BUTTE COUNTY PLANNING COMMISSION NOTICE OF PUBLIC HEARING Notice is hereby given by the Butte County Planning Commission that a public hearing will be held on Thursday, April 9, 1998, in the Butte County Board of Supervisors' Room, County Administration Center, 25 County Center Drive, Oroville, California, regarding the following item: ITEM DETERMINED TO BE CATEGORICALLY EXEMPT FROM ENVIRONMENTAL REVIEW 9:00 a.m. - Nathan Stewart - Use Permit for a "Welcome to Chico" sign on property zoned A-40 (Agricultural - 40 acre parcels) located on the west side of Highway 99, approximately 1,600 feet south of Anita Road, identified as A_ P 047-260-101, Chico. The project site is located on the west side of Highway 99, approximately 1,600 ft. south of Anita Road, north of Chico. The property is zoned A-40 (Agricultural, 40 -acre minimum parcel size) and the Land Use Element Map of the Butte County General Plan designates the project site as Orchard and Field Crops. This project is located in Supervisorial District 4. RELATED ITEMS: None FOR: Planning Commission Meeting of April 9, 1998 SUMMARY: The proposed use is considered a quasi -public use, which requires a Use Permit in the A-40 zone, and is a Secondary Use in the Orchard and Field Crops Land General Plan Land Use designation. Staff recommends approval with conditions and findings contained in this report. APPLICABLE BUTTE COUNTY REGULATIONS: This Use Permit application is submitted pursuant to Butte County Code Sections: 24-45 (Use Permits) which requires that an application be submitted and a: public hearing be held by the Planning Commission. The Commission may grant a Use Permit when it finds that the proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health or general welfare of the persons residing or working in the neighborhood, or to the general health, safety and welfare of the residents of the County; and 24-90.C.1 (A-40 Zone) which requires that a conditional Use Permit be obtained for quasi -public uses. 24-305.450 - Definition of a quasi -public use: "A use operated by a private non-profit educational, religious, recreational ... association or organization, said use having the purpose primarily of serving the general public ..." PROJECT CHARACTERISTICS: This project is a Use Permit request to allow a "Welcome to Chico' sign. The project parcel is 4.2 acres in size and has been developed with a single family dwelling unit, an olive orchard, and a small strawberry field. The sign will be 20 ft. in height and 22 feet in length. The sign will say "Welcome to Chico" at the top, with up to 17 round organizational emblems below that. The sign will be made out of wood and is not proposed to be lighted. The sign is an Eagle Scout project for the applicant. He has conceived the project from the start, and will build the sign himself. PROJECT AND SURROUNDING ZONING, GENERAL PLAN DESIGNATION AND EXISTING LAND USE: Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. Direction Zoning General Plan Project: A-40 Orchard & Field Crops North: A-10 Orchard & Field Crops SR -1 Ag -Residential South: A-40 Orchard & Field Crops East: SR -1 Agricultural -Residential West: A -10/A-40 Orchard & Field Crops Existing Land Use Rural Residential/Agricultural Grazing Suburban Residential Orchards Highway 99/Suburban Residential Orchards/Grazing ANALYSIS: This project is conditionally consistent with the A-40 zoning district and the General Plan Land Use designation of Orchard and Field Crops which identifies quasi -public uses as secondary uses. The sign will not create any visual impacts because it will be of a design that is pleasing to the eye. The dwellings across Highway 99 will not see the sign because an existing wall and vegetation blocks their view of the sign location. The sign will not require the removal of any olive trees and will not have an impact on agricultural operations. Should lighting be proposed at some time in the future, it will be required to be approved by the Planning Division and by Cal Trans. Caltrans has reviewed this project and has no objection to the sign provided that it is not located within the Highway 99 right-of-way and that only non-profit organizational emblems be allowed on the sign. A condition of this project will require the sign to be placed outside the setback along Highway 99, which will also be outside the right-of-way. Maintenance of the sign will be accomplished by the applicant's Boy Scout troop for the first two years, and then it is hoped that a community organization will take over that responsibility. A condition of this project requires that the land owner remove the sign if the Director of Development Services determines that the sign is not being properly maintained. ENVIRONMENTAL DOCUMENTATION: This application has been determined to be exempt from the California Environmental Quality Act (CEQA) as it is classified as Categorically Exempt (Class 3(a)), and as such, is not subject to the requirements of CEQA. This Section allows for an exemption to CEQA requirements when the project "consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures..." ■ Butte County Department of Development Services ■ Planning Division ■ 2 RECOMMENDATION: Staff is recommending that a Use Permit be granted to Nathan Stewart on APN 047-260-101 subject to the findings and conditions contained in Exhibit "A," attached. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Nathan Stewart is hereby granted a Use Permit in accordance with application filed: March 11, 1998 to allow a "Welcome to Chico" sign in an A-40 zone, identified as APN 047-260-101. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24- 62. 2. Unless otherwise provided for in a.special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two years of the date of.receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 5. Minor changes -may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for. amendment. ■ Butte County Department of Development Services ■ Planning Division ■ El FINDINGS: Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(a), "consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures...", and Section 2: Zoning Ordinance Findings. A. The proposed use will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or be detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, safety, and welfare of the residents of the County as supported by the following facts: 1. The sign will not generate any noise, light, or traffic that would conflict with adjacent land uses, nor will it impact agricultural operations; and, 2. The sign will not create any aesthetic impacts because it will be pleasing to the eye: and, 3. A condition of this project requires that the sign be removed if it is not being properly maintained; and, 4. The sign will be beneficial to the County and to the City of Chico because it will help inspire a sense of community: and, B. The proposed project is a Secondary Use under the Orchard and Field Crops General Plan Land Use designation and is conditionally consistent with the A-40 Zoning District. Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for Nathan Stewart on APN 047-260-101 for a "Welcome to Chico' sign. Approval shall be subject to the following conditions: B. Conditions of Approval: 1. Night lighting of the sign shall be approved by the Planning Division and by Cal Trans. 2. The sign shall be removed if the Director of Development Services determines that the sign is not being maintained. (SB) (UP98-22) (VIDEO) Mr. Betts said that there would not be a video shown, but that he had pictures that indicated the approximate location of the proposed sign. He said that the sign would be made of wood, aesthetically pleasing and would not be lighted. Chairman Lambert said that she would have preferred that a community organization come forward in reference to the maintenance of the sign, before the Commission grants the permit, rather than leave it to a possible removal, after the fact. Mr. Betts said that the applicant and his troop will maintain the sign for approximately one to two years. After the one to two years, the applicant and his troop will try to get an organization to maintain the sign. Chairman Lambert asked if the applicant was present. Nathan Stewart, Troop 3, said that this sign was his eagle project. Mr. Stewart said that he intends to meet with several organizations in the future to ask for their support in maintaining the sign. He said he might also ask the Fire Department, as they have a station near the site. The hearing was opened to the public. The hearing was closed to the public. In reference to the maintenance of the sign, Commissioner Nelson questioned how the Commission would consider the project after two years. Mr. Sanders said that there have been no problems with the sign south of town. It was moved by Commissioner Nelson, seconded by Commissioner Cage, and unanimously carried to approve the Use Permit for Nathan Stewart, AP#047-260-101, subject to the findings and conditions in Exhibit "A", as follows: Section 1: Environmental Findings. A. This project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303(a), "consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures...", and Section 2: Zoning Ordinance Findings. A. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted. to guarantee installation and established growth. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING _ 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5. This Conditional Use Permit is granted for a period of month(s) atthe end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on _, 199_, the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. 9.
