The Health Department indicated that, prior to any renovations or issuance of building permits that would alter the amount of sewage entering the existing system, sanitation clearance will be required. The following operational limits apply: • Hours and days of operation: 8: 00 am - S: 00 pm Monday through Friday • Maximum number of students: Fifteen • Limitation on barbecue and picnic events: Total of 4 events each year, 50 participants, to be held on weekdays, 8:00 am -•5:00 pm., event participants will primarily congregate in the patio area which is separated from the closest neighbor by the shed, carport and fence. Inclusion of Mitigation Measures #1 - 3 will also limit the level of outside noise generation. Other factors that limit cumulative impact contributed by the project include the use of existing facilities only (no new improvements), and unobtrusive nature of the variety of activities planned for students (such as home economics and animal husbandry). The property may be improved in overall condition due to the planned activities of the students. Additionally, since the use does not propose overnight or weekend occupancy, overall use of the property may be less since typical night time and weekend activities normally associated with an occupied dwelling will not occur. Mitigation Measure #2: Should neighbors perceive the noise level obtrusive, efforts shall be made to to be less obtrusive. The site operator shall provide a phone number to adjacent neighbors for the purpose of allowing contact with the instructor on duty. Mitigation Measure #3: At the written request of neighbors complaining about noise levels from the facility, the Use Permit shall_ be brought before the Planning Commission where the complaining parties can state their concerns. Two vans will be necessary during normal operations. Instructors are provided on a basis of one per seven students. Depending upon the level of instruction needed, additional instructors may be necessary. It is not anticipated that the number of private vehicles visiting the site will exceed four. Approximately six (4 private vehicles + 2 vans) vehicles will be present at the site during normal operations. The applicant estimates a total of 16 average daily trips for the project (personal communication with project representative). This is approximately six daily trips more than would be generated by a single family residence. According to the Public Works Department, this amount will not adversely impact levels of service on Greenbank Avenue or Foothill Boulevard (2,780 average daily trips have been measured on Foothill Boulevard by the Public Works Department) which intersects Greenbank Avenue 200 feet south of the project's entrance. The number of daily trips is not expected to be different during barbecue and picnic events as participants will be brought to the events by vans. The limited number of events (four) also minimizes traffic impact from barbecue and picnic events. Due to the limited number of parking spaces it will be necessary to utilize vans for these events. It is expected that a maximum of four vans will be necessary, since attendance will generally be less than 25. However, events may have as many as SO persons in attendance. In such instances up to six vans may be used. In those instances where additional vehicle parking can be made available, event participants may arrive by personal automobile. Additional parking will be limited to the area of impervious asphalt surface and shall not exceed the number of spaces currently available (nine). d. The facility provides nine paved parking sites (5 full size and 4 compact) which will accommodate the van and employee parking needed during normal operation. The proximity of the property at the intersection of Greenbank Avenue and Foothill Boulevard could be dangerous to students at the facility. The entire perimeter of the property is secured with wire fencing, which will discourage entry into the right-of- ways of these roads. Additionally, access to these areas will be prohibited by the instructors. The fencing and instructor supervision will limit traffic hazards to the students using the facility. Mitigation: None required 7. BIOLOGICAL RESOURCES. The Department of Public Works is requesting 30 -feet of right-of-way along Greenbank Avenue and Foothill Boulevard and road and drainage improvement plans for the installation and construction of street frontage improvements on Greenbank Avenue and Foothill Boulevard to an RS -2A standard 'of the Butte County Improvement Standards, which includes but is not limited to curb, gutter and sidewalk for parcels on gross acreage of 1 acre or less. As per the attached memo from the Public Works Department, the Planning Commission has the authority to determine if these requirements are reasonably related to the use of the property for which the permit is requested. The Planning Commission may choose to impose these requirements, or find that the proposed use does not warrant these improvements. If the Planning Commission chooses to impose the requirements they must be reflected as conditions of the Use Permit.. CEQA ISSUES A