The property is located on the northeast side of Lakeridge Court, approximately 390 feet north of Lakeridge Circle, at 14147 Lakeridge Court, Magalia. APN 066-310-016 (MM) (UP 05-12) Mr. Michelena gave a brief summary of the project. The hearing was opened to the public. Oliver Fontana, Representative of Verizon was there to answer any questions the Commission had. The hearing was closed and comments confined to the Commission and staff. It was moved by Commissioner Lambert, seconded by Commissioner Leland, and unanimously carried to approve the Use Permit for Verizon Wireless subject to the findings and conditions listed below: I. Find that this project is'exempt from the provisions of the California Environmental Quality Act under. Section 15311. Section 15311 consists of construction of minor structures accessory (appurtenant) to existing facilities. The payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required. H. Approve Use Permit 05-12 for Verizon Wireless, subject to the following findings and the conditions in Exhibit "A": A. The proposed location, size, design, and operating characteristics of the proposed use are in accordance with the purpose of this Ordinance, the purpose of the zone in which the site is located, the Butte County General Plan, and the development policies and standards of the County because: Conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-262 (Wireless Communication Facilities). The project is in accordance with the purpose of the zone in which the land lies and the Butte County General Plan because the project site is designated Commercial and is zoned C-C/WP. B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: 1. Harmony in scale, bulk, coverage, and density: The proposed generator would not create any visual impacts because it can not be seen off the site due to topography, existing vegetation, and existing structures, all of which serve to block off-site views. ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JULY 28, 2005 ■ PAGE 5 ■ I 2. The availability of public facilities, services and utilities: Electrical power service is already established to the property and no additional services or utilities are required. A water source and a sewage disposal system are not required. 3. The harmful effect, if any, upon desirable neighborhood character: The project site is already developed with •a 140 foot tall communications monopole and accessory ground -mounted equipment cabinets and shelters. The proposed generator would be operated for maintenance and testing an average of 26 hours per year. The �diesel'engine is rated to Tier II fuel emission standards and meets all air pollution mitigation requirements. The proposed stand-by generator is equipped with a commercial sound - attenuated enclosure. The noise generated by this unit will be'less than 63 dB at 7 meters (23 feet) which is comparable to commercial air conditioning units in the area. 4. The generation of traffic and the capacity and physical character of surrounding streets: The project site is already developed with a 140 foot tall communications monopole and accessory ground -mounted equipment cabinets and shelters. _ The addition of the emergency generator would result in only additional traffic for the delivery, installation and periodic visits for refueling of the emergency generator. 5. The suitability of the site for the type and intensity of use or development which is proposed: Facility development would'be confined to a previously disturbed area within the exisiing fenced lease area. Excavation and trenching will be necessary to enable facility operation. Trenching of utility connections will traverse previously disturbed vacant land and existing travel and parking roadbed. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed communication facility addition application to County Agencies and the Town of Paradise, and has . received no evidence that the use would cause any other relevant impact. C. Based on the above findings, the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public Health, safety, or welfare, or injurious to properties or improvements in- the vicinity. D. E. The proposed generator would not create any visual impacts because it cannot be seen off of the site. F. The exhaust emissions from the proposed generator would comply with all Butte County Air Quality Management District air emission regulations. G. The proposed' emergency power generator is needed to provide critical wireless communication services during the event of a commercial power outage. Conditions of Approval. Planning Division: 1. Previous conditions for Use Permits (UP 97-13, and UP 02-22) and Minor Use Permit (MUP 03-11) still apply. , 2. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Plaruiing Division, is identified as "Attachment D" and date-stamped April 1, 2005, and is incorporated herein by this reference. 3. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life of the Facility. Building Division 4. Prior to installation of the generator, obtain all necessary building permits. Environmental Health Division 5. Prior to issuance of a building permit, provide a hazardous materials statement. Butte County Fire Department/CDF 6. Construction, installation or development of structures or facilities on the parcel shall comply with the latest California Fire Safe Regulations (Public Resources Code 4290) and all other applicable State and County codes, ordinances and regulations in 'effect'at the time of application for improvement permits.. 7. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building constriction and maintained continuously thereafter. 8. Provide plans and specifications to the Butte County Fire Marshal to determine compliance with fire and life safety standards of Titles 19 and 24, California Code of Regulations. 