PC 06-21 A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION APPROVING USE PERMIT 06-09 WHEREAS, the Planning Commission has considered Use Permit 05-15 for the Chico Rotary Club, in accordance with Chapter 24, Section 45; Use Permits, of the Butte County Code on Assessor's Parcel Number 039-600-008; and WHEREAS, the Planning Commission has determined that the project is exempt from the California Environmental Quality Act; and WHEREAS, said use permit was referred to various affected public and private agencies, County departments, and referral agencies for review and comments; and WHEREAS, a public hearing was held on April 13, 2006; and WHEREAS, the Planning Commission has considered public comments and a report from the Planning Division. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission: I. Finds that the project is categorically exempt from the California Environmental Quality Act per Section 15303(a) New Construction or Conversion of Small Structures. ° II. Approves Use Permit 06-09 for the Chico Rotary Club, subject to the conditions found in Exhibit "A", and the following findings: A. The proposed uses of the property will not impair the integrity and character of the zone in which the land lies, and the use would not be incompatible with, or injurious to, surrounding properties, or detrimental to the health and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the residents of the County as supported by the following: 1. The General Plan designation for the site is Orchard and Field Crops (OFC). The proposed use is consistent with this designation in that public and quasi -public uses are allowed in the OFC as "secondary uses". 2. The Butte County Zoning Ordinance designation for the site is Agricultural 40 -acre minimum (A-40). The A-40 zone allows public and quasi -public uses by way of a use permit 3. The dominant surrounding land use is orchard and field crops that will not be negatively impacted by the proposed sign. 4. The Butte County Agricultural Commissioner reviewed the project and found that no apparent adverse agricultural issues are anticipated and that no other mitigation measures are required. 5. The proposed location, size, and design of the proposed use and the conditions under which it would be operated or 9 maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. UP 06-09 PERMIT NO. 039-600-008 ASSESSOR'S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below, the Chico Rotary Club is hereby granted a Use Permit to construct a 20' tall X 15' wide "Welcome to Chico" service clubs entry sign as detailed in this staff rerport on a 20'x 20' site on APN 039-600-008, subject to the following conditions: 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated, written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one-year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or State regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. A Butte County building permit is required. Construction shall comply with federal, state, and local regulations: 2:. Any applicable development fees for the proposed construction shall be paid prior to the issuance of building permits. 3. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 4. The proposed use is to be conducted by and for the non-profit organization as a "Welcome to Chico" sign that displays the emblems of services organizations, and is not to be used for other,commercial purposes. No sign lighting is approved for this permit. CALTRANS Department of Transportation: 5. The project must be designed to insure that there is no direct or indirect net increase of runoff or backwater effects on the State highway ROW and drainage facilities. It is the developer's responsibility to ensure that runoff from the project site to the State Route 32 ROW will meet all Regional Water Quality Control Board standards. Also, an encroachment permit will be required for any alterations made on the property or in the State's ROW that could impact the State's drainage facilities. Public Works Department: 6. Prior to the issuance of the Use Permit, prove to the satisfaction of the Director of Public Works that the parcel of the subject application is a legal parcel. County Counsel 7. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or.loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel 0 before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. Mr. Steve Troester gave a brief summary of the project. Staff is recommending the Commission approve the use permit. Staff is recommending two changes to the Conditions of Approval on page 6 of staff report. The first change recommended is under Planning division condition number 4 they want to add to the condition that, "no sign lighting has been approved". The second condition is to remove final condition #5 under Public Works (CALTRANS -encroachment permit and improvements) condition number 5 as this is a one time only construction of a sign. Public Works is not requiring that the driveway be improved to their standards. Chairman Nelson asked if there