Subject: Conditional Use Permit
Dear Mr. Parilo:
Enclosed please find a completed Butte County Uniform Application for a Conditional Use
Permit. This application is made on behalf of Smart SMR of California (d.b.a. NEXTEL
Communications) for a portion of APN 036-270-038 located on the east side of Kusel Road
approximately 'A mile south of Ophir Road. The proposed project is for the development of
an unmanned wireless telecommunication transceiving facility including a 106' high lattice
tower (120" overall) and prefabricated equipment shelter. This is one of eight sites NEXTEL
proposes within the County's jurisdiction.
As mentioned in a previous application, development of this site will permit Smart SMR of
California to offer customers more choices in high quality, reliable and affordable
telecommunications products and services.
Smart SMR of California (d.b.a. NEXTEL Communications) has been authorized by the
Federal Communications Commission (FCC) to construct and operate the first multi purpose
digital mobile network in the United States. This system provides superior service to the
public in several ways: 1) It is a fully digital alternative to current "cellular" telephone systems;
2) it provides digital two-way dispatch services to large fleet users (this dispatch service allows
one dispatcher to contact one or numerous mobile parties simultaneously); 3) it provides
numeric paging services; and 4) it provides wireless data transmission. All of these functions
are available in a single hand held unit and are offered to the general public as well as police,
fire, ambulance and other public safety agencies.
This site is proposed as a result of the combined efforts of radio engineering, site acquisition
and land planning to find a site suitable to all parties. We believe that this location, within an
M-2 zoning district, is appropriate and suitable for the requested Conditional Use.

PLEASE CONTACT THE PUBLIC WORKS DEPARTMENT FOR COMPLIANCE WITH THE FOLLOWING CHECKED CONDITIONS
A. STREETS
1. Prior to the issuance of building permits obtain encroachment permit for all new or existing
driveway approaches and construct them to County standards, as specified in County
Improvement Standards.
2. Prior to the issuance of building permits deed to Butte County, in fee simple, _ feet of right-
of-way from the centerline of The right of
way shall be sufficient for the installation of standard No. S-5 at all street intersections.
3. Prior to the issuance of building permits submit road and drainage improvement plans for the
installation and construction of the street frontage improvements on
to standard, including but not limited to P.C.C. curb,
gutter and sidewalk and the required street section for parcels with gross acreage of one acre
or less. Construct or install the required improvements.
4. Prior to the issuance of building permits dedicate a one foot "no access strip" or relinquish
abutters rights to Butte County, along the frontage of parcels
except at approved access points.
B. DRAINAGE
X 1. Prior to the recordation of the issuance of building permits a plan for a permanent solution for
drainage shall be submitted to and approved by the Department of Public Works. The
drainage plans shall specify how drainage waters shall be detained on site and or conveyed
to the nearest natural or publicly maintained drainage channel or facility and shall provide that
there shall be no increase in the peak flow runoff to said channel or facility.
2. Prior to the issuance of building permits establish 100 year floodplain elevations and the
lowest floor elevations for any structures. Show on the site plan map for building permits the
elevations (by contours) and the location of an accepted NVGD benchmark and a temporary
benchmark on-site.
C. LEGAL LOT STATUS
1. Prior to the issuance of the Use Permit, prove, to the satisfaction of the Director of Public

1. Construction, installation or development of structures or facilities on the parcels/lots shall
comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and
all other applicable State and County codes, ordinances and regulations in effect at the time
of application for. improvement permits.
2. Building identification and/or addresses shall be installed in conformance with Public
Resources Code 4290 and shall be posted at the beginning of building construction and
maintained continuously thereafter.
3. Fire hydrant identification,. reflector or post reflectors shall be installed acceptable to the
County Fire Warden.
4. In lieu of a pressurized water system or water storage tank, payment of $200.00 per created