Mitigated Negative Declaration has been prepared. Staff .is recommending three mitigation measures to address possible noise and compatibility impacts. I. The property is located on the east side of the intersection of Foothill Boulevard and Greenbank Avenue, at 245 Greenbank Avenue, in the Oroville area. (UP 99-07) (DB) (VIDEO) Mr. Wilson gave a brief summary of the project. He said Public Works is requiring curb, gutter, and sidewalk on this project. He said this is within the Oroville Urban area. A video was shown. Commissioner Nelson said it is up to the Commission to decide whether the improvements are needed or not. Commissioner Mooney said this area floods and curbs, gutters, and sidewalks are needed. He said this is next to an area that floods. He said this group should not be exempt from putting in the improvements. He said they should at least have language that if the County decides this area is improved, the applicant will agree to contribute to the drainage solution. Chairman Leland said they need to find that there is a link between the use granting and the incremental amount of flooding. He said there is very little increase of use and very little increase in runoff if this is approved. He said you need to find the nexus between the impact that this will cause by approving the permit. Commissioner Cage said it seems that there will be an increase. Mr. Wilson said the parcel was created in 1929. He discussed dedication of the road and whether the intersection needs more dedication. _ _ Commissioner Cage asked if there will be a caretaker or someone there all the time? The hearing was opened to the public. Kirby White, Office of Education, said there will not be a caretaker. He said that schools are exempt from the Use Permit process, but his office felt they should go through the process to let the neighbors,know what is being done. He said he would like to keep this property in a rural setting. He said they submitted a letter requesting a waiver of conditions pertaining to curbs, gutters, and sidewalks. He said the cost would close the program down. He said they do not have the funds to install the improvements. He said the property to the north does not have curb, gutter, or sidewalk. Mr. White said they. have an extended year program: He said people come in ana out to check on the property. Commissioner Cage said she was concerned with vandalism. Ron Leger, Program Director, said there is at least one manager when students are there. He said there is a 3-1 ratio of students to teacher. He said they have a good relationship with their neighbors. He said there is a staff person that lives in the area and there has been no problem with vandalism. She said she has no problems with this request at all. Mr. White said that this is not state property as stated in the staff report. He said it is owned by the Butte County Office of Education. He said they work with the Butte County Fire Department and would like Condition 12 deleted. He said the house is being used as an educational facility and is not a school. Chairman Leland discussed adding to Condition 12 "to the extent required by law." Commissioner Nelson said the applicant is trying to make this as normal a house as possible. He said if they are required to follow BC PRC 4290, the applicant will have to go through the Fire Department, and they will impose any regulations needed. Commissioner Mooney said that Condition 11 only addresses the signage for the property. This is an E (educational use) occupancy and should be' safe for the students. ' Commissioner Nelson said that if the applicant adheres to'PRC 4290,'it will encompass'the,whole code. The hearing was closed. Chairman Leland said they need to discuss the curb, glitter; and sidewalk issue as well as the 30 ft. dedication issue. Mr. Wilson said the 30 ft. right-of-way along Greenbank and Foothill was done years ago. Commissioner Nelson said this is a rural area and he did not want to require curb, gutter, and sidewalk. He said they are dealing with a 3 acre parcel. Chairman Leland said you need a nexus between this use and the increased use, if any, and the effect on the environment. He said he did not see any increased burden on the environment, road, streets, or traffic by this use. Commissioner Lambert said if the improvements are not done at this time, they will not have another chance to get the improvements. She said if there is flooding in the area and a lack of drainage, they -need to be concerned for the safety of the children. She said she was having a tough time waiving the condition because of the type of use, on property that has been donated to a school, where the cost would be imposed on an individual. Chairman Leland said they should always look at the impacts. He said he did not see a nexus between the request and the condition. He did not see any impact. Commissioner Nelson said if the property is split, the improvements would be required. He said in this case there is no change except for use. Mr. Wilson said there will be no new structures. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ FEBRUARY 25, 1999 ■ Commissioner Mooney said they need to look at drainage on Foothill and Greenbank. He said the applicant should pay their fair share. He suggested a covenant to pay their fare share if the improvements are required in the future: Chairman Leland said the ,drainage can be done with an assessment district. He said there has to be an impact to require the improvements. He "did not see any impacts. " Commissioner Mooney said he would like the applicant to take part in the drainage solution. Commissioner Cage said there will be more people and different things going on, not like a residence or usual school.. Mr. Wilson said the conditions for drainage are suggested conditions by the Department of Public Works and are not required by the County Code. He said it is up to the Commission to decide whether this condition in this case applies to this project. He noted that this use can be done without a Use Permit, and that the intent was to notify the neighbors because of the residential nature of the area. It was moved by Commissioner Mooney, seconded by Commissioner Lambert, to add Condition 13: For the applicant to prepare a permanent solution to drainage. Chairman Leland suggested deleting the new Condition 13 and add to the end of Condition 12 "to the extent required.by law." Commissioner Lambert said if Condition 13 is deleted, she would withdraw her second, otherwise it stands. Commissioner Nelson said he would be willing to make Condition 13 for a covenant in the future when the improvements are required. Commissioner Mooney said because this is for a Butte County School Department, it would be exempt when someone else would not be exempt. Commissioner Nelson said he did not think they should throw the burden on Butte County Office of Education, but if there is a solution, they should be a part of the solution. New Condition 13: "The applicant to participate in a general solution for drainage when a plan is developed for the general area.", and add to Condition 12, "to the extent required by law." This was alright with Commissioner Lambert. It was moved by Commissioner Mooney, seconded by Commissioner Lambert, and unanimously carried to adopt a Mitigated Negative Declaration and approve a DeMinimus exemption to the collection of Department of Fish and Game Environmental filing fees, and approve Use Permit 99-07 subject to the following findings and conditions, adding to Condition 12 "to the extent required by law." and adding Condition 13 to read: "The applicant is to participate in a general solution for drainage when a plan is developed for the general area." DESCRIPTION OF PROJECT AND SURROUNDING AREA The parcel at 245 Greenbank, in Oroville (AP # 036-450-015-000) is approximately 3.6 +/- acres in size and contains one house of approximately 1800 square feet, garage of approximately 484 square feet, carport of approximately 418 square feet, an outbuilding of approximately 161 square feet, and two shed type structures. The topography is rolling foothills, with stable cobble type soil, fenced pasture areas, with landscape trees and shrubs. (See attached photos). Uses of Greenbank Property Butte County Office of Education plans on using the house located at 245 Greenbank, Oroville CA to further the education of students with developmental disabilities in our non -graded program. Disabled students enrolled in Special Education programs, in the Regional Occupational Program and possibly students from the Private Industry Council and Las Plumas High School will be using the facility and assisting with our program. We do not expect more that 5-15 students to be using the facility at any one time. Special occasions such as community barbecues and field trips may draw more participants for a "short time. The age range of the students using the facility will vary with most of the student's age ranging from 16-22. On some occasions, younger students will participate in the activities. The use of this facility will have a positive impact on the community through the care and maintenance of the property. Site Plan STAFF COMMENT The Butte County Office of Education requests a Use Permit for an educational facility on a 3.6 acre parcel, to allow instructional programs for students with developmental disabilities, have low vision, or are blind. Specifically, students will be involved in learning typical domestic or outdoor activities such as landscaping and maintenance, animal husbandry, house cleaning, recycling, orientation/mobility training, fanning/gardening, home economics and other household duties that foster independent living skills. No more than fifteen students, aged 14 - 22, will utilize the facility at one time. Hours of operation will be from 8:00 a.m. to 5:00 p.m., Monday through Friday. Program picnics and barbecues are also proposed four times a year during the weekdays. Students and instructors will arrive by van, which will park on-site. No more than 50�persons will attend each event. All activities, barbecues and picnics will be supervised by program instructors. Existing improvements will be used, no additional improvements are proposed. ANALYSIS Project Background- The Butte County Office of Education received