial study 'and prepared a (Negative
Declaration or Enviornmental Impact) so as to evaluate the potential of this project for adverse
environmental impact:
2. When considering the record as a whole, there is no evidence before the County
that the project will have potential for an adverse impact on wildlife resources or the habitat upon
which the wildlife depends.
3. The County of Butte has, on the basis of substantial evidence, rebutted the
presumption of adverse effect contained in Section 753.5 (d), of Title 14, California Code of
Regulations, if applicable.
4. The project is hereby found to be de minimis in its effect on wildlife and exempt
from the State Fish and Game filing fees required by Section 711.4 of the Fish and Game Code.
Certification:
I hereby certify that the County of Butte has made the above findings of fact and that
based upon the initial study and hearing record the project will not individually or cumulatively

Determination:
On the basis of the initial study of environmental impact, the information
presented at hearings, comments received on the proposal and our own knowledge
and independent research:
We find the proposed project COULD NOT have a significant effect on the
environment, and a NEGATIVE DECLARATION is hereby adopted.
_ We find that the project COULD have a significant effect on the
environment, but will not in this case because of attached mitigation
measures described in item 5 above, which are by this reference made
conditions of project approval. A conditional NEGATIVE DECLARATION is
hereby adopted.

Limit soil work to periods of dry weather between April 15 to
November 15. Mulch protect, Hydro -seed, or otherwise stabilize
the soil on all areas that have been disturbed or have been cleared
of vegetation and are of erodible material, or submit an Erosion
Control Plan, prepared by a Civil Engineer or other qualified
professional, using best management practices to the Department
of Public Works prior to issuance of building permits. (MM)
2. The access road and all parking areas shall be covered with at
least two (2) inches of Class 2 aggregate material and maintained
thereafter. (MM)
3. Watering of the project site shall be accomplished if dust is raised
during construction activities. Dust shall also be kept to a minimum
on the access road and the parking areas. (MM)
4. A plan of the existing on-site mature trees, located in any area
proposed for buildings and vehicular access, shall be provided to
and approved by the Planning Division prior to the issuance of
building permits and/or prior to grading or vegetation removal. The
applicant shall minimize the removal of,mature trees, where
possible. A mature tree shall be defined as a tree with a trunk
measuring 4 inches in diameter, 4 feet from ground level. Mature
trees removed shall be replaced by planting replacement trees of
equal number and not less than 5 gallon size. (MM)
5. Noise -generating construction activities on the project site shall
only occur between the hours of 7:30 a.m. to 5:00 p.m., Monday
through Saturday. (MM)
6. All outside lighting fixtures shall utilize "low spillover" design where
all direct lighting shall remain on-site, allowing only reflective
lighting to spillover into those areas off site. (MM)

At the regular meeting of the Butte County Planning Commission held November 13, 1997, your
request for a Use Permit to allow the expansion of an existing church , was approved subject to the
conditions listed on the enclosures. Please sign both copies and return both copies to this Division
within 40 calendar days.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you must
do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville,
California, prior to 5:00 p.m., Monday, November 24, 1997. The appeal deposit of $250.00 must
be paid at that time. If you do not appeal and if there are no other appeal within the 10 calendar -
day appeal period, the action of the Planning Commission is final.
A Notice of Determination (NOD) should be filed for purpose of completing the California
environmental quality Act requirements. The fee for filing the NOD is a $25.00 document handling
fee. A check made payable to the Butte County Treasurer in the amount of $25.00 should be
submitted to the Planning Division in order to complete the process.
Pease be aware that failure to return the signed copies within 40 calendar days will invalidate the
Planning Commission's approval. Re-application to this Division would then be necessary.
The Use Permit is deemed granted when the enclosures have been signed by the applicant, with
the counter signature of the Chairman of the Planning Commission, and said permit is received by
the applicant by registered mail.
Pursuant to Section 66020 (d) (2) of the Government Code you are hereby notified that you have
90 days to register a protest challenging any fees, dedications, reservations, or exactions Imposed
as conditions of approval for this project.