Dear Mr. Michelena:
Sprint/Nextel, formerly Smart SMR of California, Inc. d/b/a Nextel Communications, obtained approval on
December 22"d, 1997 to construct a wireless telecommunication facility at 1855 Kusel Road, Oroville, CA — APN:
036-270-038, pursuant to Use Permit No. UP -98-08. (See attached Use Permit). The facility consisted of a 10'
wide x 20' long equipment shelter and a three -sector antenna array, consisting of (3) 14' tall omni whip antennas,
installed at the top of a new 106' tall lattice tower. The permit allowed Sprint/Nextel to change out the initial (3)
omni whip antennas for (12) 4' tall panel antennas at the top of the tower at a future date. (please see attached
elevation drawing). Currently the (3) omni whip antennas are on the tower.
Due to changes in technology, usage and coverage demands, the permitted three (3) 14' tall omni whip antennas
have to be replaced with a newer antenna model. The new antenna array will consist of (12) 96" tall panels
installed at the top of the tower. Cut sheets of the existing and proposed antennas are attached for additional
reference. Sprint/Nextel is requesting Planning Department approval to replace the existing 14' tall omni whip
antennas with the new 96" antennas.
As previously stated, UP -98-08 allowed Sprint/Nextel to install (12) 4' tall panel antennas. The proposed (12) 8'
tall panel antennas will not increase the power or EMF output from the output levels of the permitted (12) 4'
antennas. The proposed (12) 8' panel antennas will narrow the vertical and horizontal beam width of
Sprint/Nextel's signal in order to reduce interference to the site.

proposed 96" antennas.

At the regular meeting of the Butte County Planning Commission held December 11, 1997, your

approved subject to the conditions listed on the enclosures. Please sign both copies and return
both copies to this Division within 40 calendar days.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you
must do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville,
California, prior to 5:00 p.m., Monday. December 22, 1997. The appeal deposit of $250.00 must
be paid at that time. If you do not appeal and if there are no other appeal within the 10 calendar -
day appeal period, the action of the Planning Commission is final.
• A Notice of Exemption (NOE) should be filed for Purpose of

environmental quality Act requirements. The fee for filing the NOE is a $25.00 document
handling fee. A check made payable to the Butte County Treasurer in the amount of $25.00

Pursuant to the provisions of the Zoning Ordinance of the;County of Butte and the special
conditions set forth below: SMART SMR of California (d.b.a. NEXTEL Communications)
is hereby granted a Use Permit in accordance with application filed: September 25, 1997,
to allow a communications tower in a M-2 (Heavy Industrial): zone, identified as PpN 036
270-038, located at 1855 Kusel Road, Oroville.
1: Failure to comply with the conditions speed herein as the :basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said
permit in accordance with the procedures set forth in the Butte County Zoning
Ordinance, including Butte County Code Sea 24-62:
2. Unless otherwise provided for in a special condition to this use permit, all conditions
. must be completed prior to or concurrently with the establishment of the granted
use. The use granted by this permit must be established within 24 months of the
.delivery of the countersigned permit to. the Permittee.
3.: Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated
written request by the applicant, or their respective designee, .: Prior to such
approval, verification shall be made by each Department or Division that the
modification is consistent with the application, fees paid and environmental
determination as conditionally approved. Changes deemed to be.. major or

