Andrew W. Clay, Use Permit to allow a permanent second dwelling unit on property zoned "U
(Unclassified). The property is located at the end of Dove Court, approximately 1,000 feet off of
Simmons Road, identified as APN 071-400-013, northeast of Oroville. (File UP99-20) (SB)

A video of the site was shown. Mr. Betts gave a brief summary of the project.
Chairman Leland said he had a problem with the double density question.
Mr. Betts said the project was taken in before the new ordinance was adopted and was processed under the
old ordinance. He said property zoned "U" does not have to meet the General Plan density.
Chairman Leland asked how they could have a zoning override the General Plan density.
Mr. Wilson said it is an internal problem with the "U" zone.
Commissioner Lambert said that in many cases the "U" zone is more restrictive.
Chairman Leland said he has to look at this project to see if it fits the character of the neighborhood.
Mr. Wilson said the surrounding parcel sizes range from 6 to 26 acres:
Commissioner Lambert discussed rezoning the property.
Mr. Wilson said the General Plan designation does not fit the area.
Chairman Leland asked how many parcels in the area have a second dwelling.
Mr. Betts said one parcel has a second dwelling that is 640 square feet for senior citizens.
The hearing was opened to the public.
Andrew Clay said he purchased the land in 1986 when it was a 5 acre minimum. He said the area around
him is residential. He said he has a large investment in this property. He wants to keep the first home for
a guest house. He said he has a fire break around the property and has a 4000 gallon water tank for fire
protection.
Commissioner Lambert asked if all the improvements were done with permits and the applicant said yes.
Mr. Betts said there was a letter of intent signed by the applicant to remove the mobile home once the new
dwelling was ready for occupancy or apply for a Use Permit for the second dwelling unit. He said to make
this a guest house the applicant would need to remove the kitchen facilities and it could not be any larger
than 500 square feet.
Commissioner Lambert said she has a concern with allowing a second dwelling on this property.
Mr. Wilson said when you look at the Timber Mountain General Plan designation and the parcel sizes that
exist on the ground, it appears that the designation was put on here to preclude further lot splits.

Commissioner Mooney said the land should be zoned Foothill Residential instead of Timber.
Chairman Leland said when the zoning was put in place, there was an attempt to limit the density to what
exists at the time.
Mr. Wilson said correct, with the stipulation of allowing a second unit with a Use Permit.
Commissioner Cage said it sounds as though the conditions the Commission passed for second dwellings
should be applied to this Use Permit.
The hearing was closed.
It was moved by Commissioner Mooney to approve the Use Permit for Andrew Clay.
The motion died for lack of a second.
Commissioner Cage said she would like to pass on this item, but she did not get an answer to her question.
She said the conditions that the Commission passed are not listed on this report.
Mr. Betts said they did not apply the new conditions and'the new ordinance to this project.
Commissioner Nelson said when the applicant built the new unit there was a stipulation that the old unit
would be removed or apply for the Use Permit.
Chairman Leland said Commissioner Cage could make a motion adding the conditions adopted under the
new ordinance.
Commissioner Lambert asked if the Commission could make a'motion"that incorporates the new ordinance
conditions, when they are hearing this under the old ordinance.
Chairman Leland said this is a discretionary Use Permit, and can be granted with mitigating conditions. He
said he was inclined to not approve this. He said he can not find this consistent with the neighborhood. He
said the area has larger parcels. He said the character of the neighborhood is for less density in this area.
Commissioner Lambert said the applicant can remove the first unit. She said the second unit does not fit.
She said she has a problem with approving this. She said this application does not fit the density, the guest
home criteria, the new ordinance, and it does not fit the his
Plan density.
It was moved by Commissioner Lambert, seconded by Commissioner Nelson, and carried to deny the Us(,-
Permit

of the work he did; and, I did site visit and charged for the whole time I was out of the office but
during that trip I also made a site visit to another nearby project (does this make any sense?).
Anyway, I would like 1.75 hours of my time deducted from the time indicated on the billing sheet -
my time will now be 2 hours.

STAFF CONEWENT:
Staff recommends approval of the Use Permit with conditions and findings. This application was
submitted prior to the adoption of the new Second Dwelling Unit Ordinance.
PROJECT DESCRIPTION/SITE CHARACTERISTICS:
This is a proposal to allow a permanent second dwelling unit. The proposed second dwelling unit,
a mobile home, already exists on the property and until recently was the residence of the applicant.
A new home was recently constructed on the site, which is now the residence of the applicant. The
new dwelling was allowed to be constructed because the applicant signed a letter of intent agreeing
to remove the mobile home or obtain a Use Permit for a second dwelling unit.
The property is developed with the two dwellings, a garage, two septic systems, two wells, and a
water tank. The proposed second dwelling unit is located on Middlefork Lane, which traverses the
site. Access to the new dwelling is via a driveway to Dove Court. The site slopes steeply down to
Lake Oroville. The property is heavily vegetated with oaks and manzanita.