title to this property through a donation from a private landowner. It is the intent of BCOE programs to provide an environment very similar to that found in ordinary residential settings. Very little improvements are necessary and no additional development is proposed. General Plan and Zoning: The proposal will not conflict with the General Plan designation or zoning classification. The project is located in the Agricultural -Residential Zoning District which allows for public uses, such as the one proposed, upon securing a Use Permit. The project site's Low Density Residential General Plan designation also allows for public uses as a secondary use. Surrounding Uses and CompatibiliW The size of the property (3.6 acres), and low density residential uses of surrounding properties, contributes to the compatibility of the proposed use with surrounding properties. Adjacent properties are one-half acre to one acre in size. Although the site will no longer be used as a family residence, the activities that take place will be similar to typical domestic and outdoor activities that take place at the surrounding rural home sites. School activities may take place throughout the property. However, these activities will be very similar to a residential use of the property. Existing building improvements and fences provides for buffering between the project and adjacent residence. Local Agency Comments: The Butte County Fire Department requests the site's address number conform with the design specified under the Fire Safe Regulations. This is recommended as a condition of the Use Permit. The Building Division requests the facility comply with the provisions of the State Fire Marshal. As a State property, the State Fire Marshal is responsible for the implementation of building codes. This is recommended as a condition of the Use Permit. The Department of Public Works is requesting 30 -feet of right-of-way along Greenbank Avenue and Foothill Boulevard and road and drainage improvement plans for the installation and construction of street frontage improvements on Greenbank Avenue and Foothill Boulevard to an RS -2A standard of the Butte County Improvement Standards, which includes but is not limited to curb, gutter and sidewalk for parcels on gross acreage of 1 acre or less. As per the attached memo from the Public Works Department, the Planning Commission has the authority to determine if these requirements are reasonably related to the use of the property for which the permit is requested. The Planning Commission may choose to impose these requirements, or find that the proposed use does not warrant these improvements. If the Planning Commission chooses to impose the requirements they must be reflected as conditions of the Use Permit. CEQA ISSUES A Mitigated Negative Declaration has been prepared. Staff is recommending three mitigation measures to address possible noise and compatibility impacts. An Initial Study was completed in compliance with the California Environmental Quality Act identifying potentially significant environmental effects that the project may have. The design of the project and mitigations added to the project as shown in Exhibit "A" Conditions #6 - 8, will mitigate such effects to a level of insignificance. B. The Planning Commission has independently reviewed, analyzed and considered the proposed Negative Declaration with mitigation measures prior to making its decision on the project, and hereby finds that the Negative Declaration, with mitigation measures, adequately represents impacts associated with this project. II. Approve a DeMinimus exemption to the collection of Department of Fish and Game Environmental Filing Fees. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat. III. Approve Use Permit 99-07 subject to the conditions listed in Exhibit "A" with the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties, or detrimental to the health, safety, and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare, and safety of the County as supported by the following: The Butte County General Plan Land Use Element designates the site as Low Density Residential. The Low Density Residential General Plan designation indicates that detached single-family residential dwellings are the primary allowed uses. This designation also allows for public uses, such as the one proposed, as a secondary use. 2. Access is provided by Greenbank Avenue, a County road capable of accommodating the additional traffic generated by the use. 3. Adoption of Butte County Planning Division Conditions #1 - 10, regarding number of students/event participants, hours of operation, parking, noise mitigation and other state and local ordinances, Butte County Fire Department Condition #11, regarding signage for addressing, and Butte County Building Division Condition #12 will further protect the integrity and character of the zone in which the land lies, and ensures that the use will not be unreasonably incompatible with, or injurious to, surrounding properties. ■ Butte County Planning Commission 0 Agenda Report February 25, 1999 0 Page 3 ■ a EXHIBIT A USE PERMIT BUTTE COUNTY PLANNING COMMISSION as DATE: (Certified Mail Rec.) The use granted by this permit must, be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. Hours of operation shall be from 8:00 a.m. to 5:00 p.m., Monday through Friday. 