4. If. any use for which a use permit has been granted is not established within two.
years of the date of receipt of the countersigned permit by the Permittee; the permit
shall become null and void and reapplication and a new permit shall be required to
establish the use.
5. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit.of the heirs, legal representatives, successors, and
assigns of the Permittee.
FINDINGS:
Section 1: Environmental Findings.
A: Upon careful and deliberate review of the project and the project site
environs, the proposed cellular communications facility will have no
significant environmental effects and has been determined to meet the .
' criteria for a general rule exemption under section 15061(0)(3) of the
California Environmental Quality Act Guidelines. This finding is supported
by: the fact that the area proposed to be developed is lthan 2,500 square
feet in size, no significant amount ofess , overcovering is proposed, traffic
generation will be insignificant, and the site, is located in an area that is not
botanically or biologically sensitive.
Section 2: Zoning Ordinance Findings.
A. The proposed use will not impair the integrity and character of the zone in
which the land lies, and that the use would not be unreasonably incompatible
with, or injurious to, surrounding property, or be detrimental to the health and
general welfare of the persons residing or working in the neighborhoods or
to the general health, safety, and welfare of the residents.of the County as
supported by the following facts:
1. The project site is located in an area zoned for heavy industrial uses
and has few residential. uses and a limited potential for additional new
residential uses; and
2. The use will not generate any noise, significant light, or traffic that
would conflict with adjacent land uses; and
The.'use will not create any aesthetic impacts due to its location away
from residential areas and -because it is located in a heavy industrial
zone; and
B. The proposed project is a Secondary Use under the Industrial General Plan
Land Use designation and is conditionally consistent with the M-2 (Heavy
Manufacturing) Zoning District..
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to
approve the Use Perind for SMART SMR of Californiai(d.b.a. NEXTEL
Communications) on APN 036-270-038 for a communications tower...
Approval shall be subject to the following -conditions:
B. Conditions.of Approval:
1. The project site shall be developed; in accordance with the approved'
project site plan and the conditions contained herein. Said site ,plan
is on file in the Planning Division, identified as "Exhibit B" and dated
9125197, and is incorporated herein by this reference. '
2.. The tower shall have a flashing had light installed on the top:
3. The applicant shall paint the top 50 ft. of the cellular antenna tower
with an orange and white striped pattern for easy identification from �)
the air.
4. Prior to construction of any facility, the'operator of the facility shall send
a notification letter to all medical flight cperatgrs in:the County informing .
them of the site location and tower height.
5. All facilities that are not in continual use for a period'of six -months shall
be removed.from the site and the site shall be returned to its original
condition or use.
6. Provide an all weather access to all structures, which is designed to
carry a 40,000 pound fire apparatus at least 10 feet wide with a 15 -
foot vertical, clearance.
7. No plumbing shall be allowed in the storage building :without prior
approval by the Butte County Environmental Health Department.
8. Prior to the issuance. of building permits obtain encroachment permit
for all new or existing driveway approaches and construct them to
County standards, as specified in County Improvement Standards.
9. .Prior to the recordation of the :issuance of building permits a plan for
a permanent solution for drainage shall be submitted to and approved
by the Department of Public Works. The drainage plans shall specify
how drainage waters shall be detained on-site and conveyed to the.
nearest natural or pubiicly maintained -drainage channel or facility and.
provide that there' shall be no increase in the peak flow runoff to said
channel or facility.
10. Prior to the issuance of the Use Permit, prove, to the satisfaction of
the Director of Public Works, that the parcel of the subject application
is a legal parcel.
11.. Applicant must also comply with all other applicable State and local
statutes, ordinances and regulations.

Dear Ms. Copeland:
At the regular meeting of the Butte County Planning Commission held December 11, 1997, your
request for a Use Permit for a 106 ft. communications tower and equipment shelter, was
approved subject to the conditions listed on the enclosures. Please sign both copies and return
both copies to this Division within 40 calendar days.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you
must do so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville,
California, prior to 5:00 p.m., Monday, December 22, 1997. The appeal deposit of $250.00 must
be paid at that time. If you do not appeal and if there are no other appeal within the 10 calendar -
day appeal period, the action of the Planning Commission is final.
A Notice of Exemption (NOE) should be filed for purpose of completing the California
environmental quality Act requirements. The fee for filing the NOE is a $25.00 document
handling fee. A check made payable to the Butte County Treasurer in the amount of $25.00
should be submitted to the Planning Division in order to complete the process.
Please be aware that failure to return the signed copies within 40 calendar days will invalidate
the Planning Commission's approval. Re-application to this Division would then be necessary.
The Use Permit is deemed granted when the enclosures have been signed by the applicant, with
the counter signature of the Chairman of the Planning Commission, and said permit is received

Chairman Lambert noted that there should be more than crop dusters notified regarding
a new tower, i.e., emergency helicopters, etc.

Mel Oliver said he lives in the area. He said the tower under litigation was put in three
years ago and was built near his house. He said if this permit is approved it will make
three towers in the area and he questioned the need for that many.
Jim Simpson, NEXTEL representative, showed a map of the existing and proposedtowers
in the Oroville area. He said AT&T would not encourage co -location on their tower while
in litigation. The other AT&T site is in a bad location for co -location of satellites.
Chairman Lambert said she would like the Commission to receive a map similar to Mr.
Simpson's.
Commissioner Mooney suggested the map also be mailed with the notifications to the
flyers.
The hearing was closed.
Chairman Lambert said ALUC has a list of people that should be notified. She asked Mr.
Gerst about the list.
Mr. Gerst said there was a list and he added that he would prefer a strobe light be required
rather than a flashing red light.
Chairman Lambert encouraged staff to meet with ALUC and come up with standards for
these towers and a list of people to be notified.
It was moved by Commissioner Mooney, seconded by Commissioner Nelson, and
unanimously carried to approve the permit as follows:

