Summary:
Based on analysis and recommendations from the staff of the Development Services
Department we have deemed the proposed additions of diesel generators, equipment
cabinets, and backup batteries to be "minor changes" to existing use permits. This
memorandum grants approval of these minor changes to the five use permit applications
referenced below. The approved minor changes consist of addition of one backup
emergency diesel generator to each existing wireless communications facility, and the
addition of four equipment cabinets and back-up batteries within the existing approved
footprint of each facility. In each case the wireless facility was allowed by an approved
Use Permit or Minor Use Permit, as required by the zoning of each site.

Description of Requested Minor Modification:
Each of the five use permit applications above is to add a 25-30 KW/3-liter diesel -
powered emergency electrical generator and four equipment cabinets to an existing
wireless communications facility. These additions would be contained within the original
footprint of the approved facility.' Each of the above facilities is essentially identical
interims of layout and composition of equipment on the site. The proposed additional
equipment cabinets include batteries to backup the electronic communications equipment,
bridging the time gap between grid -power outage and generator startup. Mr. Kortick of
Verizon explained that the backup generators are started remotely as a test each Thursday
morning, and run for about 15 minutes, and remotely monitored as to electrical output.
Each facility is serviced once per month, at which time the generators would also receive
any required service.
Each of the use permit approvals that granted the original wireless facility contained the
following standard special condition of approval #3:
Minor changes may be approved administratively by the Directors of Development
Services, Environmental Health, or Public. Works upon receipt of a substantiated
written request by the applicant, or their respective designee. Prior to such approval,
verification shall be made by each Department or Division that the modification is
consistent with the application, fees paid, and environmental determination as
conditionally approved. Changes deemed to be major or significant in nature shall
require a formal application for amendment.
Staff assessed the following potential impacts of the proposed changes:
• Noise impacts from generator/hours of operation. `
• Air quality impacts from generator operations.
• Hazards/toxics issues with storage of diesel fuel on the site.
• Hazards/toxics issues with backup batteries on the site.
DETERMINATIONS: The Development Services Department has made the following
determinations:
1) The applications for use permit listed above, are deemed to be requests for "minor
changes" to the approved use permit/minor use permit on each site.
2). The proposed changes are consistent with the environmental determination for the
originally -approved use permit or minor use permit.
3) The proposed changes are consistent with the County Code 24-262 Wireless
Communications Facilities purpose, intent, applicability, exemptions, permit
requirements, application requirements, development criteria, and general
standards for the zones in which each is respectively located.
4) As no fee structure exists asyet for minor changes to use permits, the original fees
paid will be refunded to the applicant minus the cost of the actual staff time spent
in processing these minor changes.

Environmental Health Department (EHD) Fee:
Program Manager Mike Huerta has - determined that the Environmental Health
Department will assess a $90 fee for the processing of each of these applications, to cover
the required staff time. The applicant will need to complete a separate Request for
Service Environmental Health Department application for each project.
Planning Department Fee:
The Planning Department has expended approximately 3.5 hours to process each of these
applications. At the standard weighted planning staff rate of $137 per hour (3.5 X $137 =
$4.79.50), it is reasonable to conclude that a $480 fee will be deducted from the Use
Permit fees already paid for processing each of the five applications. The balance of fees
already paid will then be refunded to the applicant.
REQUIREMENTS REGARDING THE APPROVED MINOR CHANGES:
Planning Division:
1. All previous conditions for Use Permits or Minor Use Permit still apply.
2. The project site shall be developed in accordance with the approved project site plan
and the conditions for each Use Permits/Minor Use 'Permit. All new equipment
additions must be installed within the original footprint of the approved facility.
Said site plan is on file in the Planning Division.
3. The minor changes are. limited to addition of one 25-30 KW/3-liter diesel -
powered emergency electrical generator, four equipment cabinets, and backup
batteries. All new facilities shall be painted and/or screened from view with
adequate landscaping appropriate to the surrounding environment. All aesthetic
treatments, including landscaping shall be maintained as approved for the life of
the facility.
4. Minor change approval includes a requirement that the weekly generator tests
take place only between the hours of 8:00 a.m. 5:00 p.m., Monday through
Friday.
5. As noise impacts are anticipated to be infrequent and short-term, prior to'issuance
of building permit, the applicant is required to provide technical documentation
certifying that the noise levels from generator operation will be less than 70 dB at
the perimeter of the facility, per General Plan Noise Element Chart No. 4,
conditionally -acceptable level for residential low-density housing. (see attached
GENERAC specification sheet of 5/22/03 'and comment by Verizon Wireless
Engineers of 11/10/05). The applicant is required to install the Series 2000 Sound
Attenuated Enclosure for which noise attenuation data was provided.

