Jerry Jazmadarian, Cingular Wireless, said he concurred with the conditions. The hearing was closed and comments confined to the Commission and staff. It was moved by Commisioner Leland, seconded by Commissioner Wilson, and unanimously carried to adopt Resolution PC 06-47 approving UP 06-16 for Cingular Wireless subject to the findings and conditions. Location: Butte Valley area, APN 041-430-012 is at 2822 Clark Road just northeast of Butte College, approximately 2700 feet north of the Clark Road/ Durham Pentz Road intersection. Area is generally rural with large homesites, characterized by rolling hills. Tower will sit in the west portion of the Crone's approximate 10 -acre parcel (elevation 360 feet), about 300 feet from Clark Road. Closest antenna's are about 4.5 miles to the southwest on H 149, and 5 miles to the east on Cherokee Road. Owner: Danny and Teresa Crone (tower owner is T -Mobile) Representative: Jerry Jazmadarian Action: Cingular Wireless proposes to install twelve panel antennas 54 feet above ground to enhance its wireless voice and data services; panels are 75.4" long by 10.3" wide by 5.9" deep and neutral grey. Cingular also proposes to install a 12' by 20' prefabricated equipment shelter to house radio transmitting equipment. No microwave dishes are proposed. Cingular will be the fourth carrier with service on the pole; T - Mobile will install six panels at 87.8 feet above the ground, Nextel will install 12 panels at 75 feet, and Verizon will install additional antennas at the 64 foot level. El 12 Evidence of a valid, current operating license or construction permit from the FCC or, if -the applicant is not a wireless communications service provider, a user operating agreement for each and every such provider to which the applicant intends to rent space on the proposed Facility. 18. © [2 A report. signed by a qualified radio freauencv engineer licensed by the FCC, nrenared pursuant to FCC OET 65, stating whether the maximum radio frequency radiation/electromagnetic radiation (RF/EMF) to be emitted by the proposed Facility, taking into account all other Facilities, both existing and known future Facilities, at the proposed site and adjacent properties, conforms to safety standards adopted by the FCC, if applicable. The reports prepared for Facilities shall conform to the reporting requirements set by the County and FCC OET 65 human exposure standards. The report shall also analyze the evidence provided in support of the proposed Facility location, height and radiated power, frequency, the number of channels, and all other related data and present alternatives for the location, height and radiated power, pursuant to the requirements of this section. If the proposed Facility exceeds FCC OET 65 human exposure standards, applicant shall also provide additional comprehensive technical and planning information regarding how the applicant shall protect all persons from such excessive exposure consistent with all Federal and State requirements, and any additional County requirements. 19. landscaping and painting plans for the completed project. 20. © Projects in Agricultural Zones (A-5 through A-160) shall, prior to submitting an applicalfion for a proposed Facility, submit a site plan of the proposed Facility to the Butte County Agricultural Commissioner for comment and send a notification letter to all aerial agricultural applicators registered in the County informing them of the proposed site location and tower height. No hearing on an application for a proposed facility in any agricultural zone will be scheduled, nor shall any Administrative Permit for any such facility be issued without proof that the Butte County Agricultural Commissioner and all aerial agricultural applicators registered in the County have been notified, as specified herein. IF INSUFFICIENT INFORMATION IS SUBMITTED, THE APPLICATION WILL BE DEEMED INCOMPLETE. 5 21. Conditions of approval have been applied to this project pursuant to the applicable requirements of Section 24-262 (Wireless Communicatign Facilities). The project is in accord with the purposes of the AR -2 '/z zone and the Butte County General Plan designation of Agricultural Residential. The AR -2 '/2 zone allows co -locations with approval of a Use Permit. The Agricultural Residential land use designation allows public utilities as Secondary Uses. ii. Collocation of antennas on a previously approved tower decreases the need j.or communication towers elsewhere to provide service. Reducing the number of communication towers needed to provide necessary service is a benefit to rhe County. 1 • B. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjacent uses, residents, buildings, structures, or natural resources, with consideration given to: .... L. Harmony in scale, bulk, coverage, and density: The proposed antennas would not increase the height of the proposed communications tower or extend horizontally beyond the other propos-ed antennas. 2. The availability of public facilities, services and utilities: Electrical power service would be established at the property and no additional services or utilities would be required with this project. A water source and a sewage disposal system are not required because the facility will be unmanned. 3. The harmful effect, if any, upon desirable neighborhood character: The radio-frequency emissions from the proposed antennas would meet FCC standards for public exposure. The proposed antennas would not result in a significant visual impact to the neighborhood in that the new antennas aad mounting hardware would be painted to match the required earth tone color of the proposed communications tower. The proposed antennas and equipment shelter would not generate any noise. 