proposed cellular communications facility will have no significant environmental
effects and has been determined to meet the criteria for a general rule exemption
under section 15061(b)(3) of the California Environmental Quality Act Guidelines.
This finding is supported by the fact that the area proposed to be developed is less
than 2,500 square feet in size, no significant amount of overcovering is proposed,
traffic generation will be insignificant, and the site is located in an area that is not
botanically or biologically sensitive. • `

residential areas"and because it is located in a heavy industrial zone; and
B. The proposed project is a Secondary Use under the Industrial General Plan Land
Use designation and is conditionally consistent with the M-2 (Heavy Manufacturing)
Zoning District.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve
the Use Permit for SMART SMR of California (d.b.a. NEXTEL Communications) on
APN 036-270-038 for a communications tower. Approval shall be subject to the
following conditions:

3. The applicant shall paint the top 50 ft. of the cellular antenna tower with an
orange and white striped pattern for easy identification from the air.
4. Prior to construction of any facility, the operator of the facility shall send a
notification letter to all medical flight operators in the County informing them of
the site location and tower height.
5. All facilities that are not in continual use for a period of six months shall be
removed from the site and the site shall be returned to its original condition or
use.
6. Provide an all weather access to all structures, which is designed to carry a
40,000 pound fire apparatus at least 10 feet wide with a 15 -foot vertical
clearance.
7. No plumbing shall be allowed in the storage building without prior approval
by the Butte County Environmental Health Department.
8. Prior to the issuance of building permits obtain encroachment permit for all
new or existing driveway approaches and construct them to County
standards, as specified in County Improvement Standards.
9. Prior to the recordation of the issuance of building permits a plan for a
permanent solution for drainage shall be submitted to and approved by the
Department of Public Works. The drainage plans shall specify how drainage
waters shall be detained on-site and conveyed to the nearest natural or
publicly maintained drainage channel or facility and provide that there shall
be no increase in the peak flow runoff to said channel or facility.

SUMMARY: This application is for a Use Permit to allow a 106 ft. tall communications tower and
associated equipment in a M-2 zone. The proposed use requires a Use Permit in the M-2 zone
and is a Secondary Use in the Industrial General Plan Land Use designation. Staff recommends
approval with conditions and findings contained in this report.
APPLICABLE BUTTE COUNTY REGULATIONS: This Use Permit application is submitted
pursuant to Butte County Code Sections:
24-45 (Use Permits) which requires that an application be submitted and a public hearing be
held by the Planning Commission. The Commission may grant a Use Permit when it finds that
the proposed use of the property will not impair the integrity and character of the zone in which
the land lies and that the use would not be unreasonably incompatible with, or injurious to,
surrounding properties, or detrimental to the health or general welfare of the persons residing
or working in the neighborhood, or to the general health, safety, and- welfare of the residents of
the County; and
24-180.C.7 - M-2 Zone (Heavy Industrial) which requires that a conditional Use Permit be
obtained for quasi -public uses.
PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a 106 ft. tall
communications tower and associated equipment. The tower will support antennas to be used
to provide digital cellular mobile phone service. The project parcel is 1.5 acres in size. The
parcel is zoned M-2 (Heavy Industrial) and the Land Use Element Map of the Butte County
General Plan designates the project site as Industrial. A conditional Use Permit is required for
the communications tower use.

The project site is developed with an older single family dwelling unit and a 1,000 sq. ft.
corrugated metal building. A recycling business (Nor Cal Recyclers) is established on the project
site. The recycling business recycles many different types of material, including automobiles.
The communications tower and ancillary equipment will use only a 50' X 50' (2,500 sq. ft.)
portion of the parcel and will be located in the southwest corner of the parcel. Access to the
tower will be via a short easement across the parcel from Kusel Road.
The communications tower will be a three-legged 106 ft. tall lattice -type tower, with three whip
antennas extending 14 ft. above the top of the tower. Up to four 8' microwave dishes are
proposed to be installed on the tower in the future. At some point in the future the whip
antennas will be replaced with a "top hat" antenna configuration containing 12 panel -type
antennas. In addition to the tower, a 200 sq. ft. prefabricated building containing
communications equipment will be installed. A backup generator, and a 499 -gallon propane fuel
tank will also be installed. The 50'X 50' project area will be surrounded by a 6' tall chain link
fence with green slats and topped with three strands of barbed wire.
The tower is one of approximately eight towers that are to be placed in Butte County by
NEXTEL Communications. NEXTEL Communications, utilizing these towers, will be able to
provide multipurpose digital mobile network services, such as digital voice, digital two-way
dispatch, numeric paging, and wireless data transmission services, to Butte County. This type
of mobile service is currently not available in Butte County.

