Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Thomas Ike is hereby granted a Use Permit in accordance with application filed on Noveiriber. 12, 1997, for a Use Permit for com.nc.cial building with professional offices. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special. condition to this Use Permit, all conditions must be completed prior to, or concurrently with, the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. If any use for which a use permit has been granted is not established within two year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Approval of this permit shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 6. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environrriental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. Conditions of Approval: 1. All outside lighting fixtures shall utilize "low spillover" design where all direct lighting shall remain on-site, allowing only reflective lighting to spillover into those areas off site. Commercial uses on-site are limited to those neighborhood commercial uses as indicated in the Butte County Code Section 24-160. 4. Prior to the recordation of the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained or retained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. 5. Prior to the recordation of the issuance of building permits, the applicant shall meet Butte County Health Department requirements for sewage disposal. 6. Prior to the recordation of the issuance of building permits, the applicant shall meet Butte County Health Department requirements for storm drainage. Building size was determined by required parking spaces and designated percentage for landscape. WATER DRAINAGE Water drainage is located on both Lassen & Godman Avenues. Engineering by North Star Engineering of Chico, California has designed an adequate drainage system to accompany water run-off as per requirement & regulations by the county. SEPTIC Septic tank & leachfield were designed by North Star Engineering to accommodate the capacity for the proposed project as per county requirements. SEWER As the developer of this property we have entered into an agreement with the City of Chico in which it is agreed that upon initiation of sewer assessment district proceedings, County, the City of Chico, or any other governmental entity conducting such sewer assessment district proceedings shall have the right to enter upon the Property and construct thereon any sewer laterals that may be necessary to connect plumbing fixtures appurtenant to a building or., structure located on the Property. (SH) (UP 98-14) (VIDEO) (Continued open from May 28, 1998) Mr. Hackney handed out a revised site plan showing the landscaping proposed and a memo from Environmental Health suggesting an additional condition. He said staff recommends the condition be added to this permit if approved. He said staff recommends approval and that the landscaping, sewer, and septic concerns have been addressed. The hearing was opened to the public. Mark Adams, NorthStar Engineering, said a lot of work has been done with Environmental Health and Planning to solve the problems with the parking and landscaping. He said the applicant agrees with the conditions. The hearing was closed. It was moved by Commissioner Mooney, seconded by Commissioner Nelson, and unanimously carried for approval as follows: Section 1: Environmental Findings. A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. Provisions and the design of the project and the conditions added to the project will mitigate such effects to a level of insignificance; and B. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat, and a de minimus exemption to the collection of Department of Fish and Game Environmental Filing Fees is recommended; and C. The Planning Commission has independently reviewed, analyzed, and considered the proposed Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration reflects the independent judgement of Butte County; and Section 2: Zoning Ordinance Findings. A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with or injurious to surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County because: 1. The construction of the commercial building will provide additional facilities to meet the growing need for neighborhood commercial uses in the north Chico area. The subject site is located adjacent to a church and a mini -mart and is on a busy collector street. Adjoining residential uses are already subject to impacts associated with these uses. Construction of a commercial building with neighborhood commercial uses will provide a use on the property that will be compatible with surrounding uses in as much as retail and professional services will be similar to existing commercial services; and 3. The property already has curb, gutter and sidewalks on-site, enhancing pedestrian and vehicular traffic safety; and 4. Access to the site will be from a side street, Godman Avenue, reducing potential traffic and safety impacts which may occur with access onto busy Lassen Avenue; and 5. A fire hydrant exists on the property, enhancing public safety for fire protection services. B. The proposed project is provided for in the Zoning Code under Section 24-120 D. 10. which provides for neighborhood commercial uses; and Section 3: Action. A. Subject to the findings in Sections 1 and 2 of this Exhibit move to approve the Use Permit for Thomas Ike on APN 007-220-023 to allow the construction of a commercial building. (SH) (UP 98-14) A video of the site was shown. Mr. Sanders gave a brief summary of the project. He