INITIAL STUDY
EVALUATION OF ENVIRONMENTAL IMPACTS
I. BACKGROUND:
1. Name of Proponent: Berry Creek Community Church (Stuart Sanderson)
2. Address: 173 Sandy Spring Lane, Berry Creek CA 95916 Phone: (916) 589-3062
3. Name of Proposal, if applicable:
4. Type of Project: Use Permit
Project Description and Location of Parcel: This project is for a quasi -public use to allow a church in an
Unclassified zone. The site is zoned U (Unclassified) and has a General Plan land use designation of
Agricultural Residential. The project site, which is 1.89 acres in size, has been developed with a single
family residence and attached garage. The site is vegetated with numerous pine trees, a few oaks, and
manzanita brush. The project site gently slopes downhill from east to west, with an average slope of 12%.
The site fronts on Bald Rock Road. The Berry Creek Community Church currently meets in the Berry
Creek Grange Hall which is located adjacent to the project site. The church currently has about 35
members. This project will result in four new structures being placed on the project site. The structures
will be built in 4 phases: Phase 1 will be a 1,440 sq. ft. church with a study and an office; Phase 2 will be
a 1,467 sq. ft. addition to the church; Phase 3 will be a 1,344 sq. ft. multi-purpose center; and Phase 4 will
be a 400 sq. ft. storage building. A graveled 70 -space parking area will be constructed, along with new
leachfields. Additional project description can be found at the end of this document.

II. DETERMINATION:
On the basis of this initial evaluation:

or replanted. Another mitigation will require that the parking spaces and the access road be graveled with
at least 2 inches of Class 2 aggregate material in order to reduce soil erosion. Therefore, significant
erosion impacts are not expected to occur.
The proposal will require some excavation or grading for driveways and level building sites. Any fill
placed on site will have to meet the requirements of Chapter 70 of the Uniform Building Code and will be
compacted to accepted engineering standards and will not represent a hazard. Therefore, the project will
not create any unstable earth conditions or result in changes to geologic substructures.
This proposal will result in some soil disruption, displacement, compaction and overcovering of the site
as a result of development of a road, structures, driveways, leachfields, and landscaping. Overcovering
will represent a minor percentage of the property. All grading associated with residential construction will
also be subject to the requirements of Chapter 70 of the Uniform Building Code. Based on this information
the project will not result in significant soil impacts.

Response: There are no surface water features on-site. No changes will occur in any water movements,
nor in quantities ofgroundwaters. Once all of the proposed structures are completed, approximately 9%
of the project site will be covered by structures, and approximately 80.16 covered by graveled parking
areas. Minimal. changes in absorption rates and drainage patterns may occur due to impervious
coverages from the new structures. The Department of Public Works is requiring a plan for a permanent
solution for drainage be submitted prior to issuance of a building permit. The plans will show how
drainage waters will be detained on site and(or conveyed to the nearest drainage channel. The plan will
provide that there be no increase in the peak flow runoff off the site. In addition, the two mitigations found

the church is already operating out of the Berry Creek Grange Hall, located on the adjacent parcel to the
east. Temporary air quality impacts may occur to residents in the project area as a result of construction
activities on the project site. The nearest dwelling unit is located approximately 75 feet west of the project
site. Another dwelling unit is located approximately 150 north of the project site and is located behind
extensive vegetation. The access road and parking areas will be graveled. Vehicles on the gravel may
put dust into the air. In order to reduce these impacts, a mitigation of this project will require that the
project site be watered down during construction, and that the gravel road and parking areas be
maintained so as not to put dust into the air.
Once construction of all the facilities are complete there will be an increase in vehicle traffic over time as
the church grows to meet the needs of the community. to an increase in the membership of the church,'
but no further impacts to air quality are expected. By having the church facilities in the community,
residents will not have to drive to Oroville for church services, thus reducing the amount of pollutants

Response: The impacts caused by the vehicle trips generated by the church is already present in the
project area because the church use is already operating out of the Berry Creek Grange Hall on the
adjacent parcel to the east of the project site. Based on the number of current members of the church,
and if each person arrived in their own vehicle, approximately 70 vehicle trips (35 in, 35 out) are
generated by the church use. Estimates from the Institute of Transportation Engineers Trip Generation
handbook (5th Ed.), for a church this size indicate that approximately 27 vehicle trips during a weekday,
28 vehicle trips on a Saturday, and 106 vehicle kips on a Sunday will be generated. These figures are
for a church located in an urban setting. Peak use of the proposed church will occur on Sundays, from
9 A.M. to 1 P.M. During this time period, short term traffic impacts may occur on Bald Rock Road as
vehicles enter and exit the project site. However, this coincides with off-peak usage of Bald Rock Road
and will therefore not result in any significant impacts.

