PROJECT DESCRIPTION/SITE CHARACTERISTICS: • The project is a proposed Certificate of Correction to amend a map by deleting condition #3 of a previously recorded parcel map (Book 146, Pages 80 through 82) recorded on February 26; 1999. • Condition #3 requires a 50 -foot "No Development Zone" on either side of a drainage way extending through the property. • A 100 -foot leach free zone is required on either side of the drainage way. • The source of the water flowing in the drainage way was overflow from a perimeter drainage ditch. • The project site is designated by the General Plan as LDR (Low Density. ANALYSIS: • The project parcels were created by Parcel Map. TPM 97-21 recorded on February 26, 1999. • Condition #3, proposed for deletion, states; "Show on a map a 50 foot No Development Zone along the unnamed drainages located on parcels 2 and 3. The distance shall be measured from the top of the bank of each drainage. Place a note on a separate document which is to be recorded concurrently with the map or on an additional map sheet that states, `Structures, dumping, fill material, and/or excavation shall not be allowed with the 50 feet No Development Zone as depicted.' " • During heavy rain events, water shedding from the adjoining property on the east would sheet flow into a perimeter drainage ditch, overflow the ditch, then over time created the drainage way. • Section 20-91(a)(7) of the Butte County Subdivision Ordinance permits the modification or deletion of map conditions if circumstances have changed since the time the map was recorded. • The change in circumstance is that the drainage ditch has been cleaned, substantially increasing its capacity, and is capable of preventing overflow onto the property. Water is now carried around the perimeter of the property, crosses under Miners Ranch Road at the northwest corner of the property, and then eventually into the West Branch of Honcut Creek. • Per Section 66469 of the Subdivision Map Act and Section 20-91 of the Butte County Code, amendments to a final map are permissible with a certificate of correction. The determination of this Certificate of Correction is under Section 66472.1 of the Subdivision Map Act and Section 20-91(a)(7) of the Butte County Code which allows. amendment when there are changes in circumstances that the condition in its present wording is no longer appropriate or necessary. In order.to approve the amendment, three requirements have to be met. The first is that changes in circumstances which make any or all of the conditions or mitigations no longer appropriate or necessary. Offsite drainage no longer traverses the property. Condition #3 requires a 50 - foot "No Development Zone " on either side of a drainage way extending through the property in order to address flooding potential on site. Because the drainage issue on the adjacent property has been resolved, Condition #3 is no longer necessary. 2. The COC would potentially alter the location of previously approved land uses. It would not alter the right, title or interest in the real property. 4. The amendment conforms to the provisions of section 20-65 of the Butte County Code (BCC) which requires: a) a public hearing by the advisory agency, in this case the Planning Commission, to review the submitted map revision, and associated agency reviews and recommendations, and The public hearing before your Commission satisfies this requirement. b) conformance with applicable design and improvement standards of the BCC, State Subdivision Map Act, and General Plan The requested Certificate of Correction does not conflict with any applicable design or improvements standards; the building setback is not required as a matter of BCC, the Subdivision Map Act, or the General Plan. It was required to address potential flooding issues which have been resolved by improvements to a nearby drainage way. ENVIRONMENTAL REVIEW: • The drainage way has been. eliminated by the repair and cleaning of an existing. periphery drainage ditch. The use of the property will be consistent with a single family home on a 10 acre parcel • This project has been determined to be exempt from the California Environmental Quality Act (CEQA) provisions under Categorical Exemption 15305 Minor Alterations in Land Use Limitations, for areas with an average slope of less than 20% which do not result in any changes in land use or density. The property is used for normal residential and accessory uses, and for temporary storage of house boats as a nonconforming use. The deletion of the No Development Zone will have no effect on allowable land uses or density. We own and operate 16 large houseboats and many smaller boats in our rental fleet. We can take a few of our largest boats.at a time from the lake.to our.dry.boat area for repairs and refurbishment during the off season (Oct to May). Sometimes, we can take one or two boats to J&N's yard for work; but, we cannot provide storage space or working space for other boats. Al Norris, also, has very limited space in his Dry Dock Marine yard. We have hundreds of privately -owned, large houseboats moored