ANALYSIS: This project is conditionally consistent with the M-2 zoning district and the General
Plan Land Use designation of Industrial which notes public and quasi -public uses as secondary
uses. The proposed facility is not within a one -mile radius of an airport and is less than the 200 -
foot height restriction imposed by the Federal Aviation Administration (FAA). The area is not
associated with any special status plant, invertebrate or other protected species.
The emergency generator will be automatically tested for a 15 -minute period once a week. The
noise and emissions generated by the generator will not be significant. Installation of the
propane tank will be in accordance with County and State regulations.

The increase in vehicle traffic caused by the proposed use will not be significant. There will be
no impacts to traffic operations in the project area. Routine inspection and maintenance will
occur approximately once a month. Other than that, the project site is unmanned.
A light is proposed to be placed over the door to the equipment shelter. The light is proposed
to be a motion detector activated light and will not shine all night.
Co -location of Antennas
Ideally, the County prefers operators to co -locate their facilities on existing towers whenever
possible. However, in some cases this is not possible due to existing towers not providing the
proper coverage, radio interference from other antennas on the same tower, or no space for
additional antennas on an existing tower. The proposed tower service area coverage and call
capacity will be the Highway 70 Corridor south of Oroville to the Highway 70/Power House Hill
Road intersection and north to the Oroville downtown area. This is approximately a four mile
radius.
There are two existing wireless towers near the project parcel. One tower is located on Ophir
Road near Feather River Blvd., approximately 1 mile west of the project site. According to the
applicant, this tower would provide adequate coverage to the desired service area, but it is
currently involved in litigation and is not available for co -location. The second tower is located
on Lincoln Blvd., approximately 1.75 miles northeast of the project site. The applicant has stated
that this existing tower is too far from the coverage area objective of the Highway 70 corridor.
Aesthetic Concerns'
The proposed tower is a 3 -legged lattice tower and will be 106 ft. tall with various types of
antennas mounted on the top and on the sides. The tower is proposed to be finished in a
galvanized coating which will weather to a non -glare grey finish. No tower lighting is proposed
by the applicant unless required by the FAA or the County. In order to assure that the tower will
be seen by low flying aircraft, a condition of this project will require that a flashing red light be
placed on top of the tower and that the top 50 feet of the tower be painted alternating orange
and white.
The addition of a 106 ft. tall tower to the project site will reduce the aesthetic quality of the
project area. The tower will be the tallest structure in the project area, and will be visible from
Ophir Road and Lincoln Blvd. Locating the tower elsewhere on the property would not
significantly reduce its visibility. Structures located in an industrial area are built for function
rather than for aesthetics, and tend not to be visually pleasing to the eye. The proposed 106 ft.
tower will be consistent with other functional structures in the project area. A condition of this
project will require that the tower be removed if it is not used continuously for a six month period.
Other Agency Concerns
The Butte County Fire Department is requesting that an all-weather access be provided to all
structures, which is designed to carry a 40,000 pound fire apparatus, at least 10 feet wide with
a 15 -foot vertical clearance. This has been added as a condition of project approval.

The proposed use will not require sewage disposal or water service. The Butte County
Environmental Health Division has commented that if any waster plumbing is proposed for the
equipment shelter a septic system will be required. They have also commented that if water is
required it must be OWID treated or install a well. These comments have .been added as
conditions of project approval. •
The Butte County Department of Public Works is requesting that a plan for a permanent solution
for drainage be submitted and approved, and that an encroachment permit be obtained for all
new or existing driveway approaches, and construct them to County standards. They are also
requesting that prior to the issuance of the Use Permit the applicant prove to the satisfaction
of the Director of Public Works that the project parcel is a legal parcel. These three requests
have been added as conditions of project approval.
ENVIRONMENTAL DOCUMENTATION: This application has been determined to be exempt
from the California Environmental Quality Act (CEQA) as it is classified as Categorically Exempt
(Class 3(a)), and as such, is not subject to the requirements of CEQA. This Section allows for
an exemption to CEQA requirements when the project "consists of construction and location of
limited numbers of new, small facilities or structures; installation of small new equipment and
facilities in small structures..."
RECOMMENDATION: Staff is recommending that a Use Permit be granted to Smart SMR of
California (d.b.a. NEXTEL Communications) on APN 036-270-038 subject to the findings and
conditions contained in exhibit 'A" attached. This recommendation is based on the project's
ability to meet the requirements of the Zoning Ordinance. If the Commission cannot make the
required findings to approve the project, the appropriate action would be to make a motion of
intent to deny and provide Staff direction to make the necessary findings.