Response: The project will result in an increase in noise created on the project site. Construction
activities will cause temporary, localized increases in existing noise levels which will have an impact on
the residents of adjacent parcels. In order to reduce construction -related noise to a less than significant
level, a mitigation of this project will allow noise-generaling construction activities on the project site to only
occur from 8.00 a.m. to 5:00 p.m., Monday through Friday. This will ensure that noise -producing
construction activities only occur during normal working hours.

Response: As discussed in Section /V of this document, this project will not significantly degrade the
quality of the environment.. This project will not have any significant cumulative impacts on the
environment. Those potential impacts -- erosion control, loss of pine trees, dust, noise, and outside
lighting -- have been identified in this document and will not have any significant adverse effects on
human beings with incorporation of the recommended mitigation measures.
V. MITIGATION MEASURES AND MONITORING REQUIREMENTS:
Limit soil work to periods of dry weather between April 15 to November 15. Mulch protect, Hydro -
seed, or otherwise stabilize the soil on all areas that have been disturbed or have been cleared
of vegetation and are of erodible material.
2. The access road and all parking areas shall be covered with at least two (2) inches of Class 2
aggregate material and maintained thereafter.
3. Watering of the project site shall be accomplished if dust is raised during construction activities.
Dust shall also be kept to a minimum on the access road and the parking areas.
4. A plan of the existing on-site mature trees, located in any area proposed for buildings and
vehicular access, shall be provided to and approved by the Planning Division prior to the issuance
of building permits and/or prior to grading or vegetation removal. The applicant shall minimize
the removal of mature trees, where possible. A mature tree shall be defined as a tree with a
trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be
replaced by planting replacement trees of equal number and not less than 5 gallon size.
5. Noisegeneratng construction activities on the project site shall only occur between the hours of
7:30 a.m. to 5:00 p.m., Monday through Saturday.
6. All outside lighting fixtures shall utilize "low spillover" design where all direct lighting shall remain
on site, allowing only reflective lighting to spillover into those areas off site.

Berry Creek Community Church - proposed Negative Declaration with mitigation
measures regarding environmental impacts and Use Permit to allow a church on
property zoned "U" (Unclassified) located on the north side of Bald. Rock Road,
approximately 3.7 miles east of Oro -Quincy Highway, at 1461 Bald Rock Road,
identified as APN 062-230-102, Berry Creek. (SB) (UP98-01) (VIDEO)
A video of the site was shown. Mr. Betts gave a brief summary of the project.
Commissioner Mooney suggested Condition one be limited to dry periods or do an
erosion control plan.
The hearing was opened to the public.
Mr. Sanderson said they agree with the conditions.
Mr. McLafferty, owns the property west of the church, said he had no objections to this
permit.
The hearing was closed.
It was moved by Commissioner Mooney, seconded by Commissioner Cage, and
unanimously carried for approval as follows:
FINDINGS:
Section 1: Environmental Findings.
A. An Initial Study was completed in compliance with the California.
Environmental Quality Act identifying potentially significant environmental
effects that the project may have. Provisions and the design of the project
and the conditions added to the project will mitigate such effects to a level
of insignificance; and
B. The design of the proposed project improvements will not cause
environmental damage to fish, wildlife, or their habitat; and
C. The Planning Commission has independently reviewed, analyzed and
considered the proposed Negative Declaration with mitigation measures
prior to making its decision on the project, and the Negative Declaration
reflects the independent judgement of the County of Butte; and
Section 2: Zoning Ordinance Findings.
A. The proposed use will not impair the integrity and character of the zone in
which the land lies, and that the use would not be unreasonably
incompatible with, or injurious to, surrounding property, or be detrimental
to the health and general welfare of the persons residing or working in the

neighborhood, or to the general health, safety, and welfare of -the
residents of the County because:
1 1. The proposed use is already operating out of the, Berry Creek
Grange Hall on the adjacent parcel and the impacts as
with the church use already exist in the project area; and
2. The operating hours of the proposed church are compatible with
residential uses; and
3. Noise levels generated by the proposed church are not expected to
exceed acceptable noise levels for residential areas; and
4. Conditions have been proposed that will reduce visual, erosion,
and dust impacts to a less than significant level; -and
B. The proposed use is conditionally consistent with the U Zone; and
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move
to approve the Use Permit for the Berry Creek Community Church on
APN 062-230-102 to allow a church. Approval shall be subject to the
following conditions:

