Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: James and Esther Thompson are hereby granted a Use Permit in accordance with
application filed: Use Permit to allow an expansion of a pre-existing church.
Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit, constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must
be completed prior to, or concurrently with, the establishment of the granted use. The use
granted by this permit must be established within 24 months of the delivery of the
countersigned permit to the Permittee.
If any use for which a use permit has been granted is not established within two years of the
date of receipt of the countersigned permit by the Permittee, the permit shall become null and
void and reapplication and a new permit shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
Mi ,n? changes maybe approved administ-ratively by the Directors of Development Services;
Environmental Health, or Public Works upon receipt of a substantiated written request by
the applicant, or their respective designee. Prior to such approval, verification shall be made
by each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
CONDITIONS OF APPROVAL
1. The project site shall be developed in accordance with the approved project site plan and the
conditions contained therein. Said site plan is on file in the Planning Division and is
identified as Site Plan, dated 10-28-98.
2. Obtain building permits from the City of Oroville.
All new external light fixtures shall be shielded in a manner that insures direct light does not
produce glare or project beyond property boundaries.
4. Hours of construction shall be limited to 8:00 a.m. to 5:00 p.m., Monday through Saturday.
5. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
6. Prior to the issuance of building permits deed to Butte County, in fee simple, 30 feet of right-
of-way from the centerline of Burlington Avenue and B Street. The right-of-way shall be
sufficient for the installation of standard No. S-5 at all street intersections.
7. Prior to the issuance of building permits submit road and drainage improvement plans for
the installation and construction of the street frontage improvements on Burlington Avenue
and B Street to RS -2A standard, including, but not limited to, P.C.C. curb, gutter and
sidewalk and the required street section for parcels with gross acreage of one acre or less.
Prior to issuance of a building permit, install the required road and drainage improvements
or sign and record a covenant agreeing to install the improvements when required to do so
by the County.
8. Prior to the issuance of building permits a plan for a permanent solution for drainage shall
be submitted to and approved by the Department of Public Works. The drainage plans shall
specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural
or publicly maintained drainage channel or facility and shall provide that there shall be no
increase in the peak flow runoff to said channel or facility. Any required drainage
improvements shall be installed prior to issuance of building permits or bonded to guarantee
installation of the improvements.
9. Prior to issuance of the sanitation clearance for a building permit, provide two (2) plot plans
and two (2) floor plans which show the community sewage system and community water
system connections to the proposed addition.

are in fact the conditions which were imposed upon the granting of this use permit, and that I agree
to abide fully by said conditions.

WHEREAS, the undersigned are presently the owners of that land commonly known as
A.P. located in Butte County, California, the
legal description of which is set forth on EXHIBIT A, attached hereto and incorporated herein and;
WHEREAS, said owners propose to develop said land by parcel map or a commercial or multi-
family development, and hereby specifically agree that when the County of Butte determines in its
discretion that it is in the best interest of this particular area to install curbs, gutters and sidewalks, or
other urban improvements, the undersigned or their successor in interest, upon notification by County of
Butte, hereby consent to said installation and agree to install the same upon demand of the County, at
their own expense or at the expense of their successor in interest. The undersigned or their successor
in interest, hereby agree that such improvements may be installed by County and become a lien upon
the property.
The undersigned hereby agree to cooperate and support the County of Butte in obtaining the
permission and approval of property owners within any assessment district, within which the above-
described property is included, formed for the purpose of installation of curbs, gutters, sidewalks or other
urban improvements.
In consideration of the foregoing and other good and valuable consideration, the undersigned
owners of said parcel, expressly agree that the foregoing shall be an agreement running with the land
and shall be binding upon their heirs and all successors in interest.

zoned R -N (Residential Nonconforming). The project is located at 3291 Burlington Street, identified
as AP 035-096-003, Oroville. (SB) (UP 99-08) (VIDEO)
A video of the site was shown. Mr. Betts gave a brief summary of the project. He said this request is for an
expansion of classes and that the seating capacity of the church will not increase. He said there are no curbs,