4. The generation of traffic and the capacity and physical character of surrounding streets: Only a negligible amount of vehicle traffic will occur during installation of tie antennas and equipment cabinet. The communications facility would oe unmanned and only one site visit per month would be required by maintenance personnel after installation. Clark Road would provide access for the project site and would not be impacted by this increase in vehicular traffic. 5. The suitability of the site for the type and intensity of use or development which is proposed: The site is ideally suited for the project because the proposed antennas wou.'d be mounted on a previously approved communications tower that would provide wireless service to the Butte Valley area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed collocation application .o County Agencies and has received no evidence that the use would cause ary other relevant impact. C. Based on the above findings, the proposed location, size, design, and operatir_g characteristics of the proposed use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare, or injurious to properties or improvements in the vicinity. D. The proposed use will comply with each of the applicable provisions of Butte County Code Chapter 24, Section 262. Conditions of approval have been applied to 2 this project pursuant to the applicable requirements of Section 24-262 (Wireless Communication Facilities). The project is in accordwith the purposes of the AR -2 %Z zone and the Butte County General Plan designation of Agricultural Residential. The AR -2 %2 zone allows collocations with approval of a Use Permit. The Agricultural Residential land use designation allows public utilities as Secondary Uses. E. This project would place antennas on a previously approved communications tower, which eliminates the need for a new communications tower to be erected elsewhere in the project area. F. The radio-frequency emissions generated by the antennas on the communications tower would be below the public exposure limits set by the FCC for wireless communication facilities. G. The proposed antennas would not create any impacts to aircraft operations because they will not increase the height of the previously approved communications tourer nor extend horizontally beyond the other proposed antennas. H. Wireless telephone services are regulated by the California Public Utilities Commission and are considered to be a public use consistent with the AR -2 %i zo-ze and the AR General Plan land use designation. If any use for which a Use Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division 1. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment D". and date-stamped June 9, 2006, and is incorporated herein by this reference. 2. The new antennas and mounting hardware shall be painted to match the earth tone color of the proposed communications tower. 4 3. The installation of the Facility shall comply with all applicable building and electrical codas. The Facility operator shall submit certification from a registered structural engineer to the Building Division that all associated towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmenrial Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all-weather access.to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet ,of vertical clearance. 8. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility shall fall within current standards and regulations of the Federal Aviation Administration -(FAA), the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 10. The Facility or combination of the Facilities on the site shall not generate, at any tirr_e, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of fze FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of tie Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RE emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC Office of Engineering and Technology Bulletin 65. 12. Prior to issuance of the Use Permit, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the Counly, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standares. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish complians:e with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. E rF 14. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 15. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagne:ic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by fze FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 16. The Facility shall be secured at all times to prevent access by the public. 17. The collocation of the antennas allowed by this Use Permit requires the issuance of a building permit from the Butte County Building Division. The Building Division, based upon engineered calculations submitted by the applicant, may determine that the tower cannot physically support the requested number of antennas. If that is the case, the number of new antennas allowed on the tower may be less than the number of antennas permitted by this Use Permit. California Department of Forestry/Butte County Fire 18. Prior to building construction, provide an all weather access of at least 10 feet wide and vertical clearance of 15 feet that will allow for ingress and egress and accommodate a 40,000 pound fire apparatus to within 150 feet of all structures. Environmental Health Division 19. Prior to issuance of a building permit, provide a completed Hazardous Materials Release Response Plan to Butte County Environmental Health as required by Chapter 6.95 of the California Health & Safety Code. Pacific Gas and Electric 20. Any relocation or rearrangement of any existing PG&E facilities in the area to accommoda_e this project will be at the expense of the developer. 