9. The Applicant is currently hardening site capabilities for the sites that are critical to network stability. This work is being preformed as part of the implementation of the E-911 development mandated by the Federal Government and for compliance with National Security guidelines. The stand-by generator will allow this site to remain in operation for extended periods of time should there be a major failure in the commercial power grid. The existing site is designed as an unmanned facility. Once the construction is complete the site is self- supporting except for routine maintenance by the Applicant's field serve personnel. On average service personnel will visit the site about once a month. Vehicle access to the site will be provided off an existing driveway into an existing parking area adjacent to the equipment shelter. Wireless communications facilities with permanent stand-by generator capabilities, such as proposed in this application, are not generally regarded as posing any increased risk of hazard. The general vicinity within the lease area has been cleared of any underlying vegetation, overlaid with weed barrier fabric and covered with a minimum of 6 inches of gravel thus reducing the potential fire hazard, regardless of whether such potential hazard originates on-site or off-site. The proposed equipment shelter is constructed of concrete and is fireproof. All other structural elements and other site improvements are constructed of non-combustible materials. The site is situated well back from any public roads and areas. The proposed use does not require, nor will result in, the division of any property. The access road to the site already exists and all necessary utilities are immediately available to the site. The facility uses no water, nor does it generate wastewater. There are no underground utilities, sewer, septic leach fields and the site is not connected to any type sanitary sewer system. Geotechnical evaluation indicates that the soils and geology at the proposed location are stable and well suited to the proposed use. The addition of a permanent stand-by generator will not create any negative change to agricultural, commercial or residential activities in the area. This determination is substantiated by th_- following clarification of all items listed in the CEQA environmental assessment: Aesthetics The proposed site is located on an existing water tank site. There are several existing structures and vertical elements associated with the water tank operations and existing wireless telecommunication, facilities. There are also several other tall structures in the surrounding area, including utility poles. The Relatively small footprint of the generator at the base of the existing monopole will not be visible from any public view corridor. Based on this information, the proposed addition of a permanent stand -bp generator to the existing wireless telecommunication facility will not have substantial effect on the scenic vista of the community in accordance with the general plan. The facility will in fact reduce damage to the scenic resources, the degradation of the existing visual character and will not create a new source of ligh= or glare. Agricultural Resources The addition of a permanent stand-by generator to the existing wireless telecommunication facility will be located on a 0.78 -acre parcel of land zoned C — Commercial which is currently used as a water tank site and wireless telecommunication facility. The tract has been used in the past and can continue to be used as water storage for community water use. The proposed use will not conflict with, or change any commercially accepted agricultural practices in the vicinity. The proposed use will not contribute to the reduction of prime farm or forest land either directly or indirectly. Air Quality The proposed permanent stand-by generator will be located on wireless telecommunication site that is 'an unmanned non -habitable facility and would therefore not conflict, obstruct, violate or increase pollutants in the area or cause to alter the Air Quality Attainment Plan or Congestion Management Plan. The generator will be operated for maintenance and testing an average of 26 hours per year. The diesel engine is rated to Tier II fuel emission standards and meets all air pollution mitigation requirements. On average, one service vehicle, for regular maintenance will be visiting the site monthly along with periodic visits for refueling the generator. Biological Resources On behalf of Verizon Wireless, On Air LLC consulted with the Sacramento Fish and Wildlife (FWS) office regarding the presence of threatened or endangered species and their critical habitat that my be affected by the proposed addition of a permanent stand-by generator to this wireless telecommunication facility. The site has been previously cleared of all vegetation and undergrowth. The east boundary of the subject parcel contained the wireless telecommunication facility. Th.