In the matter of the application for a license by Elmo Myrrl West and Mark Paul West, Tuscan Ridge Golf Course, 3100 Skyway, Paradise, the local approving body, the Butte County Planning Commission approved the issuance of a Letter of Public Convenience or Necessity in support of this application on February 9, 2006. The Butte County Sheriff. Department had no objection to issuance of the requested license. DATE: February 1,.2006 Department of Development Services Planning Division Background: Pursuant to State law, the Department of Alcoholic Beverage Control (ABC) has determined that the Tuscan Ridge Golf Course, which is located at 3100 Skyway, Paradise, Assessor's Parcel Number 040-520-103; is in an area with an . "undue concentration" of establishments selling alcoholic beverages. Therefore, pursuant to Business and Professions Code Section 23958.4, the requested license can only be issued if the local governing body, or its designated subordinate body, determines that the public convenience or necessity would be served by the issuance of the license. Elmo Myrrl West and Mark Paul West have applied on November 22, 2005 to the Department of Alcoholic Beverage Control for a Type 40 liquor license for the Tuscan Ridge Golf Course (see application her attached). The Type 40 liquor license (Bar, Tavern) authorizes the sale of beer for consumption on or off the premises where sold. No wine or distilled spirits may be on the premises. Full meals are not required; however, sandwiches or snacks must be available. Minors are allowed on the premises. By law, ABC must deny the application unless Butte County provides a Letter of Public Convenience or Necessity by February 22, 2006. Use Permit: The golf course use was established by Use Permit 99-10, approved August 11, 1999, granted to Chico Golf Ventures.. Four phases were approved in the original use permit, as.described in the attached Project Description from UP 99-10 environmental review: • Phase 1: Gold Learning Center and Driving Range • Phase 2. First Nine Holes and Maintenance Compound • Phase 3. Second Nine Holes • Phase 4. Clubhouse Development ABC Public Convenience or Necessity MEMO, Tuscan Ridge Golf Course; APN 040-520-103, February 1, 2006 1 The golf course is currently operating the first three phases of approved uses at the facility. The application for "on -sale" beer -only license is related to the existing pro -shop and eventual Phase 4 clubhouse development. The current owners are making some progress on compliance with the conditions of approval of the original use permit UP 99-10. However, as detailed in the March 10, 2005 letter to the applicants (here attached) Condition #18, Road Improvements and Condition # 8 Waste Discharge Requirements have not yet been met. Food Service/ Health Department Requirements: As mentioned above, a Type 40 liquor license requires that, at minimum, sandwiches or snacks must be available within the facility. The golf course has constructed the necessary space for a deli/snack bar within the existing pro -shop building. However, such a deli/snack bar must be licensed by the Butte County Health Department to serve food. The operators have already applied for the necessary permit. However, before that permit can be issued, the operator must receive approval of the state Water Quality Control Board for the on-site "package" waste water treatment system (as described below). In addition, the Butte County Environmental Health Department must determine that the capacity of that plant is adequate to serve the existing facilities and proposed deli/snack bar uses. Although the operator has a certificate for the on-site well, it is not yet licensed as a "small water system" appropriate to serve the needs of the proposed food service facilities. Also, the application fees for such licensing have not yet been paid. At the time of this report the operator was still engaged with the Environmental Health Department in water quality testing to secure the "small water system" license. . Use Permit Condition # 8 Waste Discharge Requirements: The applicant has purchased and installed a "package" treatment system. Prior to the installation of this system, the applicant had used portable toilet units. The applicant's engineers, North Star Engineering are preparing a certification to the state Water Quality Control Board (WQCB) to satisfy the requirement for discharge from this facility. The applicant's engineer estimates that this certificate should be ready by the time of the Planning Commission hearing on the ABC license request. In the meantime, a tank storage system has been installed to collect the wastes. The applicant's engineers project that this storage system will be adequate until WQCB approves discharges from the package system. The package system includes an overland flow evaporation area that will be used for discharge of the treated waste water during non -rain months. Use Permit Condition #18, Road Improvements: The Public Works Department reports that although an encroachment permit was been approved and some of the required access road improvements were built, these improvements have not yet been completed. To date, only the improvements required for Phase 1 of the use permit uses have been started. While the entry access drive has received some paving, it does not meet the RS -8 -LD -IV Butte County Road Standard as required in Condition #18. Public Works also has some concerns about the alignment of the internal road and its curves. Also, the public works Department commented that the acceleration and deceleration lanes provided on the Skyway are only adequate for the Phase 1 portion of the development. The second "nine holes" expansion which is already in use (Phase 3) requires improvements to those lanes and other infrastructure that have not yet begun. ABC Public Convenience or Necessity MEMO, Tuscan Ridge Golf Course, APN 040-520-103, February 1, 2006 . 2 Parking: To date the operator has provided only the 40 parking spaces required for Phase #1 of the development. Fifty-two spaces are currently in place at the pro -shop, but are only chip -sealed and do not meet County standards for the facility. Phase #2 of the use permit (already in place) required that the operator expand the spaces to 102 total. Butte County Sheriff. Comment: Development Services staff conferred with the Butte County Sheriff who had no objection to the approval of the upgraded license. ACTION FOR CONSIDERATION: Staff recommends that the Planning Commission take some of the following action (OPTIONS): I. Approve the request for Letter of Public Convenience or Necessity to the Bureau of Alcoholic Beverage Control regarding application for "on -sale" beer -only Type 40 license, for Elmo Myrrl West and Mark Paul West, at the Tuscan Ridge Golf Course, 3100 Skyway, Paradise, APN 040-520-103. Project Description: This is a proposal to construct a par 72,.7,100 -yard, 18 -hole daily -fee golf course with driving range, clubhouse and support facilities on a 180 -acre site within a 352 -acre parcel. The proposal will be developed in four phases as described below. This phase involves the development of a modem driving range with target greens, forty tee spaces, chipping and putting greens and.a 1,200 sq. ft. administrative building that will include a PGA golf shop, limited food and beverage sales, and restrooms. A 