21. There shall be no building of structures, or the storage of materials allowed over or under ar_y existing PG&E facilities, or inside any easements that exist which would infringe on PG&E easement. rights. PROJECT DESCRIPTION: • Use Permit to co -locate a total of 12 panel antennas at the 54 -foot height of an approved but r_ot- yet built 92 -foot tall communications tower owned by T -Mobile (UP 05-01, approved July 23, 2005.) A 12' by 20' prefabricated equipment shelter will be installed on leased ground. • Panels are 75.4" long by 10.3" wide by 5.9" deep and will match the earth tone color of the communications tower. • Cingular Wireless will use this facility, operating in the incumbent cellular 850 megahertz (MHz) and Personal Communications Services (PCS) 1900 MHz ranges, to enhance its wireless voice and data services. Cingular also proposes to install Universal Mobile Telecommunications System (UMTS) service to provide high-speed internet through a subscriber handset. ■ Butte County PLANNING COMMISSION.. AGENDA REPORT ■ ■ September 14, 2006 ■ Crone UP 06-16 Agenda Report ■ Page 1 of 11 a • The communication facility will be unmanned and does not require a water source or a sewage disposal system. • Approximately one visit per month would be made to the site by Cingular Wireless technician: to perform routine maintenance. • An equipment shelter would be located within the new leased area. • No advertising or signage is proposed, except signs required by the Federal Communications Commission (FCC) and emergency contact information. • A single exterior light above the equipment shelter door will only be lit during maintenance. • Access to the site is, and will continue to be, from Clark Road. • There will be a total of four wireless communication carriers on the proposed communicaticns tower: Cingular Wireless with 12 panel antennas at 54 feet; Verizon with 9 panel antennas at 64 feet; Nextel with 12 panels at 75 feet; and T -Mobile with six panels at 87.8 feet. Separate Use Permits will be required for the collocation of these antennas. SITE CHARACTERISTICS: • The project site is zoned AR -2 '/z (Agricultural Residential 2 '/2 acre minimum) and has a General Plan Land Use designation of Agricultural Residential. • The parcels to the north and immediately east of the site are also zoned AR 2 %2. The parcels to t= -ie west across Clark Road are zoned A-5 and P -Q (for Butte College) and the parcel to the south is zoned A-160. • Land uses on the surrounding parcels vary and include Butte College, uncultivated fields, rural density housing and, approximately 1,500 feet to the north, a mobile home park. • The project site, 340 to 360 feet above sea level, contains a dwelling and several accesso_y structures, a pond, an unnamed waterway with riparian vegetation, and vacant fields of grasses. The entire parcel is within the northwest corner of vernal pool critical habitat (Subunit 7K). • The communications tower to be built on the project site was approved in 2005 with Use Permit 05-01. • The communications tower and associated equipment shelter will be located within a 1,500 squa-e foot lease area. • The project site is not located within an Airport Compatibility Zone. • The lease area will be surrounded by a 6 -foot tall chain link fence topped with 3 strands of barbed wire. • The proposed 92 -foot tall tower will be located on the project site such that if it should structurally fail it will not fall onto an adjoining parcel, Clark Road, or on the project site dwelling. ANALYSIS: • The project would not result in a significant increase in air emissions, fugitive dust emissions, light, noise, or vehicle traffic. ■ Butte County PLANNING COMMISSION AGENDA REPORT ■ ■ September 14, 2006 ■ Crone UP 06-16 Agenda Report ■ Page 2 of 11 ■ • Only a minor amount of construction activity would be required to install the proposed antennas and associated ground equipment. • The proposed antennas are not expected to create any significant visual impacts because they would not increase the height of the proposed tower nor will they extend horizontally beyond -=he existing antennas. • Photo simulations of the proposed antennas show that they would not significantly change -he appearance of the tower. • No emergency power generators are proposed; emergency power would be obtained from gel acid batteries installed in the equipment shelters. ZONING/GENERAL PLAN CONSISTENCY • Section 24-96 of Butte County Code states that communications facilities are not permitted in lie AR -2.5 zoning district unless a permit is obtained, subject to the requirements of Butte County Code Section 24-262. Section 24-262(d) states that a Use Permit must be obtained for the installation of a new communication facility and for the collocation of antennas on an existi_Zg tower/pole in the AR -2 '/2 zone. • The project site is designated as Agricultural Residential by the Land Use Element Map of tie General Plan, which allows public uses as secondary uses (note: mobile phone service providers are considered a public utility because they are regulated by the California Public Utiliti: s Commission). The project has been conditioned to meet the requirements of Section 24-262, including: • Radio-frequency emissions in excess of FCC standards are not allowed. • Facilities that are not in continual use for a period of six (6) months shall be considered to be abandoned and must be removed. • Written verification submitted annually attesting that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC Office of Engineering & Technology Bulletin 65 (Evaluating Compliance with FCC Guidelines for Human Exposure to Radiofrequency Electromagnetic Fields, August 1997). • Submittal of a bond or cash deposit to cover the cost.of a radio-frequency study and removal of the proposed facilities. • Engineering analysis to ensure that the proposed communications tower would be able to suppo-t the proposed antennas. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission: I. Finds that this project is exempt from the provisions of the California Environmer_tal Quality Act under Section 15311. The location, size, design, and operating characteristics of the proposed use would be compatible with, and would not adversely affect, or be detrimental to adjac? nt uses, residents, buildings, structures, or natural resources, with consideration gi-en to: 1. Harmony in scale, bulk, coverage, and density: The proposed antennas would not increase the height of the propo ed communications tower or extend horizontally beyond the other proposed antennas. 2. The availability of public facilities, services and utilities: Electrical power service would be established at the property and no additio_zal services or utilities would be required with this project. A water source and a sewage disposal system are not required because the facility will be unmanned. 3. The harmful effect, if any, upon desirable neighborhood character: The radio-frequency emissions from the proposed antennas would meet FCC standards for public exposure. The proposed antennas would not result in a significant visual impact to the neighborhood in that the new antennas cnd mounting hardware would be painted to match the required earth tone color of the proposed communications tower. The proposed antennas and equipment shelter would not generate any noise. 4. The generation of traffic and the capacity and physical character of surrounding streets: Only a negligible amount of vehicle traffic will occur during installation of :he antennas and equipment cabinet. The communications facility would be unmanned and only one site visit per month would be required by maintenapce personnel after installation. Clark Road would provide access for the prof --ct site and would not be impacted by this increase in vehicular traffic. 5. The suitability of the site for the type and intensity of use or development wh ch is proposed: The site is ideally suited for the project because the proposed antennas would be mounted on a previously approved communications tower that would provide wireless service to the Butte Valley area. 6. Any other relevant impact of the proposed use: The Planning Division has circulated the proposed collocation application to County Agencies and has received no evidence that the use would cause any other relevant impact. C. The AR -2 1/Z zone allows collocations with approval of a Use Permit. The Agricultural Residential land use designation allows public utilities as Secondary Uses. E. This project would place antennas on a previously approved communications tower, which eliminates the need for a new communications tower to be erected elsewhere in the project area. F. The radio-frequency emissions generated by the antennas on the communications tower would be below the public exposure limits set by the FCC for wireless communication facilities. G. The proposed antennas would not create any impacts to aircraft operations because they will not increase the height of the previously approved communications tower nor extend horizontally beyond the other proposed antennas. H. Wireless telephone services are regulated by the California Public Utilities Commission and are considered to be a public use consistent with the AR -2 t/z zone and the AR General Plan land use designation. Failure to comply with the conditions specified herein as the basis for approval of this Use Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-41. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this Use Permit must be established within 12 months of the delivery of the countersigr_ed permit to the Permittee. Minor changes may be approved administratively by the Directors of Development Servims, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division 1. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. The new antennas and mounting hardware shall be painted to match the earth tone color of the proposed communications tower. 3. The installation of the Facility shall comply with all applicable building and electrical coc.es. The Facility operator shall submit certification from a registered structural engineer to the Building Division that all associated towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility shall fall within current standards and regulations of the Federal Aviat=on Administration (FAA), the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards End regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of :he FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of he Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safcty, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all curr-,nt standards established by the FCC, pursuant to FCC Office of Engineering and Technolcgy Bulletin 65. 12. Prior to issuance of the Use Permit, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient. to cover the cost of a one-time test by a radio frequency consultant selected by the Cour_ty, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 15. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The collocation of the antennas allowed by this Use Permit requires the issuance of a building permit from the Butte County Building Division. The Building Division, based upon engineered calculations submitted by the applicant, may determine that the tower cannot physically support the requested number of antennas. If that is the case, the number of new antennas allowed on the tower may be less than the number of antennas permitted by this Use Permit. California Department of Forestry/Butte County Fire 18. Prior to building construction, provide an all weather access of at least 10 feet wide and vertical clearance of 15 feet that will allow for ingress and egress and accommodate a 40,000 pound fire apparatus to within 150 feet of all structures. Environmental Health Division 19. Prior to issuance of a building permit, provide a completed Hazardous Materials Release Response Plan to Butte County Environmental Health as required by Chapter 6.95 of the California Health & Safety Code. Pacific Gas and Electric 20. Any relocation or rearrangement of any existing PG&E facilities in the area to accommodate this project will be at the expense of the developer. 21. There shall be no building of structures, or the storage of materials allowed over or under zny existing PG&E facilities, or inside any easements that exist which would infringe on PG&E easement rights. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below, T -Mobile USA, Inc. is hereby granted a Use Permit to install a 92 - foot tall "stealth" telecommunications tower. Six T -Mobile panel antennas would be centered 87.8 feet above ground level and 12 Nextel panel antennas centered 75 feet above ground level. Both sets of antennas would be located behind fiberglass enclosures. Also proposed are two pre -fabricated equipment shelters (10' x 16' and 20' x 12'); one underneath the tower and the other located approximately 12 feet to the east of the tower, subject to the following conditions: 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code See. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two (2) years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, thirty (30) days prior to the expiration date, a request for a one-year extension is submitted to the Board 1 of Supervisors together with sufficient evidence that the time limits for processing development permits under federal or State regulations require time limits which exceed one (1) year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: Mitigation Measure # 1: To avoid creating substantial glare, the tower/windmill shall be painted an earth tone color with a low light reflectivity value. Prior to issuance of a building permit, the applicant shall submit sample color chips to the Planning Division for review and approval. All painted surfaces are to be maintained during the life of this project. Plan Requirements: The note shall be placed on all building and site development plans. Timing: Requirements of the condition shall be adhered to throughout the life of the project. Monitoring: Department of Development Services shall ensure that this note is placed on all building and site development plans. Prior to issuance of a building permit, the applicant shall submit sample color chips to the Planning Division for review and approval. Building inspectors shall spot check and shall ensure compliance on-site. 2. Mitigation Measure # 2: All exterior lighting shall be fully shielded and directed downward so as to not create any glare or excess light on adjacent parcels. Plan Requirements: Building and site development plans shall indicate that all exterior lights shall be fully shielded and directed downwards. Timing: The requirements of this measure shall be adhered to at all times. Monitoring: Department of Development Services staff shall conduct a field inspection prior to use of the facility to verify that all exterior lights meet the requirements of this mitigation measure. Building inspectors shall check and ensure compliance on-site. 3. Mitigation Measure # 3: 2 Dusi generated by the development activities shall be kept to a minimum with a goal of retaining dust on the site. Follow the dust control measures listed below: a. Water shall be applied by means of truck(s), hoses, and/or sprinklers as needed prior to any land clearing or earth movement to minimize dust emissions, b. Haul vehicles transporting soil into or out of the property shall be covered. C. A water truck shall be on site at all times during development activities. Water shall be applied to disturbed areas a minimum of two (2) times per day or more as necessary. d. On-site construction vehicles shall be limited to a speed of 15 mph on unpaved roads. e. Post a publicly visible sign with the telephone number and person to contact regarding dust complaints. This person shall respond and take corrective action within 24 hours. - The telephone number of the Butte County. Air Quality Management District shall be visible to ensure compliance with BCAQMD Rule 200 ' & 205 (Nuisance and Fugitive Dust Emissions). f. All visibly dry disturbed soil surface areas of operation shall be watered to minimize dust emissions. g. Existing roads and street adjacent to the proj ect shall be cleaned at least once per day if dirt or mud from the project site has been tracked onto these roadways, unless conditions warrant a greater frequency. Plan Requirements: The note shall be placed on all building and site development plans. Timing: Requirements of the condition shall be adhered to throughout all grading and construction periods. Monitoring: Department of Development Services shall ensure that this note is placed on all building and site development plans. Building inspectors shall spot check and shall ensure compliance on-site. Butte County Air Quality Management District inspectors shall respond to nuisance complaints. 