-- remainder of the subject parcel is relatively flat without any topographical or geographical features and covered in native and opportunistic grasses and weeds. There was no suitable habitat visibly for threatened or endangered species on the property in the immediate vicinity of the planned stand-by generator. • Facility development would be confined to a previously disturbed area within the existing fence_ Excavation and trenching will be necessary to enable facility operation. Trenching of utility connections will traverse previously disturbed vacant land and existing travel and parking roadbed and is not planned to exceed 24 -inches below ground surface. As such, the site would not affect any listed species known to occur within the quadrangle or their critical habitat. • No listed threatened or endangered species, including vascular plant species, were observed on the subject property within the project vicinity. • According to information obtained from agency maintained databases, the subject property was not identified as being within critical habitat or proposed critical habitat of Butte County. The proposed permanent stand-by generator will be located on and adjacent to an existing wireless telecommunication facility within a developed area in northwest Magalia. The site vicinity is commercial and industrial setting composed of man-made infrastructure and introduced plant varieties used for landscaping. Opportunistic weeds and grasses had established in disturbed areas. The site inspection revealed that the subject property did not contain suitable habitat for threatened or endangered species known to habituate within the general project area. As such, the addition of a permanent stand-by generator to the existing wireless telecommunication facility does not appear tc impact or adversely modify an existing or proposed critical habitat. Aquatic habitat would not be impacted by construction and operation of the proposed generator. As a result, no listed amphibians or fish will be affected by the facility. No threatened or endangered species, including plant species, were observed at the site or within the site vicinity. The wireless telecommunication service facility does not appear to impact threatened or endangered species or adversely modify an existing or proposed critical habitat, and would not likely result in the "take" of threatened or endangered species. Excavation will be necessary to prepare a foundation for the placement of the generator and for the installation of underground utility conduits. The proposed lease area and utility trench route are located on a previously disturbed site surrounded by man-made structures, dwelling, and impervious materials. Ground disturbance associated with construction will be confined to previously disturbed land. A trench roughly 12 -inches wide and 24 -inches deep will be excavated between the generator and the existing telecommunications shelter to enable electrical and telecommunication connections. The trench will be opened, conduit inserted and refilled and compacted. The site is predominantly covered with both pervious and impervious materials. The area ncrt covered by equipment and debris had been previously disturbed by vehicular activity. A pedestrian survey of the proposed area and subject property was completed and failed to note any cultural debris, structures, or artifacts. We believe that no historical/cultural resources or archaeological properties would be impacted by development of the proposed wireless telecommunication facility. Geology and Soils The proposed generator will not be located on or near an earthquake fault zone, landslide area, unstable soil or expansive soil. Based upon a review of the United States Geological Survey (USGS) 7.5 -minute quadrangle map (Paradise East, CA 1980) The subject property was located approximately 2300 -feet above mean sea level (amsl) in an area west of the Magalia Reservoir. The area is not listed in the Alquist-Priolo Earthquake Fault Zoning Act (Law) as being on the surface trace of any active earthquake fault zones. Hazards and Hazardous Materials The existing wireless telecommunications facility is un -manned and will not be the source of or location of hazardous materials storage. The proposed generator will not emit hazardous emissions beyond the federally mandated emissions standards. The proposed equipment incorporates adequate safety measures and precautions. Each facility is electronically monitored 24 hours a day for intrusion and environmental disruption. Verizon Wireless complies with all FCC regulations regarding signage and security at the facility. Hydrology and Water Quality The existing wireless telecommunications site is an un -manned and non -habitable facility and therefore does not require the use of water and cannot violate the regional water quality standards. A review of flood status maps prepared by FEMA for Butte County indicated that the subject property was located =n Zone X. This zone has been designated by FEMA to be an area outside any Special Flood Hazard Area. Land Use The project is located on a property currently being used as a commercial water storage tank and adjacent to low-density commercial, industrial and residential areas. The existing facility includes antennas mounted to 135 -foot monopole and prefabricated equipment shelters on concrete foundations on the east side of the property. The site is naturally camouflaged by the existing structures, ancillary equipment and vegetation. Additionally, the County requires a conditional use approval wherein conditions may be added to further mitigate any land use issues. Mineral Resources The proposed facility will not be located in an area where known mineral resources exist and wouid therefore not resulting the loss of available locally important mineral resources. Noise The proposed facility is . un -manned and non -habitable and in itself does not generate excessive nois-1. The proposed stand-by generator is equipped with commercial sound attenuated enclosure. The noise generated by this unit will be less than 63 dB at 7 meters (23 feet) which comparable to commercial air conditioning units in the area. Additionally, the facility will be operated within any Butte County noise standards. Population and Housing The existing wireless telecommunications facility is an un -manned non -habitable site. The proposed generator addition will not affect population or housing trends in the area because of the nature of the type of land use. Additionally, contractors and technicians building and servicing the facility already live and work in the general area; therefore additional demand for