approved project site plan and the conditions contained herein.
Said site plan is on file in the Planning Division, is identified as
"Exhibit B" and dated June 6, 1997 and is incorporated herein by
this reference.
8. Trash receptacle areas shall be screened from public view.
9. All electrical and mechanical equipment, including, but not limited
to, air conditioning units, electrical boxes, transformers, and
backflow preventers, shall be screened from public view.
Screening shall be to the satisfaction of the Planning Division and
in compliance with the Building Division.
10. Construction, installation or development of structures or facilities
on the parcels/lots shall comply with the latest California Fire Safe
Regulations, (Public Resources Code 4290), and all other
applicable State and County codes, ordinances and regulations,in
effect at the time of application for improvement permits.
11. Building identification and/or addresses shall be installed in
conformance with Public Resources Code 4290 and shall be
posted at the beginning of building construction and maintained
continuously thereafter.
12. Prior to issuance of building permits for Phase III, install a 2,500
gallon water storage tank for fire protection. Contact the California
Department of Forestry/Butte County Fire Department for location
and Fire Department connection requirements.

permit for all new or existing driveway approaches and construct

fee simple, 30 feet of right-of-way from the centerline of Bald Rock

15. Prior to the recordation of the issuance of building permits a plan
for a permanent solution for drainage -shall be submitted to and
approved by the -Department of Public Works. The drainage plans
shall specify how drainage waters shall be detained on-site and/or
conveyed to the nearest natural or publicly maintained drainage .
channel or facility and shall provide that there shall be no increase
in the peak flow runoff to said channel or facility.

REQUEST: Use Permit 98-01 for the Berry Creek Communitv Church, File # UP 98-
01: A Use Permit request to allow a church in a U (Unclassified) zone,
identified as APN 062-230-102, located on the north side of Bald Rock Rd.,
approximately 3.7 miles east of Oro -Quincy Highway, at 1461 Bald Rock
Road, Berry Creek. The project site is located in Supervisorial District 1.

SUMMARY: This application is for a Use Permit to allow a church as a quasi -public use. The
proposed use requires a Use Permit in the U zone and is a Secondary Use in the Agricultural -
Residential General Plan Land Use designation. Staff recommends approval with conditions
and findings contained in this report.
APPLICABLE BUTTE COUNTY REGULATIONS: This use permit application is submitted
pursuant to Butte County Code Sections:
24-45 (Use Permits) which requires that an application be submitted and a public hearing be
held by the Planning Commission. The Commission may grant a Use Permit when it finds that
the proposed use of the property will not impair the integrity and character of the zone in which
the land lies, and that the use would not be unreasonably incompatible with, or injurious to,
surrounding properties, or detrimental to the health or general welfare of the persons residing
or working in the neighborhood, or to the general health, safety and welfare of the residents of
the county; and
24-230.C.5 (Unclassified Zone) which requires that a conditional Use Permit be obtained for
quasi -public uses; and
24-240.B (Parking Regulations) which stipulates that churches provide one (1) space for each
six (6) individual seats or equivalent in the church or one (1) space per fifty (50) sq. ft. of usable
seating area, whichever is greater, plus one (1) space for each classroom or office.
PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a church. The
project parcel is 1.89 acres in size. The parcel is zoned U.(Unclassified). The Land Use

Element Map of the Butte County General Plan designates the project site as Agricultural -
Residential. The church use is a quasi -public use, and the U Zoning Ordinance requires that
a conditional Use Permit be obtained for quasi -public uses.
The project site is developed with a single family dwelling unit and an attached garage. There
are many pine trees, a few oak trees, and manzanita on the project site. The project site gently
slopes down to Bald Rock Rd. Domestic water service for the project site is supplied by an on-
site well. Sewage disposal is handled by an on-site septic tank and leachfield system. A 60 ft.
road right-of-way easement, which is used by the residents of the parcel to the north of the
project site, is located on the eastern portion of the project site.
The church facilities are proposed to be built in four phases. Phase I will be a 1,440 sq. ft.
structure that will be used as a church, and which will include a study and an office. Phase II will
be a 1,467 sq. ft. addition to the structure built for Phase I. Phase III will be a 1,344 sq. ft. multi-
purpose center. Phase IV will be a 400 sq. ft. storage shed. At the completion of Phase III,
there will be 70 parking spaces on the project site. The existing dwelling unit will be used as a
parish house or as a caretaker's house.

