File # 95-83: A Use Permit request to allow the placement of a temporary second dwelling on a 1.8 acre parcel of land located on the south side of Crane Avenue, in the Oroville area. The property is zoned AR. FOR: Planning Commission Meeting of January 12, 1995 ABSTRACT: Staff recommends approval of this application. PROJECT CHARACTERISTICS: This request is a use permit request to allow the placement of a temporary second dwelling on a parcel that is already developed with a single family residence. The property is located on the south side of Crane Avenue in the Oroville area. It is a flag lot with only 20' of frontage. Access to the mobile home site is via a long driveway. Surrounding parcels are of similar size and developed with residential uses. Domestic water will be provided by Oroville Wyandotte Irrigation District and Lake Oroville Area Public Utility District will provide sanitary sewer service.. PROJECT AND SURROUNDING ZONING GENERAL PLAN DESIGNATION AND EXISTING LAND USE: Described below are the project and surrounding zoning, general plan land use designation and the existing land uses. West: AR Low Density Residential Residential ANALYSIS: This request will allow for the placement of a temporary mobile home to house the applicant on the property of her daughter and son-in-law. The applicant is in need of family assistance as stated in Section 24-303 of the Butte County Code. Adequate room is available on the property and water and sewer service is available. Placement of the mobile home will not violate any required side or rear yard setbacks. Required parking is available. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied. The Code also makes provision for the County to require a bond or deposit of sufficient size to cover the removal expense of the mobile home should the County be forced to remove the mobile home. If the applicant removes the mobile home voluntarily, then the bond or deposit would be returned. The applicant is in need of family assistance as stated in Section 24-303 of the Butte County Code. Adequate room is available on the property and water and sewer service is available. Placement of the mobile home will not violate any required side or rear yard setbacks. Required parking is available. Butte County Code Section 24-304 provides for.removal of the mobile home within 120 days of the time that it is no longer being occupied. The Code also makes provision for the County to require a bond or deposit of sufficient size to cover the removal expense of the mobile home should the County be forced to remove the mobile home. If the applicant removes the mobile home voluntarily, then the bond or deposit would be returned. PUBLIC NOTICE AND COMMENTS: This application requires that a public hearing be advertised and held. Advertisement of the public hearing will occur in a local newspaper and public notices were mailed to all property owners within a 300 foot radius of the subject property. As of the date of this report we have received no public comment. RECOMMENDATION: Staff recommends that the Planning Commission approve the use permit on A.P. 036-050- 056, subject to the following findings and conditions: FINDINGS: Section 1: Environmental Findings. A. Find that this project is Categorically Exempt from environmental review; and Section 2: Zoning Ordinance Findings. A. The proposed use of the property will not impair the integrity, and character of the zone in which the land lies and that the use would not be unreasonably incompatible with or injurious to surrounding property or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood or to the general health, welfare and safety of the County; and Section 3: Action. A. Subject to the findings indicated in Sections 1 and 2 of this report, move to approve the Use Permit for Thelma Jewell Hitte on AP# 036-050-056 to allow a temporary second dwelling. Approval shall be subject to the following conditions: B. Conditions of Approval: 1. Occupancy of the mobile home is limited to Thelma Jewell Hitte. 2. No rent is to be charged to the occupant of the mobile home. 3. Meet the requirements of the Butte County Environmental Health Department for domestic water supply and sewage disposal. 4. The mobile home is to be a temporary use on the property pursuant to the requirements of Section 24-304 of the Butte County Code. 5. The Use Permit shall expire two years from the date of issuance of the Use Permit. Upon application, the Planning Commission may grant an extension of the Use Permit not exceeding one year. 6.