40 -space gravel parking and private entrance road shall be developed, providing for year-round access. An irrigation pump station will be housed in a small shed, and other small portable sheds shall be developed to house maintenance equipment. A small diesel powered electric generator will be used to supply power needs until electrical utility service becomes available. This phase of development will include a modular wastewater treatment system to be approved by the Central Valley Regional Water Quality Control Board. The private road will serve as access directly from the Skyway, a county maintained road. This road is a through road which serves additional parcels to the south. This phase involves the construction of the first nine holes of the 18 -hole golf course. These holes are the front holes of the golf course, generally grouped to the northwest. The initial 40 -space parking area shall be expanded to 102 spaces. The private access road shall be paved at this time. Portions of, or all of the golf cart paths will be paved with asphalt or concrete. This phase will also includes development of a maintenance compound. This involves the construction of a 2,000 sq. ft. maintenance building, a gravel surfaced maintenance yard surrounded by a chain link fence, and a 20 -space gravel parking area for maintenance personnel. A 5,000 sq. $. canopy shall be developed for golf cart storage. This canopy will be located northeast of the administrative building and adjacent to the driving range. An alternative maintenance facility may be developed in the interim, prior to development of the larger facility. This facility will be located on the entrance road across from the driving range. Special events may be scheduled during this phase for promotion of the golf course. Parking for these . events may involve utilization of the parking area for the maintenance facility and road shoulder. This phase involves the construction of the second nine holes of the 18 -hole golf course. These holes are the back holes of the golf course, generally grouped to the southeast. All, parking areas and golf cart paths shall be paved at this time. This phase involves the construction of a two-story clubhouse up to 9000 sq.feet. in size. The clubhouse will include two dining areas, lounge, pro shop, office, kitchen, restrooms and storage. The upper level will include a special function room. The clubhouse will include a food and beverage facility capable of catering to groups of.up to 250 persons. This phase of development will include a larger modular wastewater treatment system. The modular sewage treatment plant described in Phases 1 and 4 will be supplied by a private vendor. This system is described as an advanced batch treatment system and will be professionally engineered for the proposed use. Phase 1 will utilize a 500 -gallon unit. Prior to Phase 4, the system will be expanded to approximately 12,000 gallons to accommodate for increased demand. In this system, effluent is discharged into an underground modular unit where aeration and processing occurs. Prior to discharge, disinfecting with chlorine or other agent is accomplished. The system discharges into a waste water storage and irrigation pond. The pond shall be engineered to accommodate wastewater flows. Additionally, the wastewater will be mixed with well water and certified to be used in irrigation and toilet flushing. The system shall be maintained by the golf course operator and monitored 24 -hours a day. A report of waste discharge will be submitted within 120 days.before any wastewater is discharged. Discharge levels will meet or exceed Waste Discharge Requirements required by the Regional Board. ❑ Butte County Department of Development Services ❑ Planning Division ❑ 2 4 Project: Chico Golf Ventures, Bruce Holderbein, UP 99-10 The placement of the -1 8 -holes may be slightly different than shown on the exhibit as natural features may affect hole design and layout. Golf holes near the Skyway are designed to reduce the probabilities of errant golf balls straying onto the Skyway. Mounding and tree planting will also be developed to help protect the Skyway from errant golf balls. The course shall be designed in such a way as to keep a majority of the trees now present. Any oak trees that must be removed will be replaced on a 3 to 1 basis with oaks or other native trees. The proposed maintenance compound included in Phase 2 will be improved with a sod, or "living roof' to enhance visual quality as seen from the Skyway. This is intended to make the building more compatible with the Scenic Highway Zoning District. Location: The project is located on the southeast side of the Skyway, approximately 1.5 miles east of Rocky Bluffs Drive, east of the City of Chico. 7. Setting: The property is currently undeveloped and used asgrazing land. The area is bounded to the southeast by an abandoned railroad grade, and to the northwest by the Skyway. Characteristic vegetation is of a Foothill -Woodland type and includes mature blue oaks, grey pine, deer brush and manzanita. Numerous songbirds, snakes and small rodents have been observed at the site. The property lies atop Coon Ridge which separates Nance Canyon to the south from Crouch Ravine. Elevation is from approximately 660 -940 -feet. Slopes are from 2 to 15 percent with moderate slopes prevalent except at Crouch Ravine where steeper slopes are located, in the southern portion of the project. Drainage is generally from the north to the south and southwest. A small unnamed draw drains a portion of the northern part of the site into Nance Canyon to the south. The upper slopes of Crouch Ravine drains the remainder of the site. The soil is characterized'as "Scabland" and "Rough, Broken and Stony Land" by local Department of Agriculture soil maps. The area is also known to be underlain by "lava -cap," a rocky substrate that limits soil depth. Mr. Mo West Tuscan Ridge Golf Course,Use Permit (UP 99-10) March 10, 2005, Page 2 Condition #18 as shown above indicates that that the golf course access road will be improved in conjunction with Phase 2 (the first nine holes) to an RS -8 -LD -IV county road standard, and to the satisfaction of the Department of Public Works. Further improvements of this road are not required until Phase 4 (construction of clubhouse) of the golf course becomes operational, and an RS -313 road standard would be required. Phase 4 also requires increasing improvement standards for the encroachment on the Skyway (Condition #17). The Department of Public Works has also commented that they have not been provided any improvement plans concerning the development and alignment of the proposed access road. They have further indicated that this roadway is to have a design speed of 35 miles per hour, which requires a minimum curve radius of 500 feet. Condition #8, Waste DischarIze Requirements Prior to operations the applicant and/or landowner shall submit information related to wastewater treatment and disposal sufficient to allow for Waste Discharge Requirements to be adopted by the CVRWQCB for the proposed modular unit sewage treatment plant. Installation, operation and maintenance of the system shall be the responsibility of the landowner, and must be carried out in conformance with all provisions required by -the CVRWQCB. (Mitigation Measure #5) Condition #8 as shown above requires that