6. Prior to installation of the new equipment, obtain all necessary building permits.
Environmental Health Division:
7. Prior to issuance of a building permit, provide written verification that the Butte
County Environmental Health Division has received and approved a Hazardous
Materials Release Response Plan regarding the. requested additions.
Butte County Fire Department/CDF:.
8. Construction, installation or development of structures or facilities on the parcel
shall comply with the latest California Fire Safe' Regulations (Public Resources
Code 4290) and all other applicable State and County codes, ordinances and
regulations in effect at the time of application for improvement permits.
9. Building identification and/or addresses shall be installed in conformance with
Public Resources Code 4290 and shall be posted at the beginning of building
construction and maintained continuously thereafter.
10. Provide plans and specifications to the Butte County Fire Marshal to determine
compliance with fire and life safety standards of Titles 19 and 24, California Code
of Regulations.
11. Comply with NFPA Standard 110 Emergency Standby Power Systems.
Butte County Air Quality Management District:
12. Prior to issuance of a building permit, provide written verification that the Butte
County Air Quality Management District has determined that the proposed diesel
generator(s) fall below the State -mandated threshold (37 KW) at which ` the
licensing of such diesel engine installations is required (see attached letter of
January 19, 2006).

Dear Mr. Troester:
The District has reviewed the information submitted regarding,use permit applications for diesel
generators at Verizon Wireless Communications Facilities. The District recommends that Butte
County Planning Division consider the following information regarding diesel generators.
Stationary internal combustion engines rated at less than 50 horsepower do not currently require
written approval or other authorization from the Air Pollution Control Officer prior ,to installation
and/or operation in Butte County. However, the installation of several power generation units
(each rated at less than 50 HP) that collectively power one communications system at a location
in an effort to circumvent permitting requirements will be considered a violation of. District rules,
regulations, and policies.
District Rule 400, Section 4.13 exempts other sources of minor significance as specified by the
APCO. In District Policy 6.6.1., the District has specified that stationary internal combustion
engines rated at 50 horsepower or below are exempt from District permitting requirements and
do not require an application or request for exemption prior to installation or operation.

This checklist is designed to assist applicants in making sure all necessary information is included in their
application packet for a communications facility. Please include this checklist along with your submittal.

applicant has provided notice to all FCC licensed wireless communication service carriers

applicant is not a wireless communications service provider, a user operating agreement for
each and every such provider to which the applicant intends to rent space on the proposed
Facility.
18. ❑ A report, signed by a qualified radio frequency engineer licensed by the FCC, prepared

pursuant to FCC OET 65, stating whether the maximum radio frequency
radiation/electromagnetic radiation (PF/EMF) to be emitted by the proposed Facility, taking
into account all other Facilities, both existing and known future Facilities, at the proposed
site and adjacent properties, conforms to safety standards adopted by the FCC, if applicable.
The -reports prepared for Facilities shall conform to the reporting requirements set by the
County and FCC OET 65 human exposure standards. The report shall also analyze the
evidence provided in support of the proposed Facility location, height and radiated power,
fre-quency, the number of channels, and all other related data and present alternatives for the
location, height and radiated power, pursuant to the requirements of this section. If the
proposed Facility exceeds FCC OET 65 human exposure standards, applicant shall also
provide additional comprehensive technical and planning information regarding how the
applicant shall protect all persons from such excessive exposure consistent with all Federal
and State requirements, and any additional County requirements.
19. \�/ / ❑ Landscaping and painting plans for the completed project.
20. ❑ ❑ Projects in Agricultural Zones (A-5 through A-160) shall, prior to submitting an application
for a proposed Facility, submit -a site plan of the proposed Facility to the Butte County
`- Agricultural Commissioner for comment and send a notification letter to all aerial
agricultural applicators registered in the County informing them of the proposed site
location and tower height. No hearing on an application for a proposed facility in any
agricultural zone will be scheduled, nor shall any Administrative Permit for any such facility
be issued without proof that the Butte County Agricultural Commissioner and all aerial
agricultural applicators registered in the County have been notified, as specified herein.

