The project is located at the Yuba Feather Museum, at 19096 New York Flat Road, Forbestown. (UP 99-18) (SB) (VIDEO) A video of the site was shown. Mr. Betts gave a brief summary of the project. Commissioner Mooney said there is an occupancy of 28 people for the church. He said they will run into problems with the Building Division in building this replica. Commissioner Lambert said with the problems related to building this, there could be a problem holding small weddings. Chairman Leland said the Building Division would take care of the problems. The hearing was opened to the public. Bill Warren said he has discussed this with the Building Division and there will be some general exceptions_ He said this is just a replica. Scott Lawrence, Feather River Recreation and Parks District, said he supports this request. Marjory Moore said this is a nice park. She said with the activity at the park; drug use in the area is down. She said the park attracts people from all over. She said schools make trips to the museum and park. She said they are open from Memorial Day to Labor Day.. The hearing was closed. Mr. Betts recommended adding the standard condition regarding addressing, under the Fire Conditions. It was moved by Commissioner Mooney, seconded by Commissioner Cage, and unanimously carried to find that the project is Categorically Exempt from environmental review and approve Use Permit 99-18 for the Yuba Feather Historical Association subject to the findings and conditions listed below, adding a new Condition #6 to read: `Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter." Renumber 6 to 7. I. Find that the project is Categorically Exempt from environmental review under a Class 3 Exemption. II. Approve Use Permit 99-18 for the Yuba Feather Historical Association, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: The proposed chapel will not cause a significant increase in vehicle traffic. 0 BUTTE COUNTY PLANNING COMMISSION ■ MINUTES 0 APRIL 22, 1999 ■ 2. The chapel use will not cause a significant increase in noise levels. 3. There is sufficient on-site parking spaces for visitors to the chapel and for wedding held in the chapel. B. The project is consistent with the Unclassified zone which allows quasi -public uses with a Use Permit, and is consistent with Agricultural -Residential General Plan land use designation which allows a quasi -public use as a Secondary Use. CONDITIONS OF APPROVAL Planning Division 1. All outside lights installed for the chapel use shall be fully shielded to prevent glare on adjacent parcels. 2. Applicant must also comply with all other applicable State and local statutes, ordinances ane - regulations. Building Division 3. Prior to building permit issuance the applicant shall pay all applicable development fees at the rate in effect at the time of acceptance of the application. Such fees may include, but not be limited to: School Fee, Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire Protection Fees. 4. Prior to issuance of building permits obtain an encroachment permit, for the existing driveway approach at the museum. Construct the driveway approach to County standards, as specified in County Improvement Standards. 5. Construction, installation or development of structures or facilities on the parcel shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 6. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. Environmental Health 7. Restroom facilities shall be provided for weddings or special functions held in the chapel. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 5. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. CONDITIONS OF APPROVAL All outside lights installed for the chapel use shall be fully shielded to prevent glare on adjacent parcels. 2. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. 3. Prior to building permit issuance the applicant shall pay all applicable development fees at the rate in effect at the time of acceptance of the application. Such fees may include, but not be limited to: School Fee, Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire Protection Fees. 4. Prior to issuance of building permits obtain an encroachment permit for the existing driveway approach at the museum. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The chapel replica will be located at the Yuba Feather Museum, which is owned by the Feather River Recreation and Park District (a public agency). The museum is operated by the Yuba Feather Historical Association (a non-profit organization). In addition to the museum, there is a small-scale replica of an old -west town. The proposed chapel will be a part of this replica town. The project site also contains the Forbestown Community Hall, a multi-purpose basketball court, picnic area, and pathways throughout the property. Vegetation on the site is mostly pine trees and grass areas. The museum is open Saturday and Sunday, noon to 4:00 p.m., from Memorial Day through Labor Day. Visitors will be allowed access to the interior of the chapel. ' The chapel will have pew seating for 24 people. The applicant proposes to hold an occasional wedding in the chapel. The chapel will not contain any kitchen or restroom facilities. . Surrounding parcels are.zoned Unclassified and Timber -Mountain -1. Land use on these parcels is primarily single family dwellings on 1+ acre parcels. A church is located on an adjacent parcel. ANALYSIS: The Unclassified zoning district allows quasi -public uses with a Use Permit. The proposed chapel is considered a quasi -public use. The proposed use is consistent with the Butte County General Plan Agricultural -Residential land use designation which allows quasi -public uses as a Secondary Use. . According to the applicant, there are approximately 3 to 5 cars at the museum at any one time. There are 16 parking spaces at the museum, and additional parking for 13 vehicles at the Community Hall. The addition of the chapel to the site may result in a minor increase in vehicle traffic in the area. This is not anticipated to have a significant impact due to the small number of visitors to the museum, which is not anticipated to grow significantly as a result of the project. If a wedding is held in the chapel, additional vehicle traffic will be generated. The number of vehicle trips generated by a wedding is not anticipated to have a significant impact because of the limited number of seats in the chapel (24). There is adequate off-street parking to handle the additional vehicle traffic generated by the chapel use and for any weddings held at the chapel. Conditions requested by the Public Works Department, Fire Department, and Environmental Health Division have been added to project approval to address these department's concerns. ACTIONS FOR CONSIDERATION Staff recommends that the Planning Commission take the following actions: I. Find that the project is Categorically Exempt from environmental review under a Class 3 Exemption. II. Approve Use Permit 99-18 for the Yuba Feather Historical Association, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The proposed chapel will not cause a significant increase in vehicle traffic. 2. The chapel use will not cause a significant increase in noise levels. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major. or significant in nature shall require a formal application for amendment. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. 3. Prior to building permit issuance the applicant shall pay all applicable development fees at the rate in effect at the time of acceptance of the application. Such fees may include, but not be limited to: School Fee, Drainage Fee, Permit and Plan Checking Fees, Water and Sewer Service Fees, and Fire Protection Fees. 4. Prior to issuance of building permits obtain an encroachment permit for the existing driveway approach at the museum. Construct the driveway approach to County standards, as specified in County Improvement Standards. 5. Construction, installation or development of structures or facilities on the parcel shall comply with the latest California Fire Safe Regulations, (Public Resources Code 4290), and all other applicable State and County codes, ordinances and regulations in effect at the time of application for improvement permits. 6. Restroom facilities shall be provided for weddings or special functions held in the chapel. If the restroom facilities in the museum are not available, portable chemical toilets shall be provided at a ratio of one toilet for each 50. people. I understand the project to be the construction of a 384 SF chapel as a new addition to an existing historical (museum type facility) which is owned by a public entity. The chapel will be primary used for education or as a display of historical archeticure. The public may enter the chapel to view displays and the interior of the building. Further, there may be occations where the chapel is used for small weddings and in the case of a disaster emergency to house refugees. The chapel will not be used as a normal church with regular gatherings. As you indicate the is not a commercial use. Are there fees for viewing the chapel and fees for weddings? Can more than 30 people fit into the chapel? Food for thought... When an agency has discretionary authority to deny or modify any aspect of a project, the permit process is at least partially discretionary and CEQA may apply. In Centie/a Hospita Assication v. City of Inglewood approval of a 15 bed psychiatric facility was subject to exemption under CEQA Guidelines section 15303, which governs new construction of small structures. (I do not know if there was discretionary authority for approval in this case. When relying on any categorical exemption, the approving agency should be careful to create an adminstrative record showing that the agency fully considered whether the project might cause significant impacts. Is there a "fair agrument" that the project will cause "significant impacts"? The only problem I find with this is that the proposed 384 sq. ft. chapel replica is not a commercial structure and does not fall within the examples given above. However, this exemption specifically states "Examples of this exemption include but are not limited to," which leads me to believe that local agencies can determine what this exemption applies to. Based upon the size'of the chapel and the fact that the primary use of the chapel will be for educational purposes, and not for use as a church, I believe that this exemption can be used for this project. Prior to any use of the project site or business activity being commenced thereon, pursuant to this permit, conditions of approval contained herein shall be completed to the satisfaction of the Planning Division. 5. All electrical and mechanical equipment, including but not limited to air conditioning units, electrical boxes, transformers, and backflow preventers, shall be screened from public view. Screening shall be to the satisfaction of the Planning Division and in compliance with the Building Division. K. LANDSCAPING 1. A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. 2. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. ' 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her fmdings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS _ 1. Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. 2. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. 4. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. Originally the site of Forbestown School, the site has been used for recreation purposes for more than 30 years. Existing improvements consist of a 2,000 sq. ft. community building that is frequently used for meetings, parties, and group gatherings. The District provides maintenance for the building while the Forbestown Advisory Council coordinates its use. The old school building was converted to a museum and has been expanded over the years to include a second story and pioneer town exhibits. The museum is maintained and operated by the Yuba Feather Historical Association and is open Saturdays and Sundays from Memorial Day through Labor Day. The terrain is relatively flat next to the road, tapering down hill to the east. An irrigated turf area between the community hall and the museum was added last year and contains a multi-purpose concrete basketball court and picnic area. A small playground is planned for the near future. The elevation of Forbestown Park is about 2,500 ft. above sea level and is located in a woodland area containing mostly Ponderosa Pine, Incense Cedar, and other vegetation commonly found at that elevation. Soil type varies from clay to clay sand with forest compost over much of the area. Forest vegetation has been opened up in some areas for easier access by the public and wood chips spread along pathways to reduce erosion. A chain link fence surrounds the park as well as the museum grounds. Lighting is also provided in critical areas for added security. Adequate off-street parking exists for normal usage of the park and museum. Overflow parking is available elsewhere in the area for large community events. DESCRIPTION OF THE SURROUNDING PROPERTIES: Forbestown Park is located in a rural area with very low density population. Few residences exist around the park and those that do, are not easily seen due to the terrain and tall trees. New York Flat Road which borders the western boundary of the park is a paved county road with minimal traffic. The Forbestown Ditch, managed by the Yuba County Water District, flows just to the east. A church is located adjacent to the park on the south while a drive way leading to a residence behind the park lies immediately adjacent to the Community Hall on the north. Find that the project is Categorically Exempt from environmental review under a Class 3 Exemption II. Approve Use Permit 99-18 for the Yuba Feather Historical Association, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: 1. The proposed chapel will not cause a significant increase in vehicle traffic. 2. The chapel use will not cause a significant increase in noise levels. 3. There is sufficient on-site parking spaces for visitors to the chapel and forte weddings held in the chapel. B. The project is consistent with the Unclassified zone which allows quasi -public uses with a Use Permit, and is consistent with Agricultural -Residential General Plan land use designation which allows a quasi -public use as a Secondary Use. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to, or concurrently with, the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 4. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment.