ANALYSIS: The proposed use will not cause a significant impact to the project area. The Berry
Creek Community Church currently holds services in the Berry Creek Grange Hall on the
adjacent parcel to the east of the project site. The Berry Creek Community Church currently has
approximately 35 members. It is the church's intention to build the new church building, and as
the congregation grows, add on to the first structure, with the multi-purpose structure to follow.
It may be several years before the church membership grows large enough to require enlarging
the first structure.
The church use will cause visual and noise impacts to the residents living on the parcel to the
west of the project site. The residents on that parcel currently have a nice view of the project
site, seeing mostly trees. With the proposed use, many of the trees will be removed and three
new structures will be erected. The church use will result in a degradation of the visual quality
of the project site due to the removal of trees and the due to the construction of new buildings.

The applicants have stated that they intend to save as many trees as possible. A mitigation of
this project requires that any mature tree that is cut down must be replaced.
The adjacent residents will also be subject to noise impacts from the proposed church. Vehicles
arriving and departing the project site and in the parking lot will generate low levels of noise
which will be heard on the adjacent parcel. Events held outside, such as church picnics or
children playing, will also generate noise that will be heard by the adjacent residents. The peak
hours of noise will occur from 9:00 a.m. to 1:00 p.m. on Sundays.
According to the Butte County General Plan Noise Element, acceptable noise levels in a
residential area are 50 to 70 dB CNEL. Acceptable noise levels for a church are also 50 to 70
dB CNEL. It is not expected that the church use will generate noise levels that exceed 70 dB
CNEL. 70 dB is equal to the sound of a power mower at 100 ft. It is expected that the church
use will generate a noise level of 55 to 60 dB. 60 dB equates to the sound an air conditioner
makes at 50 feet.
The impacts caused by the vehicle trips generated by the church are already present in the
project area because the church use is already operating out of the Berry Creek Grange Hall on
the adjacent parcel to the east of the project site. Based on the number of current members
of the church, and if each person arrived in their own vehicle, approximately 70 vehicle trips (35
in, 35 out) are generated by the church use. Based upon estimates from the Institute of
Transportation Engineers Trip Generation handbook (5th Ed.), a church the size of the proposed
church will generate approximately 27 vehicle trips during a weekday, 28 vehicle trips on a
Saturday, and 106 vehicle trips on a Sunday. These figures are for a church located in an urban
setting, not a rural area, so it is anticipated that the actual vehicle trips will be less. Peak use
of the proposed church will occur on Sundays, from 9:00 A.M. to 1:00 P.M. During this time
period, short term traffic impacts may,occur on Bald Rock Road as vehicles enter and exit the
project site.
The site plan indicates that 70 parking spaces will be provided. This is approximately 10 more
than is required by the parking requirements of the Zoning Ordinance for a church this size. A
mitigation of this project will require that the access road and all parking areas be covered with
at least 2" of Class 2 aggregrate material.
The nearest fire station (#61) is located approximately 1 mile away. The Butte County Fire
Department is requesting that the structures. comply with the latest California Fire Safe
Regulations (Public Resource Code 4290) and all other applicable State and County Codes.
They are also requesting that building identification and/or addresses be installed in
conformance with PRC 4290 and that the structures meet the requirements of the Uniform Fire
Code. The Fire Department is also requesting that prior to beginning Phase 3, a 2,500 gallon
water storage tank for fire protection be installed on the project site. This has been added as
a condition of project approval.

The Butte County Environmental Health Division has stated that there is ample room for at least
one new septic system and did not recommend any conditions. Any new septic systems or wells
will be required to meet the requirements of the Environmental Health Division.
The Butte County Department of Public Works is requesting that encroachment permits be
obtained for all new or existing driveway approaches and construct them to County standards.
They are also requesting the applicants deed to Butte County 30 feet of right-of-way from the
centerline of Bald Rock Road. The Department of Public Works is also requesting that a plan
for a permanent solution for drainage be submitted and approved. These three requests have
been added as conditions of project approval.
ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under
the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of
CEQA. An Initial Study has been prepared by County staff. Based upon a review of the Initial
Study, staff has determined that the project impacts can be fully mitigated with the addition of
mitigation measures added as conditions of approval for the project.
PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be
advertised and held. Advertisement of the public hearing was published in a local newspaper
and were mailed to all property owners within a 300 -foot radius of the subject property.
RECOMMENDATION: Staff is recommending that a Use Permit be granted for the Berry Creek
Community Church on APN 062-230-102 subject .to the findings and conditions contained in
exhibit 'A," attached. This recommendation is based on the project's ability to meet the.
requirements of the Zoning Ordinance. If the Commission cannot make the required findings
to approve the project, the appropriate action would be to make a motion of intent to deny and
provide Staff direction to make the necessary findings.

