(SB) (UP98-15) A video of the site was shown. Mr. Sanders gave a brief summary of the project. The hearing was opened to the public. Jim Simpson, NEXTEL representative, submitted additional exhibits. He said the property owner will cease his business and apply for a Use Permit. He discussed why they could not co -locate on the Air Touch Tower. He commended Mr. Betts and Mr. Sanders for making the process go smoothly. Mr. Sanders commented that the exhibits submitted show a different location than the ones in the file. Mr. Arnold, owner of the property, said he will apply for a Use Permit for his business. He said the tower will be located next to the barn. He said he can not have a,phone at his address because of the cost. He said if this project is approved, he will be able to have a cellular phone. The hearing was closed. Chairman Lambert said on Condition 6, where an application is being required for a Use Permit, maybe they should add "and be approved"? Mr. Sanders said they are trying to gain compliance with the use, an application will give the Commission a chance to review the project. Commissioner Cage asked what happens when Highway 149 goes to 4 lanes. Mr. Sanders said it will not conflict with this project. It was moved by Commissioner Nelson, seconded by Commissioner Mooney, and unanimously carried for approval as follows: FINDINGS: Section 1: Environmental Findings A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(a), "consists of construction and location of limited numbers of new, small facilities or structures, installation of small new equipment and facilities in small structures...", and 1r D Butte County Planning Commission Minutes - January 22, 1998 0 Page 7 0 B. The design of the proposed project improvements will not cause environmental damage to fish, wildlife, or their habitat; and C. The Planning Commission has independently reviewed, analyzed and considered the proposed Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration. reflects the independent judgement of the County of Butte; and Section 2: Zoning Ordinance Findings. A. The proposed use will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or be detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, safety, and welfare of the residents of the County as supported by the following facts: 1. The project site is located .in an area that has few residential uses and a limited potential for additional new residential uses; and 2. The use will not generate any noise, significant light, or traffic that would conflict with adjacent land uses; and 3. The use will not create any aesthetic impacts due to its location adjacent to three high-voltage power lines and support towers; and 4. A condition of this project requires that the tower be removed if it is on longer in continual use; and B. The proposed project is a Secondary Use under the Grazing and Open Land General Plan Land Use designation and is conditionally consistent with the U (Unclassified) Zoning District. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for NEXTEL Communications on APN 041-190-024 for a 98 foot monopole communications tower. Approval shall be subject to the following conditions: B. Conditions of Approval: 1. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit B" and dated 11/24/97 and is incorporated herein by this reference. 2. The applicant shall paint the top 50 ft. of the cellular antenna tower with an orange and white striped pattern for easy identification from the air. 4. Prior to construction of any facility, the operator of the facility shall send a notification letter to all flight operators who operate in Butte County, including but not limited to aerial applicators, CHP, Sheriff's Department, medical life flight operators, and the Agricultural Commissioner's Office, informing them of the site location and tower height. 5. All facilities that are not in continual use for a period of six months shall be removed from the site and the site shall be returned to its original condition or use. 6. Prior to issuance of a Use Permit, an application for a Use Permit for the non -conforming business use on the property shall be submitted to the Planning Division, or discontinue the non -conforming use. 7. Prior to the issuance of building permits obtain encroachment permit for all new, or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 8. Construction, installation or development of structures 'or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 9. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 10. Meet Environmental Health requirements for submittal of a Hazardous Material Release Response Plan prior to issuance of a Building Permit. 