(SH) (UP98- 12) (VIDEO) Stephen Hackney summarized the Agenda Report. The concerns for drainage and light and glare will be addressed by conditions and mitigations. Chairman Lambert noted that a letter was received from John and Sheryl Russell which included a request for reversal of Phases 2 and 3. Coni nissioner Mooney noted that Condition 8, to bring existing buildings up to current Building and Zoning regulations, should only apply to those buildings which are subject to a changed use. There was consensus that Condition 8 should apply to buildings subject to a changed use and that the standard condition should be modified for clarification. There was a discussion of setbacks for the buildings. Mr. Sanders said the setback for the zone is 5 feet from the rear and side property lines. Commissioner Nelson said the reason the Russell's would like Phases 2 and 3 reversed is simply to retain their view for as long as possible. The Russell's do not object to the project. The Russell's are also concerned about drainage. They are also concerned about fencing, lighting and security. Mr. Hackney said the property is surrounded by fencing and there is a caretaker on site as well as the applicants living on site. There is a condition to address lighting. Condition 11 addresses drainage. Commissioner Cage asked about plans to widen Eaton Road at this location. Mr. Sanders said widening of Eaton Road is a long range plan of Butte County although a 4 lane road may not be feasible at this location. Widening would not be in the near future. HEARING OPEN TO THE PUBLIC Cathy and Harry Webster were present. Ms. Webster said the drainage ditches do fill up but there has not been a problem with flooding. An engineer will have to address the drainage condition. She asked what a landscape and irrigation plan would entail. Mr. Sanders said 5% of the site is recommended for landscaping and a landscaping plan can be drawn by the applicants without hiring a professional landscaper. Ms. Webster thought 40 feet of right-of-way has already been deeded to Butte County. Mr. Sanders said the condition may have already been met. BUTTE COUNTY PLANNING COMMISSION MINUTES APRIL 23, 1998 Ms. Webster asked if the street improvements required by Condition 10 could be postponed until the other properties on Eaton Road construct those improvements. Commissioner Mooney said that street improvements and storm drainage should be handled over a large area at the same time, rather than in a piecemeal fashion. He suggested applying for a covenant for street improvements. Commissioner Leland recommended that the Planning Commission make it clear that street improvements could be postponed until the neighboring properties are improved similarly. Commissioner Mooney said it does not make sense to require preparation of plans for street improvements that may be installed much later. There was discussion of the language of Condition 10 in that it requires plans but not actual construction. Mr. Sanders said the condition was not correctly transcribed from the recommended Public Works condition, which did ask for construction as well as plans. Mr. Hackney said covenants have been granted on other projects in similar circumstances. Chairman Lambert suggested that the various plans should be co-ordinated by the Public Works Department. Mr. Sanders suggested having a Workshop with someone from the Public Works Department regarding street improvements and covenants. There was consensus that a Workshop is an excellent idea. Commissioner Leland suggested a covenant running with the land for street improvements. Commissioner Mooney noted that improvements for a 4 lane road standard would be inappropriate if the road remains a 2 lane road. He was in favor of a covenant. There was a suggestion for bonding the improvements, which was rejected, since a bond might get lost and would tie up the applicants' money. Mr. Webster asked if they could use a drainage easement which goes out to Highway 99. Mr. Nelson said it would be necessary to work with the Public Works Department on meeting the drainage condition. Commissioner Nelson read the letter from the Russell's regarding their concerns about reversing the phases to retain their view, drainage, and fencing for privacy and security. He suggested working with the neighbors. HEARING CLOSED TO THE PUBLIC There was discussion of fencing but no changes were made in the conditions. BUTTE COUNTY PLANNING COMMISSION MINUTES APRIL 23, 1998 l Mr. Hackney said the property is fenced with variations in kind, quality and height. The applicants will be removing all outdoor storage of vehicles although there is no condition to prohibit outdoor storage. There was a discussion of fire protection and it was noted that there are fire hydrants and a fire station nearby. It was moved by Commissioner Leland, seconded by Commissioner Mooney, and carried unanimously to approve the Use Permit 98-12 for Cathy and Harry Webster subject to the findings and conditions of Exhibit A of the Agenda Report dated April 2, 1998, including modification of Condition 8 to insert a clause after "existing building" to state "which are subject to a changed use," and modification of Condition 10 to delete the first clause "prior to issuance of building permits," and replace that wording with "Execute and record against the property a covenant running with the land requiring the landowners to" and to add to end of the condition, "when neighboring properties are similarly improved." Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Cathy & Harry Webster is hereby granted a Use Permit in accordance with application filed on November 3, 1997, for a Use Permit for the expansion of a mini -storage. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24- 45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to, or concurrently with, the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Approval of this permit shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 6. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. Section 1: Environmental Findings. BUTTE COUNTY PLANNING COMMISSION MINUTES APRIL 23, 1998 A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. Provisions and the design of the project and the conditions added to the project will mitigate such effects to a level of insignificance; and I B. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat, and a de minimus exemption to the collection of Department of Fish and Game Environmental Filing Fees is recommended; and C. The Planning Commission has independently reviewed, analyzed, and considered the proposed Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration reflects the independent judgement of Butte County; and Section 2: Zoning Ordinance Findings. A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The mini -storage expansion will incorporate a number of building design features to provide modern facilities which meet current building codes while replacing some aged facilities; and 2. The use does not represent a change from the historical use of the site which has existed compatibly with adjoining residential properties for approximately 40 years; and The hours of operation are compatible with adjoining uses and security lighting will be conditioned to minimize impacts to adjoining residences; and 4. The nature of the use generates little noise or traffic and the operations are spread out over the entire operating day resulting in no particular time of peak activity that could disrupt neighboring residences; and Section 3: Action. A. Subject to the findings in Sections 1 and 2 of this Exhibit move to approve the Use Permit for Cathy & Harry Webster APN 007-210-060 to allow the replacement and expansion of mini -storage facilities. Approval shall be subject to the following conditions: B. Conditions of Approval: Mitigation Measures: All outside lighting fixtures shall utilize "low spillover" design where all direct lighting shall remain on-site, allowing only reflective lighting to spillover into those areas off-site. or BUTTE COUNTY PLANNING COMMISSION MINUTES APRIL 23, 1998 2. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division." Planning Division Conditions: 3. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 4. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Building Division. 5. Prior to building permit issuance for a new conunercial or industrial development, or addition to an existing development, the applicant shall pay all applicable development fees at the rate in effect at the time of acceptance of the application. Such fees shall include, but not be limited to: School Fee, Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire Protection Fees. 6. Obtain required building permits. Plans shall be prepared by a design professional licensed or registered to practice in the State of California. 7. Comply with the Uniform Building Code for property line clearances considering use, area and fire - resistiveness of existing buildings. 8. Existing building(s) which are subject to a changed use shall be made to comply with current Building and Zoning regulations for the intended new use of the building(s) or the existing building(s) shall be demolished. Public Works Conditions: 9. Prior to the issuance of building permits deed to Butte County, in fee simple, 40 feet of right-of-way from the centerline of Eaton Road. The right-of-way shall be sufficient for the installation of standard No. S-5 at all street intersections. 10. Execute and record against the property a covenant running with the land requiring the landowner to submit road and drainage improvement plans and construct street frontage improvements on Eaton Road to an RS -14 lane standard, including, but not limited to, P.C.C. curb, gutter and sidewalk and the required street section, when neighboring properties are similarly improved. Prior to the recordation of the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained or retained on-site and or conveyed to the nearest BUTTE COUNTY PLANNING COMMISSION MINUTES APRIL 23, 1998 natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Environmental Health Conditions: 12. Prior to issuance of building permits for Phase II, the applicant shall complete work for the abandonment of well and septic tanks as per Environmental Health requirements. BUTTE COUNTY PLANNING COMMISSION MINUTES APRIL 23, 1998 AGENDA REPORT TO: Honorable Chair and Planning Commission FROM: Development Services Department DATE: April 2, 1998 REQUEST: Use Permit UP 98-12 for Cathy and Harry Webster: A request for a Use Permit for an expansion of a mini storage business on property zoned SR (Suburban Residential) located on the south side of Eaton Road, approximately 600 ft. west of Morseman Ave., at 725 Eaton Road, Chico, identified as APN 007-210-060, with a General Plan designation of Low Density Residential. This project is located in Supervisorial District 3. RELATED ITEMS: None FOR: Planning Commission Meeting of April 23, 1998 SUMMARY: This application is for a Use Permit to provide for the replacement and expansion of mini storage facilities. The use is a pre-existing nonconforming use that pre -dates the zoning classification. The Zoning Code provides for the expansion and reconstruction of such uses when they will not conflict with, impair, or be detrimental to the uses of the zone in which it is located. Staff recommends approval with conditions and findings contained in this report. APPLICABLE BUTTE COUNTY REGULATIONS: This Use Permit application is submitted pursuant to Butte County Code Sections: 24-45 (Use Permits) which requires that an application be submitted and a public hearing be held by the Planning Commission. The Commission may grant a use permit when it finds that the proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health or general welfare of the persons residing or working in the neighborhood or to the general health, safety and welfare of the residents of the county; and 24-35.20 (Change or Expansion of Nonconforming Use) which provides for the expansion of a nonconforming