I. FINDINGS
Section 1: Environmental Findings.
A. This application has been determined to be categorically exempt from the provisions of the
California Environmental Quality Act under a Class 3 exemption (Section 15303(c)), construction
of new, small structures; and .
Section 2: Zoning Ordinance Findings.
A. The proposed use of the property will not impair the integrity and character of the zone in which the
land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding
property, or detrimental to the health, safety and general welfare of the persons residing or working
in the neighborhood, or to the general health, welfare and safety of the County because:
1. The expansion will not increase the seating capacity of the church and will not cause an
increase in vehicle traffic or parking needs; and
2. The expansion will not increase the noise levels in the project area; and
3. There is sufficient area on the project site for the required number of parking stalls; and
4. The church use has been on the property since 1928 and no land,use conflicts have occurred
due to this use; and
B. The proposed project is a Secondary Use under the Medium Density Residential General Plan Land
Use designation and is conditionally consistent with the R -N (Residential -Nonconforming) Zoning
District; and ,
CONDITIONS OF APPROVAL

The project site shall be developed in accordance with the approved project site plan and the
conditions contained therein. Said site plan is on file in the Planning Division and is identified as
Site Plan, dated 10-28-98.
2. Obtain building permits from the City of Oroville.
3. All new external light fixtures shall be shielded in a manner that insures direct light does not produce
glare or project beyond property boundaries.
4. Hours of construction shall be limited to 8:00 a.m. to 5:00 p.m., Monday through Saturday.
5. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
6. Prior to the issuance of building permits deed to Butte County, in fee simple, 30 feet of right-of-way
from the centerline of Burlington Avenue and B Street. The right-of-way shall be sufficient for the
installation of standard No. S-5 at all street intersections.
7. Prior to the issuance of building permits submit road and drainage improvement plans for the
installation and construction of the street frontage improvements on Burlington Avenue and B Street
to RS -2A standard, including, but not limited to, P.C.C. curb, gutter. and sidewalk and the required
street section for parcels with gross acreage of one acre or less. Prior to issuance of a building
permit, install the required road and drainage. improvements or sign and record a covenant agreeing
to install the improvements when required to do so by the County.
8. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be
submitted to and approved by the Department of Public Works. The drainage plans shall specify
how drainage waters shall be detained on-site and/or conveyed to the nearest natural or publicly
maintained drainage channel or facility and shall provide that there shall be no increase in the peak
flow runoff to said channel or facility. Any required drainage improvements shall be installed prior
to issuance of building permits or bonded to guarantee installation of the improvements.
9. Prior to issuance of the sanitation clearance for a building permit, provide two (2) plot plans and two
(2) floor plans which show the community sewage system and community water system connections
to the proposed addition.

This is to follow-up our conversation regarding a use permit that was issued for an
existing non -conforming church expansion. As the property is located within the
enterprise zone, a question must first be answered -is this a commercial or industrial
land use?
If the proposed use is commercial or industrial in nature, the Enterprise Zone MOU
states that the City of Oroville shall be the planning and subdivision agent for such
development projects. If the project is not considered commercial or industrial, the
processing and permit issuance shall be accomplished by Butte County Planning.
According to a copy of the use permit received by the City, this project was processed
and approved by Butte County, but conditioned to receive,.building permits from the City
of Oroville. This is a strange combination for permit issuance and it would appear that
we still have not answered the first question - is a church a commercial or industrial
use? We, City and County Planning, should mutually determine the answer and stick
with it.