ANALYSIS:
General Plan and Zoning:
The project site is designated as Timber -Mountain by the Land Use Element Map of the General Plan.
Residential uses are allowed by the General Plan as secondary uses. The Timber -Mountain
designation requires a minimum parcel size of 40 -acres, with one single-family dwelling.per parcel.
The project site is zoned U (Unclassified). The Unclassified Zoning District allows second dwelling
units by Conditional Use Permit (Section 24-230.C.1). Second dwelling units in the Unclassified zone
do not have to meet the General Plan density requirements (Section 24-230.C.1).
Surrounding Uses and Compatibility:
Surrounding parcels range in size from 6 to 26 acres and land use on these parcels is rural residential.
An adjacent parcel has a second dwelling unit that is restricted to senior citizen occupancy. The
operating characteristics of the proposed second dwelling unit are such that it will be compatible with
the other residential uses in the area. Simmons Road and Middlefork Road are wide enough to safely
handle two-way traffic. These roads also have a good gravel base in most places and do not contain
any ruts or washouts. Additional vehicle traffic generated by the proposed second dwelling unit will
cause a minor increase in airborne dust which may impact dwellings located near the site's access
roads. The second dwelling unit may generate approximately 10 vehicle trips per day (Institute of
Traffic Engineers, Trip Generation Handbook). However, it is expected that this amount of vehicle
traffic will not be generated due to the remote location of the second dwelling unit. The vehicle
traffic generated by the proposed second dwelling unit is not expected to cause a significant impact
to vehicle circulation in the project area. Simmons Road and Middlefork Road are private roads and
the responsibility of maintaining these roads lies with the property, owners in the area.
Local Agency Review:
The Butte County Environmental Health Division indicates that the property is suitable for on-site
sewage disposal and the two existing septic systems have been installed with the proper permits.
ACTIONS FOR CONSIDERATION:
Staff recommends that the Planning Commission take the following actions:
I. Find that the project is Categorically Exempt from environmental review under a Class 3
Exemption.
II. Approve Use Permit 99-20 for Andrew Clay, subject to the conditions found in Exhibit A and
subject to the following findings:

A. The proposed use of the property will not impair the integrity and character of the
zone in which the land lies, and that the use would not be unreasonably incompatible
with, or injurious to, surrounding property, or detrimental to the health, safety and
general welfare of the persons residing or working in the neighborhood, or to the
general health, welfare and safety of the County because:
The second dwelling unit will not cause a significant increase in vehicle traffic.
2. The second dwelling unit use will not cause a significant increase in noise
levels.
There are sufficient on-site parking spaces for both dwellings
4. - There is adequate area for the required septic systems.
B. The project is consistent with the Unclassified zone which allows second dwelling
units with a Use Permit, and is consistent with Timber -Mountain General Plan land
use designation which allows residential uses as a Secondary Use.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Andrew Clay is hereby granted a Use Permit in accordance with application filed:
Use Permit for a permanent second dwelling unit.
1. Failure to comply with the conditions specified herein as the basis for approval of
application and issuance of Permit` constitutes cause for the revocation of said permit
in accordance with the procedures set forth in the Butte County Zoning Ordinance,
including Butte County Code Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions
must be completed prior to or concurrently with the establishment of the, granted use.
The use granted by this permit must be established within 24 months of the delivery
of the countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public Works upon receipt of a substantiated
written request by the applicant, or their respective designee. Prior to such approval,
verification shall be made by each Department or Division that the modification is
consistent with the application, fees paid and environmental determination as
conditionally approved. Changes deemed to be major or significant in nature shall
require a formal application for amendment.
4. If any use for which a use permit has been granted is not established within two years
of the date of receipt of the countersigned permit by the Permittee, the permit shall
become null and void and reapplication and a new permit shall be required to establish
the use.
5. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and assigns
of the Permittee.

Construction, installation or development of structures or facilities on the parcels shall
comply with the latest California Fire Safe Regulations (Public Resources Code 4290), and
all other applicable State and County codes, ordinances and regulations in effect at the time
of application for improvement permits.
2. Building identification and/or addresses shall be installed .in conformance with Public
Resources Code 4290 and shall be posted at the beginning of building construction and
maintained continuously thereafter. 1.
Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
I hereby declare under penalty of perjury that I have read the foregoing conditions, that they
are in fact the conditions which were imposed upon the granting of this use permit, and that I agree
to abide fully by said conditions.

Construction, installation or development of structures or facilities on the parcels/lots shall comply
with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other
applicable State and County codes, ordinances and regulations in effect at the time of application for
improvement permits.
2. Building identification and/or addresses shall be installed in conformance with Public Resources Code
4290 and shall be posted at the beginning of building construction and maintained continuously
thereafter.
Fire hydrant identification, reflector or post reflectors shall be installed acceptable to the County Fire
Warden.
4. In lieu of a pressurized water system or water storage tank, payment of $200.00 per created parcel
into the Battalion _water tend fund, is required prior to the issuance of a building permit.
5. A pressurized community water system for fire protection is required. The specific locations and fire
flow requirements shall be in accordance with the Fire Department specifications and to the
satisfaction of the County Fire Warden. Average required hydrant spacing _ feet, hydrant size _
inches, and residual fire flow _ gpm. Submit plans to the Fire Department for review and approval
prior to construction of facilities.
6. In lieu of hydrant installation, payment may be made into the hydrant fund at a cost of $1.72
per lineal foot of street frontage. The estimated fee amount is $