use upon obtaining a Use Permit from the Planning Commission. PROJECT CHARACTERISTICS: The property consists of 3.65 acres developed with a number of existing structures besides the mini storage facilities: a double -wide mobile home for the managers located at the south end of the property, a single -wide mobile home for the caretaker at the northern end of the property, three wells, two septic systems, and two propane tanks servicing the residences. The project is located in the northern urban area of Chico, on the south side of Eaton ,i BUTTE COUNTY PLANNING COMMISSION :' AGENDA REPORT 0 PAGE 1 '_' Road, half way between Godman Avenue and Morseman Avenue. The property site is zoned SR (Suburban Residential), and has a General Plan Land Use designation of Low Density Residential. Elevation on the property is approximately 220 feet. The site topography is characterized by level terrain - 0% to 2% slope. The vegetation on-site is limited to a number of trees in the northwest corner of the property, and an assortment of shrubs, trees and plants around the manager's residence. The soil consists of Vina Clay Loam Adobe, which is characterized as retaining water well, but having slow infiltration. Access to the site is provided from Eaton Road, at one point, on the property's north boundary. Surrounding land uses include a mixture of agricultural uses of both row crops and orchards on the north and south, rural residential development on the east and west, with urban residential development located several parcels removed to the south and southwest. The proposed expansion of the mini storage will consist of three phases: Phase I. Replace 22 existing storage boxes in a deteriorated state, covering 1,376 sq. ft, with two buildings totaling 2,100 sq. ft. One building will contain 12 storage units, 10'X25'. The second building will contain 3 storage units, 10'X10'. Construction is proposed for 1998. Phase II. Construct three buildings each sized at 80'X30' for a total of 7,200 sq. ft. The buildings are to be located on the undeveloped portion in the northwest corner of the property. Each building will contain 8 units, each 10'X20', and 16 units, each 5'X10'. Construction is proposed for 1999- 2000. Phase III. Construct one building sized at 120'X35', covering 8,400 sq. ft., on the undeveloped west side of the property. The building will contain 12 units, each 10'X15', and 12 units, each 10'X20'. Construction is proposed for 2001-2002. Neither the zoning or land use designation make provision for a mini storage use, however, the current facilities constitute a pre-existing nonconforming use. ANALYSIS: The existing mini -storage facility is a pre-existing nonconforming use in the zone. The assortment of buildings on-site were constructed at various dates, but the earliest mini storage use dates back over 40 years ago, predating the zoning classification of SR by approximately 20 to 25 years. Section 24-35.20 of the Butte County Code provides for the change or expansion of nonconforming as long as such uses will not conflict with, impair or be detrimental to the uses permitted and conditional in that zone, and a Use Permit is obtained. Although the mini storage use is not consistent with the zoning and land use designation, the use is not determined to constitute a significant impact in terms of compatibility with existing land uses in the vicinity. The commercial use of this property dates back to approximately 1960, with additional mini storage facilities added in 1965, 1972, and 1975 (pers comm. Al Petersen, Assessor's Office, February 11, 1998). The property was zoned A-2 during this time period. BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT PAGE 2 • The earlier surrounding land uses were probably dominated by agricultural activities. A recent site visit and aerial photo show the project site to be bordered on two sides by agricultural land used for row crops and orchards. Over the intervening years, residential development has progressed in the vicinity of the project site so that currently there is a mixture of rural and urban density residential development as well as continued agricultural activities. The uses of the site have apparently been compatible with the neighbors over a period of approximately 38 years. As the area continues to become more urbanized and have more residents this use will still remain compatible with the area. The mini storage will serve residents of the neighborhood without causing undue noise, traffic congestion, light or glare. The hours of operation will also be compatible with residential uses. Staff identified several concerns/issues. These concerns included drainage, and light & glare. Drainage. The expansion of additional storage facilities with associated paving will increase runoff from the site. The property is within the Shasta Union Drainage Assessment District and part of the drainage system is located on-site along the western border of the property. The system was installed in 1964: At that time the property site consisted of only one storage facility and a single family residence. The contract engineer for the assessment district attributed the site with a residential classification for purposes of calculating runoff and capacity figures for the system. The drainage system may not be adequately sized to meet any increased runoff resulting from additional impervious coverages on the property. The Department of Public Works is requiring, as a condition of approval, that the site be re-examined by an engineer and a drainage plan prepared which will address the issue. This condition will adequately address any potentially significant impacts. Light & Glare. The mini storage will not be open to the public at night. The applicant has stated no new lights will be necessary for this expansion. Currently, there are security lights in the area of the gate and elsewhere on-site. However, in the event the applicant may want to place additional lights on the expanded facilities, for security reasons or otherwise, and because of the potential for future parcel development on neighboring properties, an appropriate mitigation measure should be recommended to address any future potential impacts. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. Based upon the review of the Initial Study, staff has determined there are no potentially significant environmental impacts resulting from this project after appropriate mitigation measures have been implemented. RECOMMENDATION: Recommend that the Planning Commission approve the application for Cathy and Harry Webster on APN 007-210-060, subject to the findings and conditions in attached Exhibit "A." They initially were working with Joe Baker and got nowhere. Felix was good enough to write a lawyerly letter to the owner of Anchor Storage as they were holding garage/estate sales at all sorts of disrupting times. The Russells live immediately next door. Apparently when the permit was issue some years ago (Craig Sanders) the storage facility was permitted to build right up to the boundary line between the storage and the Russells. What Mr. Russell wants is a fence between his property and the Anchor Inn. He feels the county owes him that. I have further suggested that there also be landscaping. A tenant asked to have a garage sale to consolidate the things that they had from three units down to one .... we had no prior knowledge that they were going to call it an "estate liquidation sale". We did however allow them to come into our facility. prior to our normal opening hours, to price their items, which was a mistake on our parts, as they. did make some noise at that time. We upon receiving a complaint from our neighbor, told our tenant that they could no longer sell items out of their units, and in fact, refunded their rental money and asked -them to vacate their units. We are very sorry for the problem that occurred...... we are adhering to our operating hours, and in the future will not let any of our tenants conduct a garage sale or any type of sale out of their storage units. We have gone to our neighbor and apologized and assured them that a sale of this type would not happen again. We are sorry. for. the problem that this one incident has caused. Project Description and Location of Parcel(s): The application is a request for a Use Permit to replace and expand new mini storage facilities, in three phases over the next five years. The project consists of three. development phases: Phase I. Replace 22 existing storage boxes in a deteriorated state, covering 1,376 sq. ft, with two buildings totaling 2,100 sq. ft. One building will contain 12 storage units, 10'X25'.. The second building will contain 3 storage units, 10'X10'. Construction -is proposed for 1998. Phase II. Construct three buildings each sized at 80'X30' for a total of 7,200 sq. ft. The buildings are to be located on the undeveloped portion in the northwest corner of the property. Each building will contain 8 units, each 10'X20', and 16 units, each 5'X10'. Construction is proposed for 1999-2000. Phase III. Construct one building sized at 120X35', covering 8,400_sq. ft., on the undeveloped west side of the property. The building will contain 12 units, each 10'X15', and 12 units, each 10'X20'. Construction is proposed for 2001-2002. The property consists of 3.65 acres developed with'a number of existing structures besides the storage facilities: a double -wide mobile home for the managers located at the south end of the property, a single -wide mobile home for the caretaker at the northern end of the property, three wells, two septic systems, and two propane tanks servicing the residences. The project is located on 3.65 acres of land in the northern urban area of Chico, on the south side of Eaton Road, half way between Godman Avenue and Morseman Avenue. Surrounding land uses include a mixture of agricultural uses of both row crop and orchards on the north and south, rural residential development on the east and west, with urban residential development located several parcels removed to the south and southwest. The property site is zoned SR (Suburban Residential), and has a General Plan Land Use designation of Low Density Residential. Neither the zoning or land use designation make provision for a mini storage use, however, the current facilities constitute a pre- existing nonconforming use. The assortment of buildings were constructed at various dates, but the earliest mini storage use dates back over 40 years ago, predating the zoning classification of SR by approximately 20-25 years. Elevation on the property is approximately 220 feet. The site topography is characterized by level terrain - 0% to 2% slope. The vegetation on site is limited to a number of trees in the northwest corner of the property, and an assortment of shrubs, trees and plants around the manager's residence. Access to the site is provided from Eaton Road, atone point, on the property's north boundary. Although the mini storage use is not consistent with the zoning and land use designation, the use is not determined to constitute a significant impact in terns of compatibility with existing land uses in the vicinity. The commercial use of this property dates back to approximately 1960, with additional mini storage facilities added in 1965, 1972, and 1975 (pers comm. Al Petersen, Assessor's Office, February 11, 1998). The earlier surrounding land uses were probably dominated by agricultural activities. A recent site visit and aerial photo show the project site to be bordered on two sides by agricultural land used for row -crops and orchards. Over the intervening years, residential development has progressed in the vicinity of the project site so that currently there is a mixture of rural and urban density residential development as well as continued agricultural activities. The uses of the site have apparently been compatible with the neighbors over a period of approximately 38 years. Replacing older structures and expanding the mini storage use is determined to be compatible with both existing and future planned land uses for the area. The contract engineer for the assessment district attributed the site with a residenfial classification for purposes of calculating runoff and capacity figures for the system. The manner and nature of traffic in a mini storage facility, after the storage unit has been rented, is infrequent and sporadic. Typically, renters store their possessions for months on end without returning to the unit. The type of project is a low traffic generator. Additionally, the facility will most likely serve residents living in the area, reducing trips to other mini -storage facilities. Mitigation: None required. 