4. Mitigation Measure # 4: Should development, activities reveal the presence of cultural resources (i.e., artifact concentrations, including arrowheads and other stone tools or chipping debris, cans, glass, etc.; structural remains; human skeletal remains), work within. 50 feet of the find shall cease immediately until a qualified professional archaeologist can be consulted to evaluate the remains and implement appropriate mitigation procedures. Should human skeletal remains be encountered, State law requires immediate notification of the County Coroner. Should the County Coroner determine that such remains are in an archaeological context, the Native American Heritage Commission in Sacramento shall be notified immediately, pursuant to State law, to arrange for Native American participation in determining the disposition of such remains. Plan Requirements: This note shall be placed on all building and site development plans. Timing: This measure shall be implemented during all site development activities. Monitoring: The applicant/developer shall notify the Planning Division if any cultural 3 0 J 0 resources are uncovered. Should cultural resources be discovered, the Planning Division shall coordinate with the developer and appropriate authorities to avoid damage to cultural resources and determine appropriate action. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment T' and date-stamped July 9, 2004, and is incorporated herein by this reference. 6. No new driveway/road encroachments onto Clark Road (SR -191) shall be allowed. The Facility must meet or fall within current standards and regulations of the Federal Aviation Administration (FAA), the Federal Communications Commission (FCC), the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 8. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 9. No advertising or display shall be permitted on the Facility. 10. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 11. The installation of the Facility shall not violate any existing deed restrictions. 12. The Facility shall have a minimum of twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 13. There shall be no outdoor vehicle or equipment storage except for emergency purposes other than what is proposed. 14. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 15. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. • 0 16. If itis found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC QET 65. 17. Prior to issuance of the Use Permit, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one -tinge test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 1.8. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. 19. Prior to issuance of a building permit for the Facility, the applicant shall obtain a detailed estimate from an appropriate building industry business or contractor for the removal of the Facility, including the proper disposal of all removed materials and the return of site to its original condition. a) A copy of the estimate shall be submitted to the Building Division for review and approval prior to issuance of building permits. b) Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form detennined by the Director of Development Services that is sufficient to cover the cost of removal of the Facility, proper disposal of all removed materials, and return of the site to its original condition in the event that such Facility is abandoned, or if the permit has been terminated for violation of its conditions by the County after hearing, or has expired, and after notice has been given to the owner/operator by the County, no application for renewal has been filed. c) If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expenses. 20. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including 5 landscaping shall be maintained as approved for the life of the Facility 21. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 22. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 23. The Facility shall be secured at all times to prevent access by the public...... 24. All facilities and related equipment, including lighting, fences, shields, cabinets, and poles, shall be maintained in good repair, free from trash, debris, litter and graffiti and other forms of vandalism, and any damage from any cause shall be repaired as soon as reasonably possible so as to minimize occurrences of dangerous conditions or visual blight. Pacific Gas and Electric Company 25. Any relocation or rearrangement of any existing PG&E facilities in the area to accommodate this project will be at the expense of the developer. 26. There shall be no building of structures, or the storage of materials allowed over or under any existing PG&E facilities, or inside any easements that exist which infringe on PG&E easements rights. Public Works Department 27. Prior to the issuance of building permits, obtain an encroachment permit for the existing driveway approach and construct it to County standards, as specified in County Improvement Standards. 