the proposed sewage treatment plant comply with the requirements of the Central Valley Regional Water Quality Control Board, for waste generated on-site. Various arrangements were made with the previous operators to allow for operation of the golf course with temporary toilets, provided they complied with deadlines concerning the provision of a sewer system. This approval was made for a 6 month period that concluded on December 8, 2001. The previous operators never complied with the required deadline. Because there has been ample time provided to comply with this condition, and previous allowances were made by County staff to accommodate construction delays, compliance with this condition is required prior to opening the golf course to the public. No further allowances for temporary toilets will be allowed. •. We are addressing the remaining conditions that were outlined in your letter. Following is a summary of the actions taken with regards the outstanding conditions. Condition 18. Road Improvements. Condition 18 requires that the roadway serving the golf course be constructed to RS -8 -I -D -IV standard., Until Phase 4 of the project, no further improvements will be required. According to DPW, there are no approved plans. @We are currently researching the origin of the plans for the constructed roadway. Failing this effort, we will provide a detailed topographic survey for the constructed improvements and demonstrate compliance or construct the necessary improvements. In addition, we have prepared a description of the easement accessing the property and are in the process of generating an offer of dedication to the County of Butte for public use. Condition 8. Waste Discharge Requirements. The "sewer treatment plant" that is described in the Waste Discharge Requirements (Order No. R5-2002-0035) is a Cromaglass secondary treatment unit followed by chlorine disinfection to a battery of storage tanks. The effluent is to be stored in these tanks during the winter months and applied to a 10,000 square foot overland flow area for disposal by evapotranspiration. A list of the deficiencies and the repairs made are as follows: Treatment System The electrical wiring to the treatment unit was not completed. We have had the wiring to the pumps and floats completed and there is power to the Cromaglass unit. , The treatment aeration pump is missing. The pump has been ordered and will be installed as soon as it arrives. The plans prepared by NorthStar Engineering for the storage and disposal portion of the system note that the treatment system was to be followed by chlorine disinfection. Because the design of the treatment and disinfection was done by other, there are no plans or details for these components on the storage and disposal plans. We have been unable to locate the plans for the treatment and disinfection portion of the system but have been in contact with Cromaglass engineers to complete this portion of the installation. The contact chamber is not installed but has been ordered. Lift Station to the Storage Tanks and Overland Flow Area The lift. station shown on the plans has been ordered and will be installed per the plans prepared by NorthStar Engineering. A closing pump capable, of transferring the treated effluent to the storage tanks is installed in the closing compartment of the Cromaglass unit and is functional. , Transport Line to the Storage Tanks The transport lines to the storage tanks are installed and capable of transporting effluent to the storage tanks. Wet Weather Storage Tanks The plans show a total of (10) 9,150 -gallon plastic above storage tanks totaling 91,500 gallons. These are to be used during the rainy season to store the treated effluent for disposal in the dry months. There are (6) 9,000 tanks onsite and plumbed at this time. These tanks can provide 54,000 gallons of storage or 108 days of flow assuming a daily flow of 500gpd. The remaining tanks are on order and will be installed as soon as they arrive. The piping needs to be painted for UV protection. The field needs to be planted with Bermuda grass or other suitable vegetation as directed in the Waste Discharge Requirements (WDR). As you know, we are trying to open the golf course as soon as possible. We realize that arrangements made with thee previous owners regarding temporary toilets was not complied with, obviously leaving the County reluctant to allow any concessions regarding the use of temporary toilets. We would like to propose the use of the bathrooms on site that are connected to the treatment system. Granted that this system is not yet fully constructed, we feel that the system can function in its current condition while the construction of the system is completed to full conformance with the WDRs and the plans. Specifically, we are proposing to store the secondary treated effluent from the Cromaglass unit in the existing storage tanks until the complete construction of the system Is completed. No wastewater would be discharged until authorized by the Regional Water Quality Control Board. This will allow the use of the golf course during the completion of the wastewater system construction. There are (6) 9000 -gallon tanks onsite and plumbed at this time. These tanks can provide 54,000 gallons of storage or 108 days of flow assuming a daily flow of 500gpd. When the tank storage reaches 75% of the total storage volume or 40,500 gpd the tanks would be pumped and transported to the Neal Road Landfill as septage. Disinfection would be accomplished during the installation of an inline chlorine contact chamber by introducing the table chlorine to the storage tanks. The effluent would be delivered to the tanks with the pump currently installed in the dosing compartment of the Cromaglass unit until the lift station can be installed. Once the system construction has been completed, the as-builts and O&M manuals will be submitted to the RWQCB for their review at least 60 days prior to initial discharge to the overland field as stated in the Waste Discharge Requirements. In addition, we feel that the current condition of the existing roadway is sufficient to allow for the uses contemplated through Phase 2 of the project. We would be willing to commit to an agreement to suspend operations of the golf course after October 31 st if the construction of the wastewater system is not completed and the required roadway plans and easements are not provided. If necessary, we would also be willing to provide bi-monthly reports of the total stored volume and chlorine concentrations in the tanks. The proposal will be developed in four phases as described below. Phase 1. Golf Learning Center and Driving Rangle This phase involves the development of a modern driving range with target greens, forty tee spaces, chipping and putting greens and a 1,200 sq. ft. administrative building that will include a PGA golf shop, limited food and beverage sales, and restrooms. fA 40-spaceIgravel- -parking and private entrance road shall be developed, providing for year-round access. An irrigation pump station will be housed in a small shed, and other small portable sheds shall be developed to house maintenance equipment. A small diesel powered electric generator will be used to supply power needs until electrical utility service becomes available. This phase of development will include a modular wastewater treatment system