were any questions for staff. He then opened the public hearing. Mr. Bill Dinsmore of the Chico Sunrise Rotary Club said with the removal of condition five they agreed with the conditions. Chairman Nelson asked if anyone else wanted to speak regarding this matter. No one responded. He closed the public hearing and confined comments to the Commission and staff. Commissioner Lambert moved to approve, finding that this project is exempt from the provisions of the California Environmental Quality Act, the use permit 06-09 for Chico Sunrise Rotary Club subject to the findings and conditions located in exhibit A. With the change on page 6 item 4 adding no sign lighting has been approved and deleting under Public Works number 5 and re -numbering 5 down. Commissioner Wilson seconded. UP 06-06 was unanimously approved. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. A Butte County building permit is required. Construction shall comply with federal, state, and local regulations. 2. Any applicable development fees for the proposed construction shall be paid prior to the issuance of building permits. 3. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. 4. The proposed use is to be conducted by and for the non-profit organization as a "Welcome to Chico" sign that displays the emblems of services organizations, and is not to be used for other commercial purposes. No sign lighting is approved for this permit. CALTRANS Department of Transportation: 5. The project must be designed to insure that there is no direct or indirect net increase of runoff or backwater effects on the State highway ROW and drainage facilities. It is the developer's responsibility to ensure that runoff from the project site to the State Route 32 ROW will meet all Regional Water Quality Control Board standards. Also, an encroachment permit will be required for any alterations made on the property or in the State's ROW that could impact the State's drainage facilities. Public Works Department: 6. Prior to the issuance of the Use Permit, prove to the satisfaction of the Director of Public Works that the parcel of the subject application is a legal parcel. County Counsel • 7. The sign site will be accessed for construction and maintenance by way of an existing, gravel, agricultural access road originating off of Highway 32, near the northeast corner of the parcel. The land surrounding the sign site is designated Orchard Field Crop (OFC) by the Butte County General Plan and A-40 (Agricultural, 40 -acre) zoning desigantion and is in active agricultural/orchard production (see General Plan/Zoning Map, Exhibit B). 3. The project site is located within 100 -year flood zone A, and is not subject to a Williamson Act contract. ANALYSIS: 1. The proposed sign is consistent in size with other outdoor display signs along the segment of Highway 32 between Hamilton City and Chico. 2. The proposed sign is consistent with the general plan and zoning designations of the site, with a use permit. 3. A comment letter from CALTRANS of February 22, 2006 indicates that the proposed sign is not considered an "advertising structure" or "advertising display" under the Outdoor Advertising Act, and is thus subject only to Butte County codes. 4. The proposed use is considered a quasi -public use, in that the applicant is a non-profit organization and the sign is not proposed for commercial purposes. General Plan and Zoning. The project was reviewed and conditions applied.by local agencies. 2. The Butte County Agricultural Commissioner reviewed the project and found that no apparent adverse agricultural issues are anticipated and that no other mitigation measures are required. 3. The City of Chico commented on January 26 2006 that the project is outside of their sphere of influence. While the sign design proposes the display of the seal of the City of Chico, the applicant will need to secure the City's approval for use of this logo. 4. The Butte County Public Works Department reviewed the project and is requiring that prior to the issuance of building permits, the applicant must obtain a CalTrans encroachment permit and improve all new and existing driveway approaches to publicly maintained roads. 5. The Public Works Department is also requiring that prior to the issuance of the Use Permit, the applicant must prove to the satisfaction of the Director of Public Works that the parcel of the subject application is a legal parcel. 6. CALTRANS requested that the project be designed to insure that there is no direct or indirect net increase of runoff or backwater effects on the State highway ROW and drainage facilities. It is the developer's responsibility to ensure that runoff from the project site to the State Route 32 ROW will meet all Regional Water Quality Control Board standards. Also, an encroachment permit will be required for any alterations made on the property or in the State's ROW that could impact the State's drainage facilities. The .project site is located within 100 -year flood zone A, and is not subject to a Williamson Act contract. ANALYSIS: 1. The proposed sign is consistent in size with other outdoor display signs along the segment of Highway 32 between Hamilton City and Chico. 