C: Legal Description STAFF COMMENT State law requires that the Planning Commission find that an abandonment such as proposed will not be in conflict with a General Plan. Staff has analyzed this request and recommends approval. PROJECT DESCRIPTION/SITE CHARACTERISTICS: The public services easement proposed for abandonment is approximately 20 feet by 750 feet (one-third acre) in size. This easement was created in 1993 as part of the Heritage Estates Phase Two Subdivision (Map of Records Book 130,Pages 27-29). The easement was not a County requirement and has never been utilized for any public service purposes. The easement is surrounded by a single parcel of 20.25- acres. ANALYSIS: Pacific Gas and Electric (PG&E), Pacific Bell, TCI Cable, Oroville-Wyandotte Irrigation District and the Lake Oroville Public Utility District commented on this project and do not object to the abandonment of the public services easement. Abandoning the easement will not result in any impacts to these utility providers. According to California Government Code Section 65402,the abandonment of property must be in conformance with the General Plan. This request is consistent with the Butte County General Plan because it does not conflict with any adopted or proposed element of the General Plan. The purpose of this letter is to affirm that OWID has no existing facilities, nor plans to install facilities in the future, within the public service easement for which the abandonment petition is being filed. (Specifically, the easement extends in a southeasterly direction across Lot "B", 130 MOR 27, from the easterly right-of-way line of Heritage Road-to the southwesterly right-of-way line of Kelly Ridge Road.) Therefore, OWID has no objection to the easement being abandoned. Please let me know if you have questions or need additional information.