H. BUILDING PERMITS
1. Prior to building permit issuance for a new residential dwelling unit(s), the applicant shall pay all
applicable development fees at the rate in effect at the time of acceptance of the application. Such
fees, shall include, but not be limited to: ' Park Fee, School Fee, Drainage Fee, Permit and Plan
Checking Fees, Water and Sewer Service Fees, and Fire Protection Fees. -

existing development, the applicant shall pay all applicable development fees at the rate in effect at
the time of acceptance of the application. Such"fees shall include, but not be limited to: School Fee,

EXISTING STRUCTURES

J. SITE DEVELOPMENT
The project site shall be developed in accordance with the approved project site plan and the
conditions contained herein. Said site plan is on file in the Planning Division, is identified as
"Exhibit B" and dated _, 19_ and is incorporated herein by this reference.
2. Prior to the issuance of building permits, the plans, incorporating all applicable conditions of approval
shall be submitted to the Planning Division to verify compliance with said conditions of approval.
3. Trash receptacle areas shall be enclosed by a 6 foot high solid masonry wall with view obstructing
gates and a solid or semi -open shade cover. Plans to be reviewed and approved by the Planning
Division prior to construction.
4. Prior to any use of the project site or business activity being commenced thereon, pursuant to this
permit, conditions of approval contained herein shall be completed to the satisfaction
of the Planning Division.
5. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical
boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall
be to the satisfaction of the Planning Division and in compliance with the Building Division.
K. LANDSCAPING
1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and
approved by the Planning Division prior to the issuance of building permits.
2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular
access, shall be provided to and approved by the Planning Division prior to the issuance of building
permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of
mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches
in diameter, 4 feet from ground level.
Mature trees removed shall be replaced by planting replacement trees of equal number and not less
than _ gallon size.
3. All landscaped areas shall be inaintained in a healthy and thriving condition, free from weeds, trash,.
and debris, during the term of this permit.
4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted,
mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system
shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted
to guarantee installation and established growth.
—5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall
be provided to reduce heat gain from -the paved surface and to soften the visual impact of the paved
area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree
species shall be approved by the Planning Division prior to planting.
6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak
trees which are to be retained as part of the project, shall be fully protected through the use of root
protection zones (RPZ). During construction; RPZs shall be established using protective fencing
enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this
protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed.
The RPZs shall be maintained after the completion of construction in order to continue to protect the
oak trees, but the fencing shall be removed.
L. GRADING
During construction, should any archaeological artifacts be discovered, the Planning Division shall
be notified immediately, and all work shall cease until a qualified archaeologist has examined the
artifacts and the site and submitted his or her findings to the Planning Division, and recommended
clearance to continue. Recommencement of construction shall be upon the approval of the Planning
Division. Archaeological artifacts are defined as follows:
2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain
and/or streambed the following entitlements must be obtained: a California Fish and Game 1604
Streambed Alteration permit and an Army Corps 404 permit or exemption certificate.
M. ADDITIONAL APPROVALS
Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact
Fees shall be made.
—2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall
execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee.
3. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or
other agricultural use of the property, the property owner shall enter into the County approved
Orchard Management Agreement. The agreement shall terminate
in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The
agreement shall be recorded and recording fees paid by the applicant.
—4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and
all other applicable State and County laws and regulations in effect at the time of building permit
application.
5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it
shall expire (unless the approving authority has held a hearing thereon and granted an extension. In
connection with such an extension the approving authority may add, change, or delete conditions.
6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been
granted is not established within two calendar year from the date of approval. No formal cancellation
or revocation action by the County will be necessary.
The developer shall display a current County Zoning and County Land Use Map in the sales office
at all times, and/or suitable alternatives.
8. Approval of this application does not become effective unless, prior to 4:00 p.m. on
_, 199_, the applicant shall sign and file with the Department of Development Services an Indemnity
Agreement in a form satisfactory to the County Counsel.
9. Prior to the issuance of a building permit or prior to the issuance of a Use Permit for a Mobile Home
Park the Sheriff Facilities Impact Fee shall be paid, pursuant to the provisions of Chapter 3, Article
II of the Butte County Code. The fee amount shall be determined and calculated as of the date of
application for building permit.
10. Prior to the issuance of the Use Permit the applicant or property owner shall sign and record the CSA
87 Traffic and Drainage Mitigation Agreement or pay the required fees prior to the issuance of the
Use Permit.
11. Prior to the issuance of the Use Permit, the applicant shall contact the Butte County Tax Collector's
Office to begin the process of a Transient Occupancy Registration Certificate. A Transient
Occupancy Registration Certificate shall be required within ten (10) days after commencing business
for a motel, hotel, inn, tourist home, bed and breakfast, rooming house, apartment house, mobile
home park, recreational vehicle park, campground, or parking area (See Chapter 23A).
12. Prior to the issuance of the Use Permit, the applicant shall pay all outstanding County fees.