2. The proposed sign is consistent with the general planandzoning designations of the site, th a use permit 3.. A comment letter from CALTRANS.00f February 22, 2006 indicates that the proposed sign is noticonsidere�dvertising structure" or "advertising display" under the Outdoor t dvertising Act, and is thus subject only to Butte County codes. 4. The proposed use is considered a quasi -public use, in that the applicant is a non-profit organization and the sign is not proposed`for co ercial purposes. USE -OF PROPERTY AND TERM OF EASEMENT 1.1 Grant of Easement. For and in consideration of the covenants to be performed by the Grantee under this Easement, Grantors hereby agree to grant to Grantee the right to use the Sign Site for the purposes described herein, together with necessary rights of ingress and egress over the entire Property, to Grantee and Grantee agrees to use the Sign Site on the terms and conditions set forth in this Easement. 1.2 Status of Title. Title to the easement granted hereby is subject to all exceptions, easements, rights; rights of way, and other matters of record appearing in the official records of Butte County as of the date of this Easement. 1.3 Term of Easement. Grantors retain the right to use the Sign Site for all purposes that are not inconsistent with the rights granted to Grantee hereunder. ARTICLE 4. TAXES AND UTILITIES 4.1 Property Tax Exemption. Grantee shall apply for a property tax exemption for the Sign Site after completion of the improvements to the Sign Site. Grantee will cooperate and assist Grantors in obtaining that exemption. In general Grantee shall pay any tax attributable to the Sign Site. The parties shall endeavor to have the Sign Site designated 'as a separate assessment parcel. If the Property is nevertheless assessed as one parcel, then Grantee shall pay the portion of the property tax allocable to the Sign Site, as determined by Grantors. 4.2 Utilities. If Grantee illuminates the Sign or otherwise uses electricity regularly, Grantee shall establish a separate utility account for charges incurred during the term of this Easement in connection with the operation of the Sign Site. Grantee shall pay for electricity attributable to the operation of its facilities. 4.3 Payment by Grantors. Should Grantee fail to pay within the time specified in this article any utilities or other charges required by this article to be paid by Grantee, Grantors may, upon thirty (30) days' written notice to Grantee, pay, discharge, or adjust that charge for the benefit of Grantee. In that event, Grantee shall promptly on written demand of Grantors reimburse Grantors for the full amount paid by Grantors together with interest thereon at the rate of seven percent (7%) per annum from the date of payment by Grantors until the date of repayment by Grantee. The Sign shall be constructed, all work on the Property shall be performed, and other improvements on the Property shall be done in a good workmanlike manner. 5.4 Zoning and Use Permits. Should any party now or in the future deem it necessary or appropriate to obtain any use permit, variance, or rezoning of the Property in order to construct the Sign or display it on the Sign Site, Grantors agree to execute any documents, petitions, applications, and authorizations that may be necessary or appropriate and hereby appoints Grantee as Grantors' attorney in fact to execute in the name and on behalf of Grantors any such documents, petitions, applications, or authorization; provided, however, that any such permits, variances, or rezoning shall be obtained at the sole cost and expense of Grantee and Grantee agrees to protect and save Grantors and the property of Grantors, including the Property, .free and harmless from any such cost and expense. ' .5.5 Ownership of. Improvements. Grantee shall maintain title to the improvements constructed on the Sign Site during the Easement. Grantee agrees to execute, acknowledge, and deliver to Grantors any instrument requested by Grantors as necessary in, Grantors' opinion to perfect Grantors' right, title, and interest to the improvements and the Property. ARTICLE 6. MAINTENANCE AND REPAIRS 6.1 Maintenance. Grantee shall maintain the Sign Site and the Sign and all other improvements to the Sign -Site. 6.2 Requirements of Maintenance. At all times during the term of this Easement, Grantee, at its own cost and expense, shall make all alterations, additions, or repairs to the Sign Site or the improvements on the Sign Site required by any valid law, ordinance, statute, order, or regulation now or hereafter made or issued by any federal, state, county, local or other governmental agency or entity. Grantee shall defend, indemnify and hold Grantors and the Property free and harmless from any and all liability, claims, loss, damages, or expenses, including attorneys' fees, resulting from the erection or maintenance of the Sign, or the