At the regular meeting of the Butte County Planning Commission held January 14, 1999, your request
for a Use Permit to allow the expansion of a pre-existing church, was approved subject to the conditions
listed on the enclosures. Please sign both copies and return both copies to this Division within 40
calendar days.
Should you desire to appeal any of the conditions imposed by the Planning Commission, you must do
so in writing, to the Clerk of the Board of Supervisors, 25 County Center Drive, Oroville, California,
prior to 5:00 p.m., Monday, January 25, 1999. The appeal fee of $50.00 must be paid at that time. If
you do not appeal and if there are no other appeal within the 10 calendar -day appeal period, the action
of the Planning Commission is final.
A Notice of Exemption (NOE) should be filed for purpose of completing the California Environmental
Quality Act Requirements. The fee for filing the NOE is a $25.00 document handling fee. A check
made payable to the Butte County Treasurer in the amount of $25.00 should be submitted to the
Planning Division in order to complete the process.
Please be aware that failure to return the signed copies within 40 calendar days will invalidate the
Planning Commission's approval. Re-application to this Division would then be necessary.
The Use Permit is deemed granted when the enclosures have been signed by the applicant, with the
counter signature of the Chairman of the Planning Commission, and said permit is received by the
applicant by registered mail.

PROJECT DESCRIPTION: The existing church structure is 1,841 sq. ft. in size. The proposed
expansion is approximately 936 sq. ft. in size (including handicapped ramps) and is to be used for
Sunday school purposes. According to the applicants, the church was established in 1928, a time
when there was no zoning in the County. The existing church use is considered a pre-existing,
nonconforming use. The church congregation is very small, with approximately 12 families (roughly
40 people total) attending on a regular basis. In addition to Sunday morning services, classes are held
on Sunday, Tuesday, and Friday nights.
The expansion will require the removal of an existing 295 sq. ft. (approx. 30' x 10') addition to the
church and the removal of a concrete slab. The actual building expansion will add 864 sq. ft. (24' x
36) to the church, with handicapped ramps located on the north and west sides of the new building.
Vehicle circulation on the site is via a gravel driveway located behind the church, running between
B Street and Burlington Avenue. The property is connected to public water and public sewer systems
(OWID & LOAPUD). A fire hydrant is located approximately 70 feet southeast of the site. Land
uses in the project area consist of single family dwellings at urban densities and a public park (Martin
Luther King Park), which is located on the east side of the site. There are no curbs, gutters, or
sidewalks along Burlington Avenue or B Street.

The project site is located within the Oroville Enterprise Z ne and the City of Oroville is the
approving agency for Use Permits for commercial uses in th nterprise Zone. This Use Permit is
for a non-commercial use and, therefore, the County is the pproving agency. However, building
permits for the expansion will be issued by the City of Oroville. The City of Oroville did not object vAJVVOA
to this project and did not recommend any conditions for approval.
CEQA ISSUES: This project is categorically exempt from the provisions of the California
Environmental Quality Act under a Class 3 Exemption.
ANALYSIS: The proposed church expansion is consistent with the Butte County General Plan
Medium Density Residential land use designation which allows quasi -public uses as a secondary use.
The R -N zoning district allows quasi -public uses with a Use Permit. The church use is considered
to be a quasi -public use.
The church use was established 70 years ago and no significant land use conflicts have occurred due
to this use. The 864 sq. ft. expansion will be used for Sunday school/youth room/Bible study
purposes and will consist of one room. The proposed expansion will not increase the seating capacity
of the church sanctuary. No additional vehicle traffic will be generated due to the proposed
expansion.
The proposed expansion will place the church structure approximately 6 feet closer to the north
property he than its current position. There will be approximately 27.5 feet between the church and
the property line. A house is located five feet beyond the north property line. The occupants of this
house could be impacted by construction noise during the building of the new addition. However,
this noise will be short term in nature and a condition of this project will limit the hours of
construction from 8:00 a.m. to 5:00 p.m., Monday through Saturday. Additionally, in order to keep
any new lights on the project site from disturbing adjacent residents, a condition of this project will
require that all new outside lighting not create glare and be contained on-site.
Parking area on the site will be slightly reduced due to the expansion. Section 24-240.B of the Butte
County Zoning Ordinance requires that a church provide at least one parking space for each six
individual seats or equivalent in the auditorium or church, or one parking space per 50 sq. ft. of
usable seating area, whichever is greater, plus one space for each classroom or office. The church
sanctuary has a seating area of 525 sq. ft., which requires 11 parking spaces. The seating capacity
is 52 persons, which requires 9 parking spaces. The site plan shows that there will be 11 on-site
parking spaces provided. This number of parking spaces substantially meets the requirements of the
Zoning Ordinance. There is also additional parking available in the parking lot of the Martin Luther
King Park, which is located adjacent to the church.
The Public Works Department is requesting that 30 feet of right-of-way from the centerline of
Burlington Avenue and B Street be deeded to the County. The Public Works Department is also
requesting that an on-site drainage plan be submitted and approved and that the required drainage
improvements be constructed prior to issuance of building permits. However, the applicants can post
a bond with the Public Works Department to guarantee installation of the required drainage
improvements.