1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said permit in
accordance with the procedures set forth in the Butte County Zoning Ordinance, including
Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a special condition to this use permit, all conditions must
be completed prior to or concurrently with the establishment of the granted use. The use
granted by this permit must be established within 24 months of the delivery of the
countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated written
request by the applicant, or their respective designee, Prior to such approval, verification
shall be made by each Department or Division that the modification is consistent with the
application, fees paid and environmental determination as conditionally approved.
Changes deemed to be major or significant in nature shall require a formal application for
amendment.
4: If any use for which a use permit has been granted is not established within two years of
the date of receipt of the countersigned permit by the Permittee, the permit shall become
null and void and reapplication and a new permit shall be required to establish the use.
5. The terms and conditions of this permit shall run with the land and shall be binding upon
and be to the benefit of the heirs, legal representatives, successors, and assigns of the
Permittee.

FINDINGS:
Section 1: Environmental Findings.
A. An Initial Study was completed in compliance with the California Environmental
Quality Act identifying potentially significant environmental effects that the project
may have. Provisions and the design of the project and the conditions added to
the project will mitigate such effects to a level of insignificance; and
B. The design of the proposed project improvements will not cause environmental
damage to fish, wildlife, or their habitat; and
C. The Planning Commission has independently reviewed, analyzed and considered
the proposed Negative Declaration with mitigation measures prior to making its
decision on the project, and the Negative Declaration reflects the independent
judgement of the County of Butte; and
Section 2: Zoning Ordinance Findings.
A. The proposed use will not impair the integrity and character of the zone in which
the land lies, and that the use would not be unreasonably incompatible with, or
injurious to, surrounding property, or be detrimental to the health and general
welfare of the persons residing or working in the neighborhood, or to the general
health, safety, and welfare of the residents of the County because:
The proposed use is already operating out of the Berry Creek Grange Hall
on the adjacent parcel and the impacts associated with the church use
already exist in the project area; and
2. The operating hours of the proposed church are compatible with residential
uses; and
3. Noise levels generated by the proposed church are not expected to exceed
acceptable noise levels for residential areas; and
4. Conditions have been proposed that will reduce visual, erosion, and dust
impacts to a less than significant level; and
B. The proposed use is conditionally consistent with the U Zone; and
Section 3: Action.

A. Subject to the findings indicated in Sections 1 and 2 of this report, move to
approve the Use Permit for the Berry Creek Community Church on APN 062-230-
102 to allow a church. Approval shall be subject to the following conditions:

Limit soil work to periods of dry weather between April 15 to November 15.
Mulch protect, Hydro -seed, or otherwise stabilize the soil on all areas that
have been disturbed or have been cleared of vegetation and are of erodible

2. The access road and all parking areas shall be covered with at least two (2)
inches of Class 2 aggregate material and maintained thereafter. (MM)
3. Watering of the project site shall be accomplished if dust is raised during
construction activities. Dust shall also be kept to a minimum on the access
road and the parking areas. (MM)
4. A plan of the existing on-site mature trees, located in any area proposed for
buildings and vehicular access, shall be provided to and approved by the
Planning Division prior to the issuance of building permits and/or prior to
grading or vegetation removal. The applicant shall minimize the removal
of mature trees, where possible. A mature tree shall be defined as a tree
with a trunk measuring 4 inches in diameter, 4 feet from ground level.
Mature trees removed shall be replaced by planting replacement trees of
equal number and not less than 5 gallon size. (MM)
5. Noise -generating construction activities on the project site shall only occur
between the hours of 7:30 a.m. to 5:00 p.m., Monday through .Saturday.

