This is approximately a two (2) mile radius. This site was selected based on a coordinated effort between radio engineering, site acquisition and land planning. We believe it is an appropriate site, based on the following: • Maximizes service area signal from a radio engineering perspective; • Willing landlord from a site acquisition perspective, and • Appropriate land use, zoning and minimized visual impact from a planning perspective. The Smart SMR of California (d.b.a. NEXTEL Communications) digital wireless signal for this service area has an effective coverage radius of approximately two (2) miles to minimize interference with adjacent sites and to provide additional call capacity. This project is located in Supervisorial District 4. RELATED ITEMS: None FOR: Planning Commission Meeting of January 22, 1998 SUMMARY: This application is for a Use Permit to allow an 80 ft. tall communications tower and associated equipment in a M-1 zone. The proposed use requires a Use Permit in the M-1 zone and is a Secondary Use in the Industrial General Plan Land Use designation. Staff recommends approval with conditions and findings contained in this report. APPLICABLE BUTTE COUNTY REGULATIONS: This Use Permit application is submitted pursuant to Butte County Code Sections: 24-45 (Use Permits) which requires that an application be submitted and a public hearing be held by the Planning Commission. The Commission may grant a Use Permit when it finds that the proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health or general welfare of the persons residing or working in the neighborhood, or to the general health, safety, and welfare of the residents of the County; and 24-175.C.7 - M-1 Zone (Light Industrial) which requires that a conditional Use Permit be obtained for quasi -public uses. PROJECT CHARACTERISTICS: This project is a Use Permit request to allow an 80 ft. tall communications tower and associated equipment. The tower will support antennas to be used to provide digital cellular mobile phone service. The project parcel is 2.68 acres in size. The parcel is zoned M-1 (Light Industrial) and the Land Use Element Map of the Butte County General Plan designates the project site as Industrial. A conditional Use Permit is required for the communications tower use. ■ Butte County Department of Development Services ■ Planning Division ■ The project site is developed with an single family dwelling unit and a bar and grill business (Doc's Oasis). The residential use was approved in 1978 (Use Permit 78-06) and the tavern business is a legal, pre-existing, non -conforming use. There are many inoperable vehicles and piles of scrap metal on the project site. Surrounding land uses include a chemical supply business to the south, a trucking company to the east, a recycling/scrap metal business to the north and agricultural/open space to the west. The communications tower and ancillary equipment will use a trapezoid -shaped 2,840 sq. ft. portion of the parcel and will be located in the southeast corner of the parcel. Access to the tower will be -via a short easement from an existing gravel road which runs off of Keenan Ct. The communications tower will be a three-legged 80 ft. tall lattice -type tower, with six panel antennas. Up to four 8' microwave dishes are proposed to be installed on the tower in the future. At some point in the future additional panel antennas will be added to the tower. In addition to the tower, a 200 sq. ft. prefabricated building containing communications equipment will be installed. A backup generator, and a 499 -gallon propane fuel tank will also be installed. The project area will be surrounded by a 6' tall chain link fence which will be topped with three strands of barbed wire. The tower is one of approximately eight towers that are to be placed in Butte County by NEXTEL Communications. NEXTEL Communications, utilizing these towers, will be able to provide multipurpose digital mobile network services, such as digital voice, digital two-way dispatch, numeric paging, and wireless data transmission services to Butte County. This type of mobile service is currently not available in Butte County. PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION, AND EXISTING LAND USE: Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. Direction Zoning General Plan Existing Land Use Project: M-1 Industrial Residential/Bar & Grill North: M-1 Industrial Chico Scrap Metal South: M-1 Industrial Spray Chem Chemical East: M-1 Industrial Viking Freight Services West: A-5 Orchard/Field Crops Open Space ANALYSIS: This project is conditionally consistent with the M-1 zoning district and the General Plan Land Use designation of Industrial which notes public and quasi -public -uses as secondary uses. The proposed facility is not within a one -mile radius of an airport and is less than the 200 - foot height restriction imposed by the Federal Aviation Administration (FAA). The area is not associated with any special status plant, invertebrate or other protected species. ■ Butte County Department of Development Services ■ Planning Division ■ 2 a • The emergency generator will be automatically tested for a 15 -minute period once a week. The noise and emissions generated by the generator will not be significant. Installation of the propane tank will be in accordance with County and State regulations. Two air conditioning units will be installed on one end of the prefabricated shelter structure. The increase in vehicle traffic caused by the proposed use will not be significant. There will be no impacts to traffic operations in the project area. Routine inspection and maintenance will occur approximately once a month. Other than that, the project site is unmanned. A light is proposed to be placed over the door to the equipment shelter. The light is proposed to be a motion detector activated light and will not shine all night. Co -location of Antennas Ideally, the County prefers operators to co -locate their facilities on existing towers whenever possible. However, in some cases this is not possible due to existing towers not providing the proper coverage, radio interference from other antennas on the same tower, or no space for additional antennas on an existing tower. The proposed tower service area coverage area will be the Highway 99 corridor from Neal Road to the Highway 99/149 intersection. This is approximately a two mile radius. The applicant has stated that the two existing towers in the project area, one approximately 3 miles to the west on Esquon Road and the other just south of the intersection of Highway 99 & 149, are located too far away to provide adequate service coverage. Aesthetic Concerns The proposed tower is a 3 -legged lattice tower and will be 80 ft. tall with panel antennas and microwave dishes mounted on the sides. The tower is proposed to be finished in a galvanized coating which will weather to a non -glare grey