The Butte County Department of Public Works is requesting that the applicant submit road and
drainage improvement plans for the installation of street frontage improvements on Burlington
Avenue and B Street. The street improvements are required because the site is located in the
Oroville Urban Area and County ordinance requires street improvements in this area. The road is to
be improved .to the RS -2A County Standard (vertical curb, gutter and sidewalk and the required
street section). The RS -2A standard requires a 36 ft. paved roadway, 2.5 ft. wide gutters and a 5 ft.
wide sidewalk. There are no improved curbs, gutters, or sidewalks in the immediate area of the
project site, and the closest street improvements are on Fallbrook Avenue, two streets over from the
project site. Because these will be the only street improvements in the area, staff is recommending
that the applicants sign and record a covenant agreeing to install the improvements at some point in
the future when the Department of Public Works requires that the street improvements be installed.
The covenant runs with the land and is binding on any future land owners.
RECONUMENDATION: Staff recommends that the Planning Commission approve Use Permit UP
99-08 for James and Esther Thompson, subject to the following findings and conditions found in
Exhibit "A."
I. FINDINGS
Section 1: Environmental Findings.
A. This application has been determined to be categorically exempt from the provisions of the
California Environmental Quality Act under a Class 3 exemption (Section 15303(c)),
construction of new, small structures; and
Section 2: Zoning Ordinance Findings.
A. The proposed use of the property will not impair the integrity and character of the zone in
which the land lies, and that the use would not be unreasonably incompatible with, or
injurious to, surrounding property, or detrimental to the health, safety and general welfare of
the persons residing or working in the neighborhood, or to the general health, welfare and
safety of the County because:
The expansion will not increase the seating capacity of the church and will not cause
an increase in vehicle traffic or parking needs; and
2. The expansion will not increase the noise levels in the project area; and
3. There is sufficient area on the project site for the required number of parking stalls;
and
4. The church use has been on the property since 1928 and no land use conflicts have
occurred due to this use; and

B. The proposed project is a Secondary. Use under the Medium Density Residential General Plan
Land Use designation and is conditionally consistent with the R -N (Residential -
Nonconforming) Zoning District; and

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: James and Esther Thompson are hereby granted a Use Permit in accordance with
application filed: Use Permit to allow an expansion of a pre-existing church.
Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit, constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must
be completed prior to, or concurrently with, the establishment of the granted use. The use
granted by this permit must be established within 24 months of the delivery of the
countersigned permit to the Permittee.
.3. If any use for which a use permit has been granted is not established within two years of the
date of receipt of the countersigned permit by the Permittee, the permit shall become null and
void and reapplication and a new permit shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
5. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by the
applicant, or their respective designee. ' Prior to such approval, verification shall be made by
each Department or Division that the modification is consistent with the application, fees paid
and environmental determination as conditionally approved. Changes deemed to be major or
significant in nature shall require a formal application for amendment.