21. ❑ All applications for Facilities that are proposed to be located within the boundaries of any
Comprehensive Airport Land Use Plan or Airport Area of Influence, as adopted or
N0 designated from time to time by the Butte County Airport Land Use Commission, shall be
submitted to the Department of Development Services, Planning Division, and a cop}
submitted to the Butte County Airport Land Use Commission for review regarding
consistency with adopted Comprehensive Airport Land Use Plans and for recommendations
addressing potential impacts to air navigation within the Airport Area of Influence. -
The County may in its sole discretion retain an independent consultant to review either individual
elements of or the entire application and advise the County at the applicant's sole'expense.
Additional information may be required in order to clarify, amplify, correct or otherwise supplement the above:
submittal information or to complete any required environmental review documents, as deemed necessary by the
Department of Development Services, Public Works, Environmental Health Division, Butte County Fire
Department, or Agriculture Commissioner.

❑ 4. Prior to the issuance of building permits, relinquish abutter's rights of access to Butte County along
the frontage of parcels , except at approved access points.
B. DRAINAGE
❑ 1. Prior to the issuance of building permits, a plan for a permanent solution for drainage shall be
submitted to and approved by the Department of Public Works. The drainage plans shall detail
existing drainage conditions and shall, specify how drainage waters shall be detained or retained on-
site and/ or conveyed to the nearest natural or publicly maintained drainage channel or facility and
shall provide that there shall be no increase in the peak flow runoff to said channel or facility.
❑ 2. Prior to the issuance of building permits, establish 100 year flood plain elevations and the lowest floor
elevations for any structures, in accordance with Butte County Code §26-25. Show on the additional
map sheet the elevations (by contours) and the location of an accepted NGVD29 (National Geodetic
Vertical Datum of 1929) benchmark and a temporary benchmark on-site.

❑ 6. , 'Proposed improvements shall comply with recorded map conditions applicable to construction.
❑ 7. Proposed improvements shall comply with Public Resources Code 4290 Fire Safe Construction
standards.
❑ 8. Development fees for the proposed residential or non-residential improvements shall be paid prior to
the issuance of building permits. The fees shall be those in effect at time of application, and shall
include, but not be limited to, School Fees, Park and Recreation District fees, Water and Sewer
Service Fees, Permit and Plan Check fees, and Fire Protection Fees.

J. FIRE CLEARANCE
❑ 1. Construction, installation or development of buildings and/or roads, driveways, gates and
bridges on parcels/lots shall comply with the latest California Fire Safe Regulations—Public
Resources Code 4290, 4291 and current Butte County Improvement Standards, whichever is
stricter.
❑ 2. Prior to construction, a pressurized community water system for fire protection is
required. Bonding may be allowed with the approval of the County Fire Chief. Average
required hydrant spacing is feet, hydrant size inches, and residual fire flow of
GPM. -Fire hydrant identification, road reflectors or post reflectors acceptable to
the County Fire Chief shall be installed or bonded, prior to Parcel or Final map recordation.
Submit plans to the Fire Department for review and approval prior to construction.
❑ 3. Place a note on a separate document and recorded concurrently with the Parcel, Final map or
an additional map sheet stating that "Fire suppression sprinkler systems shall be installed in
all new residential dwellings in accordance with NFPA Standard 13D, unless a pressurized
community water system with hydrants that meet Fire Department specifications serves the
property." A note stating "Automatic Fire Sprinklers conforming to NFPA Standard 13D
required" is to be added to, all affected building plans.
❑ 4. In lieu of hydrant installation, prior to recordation of the Parcel or Final map, payment shall
be made into the hydrant fund at the current rate per lineal foot of street frontage.
❑ 5. Prior to building construction, provide an all weather access of at least 10 feet wide and
vertical clearance of 15 feet that will allow for ingress and egress and accommodate a
40,000 -pound fire apparatus to within 150 feet of all structures.
❑ 6. Place a note on a separate document, which is to be recorded concurrently with the Parcel or
Final map, or on an additional map sheet stating, "Building identification and/or addresses
shall be installed in conformance with Public Resources Code 4290 and shall be posted at
the time of permit issuance and maintained continuously thereafter.