housing will not be necessary. Public Services, Energy and Utilities The small un -manned facility does not generate demand for additional public services and does not increase demand upon existing energy sources. The equipment connects to and uses utility systems (electrical power and telephone land lines) that are already present on the subject parcel. The proposed facility does not require, and is not connected to, services such as water or sewer. Transportation and Circulation The existing facility has minimal impact on traffic and circulation. Peak travel to the proposed project will be limited to the initial construction of the facility, which should take approximately two weeks. After construction is complete, the facility will be visited once or twice a month for routine maintenance by one technician. Utilities and Service Systems The site is an unmanned, non -habitable facility requiring only electrical power for operation which power is already connected. The existing facility does not significantly increase consumption of or demand fcr natural resources. Mandatory Findings of Significance The proposed addition of a permanent stand-by generator to the existing wireless telecommunication does not have the potential to degrade the quality of the environment, nor substantially reduce the habitat of a fish or wildlife species, nor cause a fish or wildlife population to drop below self-sustaining levels, ncr threaten to eliminate a plant or animal community, nor will the project reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods cf Californian history or prehistory. The proposed addition of a permanent stand-by generator to the existing wireless telecommunication facility does not have impacts that are individually limited, but cumulatively considerable. The proposed addition of a permanent stand-by generator to the existing wireless telecommunication facility does not have environmental effects, which will cause substantial adverse effects on huma_-i beings, either directly or indirectly. On average service personnel will visit the site about once a month. SITE CHARACTERISTICS: • The project site is owned by the Del Oro Water Company and is developed with a communications monopole, equipment shelters/cabinets, a large water storage tank, and water pumping equipment. • The site is not located within a 100 -year flood zone, an earthquake zone, or an airport land use compatibility zone. • Access to the lease area is via a 12 -foot wide easement over -the adjoining parcel to the south (APN 066-310-055), which is owned by the Del Oro Water Company. A portion of the driveway leading to the lease area is paved, with the balance covered with gravel. • The existing monopole was permitted with Use Permit, 97-13, which was approved in 1997, with several colocations approved on the monopole. Use Permit 02-22 allowed the monopole to be increased in height from 108 feet to 136 feet and to add additional panel antennas. • Various types of commercial uses are found on the parcels to the west and south. The Del Oro Water Company service center is located on the adjacent parcel to the south. A fire station and sheriffs substation are located across the cul-de-sac from the site. The cul-de-sac is occasionally utilized as an emergency heliport for medical evacuations. Zoning on surrounding parcels is Community Commercial (C -C), Public/Quasi-Public (P -Q) (the fire station and sheriffs substation), and Timber Mountain 10 -acre minimum (TM -10) to the north. The nearest residential dwelling units are located on the west side of Skyway, at a distance of approximately 700 feet. • The project site is zoned C -C and is within the WP (Watershed Protection Overlay) zone. • The project site is located within the Town of Paradise's Sphere of Influence. • The project site has had two Use Permits (UP 97-13 and UP 02-22) and one Minor Use Permit (MUP 03-11) which are related to the existing wireless communication facility. All conditions from the three previous use permits will continue to apply. ANALYSIS• • Only a minor amount of construction activity would be required due to the project. • The proposed generator would not create any visual impacts because it can not be seen off the site due to topography, existing vegetation, and existing structures, all of which serve to block off-site views. • The proposed generator would be operated for maintenance and testing an average of 26 hours per year. Trenching of utility connections will traverse previously disturbed vacant land and existing travel and parking roadbed and is not planned to exceed 24 -inches below ground surface.. • The proposed facility is un -manned and non -habitable and in itself does not generate excessive noise. The proposed stand-by generator is equipped with a commercial sound -attenuated enclosure. The noise generated by this unit will be less than 63 dB at 7 meters (23 feet) which is comparable to commercial air conditioning units in the area. There have been three discretionary permits for the wireless communications facility on this parcel: UP 97-13, which allowed the facility UP 02-22, which extended the height of the monopole MUP 03-11, which allowed the collocation of antennas on the monopole On Air (representing Verizon Wireless) wants us to allow the generator as a minor change. I told their representative (Mr. Fontana) that that decision rests with you. Mr. Fontana told me that the generator is needed due to homeland security requirements. I asked him to provide us with additional noise information, but he said the manufacturer does not provide that information. He did say (as stated in his letter) that the generator would be placed within a sound attenuated enclosure, resulting in a sound level of about 60 dB at 50 feet. Please let me know if you consider this to be a minor change to the