3. No more than 4 program picnics/program barbecues shall be permitted each year. Picnic/barbecue events shall be limited to weekdays only. No more than 50 persons shall attend each event. 4. Nine on-site parking spaces (4 full size, 4 compact, and 1 handicap stall) shall be provided. 5. The existing wire fencing shall be maintained in good condition along the property lines and the right -of ways of Greenbank Avenue and Foothill Boulevard. 6. No outdoor music or amplified public address systems are allowed during any activity related to this Use Permit. (Mitigation Measure #1) 7. Should neighbors perceive the noise level obtrusive, efforts shall be made to be less obtrusive. The site operator shall provide a phone number to adjacent neighbors for the purpose of allowing contact with the instructor on duty. (Mitigation Measure #2) 8. Upon the written request of neighbors complaining about noise levels from the facility, the Use Permit shall be brought before the Planning Commission where the complaining parties can state their concerns. The Planning Commission shall determine if subsequent review is needed and, if required, set a hearing date to review the Use Permit. (Mitigation Measure #3) 9. Any improvement or activity which would increase the number, of students to more than fifteen shall be reviewed by the Planning Commission to determine if an amended Use Permit is necessary. 10. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. 11. The existing address signage for the property shall be made to conform to the Fire Safe Regulations (Public Resources Code Section 4290). 12. The comments describe two items that would become required conditions of the Use Permit. One requires deeding property for a right-of-way to Butte County and the other requires design, plans, and construction of curb, gutter and sidewalk on the Greenbank and Foothill Blvd. property lines. The Butte County Office of Education is formally requesting that the later conditioni be waived for the following reasons. First, please be reminded that the original intent of the previous property owner in her bequeathing the property to Butte County Office of Education (BCOE) was to enhance and provide an educational environment for the benefit of the students that BCOE serves. The cost to design, develop plans and the construction of almost 900 feet of curb, gutter, and sidewalk would very significantly negatively impact this program, perhaps to the point of closure. BCOE has not received any additional state funds to run the proposed program/site and does not expect any in the future. In fact, the state funds BCOE Special Education programs receive are insufficient to run the current programs; i.e. they are deficit funded. The additional financial impact to perform this work could potentially cause BCOE to liquidate the property. • There are no other additional budgeted funds to perform this work. No other properties in the general area have curb, gutters, and sidewalks. BCOE is striving to preserve the site in as rural of a condition as possible. Curb, gutter, and sidewalks do not enhance the rural environment. SITE DEVELOPMENT The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit B" and dated 19_ and is incorporated herein by this reference. Prior to the issuance of building permits, the plans, incorporating all applicable conditions of approval shall be submitted to the Planning Division to verify compliance with said conditions of approval. 3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing gates and a solid or semi -open shade cover. Plans to be reviewed and approved by the Planning Division prior to construction. 4. Prior to any use of the project site or business activity being commenced thereon, pursuant to this permit, conditions of approval contained herein shall be completed to the satisfaction of the Planning Division. —5. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING 1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. —4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on _, 199_, the applicant shall sign and file with the Department of Development Services an Indemnity • 0 Agreement in a form satisfactory to the County Counsel. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article II of the Butte County Code. The fee amount shall be determined and calculated as of the date of application for building permit. 10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and record the CSA 87 Traffic and Drainage Mitigation Agreement or pay the required fees prior to the issuance of the Use Permit. 11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax Collector's Office to begin the process of a Transient Occupancy Registration Certificate. A Transient Occupancy Registration Certificate shall be required within ten (10) days after commencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobile home park, recreational vehicle park, campground, or parking area (See Chapter 23A). 12.