11. This project is located in Supervisorial District 4. RELATED ITEMS: None FOR: Planning Commission Meeting of January 22, 1998 SUMMARY: This application is for a Use Permit to allow a 98 ft. tall communications tower and associated equipment in an Unclassified zone. The proposed use requires a Use Permit in the U zone and is a Secondary Use in the Grazing and Open Land General Plan Land Use designation. Staff recommends approval with conditions and findings contained in this report. APPLICABLE BUTTE COUNTY REGULATIONS: This Use Permit application is submitted pursuant to Butte County Code Sections: 24-45 (Use Permits) which requires that an application be submitted and a public hearing be held by the Planning Commission. The Commission may grant a Use Permit when it finds that the proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or, injurious to, surrounding properties, or detrimental to the health or general welfare of the persons residing or working in the neighborhood, or to the general health, safety and welfare of the residents of the County; and 24-230.0.5 (Unclassified Zone) which requires that a conditional Use Permit be obtained for quasi -public uses. PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a 98 ft. tall communications tower and associated equipment. The project parcel is 6.3 acres in size. The parcel is zoned U (Unclassified) and the Land Use Element Map of the Butte County General Plan designates the project site as Grazing and Open Land. A conditional Use Permit is required for the communications tower use. ■ Butte County Department of Development Services ■ Planning Division ■ The project site is developed with a 500 sq. ft. mobile home and a 720 sq. ft. barn. Until recently, a Christmas tree farm was located on the parcel. The trees have been removed, and a retail business that sells antique farm equipment (Heritage House Antique Collectibles) has been established. This business is not a legally established use and is in violation of Butte County Code. This issue will be addressed later in this report. The remainder of the site consists of either open space or agricultural production. The communications tower and ancillary equipment will use only a 17 ft. x 30 ft. (510 sq. ft.) leased ground portion of the parcel for the antenna. A shelter containing the associated communications will be located in the existing barn. The communications tower will be a 98 ft. tall monopole tower. The tower will initially be equipped with six (6) panel type antennas. The panel antennas will extend two feet above the top of the tower. Up to twelve (12) panel antennas and two (2) microwave dishes may be placed on the tower at some point in the future, depending on future capacity. In addition to the tower, a back up generator and a 499 -gallon propane fuel tank will also be installed. The 17 ft. x 30 ft project area will be covered with 6" of gravel and will be surrounded by a 6' tall chain link fence topped with three strands of barbed wire. The tower is one of approximately eight towers that are to be placed in Butte County by NEXTEL Communications. NEXTEL Communications, through these towers, will be able to provide multipurpose (digital voice, digital two-way dispatch, numeric paging, and wireless data transmission) digital mobile network service to Butte County. This type of mobile service is currently not available in Butte County. The proposed tower will provide service to the Highway 149 corridor, from approximately 4 miles northwest of the site (Highway 99/Durham-Pentz Road interchange) to approximately 4 miles southeast of the site (Cottonwood Road/Table Mountain Boulevard intersection). PROJECT AND SURROUNDING ZONING GENERAL PLAN DESIGNATION AND EXISTING LAND USE:. Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. Direction Zonina General Plan Existing Land Use Project: U Grazing/Open Land Residential/Retail business/Ag North: U Grazing/Open Land Grazing " South: U Grazing/Open Land Highway 149/Orchards East: U Grazing/Open Land Grazing West: U Grazing/Open Land Grazing ANALYSIS: This project is conditionally consistent with the U zoning district and the General Plan Land Use designation of Grazing/Open Land which notes utilities and public and quasi - public uses as secondary uses. The proposed facility is not within a one -mile radius of an airport and is less than the 200 -foot height restriction imposed by the Federal Aviation Administration ■ Butte County Department of Development Services ■ Planning Division ■ 2 (FAA). The project site is not associated with any special status plant, invertebrate or other protected species. An emergency generator will be installed on the project site , to provide power to the communications facility in case of a commercial power outage. The generator will be fueled by propane, and a 499 -gallon propane tank will be installed on the site. The generator will be automatically tested for a 15 -minute period once a week. The noise and emissions generated by the generator will not be significant. Installation of the propane tank will be in accordance with County and State regulations. The increase in vehicle traffic caused by the proposed use will not be significant. There will be no impacts to traffic operations in the project area. Routine inspection and maintenance of the tower and communications equipment will occur approximately once a month. Other than that, the project site is unmanned. A light is proposed to be placed over the door to the equipment shelter. The light is proposed to be a motion- detector activated light and will not shine all night. A mitigation of this project requires that all lights on the project site be shielded to prevent them from causing a nighttime visual impact. No tower lighting is proposed to be placed on the tower by the applicant unless required to do so by the FAA or the County. Collocation of Antennas Ideally, the County prefers operators to co -locate their facilities on existing towers whenever possible. However, in some cases this is not possible due to existing towers not providing the proper coverage, radio interference from other antennas on the same tower, or no space for additional antennas on an existing tower. There are four existing wireless towers near the project parcel. According to the applicant, three of the existing towers