said they are requiring as a condition that any tenant that locates or occupies this location, meet the requirements listed under the Neighborhood Commercial zoning uses. Chairman Lambert added the Condition "Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations." Commissioner Mooney said Condition 4 says to -retain -drainage -on-site and it does not look like there will be any place to do that. It also says and/or convey t4tothe�neaest� natural drain. He did not think they would be able to control the peak runoff. He asked if there was a drain on=site. Mr. Sanders said Lassen Avenue has a storm drain. There was a brief discussion on annexing this property to the City. The hearing was opened to the public. Thomas Ike said NorthStar Engineering is doing�he :dranageplan. He asked for approval. He said this is a good project and will help the neighborhood. Marty Domyancic said the coffee shop is a great idea. She said there are trees along the property lines that are beautiful and 30 years old and should be retained. She said her septic is close to her property line and she is concerned with drainage which has changed since the convenience mart across the street expanded their parking. The hearing was closed. —� MT. Sanders said there is lapmg required. He said it appears the proposed building is the largest allowed for the site. SixteepL;Ring--spaces are required. He said it does not leave much area for landscaping. They need to discuss either allowing different uses to reduce parking or reduce the size of the building. Chairman Lambert suggested a Motion of Intent to allow staff time to meet with the applicant to revise the plans. Mr. Sanders said he would like to go over the-landscaping=with_the=applicant. It was moved by Commissioner Leland, seconded by Commissioner Cage, and unanimously carried to continue this hearing to June 25, 1998, at 9:00 a.m. 's>_s BUTTE COUNTY PLANNING COMMISSION MINUTES MAY 28, 1998 AGENDA REPORT • TO: Honorable Chair and Planning Commission FROM: Department of Development Services - Planning Division DATE: April 24, 1998 REQUEST: Use Permit #98-14 for Thomas Ike on APN 007-220-023• The application is a request for a Use Permit to construct a commercial office building, of approximately 3256 square feet, to house a gourmet coffee shop, with the remaining square footage to be occupied by professional offices/businesses. The project is located on 0.28 acre of land in the northern urban area of Chico. The property is zoned R-3 ' (Medium Density Residential) and has a land use designation of Medium Density Residential. The project is located in Supervisorial District 3. RELATED ITEMS: None FOR: . Planning Commission Meeting of May 28, 1998 SUMMARY: This application is for a Use Permit to provide for the construction of a business office(s) building which will provide retail convenience shopping and personal services. Staff recommends approval with conditions and findings contained in this report. APPLICABLE BUTTE COUNTY REGULATIONS: This Use Permit application is submitted pursuant to Butte County Code Sections: 24-45 (Use Permits) which requires that an application be submitted and a public hearing be held by the Planning Commission. The Commission may grant a Use Permit when it finds that the proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health or general welfare of the persons residing or working in the neighborhood, or to the general health, safety and welfare of the residents of the county; and 24-120 D. 10. (R-1 Through R-4 (Residential Zones) which provides for neighborhood commercial uses in an R-3 zoned area with a conditional Use Permit. PROJECT CHARACTERISTICS: The project consists of the construction of a commercial building for retail/professional services uses on a parcel zoned R-3 (Medium Density Residential). The parcel is approximately 12,000 square feet. A fire hydrant is located in front of the parcel on Lassen Avenue. Septic disposal will be on-site, and water service will be provided by a community water system. A driveway access exists on the Godman Avenue side of the property. The project design submitted by the applicant meets County and American Disability Act parking requirements (see Application on file). The site is bordered by curb, gutter and sidewalk. 0 • Drainage will be provided at curbside along Lassen Avenue. No surface water exists on-site. The proposed use will be compatible with surrounding area uses. Multi -family residences exist on the north side of the project; a church and rectory exist on the west side; a mini -storage facility exists on the south side across Lassen Avenue; and a gas station/mini-mart exists on the east side across Godman Avenue. An espresso shop, Realtors' offices and other such uses will complement the existing surrounding uses while providing services to residences within walking and/or limited driving range of the site. ANALYSIS: The applicant's request to construct a commercial building in an R-3 zone requires a Use Permit for neighborhood commercial uses. The allowed uses in the structure must meet the retail/services uses defined as neighborhood commercial, e.g., espresso shop, Realtor offices, and so forth. The applicant has indicated these are the proposed type of uses for the building (see applicant's letter in file). Staff identified several concerns/issues. These concerns included traffic, light & glare, land use compatibility, and safety/hazards. Traffic. Approval of the project will not significantly impact traffic on Lassen Avenue or any nearby collector streets. There is very good line -of -sight distancing along both Lassen Avenue and Godman Avenue. Traffic volumes in and out of the site may actually reduce traffic on these streets in as much as the professional and business services to be provided to the surrounding residents will reduce the need for those residents to drive outside the neighborhood to receive those same services. The project design submitted by the applicant meets County and American Disability Act parking requirements. The site is bordered by curb, gutter and sidewalk. This will help facilitate movement of pedestrians and bicyclists. No substantial impacts upon existing transportation systems will result from the project. Light & Glare. The businesses proposed to be located in the building probably will not be open at night. In order to assure there will be no potential impacts from light or glare, it is recommended an appropriate mitigation be required which limits or prohibits spillover light from the project onto Lassen and Godman Avenues. Land Use Compatibility. The surrounding properties include a mixture of commercial, quasi public and multi -family residential uses. The addition of a commercial building, in which neighborhood oriented retail and professional services are offered, will result in a compatible mixture with the adjacent mixed uses. In a general overview of growth in north Chico, approval of this project will meet growing demands for such services for the local community. Espresso shops are located out the Esplanade at Philadelphia Square, at the Albertson's shopping center on West East Avenue, and at the North Valley Mall. An espresso shop at this location will provide a similar service for the local residences, reducing travel distance and time. The growth of both residential and industrial development in north Chico, in the east Lassen/Eaton Avenue area, and around the airport, indicates support for the presence of additional real estate offices in this area. Providing such neighborhood services is consistent with the R-3 zoning which allows for neighborhood commercial uses with a Use Permit. The County has concern over future possible uses of the commercial building. The R-3 zoning provides for neighborhood commercial uses with a Use Permit. The neighborhood commercial use provides a limited selection of retail convenience shopping and personal services. Some of the uses include a market or grocery store, drugstore, hardware store, bookstore, laundromat, restaurant and delicatessen that does not have drive through service, and professional offices such as doctors, dentists, insurance or real estate. -The County's concern can be addressed with an appropriate condition of approval requiring any future use(s) in the building be restricted to those uses described in the Butte County Code Section 24-160, A. & B. Safety/Hazards. The property, located on a busy street, Lassen Avenue, will provide access from Godman Avenue. County parking requirements are met with adequate parking designed into the plans (see application file). Curb, gutter and sidewalk already exist on the property. These features will enhance pedestrian and vehicular safety in and around the project site. A fire hydrant exists on-site enhancing fire protection services. All these features reduce potential safety hazards and enhance the health and safety of the public. There were no other concerns/issues identified with this project. ENVIRONMENTAL DOCUMENTATION: This application has been defined as a project under the California Environmental Quality Act (CEQA) and as such, is subject to the requirements of CEQA. Based upon the review of the Initial Study, staff has determined there are no potentially significant environmental impacts resulting from this project after appropriate mitigation measures have been implemented. RECOMMENDATION: Staff recommends that the Planning Commission make the findings and take the action listed below to approve the Use Permit for Thomas Ike on APN 007-220-023, including conditions in Exhibit "A." Section 1: Environmental Findings. A. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. Provisions and the design of the project and the conditions added to the project will mitigate such effects to a level of insignificance; and B. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat, and a de minimus exemption to the collection of Department of Fish and Game Environmental Filing Fees is recommended; and C. The Planning Commission has independently reviewed, analyzed, and considered the proposed Negative Declaration with mitigation measures prior to making its decision on the project, and the Negative Declaration reflects the independent judgement of Butte County; and Section 2: Zoning Ordinance Findings. The proposed use of the property will not impair the integrity and character of the zone in which the land lies and that the use would not be unreasonably incompatible with or injurious to surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County because: The construction of the commercial building will provide additional facilities to meet the growing need for neighborhood commercial uses in the north Chico area. Such uses are provided for in the R-3 zoning for neighborhood commercial uses; and 2. The subject site is located adjacent to a church and a mini7mart and is on a busy collector street. Adjoining residential uses are already subject to impacts associated with these uses. Construction of a commercial building with neighborhood commercial uses will provide a use on the property that will be compatible with surrounding.uses in as much as