Introduction
Sacramento Valley Limited Partnership, d/b/a Verizon Wireless, formerly AirTouch
Cellular is a partnership of Bell Atlantic Wireless, GTE Mobilnet and AirTouch Cellular,
organized to bid on radio. frequency spectrum licenses auctioned by the Federal
Communications Commission ("FCC"). In addition to mobile phone services, Verizon
Wireless also offers wireless email, text messaging; internet access, paging, photo messaging
and data transmission. As the nation's largest wireless service provider, Verizon Wireless is
continuing to expand its network in California and the Sacramento area. The existing
wireless communication site includes an existing 150 -lattice tower with various Verizon
antennas and 2 radio cabinets. No changes are proposed to the tower and antennas.
Proposal
Verizon Wireless is seeking permission of to upgrade the equipment for an existing wireless
communication facility located at 3902 Esplanade north of Chico. (APN 006-400-056). The
service objective is primarily to improve emergency service in the Highway 99.rural area by
adding the emergency only generator and improve the capacity of the radio equipment at the
site by adding additional cabinets.
The proposed generator is a Generac SD030. Copies of a description of the unit are
attached. Also attached is a Statement of Exhaust Emissions for Diesel Fueled Generator.
The generator hours of operation are limited to testing once a week for about an hour. The
generator will operate 24/7 if the power grid fails out due to an emergency. The generators
are fueled with diesel stored on site. The tank holds 210 gallons in a duel wall, alarmed tank
that detects leaks. Noise levels are 65 db when operating as measured 7 meters or 23 feet
from the center of the tank.
Verizon Wireless will install equipment four (4) cabinets on a concrete pad to be
located in the equipment compound. The additional cabinets are 66" tall by 56" wide by 34"
deep. The cable will run from the pole to the equipment shelter, connecting the antennas in
the pole with the equipment.

Once the construc* work is complete and the telephone sohing equipment is
fine-tuned, visitation to the site by service personnel. for routine maintenance typically occurs
an average of once per month. The site is entirely self -monitored and connects directly to a
central office where sophisticated computers alert personnel to any equipment malfunction.
This includes the testing and operation of the generator. Because the wireless facility will be
unstaffed, there will be no regular hours of operation and no impact to existing local traffic
patterns. No water or sanitation service is required for this facility. No advertising or
signage is proposed, except signs required by the FCC and facility emergency contact
information.
Verizon Wireless will comply with safety requirements of the Uniform Building
Code, as well as all other applicable regulations and permits, FCC rules governing
construction requirements, technical standards, interference protection, power, height
limitations, radio frequency standards and FAA rules governing construction and operation.
If the Verizon Wireless equipment is unused or becomes obsolete, it will be removed within
six months after its operation has ceased.
Justification Statement
The economic, business and residential growth along with increased general public
usage of Verizon Wireless' services in Yuba County and surrounding area have 'significantly
increased the volume of calls on the Verizon Wireless facilities. Verizon Wireless users have
expressed major concerns about the poor coverage, dropped and blocked calls on the network
throughout the area. Verizon Wireless radio engineers have conducted analysis of the
existing network and services in the area and have determined that Verizon Wireless capacity
is very marginal in the area. This general location is necessary for Verizon Wireless to
provide seamless coverage in the area.
The FCC mandates that licensed service providers comply with stringent
requirements such as providing high quality in -building coverage to the general public within
a very aggressive timeframe. The FCC mandates 911 -locator functionality and the
maintenance of sufficient capacity to accommodate developing wireless data transmission
technology for internet access, instant messaging and other wireless services. Sufficient
wireless coverage not only meets the general service expectations of wireless customers, but
also enhances the safety of travelers by allowing immediate access to emergency assistance.
Land Use Compatibility
The proposed project is not inconsistent with the other existing uses. The facility is
proposed in an area used as support for the farming function. The facility will not interfere
with the farming function and is a reasonable use for the "A-2-40" zone district. Visually, no
alterations are being made at the site that the public will notice. The Verizon Wireless facility
will result in no impact to the environment to the area in which it is located. The facility will
not contribute significantly noise, smoke or odor. Construction will result in minimal
modifications and disturbance to the surroundings.