in our buoy system; many owners ask for a dry boat area where they can temporarily store their boat. We have no good answer to their requests. Due to the size of these boats, it is essential that the storage area be easily accessible to and from the launch ramp. With these new construction plans we are allocating 4 acres (of the 10) in the rear of property for boat storage. Boats and RV's have always been stored on this property known as Miners' Ranch Storage since Mr. Berry bought it. With the flood of Dec 12 1996 there was a tremendous increase to boat storage due to damage of the boats from Bidwell Marina's buoy breaking. And again in 2002 when Lime Saddle Marina broke from the 125 mph winds there were several houseboats in need of storage and repair. Many of these repairs cannot be done on the water due to State Regulations and , Requirements therefore people were forced to locate a storage facility. Not only is there a need for boat storage but this location within 1 mile from the lake on the same road prevents the hauling of houseboats thru town. We would like to reiterate that this property has been used for boat storage since Mr. Berry purchased it and that the demand for storage continues to be of importance. He is aware that both Code Enforcement and Public Works have been to the site and determined that less than 1000 cubic yards of dirt have been moved. They were not aware of the no disturbance zone on the recorded parcel map. Mr. Bailey has called me on several occasions that he has watched a 10 yard truck make at least four or five trips an hour on the property moving dirt. He says this has been going on for months. According to him they are extending the hours of this type of grading. He has been patient during the whole process and. realized things tend to move slowly. But he mentioned that he might contact Supervisor Beeler, to let him know of his concerns. It used to be one parcel until a Parcel Map was recorded back in February 1999. - When it was one parcel a business operated on the site (on the southern portion). I spoke with the Assessors office and they have no record of a business on the property. The person who registered the complaint believes it was a houseboat storage/storage yard. Over time it appears that it also became a repair facility. There are two problems on the parcels. 1. There are two parcels now. The southern parcel (072-070-020) waE the area where the business operated. Actual limitations on where the business was operating can not be determined. The business use has now spread to the northern parcel (072-070-021). There is no question that what ever the legal nonconforming business is, it is expanding. Solution: Apply for a Use Permit. 2. When the original parcel was split, a 100 foot no development (structures, dumping, fill material, and/or excavation shall not be allowed) was established on both parcels. The property (072-070- 021) is being heavily graded. The concerns are the Parcel Map condition is being violated and the amount of earth being moved on site. The site is about 825 feet above sea level. It has not been determined if the drainage swale/riparian habitat in the no development zone has been filled to allow trucks to move back and forth across the property. The grading of the property has been going on for some time now. This issue really needs to be addressed immediately. Violation of land excavation and filling limitations: Prior to applying for a change of use permit, extensive excavation (est. several 1000 yds.) was completed without permit violating Butte County code. (see foot note 1.) 3. Violation of Butte County "No Disturb Area" designation by extensive earth movement, filling and grading creating area for House Boats. 4. Hazardous Road Condition. Moving huge "Extra Wide Load" house boats onto and off Miners Ranch Rd. at parcel # 072-070-021 is dangerous. Log trucks, gravel trucks, highway trucks and automobiles will be blocked on Miners Ranch Rd. 5. Industrial/Manufacturing use violation of County zoning; conducting a business of Repairing and Rebuilding House Boats has continued on the property for more than two years; a business that requires Industrial or Manufacturing zoning. The impact has been: machinery noise, heavy hammering, sand blasting, diesel motors to power the welders and compressors, etc.; and, sand blasting dust. Operations regularly occur during weekdays, weekends and late into the evening. Notably, if applicant had not performed the illegal excavation and encroachment on the "No Disturb Area" the proposed House Boat Facility would most probably not be feasible! The House Boat Storage and Repair business has operated on the subject property for more than two years prior to submitting application for permit. In reality there has been multiple County Code violations. The business could not have operated without performing excavation in violation of Butte county code. Based on past actions, we believe there is intention to resume "industrial work"! Alternatively, priority should be placed on undoing or repairing of the property damage that has resulted.