CONDITIONS OF APPROVAL
Planning Division
The project site shall be developed in accordance with the approved project site plan and the
conditions contained therein. Said site plan is on file in the.Planning Division and is identified
as Site Plan, dated 10-28-98.
2. Obtain building permits from the City of Oroville.
3. All new external light fixtures shall be shielded in a manner that insures direct light does not
produce glare or project beyond property boundaries.
4. Hours of construction shall be limited to 8:00 a.m. to 5:00 p.m., Monday through Saturday.
5. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
Public Works Department
6. Prior to the issuance of building permits deed, to Butte County, in fee simple, 30 feet of right-
of-way from the centerline of Burlington Avenue and B Street. The right-of-way shall be
sufficient for the installation of standard No. S-5 at all street intersections.
7. Prior to the issuance of building permits submit road and drainage improvement plans for the
installation and construction of the street frontage improvements on Burlington Avenue and
B Street to RS -2A standard, including, but not limited to, P.C.C. curb, gutter and sidewalk
and the required street section for parcels with gross acreage of one acre or less. Prior to
issuance of a building permit, install the required road and drainage improvements or sign and
record a covenant agreeing to install the improvements when required to do so by the County.
8. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be
submitted to and approved by the Department of Public Works. The drainage plans shall
specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural
or publicly maintained drainage channel or facility. and shall provide that there shall be no
increase in the peak flow runoff to said channel or facility. Any required drainage
improvements shall be installed prior to issuance of building permits or bonded to guarantee
installation of the improvements.

9. Prior to issuance of the sanitation clearance for a building permit, provide two (2) plot plans
and two (2) floor plans which show the community sewage system and community water
system connections to the proposed addition.

I made changes to the agenda report per your comments. I dropped the condition to meet the
requirements of the El Medio Fire District. I talked with Stu in the Land Development Division and
found out that the landowner can sign a covenant agreeing to install the required road improvements
at some time in the future when the County determines they should be installed (please see the
attached covenant fo ). The required drainage improvements have to be installed prior to issuance
of building permits,however, the applicants can post a bond with the Public Works Department to
guarantee installation of the improvements] Ul e- T4 5

1. Construction, installation or development of structures or facilities on the parcels/lots shall comply
with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other
applicable State and County codes, ordinances and regulations in effect at the time of application for
improvement permits.
Building identification and/or addresses shall be installed in conformance with Public Resources Code
4290 and shall be posted at the beginning of building construction and maintained continuously
thereafter.
—3. Fire hydrant identification, reflector or post reflectors shall be installed acceptable to the County Fire
Warden.
4. In lieu of a pressurized water system or water storage tank, payment of $200.00 per created parcel
into the Battalion _ water tend fund, is required prior to the issuance of a building permit.
5. A pressurized community water system for fire protection is required. The specific locations and fire
flow requirements shall be in accordance with the Fire Department specifications and to the
satisfaction of the County Fire Warden. Average required hydrant spacing _ feet, hydrant size _
inches, and residual fire flow _ gpm. Submit plans to the Fire Department for review and approval
prior to construction of facilities.
6. In lieu of hydrant installation, payment may be made into the hydrant fund at a cost of $1.72
per lineal foot of street frontage. The estimated fee amount is $

access points.
B. DRAINAGE
1. Prior to the recordation of the issuance of building permits a plan for a permanent solution for
drainage shall be submitted to and approved by the Department of Public Works. The drainage plans
shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or
publicly maintained drainage channel or facility and shall provide that there shall be no increase in
the peak flow runoff to said channel or facility.
2. Prior to the issuance of building permits establish 100 year floodplain elevations and the lowest floor
elevations for any structures. Show on the site plan map for building permits the elevations (by
contours) and the location of an accepted NVGD benchmark and a temporary benchmark on-site.
C. LEGAL LOT STATUS
Prior to the issuance of the Use Permit, prove, to the satisfaction of the Director of Public Works, that
the parcel of the subject application is a legal parcel.

J. SITE DEVELOPMENT
1. The project site shall be developed in accordance with the approved project site plan and the
conditions contained herein. Said site plan is on file in the Planning Division, is identified as
"Exhibit B" and dated 19_ and is incorporated herein by this reference.
2. Prior to the issuance of building permits, the plans, incorporating all applicable conditions of approval
shall be submitted to the Planning Division to verify compliance with said conditions of approval.
3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing
gates and a solid or semi -open shade cover. Plans to be reviewed and approved by the Planning
Division prior to construction.
Prior to any use of the project site or business activity being commenced thereon, pursuant to this
permit, conditions of approval contained herein shall be completed to the satisfaction
of the Planning Division.
5. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical
boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall
be to the satisfaction of the Planning Division and in compliance with the Building Division.
K. LANDSCAPING
1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and
approved by the Planning Division prior to the issuance of building permits.
2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular
access, shall be provided to and approved by the Planning Division prior to the issuance of building
permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of
mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches
in diameter, 4 feet from ground level.
Mature trees removed shall be replaced by planting replacement trees of equal number and not less
than _ gallon size.
All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash,
and debris, during the term of this permit.
4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted,
mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system
shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted
to guarantee installation and established growth.
5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall
be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved

area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree
species shall be approved by the Planning Division prior to planting.
6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak
trees which are to be retained as part of the project, shall be fully protected through the use of root
protection zones (RPZ). During construction, RPZs shall be established using protective fencing
enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this
protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed.
The RPZs shall be maintained after the completion of construction in order to continue to protect the
oak trees, but the fencing shall be removed.
L. GRADING
During construction, should any archaeological artifacts be discovered, the Planning Division shall
be notified immediately, and all work shall cease until a qualified archaeologist has examined the
artifacts and the site and submitted his or her findings to the Planning Division, and recommended
clearance to continue. Recommencement of construction shall be upon the approval of the Planning
Division. Archaeological artifacts are defined as follows:
—2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain
and/or streambed the following entitlements must be obtained: a California Fish and Game 1604
Streambed Alteration permit and an Army Corps 404 permit or exemption certificate.
M. ADDITIONAL APPROVALS
1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact
Fees shall be made.
2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall
execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee.
3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or
other agricultural use of the property, the property owner shall enter into the County approved
Orchard Management Agreement. The agreement shall terminate
in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The
agreement shall be recorded and recording fees paid by the applicant.
4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and
all other applicable State and County laws and regulations in effect at the time of building permit
application.
5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it
shall expire (unless the approving authority has held a hearing thereon and granted an extension. In
connection with such an extension the approving authority may add, change, or delete conditions.
6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been
granted is not established within two calendar year from the date of approval. No formal cancellation
or revocation action by the County will be necessary.
—7. The developer shall display a current County Zoning and County Land Use Map in the sales office
at all times, and/or suitable alternatives.
8. Approval of this application does not become effective unless, prior to 4:00 p.m. on
199 the applicant shall sign and file with the Department of Development Services an Indemnity
Agreement in a form satisfactory to the County Counsel.

—9. Prior to the issuance of a building pernut or prior to the issuance of a Use Permit for a Mobile Home
Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article
II of the Butte County Code. The fee amount shall be determined and calculated as of the date of
application for building permit.
10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and record the CSA
87 Traffic and Drainage Mitigation Agreement or pay the required fees prior to the issuance of the
Use Permit.
11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax Collector's
Office to begin the process of a Transient Occupancy Registration Certificate. A Transient
Occupancy Registration Certificate shall be required within ten (10) days after commencing business
for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobile
home park, recreational vehicle park, campground, or parking area (See Chapter 23A).
12. Prior to the issuance of the Use Permit, the applicant shall pay all outstanding County fees

WHEREAS, the undersigned are presently the owners of that land commonly known as

WHEREAS, said owners propose to develop said land by parcel map or a commercial or multi-
family development, and hereby specifically agree that when the County of Butte determines in its
discretion that it is in the best interest of this particular area to install curbs, gutters and .sidewalks, or
other urban improvements, the undersigned or their successor in interest, upon notification by County of
Butte, hereby consent to said installation and agree to install the same upon demand of the County, at
their own expense or at the expense of their successor in interest. The undersigned or their successor
in interest, hereby agree that such improvements may be installed by County and become a lien upon
the property.
The undersigned hereby agree to cooperate and support the County of Butte in obtaining the
permission and approval of property owners within any assessment district, within which the above-
described property is included, formed for the purpose of installation of curbs, gutters, sidewalks or other
urban improvements.
In consideration of the foregoing and other good and valuable consideration, the undersigned