RFR/EMF Description
The total output and number of channels for the N. Esplanade site is 120 watts. That
represents no change in output from the current set up as no changes are proposed to the
antennas. The six cabinets will produce 20 watts each for a total of 120 watts.
Benefits to the Community
The proposed Verizon Wireless facility will provide many benefits to area residents,
businesses and motorists in the general area. These benefits include:
➢ 911 capability allowing motorists to, summon aid and report dangerous
situations
➢ The site will be capable of operating fully when power is out due to an
emergency or severe weather.
➢ Support for emergency services by providing wireless communications to
paramedics, firefighters, and law' enforcement agencies
➢ The ability to transmit data allowing for immediate access to vital information
➢ A back-up system to the land -line system in the event of power outages,
natural or man-made disasters
➢ Communication capabilities in remote areas, enhancing the safety of travelers
by allowing immediate access to emergency assistance
➢ Provide quality wireless communications including voice,'paging, digital data
capabilities for email, facsimile and internet access
➢ Enhance the communications systems of residents who telecommute from
their homes
Summary
The new Verizon Wireless facility will provide an improved "State of the Art"
wireless telecommunication services to the Esplanade community and become an important
part of the area's infrastructure for residents. Verizon Wireless respectfully requests
approval of its application.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Mericom Corporation is hereby granted a Minor Use Permit in accordance with
application filed: Minor Use Permit to install three (3), four (4) square foot (1 -foot wide x 4 feet
long) panel antennas on an existing 90 -foot tall lattice tower at the 80 -foot level, and to install four
(4) 6.5 square foot equipment cabinets.
Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit, constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions must
be completed prior to or concurrently with the establishment of the granted use. The use
granted by this permit must be established within 12 months of the date of approval.
3. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by
the applicant, or their respective designee. Prior to such approval, verification shall be made
by each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
4. If any use for which a Minor Use Permit has been granted is not established within one year
of the date of approval, the permit shall become null and void and reapplication and a new
permit shall be required to establish the use. A Minor Use Permit subject to lapse may be
renewed for an additional period of up to one year, provided that sixty (60) calendar days
prior to the expiration date, an application for renewal of the Minor Use Permit is filed with
the Planning Division on the prescribed form and accompanied by the necessary data and
fees.
The terms, and conditions of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally
omit or misrepresent any material fact in connection with the application. Any alleged
material misrepresentation shall constitute grounds for the Director of Development Services
to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds
to revoke a permit.
Conditions of Approval:
The new antennas shall be painted to match the color of the existing tower at the height they
will be located.
2: The Facility must meet or fall within current standards and regulations of the FAA, the FCC,
the County and any other agency of the Federal or State government with the authority to
regulate such Facilities. ,
3. The installation of the Facility shall comply with all applicable building and electrical codes.
The Facility operator shall submit certification from a registered structural engineer to the
Building Division, that all associated monopoles and towers in excess of thirty (30) feet in
height will withstand sustained winds as required by the Uniform Building Code.
4. No advertising or display shall be permitted on the Facility.
The placement of any antenna or structure shall not adversely affect any on-site sewage
disposal system or its repair area without written, approval from the Division of
Environmental Health.
6. The installation of the Facility shall not violate any existing deed restrictions.
7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained
road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15)
feet of vertical clearance.
There shall be no outdoor vehicle or equipment storage exceptTor emergency purposes.
9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any
other State and/or Federal agency with the authority to regulate such Facility. If such
standards and regulations are changed, the property owner or responsible party shall bring
the Facility into compliance with such revised standards and regulations within ninety (90)
days of the .effective date of such standards and regulations, unless a more stringent
compliance schedule is mandated by the controlling agency.
10. The Facility or combination of the Facilities on the site shall not generate, at any time;
electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of
the FCC adopted standards for human exposure, as amended over time.
11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of
persons working or residing near such facility, then the service provider(s) and property
owner shall be jointly and solely responsible for the removal, adjustment, or replacement of

