The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit B" and dated 19_ and is incorporated herein by this reference. 2. Prior to the issuance of building permits, the plans, incorporating all applicable conditions of approval shall be submitted to the Planning Division to verify compliance with said conditions of approval. 3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing gates and a solid or semi -open shade cover. Plans to be reviewed and approved by the Planning Division prior to construction. 4. Prior to any use of the project site or business activity being commenced thereon, pursuant to this permit, conditions of approval contained herein shall be completed to the satisfaction of the Planning Division. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING 1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance. of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. 3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The developer shall display a current County Zoning and County Land Use Map in the sales office at all times, and/or suitable alternatives. 8. Approval of this application does not become effective unless, prior to 4:00 p.m. on _, 199 the applicant shall sign and file with the Department of Development Services an Indemnity Agreement in a form satisfactory to the County Counsel. 9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article II of the Butte County Code. The fee amount shall be determined and calculated as of the date of application for building permit. 10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and record the CSA 87 Traffic and Drainage Mitigation Agreement or pay the required fees prior to the issuance of the Use Permit. 11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax Collector's Office to begin the process of a Transient Occupancy Registration Certificate. A Transient Occupancy Registration Certificate shall be required within ten (10) days after commencing business for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobile home park, recreational vehicle park, campground, or parking area (See Chapter 23A). 12. Prior to the issuance of the Use Permit, the applicant shall pay all outstanding County fees. At any time during the Lease Option Period BCCC shall have the exclusive Option to purchase the BUILDING for the purchase price of Two Hundred Thirty Five Thousand ($235;000.00) Dollars; LOT 6, for Thirty Three Thousand Seven Hundred Fifty ($33,750.00)Dollars; and LOT 5, for Thirty Seven Thousand Five Hundred -($37,500.00) Dollars, all payable in cash at close of escrow. The deposit of $5,500.00 will be credited provided all monthly payments have been paid promptly, and no other expenses have been accrued to CFT. 5. USE AND RENOVATION PERMITS. Within fifteen days after the Effective Date, BCCC shall have prepared and submitted to the County of Butte applications for the Use and Renovation Permits approving the building for church services. BCCC shall at its sole expense, obtain all permits, renovate the interior, including but not limited to; relocation of bath rooms, completing the air conditioning system, ceiling insulation, ceiling lighting, flooring, and exterior work as required. All work to be supervised by licensed Contractors, Engineer, or Architect. BCCC shall furnish to CFT copies of the final revision plan signed by the County of Butte and "an as built plan" signed by the Engineer and/or Architect. Also indicate by measurement on the plan prior location of plumbing in Unit B and Unit C. 6. SUBSEQUENT OFFERS. From the Effective Date and until the Use and Renovation permits are issued, CFT is permitted to accept offers on the building. Should CFT receive such offer of equal or greater value, BCCC shall have the right of First Refusal in meeting the conditions of the offer, or relinquishing all rights under this Agreement. If BCCC does not choose to exercise their First Rights of Refusal, then within thirty days thereafter CFT shall reimburse BCCC for expenses of materials only, expended during this period, but in no case shall the reimbursement exceed Five Thousand Five ($5,500.00) Dollars. This paragraph becomes null and void in either of the following; [a] no other offer is proffered, [b] BCCC has received the Use and Renovation Permits and started work. 7. INCENTIVE FOR EARLY PURCHASE AND ESCROW CLOSING. (i) Should BCCC choose to close escrow on the purchase of the BUILDING on or before June 30, 1999, CFT will sell LOT 6, in the same escrow for an additional One Thousand Dollars. INSURANCE. BCCC, at its expense, shall maintain liability, personal injury and property damage with minimum coverage in the amount of $1,000,000 and shall provide CFT a Certificate of Insurance showing CFT as additional insured. Not later than the tenth of each month BCCC shall famish to CFT Lien Releases on Labor and materials fiunished by suppliers in the previous month. 9. ASSIGNMENT RIGHTS. CFT retains the right to assign, or exchange, this Lease with Option To Purchase Agreement providing all terms and conditions of the Agreement is maintained. 10. PRELIMINARY TITLE REPORT. BCCC has received a Preliminary Title Report, dated. December, 1998, from 1 [id Valley Title and Escrow Company. BCCC has examined this report and accepts the conditions therein. 11. ESCROW AND CLOSING COSTS. BCCC and CFT hereby agree to execute such additional instructions, not inconsistent with this Agreement, as may be reasonably required by the Escrow Holder in order to consummate the transactions of this Agreement. All transactions of the Agreement shall be completed within the Option Period. The costs incidental to the Escrow closing shall be paid as follows: [a] CFT shall pay; The premium for CLTA Title Insurance, (ii) One-half of the Escrow Holder's fees, charges and other miscellaneous expenses in connection with the Escrow, [iii] documentary transfer tax [b] BCCC shall pay; One half of the Escrow Holder's fees, charges and other miscellaneous expenses in connection with the Escrow, [ii] any premium or cost for any endorsements to the Title Policy requested -by BCCC, and [iii] such other costs of escrow as are customarily paid by buyers in Butte County real estate transactions. [c] Real Estate taxes shall be prorated and allocated between BCCC and CFT as of 11:59 of the day prior to the close of escrow, based upon the latest available tax statement. [d] An Escrow Closing Statement shall be prepared by the Escrow Holder showing the expenses charged to each, and approved by BCCC and CFT prior to Closing Day. 12. MISCELLANEOUS. [a] Notices. It contained recommendations, by the Building Department, of what will be needed to convert the structure. Commissioner Lambert questioned the off-site parking. She was concerned that the off-site parking was on a separate parcel. She said the Use Permit goes with the land. She asked what would happen if the leased parcel was sold. Mr. Betts said that one of the conditions of the Use Permit is that the applicant maintain sufficient parking. Mr. Wilson said the applicant did not have sufficient on-site parking when the project was received. The applicant leased the adjacent parcel during the processing of this