Dear Gary & Bonnie Bethel: Thank you for the submittal of the above referenced application. This application was submitted on June 12, 2008. The project application and related items have been initially reviewed by county agencies in order to determine if the application is complete and contains the information necessary for ongoing processing. Your application was deemed incomplete due to the following items: Item #1: Chris Tolley, Associate Planner assigned to this project at that time spoke with you on June 26, 2008 regarding this application. At that time you ,told him that you wished the project put "on hold", pending your decision on whether or not you wished to move forward with the application. You also stated at that time that you were unsure if the total expenses for the building permits and use permit were feasible for you. You also stated that you would be deciding whether or not to sell the property; You stated that you would notify Mr. Tolley within two weeks of whether you would want to move forward or withdrawal the application. Item #2: In addition, you spoke with Charlotte Walters of the Environmental Health Department regarding the pre -application requirements of that department, with regard to septic system. She informed you that you need to submit a proposal for a sewage disposal system to accommodate the proposed 30 dog limit. At that time you discussed with her what that Department of Environmental Health would be looking for. That department has not had any contact with you since. The Department of Development Services has an expectation that viable projects will respond to incompleteness issues in a reasonable timeline. No progress has been made on this application's incompleteness issues since its submittal June 12, 2008. The Persistent Incompleteness, Use permit application for Kennel, "Bethel" P08-0004, 2-17-10 County has not had had no correspondence or contact from you for nearly two years, since June 26, 2008 (see above). Applications that persist without reasonably timely action to resolve incompleteness issues result in significant cost to the County due to the duplication of effort needed to update, recreate, restart and duplicate project processing, caused by prolonged delays. These costs are not covered by the County's application fee structure. To resolve this situation, please select one of the three options below 1) Satisfy the incompleteness issue described above regarding this application. 2) Provide a letter withdrawing the application. 3) If by April 16, 2010 we do not receive options 1) or 2) above from you, the project will be agendized for action by the Planning Commission with a recommendation of denial. He explained that he has a neighbor (thinks it is the one who turned him in) that came from Los Angeles and is buying all the property up around his house. Mr. Bethel and him in a fued about property lines and such and both have lawyers. He explained he has lived on property for ten years and that his kennel happened by accident. He said he used to run his dogs in field trials and differant events and that people liked the way he trained so he started breeding and raising labs (3 yrs ago). He stated that some of the dogs are sold before they are born .He also stated that he is disabled but a Malcom Keene does 90% of the training. He also stated that he has two litters a year and that 6-7 pups a year are sold. I let him know he needed to contact planning to aquire a use permit and that he will need to put a seperate septic on the property for the dogs. I let him know of the procedures of a use permit and kennel permit. I explained about the public hearing and board of supervisors. I relayed that I will hold the citation but that he would need to submit all of the rabies certificates for all of the dogs on his property and that he needed to contact planning. He has dogs vaccinated at LAVS He agreed. Tw 5/5/08- Gary Bethel returned my phone call from Friday. He stated that he is almost finished with the paperwork and that the plot map is the hardest so far. He says he knows a couple of people in planning and that everyone has been really helpful. As discussed, Butte County Code 4-3 states "Every person who owns or controls a kennel or other place in the unincorporated areas of the county where more than five (5) dogs over the age of four (4) months are kept, for any purpose whatsoever, shall obtain a kennel license within thirty (30) days after the kennels is established and annually thereafter". Prior to the kennel license permit, application must be made to the Development Services Department for a use permit. On May 5, 2008, you stated during a telephone conversation that the paperwork was almost complete for the required use permit issued through the Department of Development Services. On May 21, 2008, the Development Services 'Department stated they had not received a use permit application for the above -referenced kennel. Please note that the kennel is still in violation of County Code. In order to prevent enforcement actions, you are hereby required to submit the completed use permit to the Development Services Department no later that June 13, 2008. I'm not sure what that is supposed to cover. Anyway, I have sent the attached letter to the Bethels to see if we can't either get the ball rolling again or close out the project via denial by the Planning Commission. I copied that letter to Deborah Trew as well. We'll see how they respond. Every development project which requires a discretionary governmental approval will require at least some environmental review pursuant to CEQA, unless an exemption applies. The environmental review required imposes both procedural and substantive requirements. At a minimum, an initial review of the project and its environmental effects must be conducted. Depending upon the potential effects, a further and more substantial review may be conducted in the form of an environmental impact report (EIR). A project may not be approved if feasible alternatives