to be approved by the Central Valley Regional Water Quality Control Board. The private road will serve as access directly from the Skyway, a county maintained road. This road is a through road which serves additional parcels to the south. This phase involves the construction of the first nine holes of the 18 -hole golf course. These holes are the front holes of the golf course, generally grouped to the northwest. The iiiitial 40 -'space parking area shall be expanded to 102 spaces. The private access road shall be paved at this time. Portions of, or all of the golf cart paths will be paved with asphalt or concrete. This phase will also includes development of a maintenance compound. This involves the construction of a 2,000 sq. ft. maintenance building, a gravel surfaced `maintenance yard surrounded by a chain link fence, and a 20 -space gravel parking area for maintenance personnel. An alternative maintenance facility may be developed in the interim, prior to development of the larger facility. This facility will be located on the entrance road across from the driving range. Special events may be scheduled during this phase for promotion of the golf course. Parking for these events may involve utilization of the parking area for the maintenance facility and road shoulder. This phase involves the construction of the second nine holes of the 18 -hole golf course. These holes are the back holes of the golf course, generally grouped to the southeast. All parking areas and golf cart paths shall be paved at this time. This phase involves the construction of a two-story clubhouse up to 9000 sq. feet. in size. The clubhouse will include two dining areas, lounge, pro shop, office, kitchen, restrooms and storage. The upper level will include a special function room. The clubhouse will include a food and beverage facility capable of catering to groups of up to 250 persons. 'This phase of development will include a larger modular wastewater treatment system. The modular sewage treatment plant described in Phases 1 and 4 will be supplied by a private vendor. This system is described as an advanced batch treatment system and will be professionally engineered for the proposed use. Phase 1 will utilize a 500 -gallon unit. Prior to Phase 4, the system will be expanded to approximately 12,000 gallons to accommodate for increased demand. In this system, effluent is discharged into an underground modular unit where aeration and processing occurs. Prior to discharge, disinfecting with chlorine or other agent is accomplished. The system discharges into a waste water storage and irrigation pond. The pond shall be engineered to accommodate wastewater flows. Additionally, the wastewater will be mixed with well water and certified to be used in irrigation and toilet flushing. The system shall be maintained by the golf course operator and monitored 24 -hours a day. A report of waste discharge will be submitted within 120 days before any wastewater is discharged. Discharge levels will meet or exceed Waste Discharge Requirements required by the Regional Board. ❑ Butte County Department of Development Services ❑ Planning Division ❑ 2 Project: Cbico Golf Ventures, Bruce Holderbein, UP 99-10 The placement of the 18 -holes may be slightly different than shown on the exhibit as natural features may affect hole design and layout. Golf holes near the Skyway are designed to reduce the probabilities of errant golf balls straying onto the Skyway. Mounding and tree planting will also be developed to help protect the Skyway from errant golf balls. The course shall be designed in such a way as to keep a majority of the trees now present. Any oak trees that must be removed will be replaced on a 3 to 1 basis with oaks or other native trees. The proposed maintenance compound included in Phase 2 will be improved with a sod, or "living roof' to enhance visual quality as seen from the Skyway. This is intended to make the building more compatible with the Scenic Highway Zoning District. An erosion control plan will be implemented that will require all graded areas to be seeded or hydro mulched prior -to the rainy season (October 1). The easement accessing the property will be offered to the County of Butte for dedication for public use. During Phase 2 the road will be improved to provide two, 12 -foot traffic lanes with a double sealcoat surface. Traffic calming devices will be included in the design to protect the safety of pedestrians and golf cart occupants crossing the road. During Phase 4 the road will be improved to provide for two, 14 -foot traffic lanes with two -inches of asphalt concrete. 6. Location: The project is located on the southeast side of the Skyway, approximately 1.5 miles east of Rocky Bluffs Drive, east of the City of Chico. 7. Setting: The property is currently undeveloped and used as grazing land. The area is bounded to the southeast by an abandoned railroad grade, and to the northwest by the ` Skyway. Characteristic vegetation is of a Foothill -Woodland type and includes mature blue oaks, grey pine, deer brush and manzanita. Numerous songbirds, snakes and small rodents have been observed at the site. The property lies atop Coon Ridge which separates Nance Canyon to the south from Crouch Ravine. Elevation is from approximately 660 -940 -feet. Slopes are from 2 to 15 percent with moderate slopes prevalent except at Crouch Ravine where steeper slopes are located, in the southern portion of the project. Drainage is generally from the north to the south and southwest. A small unnamed draw drains a portion of the northern part of the site into Nance Canyon to the south. The upper slopes of Crouch Ravine drains the remainder of the site. The soil is characterized as "Scabland" and "Rough, Broken and Stony Land" by local Department of Agriculture soil maps. The area is also known to be underlain by "lava -cap," a rocky substrate that limits soil depth. However, a topsoil layer is present and sufficient to establish growth of understory shrubs and grasses. Small to medium sized volcanic boulders are scattered throughout the site. Please see the Regional Water Quality Control Board's Monitoring and Reporting Program R5-2005-0035, Waste Discharge Requirements Order # R5-2002=0035, and the Standard Provisions and Reporting Requirements attached in the Appendix for more detailed, information. OVERLAND FLOW AREA MONITORING Per the Regional Water Quality Control Board's Monitoring and,,R�porting Program R5-2005- 0035, the overland flow area shall be monitored for ponding and other evidence of failure. This area must be monitored not less than weekly. DISCHARGE FLOW VOLUME The monthly discharge flow volume shall be measured on the last day of leach month and p re orted.>> STORAGE TANK VOLUME The volume of the wastewater in the�torage tanks ,3halt:,be measured on the last day of each month and reported. The storage tanks`mus_fbe completely empty prior to October 31 of each year.\> TROUBLESHOOTING ALARM SOUNDS An alarm is triggered when the liquid± level in one of the tank reaches a level that is higher or lower than it should be:\An alarm can also sound when one of the pumps is not drawing the correct amperage. To silence �the alarm~pushthe-red button on the control panel marked "push to silence". As_soon-as possible, call the appropriate maintenance personnel, but first check the following: ! A N Note the liquid level in,the�tank to see if it is over the alarm float. ��- Tum the pump to, manual to see if it comes on. IMPORTANT Before doing any work on either the wiring to the level control floats and pump in the vault or in the�pump�control panel, set the circuit breaker in the panel to its "OFF" positions, then switch off the power -to the system at the service entrance panel. 