the Facility. In no case shall the Facility remain in operation if it is found to create a hazard
to health, safety, and welfare. The Facility shall not be found to create a hazard to health,
safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets
all current standards established by the FCC, pursuant to FCC OET 65.
Prior to issuance of the building permit for the installation of the Facility, the applicant shall
post a performance security in an amount and form determined by the Director of
Development Services that is sufficient to cover the cost of a one-time test by a radio
frequency consultant selected by the County, sufficient to determine whether the Facility's
RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined
to exceed FCC standards, the applicant is required to pay for such other tests and other
corrective measures as are necessary to establish compliance with FCC OET 65 and -its
successors and such noncompliance shall constitute sufficient grounds to commence a permit
revocation hearing which may lead to permit revocation. The applicant shall.cooperate in
all respects with the County's consultant to assist the consultant to reach his/her conclusion.
12. All Facilities that are not in continual use for a period of six (6) months shall be considered
abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances,
requiring no amortization period. If the Director of Development Services detenmines that
the Facility is abandoned, the applicant may be required to remove all equipment belonging
to the applicant from the premises and return the site to its original condition within thirty
(30) calendar days of.receipt of notice to abate. If such Facility is not removed and the site
returned to its original condition within thirty (30) days, the County may remove the Facility
at the applicant's and/or land owner's joint and several expense.
13. All ground level support Facilities shall be painted and/or screened from view with adequate
landscaping appropriate to the surrounding environment. All aesthetic treatments, including
landscaping shall be maintained as approved for the life of the Facility.
14. The Facility may not encroach into, under, over, above, or upon any public street in the
unincorporated area of the County in the absence of a valid encroachment permit from the
County.
15. The owner/operator of the Facility shall annually submit a written verification, attested to
under penalty of perjury, signed by both the owner/operator and an FCC licensee in the
employ of ' or retained by the owner/operator, that the radio frequency
radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety
standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to
reporting requirements set by the FCC and the County. The reports shall be submitted to the
Planning Division and the Building Division no later than January 31 of each year.
16. The Facility shall be secured at all times to prevent access by the public.
17. Applicant shall implement measures to prevent fugitive dust emissions during all .
construction activities.
18. The project site shall be developed in accordance with the approved project site plan and the
conditions contained herein. Said site plan is on file in the Planning Division, is identified
as "Exhibit E" and date-stamped June 1, 2000, and is incorporated herein by this reference.
19. Prior to use of this project, the applicant shall contact the Planning Division for a field
inspection to verify all conditions of approval and ordinance requirements have been met.
20. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.

21. Building permits required for antennas and equipment cabinets. Engineer design calculations
are required to verify adequacy of existing tower structure and footings when additional
antennas are installed.

Findings of Exemption (attach as necessary):
1. The County of Butte has conducted an initial study and prepared a Negative
Declaration so as to evaluate the potential of this project for adverse environmental impact:
2. When considering the record as a whole, there is no evidence before the'County
that the project will have potential for an adverse impact on wildlife resources or the habitat upon
which the wildlife depends.
3. The County of Butte has, on the basis of substantial evidence, rebutted the
presumption of adverse effect contained in Section 753.5 (d), of Title 14, California Code of
Regulations, if applicable.
4. The project is hereby found to be de minimis in its effect on wildlife and exempt
from the State Fish and Game filing fees required by Section 711.4 of the Fish and Game Code.

J. FIRE CLEARANCE
❑ I. Construction, installation or development of buildings and/or roads, driveways, gates and
bridges on parcels/lots shall comply with the latest California Fire Safe Regulations—Public
Resources Code 4290, 4291 and current Butte County Improvement Standards, whichever is
stricter.
❑ 2. Prior to construction, a pressurized community water system for fire protection is
required. Bonding may be allowed with the approval of the County Fire Chief. Average
required hydrant spacing is feet, hydrant size inches, and residual fire flow of
GPM. Fire hydrant identification, road reflectors or post reflectors acceptable to
the County Fire Chief shall be installed or bonded, prior to Parcel or Final map recordation.
Submit plans to the Fire Department for review and approval prior to construction.
❑ 3. Place a note on a separate document and recorded concurrently with the Parcel, Final map or
an additional map sheet stating that "Fire suppression sprinkler systems shall be installed in
all new residential dwellings in accordance with NFPA Standard 13D, unless a pressurized
community water system with hydrants that meet Fire Department specifications serves the
property." A note stating "Automatic Fire Sprinklers conforming to NFPA Standard 13D
required" is to be added to all affected building plans.
❑ 4. In lieu of hydrant installation, prior to recordation of the Parcel or Final map, payment shall
be made into the hydrant fund at the current rate per lineal foot of street frontage.
❑ 5. Prior to building construction, provide an all weather access of at least 10 feet wide and
vertical clearance of 15 feet that will allow for ingress and egress and accommodate a
40,000 -pound fire apparatus to within 150 feet of all structures.
❑ 6. Place a note on a separate document, which is to be recorded concurrently with the Parcel or
Final map, or on an additional map sheet stating, "Building identification and/or addresses
shall be installed in conformance with Public Resources Code 4290 and shall be posted at
the time of permit issuance and maintained continuously thereafter.