occupation and use of the Property by Grantee or its agents or any subtenant, licensee or invitee of Grantee, specifically including, without limitation, any liability, claim, loss, damage, or expense arising by reason of the negligent or intentional act or omission of Grantee or its agent, employee, officer, director, subtenant, licensee or invitee. ARTICLE 8. CONDEMNATION 8.1 Award of Condemnation. In the event of any taking, the parties agree that the full amount of any award shall be payable to Grantors and the value shall be determined as though Grantors held full unencumbered legal title to the Property and all improvements thereon and without regard to this Easement. ARTICLE 9. ASSIGNMENT AND SUBLEASING 9.1 Assignment and Subleasing Standards. Grantee may not assign this Easement or any interest in this Easement or sublease all or any portion of the Sign Site, without the prior written consent of Grantors, which consent Grantors may grant or withhold in its sole and absolute discretion. 9.2 'Limits on Assignment or.Subleasing. A consent by Grantors -to one assignment or sublease shall not be deemed to be a consent to any subsequent assignment or sublease. Any assignment or sublease made contrary to the terms of this paragraph shall be null and void unless otherwise permitted by this Article. The term of any sublease shall not extend beyond the term of this Easement; any and all subleases shall be expressly made subject to all of the terms; covenants, and conditions of this Easement; and any subtenant shall be required to attorn to Grantors in the event of Grantee's default under this Easement. ARTICLE 10. DEFAULT AND REMEDIES 10.1 Termination and Unlawful Detainer. In the event of an uncured default by Grantee under this Easement, Grantors may terminate this Easement bywritten notice to Grantee and bring an action tore -enter and regain possession of the Sign Site in the manner provided by the laws of unlawful detainer of the State of California then in effect. 10.2 Breach and Default by the Grantee. All covenants and agreements contained in this Easement are declared to be conditions to this Easement and to the easement hereby granted to Grantee. He was very helpful and gave us the Building Permit Application and took the time to explain exactly what documentation we needed to provide in order to obtain the required building permit. He indicated that with the current volume of work within the department, once the application was received along with the' required exhibits and a check for $439.93, the process would normally take 4-6 weeks. This application along with the required exhibits, etc. was submitted for approval to Butte County in mid May and the next time we heard was in early July from Willdan Co. who -apparently does work for the county. They had some questions and requested additional detail be submitted in order to complete the review of the Building Permit Application. After a num er of inquiries with individuals in Development Services in late August, we were told that our application had been turned over to Mr. Chris Tolley. We exchanged phone calls for a few days and finally connected in mid August. In that discussion we were told that he was now reviewing the project and that based on his review a Use Permit would be required prior to the issuance of the Building Permit for the project. Mr. Tolley also indicated that there was a fee for that permit in the range of $3,000 +/- unless we requested a waiver of the project fees through the Board of Supervisors. This turn of events was obviously disappointing since it was a surprise, which should not have occurred, plus we are now facing a'further delay plus substantial additional costs. At the present time we are in process of compiling all the necessary items on the Application Check List for a Use Permit and would hope to have this completed in the next couple of weeks. I hope we can count on the County to expedite this Use Permit under the circumstances and allow us to move forward just as quickly as possible. In the interim, prior to filing the Use Permit Application, we would appreciate your assistance in obtaining the necessary approval from the Board to waive all County fees on this project including a refund of the Building Permit which we already paid. This sign project is for the benefit of all citizens within.the County and will be available to display individual promotional signs with names, logos, meeting times, etc. for all service clubs, churches, fraternal organizations, youth organizations, etc. within Butte County. Our Rotary Club is providing approximately $13,000 which is approximate amount necessary to construct and install the sign. Hupp Neon is working with the club by doing the project for their cost and Rolls, Andersen & Rolls has donated the engineering and related costs. In general Grantee shall pay any tax attributable to the Sign Site. The parties shall endeavor to have the Sign Site designated as a separate assessment parcel. If the Property is nevertheless assessed as one parcel, then Grantee shall pay the portion of the property tax allocable to the Sign Site, as determined by Grantors. 