6. All outside lighting fixtures shall utilize "low spillover" design where all direct
lighting shall remain on-site, allowing only reflective lighting to spillover into
those areas off site. (MM)
7. The project site shall be developed in accordance with the approved project
site plan and the conditions contained herein. Said site plan is on file in the
Planning Division, is identified as "Exhibit B" and dated June 6, 1997 and
is incorporated herein by this reference.
8. Trash receptacle areas shall be screened from public view.
9. All electrical and mechanical equipment, including, but not limited to, air
conditioning units, electrical boxes, transformers, and backflow preventers,

10. Construction, installation or development of structures or facilities on the

codes, ordinances and regulations in effect at the time of application for
improvement permits.
11. Building identification and/or addresses shall be installed in conformance
with Public Resources Code 4290 and shall be posted at the beginning of
building construction and maintained.continuously thereafter.
12. Prior to issuance of building permits for Phase III, install a 2,500 gallon
water storage tank for fire protection. Contact the California Department of
Forestry/Butte County Fire Department for location and Fire Department
connection requirements.
13. Prior to the issuance of building permits obtain encroachment permit for all

drainage waters shall be detained on-site and/or conveyed to the nearest
natural or publicly maintained drainage channel or facility and shall provide
that there shall be no increase in the peak flow runoff to said channel or
facility.

B. DRAINAGE
1. Prior to the recordation of the issuance of building permits a plan for a permanent solution
for drainage shall be submitted to and approved by the Department of Public Works. The
drainage plans shall specify how drainage waters shall be detained on site and or
conveyed to the nearest natural or publicly maintained drainage channel or facility and
shall provide that there shall be no increase in the peak flow runoff to said channel or
facility.
_ 2. Prior to the issuance of building permits establish 100 year floodplain elevations and the
lowest floor elevations for any structures. Show on the site plan map for building permits
the elevations (by contours) and the location of an accepted NVGD benchmark and a
temporary benchmark on-site.

PLEASE CONTACT THE BUTTE COUNTY FIRE DEPARTMENT FOR COMPLIANCE WITH THE
FOLLOWING CHECKED CONDITIONS
1. Construction, installation or development of structures or facilities on the parcels/lots shall
comply with the latest California Fire Safe Regulations, (Public Resources Code 4290),
and all other applicable State and County codes, ordinances and regulations in effect at
the time of application for improvement permits.
Y2. Building identification and/or addresses shall be installed in conformance with Public
Resources Code 4290 and shall be posted at the beginning of building construction and
maintained continuously thereafter.
3. Fire hydrant identification, reflector or post reflectors shall be installed acceptable to the
County Fire Warden.
4. In lieu of a pressurized water system or water storage tank, payment of $200.00 per
created parcel into the Battalion _ water tend fund, is required prior to the issuance of a
building permit.
5. A pressurized community water system for fire protection is required. The specific
locations and fire flow requirements shall be in accordance with the Fire Department
specifications and to the satisfaction of the County Fire Warden. Average required hydrant
spacing _ feet, hydrant size _ inches, and residual fire flow _ gpm. Submit plans to
the Fire Department for review and approval prior to construction of facilities.
6. In lieu of hydrant installation, payment may be made into the hydrant fund at a cost
of $1.72 per lineal foot of street frontage. The estimated fee amount is $

H. BUILDING PERMITS
1. Prior to building permit issuance for a new residential dwelling unit(s), the applicant shall
pay all applicable development fees at the rate in effect at the time of acceptance of the
application. Such fees, shall include, but not be limited to: Park Fee, School Fee,
Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire
Protection Fees.
2. Prior to building permit issuance for a new commercial or industrial development, or
addition to an existing development, the applicant shall pay all applicable development
fees at the rate in effect at the time of acceptance of the application. Such fees shall
include, but not be limited.to: School Fee, Drainage Fee, Permit and Plan Checking Fees,
Water and Sewer Service Fees, and Fire Protection Fees.
I. EXISTING STRUCTURES
1. Comply with the Uniform Building Code for property line clearances considering use, area
and fire -resistiveness of existing buildings.
2. Existing building(s) shall be made to comply with current Building and Zoning regulations