Changes deemed to be major or significant in nature shall require a formal application for
amendment.
4. If any use for which a use permit has been granted is not established within two years of

Project Description
The requested Conditional Use Permit is for the proposed development of a portion of this 1.5± acre
parcel for a Smart SMR of California (d.b.a. NEXTEL Communications) wireless telecommunication
transceiving facility consisting of a 106'± lattice tower, panel antennas, prefabricated building, back-
up generator and propane fuel tank located within a 50'. x 50' leased area. • This site is designed to
provide service to the Highway 70 corridor in the Ophir Road area from approximately 4 miles north
of the site (City of Oroville proper) to approximately 4 miles south of the site (Highway 70/Power
House Hill Road intersection).
Site Improvements: The 50' x 50' lease area will be accessed from Kusel Road. Existing site
development consists of a corrugated metal building of approximately 1,000 SF± and an older, one-
story, single family residence. The corrugated metal building and a portion of the site are utilized in
conjunction with the adjacent recycling business. The lease area, located between the residence and
Kusel Road, will be fenced with chain-link fencing topped with three (3) strands of barbed wire. A
double, 12' wide vehicle gate will provide access to the fenced enclosure. A 10' x 20' prefabricated
equipment shelter, propane tank and back-up generator will be installed on graded pads with concrete
foundation slabs. The balance of the lease area receives permeable gravel paving. Electrical and
telephone utilities will be extended from adjacent services.
Tower: The 106' lattice tower will be a three (3) legged style finished in a galvanized coating which
will weather to a non -glare grey finish. No tower lighting is proposed unless required by the FAA.
A light is proposed over the door to the equipment shelter. This light is typically motion detector
activated and is not on all night.
Equipment: The tower will initially be equipped with three (3) whip antennas. Twelve (12) panel
type antennas and four (4) microwave dishes are planned in the future. The panel antennas would
replace the whip antennas. The overall height with the whip antennas is 120'. The panel antennas will
be arrayed with four (4) per sector or side of the three sided tower with a rad center of 104' and
overall height of 107'±. Panel antennas are approximately 4'=6" (h) x 12" (w) x 9" (d). The four (4)
microwave dishes are eight (8) feet in diameter and mounted below the panel antennas. Two (2) 12"
high, receive only, G.P. S. (Global Positioning System) antennas will be mounted to the eave of the
prefabricated shelter structure. A Test Mobile antenna (approximately 5" x 12", triangular shaped)
is also proposed.
All other radio equipment is installed within the prefabricated shelter building.
Two (2) air conditioning units will be installed on one end of the prefabricated shelter structure.
A 499 gallon propane tank is proposed for an emergency generator. The propane fueled generator
is for emergency back-up only. It is designed to meet State and local requirements for containment
and siting. A 5' x 8' concrete pad will be provided for the 3' (w) x 4' (h) x 6' (1) generator. The
generator is only intended to operate for a limited time during electrical power outages. Generators
are automatically cycled for approximately 15 minutes a week for operational testing.

utility use within the M-2, Heavy Industrial zoning district.