4'.2 Utilities. If Grantee illuminates the Sign or otherwise uses electricity. regularly, Grantee shall establish a separate utility account for charges incurred .during the term of this Easement in connection with the operation of the Sign Site. Grantee shall pay for electricity attributable to the operation of its facilities. 4.3 Payment by.Grantors. Should Grantee fail to pay within the time specified in this article any utilities or other charges required by this article to be paid by .. Grantee, Grantors may, upon thirty (30) days' written notice to Grantee, pay, discharge, or adjust that charge for the benefit of Grantee. Grantee shall maintain title to the improvements constructed on the Sign Site during the Easement. At all times during the term of this Easement, Grantee, at its own cost and expense, shall make all alterations, additions, or repairs to the Sign Site or the improvements on the Sign Site required by any valid law, ordinance, statute, order, or regulation now or hereafter made or issued by.any federal, state, county, local or other governmental agency or entity. ARTICLE 8. CONDEMNATION 8.1 Award of Condemnation. In the event of any taking, the parties agree that -the full amount of any award shall be payable to Grantors and the value shall be determined as though Grantors held full unencumbered legal title to the Property and all improvements thereon and without regard- to this Easement. ARTICLE 9. ASSIGNMENT AND SUBLEASING 9.1 Assignment and Subleasing Standards. Grantee may not assign this Easement or any interest in this Easement or sublease all or.any portion of the Sign Site, without the prior written consent of Grantors, which consent Grantors may grant or withhold in its sole and absolute discretion. 9.2 Limits on Assignment or Subleasing. A consent by Grantors to one assignment or sublease shall not be deemed to be a consent to any subsequent assignment or sublease.. Any assignment or sublease made contrary to the terms of this paragraph shall be null and void unless otherwise permitted by. this. Article. The term of any sublease shall not extend beyond the term of this. Easement; any and all subleases shall be expressly made subject to all of the terms; covenants, and conditions of this Easement; and any subtenant shall be required to attorn to Grantors in the event of Grantee's default under this ,Easement. ARTICLE 10. DEFAULT AND REMEDIES 10.1 Termination and Unlawful Detainer. In the event of an uncured default by Grantee under this Easement, Grantors may terminate this Easement by written notice to Grantee and bring an action to re-enter and regain possession of the Sign Site in the. manner provided by the laws of unlawful detainer of the State of California then in effect. 10.2 Breach and Default by the Grantee. All covenants and agreements. contained in this Easement are declared to be conditions to this Easement and to the easement hereby granted to Grantee. Grantors may be deemed to be in default of this Easement if they fail to perform any of their obligations hereunder for a period of ninety (90) days following written notice from Grantee giving notice of such default. Grantee shall then be entitled to any remedies available under the laws in effect.at the time of the default. Grantors may have additional time to cure such default if they commence cure of such default within such 90 -day period and diligently pursue such cure to completion. ARTICLE 11. (2) General commercial uses, including art shops, 4 aviaries, bars and cocktail lounges, billiard, parlors and pool halls, bowling alleys, building material sales, 5 cleaning and pressing establishments, dance halls, interior decorating shops, employment agencies, governmental 6 legislative buildings, gymnasiums, public, commercial or physical cultural studios, hospitals, hotels and motels, 7 laboratories and X-ray facilities; massage parlors and 8 reducing salons, equipment rentals, pet shops,- new and used car sales, repair garages, auto car washes, plumbing shops, 9 cabinet shops, sign manufacturing shops, restaurants with drive through facilities, and other similar uses. 10 (3) Adult hotels and motels, subject to the requirements of article IV, adult business regulation, of chapter 15 of 11 this Code. (b) Accessory uses: 12 (1) A. single family dwelling or modular home as an accessory use to a commercial use listed above, subject to 13 the site requirements of section 24-75. 14 (c) Uses requiring use permits: The following uses are permitted subject to a use permit: 15 (1) Welding shops, auto body shops. (2) Manufacturing of clothing, handicraft products, 16 printing, lithographing and other light manufacturing or industrial uses of similar character. 17 (3) Public or quasi -public uses not specifically allowed in subsection (a), above. 18 (4) Shopping malls and shopping centers on sites of five 19 (5) acres or greater, commercial recreation uses, kennels and small animal hospitals, and mortuaries. 