(SH) *(UP98-06) (VIDEO) A video of the site was shown. Mr. Sanders gave a brief summary of the project. The hearing was opened to the public. Mr. Jeffers said the new sign will be a Texaco approved and standard sign. He said they can take the existing sign down if the permit is so conditioned. The hearing was closed. Mr. Sanders asked if the applicant understood all the conditions. He said Condition 1 .limits the sign to 40 sq. ft., not the proposed 52 sq. ft. This limitation is so the sign meets the City of Chico requirements, as the property is in the Sphere of Influence. Mr. Jeffers said that could be a problem. The Commission discussed the limitation and supported meeting the City requirements. It was moved by Commissioner Nelson, seconded by Commissioner Mooney, and unanimously carried for approval as follows: It was moved by Commissioner Leland, seconded by Commissioner Mooney, and unanimously carried to change Condition 1 from 40 sq. ft. to 52 sq. ft. Commissioner Leland rescinded his motion. Commissioner Mooney rescinded his second. The motion.carried as originally stated., Section 1: Environmental Findings. A. Find that the project is exempt from environmental review as allowed under Section 15303, Class 3, CEQA Guidelines for a Categorical Exemption; and B. Subject to the findings indicated in Sections 1 and 2 of this Permit a Categorical Exemption is hereby adopted and the Use Permit approved for Finis Jeffers on APN 006-400-020 to allow a gasoline sign inside the 55 foot setback on the east side of the Esplanade on property zoned C-2 located at 3990 Esplanade, Chico. B. Minor changes may be approved administratively by the Directors of Environmental Health, Development Services or Public Works, or their designee, upon receipt of a substantiated written request by the applicant and only as to those conditions or requirements recommended by their respective departments. Prior to such approval, verification shall be' -made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. C. Conditions of Approval: Sign shall not exceed 40 square feet in size and .must be located at least 50 ft. from the centerline of the Esplanade. 2. The permit may be revoked or modified by the Planning Commission whenever the Commission determines that removal, relocation or modification of the encroachment is necessary to maintain adequate traffic safety as a result of any changed condition or of any public right-of- way acquisition or improvement project. 3. Any removal, relocation or modification required pursuant to paragraph (2) above shall be accomplished without loss or cost to the County of Butte within thirty (30) days of notice of the decision of the Planning Commission. 4. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 0 BUTTE COUNTY PLANNING COMMISSION MINUTES - NOVEMBER 13, 1997 0 AGENDA REPORT TO: Honorable Chair and Planning Commission BY: Development Services Department - Planning Division DATE: October 15, 1997 REQUEST: Use Permit on APN 066-400-020 for Finis Jeffers, File #98-06: Request to allow the installation of a gasoline price sign inside the 55' set -back from the centerline of the Esplanade, on a 0.68 acre parcel zoned C-2 (General Commercial), at the terminus of the Esplanade at SR 99, in the Chico area. The project is located in Supervisorial District 2. FOR: Planning Commission Meeting of November 13, 1997 SUMMARY: The request is consistent with the C-2 zone, the General Plan Land. Use designation of Commercial, and the Butte County Code, Sections 10-7(a) and 10-10. Staff recommends approval with conditions and findings contained in this report. APPLICABLE BUTTE COUNTY REGULATIONS: This use permit application is submitted pursuant to Butte County code Sections: 24-45 (Use Permits) which requires that an application be submitted and a public hearing be held by the Planning Commission. The Commission may grant a use permit when it finds that the proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health or general welfare of the persons residing or working in the neighborhood or to the general health, safety and welfare of the residents of the county; and 10-10 (Use permits, mandatory conditions) which indicates that placement of the sign in. a setback requires a use permit. Such a use permit grants conditional permission to place a commercial sign within the setback. 10-7 (Established) indicates the setback line upon and along federal and secondary routes in the county shall be distant fifty-five feet from and on both sides of the established centerline of each such route. PROJECT CHARACTERISTICS: The project site consists of 0.68 acres, zoned C-2 with a General Plan Land Use Element designation of Commercial. There is a mini -mart gas station on the property. The site has had this commercial use for a number of years. The project site is located on the east side of the Esplanade, at the northern terminus. of the Esplanade at SR 99, in the north Chico area. The surrounding parcels have zoning ❑ Butte County Department of Development Services - Planning Division ❑ 1 classifications of C-2, M-1, and A-20. There are other commercial businesses nearby, consisting of mobile home sales, auto services, and outdoor supply products. ANALYSIS: The applicant's request is to place a gasoline price sign five (5) feet in the 55 foot setback. Butte County Code, Chapter 10, Highways and Streets, allows conditional permission for the placement of such a sign within the setback (Section 10-10). The setback distance is established at 55 feet in the same chapter (Section 10-7). The applicant must keep the sign out of the public right-of-way which is 40 feet from center line of the Esplanade. The proposed sign will be constructed 50 feet from center line of the Esplanade. The applicant's request for the placement and location of the sign was instigated by the requirements of the State of California's Sealer of Weights & Measures. In response to reported incidences of price gouging at some service stations during the gas shortages of the early 1970s, the state passed requirements which included gas price signs be posted near gas pump stations. The placement of these signs was required to be visible from the normal traffic pattern. The project site is located in the City of Chico's Sphere of Influence. The County tries to comply with the city's sign ordinance on such projects so that when the city eventually annexes the area, such issues as signage are already in compliance with the city code. . Staff has identified no concerns or issues with the request. There is good line -of -sight distance in both directions along the Esplanade approaching the entrance to the mini -mart. Placement of the sign at the proposed location will meet the Sealer of Weights & Measures' requirements. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be exempt from the California Environmental Quality Act (CEQA) as it is classified as Categorically Exempt (Class 3(a)), and as such, is not subject to the requirements of CEQA. This Section allows for an exemption to CEQA requirements when the project "consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures .. ..." RECOMMENDATION: Staff recommends that the Planning Commission approve the application for Finis Jeffers on APN 006-400-020, subject to the following findings and conditions in the attached Exhibit "A." Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Finis Jeffers is hereby granted a Use Permit in accordance with application filed: September 9, 1997 to allow a gasoline price sign to be placed -5 feet inside the 55 foot set -back on the Esplanade, on property zoned C-2 located at 3990 Esplanade, Chico. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed by the Permittee within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