1. When a high liquid level.is present, first check the circuit breakers, switches, and fuses in the system control panel. If separate breakers in the main panel were used for the pumps and controls, also check these breakers. If a breaker is found to be tripped, reset the breaker a. nd observe the operation for continuous tripping. - If tripping does not recur, then likely the problem has been found or corrected itself. Test the automatic function of the system as shown in the Operation section of this manual to verify proper operation. Page 7 2. If, after checking the circuit breakers, and switches, the pump still does not operate, move the MOA switch to manual (MAN). If the pump engages, the problem is likely in the float system. If the motor contactor engages, but the pump doesn't, go to step 6. Pump the tank down to a level just above the "Redundant OFF/Low level ALARM" float and return the MOA switch to the automatic (AUTO) position. Do not leave a pump in the MAN position unattended. If you do, the "Redundant OFF/Low level ALARM" float should turn off the pump and sound a low level alarm, however, in the event of a redundant off failure, the pump can continue to run and draw solids to the screen and operate the/pump without liquid, causing potential major failure problems. j 3. Isolate the float switches and check to ensure all floats are operating Jproperly. If a float is found to be faulty, proceed to the section entitled Removing and replacing inoperative floats. 4. Check the pumps for discharge flow. Close' thevalve and disconnect the union in the discharge plumbing assembly and turn the union so that it is facing down. Engage the pump and visually inspect the approximate flow rate `being discharged. If you are unsure of the discharge rate, fill a five gallon bucket with the discha�ge/a nd`time the sequence. Check this value against the appropriate pump curve. If the flow-rate.,is deficient, the pump may have to be cleaned. Refer to the pump manufact rer fiorr pump maintenance details. 5. If the pump operates in the proper flow�range; ,check all dowristream valves to ensure they 1% kare in the open position. If the valves are all open, test the discharge pressure of the pump. Refer to the pump manufacturer for testing'�pumps .~ 6. Check the panel to verify that the (motor contactor engages, but the pump doesn't operate, then it is either a pup/failure or al'bad electrical connection. 7. Remove the— access\riser,lid and, using a phillips screwdriver, remove the stainless steel screws from the'splice boxed, 'being careful'not,to drop the screws into the tank. If the splice box was submerged, or,if there is a crack in the conduit, there may be water in the splice box. If this is, -,the case, remove water„from the splice box with a syringe or other appropriate method'\Carefully check�the splicesto,ensure that they are intact and remain watertight. If e splicesare,found to be watertight, replace splice box lid. In the control panel, carefully tug on each wirelgoing to the splice box. Correct any wires that are loose. Reactivate and retest the system. ”` { 8. If the system operates, but cant keep up with the flow, check the system for watertightness. A leaking tank ca 'Ninfiltr'ate enough water to overcome the pump. Also check for leaking fixtures in the home,` though it is unlikely a leaky fixture could provide enough liquid b overcome the pump. Low liquid level alarm When a low liquid level is present, the source of the problem is likely one of two things. Page 8 1. The tank may be siphoning. Inspect the liquid level in the tank. If the liquid level is below the "Redundant OFF/Low-level ALARM" float, then likely the problem is either a leaky tank or siphoning. Siphoning typically occurs when the system is pumping downhill into the main line. When the pressure is low in the main line and a system operates, even after the pump shuts off, the system may continue to draw liquid from the tank with a siphon action. A system will not necessarily siphon every time it operates. It is dependent on the system design. A siphoning system can be retrofitted with an anti -siphon valve. Most siphoning problems, will manifest in the first months of operation. 2. If the hydraulics of the system do not allow for siphoning,'fthen it is likely that the tank is leaking. Fill the tank to a normal operating level and return ,and inspect the tank at a later time. R5-2002-0035 WASTE DISCHARGE REQUIREMENTS LVOZ FOR CHICO GOLF VENTURES LLC dba TUSCAN RIDGE GOLF CLUB WASTEWATER TREATMENT AND DISPOSAL FACILITY BUTTE COUNTY The California Regional Water Quality Control Board, Central Valley Region, (hereafter Regional Board) finds that: 1. Chico Golf Ventures LLC (hereafter Discharger) submitted a Report of Waste Discharge, dated 26 May 2000, for a proposed discharge of domestic wastewater to land from a golf course wastewater treatment and disposal facility. The golf course, known as Tuscan Ridge Golf Club, is in Butte County about 7 miles east-southeast of Chico, as shown in Attachment A, which is incorporated herein and made part of this Order. The Tuscan Ridge Golf Club includes Assessor's Parcel Numbers 040-010-031, 040-520-087, and 040-520-098 and is in Section 1, T21N, R2E, MDB&M. 2. When completed, the Tuscan Ridge Golf Club will consist of an 18 -hole golf course, pro - shop, administration building, clubhouse, and ancillary facilities on 165 acres of land. The estimated final wastewater flow is 12,000 gallons per day. This Order addresses the golf course in a preliminary phase of development which is nearly complete. The preliminary phase consists of an 18 -hole course (currently 9 holes), driving range, administration building, pro -shop, snack bar, restrooms, roads, parking facilities, and a maintenance yard. The estimated wastewater flow from the preliminary phase is 500 gallons per day. Any increase in flows above 500 gallons per day will require revision of this Order. The Discharger has submitted plans and specification for a wastewater treatment and ' disposal facility to handle up to 500 gpd of wastewater collected from restrooms and sinks. Wastewater will gravity flow to a Cromaglass secondary treatment unit. A lift station will pump treated effluent to 10 plastic above -ground storage tanks having a total capacity of 91,500 gallons. From 1 April through 31 October, treated effluent may be discharged from the storage tanks or the Cromaglass unit to a 10,000 square foot overland flow area for disposal by evapotranspiration. 