Pursuant to the,provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: SMART SMR of California (d.b.a. NEXTEL Communications)
is hereby granted a Use Permit in accordance with application filed: September 25, 1997,
to allow a communications tower in a M-2 (Heavy Industrial) zone, identified as APN 036-
270-038, located at 1855 Kusel Road, Oroville.
1: Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit, constitutes cause for the revocation of said
permit in accordance with the procedures set forth in the Butte County Zoning
Ordinance, including Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a special condition to this use permit, all conditions
must be completed prior to or concurrently with the establishment of the granted
use. The use granted by this permit must be established within 24 months of the
delivery of the countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated
written request by the applicant, or their respective designee, Prior to such
approval, verification shall be made by each Department or Division that the
modification is consistent with the application, fees paid and environmental
determination as conditionally approved. Changes deemed to, be major or
sianificant in nature shall require a formal application for amendment.
4. If any use for which a use permit has been granted is not established within two
years of the date of receipt of the countersigned permit by the Permittee, the permit
shall become null and void and reapplication and a new permit shall be required to
establish the use.
5. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and
assigns. of the Permittee.
FINDINGS;
Section 1: Environmental Findings.
A. Upon careful and deliberate review of the project and the project site
environs, the proposed cellular communications facility will have no.
significant environmental effects and has been determined to meet the
criteria for a general rule exemption. under section 15061(b)(3) of the
California Environmental Quality Act Guidelines. This finding is supported
by the fact that the area proposed to be developed is less than 2,500 square
feet in size, no significant amount of overcovering is proposed, traffic
generation will be insignificant, and the site is located in an area that is not
botanically or biologically sensitive.
Section 2: Zoning.Ordinance Findings.
A. -` The proposed use will not impair she integrity and character of the zone In
which the land lies, and that the use would not be unreasonably incompatible
with, or injurious to, surrounding property, or be detrimental to the health and
general welfare of the persons residing or working in the neighborhood, or
to the general health, safety, and welfare of the residents of the County as
supported by the following facts:
The project site is located in an area zoned for heavy industrial uses
and has few residential uses and a limited potential for additional new
residential uses; and
2. The use will not generate any noise, significant light, or traffic that
would conflict with adjacent land uses; and
3. The use will not create any aesthetic impacts due to its location away
from residential areas and because it is located in a heavy industrial
zone; and
B. The proposed project is a Secondary Use under the Industrial General Plan
Land Use designation and is conditionally consistent, with the M-2 (Heavy
Manufacturing) Zoning District.
Section 3: Action.
A. Subject to the findings indicated in Sections 1 and 2 of this report, move to
approve the Use. Permit for SMART SMR of California (d.b.a. NEXTEL
Communications) on APN 036-270-038 for a communications tower.
Approval shall be subject to the following conditions:
B. Conditions of Approval:
The project site shall be developed. in accordance with the approved
project site plan and the conditions contained herein. Said site plan
is on file in the Planning Division, identified as "Exhibit B" and dated
9/25/97, and is incorporated herein by this reference.
2. The tower shall have a flashing red light installed on the top.
3. The applicant shall paint the top 50 ft. of the cellular antenna tower
with an orange and white striped pattern for easy identification from
the air. .
4. Prior to construction of any facility, the operator of the facility shall send
a notification letter to all medical flight operators in the County informing
w: them of the site location and tower height.
5. All facilities that are not in continual use for a period of six months shall
be removed from the site and the site shall be returned to its original
condition or use.
6. Provide an all weather access to all structures; which is designed to
carry a 40,000 pound fire apparatus at least 10.feet wide with a 15 -
foot vertical clearance.
7. No plumbing shall be allowed in the storage building without prior
approval by the Butte County Environmental Health Department.
8. Prior to the issuance of building permits obtain encroachment permit
for all new, or existing driveway approaches and construct them to
County standards, as specified in County Improvement Standards.
9. Prior to the recordation of the issuance of building permits a plan for
a permanent solution for drainage shall be submitted to and approved
by the Department of Public Works. The drainage plans shall specify
how drainage waters shall be detained on-site and conveyed to the
nearest natural or pubi.iciy maintained drainage.channei:or facility and
provide that there shall be no increase in the peak flow runoff to said
channel or facility.
r 10. Prior to the issuance of the Use Permit, prove, to the satisfaction of
OX the .Director of Public Works, that the parcel of the subject application
is a legal parcel.
11. Applicant must also comply with all other applicable State and local
statutes, ordinances and regulations.