20 (5) Recycling facilities as per section 24-275. (6) Residential uses not in conjunction with a permitted 21 use, recreational vehicle parks, multi -family dwellings, and mobile home parks. 22 (d) Uses requiring an administrative permit. The following uses may be permitted subject to the requirements of 23 section 24-40:. (1) Temporary uses as listed in section 24-300. 24 (2) Reverse vending machine and small collection recycling facilities pursuant to section 24-275. 25 (e) Site requirements: The following site requirements 26 shall apply: (1) Lot width required: Minimum lot width shall not be 27 less than forty-five (45) feet for commercial uses. The lot width requirements for residential uses shall conform to ^^ sections 24-75 and 24-80 of'this code. 3 0 0 (2) Minimum lot size: None, except as required to meet 1 parking and building site development requirements and 2 minimum sewage disposal requirements of chapter 19 of the Butte County Code. Residential uses shall meet the 3 requirements of sections 24-75 and 24-80 of this Code. (3) Side yard requirements: None, except when the side of 4 a lot abuts upon the side of a lot that is zoned to allow a residential use, in which case the side yard shall be not 5 less than ten (10) feet. The side yard requirements for residential uses shall conform to section 24-75 of this 6 Code. (2) Rear yard: None, except where the rear yard abuts a 7 lot that is zoned to allow a residential use, in which 8 case the rear yard shall be not less than ten (10) feet. The rear yard requirements for residential uses 9 shall conform to section 24-75 of this Code. (f) Site development standards. 10 Signs: In instances in which any commercially zoned property abuts residentially zoned property: 11 (i) The standards as it pertains to allowable signs shall be that of the N -C (Neighborhood Commercial) 12 zoning district; (ii) Use Permit approval must be obtained by 13 applicants prior to installation of any proposed 14 freestanding pole sign. (iii) Monument signs are allowable up to eight (8) 15 feet tall, 32 square feet of sign face, and with internal or exterior lighting. Use permit approval 16 must be obtained by applicants prior to installation of a proposed monument signs that would exceed the 17 allowable height or square footage criteria. 18 24-155 H -C (Highway Commercial) Zone. 19 (a) Uses permitted: 20 (1) One (1) single-family dwelling or modular home per parcel. 21 (2) The use of a single-family residence as a small family day care home, licensed family care home, foster home, or 22 group home for mentally disordered or otherwise handicapped persons or neglected children.. Said homes shall serve six 23 (6) or fewer persons and shall be subject to all applicable state regulations and limitations. 24 (b) Accessory uses: 25 (1) Those uses and structures normally associated with a single-family residential use and are in conjunction with 26 or incidental to the residential use, including, but not limited to, a garage, workshop, garden, private swimming 27 pool, private tennis court, gazebo, spa, etc. (2) A guesthouse as defined by section 24-305.175. — (c) Uses requiring use permits. The following uses are 4 I 0 permitted subject to a use permit: . 1 (1) Duplex, multi -family dwellings, bed and breakfast 2 inns, and multiple single-family residences. (2) Hotels and motels, clubs, lodge halls, hospitals, 3 sanitariums and clinics. (3) Retail stores and shops of light commercial character 4 as listed in the C-1 zoning district. (4) Outdoor advertising signs, new automobile sales, 5 amphitheaters and theaters, small animal hospitals, dance academies, pet shops, mortuaries, used car sales, used or 6 secondhand goods, refreshment stands, service -stations, drive-in restaurants and other uses which are of similar 7 character. 8 (5) Recreational vehicle and mobile home parks.,, (6) Public and quasi -public uses. 9 (7) Recycling facilities as per section 24-275. (d) Uses requiring a minor use permit: The following uses 10 may be permitted subject to the requirements of section 24- 41: 11 (1) Large family day care facilities subject to the requirements of section 24-265. 12 (2) Second dwelling units subject to the requirements of section 24-280. 13 (3) Bed and breakfast home. 14 (e) Uses requiring an administrative permit: The following uses may be permitted subject to the requirements of 15 section 24-40: (1) Home occupations subject to the. requirements of 16 section 24-270. (2) Temporary uses as listed in section 24-300. 17 (3) A temporary mobile home subject to the requirements of sections 24-295 and 24-295.10. 18 (f) Site requirements: The requirements of section 24-75 of this Code are modified in the following particulars for 19 building sites in H -C zones: 20 (1) Lot width required: Minimum lot width shall not be less than sixty-five (65). 