4. The Discharger currently stores gasoline and diesel fuel in three aboveground storage tanks; a 250 -gallon gasoline tank, a 500 -gallon diesel tank, and a 1000 -gallon diesel tank. The tanks are in an uncovered area over native soil. The tanks lack fail-safe mechanisms and secondary containment. Because total storage exceeds 1320 gallons, the Discharger WASTE DISCHARGE REQUIREMENTS ORDER NO. R5-2002-0035 - 2 - CHICO GOLF VENTURES LLC dba TUSCAN RIDGE GOLF CLUB WASTEWATER TREATMENT AND DISPOSAL FACILITY BUTTE COUNTY must obtain an operating permit by submitting a storage statement and a filing fee to the State Water Resources. Control Board (SWRCB). The Discharger must also prepare and follow a Spill Prevention Control and Countermeasures Plan. The discharge is within the Upper Butte Creek Hydrologic Area (No. 521.30) as depicted on interagency hydrologic maps prepared by the Department of Water Resources (DWR) in August 1986.. Surface water drainage is to Crouch Ravine and Nance Canyon which are tributary to Butte Creek, a water of the United States. 6. Soils at the site are characterized as "scabland" and "rough, broken and stony land" on United States Department of Agriculture soil maps. Soils are typically shallow and overlie rocky volcanic deposits. Butte County staff have indicated the geology is unsuitable for leach field disposal systems. The Tuscan Formation near the surface serves as an aquitard to prevent migration of wastewater to groundwater. 7. Depth to first groundwater is unknown. The Discharger anticipates installing a 1,000 gallon per minute water supply well that is from 600 to 650 feet deep. The closest existing well is over a mile away. Average annual rainfall at the site is about 28 inches, according to Mean Annual Precipitation in the California Region, 1969 (compiled by S.E. Rantz). 9. The disposal area is outside the 100 -year flood zone. 10. The SWRCB adopted Order No. 97-03-DWQ (General Permit No. CAS000001), on 17 April 1997, specifying waste discharge requirements for discharge of storm water associated with industrial activities, excluding construction activities, and requiring submittal of a Notice of Intent (NOI) by industries covered under the permit. This discharge is not subject to the General Permit because the discharge is less than 1.0 mgd. 11. The Board adopted a Water Quality Control Plan, Fourth Edition, for the Sacramento River Basin and the San Joaquin River Basin (hereafter Basin Plan), which designates beneficial uses, establishes water quality objectives, and contains implementation plans and policies for protecting waters 'of the basin. This includes plans and policies adopted by the SWRCB and incorporated by reference into the Basin Plan. These requirements implement the Basin Plan. 12. The beneficial uses of Butte Creek are municipal and domestic supply; agricultural supply; hydropower generation; water contact recreation; warm and cold freshwater habitat; wildlife habitat; migration of aquatic organisms; and spawning, reproduction, and/or early development of fish. 13. The beneficial uses of underlying groundwater are municipal and domestic supply, agricultural supply, industrial service supply, and industrial process supply. WASTE DISCHARGE RPUIREMENTS ORDER NO. R5-2002-0035 - 3 - CHICO GOLF VENTURES LLC dba TUSCAN RIDGE GOLF CLUB WASTEWATER TREATMENT AND DISPOSAL FACILITY BUTTE COUNTY 14. State Water Resources Control Board Resolution No. 68-16 (hereafter Resolution 68-16 or the "Antidegradation Policy") requires the Regional Board, in regulating the discharge of waste, to maintain high quality waters of the State until it is demonstrated that any change in quality will be consistent with the maximum benefit to the people of the State, will not unreasonably affect beneficial uses, and will not result in water quality less than that described in the Board's policies (e.g., quality that exceeds water quality objectives). 15. The discharge will take place only during dry weather to an overland flow area that is designed to maximize evapotranspiration and minimize infiltration. Deep percolation of treated and disinfected effluent is not expected to occur because of the Tuscan Formation. - Accordingly, the discharge should have no impact on waters of the State, which is consistent with the antidegradation provisions of Resolution 68-16. 16. Section 13267(b) of California Water Code provides that: "In conducting an investigation specified in subdivision (a), the regional board may require that any person who has discharged, discharges, or is suspected of discharging, or who proposes to discharge within its region, or any citizen or domiciliary, or political agency or entity of this state who has discharged, discharges, or is suspected of discharging, or who proposes to discharge waste outside of its region that could affect the quality of the waters of the state within its region shall furnish, under penalty of perjury, technical or monitoring program reports which the board requires. The burden, including costs of these reports, shall bear a reasonable relationship to the need for the reports and the benefits to be obtained from the reports." Monitoring and Reporting Program No. 115-2002-0035 is necessary to assure compliance with these waste discharge requirements. The Discharger operates a wastewater treatment and disposal system that discharges waste subject to this Order. 17. The Butte County Planning Commission, on 11 August 1999, approved a mitigated negative declaration in accordance with the California Environmental Quality Act (CEQA), Public Resources Code Section 21000, et seq., and the State CEQA Guidelines. The project, as approved, will not have a significant effect on water quality. 18. The Regional Board has considered the mitigated negative declaration and concurs that impacts on water quality will not be significant, if mitigation measures in the mitigated negative declaration are implemented. Mitigation includes treatment and disposal of wastewater. 19. The discharge authorized herein is exempt from the requirements of Title 27. The exemption, pursuant to Section 20090(b), is based on the following: a. The Board is issuing these waste discharge requirements; b. These waste discharge requirements implement the Basin Plan and allow discharge only in accordance with the Basin Plan; and WASTE DISCHARGE RIPUIREMENTS ORDER NO. R5-2002-0035 _4 - CHICO GOLF VENTURES LLC dba TUSCAN RIDGE GOLF CLUB WASTEWATER TREATMENT AND DISPOSAL FACILITY BUTTE COUNTY C. The wastewater does not need to be managed according to 22 CCR, Division 4.5, Chapter 11, as a hazardous waste. s. 20. The Regional Board has notified the Discharger and interested agencies and persons of its intent to prescribe waste discharge requirements for this discharge and has provided them with an opportunity for a public hearing and an- opportunity to submit their written comments and recommendations. 21. The Board, in a public meeting, heard and considered all comments pertaining to the discharge. IT IS HEREBY ORDERED that, pursuant to Sections 13267 and 13263 of the California Water Code, Chico Golf Ventures LLC, its agents, successors, and assigns, in order to meet the provisions contained in Division7 of the California Water Code and regulations adopted there under, shall comply with the following at Tuscan Ridge Golf Club: A. Discharge Prohibitions The discharge of wastes to surface waters or surface water drainage courses is prohibited. 2. The by-pass or overflow of untreated or partially treated waste from the collection or treatment facilities is prohibited. 