permit. Commissioner Lambert said this has not been allowed in the past because of the concern that this parcel could be sold and the applicant would not be able to meet the requirement. Chairman Leland noted Condition 1 that states the applicant will maintain sufficient off-street parking spaces. Commissioner Mooney said that on Condition 7, a plan for a permanent solution to drainage, is normally provided for improvements. He said this building is at least 5 years old. He said if it is only for the parking area, the applicant should be able to handle it. Mr. Betts said the developed site has curb, gutter, and sidewalk around to it. Where they are proposing to put the parking lot, does not have curb, gutter, and sidewalk. The hearing was opened to the public. The project site is within the City of Oroville 's Sphere of Influence and the city has prezoned the project site C-2 (Heavy Commercial). Oroville's C-2 zone allows churches with a Use Permit (City of Oroville Zoning Ordinance). Oroville 's General Plan designates the project site as Retail and Business Services which allows a church as a secondary use. The City of Oroville did not object to the project. Surrounding land uses include single-family dwellings to the north (R-1 zoning), a convenience store/gas station to the west (R-4 zoning), and vacant lands zoned R-4 to the east and C-2 to the south. The change from a commercial use to a church use will be compatible with existing land uses in the vicinity because the church use will have fewer impacts then the commercial use. The church will generate less vehicle traffic then the commercial use, and it will not create any significant noise. Peak use of the church will occur on Sunday mornings, `when vehicle traffic in the project area is at a minimum. Mitigation: None required. 2. POPULATION AND HOUSING. The project site is not located near any known earthquake faults (Butte County Constraints Map). The structure that the church will use is already constructed and was built for commercial office purposes. This building will be required to meet the Uniform Building Code (UBC) standards for the change of use from an office (B occupancy) to a church (A-3 occupancy). The Butte County Building Division will ensure that the building meets the UBC standards through the building permit process. The area just to the east of the existing building will be graded for an 8 -car parking lot. Very little grading will be necessary because this area is small (approximately 4, 000 sq. ft.) and is already relativity level. All grading associated with the parking lot will be subject to the requirements of Chapter 70 of the Uniform Building Code. This parking area is proposed to be surfaced with gravel and landscaping will be installed as required per Butte County Code section 24-240.10. This will help to stabilize the soils on the site and help prevent soil erosion. The project is not anticipated to cause an increase in soil erosion. Mitigation: None required. 4. However, air quality has improved over the last three years, and the Butte County Air Quality Management District and Butte County Association of Governments recently submitted a redesignation request to the Environmental Protection Agency to certify Butte County as being in attainment of air quality standards. The Butte County Air Pollution Control Plan does not address the air quality impacts of small developments for possible mitigation measures. A very limited amount of grading will be required for the construction of an 8 -vehicle parking lot. No significant amounts of dust are anticipated to be raised during grading activity because of the small area that will be leveled. This parking area will be covered with gravel and vehicles driving over it could raise dust. Peak hours of vehicle traffic generated by the church will be weekdays 10: 00 a.m. to noon and 7:00 p. m. to I1: 00 p. m., Saturdays 5:00 p. m. to 8:00 p. m., and Sundays 9:00 a.m. to 1: 00 p. m. (Institute of Traffic Engineers Trip Generation Handbook). These peak hours of vehicle traffic generated by a church use do not coincide with normal vehicle traffic -peak hours (7:00 a.m. to 9:00 a.m. and 4: 00 p. m. to 6: 00 p. m. , Monday through Friday). Most vehicle traffic generated by the proposed church is expected to use Monte Vista Avenue for access to the site. This roadway has been classified as a collector street, and has a Level of Service of "C" or better (1995 City of Oroville General Plan). This level of service indicates that vehicle traffic is f lowing freely. The other main roadway that vehicle traffic generated by the church will use is Lincoln Boulevard. Lincoln Boulevard has a Level of Service of "A" (Butte County Master Environmental Assessment). The intersection of Monte Vista Avenue and Lincoln Boulevard may be subject to short term impacts after Sunday morning services when vehicles may be leaving the site in a short period of time. These short term impacts are not expected to be significant because of the minimal number of vehicles leaving the site and because it will not occur during normal peak vehicle traffic hours. Based upon the size of the church sanctuary and the number of offices, a total of 22 parking on-site parking spaces must be provided (Butte County Zoning Ordinance, section 24- 240.B). The site plan shows that there will be a total of 25 on-site parking spaces, including 3 spaces in two garages. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 5. Minor changes may be approved adniiristratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. CONDITIONS OF APPROVAL 1. .Applicant shall maintain sufficient off-street parking spaces to meet the requirements of Butte County Code Section 24.240.B. Any increase in the seating capacity of the church may require a modification to the Use Permit and additional off-street parking spaces. The number of new parking spaces needed shall be determined by the Planning Division. 2. A detailed landscape and irrigation plan for the new parking area shall be submitted to and approved by the Planning Division prior to the issuance of the Use Permit. The landscaping shall meet the requirements of Butte County Code section 24-240.10. The required landscaping shall be installed within three (3) months of completion of the new parking area. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as 'Exhibit B" and dated December 8, 1998, and is incorporated herein by this reference. 4. All new exterior lights shall be fully shielded to prevent glare on adjoining roads and properties. 5. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. 6. Obtain encroachment permit for all new driveway approaches and construct them to County standards, as specified in County Improvement Standards. 7. Prior to the start of construction of the new parking area, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and/or conveyed to the nearest natural or publicly maintained drainage channel or facility, and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Construction, installation or development of structures or facilities on the parcels/lots shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 9. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 10.