J. SITE DEVELOPMENT
1. The project site shall be developed in accordance with the approved project site plan and
the conditions contained herein. Said site plan is on file in the Planning Division, is
identified as "Exhibit B" and dated _, 19_ and is incorporated herein by this
reference.
2. Prior to the issuance of building permits, the plans, incorporating all applicable conditions
of approval shall be submitted to the Planning Division to verify compliance with said
conditions of approval.
3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view
obstructing gates and a solid or semi -open shade cover. Plans to be reviewed and
approved by the Planning Division prior to construction.
4. Prior to any use of the project site or business activity being commenced thereon, pursuant
to this permit, conditions of approval contained herein shall be completed
to the satisfaction of the Planning Division.
5. All electrical and mechanical equipment, including but not limited to air conditioning units,
electrical boxes, transformers, and backflow preventers, shall be screened from public
view. Screening shall be to the satisfaction of the Planning Division and in compliance with
the Building Division.
K. LANDSCAPING
1. A detailed landscape and irrigation plan consistent with the project site plan shall be
submitted to and approved by the Planning Division prior to the issuance of building
permits.
2. A plan of the existing on-site mature trees, located in any area proposed for buildings and
vehicular access, shall be provided to and approved by the Planning Division prior to the
issuance of building permits and/or prior to grading or vegetation removal. The applicant
shall minimize the removal of mature trees, where possible. A mature tree shall be
defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level.,
Mature trees removed shall be replaced by planting replacement trees of equal number
and not less than _ gallon size.

3'. All landscaped areas shall be maintained in a healthy and thriving condition, free from
weeds, trash, and debris, during the term of this permit.
4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded,
planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent
irrigation system shall be installed for non-native vegetation. A one year Faithful
Performance bond shall be posted to guarantee installation and established growth.
5. In parking lots of commercial and industrial development, trees of not less than 15 gallon
size shall be provided to reduce heat gain from the paved surface and to soften the visual
impact of the paved area. Such trees shall be planted at a minimum density of one tree
every three parking spaces. Tree species shall be approved by the Planning Division prior
to planting.
6. Prior to the commencement of grading and/or construction activity, all individual or groups
of oak trees which are to be retained as part of the project, shall be fully protected through
the use of root protection zones (RPZ). During construction, RPZs shall be established
using protective fencing enclosing an area with a radius 1.5 times the distance from the
trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation
alteration of any kind shall be allowed. The RPZs shall be maintained after the completion
of construction in order to continue to protect the oak trees, but the fencing shall be
removed.
.L. GRADING
1. During construction, should any archaeological artifacts be discovered, the Planning
Division shall be notified immediately, and all work shall cease until a qualified
archaeologist has examined the artifacts and the site and submitted his or her findings to
the Planning Division, and recommended clearance to continue. Recommencement of
construction shall be upon the approval of the Planning Division. Archaeological artifacts
are defined as follows:
2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year
floodplain and/or streambed the following entitlements must be obtained: a California Fish
and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption
certificate.
M. ADDITIONAL APPROVALS
1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic
Impact Fees shall be made.
2. Prior to the issuance of a building permit for each new or additional living unit the applicant
shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established
fee.
_ 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the
orchard or other agricultural use of the property, the property owner shall enter into the
County approved Orchard Management Agreement. The agreement shall terminate
in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160.
The agreement shall be recorded and recording fees paid by the applicant.
4. Approval of this request shall not waive compliance with all sections of the Zoning

Ordinance and all other applicable State and County laws and regulations in effect at the
time of building permit application.
5. This Conditional Use Permit is granted for a period of month(s) at the end of which
time it shall expire (unless the approving authority has held a hearing thereon and granted
an extension. In connection with such an extension the approving authority may add,
change, or delete conditions.
6. Approval of this Conditional Use Permit shall become null and void if the use for which it
has been granted is not established within two calendar year from the date of approval. No
formal cancellation or revocation action by the County will be necessary.
7. The developer shall display a current County Zoning and County Land Use Map in the
sales office at all times, and/or suitable alternatives.
8. Approval of this application does not become effective unless, prior to 4:00 p.m. on
_, 199_, the applicant shall sign and file with the Department of
Development Services an Indemnity Agreement in a form satisfactory to the County
Counsel.
9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a
Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the
provisions of Chapter 3, Article II of the Butte County Code. The fee amount shall be
determined and calculated as of the date of application for building permit.
10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and
record the CSA 87 Traffic and Drainage Mitigation Agreement or pay the required fees
prior to the issuance of the Use Permit.
11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax
Collector's Office to begin the process of a Transient Occupancy Registration Certificate.
A Transient Occupancy Registration Certificate shall be required within ten (10) days after
commencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming
house, apartment house, mobile home park, recreational vehicle park, campground, or
parking area (See Chapter 23A).
12. Prior to the issuance of the Use Permit, the applicant shall pay all outstanding County fees.