3. Discharge of waste classified as "hazardous" as defined in Sections 2521(a) of Title 23, CCR, Section 2510, et seq., or -"designated," as defined in Section 13173 of the' California Water Code, is prohibited. B. . Discharge Specifications The discharge shall not cause degradation of any water supply 12. Objectionable odors originating from the treatment or discharge of wastewater shall not be perceived beyond the limits of the Discharger's property. The wastewater treatment and disposal facility shall be operated and maintained in accordance with an operations and maintenance manual certified by and prepared by, or under the direction of, a California Registered Civil Engineer. 4. Flow to the treatment facility shall not exceed 500 gallons per day. 5. The overland flow area.shall be constructed and operated to preclude ponding of effluent. WASTE DISCHARGE REQUIREMENTS ORDER NO. R5-2002-0035 - 5 - CHICO GOLF VENTURES LLC dba TUSCAN RIDGE GOLF CLUB WASTEWATER TREATMENT AND DISPOSAL FACILITY BUTTE COUNTY 6. The discharge shall remain within the boundaries of the overland flow area at all times. 7. Effluent shall not be applied to the overland flow area at a rate exceeding 0.2 gallons per day per square foot. 8. Effluent shall be applied to the overland flow area only from I April through 31 October, but not during periods of precipitation or if measurable precipitation is predicted to occur within 24 hours of application or if precipitation has occurred within the previous 24 hours. No discharge shall occur between sunset and sunrise. 9. Bermuda grass, or other suitable vegetation that will promote evapotranspiration and nitrogen uptake shall be grown in the overland flow area. Vegetation growing in the overland flow area shall be harvested as needed, but not less than two times during the discharge season. Harvested vegetation shall be permanently disposed of away from the overland flow area and shall not be used as fodder for meat or dairy animals. 14k Public contact with wastewater, including wastewater in the overland flow area, shall be precluded through fencing, signs, and other acceptable alternatives.. 11. The wastewater treatment and disposal facility shall be designed, constructed, operated and maintained to prevent inundation or washout due to floods with a 100 -year return frequency. 12. The wastewater storage tanks shall be empty by 31 October of each year. C. Solids Disposal The treatment unit shall be inspected for buildup of solids and the solids removed as specified in the operations and maintenance manual. Solids shall be disposed of in a manner approved by the Executive Officer and consistent with Title 27, Division 2, Subdivision 1, Section 20005, et seq. D. Groundwater Limitations The discharge,.in combination with other sources, shall not cause underlying groundwater to contain waste constituents in concentrations statistically greater than background water quality. E. Provisions At least 60 days prior to the initial discharge of wastewater to the overland flow area, the Discharger shall submit the operations and maintenance manual for review by the Executive Officer. WASTE DISCHARGE REf#IREMENTS ORDER NO. R5-2002-0035 - 6 - CHICO GOLF VENTURES LLC dba TUSCAN RIDGE GOLF CLUB WASTEWATER TREATMENT AND DISPOSAL FACILITY BUTTE COUNTY 2. At least 60 days prior to the initial discharge of wastewater to the overland flow area, the Discharger shall submit the following, each certified by a California Registered Civil Engineer: a. As -built drawings. b. An engineering report verifying that the wastewater treatment and disposal facility, including all appurtenant features, was constructed in accordance with the plans*and specifications. The engineering report shall also include all leak testing results for piping and tanks and certification that all s ruction complies wit -F county codes and permits. The Discharger shall comply with Monitoring and Reporting Program \ No. R5-2002-0035, which is part of this Order, and any revisions thereto as ordered by the Executive Officer. 4. The Discharger shall comply with the Standard Provisions and Reporting Requirements for Waste Discharge Requirements, dated 1 March 1991, which are incorporated herein and made part of this Order. This attachment and its individual paragraphs are commonly referenced as Standard Provision(s). In the event of any change in control or ownership of land or waste discharge facilities described herein, the Discharger shall notify the succeeding owner or operator of the existence of -this Order by letter, a copy of which shall be immediately forwarded to this office. To assume operation under this Order, the succeeding owner or operator must apply in writing to the Executive Officer requesting transfer of the Order. The request must contain the requesting entity's full legal name, the state of incorporation if a corporation, the name and address and telephone number of the persons responsible for contact with the Board, and a statement. The statement shall comply with the signatory paragraph of Standard Provision B.3 and state that the proposed owner or operator assumes full responsibility for compliance with this Order. Failure to submit the request shall be considered a discharge without requirements, a violation of the California Water Code. Transfer shall be approved or disapproved by the Executive Officer. 6. The Discharger must comply with all conditions of this Order, including timely submittal of technical and monitoring reports as directed by the Executive Officer. Violations may result in enforcement action, including Regional Board or court orders requiring corrective action or imposing civil monetary liability, or in revision or rescission of this Order. 7. A copy of this Order shall be kept at the discharge facility for reference by operating personnel. Key operating personnel shall be familiar. with its contents. These plans depict the as—built state of the wastewater treatment and disposal system at Tuscan Ridge Golf Course. The system as installed can accept typical domestic strength sewage waste from a proposed Clubhouse/Pro Shop at the Tuscan Ridge Golf Course. A Cromaglass package plant equipped with a chlorine disinfection unit has been installed. The plant is designed to treat up to 500 GPD with a maximum organic loading of 300mg/I BOD. The disposal area is sized so that 100% of the tertiary treated effluent is taken up by vegetation through evapotranspiration (ET). The irrigation field will be loaded on the surface and allowed to drain across a slope while creating maximum contact with the vegetation. Loading rates will fluctuate between .1 — .2 GPD/SF. Irrigation will occur during the months of April thru October with storage occurring during the months of November thru March. Power is provided to the system via an onsite generator. This generator must run continuously to provide power to the treatment system until permanent power is provided to the site. The treatment system requires constant power to properly treat the effluent in its batch process. 2. The Cromaglass plant has been designed and specified by others. The plant along with its disinfection unit and lift station shall be installed in the existing railroad cut. They shall be installed per the manufacturers' recommendations. The Cromaglass unit will be set to operate per the manufacturer's recommendations. 3. In order for this system to function properly, all tanks, collection lines, and distribution lines shall be watertight. Gravity lines shall withstand 40 psi for 30 minutes and all pressure lines shall withstand 100 psi for 30 minutes. The 2" Diameter gravity line between the storage tanks and the irrigation manifold shall be buried up to the manifold. If the manifold is exposed it shall be made of UV resistant PVC or covered with a protective coating. 