retail and professional services will be similar to existing commercial services; and The property already has curb, gutter and sidewalks on-site, enhancing pedestrian and vehicular traffic safety; and 4. Access to the site will be from a side street, Godman Avenue, reducing potential traffic and safety impacts which may occur with access onto busy Lassen Avenue; and A fire hydrant exists on the property, enhancing public safety for fire protection services. B. The proposed project is provided for in the Zoning Code under Section 24-120 D. 10. which provides for neighborhood commercial uses; and Section 3: Action. A. FOR: Planning Commission Meeting of September 10, 1998 BACKGROUND: This project was originally heard by the Planning Commission on May 28, 1998, however, it was continued due to concerns about parking and landscaping. On June 25, 1998, the Planning Commission approved the use permit which included a commercial office building of approximately 3256 square feet, a gourmet coffee shop and professional offices/businesses. The project was approved with six (6) conditions. The minutes and conditions are attached for your review. In August, 1998, staff reviewed the project file and conditions of approval when the applicant requested a building permit. A landscape plan and parking plan were submitted to the Planning Division for review. During this time, the Planning Division was informed by the Building Division that they had received phone calls from a concerned neighbor alleging that three (3) trees were cut down that were supposed to be retained. The project conditions did not specifically prohibit the removal of the large trees. Staff reviewed the landscape plan and found that one (1) large oak had been retained, however, according to the applicant, all other trees had to be removed to make room for parking. The applicant's site plan showed that many trees were replanted to make up for the removal due to the parking plan. Staff will follow-up and ensure that the landscaping is installed as proposed. Staff does not recommend any further action by the Planning Commission as the approved use permit did not specifically require retention of the subject trees. He said staff recommends the condition be added to this permit if approved. He said staff recommends approval and that the landscaping, sewer, and septic concerns have been addressed. The hearing was opened to the public. Mark Adams, NorthStar Engineering,—said a lot of work has been done with Environmental Health and Planning to solve the problems with the parking and landscaping. He said the applicant agrees with the conditions. The hearing was closed. It was moved by Commissioner Mooney, seconded by Commissioner Nelson, and unanimously carried for approval as follows: Section 1: Environmental Findings. A. An Initial.Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. He said they are requiring as a condition that any tenant that locates or occupies this location, meet the requirements listed under the Neighborhood Commercial zoning uses. Chairman Lambert added the Condition "Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations." Commissioner Mooney said Condition 4 says to retain drainage on-site and it does not look like there will be any place to do that. It also says and/or convey it to the nearest natural drain. He did not think they would be able to control the peak runoff. He asked if there was a drain on-site-.--- Mr. n-site:-- Mr. Sanders said Lassen Avenue has a storm drain. There was a brief discussion on annexing this property to the City. The hearing was opened to the public. Thomas Ike said NorthStar Engineering is doing the drainage plan. He asked for approval. He said this is a good project and will help the neighborhood. Marty Domyancic said the coffee shop is a great idea. She said there are trees along the property lines that are beautiful and 30 years old and should be retained. She said her septic is close to her property line and she is concerned with drainage which has changed since the convenience mart across the street expanded their parking. The hearing was closed. Mr. Sanders said there is landscaping required. He said it appears the proposed building is the largest allowed for the site. Sixteen parking spaces are required. He said it does not leave much area for landscaping. They need to discuss either allowing different uses to reduce parking or reduce the size of the building. Chairman Lambert suggested a Motion of Intent to allow staff time to meet with the applicant to revise the plans. Mr. Sanders said he would like to go over the landscaping with the applicant. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. • E, 4. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on _, 199_, the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. 9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article II of the Butte County Code. The fee amount shall be determined and calculated as of the date of application for building permit. 10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and record the CSA 87 Traffic and Drainage Mitigation Agreement or pay the required fees prior to the issuance of the Use Permit. _ 11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax Collector's Office to begin the process of a Transient Occupancy Registration .Certificate. A Transient Occupancy Registration Certificate shall be required within ten (10) days after commencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobile home park, recreational vehicle park, campground, or parking area (See Chapter 23A). 12.