or mitigation measures cannot substantially lessen the significant environmental effects of the project. At the state level, CEQA requires that public agencies consider the effects of their actions on historical resources eligible for listing on the California Register of Historical Resources. "Historical resource" refers to buildings, structures, sites (prehistoric and historic), objects, districts, and all manner of properties containing material remains of past human life or activity. The Department of Development Services utilizes the Northeast Information Center (NEIC) of the California Historical Resources Information System (CHRIS) to identify projects that may have archaeological significance. The CHRIS is a statewide system for managing information on the full range of historical resources identified in California. This system is under the authority and direction of the Office of Historic Preservation (OHP), the State Historic Preservation Officer (SHPO), and the State Historical Resources Commission (SHRC). The Northeast Center of the CHRIS system, located at California State University, Chico, manages the historical resource records for I I counties, including Butte County. The Northeast Information Center will furnish a Record Search to Development Services indicating the archaeological/historical significance and sensitivity of the applicant's project area and additionally providing a recommendation as to whether further archaeological survey is warranted. If further archaeological survey is required, the application would be cgnsidered incomplete until the appropriate archaeological survey is completed and reviewed. The Department of Development Services will forward applicant's payment (by check) of $75.00 and relevant project application information required for the Records Search to NEIC. TRAINING KENNEL PROJECT DESCRIPTION We are requesting a use permit for the operation of a retriever training kennel. We have 30 kennels on a ten acre training site. This is also our home site and we treat it with loving care. We have two helpers. There was no intention of getting this large when we moved here. It was a hobby that unexpectedly grew beyond anything we could imagine. There is no expectation of further growth and no room for more kennels. All the kennels are in the yard surrounded by tall heavy bushes. Training goes on year round, but slows considerably in the winter months when people are , hunting with their dogs. We do no advertising, but have grown simply by word of mouth. An avocation that became a vocation and even though it doesn't make a profit it does pay the bills. We want to get all the proper permits and licenses to comply with the county rules. Application for septic has been submitted to Environmental Health. We do two different types of training: (1) We take a limited number of client's dogs that are delivered to us to be trained with an average stay of 34 months. The client will usually come and visit the dog 2 or 3 times during the stay and will work with the dog at the end so he or she knows what the dog knows and how to make it happen. The client is required to bring information showing that dog is current on all vaccinations and on the form they fill out and sign they give us permission to take care of any medical problems as we see fit. We have a great relationship with a local veterinary hospital. (2) We have two litters of puppies a year that we raise, train and sell as trained dogs. Most of these pups are sold before whelping or soon after and stay with us for approximately one year of training depending on birth date. Their health is monitored very closely and they receive all vaccinations and care in a timely manner. The training and goals are very similar for all the dogs with minor variances tailored to individual needs and wants. The dogs are field trained to hunt waterfowl and upland game using our facilities and property. Our fields and pond are tailored and set up to teach the dogs the necessary skills and concepts to find and retrieve game birds. The fields are mowed certain ways and permanent drills are set up and always ready for use. The pond has land points running in a certain pattern (see site map) to teach the dogs various skills necessary to be good hunters. We travel with the dogs to other training areas to expose them to all kinds of cover and terrain. Obedience is a huge part of our program and a never ending lesson. We use rubber or plastic training dummies as well as pigeons, ducks and occasionally pheasants in our training. We raise some of the birds and buy some from game farms. We use mechanical launchers with electronic controls to throw birds and dummies. We fire blank shots when birds or dummies are in the air to simulate A' shooting the game as part of the program. I have trained for and competed at all levels of retriever trials and tests in the past, but now we do not train for or participate in any kind of competition. My first love and the reason I started training in 1966 was because I wanted a competent hunting companion to help me find game and I have now come full circle and we only train hunting dogs. A well trained quality dog is the number one conservation tool and the hunters best friend. All maps shall be drawn on uniform size sheets no less than 11"x17" and no greater than 24" X 36", folded to 8 %" x 11". In addition, a digital copy of the map and aerial photographs are encouraged. The detailed map must include: a.❑ Name and business address of the applicant, engineer or person who prepared the map. b. ❑ j Assessor Parcel Number(s); street address (if available); tract name and date (if applicable); and/or Township, Range and Section numbers. C. ❑ Proposed use and/or uses of the property. d. ❑ A vicinity map indicating the location of the land in relation to the nearest major roads and/or significant topographic features in the surrounding area or region. e• ❑ Property lines, lot dimensions and any applicable easements of record or proposed. f.