21 (2) Side yard requirements: None, except when the side of a lot abuts upon the side of a lot that is zoned -to allow a 22 residential use, in which case the abutting side yard shall not be less than ten (10) feet. The side yard requirements 23 for residential uses shall conform to section 24-75 of this Code: 24 (3) Rear yard: None, except where the rear yard abuts a lot that is zoned for to allow a residential use, in which 25 case the rear yard shall be not less than ten (10) feet. 26 The rear yard requirements for residential uses shall conform to section 24-75 of this Code. 27 (g) Site development standards. (1) In instances in which any commercially zoned — property abuts residentially zoned property the 67 standards as it pertains to allowable signs shall be 1 that of the N -C (Neighborhood Commercial) zoning 2 district. (2) Outdoor advertising signs require approval of a use 3 permit as shown in (c)(4)above. 4 24-225 S -H (Scenic Highway) Zone 5 (a) Uses permitted: (1) Lawful uses of land established at the time a district 6 was originally zoned S -H. (2) One (1) residential dwelling or modular home per 7 parcel. 8 (3) The use of a single-family residence as a small family day care home, licensed family care home, foster home, or 9 group home for mentally disordered or otherwise handicapped persons or neglected children. Said homes shall serve six 10 (6) or fewer persons and shall be subject to all applicable state regulations and limitations. 11 (b) Accessory uses: (1) Those uses and structures normally associated with a 12 single-family residential use and are in conjunction with or incidental to the residential use, including but not 13 limited to a garage, workshop, garden, private swimming 14 pool, private tennis court, gazebo, spa, etc. (2) A guest house as defined by section 24-305.175. 15 (3) Household pets, but not including livestock, poultry or poisonous reptiles. 16 (4) Agricultural uses and buildings. (c) Uses requiring use permits. The following uses are 17 permitted subject to a use permit: (1) Schools (including private, vocational, or craft 18 schools), public and quasi -public uses, roadside stands for the sale of produce from the land fronting the highway 19 within the district; and 20 (2) Highway services primarily for the convenience of the traveling public and including: 21 a. Gasoline service stations. b. Restaurants. 22 C. Motels and trailer courts. d. Public and quasi -public buildings and professional 23 buildings. (d) Uses requiring a minor use permit. The following uses 24 may be permitted subject to the requirements of section 24- 41: 25 (1) Large family day care facilities subject to the 26 requirements of section 24-265. (2) A second dwelling unit pursuant to section 24-280. 27 .(e) Uses requiring an administrative permit. The following uses may be permitted subject to the requirements of — section 24-40: 6 i 0 (1) Home occupations subject to the requirements of 1 section 24-270. 2 (2) Temporary uses as listed in section 24-300. (3) A temporary mobile home subject to the requirements of 3 sections 24-295 and 24-295.10. 4 (f) Site Development Standards. (1) In instances in which any commercially zoned property 5 abuts residentially zoned property the standards as it pertains to allowable signs shall be that of the N -C 6 (Neighborhood Commercial) zoning district. (2) No signs, billboards or advertising displays shall be 7 erected within the district except signs advertising only 8 the sale or lease of land upon which the sign is placed, or the products grown or raised upon such property, and 9 established or permitted uses on such property except the following: 10 (3) Directional signs are permitted in advance of an entrance to a frontage road or intersection where 11 businesses that serve the highway users (i.e., phones, roadside businesses, hospitals, motels, rest areas, 12 campgrounds and next services) are available and installed in accordance with State of California Division of Highways 13 Planning Manual of Instructions. 14 (4) Historical landmark signs are permitted in advance of an entrance to a frontage road or intersection with the 15 most direct access road to guide traffic to a registered landmark and installed in accordance with State of 16 California Division of Highways Planning Manual of Instructions. 17 (5.) Use ,Permit approval must be obtained by applicants prior to installation of any proposed freestanding pole 18 sign, 19 (g) Site requirements. The provisions of section 24-75 shall apply. Off, 21 Section 2. Severability. If any provision of this Ordinance or 22 the application thereof to any person or circumstances is for any 23 reason held to be invalid by a court of competent jurisdiction, such 24 provision shall be deemed severable, and the invalidity thereof shall 25 not affect the remaining provisions or other applications of the 26 Ordinance which can be given effect without the invalid provision or 27 application thereof. 7 j I Section 3. Effective Date and Publication. This Ordinance shall 2 take effect thirty (30) days after the date of its passage. The Clerk 3 of the Board of Supervisors is authorized and directed to publish this 4 ordinance before the expiration of fifteen (15) days after its 5 passage.