Dear Mr. Selby:
This is to notify you that the information provided the
Telecommunications Division in a letter dated August 9, 1996,
generally meets the information filing requirements for Wireless
Registration Identification (WRI) in Decision 94-10=031 as
modified by Decision 94-12-042, as a facilities -based provider of
Commercial Mobile Radio Service. Your corporate identification
number is U -3066-C. Nextel Communications, Inc. may begin
offering service to the public upon the filing of tariffs that
are in compliance with Commission rules and regulations.
In all respects except authorization for market entry, the
authority of the Commission to regulate rates, terms and
conditions of newly registered wireless carriers shall apply to
the same extent as those holding certificates of CPCN prior to
August 10, 1994. Specifically this includes, but is not limited
to the following requirements:
1. The corporate identification number assigned to applicant
is U -3066-C, which should be included in the caption of
all original filings with this Commission and in the
titles of other pleadings filed in existing cases.
2. Applicant is authorized to file tariff schedules to the
PAL Coordinator, 505 Van Ness Ave, San Francisco, CA.
94102. Tariffs become effective upon the dare filed, so
it is recommended a draft copy be sent for staff review
prior to filing final tariffs.
3. Applicant is subject to the provisions of General Order
96-A as modified by D.88-05-067 and D.90-06--025 (as
modified by D.90-10-047, D.93-04-053, and D.94-04-043).
4. Applicant shall notify the Director of the
Telecommunications Division in writing of the date
service is first rendered to the public as authorized
herein, within five days after service begins.
S. Applicant shall be granted a waiver of PU Code sections
816-830 and 851-655, consistent with Decisions 85-07-081
and 85-11-044.
6..Applicant shall comply with PUC Code Section 401, et
seq., and Resolution M-4770, as they pertain to the

collection of user fees to fund the costs of regulating
public utilities. The current user fee is zero -,.point one
percent (O.0011a).
7. Applicant shall comply with PU Code Section 2881 and
Resolution T-15254 as they pertain to a surcharge on
gross intrastate revenues to fund the "California Relay
Service and communications devices fund". The current
rate is zero point three six percent (0.0036%).
B. Applicant should include in its tariff appropriate rules
for imposing and collecting the user fees and surcharges
describee- above.
9. Applicant shall file an annual report, in compliance with
General Order 104-A, on a calender -year basis using the
format specified by the Chief of the Auditing and
Compliance Branch of CACD_ (Appendix A.)
10. The corporate identity number and authority to render
cellular service under the rates, charges, and rules
authorized will expire if not exercised within 12 -months
after the date of this letter. -
11, Within 60 days of the issuance of a Wireless Registration
Identification number, applicant shall comply with PU
Code Section 708, Employee Identification Cards, and
notify, in writing, the Director of the
Telecommunications Division.
12. If applicant fails to file an annual report or remit the
fees discussed above, then the Telecommunications
Division will file a Commission resolution that revokes
the applicants Wireless Identification Number for
Commission approval.
13. Applicant is subject to the jurisdiction of the'-
Commission
heCommission for the resolution of customer complaints.
14. Applicant shall notify the Telecommunications Division in
writing of any changes to the information it submitted
for wireless registration within 30 days_ such
information does not have to be served on competitors,
cities and counties.

Collocation Analysis
The subject site is proposed to provide service area coverage and call capacity improvements to the
Highway 70 corridor south of Oroville approximately to the Highway 70/Power House Hill Road
intersection and north to the downtown Oroville area. This is approximately a four (4) mile radius.
This site was selected based on a coordinated effort between radio engineering, site acquisition and
land planning. We believe it is an appropriate site based on the following:
• Maximizes service area signal from a radio engineering perspective;
• Willing landlord from a site acquisition perspective, and
• Appropriate land use, zoning, and minimized visual effect from a planning perspective.
The NEXTEL digital wireless signal for this service area has an effective coverage radius of
approximately four (4) miles. This is constrained by topography, road alignment, to minimize
interference with adjacent sites and to provide additional call capacity.
Existing wireless communication facilities closest to the proposed site are:
• Bronson Court, an AT&T monopole approximately 1 mile west of the proposed site;
• Cemetery Hill off of Lincoln Boulevard, two (2) multi-user towers approximately 1.75 miles
northeast of the proposed site, and
• . Arline Rhine Drive, a TCI lattice tower approximately 4 miles north of the proposed site.
The existing AT&T lattice tower approximately 1 mile west of the proposed project site on Bronson
Court would provide adequate coverage to the desired service area; however, it is currently involved
in litigation with an adjacent property owner and is not available for collocation.
The Cemetery Hill sites are too far from the coverage area objective of the Highway 70 corridor
south of Ophir Road.
NEXTEL is actively seeking a site in the downtown Oroville proper.