existing use permit. Due to the potential for air quality and noise impacts I believe that this is not a minor change and that a new minor use permit would be required. Several years ago we required that Pacific Bell obtain a use permit to add a generator to their telephone facility on Skyway, which tells us what our past actions have been. As you are aware, a use permit was issued for the monopole, and several other use permits have been approved to extend the height of the monopole and to add additional antennas to the monopole. The conditions of all these use permits state that the Director of Development Services may administratively approve a minor change to a use permit. Minor changes must also be approved by the Public Works Department , the Environmental Health Division, and the Fire Department. Changes deemed to be major or significant in nature would require a formal application for amendment. Based upon the information you have provided us it appears that the generator would be a significant change due to the increase in noise and exhaust emissions from the site. It appears that a power generator is currently not on the site. If there is an existing generator on the site, and the proposed generator would replace it, then the change might be deemed not significant. However, at this point we do not have any information that confirms that a generator is already on the site. A minor use permit would be required if the change is deemed to be significant. The minor use permit must be approved by the Butte County Planning Commission at a public hearing. If you have any questions please let me know. The permit holder shall comply with all applicable requirements of the Air Toxics "llot Spots" Information and Assessment Act of 19R7 (AF12588), pursuant to California Health and Safety Code Section 44300 ct.scq. 14. The -Right of Entry", as delineated by the California Health & Safety Code Section 41510 of Divisiou 26, shall apply at all times, and during any time when the equipment is in operation, and during reasonable daylight hours when the equipment is not in operation. OPERATIMAL COMMONS 15. The facility to which this permit is issued is striedy liable for assuring that the operating staff are advisrd and familiar with all conditions conWincd in the permit. 16. Permit requirements apply to the ftcility owner and/or operator($) and any contractor or rubrontrartor performing any activity authorized under this permit, Any person(%), including contractor(%) and/or subcontractor(%), not in compliance with the applicable permit requirements are in violation of State and local laws and subject to appropriate civil and criminal penalties. 1"he facility owner and/nr operator, and all contractor(s) or subcuntractor(s) are strictly liable for the actions and violations of their employed). The AlIrO shall be notified immediately, and in no event litter than two (2) hours from the time of discovery, of any upset or hreakdown or malfunction which occurs with the equipment under permit, or emissions exceeding any of the limits established in District Rules and Regulations or the level of emissions for which a permit or variance was granted. Excess emissions shall be reported in accordance with the rcquirementg of District Rule 266 and failure to do so constituter a willful violation of District Rules. 20. Upon detection, an upset or breakdown condition, which causes or may cause a violation of the emissions limitations as act forth in District Rules, of as a condition of this pennit, shall be corrected immediately. in the event that corrective action cannot remedy the emissions violation, the operation of the subject equipment shall be terminated. 21. The APCO shall be provided, upon request, with any and all emissions related data collected as a result of the permitted activity, including data collected or obtained as required by other regulatory agencies. 22. Maintenance and testing means operating the eginc to verify the mechanical reliability of the engine to be operated during an emergency, or to facilitate training of personnel to respund to an emergency situation. Emergency use is defmcd as the failure or loss of all or part of normal electrical power service or normal statural gas supply to the facility, which is caused by any reason other than the enforcement of a contractual obligation the owner or operator has with a third party or any oilier party, or as otherwise allowW in cunjumction with the definition of "Fmergeucy, Use' as defined in the Airborne Toxic Control Measure (ATOM) for Stationary Compression Ignition .Engines. 26. The stack emissions from the internal combustion engine shall not exceed 40°/a opacity (Ringelmantt #2) fur a period or periods aggregating more than three (3) minutes in any one (1) hour_ 29. In order to avoid the need to comply with requirements under Title V of the Tedcrol Clean Air Act, the fuUuwing limitations shall apply. The sum Of the actual emissions front each emissions unit at the stationary source, for each regulated air pollutant, as defined in District Rule t 101, except Hazardous Air Pollutants (14AP), shall not exceed 25 tons per calendar year. The petmil holder shall maintain adequate production reconts- to verify the actual air emissions of each regulated air pollutant. At the request of the APC.O, such records may include, but not he limited to, a monthly log of Operating hours, each raw material or fuel used and its amount, each product produced and its amount, and purchase orders, invoices and other documents to support the information recorded in the monthly log. Production records shall he maintained on-site fur a period of 5 years, shall be submitted to the APCO on an annual basis, and shall also he made available for inspection within 24 hours of, request by the APCO, or his desi6mWd representative.