are too far from the service area to meet coverage objectives for the proposed site. The remaining tower, which is located approximately 1 mile southwest of the project site, does not "hand-off' to the NEXTEL Table Mountain Boulevard site. The proposed tower, as with the other towers NEXTEL is installing, is designed structurally to accommodate at least two additional carriers. Aesthetic Concerns The tower will be 98 ft. tall monopole, with various types of antennas mounted on the top and on the sides. The proposed tower will be finished in a galvanized coating which will weather to a non -glare grey finish. No tower lighting is proposed to be installed unless required to do so by the FAA or the County. Due to the tower location near orchards and along a major highway, a condition of this project will require that a flashing red light be installed on the top of the monopole. This will help crop dusters and other low-flying aircraft identify and avoid the monopole. ■ Butte County Department of Development Services ■ Planning Division ■ 3 Highway 149 has been designated by Butte County to be a "County Scenic Highway," but it has not been zoned as Scenic Highway. The addition of a 98 ft. tall tower to the project site will reduce the aesthetic quality of the project area. The tower will be highly visible from Highway 149. Located approximately 200 yards west of the site are three sets of high voltage power lines and support towers. The proposed monopole will partially blend in with the high voltage power lines and support towers. This will lessen the visual impact to the project area. A condition of this project requires that the monopole be removed if it has not been in continual use for six months. Non -Conforming Uses on the Project Site A Christmas tree farm was, until recently, operated on the project site. The Christmas tree farm was an allowed use under the definition of "agricultural" and agricultural uses are permitted in the Unclassified zone. The Christmas trees were recently removed, and a retail business selling, trading, and buying antique farm equipment (Heritage House Antique Collectibles) was subsequently established. This business is not a permitted use in the zone, nor can it be considered a pre-existing non -conforming use. A Use Permit is required for this type of commercial use in the Unclassified zone. To date, no application has been received for the use. As such, the retail business use is an illegal, non -conforming use. In order to gain compliance with the zoning, a condition of this project requires that prior to issuance of a building permit a Use Permit application be submitted to the Planning Division or that the retail business use be stopped. If the Use Permit for the business is not approved, the business would have to be closed. Other Agency Concerns The Butte County Fire Department is requesting that construction, installation or development of structures or facilities on the parcel comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. The Fire Department is also requesting that building identification and/or addresses be installed in conformance with Public Resources Code 4290. The Butte County Environmental Health Division is requesting that the project meet Environmental Health requirements for submittal of a Hazardous Material Release Response Plan due to the large amount of propane gas that will be stored on the site. The proposed use will not require sewage disposal or water service. The Butte County Department of Public Works is requesting that prior to issuance of building permits encroachment permits be obtained for all new or existing driveway approaches and that they be constructed to County standards. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be exempt from the California Environmental Quality Act (CEQA) as it is classified as Categorically Exempt ■ Butte County Department of Development Services ■ Planning Division ■ 4 0 • (Class 3(a)), and as such, is not subject to the requirements of CEQA. This Section allows for an exemption to CEQA requirements when the project "consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures..." PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing was published in a local newspaper and were mailed to all property owners within a 300 -foot radius of the subject property. RECOMMENDATION: Staff is recommending that a Use Permit be granted to NEXTEL Communications on APN 041-290-024 subject to the findings and conditions contained in Exhibit 'A," attached. This recommendation is based'on the project's ability to meet the requirements of the Zoning Ordinance. If the Commission cannot make the required findings to approve the project, the appropriate action would be to make a motion of intent to deny and provide Staff direction to make the necessary findings. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: NEXTEL Communications is hereby granted a Use Permit in accordance with application filed: November 26, 1997, to allow a communications tower in a U (Unclassified) zone, identified as APN 041-190-024. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-62. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. i 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the- benefit of the heirs, legal representatives, successors, and assigns of the Permittee. FINDINGS: Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(a), "consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in. small structures...", and B. The design of the proposed project improvements will not cause environmental damage to fish, wildlife, or their habitat; and C. The Planning Commission has independently reviewed, analyzed and considered the proposed Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration reflects the independent judgement of the County of Butte; and Section 2: Zoning Ordinance Findings. A. The proposed use will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or be detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, safety, and welfare of the residents of the County as supported by the following facts: The .project site is located in an area that has few residential uses and a limited potential for additional new residential uses; and 2. The use will not generate any noise, significant light, or traffic that would conflict with adjacent land uses; and 3. The use will not create any aesthetic impacts due to its location adjacent to three 'high Voltage power lines and support towers; and . 4. A condition of this project requires that the tower be removed if it is on longer in continual use; and B. The proposed project is a Secondary Use under the Grazing and Open Land General Plan Land Use designation and is conditionally consistent with the U (Unclassified) Zoning District. Section 3: Action. A. Subject to the findings indicated in Sections '1 and 2 of this report, move to approve the Use Permit for NEXTEL Communications on APN 041-190-024 for a 98 foot monopole . communications tower. Approval shall be subject to the following conditions: B. Conditions of Approval: 'The project site shall be developed in accordance with the approved project site plan. and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit B" and dated 11/24/97 and is incorporated herein by this reference. 2. The tower shall have a flashing red light installed on the top. 3. The applicant shall paint the top 50 ft. of the cellular antenna tower with an orange and white striped pattern for easy identification from the air. 4. Prior to construction of any facility, the operator of the facility shall send a notification letter to all flight operators who operate in Butte County, including but not limited to aerial applicators, CHP, Sheriffs Department, medical life flight operators, and the Agricultural Commissioner's Office, informing them of the site location and tower height. 5. All facilities that are not in continual use for a period of six months shall be removed from the site and the site shall be returned to its original condition or use. 6. Prior to issuance of a Use Permit, an application for a Use Permit for the non- conforming business use on the property shall be submitted to the Planning Division, or discontinue the non -conforming use. 7. Prior to the issuance of building permits obtain encroachment permit for all new or existing driveway approaches and construct them to County standards, as specified in County Improvement Standards. 8. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 9. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 10. Meet Environmental Health requirements for submittal of a Hazardous Material Release Response Plan prior to issuance of a Building Permit. 11. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. _ 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and .to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. (NEXTEL) site is proposed to provide service area coverage and capacity to the Highway 99 corridor north of Oroville approximately between the Cottonwood Road/Table Mountain Boulevard intersection and Highway 99/Durham- Pentz Road interchange area. This is approximately a four (4) mile radius. This site was selected based on a coordinated effort between radio engineering, site acquisition and land planning. We believe it is an appropriate site based on the following: • Maximizes service area signal from a radio engineering perspective, • Willing landlord from a site acquisition perspective, and • Appropriate land use and zoning from a planning perspective. The NEXTEL digital wireless signal for this service area has an effective coverage radius of approximately four (4) miles. The range is constrained by topography, road alignment, to minimize interference with adjacent sites and to provide additional call capacity. Existing wireless communication facilities closest to the proposed site are: • Table Mountain Boulevard., an AT&T lattice tower approximately 4 miles southeast of the proposed site and the recently approved NEXTEL site approximately 5.25 miles on Table Mountain Boulevard; • Schlaf Drive, an AirTouch lattice tower approximately 1 mile northwest of the proposed site; • Arline Rhine Drive, a TCI lattice tower approximately 8.5 miles south of the proposed site, and • Cottonwood Road, a PG&E lattice tower approximately 3.5 miles south of the proposed site. The existing AT&T lattice tower located on Schlaf Drive approximately 1 mile northwest of the proposed project site may provide adequate service coverage to the north; however, it does not "hand-off' to the NEXTEL Table Mountain Boulevard site. The required elevation (rad center) is also not available. To achieve the required separation between carrier's antennas requires NEXTEL to locate at too low an elevation. The Table Mountain Boulevard sites are too far from the service area to provide the required coverage area objective. The PG&E and TCI towers are too far from the service area to provide the required coverage area objective for the Highway 149 corridor.
