Complete a Pre -Application Review with the Environmental Health Division for on- site sewage disposal requirements for the.proposed use. The Environmental Health Division charges a $202.00 fee for this review. (This fee will be applied towards the $404.00 Environmental Health Division fee required at the time of application submittal). 2 . The residential dwellings and accessory structures must meet standard building setback requirements for the R-1 Single Family zone. This is 5 -feet on the side and 15 -feet on the rear property lines. Setback from Lower Honcut.Road is 25 feet. 3. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 4. All outstanding application processing fees shall be paid prior to issuance of the Use Permit. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Applicant must apply for and have approved a Merger application to merge six underlying lots into two lots prior to issuance of any building permit on the property. 2. Properties adjacent on the north, and across Neighbor Street to the west, are zoned AR. Parcels range in size from 0.12 to 1.58 acres. Land uses. in the immediate project area consist of single-family residential dwellings. • There are no active commercial uses in the area. During site evaluation, discussions with individual neighboring property owners revealed a preference for residential use. • There are two vacant commercially zoned parcels located southeast (0.83 acres) and southwest (0.53 acres) across Lower Honcut Road. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 5. Applicant must apply for and have approved a Merger application to merge six underlying lots into two lots prior to issuance of any building permit on the property. 2. The residential dwellings and accessory structures must meet standard building setback requirements for the R-1 Single Family zone. This is 5 -feet on the side and 15 -feet on the rear property lines. Setback from Lower Honcut Road is 25 feet. 3. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 4. All outstanding application processing fees shall be paid prior to issuance of the Use Permit. Public Works 5. Prior to the issuance of use permit, obtain an encroachment permit and improve all new and existing driveway approaches to publicly maintained roads as specified in the County Improvement Standards and the terms of the encroachment permit. . 6. Prior to the, issuance of use permit, deed to Butte County in fee simple 40 feet of right-of- way from the centerline of Palermo Honcut Highway and Lower Honcut Road along the entire property frontage. The right-of-way shall be sufficient for the installation of Improvement Standard No. S-5 at all street intersections. 7. Prior to the issuance of use permit, submit road and drainage improvement plans for the installation and construction of the street frontage improvements on Lower Honcut Road and Palermo Honcut Highway to RS -3A County Improvement Standards. Improve resultant 2 merged parcel frontages to a 1/2+ 12' street section on Lower Honcut Road and Palermo Honcut Highway to an RS -3A road standard including, 3" AC, and 12" AB, prime coat, fog seal and 95 % relative compaction. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 5. I. CONDITIONS OF APPROVAL: Planning Division: 1. Applicant must apply for and have approved a Merger application to merge .six underlying lots into two lots prior to issuance of any building permit on the property. 2. The residential dwellings and accessory structures must meet standard building setback requirements for the R-1 Single Family zone. This is 5 -feet on the side and 15 -feet on the rear property lines. Setback from Lower Honcut Road is 25 feet. 3. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 4. All outstanding application processing fees shall be paid prior to issuance of the Use Permit. Public Works 5. Prior to the issuance of use permit, obtain an encroachment permit and improve all new and existing driveway approaches to publicly maintained roads as specified in the County Improvement Standards and the terms of the encroachment permit. 6. Prior to the issuance of use permit, deed to Butte County in fee simple 40 feet of right-of- way from the centerline of Palermo Honcut Highway and Lower Honcut Road along the entire property frontage. The right-of-way shall , be sufficient for the installation of Improvement Standard No. S-5 at all street intersections. 7. Prior to the issuance of use permit, submit road and drainage improvement plans for the installation and construction of the street frontage improvements on Lower Honcut Road and Palermo Honcut Highway to RS -3A County Improvement Standards. Improve resultant 2 merged parcel frontages to a `/z+ 12' street section on Lower Honcut Road and Palermo Honcut Highway to an RS -3A road standard including, 3" AC, and 12" AB, prime coat, fog seal and 95 % relative compaction. Submit design to Land Development Division for approval prior to construction. "R" value determination and other data may be required to support the section design. Construct or install the required improvements. 8. Prior to the issuance of use permit, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. Fire suppression sprinkler systems shall be installed in all new residential structures in accordance with the National Fire Protection Association Standard for the installation of sprinkler systems in one and two family dwellings and mobile homes, NFPA Standard 13D, unless a pressurized community water system, with hydrants that meet Fire Department specifications, serves the parcels. This condition is to be added to all building plans. Pacific Gas & Electric 10. Any relocation or rearrangement of any existing, PG&E facilities in the area to accommodate this project will be at the expense of the developer. 11. There shall be no building of structures, or the storage of materials allowed over or under any existing PG&E facilities, or inside any easements that exist which would infringe on PG&E easement rights. County Counsel 12. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to defend, indemnify and hold the County of Butte harmless from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. Gridley 15' quads Approximately 1.5 acres estimated from the project map (Butte County) Dear Mr. Durling, In response to your request, a record search for the above-cited project was conducted by examining the official maps and records for archaeological sites in Butte County. RESULTS: Prehistoric Resources:- According to our records, no sites of this type have been recorded in the project area or the project vicinity. The name Honcut is believed.to have come from a nearby Native American village, named Hoarikut, located in the project vicinity. The project area is located within the ethnographic territory of the Konkow Maidu and borders Nisenan territory. The dialect along Honcut Creek was thought to be transitional between the Konkow and Nisenan populations. Historic Resources: According to our records, no sites of this type have been recorded in. the project area. However, a historic.home located on 103 School Street was recorded in the project vicinity. The USGS Gridley 15' (1941) quad map indicates the project is located in the community of Honcut, and Lower Honcut Road, the Southern Pacific Railroad, Ahart Road, Middle Honcut Road, orchards, structures, and roads are located in the project vicinity. The Marysville 1:125,000 quad map (1895, reprinted 1909) indicates the project is located in the community of Moores Station, and the Southern Pacific Railroad (Northern California Line) the community of Honcut, roads, structures, and bridges are located in the project vicinity. The community of Honcut today was originally named Moores Station but changed to Honcut by the Southern Pacific Railroad. The original community was a mining town in 1854. The post office moved back and forth between Butte and Yuba Counties until it settled in Butte County when the community's named was changed to Honcut. In 1879, the A.M. Leach Lumber Company shut down, along with their flume that ran from Woodleaf and Clipper Mills. The lumber yard was located 1/2 -mile north of the town. The first school in the area started in 1876 on J.C. Moores' land, but was moved into town in 1878. The project area is located in the historic gold mining district of Honcut. The district was originally worked by hand methods but by 1909 to 1920 bucket -line dredging became the prevalent mining method. In the 1930s dragline dredging, methods were used to extract gold. Previous Archaeological Investigations: According to our records, no portion of the project area has been surveyed by a professional archaeologist. Literature Search: Reviewed were the official records and maps for archaeological sites and surveys in Butte County. Also reviewed were the National Register of Historic Places - Listed properties and Determined Eligible Properties (1988, Computer Listings 1966 through 7-00 by National Park Service), the California Register of Historical Resources (2005), California Points of Historical Interest (1992), California Inventory of Historic Resources (1976), California Historical Landmarks (1996), Directory of Properties in'the Historic Property Data File for Butte County (2005), Handbook of North American Indians, Vol. 8, California (1978), USGS Marysville 1:125,00 quad map (1895[1909]), A Collection of Places in Butte County, California (1977), Historic Spots in California (1966), and Gold Districts of California (1970). RECOMMENDATIONS: Based upon the above information and the local topography, the project is.located in an area considered to be moderately sensitive for prehistoric, protohistoric, and historic cultural resources. However, due to the previous heavy ground disturbance, we do not. recommend further archaeological survey work at this time. However, if any potential prehistoric, ethnographic, and/or historic cultural resources are encountered during any phase of project operations, all work should cease in the area of the find pending an examination of the site and materials by the project archaeologist. This request to cease work in the area of a potential cultural resource find should be made a condition of project approval. The CHRIS is a statewide system for managing information on the full range of historical resources identified in California. This syster-1 is under the authority and direction of the Office of Historic Preservation (OHP), the State Historic Preservation Officer (SHPO), and the State Historical Resources Commission (SHRC). The Northeast Center of the CHRIS system, located at California State University, Chico, manages the historical resource records for 11 counties, including Butte County. The Northeast Information Center will furnish a Record Search to Development Services indicating the archaeological/historical significance and sensitivity of the applicant's project area and additionally providing a recommendation as to whether further archaeological survey is warranted. If further archaeological survey is required, the application would be considered incomplete until the appropriate archaeological survey is completed and reviewed. - The Department of Development Services will forward applicant's payment (by check) of $60.00 and relevant project application information required for the Records Search to NEIC. NEIC will provide the results of the Records Search to Development Services. Development Services will notify the applicant if further archaeological survey is warranted. The $60.00 fee does not cover the cost of further archaeological survey work. If further archaeological survey work is required, Development Services will work with the applicant to see that it is accomplished, according to set standards, by a qualified archaeologist. The applicant shall bear all costs associated with further archaeological survey work required to continue processing of the planning project application.