28. Prior to the issuance of building permits, a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. Prior to issuance of a building permit, submit a completed Hazardous Material Response Plan to Butte County Environmental Health Division as required by Chapter 6.95 of the California Health and Safety Code. , Butte Coun , Fire Deparhnent/CDF 30. Due to the mounting method utilized, the general public would not normally be able to approach the antennas. Therefore, no significant impact on the general population is expected. The calculated electromagnetic field strength level in publicly accessible areas is less than the existing standard allows for exposure of unlimited duration. RF warning signs should be posted at base of the tower Background Diamond Services' has been retained by Cingular careless to conduct a Radio Frequency (RF) electromagnetic analysis for a Cingular Wireless site to be located at 2822 Clark Road, Oroville, California. This analysis consists of a review of the proposed site conditions, calculation of the estimated RF field strength of the antennas, and the provision of a comparison of the estimated field strength with the Federal Communication Commission (FCC) recommended guidelines for human exposure to RF electromagnetic fields. Site Description Based upon the information provided by Cingular Wireless, six proposed (and six future) Cingular Wireless panel antennas will be mounted on a new tower. The Cingular Wireless antennas will be mounted approximately 51'- 10" (to bottom of antennas) above ground level. In addition to the Cingular Wireless antennas, six proposed T -Mobile antennas will be mounted on the tower. Normal public access to the front of the antennas is not expected due to the mounting location and method utilized. Occupational access to the front of the antennas is not normally expected. RF Field Strength Calculation Methodology A generally accepted method is used to calculate the expected RF field strength. The method uses the FCC's recommended equation which predicts field strength on a worst case basis by Equation 1 S- (2)2 PG _ PG _ EIRP 471-R' ZR2 717R2 doubling the predicted field strength. Using these factors, the maximum calculated 850 Mhz fields at ground level are''' -2-28_/0 of the existing standard for general population uncontrolled exposure.. The ground level effect of the Cingular Wireless 1900 Mhz emissions was calculated using a maximum downtilt of 5 and a maximum ERP of 2000 watts. Results were calculated for a height of 6'-6" above ground level. Using these factors, the maximum calculated 1900 Mhz fields at grotumd level are 0.62% of the existing standard for general population uncontrolled exposure. The ground level effect of the T -Mobile 1900 Mhz emissions was calculated using a maximum downtilt of 5°, and a maximum ERP of 1531 watts. Results were calculated for a height of 6'-6" above ground level. See Table 1 for the FCC's guidelines on Maximum Permissible Exposure (MPE). Note that the RF ranges referenced for this analysis are the ranges of 300 — 1500 Mhz, and 1500 — 100;000 Mhz shown in Table 1, which is included in Appendix A. - Cingular Wireless Site No. CN0821-C1 Page 4 of 8 Diamond Services Exposure Environments The FCC guidelines incorporate two separate tiers of exposure limits that are dependent on the situation in which the exposure takes place and/or the status of the individuals who are subject to exposure. The decision as to which tier applies in a given situation should be based on the application of the following definitions. Occupational/controlled exposure limits apply to situations in which persons are exposed as a consequence of their employment and in which those persons who are exposed have been made fully aware of the potential for exposure and can exercise control over their exposure. Occupational/controlled exposure limits also apply where exposure is of a transient nature as a result of incidental passage through a location where exposure levels may be above general population/uncontrolled limits (see below), as long as the exposed person has been made fully aware of the potential for exposure and can exercise control over his or her exposure by leaving the area or by some other appropriate means. General populadon/uncontrolled exposure limits apply to situations in which the general public may be exposed or in which persons who are exposed as a consequence of their employment may not be made fully aware of the potential for exposure or cannot exercise ' control over their exposure. Therefore, members of the general public always fall under this category when exposure is not employment-related. For purposes of applying these definitions, awareness of the potential for RF exposure in a workplace or similar environment can be provided through specific training as part of a RF safety program. Warning signs and labels can also be used to establish such awareness as long as they provide information, in a prominent manner, on risk of potential exposure and instructions on methods to minimize such exposure risk. For example, a sign warning of RF exposure risk and indicating that individuals should not remain in the area for more than a certain period of time could be acceptable. Another important point to remember concerning the FCC's exposure guidelines is that they constitute exposure limits (not emission limits), and they are relevant only to locations that are accessible to workers or members of the public. Such access can be restricted or controlled by appropriate means such as the use of fences, warning signs, etc., as noted above. For the case of occupational/controlled exposure, procedures can be instituted for working in the vicinity of RF sources that will prevent exposures in excess of the guidelines. An example of such procedures would be restricting the time an individual could be near an RF source or requiring that work on or near such sources be performed while the transmitter is turned off or while power is appropriately reduced.
