This acknowledgment is necessary so that Mr. Greg Di Loreto of Bravo Building Co., Inc., (BBC) .can immediately resume and complete work that has already begun. A building permit was approved for the above described project by the Butte County Planning Division. BBC then commenced with construction and building. After further review by your agency it was determined that a Butte Co. approval (per a Butte Co. error) should not have been given due to the DFG deer migration protection mitigation measure and a 500 ft. setback. BBC'S project has since been halted. In light of what has taken place the DFG has no other reasonable alternative for this unfortunate situation other than to honor the original building permit. This letter shall serve as our waiver to the 500 ft. setback requirement as it applies here. This does not in any way support further flexibility or softening of our mutually agree upon deer mitigation guidelines. It is important that this exception or waiver for BBC not stand as precedent for further builders to reference, therefore, please submit this correspondence to the public record should later issues arise. Dear Mr. Buford and Mr. Hackney: The Department of Fish and Game (DFG) wishes to resolve the- matter concerning the Butte County Planning Division and the Black Oak Ridge project in Feather Falls, Butte County. This acknowledgment is necessary so that Mr. Greg Di Loreto of Bravo Building Co., Inc., (BBC) can immediately resume and complete work that has already begun. A building permit was approved for the above described project by the Butte County Planning Division. BBC then commenced with construction and building. After further review by your agency it was determined that a Butte Co. approval (per a. Butte Co. error) should not have been given due to the DFG deer migration protection mitigation measure and a 500 ft. setback. BBC'S project has since been halted. In light of what has taken place the DFG has no other reasonable alternative for this unfortunate situation other than to honor the original building permit. This letter shall serve as our waiver to the 500 ft. setback requirement as it applies here. This does not in any way support further flexibility or softening of our mutually agree upon deer mitigation guidelines. It is important that this exception or waiver for BBC not stand as precedent for further builders to reference, therefore, please submit this correspondence to the public record should later issues arise. Please see that alternate mitigation measures are placed on any future building activities by BBC, not as a disciplinary action measure, but for repair of damage already done to the integrity of our interagency deer protection measures. The site may be characterized as mountainous land with two occupied residences at 2181 and 2231 Lumpkin Road and one maintenance building. Additionally there is a helipad, storage Bldg. and caretaker cottage under constructions. Recently, three existing older structures were demolished. One was at the end of and east west ridges approximately 1/2 mile from Lumpkin Road, another was located at 2253 Lumpkin Road and the other at the intersection of APN #5 071-480-001, 00, 007 & 008. Past site activity, indicates logging, road blazing, and residential construction was apparent at various locations on the site. A geotechnical investigation prepared by Kleinfelder Inc. in October, 200 indicated the following: The Black Oak Ridge development is located in the Sierra Nevada Physiographic province. The site is underlain by granitic (quartz diorite) rock of the Bald Rock Pluton. Foliation in the quartz diorite dips steeply to the northeastward. The Cleveland Hill fault, which is part of the Foothills fault zone, located 10 miles southwest of the site, is the closest active fault. The inactive Beg Bend — Wolf Creek fault zone is locatd approximately 2-1/2 miles east of the site. The site is. not within an Alquist-Priolo Earthquake Fault Zone. Lumpkin Road follows a north-east trending ridgeline that divides watersheds of the middle and south forks of the Feather River. The site encompasses the upper portion of Kanaka Creek, which flow northwestward into the middle fork of the Feather River (Lake Oroville located one mile northwest of the site. Site topography slopes steeply downward from the hilltop in the eastern portion of the site (approximate elevation 2,525 feet msl) towards the northwest along the upper Kanaka Creek watershed to the western site boundary (approximate elevation 2,050 feet msl). Maximum vertical relief across the site is 475 feet. A ridge exists along the eastern edge of the property including the .residences at 2181 and 2231 Lumkin Road that provides excellent building sites. Other excellent building sites are located throughout the site and on the aforementioned knoll, at elevation 2280 feet msl, where a older structure was previously demolished. During a field visit in May 2001, standing water was observed above the entry road culvert northeast of the residence at 2181 Lumpkin Road. This appears to be the result of a clogged culvert. No other flowing water was observed on the site. Evidence of seasonal wet ground was evidenced by marshy vegetation in a dry drainage pond approximately 400 feet northeast of the former cottage. This is primarily due to a unnatural low spot and lack of drainage. Existing site vegetation consists of conifer forest with mixed oak, madrone, poison oak, manzanita and other brush. Much of the upper surrounding property is located in the Plumas National Forest an existing residence exists in the abutting private property west of the site on the foothills of Kanaka Peak. Two other residences are located immediately northeast of the site with access from Lumpkin Road. The proposed development of single family residences should easily adapt to and comply with the new zoning of TM -10. (USE PERMIT APPLICATION) "Attachment to "Uniform Application" "Project Description" October 2, 2001 Black Oak Ridge Project Description: The subject site has 2 separate parcels, which comprise approximately 15 areas. Black Oak Ridge LLC is the owner of both parcels as well as 11 other separate parcels (comparison approximately 92 acres) that adjoin these 2 subject parcels. Included throughout, the subject properties are improvements such as existing residences, wells, water storage, septic systems, infrastructure, and other utilities, roadways, storage buildings, caretaker's facility & maintenance buildings. The proposed project includes a private helicopter aircraft landing pad and a private equestrian center with other recreational facilities/areas with water features and associated infrastructure improvement site work. The helicopter aircraft -landing pad will be used for private import and export of passengers and goods, as well as serve as an emergency evacuation and airlift facility. Construction trailers currently exist on the property, which will be removed once the project is complete.