4. All pipes shall be clean and free of debris before connecting the pump to prevent clogging of the orifices. Grommets shall be used for all pipe penetrations to ensure a sealed environment. 5. All pressure lines and fittings shall be Schedule 40 PVC. All pressure transport piping shall be uniformly supported along the trench bottom. 6. All valve enclosures and manhole lids shall be installed so that the lid is approximately 2" above the surrounding finish grade. Surface drainage should be directed away from the lids. 7. The storage tanks shall be installed above grade on a level surface with a minimum 6" thick rock base. All tanks shall be installed at the some grade and connected at their base with a 2" diameter pipe so that they all share the same liquid level. The outlet of the last tank must be at least 2' above the first irrigation manifold. The first and last tanks in the series will be equipped with an aluminum ladder and liquid level gouge. 8. A 2" Dia overflow pipe shall be installed in the top of one of the tanks below the tank lid and directed into the gravity discharge line. The irrigation line that will deliver water from the golf course to supplement the treated wastewater in order to keep the disposal area healthy during peak ET periods shall enter a storage tank at least 6-12" above the overflow. This will prevent the chance of siphoning treated effluent into the water system. 9. The pump control panels shall be located on an adequate support structure in visible sight near the plant and lift station. The panels shall be installed in a weather—protected location approved by the Engineer. Ensure all electrical connections in the splice box are watertight. 10. The contractor shall coordinate all construction with the owner or the owner's representative, Butte County Environmental Health, and the Engineer. The system layout as shown on this plan is approximate and may be altered only with the approval of the County and the Engineer. Sufficient care shall be taken to limit damage to existing trees and landscaping. 11. The discharge plumbing and splice box should be arranged in the lift station to allow for easy maintenance of the pump vault filter. All float and pump cords should be coiled above the pump vault to prevent hanging up of any floats. The pump discharge assembly should contain a ball valve and union for ease of maintenance. 12. The discharge plumbing in the Cromaglass unit is an Orenco Systems Inc. P300511 pump. This shall be replaced with a Liberty S25A1 X hp pump as specified by Cromaglass. 13. The 2" Dia pressure line shall be sleeved at the drainage crossing. The sleeve shall be 4" diameter cast iron or steel with grouted ends. 14. An 80' x 125' irrigation area shall be graded and seeded prior to being dosed. The field must maintain a consistent 3-4% slope across the length of the field to prevent uneven draining or ponding. A 24" high berm made of soil shall surround the perimeter of the field. A 4" diameter pipe shall penetrate through both sides of the wall with a rock bedding surrounding both pipe ends. The discharge side shall contain a gate valve that will allow the area to be drained during rainy periods. 15. A minimum 4' high chain link fence shall be installed around the perimeter of this berm labeled with the appropriate DO NOT ENTER signs. The grass must be mature and healthy prior to a dosing period. The field shall be broken into two zones and distributed as described in the manifold detail. 16. Lift Station Material Specifications: — A High Head Pump Package supplied by Orenco Systems Inc. shall be used in the lift station. The pump will -be controlled on demand with floats set to achieve a 80` gallon dose to the storage tanks, approximately 2 minutes per cycle. — TKe Control Panel shall be manufactured by Orenco Systems, Inc. model S1—R0. WASTEWATER TREATMENT SYSTEM NOTES 1. The treatment tank is a sequential batch reactor (SBR), model CA -15, manufactured by Cromaglass Corporation. The SBR has a total volume of approximately 1,350 gallons and can treat up to 1500 GPD. Any increase in flows above 1500 GPD or waste strength greater than 300 mg/I BOD will require upgrades to the treatment system and revisions to regulations issued by the State and County. 2. Waste inflow to the SBR comes from the restrooms and sinks located in the Clubhouse/Pro shop. The SBR has three sections to allow treatment of solids and wastewater. Discharge from SBR goes to the pump basin unit (lift station). The primary purpose of the SBR is to provide secondary level treatment such that significant removals of BOD and TSS occur in the discharged effluent, including denitrification of effluent. 3. POWER: Currently, electrical power is supplied to the SBR via an onsite gas—powered generator. Power is required to operate the aeration pump, the discharge pump, and the float switches and high level alarm. 4. The aeration pump in the SBR is a Goulds model WE0311L 1/3 HP. The discharge pump in the SBR is a Liberty model S25A1 % HP. 5. TREATMENT SEQUENCE, OPERATION AND TIMER SETTINGS: Cromaglass treatment system timer settings can be set to treat up to 1500 GPD, although the time clock typically allows 1275 GPD for a 16 hour treatment process. There are normally 6 discharges per day. Maximum discharge will be approximately 260 gallons, allowing a total daily capacity of 1500 gallons. The treatment sequence consists of the following: 1. Aerate 2.5 hr 2. Anoxic 1.5 hr 3. Aerate 0.5 hr 4. Settle 1.0 hr 5. Discharge 0.5 hr Pump #1 (P1) provides the mixing of effluent and air, and is controlled by time clock #1 (TC -1). P1 is energized when the bottom microswitch on TC -1 is in the normally open position. Pump #2 (P2) is the discharge pump and is also controlled by TC -1. P2 is energized when the top microswitch on TC -1 is in the normally closed position. Time clock #2 controls the electrically operated ball valve on the air intake. The anoxic period is created when the ball valve closes, shutting off the supply of oxygen to the aeration pump (P1). TC -1 and TC -2 must remain synchronized to assure that the anoxic period occurs at the proper time in the treatment sequence. Each timer has one "red" pin which must be in the same relative location. Timer Settings TC -1 four sequences of 18 pins out, 6 pins in. TC -2 four sequences of 10 pins out, 6 pins in, 8 pins out. 6. The high water alarm circuit consists of a mercury float switch (AL) in the comminution chamber and an alarm light on the control panel. When the liquid level in the comminution chamber rises to the alarm float, the float switch closes and .,completes the circuit. The alarm light will remain on until the liquid level drops. 7. The SBR unit shall be operated according to the manufacturer's specifications which are included in the Operation & Maintenance Manual prepared by North Star Engineering. This document shall be made available to all contracted maintenance providers responsible for managing the wastewater treatment system. One copy of the manual shall be kept onsite in a convenient location at all times. 8. Solids within the SBR shall be checked and periodically pumped from the unit according to the Operation & Maintenance Manual.