7. BIOLOGICAL RESOURCES. Would the proposal result in impacts to: a) Endangered, threatened or rare species or their habitats (including but not limited to plants, fish, insects, animals, and birds)? b) Locally designated species (e.g. heritage trees)? c) Locally designated natural communities (e.g. oak forest, etc.)? d) Wetland habitat (e.g. marsh, riparian and vernal pool)? e) Wildlife dispersal or migration corridors? The parcel, 3.65 acres, is currently serviced by an underground drainage system that is part of Shasta Union Drainage Assessment District. There is some question whether the system can handle additional runoff with the new impervious coverage. The applicant, as a condition of approval, will have to provide a Drainage Plan which addresses this issue to the satisfaction of the Department of Public Works. Mitigation: None required. 13. AESTHETICS. Would the proposal. - a) Affect a scenic vista or designated scenic highway?, X b) Have a demonstrable negative aesthetic effect? X c) Create light or glare? I X Response: Approval of the project will not demonstrably affect any scenic vista nor have any negative aesthetic effect. As a condition of approval, the commercial site will be required to submit Landscape Plan subject to approval by the Department of Development Services. The mini storage will not be open to the public at night. The applicant has stated no new lights will be necessary as no lights for operation for night activities will be needed. Currently, there are security lights in the area of the gate and elsewhere onsite. However, in the event the applicant may want to place additional lights on the expanded facilities, for security reasons or otherwise, and because of the potential for future parcel development on neighboring properties, an appropriate mitigation measure should be recommended to address any future potential impacts. IX Response: The project site is located in an area identified as having high archaeological value (Butte County Constraints Map). However, the 3.6 acre parcel has been heavily used over a period dating back to at least 1960. The majority of the surface is, or is proposed to be, covered by mini storage facilities, two residences, and accessory structures. No surface evidence of archaeological value exists due to the long term intensive use and overcovering of the property. Any subsurface cultural resources that may exist are either permanently covered by existing structures. The location of the proposed new structures include an area that was once occupied by the original house which has long since been removed. The second area of the proposed construction of new facilities is in an area which has been used for years for outdoor storage of boats, recreational vehicles and an assortment of other vehicles. It is possible in the course of grading and laying the foundation that subsurface archaeological artifacts may be uncovered. An appropriate mitigation measure will adequately address such a potential impact. MITIGATION #2: During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. 15. RECREATION. Would the proposal: a) Increase the demand for neighborhood or regional parks or other recreation facilities? X b) Affect existing recreational opportunities? X Response: Approval of the project will not increase the demand for recreational facilities. The type of project is not growth inducing. No demand for additional housing and increased population will result from approval of the project. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit B" and dated _, 19_ and is incorporated herein by this reference. 2. Prior to the issuance of building permits, the plans, incorporating all applicable conditions of approval shall be submitted to the Planning Division to verify compliance with said conditions of approval. 3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing gates and a solid or semi -open shade cover. Plans to be reviewed and approved by the Planning Division prior to construction. 4. Prior to any use of the project site or business activity being commenced thereon, pursuant to this permit, conditions of approval contained herein shall be completed to the satisfaction of the Planning Division. 5. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING 1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and • 0 not less than _ gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than. 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Wdhin this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. _ 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on _, 199_, the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. 9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article II of the Butte County Code. The fee amount shall be determined and calculated as of the date of application for building permit. 10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and record the CSA 87 Traffic and Drainage Mitigation Agreement or pay the required fees prior to the issuance of the Use Permit. 11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax Collector's Office to begin the process of a Transient Occupancy Registration Certificate. A Transient Occupancy Registration Certificate shall be required within ten (10) days after commencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobile home park, recreational vehicle park, campground, or parking area (See Chapter 23A). 12.