finish. No tower lighting is proposed to be placed on the tower by the applicant unless required by the FAA or the County. In order to assure that the tower will be seen by low flying aircraft, such as airplanes or helicopters following Highway 99 during inclement weather or crop dusters operating nearby, a condition of this project will require that a flashing red light be placed on top of the tower and that the top 50 feet of the tower be painted alternating orange and white. The addition of an 80 ft. tall tower to the project site will reduce the aesthetic quality of the project area. The tower will be the tallest structure in the project area, and will be visible from Highway 99, Durham -Dayton Highway and Oroville-Chico Highway. Locating the tower elsewhere on the property would not significantly reduce its visibility. Structures located in an industrial area are built for function rather than for aesthetics, and tend not to be visually pleasing to the eye. The proposed 80 ft. tower will be consistent with other functional structures in the project area, but will be much taller. Locating the tower away from Highway 99 would reduce the negative aesthetic impacts the proposed tower would cause to Highway 99. This may not be practical because it may place the tower out of range of other towers. Locating the tower away from Highway 99 would place the ■ Butte County Department of Development Services ■ Planning Division ■ 3 L] • tower in an agricultural zone which may cause conflicts to crop dusters. In addition, the applicant may not be able to lease the land necessary for the proposed tower further away from Highway 99. As new mobile phone technologies become available, such as the use of satellites in earth orbit, the current cellular tower technology may become obsolete and not be needed. If new technology makes cellular towers obsolete, the towers should be removed. A condition of this project will require that the tower be removed if it is not used continuously for a six month period. Other Agency Concerns The Butte County Fire Department did not have any objections to or requirements for this project. The proposed use will not require sewage disposal or water service. The Butte County Environmental Health Division is requesting that the project meet the requirements of Butte County for on-site storage of hazardous materials, which is the 499 -gallon tank of propane. The Butte County Department of Public Works is requesting that encroachment permits be obtained for all existing or new driveways and construct them to County standards. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be exempt from the California Environmental Quality Act (CEQA) as it is classified as Categorically Exempt (Class 3(a)), and as such, is not subject to the requirements of CEQA. This Section allows for an exemption to CEQA requirements when the project "consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures..." RECOMMENDATION: Staff is recommending that a Use Permit be granted to Smart SMR of California (d.b.a. NEXTEL Communications) on APN 040-490-005 subject to the findings and conditions contained in exhibit 'A" attached. This recommendation is based on the project's ability to meet the requirements of the Zoning Ordinance. If the Commission cannot make the required findings to approve the project, the appropriate action would be to make a motion of intent to deny and provide Staff direction to make the ,necessary findings. Jim Simpson, NEXTEL representative, said he was in agreement with the staff report. He said this will be one of the lower towers at 80 ft. tall. Commissioner Mooney was concerned that the towers be removed when no longer needed. He asked Mr. Simpson if he knew the estimated cost of removal and restoration of the site? Mr. Simpson said he did not know what the cost would be. Chairman Lambert discussed changing the code so that in the future the County could require a bond to guarantee removal and restoration when the tower is no longer needed. Mr. Boatwright said his development will have to meet certain architectural design standards and asked that this tower not be painted orange and white and to make the tower as unobtrusive as possible. Commissioner Mooney was concerned with helicopters using this flight corridor for emergency traffic. Barbara Hennigan discussed Federal Air Regulation 137. She discussed the public safety of people who fly under 500 ft., i.e., search and rescue, CDF, etc. She wanted the tower painted orange and white. She said it was important to mark any guide wires where they exist. Jan Holman said there is farming '/2 mile from this site and the tower should be properly marked. The hearing was closed. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. _ 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on _, 199_, the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. 9. (SB) (UP98-13) A video of the site was shown. Mr. Sanders gave a brief summary of the project. The hearing was opened to the public. Jim Simpson, NEXTEL representative, said he was in agreement with the staff report. He said this will be one of the lower towers at 80 ft. tall. Commissioner Mooney was concerned that the towers be removed when no longer needed. He asked Mr. Simpson if he knew the estimated cost of removal and restoration of the site? Mr. Simpson said he did not know what the cost would be. Chairman Lambert discussed changing the code so that in the future the County could require a bond to guarantee removal and restoration when the tower is no longer needed. Mr. Boatwright said his development will have to meet certain architectural design standards and asked that this tower not be painted orange and white and to make the tower as unobtrusive as possible. Commissioner Mooney was concerned with helicopters using this flight corridor for emergency traffic. Barbara Hennigan discussed Federal Air Regulation 137. She discussed the public safety of people who fly under 500 ft., i.e., search and rescue, CDF, etc. She wanted the tower painted orange and white. She said it was important to mark any guide wires where they exist. Jan Holman said there is farming 'h mile from this site and the tower should be properly marked. The hearing was closed. Prior to construction of any facility, the operator of the facility shall send a t notification letter to all flight operators who operate in Butte County, including, but not limited to, aerial applicators, CHP, Sheriffs Department, medical life flight operators, and the Agricultural Commissioner's Office, informing them of the site location and tower height. 5. All facilities that are not in continual use for a period of six months shall be removed from the site and the site shall be returned to its original condition or use. 6. No plumbing shall be allowed in the storage building without prior approval by the Butte County Environmental Health Department. 7.
